6. If we/I fail to commence the work specified above and to give our/my confirmation of

acceptance of work in writing within fifteen (15) days of being asked to do so, we/I agree that the

Corporation shall be, without prejudice to any other right or remedy, at liberty to forfeit the entire

Earnest Money without reference to us/me. Otherwise, the said Earnest Money shall be reverted

by the Corporation towards Security Deposit. We/I agree that the Corporation will forfeit the

Earnest Money if the offer given is modified/ withdrawn within the validity period or extended

period by us/me.

PART – I : INSTRUCTION TO TENDERERS

6. GENERAL:

The Tender should be addressed to the officer who invited the tenders. Any offer made in

response to this tender, when accepted by the Cement Corporation of India Ltd., will constitute

a contract between the parties.

2. SUBMISSION OF TENDER:

6. Every tender shall be made out in English. All amounts shall be indicated by the tenderer

in figures as in words there is any difference between prices quoted in figures and in words

lower of the two shall prevail. Tender should be free from over writings. All corrections and

alternations should be duly attested by the Tenderer. The word “NOT QUOTED” should

be written against items in the schedule for which the tenderer does not wish to quote.

B) This is to be sent by post or deposited in the tender box kept for this purpose in the office of

CCI so as to be available within the due date and time fixed, in a sealed envelope in the manner

prescribed below:-

6. Commercial terms & conditions should be sent in a separate sealed cover and should be

super scribed as “COMMERCIAL BIDS”.

ii) The Price portion should be sent in a separate sealed cover and should be super scribed “PRICE

BID”.

iii) Both these sealed covers should be sent in a separate sealed cover and all the envelope should

be marked as under:-

iv) In the event of the tender being submitted by a firm, it must be signed separately by each partner

thereof. In the event of absence of any partner, it must be signed on his behalf by a partner

holding power of Attorney authorizing him to do so.

v) In the case of company, the tenderer should in the manner as laid down in the “Company’s

Articles of Association”.

vi) A true copy of a company of the partnership Deed/Articles of Memorandum of Company duly

attested should furnish.

vii) Tenders received after specified time and date are liable for rejection.

C) Tenders not submitted in the prescribed format and not complete in all respects are likely to be

rejected.

D) Tender documents are non-transferable. Only those firms can participate in whose names the

tenders have been sold.

E) The tender with terms & conditions in Part – I, II & III duly signed and sealed on each page

shall be sent along with the Earnest Money Deposit with a covering letter as prescribed. Earnest

Money Deposit shall not be kept in the PRICE BID, but shall be enclosed with the

“COMMERCIAL BID”.

F) Tenderers shall not be entitled to claim any costs, charges expenses or incidentals in connection

with the preparation and submission of their tenders even through the Corporation may decide

to withdraw the “Invitation of Tender” or reject any/all tender(s) without assigning any reason

thereof.

G) a) Photocopy of the PAN CARD is required to be submitted alongwith the commercial bid.

b) Self Attested photocopy of the letter of allotment of Service Tax Registration

no. for the relevant work.

c) The bidder shall have a valid bank account number and shall provide the account details in

the technical bid. Payment for the contract will be paid only through NEFT / RTGS mode.

d) The bidder shall have valid PAN Number; income tax will be deducted at source as per the prevailing Income Tax rules. Documentary evidence in this regard shall be submitted with technical bid.

3. OPENING OF TENDER:

6. Tender will be opened on the specified date and time in the office of the officer inviting the

tender or as directed by him, in the presence of such of those tenderers who may choose to

be present. The representatives will have to establish their identity to the satisfaction of the

Corporation by producing introductory letters from the firm/company; otherwise they may

not be allowed to be present at the tender opening. If specific date of Tender opening falls

under holiday/ bandhs etc. then the same will be open in next working day.

B) The tenders, which are not received in separate cover, as explained above, are liable for

rejection.

4. CLEAR UNDERSTANDING:

When a tenderer submitted his tender in response to the tender document he will be deemed to

have under stood fully about the requirement, terms & conditions. No extra payment will be

made or any other claim whatsoever entertained on the pretext that the tenderer did not have a

clear idea of any particular point(s).

