After 17 years in operation, SPV has met and exceeded the overall target of 55% take-
backs set out in its licence. In 2013, we took back over 600,000 tonnes of packaging waste.
These results would not have been possible without the work done by all partners
in the Integrated Packaging Waste Management System (SIGRE), without of course
forgetting the great contribution from the public in Portugal, who are more and more
committed to the mission of recycling and finding a new use for packaging waste.

WHAT TO DECLARE?
Packaging that must be declared
The annual statement must contain all non-reusable packaging that your company is responsible for placing on the market for the first time in the year to which the statement refers.
Your company is responsible for placing packaging on the market, if you:
• Pack products of your own brand
• Have products of your own brand packed by other companies
• Directly import products of any brand that you place on the Portuguese market
Packaging refers to any and all products made from any type of material that are used to contain, protect, move, handle, deliver and present goods, from the producer to the end user or final consumer. This definition also includes all “disposable” articles used for the same purpose.
The annual statement must include packaging made of all types of material:
• Glass
• Plastic
• Paper and cardboard
• Beverage cartons
• Steel
• Aluminium
• Wood
• Other materials
And it must include all types of packaging:
• Point of sale packaging or primary packaging
• Grouped packaging or secondary packaging
• Transport packaging or tertiary packaging
• Service packaging (including checkout bags)
• Multipacks

01 | Point of sale packaging or primary packaging
Any packaging designed so as to constitute a sales unit for the end user or final consumer at the point of purchase.
EXAMPLES:
• Cereal box
• Aerosol

02 | Grouped packaging or secondary packaging
Any packaging designed so as to constitute a grouping of a certain number of sales units at the point of purchase, whether they are sold as such to the end user or final consumer or serve only for restocking shelves at the point of sale, and that can be removed from the product without affecting its characteristics;
EXAMPLES:
• Corrugated cardboard box (containing cereal boxes);
• Cardboard tray with retractile plastic (containing jars of jam).

03 | Transport packaging or tertiary packaging
Any packaging designed so as to facilitate the handling and transport of a number of sales units or grouped packaging in order to prevent damage during handling and transport. Transport packaging does not include road, rail, ship or air containers.
EXAMPLES:
• Non-reusable wooden pallet
• Cardboard separators
• Plastic straps
• Plastic pallet film wrap
04 | Service packaging
Packaging that is filled or made up by companies, normally traders and retailers and companies in the services or food and beverage sectors, and intended solely for packing products that they sell at their outlets. This packaging must be declared as primary packaging, with the exception of checkout bags, for which there is a specific field in the annual statement.
EXAMPLES:
• Plastic or paper bags for bread or cakes
• Bags for fruit and vegetables sold by the kilo
• Ready-made food packaging
• Packaging for flowers sold by florists
• Plastic covering used by laundries to protect clean clothes

05 | Checkout bags
Packaging, normally plastic or paper bags with handles, provided by traders and retailers for shoppers to carry their purchases from the point of sale
EXAMPLES:
• Plastic bag with handles(provided in hypermarkets)
• Paper bag with handles(provided in a clothes shop)
06 | Multipacks
Multipacks are packaging (usually paper and/or plastic) that group several individual sales units (with its own barcode) and are especially designed for sale to the end user.
EXAMPLES:
• Plastic holding 6 cartons of milk
• Plastic holding 4 bottles of water or soft drink
• Plastic holding 6 cans of soft drink or beer
• Cardboard holding 6 bottles of beer, 6 chocolate milk cartons, 4 yoghurts

