3 ISSUES AND CONCERNS RASIED

3.1 Segregated Issues and Concerns

Table 3 to Table 6 shows the summary of the issues and concerns raised during the four public

hearings conducted.

Table 3: Issues and Concerns raised Kitaotao Public Hearing

Module Issue/Concern Raised Response

Project Description a) Is the Project really cost 37B? It can still go up or down?

b) Suggestion to include in the MMT one LGU representative, one Sangguniang Bayan Representative, and the president of the Association of Barangay Captains

c) Concern about the (technical) capacity of the MMT to conduct monitoring. Suggests capacity building for MMT be prioritized. Local MMT members should be capacitated.

a) Yes. Based on initial study the estimated project cost is 37B. But this is still subject to changes as more studies are concluded/ conducted for the project.

b) DENR DAO 2017-15 has a prescribed membership for the MMT. Additional members of the MMT should be discussed internally.

c) The suggestion is noted. Orientation of MMT members is usually

a) How much is the EGF? b) Can the EGF be used for livelihood

purposes (as indicated in the EIS document)?

c) What are the sample livelihoods qualified for SDP?

d) Cost of SDP program? Can this be increased?

a) Initial allocation for EGF is Php1,000,000.00. The final amount will be discussed during the formation of the MMT.

b) It can be used for emergency livelihood assistance for those affected.

c) The SDP contained is the framework only; hence, general approaches were indicated such as provision of gender-sensitive livelihood for men, women, youth and elders.

d) Initial allocation for SDP is Php500,000.00. This can be increased annually based on the specific programs that the community and PHPC will identify through a MOA.

Land There is already existing landslide in our area towards the river (Brgy Magsaysay). Will the establishment of the project worsen the landslide?

The needs to be further assessed. The conduct of a probabilistic seismic sampling has been required as a post-ECC condition. The results of these may be provided to the communities.

People For the land rental, how will the payment be (process on payment)?

A Resettlement Action Plan will be prepared which will contain details of the compensations scheme.

If the land is not titled, will there still be compensation/payment?

All affected properties will be compensated, including improvements. If there is no title,

Page 8: SOUTH PULANGI HYDROELECTRIC POWER PLANT PROJECTeia.emb.gov.ph/wp-content/uploads/2019/11/South-Pulangi-HEPP-Public... · accordance with the guidelines set in DENR Department Administrative

proof of ownership should be presented such as Tax Declaration.

a) The 28 households affected indicated in the report is too few considering that there are 6 barangays in Kitaotao

b) Will there be landslides once the reservoir is established?

c) The affected household should be priority for employment.

a) A resurvey to revalidate the affected household will be conducted

b) This needs further study. Nonetheless, buffer zone from the reservoir will be established.

c) Affected families will be prioritized for employment and livelihood programs.

a) Who will pay for the relocation? b) Where is the relocation site?

a) The proponent will pay for the relocation

b) The relocation site will be consulted with the affected communities and will be included in the RAP document.

The 28 households are too few. There are many others not included in the ragging/survey. There should be coordination with the tribal elders before the conduct of tagging/survey.

A revalidation survey will be conducted and will be coordinated with the concerned LGUs and Tribal Councils.

Table 4: Issues and Concerns raised Dangcagan Public Hearing

Module Issue/Concern Raised Response

People Based on the meeting last August 27, there were only 4 affected households. This may not be accurate and a resurvey must be conducted.

There will be a revalidation survey of all affected areas.

Clarification on the payment of P25, 00/ha/year.

The P25,000/ha/year is for land rental only. The payment for other improvements on the land is separate and may depend on the assessor’s office valuation.

Directly affected persons by the project should be included so they can hear the explanations for themselves.

During the RAP preparation and the validation survey, dialogue will be with the directly affected persons.

Amount of rental (P25, 000/ha/year) is small/insufficient.

The rate provided (P25,000/ha/year) is the highest given by any private entity in the Province. This was also the rate agreed with the Office of the Governor. In addition to the rental and payment for the improvements, the qualified affected persons are also priority for the employment to be

a) There people whose existing income is above P25,000/ha/year. p

b) Infrastructure in Dolorosa hanging bridge is affected

provided as well as the livelihood programs under the project.

