Title VI Training
Access and Equity ensures University compliance with the following federal and state laws:
• Title VII of the Civil Rights Act of 1964, as amended • Executive Order 11246, as amended • Revised Order No. 4 • Equal Pay Act of 1963 • Title IX of the Education Amendments of 1972 (Higher Education
Act) • Title VI of the Civil Rights Act of 1964 • South Carolina Human Affairs Law • Age Discrimination in Employment Act of 1967, as amended • Sections 503 and 504 of the Rehabilitation Act of 1973 • Vietnam Era Veterans Readjustment Act of 1974 • Americans with Disabilities Act of 1990

Title VI Compliance
Who must comply with Title VI?
Recipients• An entity or person that directly receives federal (or state) financial assistance and/or manages a program or activity.
Sub-recipients• An entity or person that indirectly receives federal (or state) financial assistance in order to implement a program or activity.

Who is responsible for Title VI Compliance?
Clemson University
• The Office of Access and Equity serves as the point of contact for university-wide Title VI Compliance
• Each PI is principally responsible the activities under his/her sponsored program
Title VI Compliance
The four major areas of Title VI compliance are:
• Public Involvement
• Contract Provisions
• Data Collection
• Limited English Proficiency (LEP)

• Title VI questionnaires
are sent to PIs biannually to collect information regarding sponsored programs
• PIs are asked to complete the form and return to A&E to document notice and compliance

Title VI requires that the University have written and published procedures for filing complaints of discrimination.

Title VI Compliance
Procurement Certification
– Roberta Elrod, SPAA
PROCUREMENT CERTIFICATION
Pre-Award Role – Encourage PIs to identify/name consultants and specify equipment and vendors in the proposal narrative and budget
Post-Award Role – Assist department requisitioners with attaching the necessary documentation. Advise requisitioners not to attach invoices to the requisitions
SPAA 44 Procurement Certification
This form should be used to place Exemption 44 (Grant Specified Procurement) orders. If the proposal for the project number on the purchase requisition names a specific product/service and vendor/consultant from which you will purchase goods, equipment, or services, use this requisition form to obtain Procurement Certification approval from Sponsored Programs Accounting & Administration. With this approval, the purchase will be exempt from the requirements of the State of SC Procurement Code. You are required to attach the budget form and narrative from the proposal that specifies the vendor/consultant and product or service you must purchase as part of the awarded project (attach via Internal Attachments below). Failure to provide this detail may result in rejection of your requisition.
REMINDER – COST SHARE POLICY

Share with anyone involved with proposals, awards and project management
If cost sharing is proposed – a cost share agreement form must be included with the proposal and the expenditures must be documented
Inferred cost sharing – If SPAA fiscal manager reads language in proposal that infers cost sharing and a cost share agreement form is not included, they will ask for a completed, signed form

1) Impact:
These rates are effective July 1, 2011 and apply to all salaries paid in FY 2012 (including sponsored program activities). The pooled fringe benefit rates for FY2012 are located on the Comptroller’s website (http://www.clemson.edu/cfo/comptroller/rates/pooled-fringe/pf12.html).
2) Four Categories:
• 9 Month Employees/Faculty
• Administrator/Staff (FED: Federal, STA: 12 Month, and GST: Temporary Grant & Time Limited)
• Students (GRD: Graduates, NEL: Undergraduates)
• Part Time/Temporary (RRR: Returning Retirees, TLR: Permanent Part-Time, TMP: Temporary Employees)
Reminder: The pooled fringe charge is based on an employee’s benefit program code. It is important this code be accurate to insure the correct pooled fringe benefit rate is applied.