PACKAGING THAT IS NOT DECLARED
The following should not be included in the annual statement:
• All reusable or returnable packaging.
EXAMPLE:The customer returns an empty pallet to his supplier, who reuses it to send goods to his customers again.
• All packaging of exported products (to European Union or other countries).
EXAMPLE:Packaging of olive oil sold to Brazil
• All packaging for hospital use in Groups III and IV of Ministry of Health Order 242/96 of 13 August
EXAMPLE:Packaging for surgical gloves used in a hospital operating theatre
• On 18 June 2011 Decree-Law 73/2011 of 17 June came into effect. It amended and republished the general regime on waste management approved by Decree-Law 178/2006 of 5 September and transposes Waste Directive 2008/98/EC of the European Parliament and of the Council of 19 November.
This new Decree-Law amends Article 5 (5) of Decree-Law 366-A/97 of 20 December and determines that the packaging mentioned no longer needs to be subject to an integrated or consignment system.
As of 18 June 2011, all economic operators responsible for first-time placing non-reusable packaging from raw materials and packaged products were no longer obliged to hand over packaging management to integrated or deposit and take-back systems, provided that it is used solely for the user’s own consumption at the premises and in a closed circuit in its utilisation process.
This means that these types of packaging should no longer be included in the annual statement.
EXAMPLE:A sackcloth bag of coffee beans that is imported for processing and packing at the premises of a manufacturer in Portugal.
• All packaging managed through other systems provided for by law and duly authorised by the competent authorities
• All packaging of products sold under a third party’s trademark
EXAMPLE:ALTA LUZ SA commissions LAMPCONSTRÓI, another company, to manufacture its SHINE brand of lamps. In this case, ALTA LUZ, SA is responsible for managing the packaging waste, not LAMPCONSTRÓI.
• All service packaging bought from an accredited service packaging supplier with the Green Dot fee included

Look at the diagram below to identify the areas that apply to the packaging of the products that you sell and use the Primary Packaging Classification Table by sector of activity if necessary.

02 | How to use the Packaging Classification Table
Companies that place both fast-moving consumer goods and industrial products on the market must use the Primary Packaging Classification Table to identify the area of the annual statement that they need to complete, based on their sector of activity.
The area identified for primary packaging of a product will be the same as that for secondary and tertiary packaging.
The weight of secondary and tertiary packaging of products with no primary packaging is included in:
• Packaging of fast-moving consumer goods (FMCG) - if it is used to pack products for the domestic market or HORECA channel/Catering.
• Packaging of industrial products (IP) - if it is used to pack products for the industrial market.
• Packaging of hazardous industrial products - if it is used to pack hazardous products for the industrial market.
The classification table should be used on the basis of the company’s sector of activity, in accordance with the following criteria:
1º - The sector in which the company operates
2º - Area of the annual statement to be completed – the area applies to its components and secondary and tertiary packaging, if any

DETAILED STATEMENT
You can choose this type regardless of your company’s size but must use it if you place more than 20,000 kg of packaging a year on the Portuguese market.
This type of statement requires you to classify packaging by type (primary, checkout bags, multipacks, secondary or tertiary), the materials that they are made of and the products that they contain (fast-moving consumer goods or industrial products).
This manual gives examples of how to complete the detailed statement for different sectors of activity.
SIMPLIFIED STATEMENT
If your company places less than 20,000 kg of packaging a year on the Portuguese market, you can choose to submit a simplified statement.
In this type, you only have to indicate the total weight of and the materials used in the packaging placed on the Portuguese market with no need to quantify each of them separately.
This statement is completed only in the year you join. In subsequent years, the amount of the statement is calculated automatically by SPV, using average growth rates in the company’s sector.
All you have to do is confirm every year that your company has not placed more than 20,000 kg of packaging on the Portuguese market and approve the statement with the figures entered by SPV. If you do not agree with the figures, you can always choose to fill in a detailed statement.
If you place more than 20,000 kg of packaging on the Portuguese market in a particular year, you will have to fill in a detailed annual statement, though you will not have to make any changes to your licensee contract.
MINIMUM STATEMENT
If your company’s turnover is €100,000 a year or less, you can choose to submit a minimum statement.
This is the simplest type, as you do not need to submit any kind of statement about packaging. You only have to pay the minimum annual contribution to the Green Dot System.
All you have to do is confirm every year that your turnover is less than €100,000. If you prefer, you can always submit a simplified or detailed statement.
If your turnover exceeds €100,000 in a particular year, then you have to fill in a simplified annual statement or a detailed annual statement, though you will not have to make any changes to your licensee contract.

