It is totally an unconstitutional situation, where the Western cowboys are subject to police brutality (confiscation of cattle money without due process), and the Eastern cowboys are worry free. It appears the Kearney complex was initiated by the government lifers on the brand inspection boarder to inspect cattle that arrive from the inspection free areas to the only two meat packers in the brand area. When I was in the meat packing business in Western Nebraska from 1970 to the mid 1980’s, we never heard of such a thing, i.e., a brand inspector assigned to look at every critter in plant’s yards, nor, in exercising our Constitutional rights, we would never consent in allowing a brand inspector to step on our private property unless one had our consent to inspect our Wake-up cowboys. Just like most government operations, the Nebraska Brand Inspection Police (NBIP) have become top heavy, inefficient, and obnoxious. And, yet, headed by a government lifer and private cows. It appears the NBIP has pulled some wool over the eyes of the only two large modern meat packers in that area. Also, why is the NBIP now concerned with cattle originating from the free part of Nebraska and other free States? This is not their constituency, and this is another assumption of illegally expanding authority. They were hired to only find strays from their area, not to expand and include the whole state. Their authority continually has been rejected by the Easterners, and claiming jurisdiction on out-of-state cattle is completely out of their realm. I, also, want to ask and understand, what brand are they looking for when inspecting a brand free animal and submitting a claim to hold cattle buying money, on the grounds that my company refuses to brand a company cow? What started this article was: Jay Buckley, Inspector in Charge, of the Kearney Complex, which supervises newly employed brand inspectors with a policy of hiring women, and who have to be want-a- be-cowboys with clippers hanging from their belts instead of guns, was confronted by author as to the competency of his women brand inspectors. The woman that submitted the claim was Stephanie A. Nelson. She was holding money at her sole discretion for cattle worth twenty thousand dollars without due process. The cattle had already been brand inspected by the area brand inspectors in the Northern part of the State. When I talked to Stephanie and explained the problem, she asked me if I was questioning her ability? I responded: absolutely. She then hung up on me. A side issue is that this plant slaughters 1,800 cattle a day, and the USDA prohibits Buckley’s harem from clipping 99% cattle. A brand inspector cannot read brands in the winter, unless the cattle are clipped, or he/she is familiar with the local cattle brands. I personally have never seen a woman brand inspector in my 68 years around livestock barns and meat packing plants. I question whether a man is strong enough to have the time, to manually clip 1,800 cattle a day, let alone a petit woman. My first gut reaction is this woman lacks experience, and Buckley is expecting a petit woman to do a muscular man’s job. Aside from this fact, two employees cannot clip or read 1800 head of cattle in a day [that’s 32 seconds per head] and match those brands with brands on the brand papers from every brand inspecting State, and still look, as their head honchos expect, at a free State cattle. (See a recent brand title, on page 3, that is convoluted with butcher, feeding and bred cows to be sorted out by our infamous brand leaders). The bottom line is: they arbitrarily and discriminately look at a small percentage of cattle and not others. Only one animal in eight years at this plant was considered to be possibly stolen or a stray. The head cattle buyer informed Buckley of this stray, or it would never have been discovered. One questionable critter in eight years does not monetarily justify a Kearney brand inspection complex. What is a court?This article is about the substantive

definition of a court. For form, legal, and dictionary definitions, see Court of Record in the next issue of Stampede. Most attorneys will tell you that a court is a forum where litigants may take problems for resolution. Others will tell you that the terms "court" and "judge" are interchangeable. Then there are the various dictionary definitions. But, here is the real substance of a court:

A court is a stage upon which the sovereign conducts his show so as to satisfy the rest of the world that his decision is a good one.

The modern concept of a court is based on the ancient English traditions. To best understand it, imagine how things were in the 12th century. The king was the sovereign. On his throne by Divine Right, he was the source of all law. So went the theory. But the king was as vulnerable to death as was anyone else.

Consider this scenarioThe king is sitting on his throne,

gazing out the window, surveilling his kingdom. He notices one of the knaves stealing oranges from his favorite orange tree. No problem. Guards are summoned and instructed to incarcerate the knave for a month in the castle dungeon.

There you have all the elements of basic court procedure: jurisdiction, evidence, accusation, judgment, punishment. The king had the jurisdiction; he had personally seen the violation of his rules (the evidence), then he rendered and executed the judgment. Theoretically, that is all that is needed.

As a practical matter, there is more to the story.

In this case the criminal's brother happens to be the king's chief cook. The cook takes a day off to visit the dungeon. The prisoner complains about the injustice of it all, that he meant no harm, that he didn't do it, and that the king was totally unfair. Mr. Cook, enraged by his brother's story, promises to help. That evening the king dies from a slight overdose of arsenic (that's how the nobility solved problems in those days).

