Failure of the Contractor to meet the above stated delivery requirements may be used by the City as grounds for the termination of this Contract, and may further affect the Contractor’s eligibility for futur e Contract awards. 1. Revision No. 1 -- BID OPENING DATE POSTPONEMENT.

Bid Postponement, Bids which were scheduled to open May 9, 2014 is hereby postponed.

The new bid opening date is scheduled for May 30, 2014 at 11:00 a.m.

2. Revision No. 2 Add the attached Section 4.5.7 to Article 4. Standard Terms and Conditions in the Bid Specification.

6. Shellcase: 45 Gap Brass Shellcase Bullet: 230 grain, Brass Enclose Base (BEB) - Truncated Cone Soft Point (Alloy 260 Brass Jacket) Powder: Clean burning, low flash Primer: Winchester patented lead free, heavy metal free, priming mix in nickel plated cup Accuracy: Product Mean of 2.5 inches (6.4 cm) Extreme Spread 5 shot target at 50 yards (45.7 m) from a 5 inch SAAMI test barrel Velocity: 830 ft/sec nominal at 15ft using a SAAMI standard 5" test barrel (835 ft/sec muzzle velocity) Energy: 356 ft-lb Lot Identification: Ammunition is assigned a unique identification number to include the day, month, and of manufacture and assembly line on which it was manufactured. Pressure: Complies with SAAMI maximum average pressure of 21,000 psi.

Questions & Answers:

Question No. 1. In reviewing the Bid Specification I wish to bring attention to the products requested and the manufacturers’ suppliers. Specifically, both the Simmunition and Hornady items have contractual agreements with their distributors/dealers which have geographical boundaries. To the best of my knowledge only one Law Enforcement Distributor can sell and bid on these items in the State of Illinois. Will the City of Chicago obtain the “ True Market Value" of the items requested? Response: All vendors are being requested to bid all line items. Question No. 2. Page 1, Bid Submittal Checklist: if no MBE/WBE Compliance Plan is required of the vendor (item #3), no Bid incentives/preferences are being requested (item #5) and a Bid Deposit are all not required (item #8), does the Contractor still have to file the documents with the packet submittal? Or will the “N/A” on the checklist be sufficient for packet completion? Response: N/A will be sufficient.

Question No. 3. Page 15, 2.3 Reverse Auction Transaction Fee: Calls for a $40,000 or 1% Transaction Fee, whichever is less, over the life of the agreement including extensions (to be paid on actual purchases at the end of each month). If, and when, $40,000 in fees has been paid to PGGI during the contract, is it accurate to assume no further fees will be due to PGGI through contract termination? Response: Yes that is accurate. When $40,000.00 in fees are reached, no other fees will be due to Peralta Garcia. Question No. 4. There is a sequence problem when you compare the “Tech Requirements 6.4.1” (page 63) with both the “RFQ list” (page 128) and “Proposal Page”. Both the RFQ and Proposal Pages are missing numbers 14, 42 & 44. However, the actual items/written order still line up correctly; equaling 43 total line items on all three documents. Response: Line items 14, 42, & 44 were never included in Specification. There are only 43 line items for this bid. Question No. 5. It is our belief that the symbols/skus for line items #27 & line item #43 are reversed on the “Tech Requirements”. This is evident by the volume totals: line item #27 currently lists WC452G (Winclean .45GAP) while line item #43 lists WC452 (Winclean .45ACP). These are different products altogether. Their volumes are currently listed as 1300 cases and 2 cases respectively. WC452 would require the 1300 case volume, not the WC452G (based on CPD usage history) and should be reversed. Response: See Revision Number 8. Line Item 43 is for 45 GAP, and Line Item 27 is for 45 AUTO, the quantities as listed are correct. Question No. 6. Technical Requirement section 6.4.43. Line Item #46 on the Tech requirements page has the wrong symbol/sku; X12RS15S should read RA12RS15S for the Winchester Segmenting slug spec; X12RS15S does not exist. a. Should the city wish to list the Segmenting Slug volume via case instead of number of actual rounds; the case

equivalent of 315,000 rounds would be 1260 cases (at 250 rounds per case). This would be consistent with the other 42 items on the bid where the UOM is stipulated in Case volumes.

Question No. 7. Additional Requirement section 6.5.2. It would be impossible to maintain the level of inventory historically ordered by CPD to ensure 5 day delivery. CPD Staff is well aware of manufacturing inventory constraints and like all other law enforcement agencies, they have ordered and forecasted out their specific needs. Is it possible the City would relax this requirement as they have done so in the past? Response: See Revision Number 7. Delivery constraints have been revised. Question No. 8. Additional Requirements 6.5.1.2. Lists the City’s ability to unilaterally extend contract beyond the initial term by 24 months. Then in the following sentence refers to a 36 months extension. Will this extension be 24 or 36 months? Response: See Revision Number 6. Extension will be thirty-six (36) months. Question No. 9. Additional Requirements 6.5.6. Price Adjustments (Capped Rate). The bid states “maximum 3% annual adjustment allowed after initial 12 month period”. Is it the City/Contracts intent to allow for this 3% adjustment (justified by Contractor) at every annual anniversary over the 60 month life of the contract and extensions? Response: Yes, as stated in Section 6.5.6. a maximum 3% annual increase may be allowed after the initial 12 month period over the 60 month life of the contract and extension options. Question No. 10. Exhibit 2: “Sample Reverse Action Service Provider and Reverse Auction Participant’s Agreement” Paragraph 20 – Modification, states that changes to PGGI’s agreement can be made at any time at PGGI’s sole discretion. This would appear to include all aspects of this proposed agreement including fees. Please clarify that fees cannot be adjusted at PGGI’s sole discretion and what boundaries, if any, exist in PGGI’s ability to modify this agreement. Response: Fees cannot be adjusted by Peralta Garcia. They are documented in the contract with the City of Chicago and can only be changed upon approval of the Chief Procurement Officer and the City of Chicago.

Question No. 11. Will the individual line item bids be based upon cost per round/item or based on total estimated volume of that line item? Manufacturers use different case quantity amounts on like-kind/equivalent bid items; therefore line item bids based on cost per case would not be equitable. Response: All bids should be in cost per 1000 rounds. It is standard in the industry so that everyone can compare costs on an even field. Cost per box or per case SHOULD NOT be used to evaluate similar items since packaging changes often. Question No. 12. By what method will the City and PGGI Auction establish an open bid price per line item? Response: Each vendor will enter their own opening bid price per line item and it will not be proscribed by the City of Chicago or Peralta Garcia. Question No. 13. Will the City of Chicago consider continuing with the traditional competitive bidding process? Response: This bid will utilize the Reverse Auction format.

4.5.7. Duty to Report Corrupt or Unlawful Activity

Pursuant to MCC 2-156-018, it is the duty of the Contractor to report to the Inspector General, directly and without undue

delay, any and all information concerning conduct which it knows to involve corrupt activity. “Corrupt activity” means any

conduct set forth in Subparagraph (a)(1), (2) or (3) of Section 1-23-020 of the MCC. Knowing failure to make such a report will

be an event of default under this Contract. Reports may be made to the Inspector General’s toll free hotline, 866-IG-TIPLINE

(866-448-4754).