All primary packaging must bear the Green Dot symbol. It is optional on secondary and tertiary packaging.
Definition of the Green Dot trademark
Any reference to the “Green Dot” trademark on packaging, or in publications or communications, must comply fully with the following definition.This definition is the result of an agreement between all the national systems licensed by PRO EUROPE - Packaging Recovery Organisation Europe, which owns the “Green Dot” trademark rights. Its purpose is to prevent any misconceptions regarding the name.
OFFICIAL DEFINITION
“The “Green Dot” trademark on packaging means that a financial contribution has been paid for it to Sociedade Ponto Verde, a company set up in accordance with the principles defined in European Packaging and Packaging Waste Directive 94/62 and in national law, which is responsible for the recovery of used packaging.”
SPV has the exclusive right to the Pro-Europe brand in Portugal.
01 | Basic rules on the use of the Green Dot symbol
LEGIBILITY
The symbol must be instantly identifiable to consumers. It must be clearly visible and easy to read and designed to last as long as the packaging, even after it has been opened.
POSITIONING
The symbol is placed on the packaging itself or on the label. It is compulsory to display it on primary packaging, with the exception of specific, duly justified cases in which there is a degree of flexibility, as provided for by law. Placing it on secondary or tertiary packaging is optional.

GRAPHIC APPEARANCE
The symbol is a circle containing two entwined arrows around a vertical axis.
COLOURS
On a white background, the arrow pointing left is light green: Pantone® 366 C, while the arrow pointing right is dark green: Pantone®343 C.
SIZE
A minimum height of 10 mm is recommended to ensure that the symbol is easily visible and identifiable. A minimum of 6 mm is acceptable for small items.
APPLICATIONThe use of Pantone® 366C and 343C or equivalent four colours is not compulsory. The symbol can also use another colour on a white or coloured background or be in one colour.

NB:The arrow pointing left must always be the lighter colour.
NB:The central axis must be vertical in relation to the wording on the packaging.

ALTERATIONS
This symbol cannot be changed. It must be used fully, in the right proportions and colours. No mentions, additional or changed graphic features can be added without prior written permission from Sociedade Ponto Verde.
Any changes in these rules for technical or legal reasons must be included in a written agreement appended to the contract with Sociedade Ponto Verde.

Nominal capacityThis is the quantity of product that the packaging was designed to contain.

PackagingAny and all products made from any type of material that are used to contain, protect, move, handle, deliver and present goods, which may be raw materials or manufactured products, from the producer to the end user or final consumer. This definition also includes all “disposable” articles used for the same purpose.
Reusable packagingPackaging conceived and designed to accomplish a minimum number of trips or rotations within its life cycle, being refilled or used for the same purpose for which it was designed, with or without auxiliary products on the market enabling the packaging to be refilled. Reusable packaging becomes packaging waste when it can no longer be reused.
Non-reusable packagingPackaging that does not fall into the previous category and therefore only goes once to the user of the product and cannot be refilled
RecyclingReprocessing of packaging waste in a new production process, for its original or for other purposes, including organic recycling but

Multipacks
MultipacksMultipacks are packaging (usually paper and/or plastic) that group several individual sales units (with its own barcode) and are especially designed for sale to the end user.
Grouped packaging of free gifts is always considered multipacks.
To qualify as a multipack, grouped packaging must meet the basic condition of being designed specifically for sale to the final consumer.
Certain practical rules have been adopted for the drinks and milk sectors to facilitate the definition of a multipack:

Bonus pack - 2 or more of the same product
• Brinde - an item given away on purchasing a product; it may be located inside or attached to the packaging.
The packaging that groups gifts with a product or products, i.e. binding, must be declared in the new multipack category, provided that the products have their own barcode. However, packaging directly covering the gift must still be declared as primary packaging.
EXAMPLES:
• In the example below, the tubs of butter are primary, the plastic around the cutlery (gift) is primary and the band is multipack.
• In the example featuring chocolate milk below, the beverage cartons are primary, the plastic around the bottles is multipack, the paper box around the gift is primary and the plastic joining them is multipack.
