Executive summary

As of June 30, 2020, the overall physical progress for the MP-1 Package (Civil and Hydro-

Mechanical) stands at 55.56%, 78.50% for the MP-2 package (Electro-Mechanical works)

and 98% for the 132 kV Transmission Line works.

During the 1st Semi-annual Social Monitor Reporting Period (January to June month),

2020, BPC has completed disbursement of land development cost and restricted land

allowance to those affected household in second phase land acquisition stage. Two

Community Forest (CF) were affected by the 132 kV TL Right of Way where members

of Taktse CF and Eusa CF both were compensated with cash based on the enumeration

carried out by Trongsa Range Office, DoFPS. All of the above compensation were made

on July 13, 2020 at Drekteng Geog Office.

1.0 Introduction

1.1 Brief Project Descriptions

The Detailed Project Report (DPR) of the project was taken up on April 08, 2013 and

completed in September 2013. The scheme with the tail water from the 118 MW Nikachhu

Hydropower Project discharging into the reservoir of the Mangdechhu Hydro Power

Project was taken up for preparation of the DPR. The height of the Dam was increased

to provide 4 hours peaking capacity with installed capacity of 118 MW, with mean annual

generation of 491.52 GWh from Nikachhu Power House and 323.77 GWh additional

generation by Mangdechhu Power House on account of Nikachhu water. Druk Green

Power Corporation Limited in its 43rd Board Meeting held on September 26, 2013

approved the DPR. On March 4, 2014, the Royal Government of Bhutan (RGoB)

approved the DPR for implementation of the 118 MW Nikachhu Hydropower Project. The

formal approval of the RGoB was communicated by the Cabinet Secretariat vide letter

No.C-3/28/328 dated March 20, 2014. The EC is renewed and valid till August 11, 2021.

Druk Green Power Corporation is an Executing Agency for the project whereas

Tangsibji Hydro Energy Limited was incorporated on April 25, 2014 as Special Purpose

Vehicle (SPV), a 100 % subsidiary company under DGPC as Implementing Agency for

the project. For environment monitoring and compliance for the project construction

works, an Environment Unit was set under the Human Resource and Administration

Division. All measure set forth in ESIA and EMP are being implemented by THyE. The

Environmental Clearance (EC) for development of 118 MW Nikachhu Project was

accorded by National Environment Commission of Bhutan on July 01, 2014 and renewed

on August 12, 2016. The clearance is valid till August 11, 2021.

For the development of the 118 MW Nikachhu Hydro Power Project, a lease agreement

was signed with the Ministry of Economic Affairs on May 1, 2015. A total of 195.262 acres

of Government Reserve Forest Land were taken into lease for development of internal

access roads, muck disposal areas, colonies and contractor construction facilities. To

minimize the number of affected households, efforts were undertaken during the design

stage by relocating the Power House to its current location at Norbuodi (latitude

27°29'12.44"N and longitude 90°29'26.71"E) from Tangsibji village. Other additional

corporate social responsibility (CSR) activities are also carried out by THyE, besides

implementing CDPW in Resettlement Plan.

The ESIA, Environment Management Plan and Resettlement Plan of Nikachhu Project

was carried out by M/s Bhutan Consultants and Research (BHUCORE, M/s Price Water

Coppers (PWC) was recruited by Asian Development Bank (ADB) was in-charge of the

ESIA. The 118 MW Nikachhu Hydro Power Project is located in Trongsa Dzongkhag and

stretches over 25 km from the Dam at Lorim to the Power House at Norbuodi with a 12.14

km Head Race Tunnel (HRT) having five intermediate Adits. With the construction of a 38

m high dam, 12.28 acres of land will be impounded by 810 m water back-flow. The

Environmental Clearance (EC) for development of Nikachhu Project and 132kv

Transmission Line was obtained from National Environment Commission of Bhutan on

July 01, 2014 and November 28, 2014 respectively. With an estimated energy generation

of 491.52 MU, 85 % shall be exported which will not only enable revenue generation for

Bhutan but also reduce Green House Gas emission in the neighboring countries by

replacement of fuel by clean and renewable energy, hydropower. Further, the outflow

from the Nikachhu Project into Mangdechhu reservoir provides additional energy

generation of 323.77 MU to Mangdechhu Hydro Electric Project.

1.2 Project Progress Status and Implementation Schedule

Physical Progress for MP-1 Package Works

As on June 30, 2020, the physical progress for Head Works (Dam, Feeder Tunnel, DC

and SFT) stands at 66.2%, HRT at 64.8%, Power House Complex (SS, BVC, PS, PH,

TFC, TRT) at 49.4% and Hydro-Mechanical works at 22%. Overall physical progress for

MP-1 Package (Civil & HM works) stands completed up to 55.56 %.

stringing of 16.4 km of Transmission Line along with 5.494 km of OPGW (Optical Ground

Wire) out of 18.6 km also stands completed as on June 30, 2020.