The arsenic factor is what led to our modern court system. The royalty of that period realized that they were vulnerable, so they devised a trial system which would encourage others to not take it out on the king. This resulted in a

mouth. My research reveals just the opposite. The people that I have interviewed claim Buckley is nothing but a “super hot dog” cop, and will say anything for job security. With his badge in his hand, he has a reputation of forcing 4H’ers to write him a check, because they took their show animal across the brand line without paper work or proof of ownership. These kind of government lifers and nincompoops need to be fired and out of government employment. Find a real job, if someone besides the government will hire them.

Buckley did admit that conditions were not the best and it was too dark for his women to read brands. I maintain manure runs downhill. This out-of-hand government outfit has stolen twenty thousand dollars of cattle buying money. I want the money today, not tomorrow. The Nebraska cattle organizations need to take the bull by the horns, and do some clipping on their alleged favorite son(s) and their illegal confiscations.

Brand inspectors can try to match these brands with each individual cow that I purchase until they are blue in the face, but don't be confiscating my money because they can't do it, or because they blame it on the light in the packing plant.

There are 48 brands on this alleged title, and I purchased 40 head on numbers 3, 4, & 5. Thanks for the extra 7 head of cattle and brands. An interesting note is that 17 of the cows were bought from the

same owner. Yet there are 47 separate brands. Three's (3's) are feeding cows; four's (4's) are bred; and fives (5's) were preg tested. Each number goes in a separate pen, but the brands are convoluted.

Also, don't blame South Dakota...Nebraska has a reciprocal agreement. Western state brand inspectors are birds of the same feather. Why doesn't Nebraska have a reciprocal agreement with Wyoming? South Dakota does. Because Nebraska and Wyoming are in cahoots and want to collect two brand inspection fees.

I'm telling you, these brand inspection head honchos are a bunch of thieves, obnoxious cops, and need to be canned. I have had similar experiences with the Wyoming and Montana a-holes.

Iowa, Kansas, Texas, and Minnesota get along great without brand cops. They have a thing called sheriffs. Why can't Nebraska?

Everyone concentrates on the problems we're having in this country lately: illegal immigration, hurricane recovery, and alligators attacking people in Florida.

Not me. I concentrate on solutions for the problems. It's a win- win situation.

Is it just me, or does anyone else find it amazing that during the mad cow epidemic our government could track a single cow, born in Canada almost three years ago, right to the stall where she slept in the state of Washington? And, they tracked her calves to their stalls. But they are unable to locate 11 million illegal aliens wandering around our country. Maybe we should give each of them a cow.

Almost all the cows brought 75¢, if they were not full. Gordon had about the same market as Martin. With Hay Springs cattle baron Mark Peiper being a no show at Gordon this week, the cow market was couple dollars lower from last week. The cows had a good weigh-up at Gordon, and consistently brought right at 77¢.

My load of cows average 74¢ with a few full ones mixed-in to lower my average cost. This seems to be the commission buyer’s trick. So I thought I’d try it. Actually, the full cows were the highest when figuring dressed weight cost. So, when you are spending your own money, it doesn’t work.

The bull market topped at 97¢. Several bulls at Gordon brought 95¢, but they were fuller than ticks, and if you were to hang them, they would cost close to $2.00 in the meat. That is $15 more a hundred weight in the meat than the big boys are willing to pay. I did spend $83,174.04 at Gordon, and nothing at Sheridan livestock.

EVIDENCE THAT COURTS AND ATTORNEYS ARE OF QUESTIONABLE BENEFITMany farmers and others who are

faced with foreclosure by one of the lending institutions, go to attorneys for help. Most attorneys are willing to take the victim's money, but the assistance they give can be determined by a poll taken by an organization call Family Farm Foreclosure Assistance Project (FFFLAP).

adheres to the traditions of the past. You can see this in the various rules, statutes, and canons. For example, in Canon 2 of the CODE OF JUDICIAL CONDUCT it is well understood that "A judge shall comply with the law and should act at all times in a manner that promotes public confidence in the integrity and impartiality of the judiciary." There is no specific requirement that he actually have integrity and impartiality beyond that minimum required by law; only that the judge should act in a manner that promotes that image.

Maintaining image while protecting sovereign interests is probably the most important function of a court. The actual effectiveness of a government court in meting out justice has been questioned. Spend a day in any traffic court and you will get the full flavor of how the courts protect sovereign interests as they put on a show of procedural propriety. ###
