I hereby move to amend 2010 -- H 7357, entitled "JOINT RESOLUTION TO APPROVE AND PUBLISH AND SUBMIT TO THE ELECTORS A PROPOSITION OF AMENDMENT TO THE CONSTITUTION OF THE STATE (ETHICS COMMISSION)", as follows:

1. On page 1, line 17, by adding the following language after the period at the end of the sentence:

“Provided, however, that notwithstanding any other provision in this Constitution, the ethics commission shall have no jurisdiction or power to investigate or sanction or otherwise penalize any official based on verbal, written, or other expressions by that official, which expressions are otherwise protected under this Constitution and/or the Constitution of the United States, as to that official’s opinion as to matters pending before the official. In this context, the phrase “verbal, written or other expressions” shall include statements and questions, both written and/or oral, which express an opinion or elicit information, but shall not include the actual act of voting on pending legislation or similar matters.”