The total payment amounting to Nu. 355 million (including advance) stands released by

THyE to BPC till date (including 10% advance above).

5.0 Land Acquisition Status

As per the ADB involuntary resettlement category, 118 MW Nikachhu Hydro Power

Project is classified as Category B. There were no significant involuntary resettlement

impacts. Over all, efforts were made during planning and design stage to minimize

involuntary resettlement impact. For the development of the project component such

as Colonies, Contractor Construction Facility, Muck yard, total area of 195.262 acres

of Government Reserve Forest Land were taken on lease. Lease agreement was

signed on May 1, 2015 with Ministry of Economic Affairs (MoEA). Prior to ADB loan

disbursement, construction work for access road of 18.388 km in length, colonies and

water supply line began in December 2014 and the respective infrastructure facility

was handed over to the contractor by end of 2015.

The construction of the project component such as access road and muck yard has

displaced 16 household (11 household originally by access road in phase one, 3

additional household by access road in second phase, 2 household by muck yard in

third phase land acquisition and substitution stage) and has acquired 8.459 acres

(3.577 acres in first phase, 3.882 acre in second phase and 1 acres by muck yard in

third phase land acquisition stage) of private land in Tangsibji Geog. Whereas 132 kV

TL tower footing has displaced 4 household in first phase acquiring 0.40 acres and 7

household as of December 31,2019 acquiring 0.820 acres of private land.

5.1 Land Acquisition by Main Pproject Ccomponent

3.577 acres of private land belonging to 11 households and one CPR was affected by

the construction of access road. The entire affected person opted for land for land

substitute and land substitute of the same area is provided along with the land

development cost as per Land Act of Bhutan (2007). List of project affected person is

attached as Annexure-I A and disbursement sheet on land development cost is

attached as Annexure-I B respectively for phase 1 land acquisition stage.

In addition, 3 new household were affected after completion of the access road works,

acquiring additional 3.882 acres of land in Tangsibji Geog. Detail list of the additional

affected area and project displaced household for the second phase land acquisition

is attached as Annexure-II A and as Annexure-II B. On the other hand, an addition

of 1 acre was acquired during development of muck disposal yard at Intermediate

Pressure Shaft. Two (2) household were affected by the development of muck yard.

The land development cost and land substitute are provided as per the entitlement

matrix of the resettlement plan. The detail of the project Displaced household and land

development cost sheet is attached as Annexure-III A and as Annexure-III B.

5.2 Land Acquisition by 132 kV DC Transmission Line

The 132 kV Transmission Line will stretch 18.2 Km from the pothead yard of Nikachhu

Hydro Power Project to power house of 720 MW Mangdechhu Hydro Power Project

located at Yurmung. Before beginning of the construction work for 132 kV DC

Transmission Line, cadastral survey work was awarded to Dzongkhag Administration

in October 2015 as deposit work. In 2017, DLC concluded that 0.4 acres of land will

be acquired affecting only 4 household from Drakteng Geog by 132 kV Transmission

Tower Footing. List of the affected person is attached as annexure-IV A and

disbursement sheet for land development and restricted land use allowance is

attached as annexure-IV B.

The MoU was signed with BPC on July 14, 2014 for an amount of Nu.233 million for

the construction of 18.6 Km, 132 kV DC line from Nikachhu Pothead yard to

Mangdechhu Pothead yard with the work to commence from June, 2016 including

tendering work by BPC. With start of the construction work for 132 kV DC

Transmission Line, BPC has been taking up all matters related to any additional land

acquisition and substitution works. Detail geotechnical survey was carried out prior to

construction stage by CDCL in August 2018, 9 tower footing were required to be

relocated. To avoid unnecessary encroachment of land, joint monitoring was carried

out with BPC, CDCL, THyE and local government on March 9, 2018. On September

3, 2018, BPC awarded cadastral survey work to Dzongkhag Administration as deposit

work for land substitution. List of additional affected household is listed as Annexure-

V.

To obtain the consensus from the additional 7 affected household, entitlements and

land substitution as per the Royal Government of Bhutan Rules, BPC had carried out

consultation meeting on October 2, 2018 at Geog conference hall, Drakteng Geog.