Tenders shall remain open for acceptance for four (04) months or as be specified from the actual

date of opening of commercial bid. No revision/modification on the tendered rate will be

allowed during the period of original validity of tenderer the extended period except for any

reduction/revision as may be asked for specifically by CCI during negotiations.

6. AWARD OF CONTRACT:

6. To accept in its sole and unfettered discretion any tenderer for whole or part quantities/part

work or to reject any or all tenders without assigning any reasons therefore and without

entitling the tenderer to any claims whatsoever.

ii) To award the contract to one or more number of firms, either on equal price or on different

prices i.e.(70:30).

iii) To enter into parallel contracts simultaneously or at any time during the period of contract with

one or more tender(s) as the Corporation may deem fit.

B. If no separate agreement has been signed by the parties to the contract, the LOI/Order resulting

this tender including all negotiations and detailed order to be issued subsequently, with its terms

& conditions and stipulations as agreed to by the tenderer and to the extent modified during

negotiation, constitutes the contract agreement relating to the work between the successful

tenderer and the Corporation and the parties shall be bound by the terms & conditions and all

provisions of this contract.

C. The Corporation does not bind itself to accept the lowest or any tender or to assign any reason

for non-acceptance of the same.

D. The Corporation shall mean and include the administrative and executive officers of its

Corporate Office at New Delhi as well as of factories/projects as the case may be who are

identified to deal with matter relating to this contract on its behalf.

liable for rejection.

PART – II : GENERAL TERMS & CONDITIONS

6.1 EARNEST MONEY DEPOSIT: -

6.1 All tenderers including those registered with the Corporation should furnish Earnest Money Deposit by

way of RTGS/NEFT in favor of Cement Corporation of India Ltd., at STATE BANK OF

HYDERABAD,KARANKOTE (CODE NO.- 20446). Any other money held by or pending with the

corporation against any other contract will not be adjusted/ treated as EMD for this tender.

1.2 Earnest Money will be forfeited if the rates are revised or modified upwards during the validity

period or extended period. Earnest Money will also be forfeited if within 30 days of the written

orders asking the contractor to start the work but work not started after acceptance of the

tenderers offer by CCI.

1.3 If work is not started after acceptance of tender/offer and depositing of security deposit, the

EMD will be forfeited.

1.4 The Earnest Money Deposit will not bear any interest. For unsuccessful of the tenderer the

EMD will be refunded immediately after finalization of the tender.

1.5 The Earnest Money Deposit of successful tenderers deposited in the form of RTGS would be

adjusted towards the portion of the Security Deposit and that of others will be refunded, except

in the cases mentioned in 1.2 above.

1.6 Public Sector Undertakings (Central/State) and SSI Units registered with NSIC are exempted from

submission of Earnest Money Deposit. The SSI Units shall furnish a documentary proof to the

effect that they are registered with NSIC along with the tender document.

2.0 SECURITY DEPOSIT: -

2.1 Security Deposit shall be deducted from the successful tenderers. It may be recovered by

deductions from the running bill of the contractors at the rate mentioned below and the earnest

money paid at the time of tender will be adjusted towards a portion of the security deposit:

6. 10% on first 1.0 lakhs from contractor’s bill.

b) 7.5% on next 1.0 lakhs from contractor’s bill.

c) 5% on balance payable subject to a maximum of total of 5.0 lakhs including adjustment

of EMD to Security Deposit.

2.2 The security deposit may be made either by RTGS/NEFT in favors of Cement Corporation of

India Ltd., Tandur (Branch Code No.- 20446) from a scheduled Bank in the prescribed form valid for

a period of 6 (Six) months beyond the date of completion of contract.

2.3 The Security Deposit shall be liable to forfeited wholly or partly at the sole discretion of the

Corporation, should the successful tenderer either fail to complete the jobs assigned to

him/them as per agreed time schedule or to fulfill his/their contractual obligations or to settle

in full his/their dues to the Corporation.

2.4 The security deposit will not bear any interest. The Corporation reserves the right to adjust

Security Deposit towards any amount due to it from the successful tenderer and in such an event

the successful tenderer on receipt of notice from the Corporation shall make, further deposit to

restore the Security Deposit to the full amount.

