    Plaintiff United States of America, on behalf of the Administrator of the United States

    Environmental Protection Agency ("EPA"), and pursuant to 28 C.F.R. 50.7, files this Notice of

    Lodging of an Amended Consent Decree that has been agreed to and signed by the parties to this

    action.

    The Complaint in this civil action was brought pursuant to Section 309 of the Clean

    Water Act (CWA), 33 U.S.C. 1319, against Defendant Trident Seafoods Corporation

    (Trident or Defendant). The United States sought injunctive relief and civil penalties

    against Trident for violations of Section 301(a) of the CWA, 33 U.S.C. 1311(a), and violations

    of the permit conditions and limitations of the National Pollutant Discharge Elimination System

    (NPDES) permits issued to Trident by the EPA under Section 402(a) of the CWA, 33 U.S.C.

    1342(a).

    The United States previously lodged a Consent Decree in this matter on September 28,

    2011 (ECF No. 2) and published a Notice of Lodging in the Federal Register, inviting public

    comment on the proposed settlement. Three comments were received and are attached hereto as

    Attachments 1, 2 & 3. The Amended Consent Decree being lodged today reflects the parties

    consideration of those comments. Each of the commenters has withdrawn its comments and

    supports the entry of this Amended Consent Decree as a final resolution of the violations alleged

    in the Complaint.

    Notice of the lodging of this Amended Consent Decree will be published in the Federal

    Register in the near future, indicating that the Department of Justice will receive comments for a

    period of thirty days. Any public comments received will be considered and filed with the

    Court. If, after consideration of any comments, the United States concludes that this Decree

    should be entered, the United States will move the Court for final approval and entry of the

    Amended Consent Decree.

    WHEREFORE, the United States withdraws the Consent Decree lodged September 28,

    2011 (ECF No. 2) and requests that the Court receive the attached Amended Consent

    Decree for lodging only.
