Ibring 1971 the Fublfc Servfcs Commission pursued its statutory respons- i b i l i t i e s in regard to the regulation of the u t i l i t y companies under the jurisdiction of the C ~ i s ~ i ~ n which consist of a total of ninety ( 9 0 ) utfllty companies; seven (7) privately owned electric companies, f ive ( 5 ) municipally owned electric companies, nineteen (19) electric cooperatives, six ( 6 ) gas companies, eleven (11) water companies and forty-two (42) telephone companies.

The Conrmission actively pursued its obligation t o review the rates and practices of the utility companies. traditional areas of concern in sme cases, and in others broke new ground. The Coarmisaion continued its efforts t o ensure that the publ€c of the S t a t e of Arkansas have adequate utility service at the lowest reasonable rates.

NEW RECULATORY RESPONSLBILITY

The Natural Gas Pipeline Safety A c t of 1968 enacted by the Congress of the United States established mfnimum aafety requirements for operating and maintaining natural gas systems. On March 15, 1971, the State Legielature of Arkansas passed Act 285, the Axlcansas Natural Gas Pipel ine Safety Act of 1971, which gave the Arkansas Publfc Service Conmission regulatory control of Intra- state systems. and operated systems.

On April 7, 1971, the Arkansas Public Service Commission adopted the Minimum Federal Safety Standards, 49 CFR Part 192, as the Arkansas Gas Pipe- l ine Code. Subsequently, the P i p e l i n e Safety Division was established under the Engineering Administrator.

The Commission participated actively during the year 1971 in hearings be- fore the Federal Power Commission concerningthe curtailment p l a n s proposed by Arkansas Louisiana Gas Company in Federal Power Cwmissiun Docket No, Bp71-122 and Louisiana-Nevada Transit Company, FPC Docket No. W72-13.

The Conantsslon also intervened in the case of the C i t y p f DeQueen Y. ' Louisiana-Nevada Transit Company, FPC Docket'No. CB71-164, in which the City

of DeQueen was attempting t o obtain additional pe& day deliveries from the Louisfane-Nevada Transit Company and an additional point of connection w i t h the Louisiana-Nevada Transit Company's pipeline, supported the application of the City of DeQueen.

'COURT CASES

. During the year 1971, the Commission was fnvolved in numerous car t cases which were appeals from the Conmission's orders or which resulted from indt- vidual suits being f i l e d against the Canmisston opposing approved tar i f f s of utility companies.

The case of Commercial Printing, Company V. The Arkansas Power &Light Cumpang and the Arkansas Public Service Commission was submitted t o the Arkansas Supreme Court during the year 1970, and a decision was rendered by the Court on April 20, 1971. 3n additional sum by A.P.& L. customers when receipt of the payment of their light bill is more than 15 days from the date of b i l l i n g , Company attacked the rulfng of the Cormnieehn approving said rate schedule directly in the Circuit Court of Pulaski County, which amounted to a collateral attack of the Conmission's orders, and it was not an appeal from a Cornmission order tteelf.

Comercia1 Printing

The Court rejected the argment of CoasPercfal Printing Company.

The case of Efrs. David A. Hibbe, e t al. V. Arkansas Public Service Cum- mission was a case whereby Hrs* Hibbs, et al. attacked the Commiesion and ArkansaB Louisfana Gas Campany alleging that the procedure of the gas company in dfscontinufng gas service without notice in certain circumstances w a s im- proper. A hearing was held before the Corpmission €XI 1970, and a decision was rendered by the m i s s i o n with one dtssent, which decision held that the pro- cedure followed by Arkla was proper and l a w f u l . Thfs decision of the Commis- sion was appealed t o the Pulaski Circuit Court and t o the Arkansas Supreme Court and on the 11th day of October, 1971, the Arkansas Supreme Court issued its opinion whfch upheld unanimously the opinion of the Cmmission.

On December 11, 2970, the Coramission issued i t s order in Docket No, U-2307 whereby i t requfred the Arkansas Louisiana Gaa Campany t o appear and Ohow cause why the previous orders of the Cmmission approving industrfal con- tracts entered into between Arkla and various Itndustrial customers should not be set asids and why Arkla should not be required t o file with the Colpmission general industrial tarfffs under which a l l of its industrial custumers could be served.

On January 4, 1971, Bamid Division of National Lead Company and Dresser Industries, lac, f i l e d a petition in Pulaski Circuit Court: praying that the Comlssion be prohibited and restrained from proceeding further with i t s hear- ings in this mat ter . On January 5 , 1971, this matter was heard by the Pulaski Circuit Court which dismissed the petition f i l e d and ruled that the Commission mfght proceed with its hearings scheduled t o begin on January 6 , 1971.

Continental O i l Cpmpany , Weyerhaeuser Company, Union Carbide Corporation, Hekoosa Edwards Paper Company, Inc., Bfo&anto -any, Reynolds Hetals Com- pany, Arkansas Power & Light Company and Olinkraft, Inc. f i l e d separate cases seeking atay of the Commission proceedings scheduled t o begin January 6, 1971. No action was taken on these petitione for stay, and the Cmmissioa proceeded with its hearing which began on J8nUary 6, 1971, and a f inal order wag issued by the Cornmission in this matter MI August 9, 1971, from which order Unton Carbide Corporation, Bromet Company, Reynolds Metals Company, Continental O f 1 Company, Monsanto Company and Arkansas Power & Light Company have filed appeals w i t h the of the Commission t o wtthdraw its approval of the previously approved indus- tr ia l contracts. the Circuit Court.

On January 4, 1971, Baroid Division of National fiead Company and Dresser Industries, inc , , moved that the Arkansas P u b l i c Service Commission dismiss a Show Cause Order directed to them in Docket No, U-2307. The &tion asserted that the Arkansas Public. Service Commission was without jurisdiction to interfere with Petitioners' industrial gas supply contracts with Arkansas Louisiana Gas Company, and requested the Com- mission to recognize and acknowledge its absence of jurisdic- t i o n .

CONCLUS IONS :

1. &To factual question is presented by Petitioners' motion. The existence of Pet i t ioners ' contracts, the related orders of the Commission and the laws of Arkansas are recog- nized by the Commission and Petitioners, The question raised is wholly a matter of l a w and a public hearing was neither requested by Petitioners nor would it serve any useful purpose,
