Board Minutes Minutes of the regular meeting Friday, January 29, 2010
The South Dakota State Board of Technical Professions held its regular meeting on Friday, January 29, 2010 in its Board Room, Rushmore Building, Rapid City, South Dakota; Chairman Randy Bacon presided. The meeting was called to order at 8:30 a.m. The following board members were present: Chairman Randy Bacon, Vice Chairman Jeff Hazard, Secretary Drake Olson, Dale Jans, Leonard Neugebauer, Hani Shafai, and David Stafford. Others present were Todd Kolden, and staff members Mark Humphreys, and Mary Ann Myers. Also present was Brian Jenner, Licensure Chair, South Dakota Engineering Society. Staff Attorney Nathan Lukkes attended via telephone. Agenda Items:

AGENDA ITEM #1 APPROVAL OF NOVEMBER 20, 2009 BOARD MEETING MINUTES (MOTION) Humphreys mentioned that the minutes have not been reviewed by Staff Attorney Nathan Lukkes at this time. Hazard suggested amending the minutes, under AGENDA ITEM #5 OLD BUSINESS – NCARB Option for ARE testing -
MOTION to reflect the intent of the committee to review all Model Law, and recommended amending the minutes as follows: “MOTION: By Olson, seconded by Stafford, to form a committee to study South Dakota Rules and Statutes as compared to NCARB’s Model Law.”
MOTION: By Jans, seconded by Stafford, for approval of minutes of November 20, 2009 as amended above, pending review by Staff Attorney Nathan Lukkes.

AGENDA ITEM #2 APPROVAL OF VOUCHERS SINCE LAST MEETING (MOTION)
MOTION: By Neugebauer, seconded by Shafai, for approval of vouchers since last meeting. ACTION: 7-0 AYE (Bacon, Hazard, Jans, Neugebauer, Olson, Shafai, Stafford) _______________________________________________________________________________________________________ AGENDA ITEM #3 ACTIVITES REPORT ENDING DECEMBER 2009. REVIEW OF DEPOSITS AND QUARTERLY REPORT Humphreys mentioned that the number of licensees has been growing. Neugebauer and Stafford noted that some of the
growth of licensees is relative to licensees’ job hunting and an increased number of firms bidding on jobs in South Dakota.
AGENDA ITEM #4 INVESTIGATION REPORTS
Case 09-03 Failure to report Disciplinary Action – Humphreys discussed the progress of the Investigative Committee appointed to work on this case. Humphreys reported that the Committee, through the Board’s Staff Attorney, has been unsuccessful in reaching an agreement with the parties involved; and therefore, at this time the Committee recommends moving to a formal hearing with a hearing examiner. Kolden will look into securing a meeting room in which to conduct the hearing that will be large enough to accommodate the number of people anticipated to be in attendance. Humphreys reported that the Board’s Staff Attorney will be unavailable during this time period; and therefore the Committee respectfully requests that the Board authorize the hiring of outside legal counsel to represent the Board in this case.
Humphreys stated that the same licensee is involved in both Case 09-03 and Case 09-07, and the same Investigative
Committee had been appointed to work on both cases. Therefore, the Investigative Committee Report and recommendations were identical for both cases.
MOTION: By Jans, seconded by Shafai, to hire outside legal counsel to represent the Board regarding Case 09-03 and Case 09-07.
ACTION: 6-0 AYE (Bacon, Hazard, Jans, Olson, Shafai, Stafford) Neugebauer abstained. Case 09-06 Competency and Professional Conduct – Discussion by Humphreys and Shafai. The Investigative
Committee has determined that this case has merits; and therefore requests that the Board make a motion to authorize the Executive Director and Investigative Committee to draft a consent order with licensee for possible settlement in this Case. In the event that a settlement is not reached, the Investigative Committee would then request a formal hearing.
MOTION: By Neugebauer, seconded by Stafford, to authorize the Executive Director and Investigative Committee to draft a consent order with licensee.
ACTION: 6-0 AYE (Bacon, Hazard, Neugebauer, Olson, Shafai, Stafford) Jans abstained. Case 09-07 Competency and Professional Conduct – Previously discussed in conjunction with Case 09-03.
Case 10-01 Land Surveying issue – Case is pending.
Case 10-02 Competency and Professional Conduct, Need Board Member assigned – Discussion by Humphreys. Neugebauer assigned to this case. Case is pending.
AGENDA ITEM #5 OLD BUSINESS