2.5 The Corporation is empowered to deduct from the Security Deposit or from any other

outstanding amount any sum that may be due and payable to the Corporation as being the

amount of loss or losses or damages suffered by it due to delay in performance or non-

performance of any of the conditions of the tender/contract. The Corporation will, however not

be bound to prove any demonstrable loss or damages suffered.

2.6 Security Deposit will be refunded within Three (03) months from the date of completion of the

contract for which the contractor has to apply for refund of Security Deposit with no claim

certificate to concerned department to obtain administrative approval of competent authority

with all dues/ no dues certificate from various departments to be obtained by executing

department.

2.7 In the event of any approved upward revisions in the value of the contract, the successful

tenderer will, on receiving intimation shall make further deposit as specified by the Corporation

towards the increased value of the contract.

2.8 The Corporation shall have a lien over all or any money that may become due and payable to the

contractor and unless the contractor pays and clears the dues immediately on demand, the

Corporation shall be entitled at all times to deduct the said sum due from the contractor from

money/security deposit which may have become payable to the contractor or may become due at

any future date between the contractor and the other of Corporation under this contract or under any

other contract without prejudice and in addition to the other rights of the Corporation to recover the

amount or any claim by other remedies legally available.

2.9 Bank Guarantee as required under this contract or agreed to against any advance made by the

Corporation/contract performance/equipment performance/guarantee etc., shall be extended by

the contractor whenever so required by the Corporation and without any question for covering

the period of completion & finalization of work, performance etc. Contractor’s failure to do so,

shall entitle the Corporation to en cash the BG towards any dues, recoveries, LD, non-

performance etc.

3.0 MEMBER OF THE CORPORATION NOT INDIVIDUALLY LIABLE: -

No Director or official or employee of the Corporation shall in any way be personally bound or

liable for acts or obligation of the Corporation under the contract or answerable for any default

or omission in observance or performance of any the acts, matters or things, which are herein,

contained.

4.0 CORPORATION NOT BOUND BY PERSONAL REPRESENTATIVE: -

The contractor shall not be entitled to any increase in the rates or any other right or claim

whatsoever by reason of any representation, explanation or statement or alleged representation,

promise or assurance given or alleged to have been given to him by any employees of the

Corporation.

5.0 NON-PERFORMANCE OF CONTRACT/CANCELLATION OR CONTRACT/RIGHT OF THE

CORPORATION: -

5.1 The Corporation reserves the right to cancel the contract if the contractor fails to carry out the

jobs assigned to him as per contract and as per instructions given by authorized representative

of the Corporation. In addition, corporation may also take any other remedial measures, in such

event, as described hereunder.

5.2 Any bribe, commission, gift or advantage given, promised or offered by or on behalf of the

tenderers, their partners agents or servants to any officer, servant or representative of the

Corporation for obtaining or for execution of this or any other contract for receiving payments

under the contract will subject the tenderer to cancellation of this or any other contracts and

also to payment of any loss resulting from any such cancellation and the Corporation shall be

entitled to deduct the amount so payable from any moneys otherwise due to the tenderer under

this or any other contract. Any question or disputed as to whether the tenderers have incurred

any liability under the clause shall be settled by the Corporation in such a manner and in such

evidence or information as it may deem fit and sufficient and the Corporation’s decision in this

regard shall be final and conclusive.

5.3 In case of any compelling circumstance or for any other reasons and in the opinion of the

Corporation, the contract needs to be determined and terminated at any stage during the

execution. The Corporation shall be entitled to do so, given one month’s notice in writing. In

such an eventuality, no compensation whatsoever for any arrangement made by the contractor

or for any liability incurred by him for any consequential loss will be payable by the

Corporation except the payment for work actually done at contracted rates after marking good

all dues, recoveries, LD if any etc., CCI also reserves right to suspend the contract for any

compelling reasons if in the opinion of the Corporation it is so required. In such an eventuality,

the time of completion will be extended to the extent of suspension period but no claim

whatsoever for any damages, increase in rates, role/wages/machinery etc. will be payable to the

contractor.

If the performance of the contract is not found to be satisfactory at any stage during operation of

contract including extended period if any due to non-deployment of additional equipments in

working condition or due to any other reason subject to force majeure conditions (clause No. 9

of Part – II). The Corporation reserves the right to get the balance job executed engaging alternate

source at the risk, responsibility and cost of the contractor.

