The Chair of the SPC, Tom Fuerth, called the meeting to order

The Chair announced that there have been some changes an the Ministry of the Environment

(MOE). Paul Heeney, left MOE for the Ministry of Natural Resources (MNR).

The Niagara region has received their approval for their Source Protection Plan.

Chitra Gowda, Project Manager for the Source Water Protection will be leaving the Essex Region

Conservation Authority (ERCA). Ms Gowda will be relocating to Oakville for a position with the

municipality. Chitra thanked the SPC for this opportunity and ERCA for all the experience and

knowledge she has gained.

Richard Wyma, General Manager/Secretary-Treasurer announced that there will be some changes

ahead for the Source Water Protection program. ERCA is currently working on a plan of action.

There will be ongoing policy and water quality work and risk management official (RMO) decisions

to be made. Although there are no definite answers yet, ERCA is working on a replacement for this

role. Mr. Wyma anticipates that the Chris Tasker, from the Thames Sydenham and Region will

provide guidance to ERCA for the interim until further decisions are made.

SUBJECT: Harrow-Colchester South, Pelee West Shore ICA and Threats Analysis

DATE: April 3, 2014

PREAMBLE

This report is a continuation of work started by Chitra Gowda beginning with SPC Report 03/13 dated

June 11, 2013 in which information was provided to the SPC concerning the work plan for technical work

related to Issue Contributing Areas (ICAs). The blue-green algae toxin ‘microcystin’ in Lake Erie was

identified as a drinking water quality issue in raw (untreated) water for all intakes within the Lake Erie

watershed in SPC Report 07/13 of August 6, 2013.

Under the Clean Water Act, once an issue such as 'microcystin' is identified, all activities that contribute to

‘microcystin’ are deemed significant drinking water threats (SDWT). Following issue identification, the

next step is the delineation of a phosphorous-based IPZ-3, delineation of an Issue Contributing Area

(ICA_) and development of policy related to the issue of microcystin.

SPC Report 10/13 provided information to the SPC about the technical work related to the phosphorus

(P) based IPZ-3, ICA and subsequent threats analysis for the Wheatley intake. Attached to SPC 10/13 was

the modelling report to support the delineation of P-based IPZ-3 and ICAs, undertaken by Chitra Gowda

and Toyese Sanni. IPZ-3 delineations for all four Lake Erie intakes and a draft Wheatley ICA were

presented to the SPC for information and discussion.

On December 16, 2013 SPC Report 12/13 was presented to provide information of ongoing technical

work related to the aforementioned Wheatley areas, the Union ICA and threats analysis for these areas.

PURPOSE

The purpose of this report is to provide information to the SPC about the technical work related to the

Harrow-Colchester South and Pelee Island West Shore Issues Contributing Areas (ICAs), and threats

analysis for these areas.

REPORT SUMMARY

Blue green algae toxin ‘microcystins’ in Lake Erie is identified as a drinking water quality issue, but has

not been formally presented in the updated Assessment Report

The phosphorus based IPZ-3s and ICAs within IPZ3s are being delineated for Lake Erie surface water

intakes serving the Essex Region Source Protection Area

Harrow-Colchester South intake ICA and Pelee Island West Shore ICA are delineated and

phosphorus contributing activities are identified within the ICA.

BACKGROUND

Per SPC Reports 10/13 and 12/13, draft Lake Erie IPZ-3 delineations were completed and presented to

the SPC for discussion purposes. The draft Wheatley ICA and two options for the Union ICA were also

presented for discussion purposes, along with a threats analysis showing numbers and types of

phosphorus contributing activities within the draft ICAs.

Draft ICA Delineation and Changes

Wheatley

The Thames Sydenham Region (TSR) SPC has yet to decide on ‘microcystins’ being a drinking water

quality issue at the Wheatley intakes. A meeting was held which included the Project Manager, SPC

Chair, John Stuart (as a Treatment Plan operator and Region SP Committee member), and Source

Protection staff from both the TSR and the Essex Region, along with staff from the Chatham PUC to

discuss various options related to microcystins and treatment of microcystins. . It should be noted that

because the Wheatley intake lies in the TSR Source Protection Area, the ERSPC cannot identify

microcystin an issue for the Wheatley intake if the TSR Committee determines it is not an issue. Map 1 is

attached as a reminder of the ICA delineations for the ERSPA and TSR.