The consultation was done in presence of all affected household, representatives from

Dzongkhag, Geog, CDCL and BPC. The entire affected household unanimously opted

for land for land substitution. No crop or fruit bearing tree will be affected. Minute of

the meeting is attached as Annexure-V. However, to ascertain actual affected person

in second phase by the Transmission Line, Dzongkhag Land Record and Survey,

BPC, THyE has carried out cadastral survey along the Transmission Line on

September 13, 2019. Following are the list of affected persons by TL tower footing:

With reference to above attributed table, only 7 household is being affected by 132 kV

TL tower footings and only 0.82 acres is being acquired in second phase land

acquisition stage. During the Detail Measurement Survey carried out by DLC,

Jamtsho, Pema Wangchuk, Kuenzang Lhamo were not affected by the Tower footing

number AP 48, AP 23, AP 46 respectively. The detail of list of the second phase land

acquisition is attached as Annexure-VI and the details on the land development cost

and Restricted Land Use allowance for the same second phase land acquisition phase

is attached as Annexure-VIII.

The land development cost and restricted land use allowance was disbursed to the 7

affected persons on July 13, 2020 at Drakteng Geog Office. Copy of the disbursement

sheets are attached as Annexure-IX. With completion of clearing of Right of Way (27

m width, 15 km length) other than AP12, AP 13, AP 18 and AP 21, these tower Right

of Way falling in the Community Forest (Taktse and Eusa Community Forest) , of which

a total of 8.388 acres of vegetation will be cleared.

As per the Minutes of Meeting drawn with Gup, Drakteng Goeg, members of the above

two CF and BPC on November 2, 2019, Trongsa Range Office has raise the

compensation aspect on behalf of the affected CF. During the assessment carried out

by Trongsa range Office, 670.00 number of trees has been marked for removal. The

compensation of the tree removal was estimated by the Trongsa Range Office based

on the commercial rate for standing tree as prescribed in Royalty for Forest Produce,

Forest and Nature Conservation Rule 2017. The two CF were compensated with Nu.

118,412.00 (Ngultum One Hundred Eighteen Thousand, Four Hundred Twelve) only

on July 13, 2020 at Drakteng Geog Office. Copy of the disbursement sheet are

attached as Annexure-X. Joint site visit was also carried out by Managing Director of

THyE, BPC and CDCL on May 5, 2020 along the 132 kV Transmission Line.

6.0 Meaningful Consultation and Grievance Redressed

The Grievance Redressal Committee (GRC) was activated on October 07, 2016 to

discuss vital functions and role of the committee. Locals having grievance can either

lodge a complaint to THyE or through a proper channel with the existing local

committee (Chiwog to Geog Administration for deliberation with THyE). The GRC is

responsible for receiving the complaints on environmental issues and its impact

assessment. If the person making the complaint is not satisfied on the decision made

by the GRC, he/she can register the grievance to higher authority such as Geog

Tsogde and Dzongkhag Tsogdue.

During the 1 SMR, no consultation has been carried out as there was no complaint

received by THyE from the stakeholders.

Tsheringma Drupchhu Restoration Programme

THyE will restore the existing Sale Outlet located at Tseringma Drupchu area and also

facilities such as toilet, tap and view point will be developed. In addition, for long term

restoration of Tsheringma Drupchhu, an alternate source from locally popular one known

as Kheyjey Tangjey (Drupchhu) will be diverted to the existing reservoir tank of

Tseringma Drupchhu. For this, THyE and local government of Tangsibji Geog have

carried out consultation meeting with the 65 Household of Tangsibji Geog on January 17,

2020. Copy of the Minutes of Meeting is attached under supporting documents.

As part of improving the sale of agriculture products, packing and food services at the

Sale Outlet, Social Expert has also advised THyE to take up training to the vendors with

Bhutan Food Regulatory Authority. However, due to COVID-19 and placement of

lockdown, the training to the vendors are temporarily suspended. Site visit at the

Tsheringma Drupchhu are was also made with Gup of Tangsibji Geog on May 15, 2020.

Discussion were made on restoration of existing sale outlet, toilets, lighting and water

supply source with an objective to revive sale of dairy and agriculture products. Design

and cost estimate are being prepared for the infrastructure in Tsheringma Drupchhu area.

8.0 Conclusion

The main project component has acquired 8.459 acres of private land and has affected

sixteen (16) Household in Tangsibji Geog. During the second phase land acquisition stage

7 households were affected by the 132 kV Transmission Tower Footings works. As part

of meeting the statutory requirement of the National and ADB SPS (2009), Land

Development Cost, Restricted Land Use Allowance was disbursed to the affected

household and also affected Community Forests was also compensated on July 13, 2020.

All the affected household who opted for land substituted will be awarded new Thram by

Responsibility such as development of roads, institutions such as Early Child Care Centre

in project areas. Moreover, the Basic Health Unit at Tashiling was also provided with new