6.0 SUB-LETTING OF CONTRACT: -

6.1 The contractor shall not subject or assign this contract or any part thereof without obtaining

prior written permission of the Corporation. In the event of the contractor sub-letting or

assigning the contract or any part thereof without such permission, the Corporation shall have

the right to rescind the contract and the contractor shall be liable to the Corporation for any loss

or damage, which the Corporation may sustain in consequences or arising out of such

cancellation.

6.2 Even in case sub-letting is permitted by the Corporation, the party to whom sub-letting is proposed

will be subject to approval of the Corporation. However, the Corporation will not recognize any

contractual obligations with the persons or party to whom the contract has been subject and all

liabilities, damages, losses, costs, charges and expenses arising out of such sub-letting either

statutory or non-statutory shall be to the account of the contractor and the contractor shall keep

the Corporation fully indemnified and harmless in this behalf. Further, notwithstanding the sub-

letting of the contract, the contractor shall be fully responsible to the contract.

7.0 COMPLIANCE OF RULES & REGULATIONS: -

7.1 The contractor shall observe all the rules/regulations of the Central and State Govt. and the local

authorities as relating to that work and shall pay all taxes (road taxes, passenger, goods tax, toll tax,

service tax, entry tax etc.) as levied by the authorities. If any breach of the said

rules/regulations/orders is committed by him, he shall be solely responsible for the same.

7.2 All persons employed by the contractor including drivers and cleaners of the trucks, tailors,

machinery operators etc., shall be instructed by the contractor to observe strictly all the safety

regulations prescribed, either generally or by CCI, whilst they are in the premises of the

Factory/Mines or the colony or on road and if any person commits breach of any of the

regulations, it shall be open to the Corporation to disqualify the person from entering the

precincts of the factory/mines or the colony. The contractor shall be bound to comply with such

instructions forthwith.

7.3 The contractor shall abide by the contract labour (Regulation and Abolition) Act, 1970 and

shall keep the Corporation indemnified and harmless against costs and consequences of his

non-compliance.

7.4 If any damage is caused to any property or injury is caused to or the death occurs of any person in the

precinct of the Factory/Mines or the colony or anywhere else due to any act of any person employed

by the contractor or through any machinery or active ties, the contractor will be liable for

damages/compensation in respect thereof and shall indemnify the Corporation and keep the

Corporation indemnified against any losses, damages, costs, charges, expenses and all liability of

whatever nature and kind which the Corporation may incur, sustain suffer or be put in consequence

or by any reason of such damages, injury or loss of life.

7.5 If any damages are caused to any of the contractor’s vehicles/belongs/equipments/

machinery/materials/establishment etc. or any injury is caused to or death occurs of any person

employed by him in connection with the performance of this contract, due to negligence of any person

employed by him for otherwise, the Corporation shall not be liable for damages or compensation in

respect thereof under the workmen’s compensation Act or otherwise.

7.6 The contractor will comply will all statutory requirements including but not limited to PF &

ESIC etc. for the personnel employed by him.

8.0 CHANGES IN CONSTITUTION:-

8.1 Where the contractor is a partnership firm, a new partner shall not be introduced in the firm except

with the previous consent in writing of the Corporation which may be granted only upon furnishing

of written undertaking by the partner to perform the contract and accept all liabilities incurred by

the firm under the contract period to the date of such undertaking.

8.2 On the death or retirement of any partner of the contractor, firm before complete execution and

performance of the contract, the Corporation may its option, rescind the contract and in such

case contractor shall no claim whatsoever to Corporation of any kind, consequential loss etc.

against the Corporation.

8.3 Without prejudice to any of the rights or remedies under this contract, if the contractor is a

proprietorship concern and the proprietor dies during the subsistence of the contract, the

Corporation shall have the option to terminate the contract without paying compensation of any

kind, consequential loss etc. to any claimant i.e. legal heirs and successors.