The bridges and other infrastructure to be affected will be included in the validation

EMB: A position paper on the proposed compensation scheme can be submitted to EMB for consideration.

Houses of higher value (than the proposed relocation unit) should have higher value compensation. Please also consider that in other cases (i.e., plantations) they can still have their land after the project. In your case, the land will be inundated and will not be usable.

The existing income from the land is about P70,000/ha/year.

If there are 3 barangays against the project, what will happen?

There will be continuing dialogue with the affected barangays.

They should talk to the people directly affected to explain to them the compensation package so they will be informed.

During the validation and the RAP, there will meetings with the directly affected persons.

What will be the rental for those titled and those not titled (stewardship only). Will they be the same?

All affected properties will be compensated, including improvements. If there is no title, proof of ownership should be presented such as Tax Declaration.

Issue/Concern Raised Response

Project Description Tribal Chieftain Natulongan

Way back in 2007, there was a “Save Pulangi Movement”. There was also a resolution passed opposing the project as well as in 2012. It was a surprise for us that in 2017, there was a resolution endorsing the project.

There should be an assembly of the affected and any resolution from the barangay should be done with consultation.

There was a mention of Dam height as 15 m only, now you are presenting a dam height of 147 m. Which is the real dam height?

Once the RAP and validation survey is on-going there will be more consultations with the directly affected persons.

For the dam height, to clarify the 15m height mentioned is the threshold to be classified as a large dam. For this project, the dam height is 143.1 m.

Issue/Concern Raised Response

Who is the President of PHPC? Will there be compensation for house owners but not lot owners?

The President of PHPC is Mr. Josue Lapitan.

All affected properties will be compensated, including improvements. If there is no title, proof of ownership should be presented such as Tax Declaration.

When will the Project start?

There is no definite timeline yet for the project start as the necessary permits are still being processed.

People Resident Brgy Natulongan

If the project is implemented, we will lose our land which is our source of income/livelihood. Once the dam is there, the land will not be usable/available.

To compensate for the lost income/land productivity, there will be a land rental for the affected person. In addition, the qualified affected residents will be priority for employment and livelihood programs.

Datu Indao

There should have been a Letter of Intent with project proposal before they started with their activities. There should also be a MOA. It should be noted that the decision making of IPs is through consensus building.

PHPC will adhere to the required processes of the NCIP.

Marcial Sayson-Brgy Talahiron

There was a survey and most people are against the project. There should also be an assembly in Brgy Talahiron with the affected people. And where is the proposed relocation?

As for the assembly, there will be consultations with the Barangay Officials and Tribal Council on this.

As for the relocation site, this will be consulted the affected persons during the preparation of the RAP.

How about those who do not want to rent but want to sell their land instead?

If this is in private lot, this will be based on the negotiations between the company and the affected.

Bukang Liwayway Resident

Proposal/request to pay for the entire 25 years of rent instead of annual/5 year lump sum. How about payment for crops?

This will be taken up with the Board/Top Management for consideration.

Issue/Concern Raised Response

Lydia Laras

Clarification on the number of affected households in Brgy Balintawak? It was not in the presentation

A validation survey will be conducted to determine the exact number of affected houses/lots. The presentation does not show the exact number of affected per barangay. Although there is initial information from the first survey, it needs to be processed and validated.

There should be an option for cash instead of relocation.

The will be considered during the preparation of the RAP.

Table 6: Issues and Concerns raised Damulog Public Hearing

Module Issue/Concern Raised Response

Land/Water There should be clarification on the water level/area that will be inundated? What will happen to people in the lowlands?

There will be a validation of the affected areas. The water level will be determined during this validation. Affected people will be provided relocation, employment and livelihood if qualified.

People Payment of the affected should be done before project start/ before construction.

This is noted and will be more in detail during the preparation of the RAP.

Where should we apply?

This will coordinated with the LGUs.

3.2 Issues and Concerns Beyond the Mandate of EMB

Among the issues raised during the Public Hearings conducted, the following are considered to be

beyond the mandate of EMB:

The FPIC process currently being undertaken by the Proponent as a prerequisite for any

activity.

The exact amount of compensation for the land rental that should be followed.