Biennial Land Surveying Seminar, 12/04/09 in Rapid City, SD – Humphreys. Upon invitation by the South Dakota Land Surveyors Society, Humphreys attended this seminar and gave a presentation and question and answer session relating to the Board and board office regarding licensing land surveyors in South Dakota. CLARB LARE Graphic Exam – Humphreys – Humphreys reported on having proctored a two-day CLARB LARE Graphic Exam for an examinee in the board office two full days in December 2009.

SDSPLS, 01/14/10 to 01/16/10 in Chamberlain, SD - Bacon, Neugebauer – Bacon reported on the progress of the group of licensed land surveyors who reviewed and discussed changes to the Land Surveyors Take Home Examination. Bacon and Neugebauer are reviewing the suggested changes and revisions and will report back at the next board meeting. Neugebauer reported on the progress of the Education Committee’s review of the rule changes and recommendations to revise rules for survey licensure as relates to the education South Dakota requires. Neugebauer, after handing out a copy of the “Draft for Review and Comment (Jan. 22, 2010)” prepared by Neugebauer and Bacon of suggested changes to South Dakota Administrative Rules 20:38:14:05, 20:38:16:01, and 20:38:17:08 to the board members, discussed the suggested changes. After discussion by the Board, Neugebauer asked for the Board’s support of the suggested changes in the Draft, and that Neugebauer and Bacon be allowed to take the Draft back to the Education Committee as the Board’s recommended changes. Hazard asked that the land surveyors also work with the architects in the process of making changes to the South Dakota Administrative Rules. Kolden mentioned that the South Dakota Rules Committee meets every other month and that the Board can present changes in Rules anytime during the year. MOTION: By Jans, seconded by Stafford, to submit the “Draft for Review and Comment (Jan. 22, 2010)” of suggested changes to South Dakota Administrative Rules 20:38:14:05, 20:38:16:01, and 20:38:17:08, for review to the South Dakota Society of Professional Surveyors (SDSPLS) as the Board’s recommended changes.
ACTION: 7-0 AYE (Bacon, Hazard, Jans, Neugebauer, Olson, Shafai, Stafford) Action Items – reports – Discussion by Humphreys and the Board regarding the Handbook for South Dakota Building Officials and Design Professionals, referred to as the Building Guide. Rules and Statutes – reports – Humphreys and the Board discussed the intentions of Neugebauer and Bacon to coordinate their efforts regarding land surveying Rule changes with Hazard, Stafford, and Olson to also incorporate architecture Rule changes. FTE & Investigator Duties –
Executive Session – Humphreys asked that the Board go into executive session and that staff be allowed to be present during the executive session. MOTION: By Neugebauer, seconded by Stafford, for the Board to go into executive session and to allow the staff to be present in the executive session. CPEES evaluation of domestic degrees – Discussion by Shafai. NCEES Credit Evaluations, formerly known as CPEES, is in the process of moving their office from Miami, Florida to Clemson, South Carolina. Shafai will be attending a meeting in March to develop new guidelines to evaluate domestic degrees that have not been evaluated by ABET as well as foreign degrees for ABET evaluation. Shafai will report the progress at next board meeting.
AGENDA ITEM #6 NEW BUSINESS
Board Member up for re-appointment, Drake Olson – Kolden has sent in a recommendation to reappoint Olson. Humphreys and Board commended Olson for his interest and input at the board meetings.
Two requests for exemption of PDH’s. 1. Military deployment. 2. Medical. (Motions) Discussion by Humphreys and the Board regarding two licensees who have applied for PDH exemptions due to temporary active duty in the U.S. Military Service or Serious Illness. After discussion, the Board moved to approve the Executive Director’s decision to grant the two licensees requests for PDH exemptions during their required PDH reporting period at time of their respective renewal dates. The Board is in agreement that the Executive Director can make the decision based on the Rules in granting PDH exemptions in the event of either Temporary active duty in the U.S. Military Service or Serious Illness, and should report his decisions to the Board at their next regular meeting for their information purposes only. No motion needed. After reviewing the Blue Book, Jans pointed out that in the case of 1. Military deployment, the licensee “is exempt from obtaining the professional development hours required during that year”. Jans further pointed out that in the case of 2. Medical, “as reviewed and approved by the board may be exempt”. Kolden mentioned that the Staff Attorney Nathan Lukkes is deploying with his South Dakota Guard group to Afghanistan in May 2010 for approximately one year. Kolden will keep Humphreys informed as to how the State will delegate legal representation for the Board.

