The subject site is 1.16 acres in size, zoned B-2 Commercial District. The property is occupied by

a closed, former car wash and a small commercial building (303 E. Pershing Road), a total of four

structures.

PROJECT DESCRIPTION

The subject request is for a Conditional Use Permit to allow for the construction of a new

automated tunnel carwash with multiple vacuum bays. The existing structures/buildings on the site

are proposed to be demolished.

The proposed car wash structure will be 5,583 square feet in area and located on the south side of

the site. It will contain a single-lane tunnel in which the vehicles will drive through. The drive-up

lanes with stacking spaces for vehicles will feed into a single lane before entering the carwash.

The primary entrance to the site is via a right-in/right-out curb cut on Pershing Road. Secondary

points of ingress/egress are also located on the southeastern corner of the site.

STAFF ANALYSIS

Staff supports the requested Conditional Use Permit. Staff believes the proposed carwash use with

multiple vacuum bays on this lot is appropriate and compatible with the neighboring commercial

uses in the B-2 Commercial District.

According to Section XXII.A.3. there are three standards which must be met in order to grant a

Conditional Use Permit. The first standard requires that the use be “necessary for the public

convenience at the location.” The proposed use of a carwash is generally compatible with the area.

The surrounding uses are commercial in nature with a shopping center to the north, a mostly vacant

commercial center to the south, a fast-food restaurant to the west and a bank/real estate office to

the east. The subject site fronts on a major arterial roadway (Pershing Road), allowing visibility

and access.

The second standard is “designed, located, and proposed to be operated that the public health,

safety and welfare will be protected.” The facility is located and designed to be operated in a way

the public health, safety and welfare will be protected. The on-site traffic circulation is efficient.

There are ample stacking spaces for the proposed car wash. No traffic backing out to Pershing

Road would be anticipated.

The third standard is the proposed use “will not cause substantial injury to the value of other

property in the neighborhood in which it is to be located.” The proposed carwash with vacuum

bays should not cause injury to the value of other properties in the areas. The site was used for a

carwash previously for over several years and it seems to have not had an adverse effect on the

area.

STAFF RECOMMENDATION

Staff recommends approval of the Conditional Use Permit with the following conditions:

1. No outside speakers shall be permitted except for the carwash drive-through facility.

2. The building located at 303 E. Pershing Road must be demolished before a Final Minor

Plat is approved.

3. A Final Minor Plat must be approved and recorded before a Site Plan will be approved.

4. The trash enclosure must be screened as approved by the Department of Economic and

Community Development.

5. Final site, landscaping and lighting plans shall be submitted to and approved by the

Economic and Community Development Department, Public Works Department and the

Fire Department prior to permits being released.

PLAN COMMISSION ACTION

Section XXII.A.2. requires the Plan Commission to hold a public hearing on a Conditional Use

Permit request, and then forward its report and recommendation to the City Council for final

approval. A motion to forward Case 19-38 to City Council by the Plan Commission with a

recommendation is warranted.
