As you are aware, you have been under investigation following allegations that you have breached one or more of the Standards of Professional Behaviour for Police Staff.

This is to notify you that this investigation has now been completed and it has been decided, based on the information available, that there is a case for you to answer. The allegation(s) has been assessed as <misconduct /gross misconduct>* and has been referred to a <misconduct meeting /misconduct hearing>* under the formal stage of Managing Misconduct (Police Staff) Police Staff. A disclosure pack of the relevant documents obtained during the investigation

A record of the investigatory interview.

You should submit a written response to these allegations using form PS22, together with any additional papers/evidence, which must be provided to the Investigating Officer within 10 working days of receiving this notice.

You have the right to be accompanied at this meeting by a work colleague, Unison or Staff Association representative.

Please refer to Managing Misconduct (Police Staff) Policy and Managing Misconduct (Police Staff) How to Guide for details of proceedings and rights of appeal.

Failure to attend the proceedings

Please note that if you fail to attend the proceedings without giving prior notice, the case will be heard in your absence. If you do not wish to attend you may submit a statement to the panel or your representative may attend on your behalf.

If the person you have chosen to accompany you cannot attend the meeting on the proposed date, you must offer an alternative time and date when you can both attend which falls within 5 working days of the proceeding date shown above. In proposing the alternative date, you should have regard to the availability of all the parties listed above.

3. Disclosure Manual Requirement

a) The Disclosure Manual, produced by the police and CPS, provides instructions on how to meet the requirements of the Criminal Procedure & Investigations Act (CPIA) 1996. Chapter 18 of the guidance sets out the procedure in relation to the revelation and disclosure of police misconduct covered in the linked CPS Disclosure Manual.

b) Whilst the Disclosure Manual does not deal with revelation and disclosure of misconduct by police staff, the obligation to reveal misconduct applies equally to police staff who are witnesses or potential witnesses in criminal prosecutions. The obligation is role based for police staff and applies to staff that are likely to submit witness statements during the course of their duties

c) If staff holding these roles are the subject of criminal or disciplinary proceedings requiring disclosure and have made a written statement, they will need to submit form MG6B in a sealed envelope to the Disclosure Officer in the criminal investigation in accordance with the linked CPS Disclosure Manual.

4. If you are dismissed as a result of these proceedings, you will be included on the barred list. Whilst included on the barred list, this will act as an absolute bar to being employed or appointed by a police force or other specified law enforcement body. After 5 years of being included on the barred list, you will have the option to have your barred status reviewed which may result in your removal from the barred list.