SDSM&T - Mining program – not ABET, FE exam applicants – Discussion by Humphreys regarding the Bachelor of Science Mining Engineering degree (BS Mining Engineering) at SDSM&T. At present the Mining Engineering program at SDSM&T is not ABET approved. SDSM&T has recently had an ABET visit for possible accreditation of the Mining Engineering program, and will not know the outcome of the ABET visit until July 2010. After Board discussion, the Board agreed that students in the Mining Engineering program at SDSM&T should not be allowed to sit for the FE Exam until such time as the Mining Engineering program at SDSM&T has been ABET accredited. Correspondence from former licensee regarding Case 01-04 (Motion) – Discussion by Humphreys and the Board regarding the licensee’s delinquency and default in payment, and Humphreys’ discussion with Staff Attorney Lukkes. MOTION: By Shafai, seconded by Neugebauer, if payment has not been received by the board office from licensee by February 1, 2010, to authorize the Executive Director Humphreys to proceed with the terms of the Consent Order entered in Case 01-04 and signed by licensee; to send a letter to licensee informing him that he will be given no refund, as he is required to comply with the Consent Order; to inform NCEES of such action; find out if licensee is licensed in any other state; and to then inform the proper board of the actions of our Board and the terms of the Consent Order signed by licensee. Review of bills: HB1011& SB68 – Kolden discussed HB1216 and asked for the Board’s opinion of this bill. After discussion, the Board agreed to support HB1216. Stafford discussed reference to IBC and IRC in this bill. Kolden to follow up on this House Bill and will keep the Board updated. HB1011 - discussion by Humphreys and the Board. SD68 - discussed by Humphreys and Board. Discussion by Neugebauer regarding the Design Professions Coalition, and information and updates he, as the board liaison, receives. Discussion by the Board followed. Neugebauer to keep board members updated.
NCEES Committee: Requesting volunteers – Discussion by Humphreys. NCEES Award Nominations – Discussion by Humphreys.
GOAC Budget Hearing, February 01 2010. Humphreys to attend – Kolden brought it to the Board’s attention that the title of this hearing is Appropriations Committee Hearing.
AGENDA ITEM #7 PDH AUDITS (MOTION) NEW AUDITS: N/A REVIEW PREVIOUS AUDITS: Humphreys brought the board up to date on the previous audit of Jonathan D. Bailey –
AR. Board directed Humphreys to consult with legal counsel and proceed according to their directive.

AGENDA ITEM #9 APPROVAL TO TAKE EXAMINATIONS FOR APRIL 2010. (MOTION) - Discussion by Humphreys that the
Mining Engineering program is not currently an ABET accredited program at South Dakota School of Mines and Technology (SDSM&T). Therefore, the FE Exam applicants in the Mining Engineering program at SDSM&T are not eligible to take the FE Exam at this time until the program is ABET accredited. No exceptions are allowed. The Mining Engineering program is currently under review by ABET for possible accreditation.

The FE exam applicants who completed their FE Examination applications online after the January 1, 2010 deadline have been notified that the board was not able to accept their applications for the April 2010 exam due to the January 1, 2010 application deadline. The board office will be working with the computer programmer on the South Dakota Board of Technical Professions website to close the link on January 2
nd for the April NCEES exams for that year, and July 2
nd for the October NCEES exams for that year to each
of the online exam applications to applicants applying to take the NCEES exams. The exam application links will reopen March 1
st (for October NCEES exams) and September 1
st (for April NCEES exams) of each year.