Union

Per SPC Report SPC 12/13, it was noted that a preliminary technical review was conducted by the

Ministry of Environment (MOE). They appear to have some questions regarding the extents of the ICAs

within the defined IPZ-3 zones. ERSPC will work with MOE to review and respond to questions and

comments received and alternate considerations related to IPZ determination.

Maps 2 and 3 are attached as a reminder of the 2 options that were presented to the SPC in December

for the Union ICA. These were based on the modelling and actual data from the KLN sampling sites, and

the special monitoring program shown by the red circles numbered 15-20.

Harrow-Colchester South (H-CS)

Big Creek was modelled for the H-CS intake and was calibrated using an extensive ‘wet weather

monitoring’ dataset. This program, conducted by ERCA from 2008 to 2009, collected a large amount of

nutrient data at various locations along Big Creek (Map 4 attached). Simulated phosphorus concentrations

for the four inland monitoring sites (BC1-BC4) are shown in Map 4, along with the simulated phosphorus

concentration at the mouth of the marsh, 0.274 mg/L.

In addition, Cedar Creek had been modelled for the Union intake (Map 5) and was considered as a

source of phosphorus for the H-CS intake. Applying the Baird in-lake dilution factors to the phosphorus

concentrations at the mouth of Big and Cedar Creeks, the resultant concentrations for P fall below the

0.02 threshold for lake PWQO.

However, data for ‘microcystin’ has shown levels above the 1.50 ug/L standard in the raw (untreated)

water tested at the H-CS intake. Therefore the committee might be interested in applying an ICA in the

vicinity of the intake (Maps 6 and 7).

Pelee Island West Shore

Pelee Island has not been subject to surface water quality monitoring in the past, and unlike the other

Lake Erie surface water intakes, there were no supplemental studies undertaken last Fall to obtain any

new information. Therefore many of the physical parameters required as inputs for the Qual2K water

quality model were unavailable, in particular no sampling was done for phosphorus.

As described in SPC Report 07/13, the Pelee Island West Shore water treatment plant operator identified

‘microcystin’ as an operational concern. With phosphorus being the limiting nutrient for the growth of

‘microcystin’, the criteria determining the concentration in which phosphorus contributes to the issue is

present on Pelee Island (land use and soil). With these concerns in mind, the committee might be

interested in adopting an ICA in the vicinity of the intake. Two options are presented (Maps 8 and 9)

which are based on the 2 hour time of travel used for creation of the IPZ-2 vulnerable area. However in

the case of Pelee Island there are no outlets in the IPZ-2, with most of the inflow to the lake coming from

pumping stations (Map 10).

The tables in Figures 1 summarize the results of modelling and actual data for all the streams that were

being considered in the development of ICAs. This snapshot shows the phosphorus concentration above

the PWQO at the mouth of each stream (green bar at the left of chart), and the relative distance to the

intake (orange bar to the right of chart).

Threats Identification

The threats analysis comprised of mainly GIS desktop exercise, where 2013 aerial photography was

reviewed for land uses, categories (e.g. crops or livestock) and a threats database was set up to list the

identified phosphorus contributing activities from the prescribed list of threats under the Clean Water

Act. A summary of the threats for the Harrow-Colchester South options are provided in Table 1 below,

with the summary of threats for the Pelee Island West Shore options in Table 2.

POLICY DISCUSSIONS

In November 2013 (SPC11/13), Administration identified several policy options if microcystins are

determined to be a significant drinking water threats, including 'soft' non-regulatory policy tools under

Section 22(7) of the CWA and Regulation 287/07; as well as those Regulatory Policy Tools available

through land use planning, prescribed instruments, and the CWA Part IV. The report proposed policy

approaches for phosphorous contributing activities in the ICAs.

As noted above, the TSR SPC has not yet determined if microcystin is to be considered an issue in the

Wheatley intake, and as such, policy considerations have not yet been developed. The TSR CPC has

established a ‘Technical Advisory Committee’ to look at the ‘microcystin’ issue, and make

recommendations to the TSR SPC. It is proposed that the ER SPC identify a similar Technical Advisory

Committee to work with the TSR Committee in reviewing microcystin for all intakes based on the

modeling and information developed and discussed, and make a recommendation to the Essex Region

and TSR SPC.

RECOMMENDATION

THAT the SPC report 01/14 be received for information and discussion purposes; and further,

THAT the SPC establish a ‘Technical Advisory Committee’ to look at various methods to deal with the

‘microcystin’ issue with TSR Technical Advisory Committee.