9.0 FORCE MAJEURE CONDITIONS:-

9.1 If at any time during the continuance of the agreement/contract, if becomes impossible by

reasons of war, or war like operations, strikes, lock-outs riots, civil commotion, epidemical

sickness, pestilence, earthquake, fire, storm or floods, the contractor shall, during the

continuance of such contingencies not be bound to execute the contract during this period as

per agreement/contract time schedule. The work shall be resumed immediately the contingency

(ies) has/have ceased or otherwise determined and contractor’s obligations shall continue to be

in force for correspondingly extended period after the resumption of execution. The contractor

shall, however, inform the corporation by registered post about such acts at the beginning and

end of the above caused of delay within ten (10) days of occurrence and cessation of such force

majeure conditions.

9.2 In the event of delay in performance of Corporation work, if arising out of causes of force majeure,

the Corporation reserves the right to cancel the contract without any compensation, whatsoever

and/or any consequential loss etc.

9.3 Only events of force majeure which affect the work at the time of is occurrence shall be taken in to

cognizance. The Corporation shall not be liable to pay any extra costs or increased rates due to delay(s)

under force majeure conditions. Only appropriate extension of time will be granted.

10.0 NOTICE:-

Any notice hereunder may be served on the contractor by registered post/mail at his last known

address. Proof of issue of any such notice at this address shall be conclusive proof of having

received the notice by the contractor.

11.0 DISPUTE UNDER THIS CONTRACT & ARBITRATION:-

11.1 “In the event of any question/dispute, breach of or difference arising in respect of the meaning

and scope of terms & conditions herein or in connection with any matter under this agreement

(except for those matter which are to be decided as per provision made in these terms &

conditions), the same shall be referred to the Chairman-Cum-Managing Director of Cement

Corporation of India Ltd. For appointment of sole Arbitrator. There will be no objection if the

arbitrator so appointed is or was an employee of the Corporation and whether he had at any

time in discharge of his duties as an employee had expressed views on all or any of the matters

in dispute or difference or dealt with the matter in substance.

The Arbitrator shall give award with reasons in respect of each claim, dispute or difference

referred to him in the event the value of the dispute(s) exceeds 50,000/- .The award of the

Arbitrator shall be final and binding on the parties to this contract”.

11.2 Subject to aforesaid, the Arbitration and Conciliation Act, 1996 and the rules made there under

and any statutory modifications thereof for the time being in force shall apply to the arbitration

proceedings under this clause.

11.3 The work, under the contract shall be continued uninterrupted during the pendency of the

Arbitration proceedings and no payment due from one to the other parties therein shall be

withheld on account of pendency of such proceedings unless such payment related to the matter

under arbitration.

11.4 The venue of the arbitration shall be Tandur/Hyderabad or such other place as the arbitral

tribunal at his discretion may determine.

12.0 JURISDICTION:-

It is hereby agreed by the parties hitherto that only courts at Tandur/Hyderabad shall have the

jurisdiction to decide or adjudicate upon any disputes, which may arise out of or be in

connection with this agreement.

13.0 LAWS GOVERNING THE CONTRACT:-

This contract shall be governed by the laws of Union of India in force.

14.0 WAIVER TO IMPAIR THE RIGHTS OF THE CORPORATION:-

Any delay in exercising or omission to exercise any right, power or remedy acquiring to the

Corporation upon any delay/default under this contract shall not impair any such right, power

or remedy or shall be construed to be a wavier thereof or any acquiescence in such default nor

shall any action or inaction of the Corporation in respect of any such default or inaction any

acquiescence by it in any defaults affect or impair any right, power or remedy of the

Corporation, in respect of any other default.

15.0 CONDITIONS GIVEN BY THE TENDERER:-

With, the acceptance of this contract with all its terms & conditions, the contractor waives all

and of their conditions.

16.0 In the event of negotiations, only down ward revision of rates will be allowed. Any change in

techno-commercial terms, as agreed earlier, will not be permitted at this stage. Hence, any

qualifying remarks in the price bid/revised/negotiated offer will not be entertained.

17.0 REFUND OF SECURITY DEPOSIT:-

The security of the contractor will be refunded within Three (03) months of the satisfactory

completion of the contract to be certified by executing deptt., in proper format applicable for

this purpose.

1.0 SCOPE OF WORK AND RELATED CONDITION:-

6.1 Details of Diesel vehicles for normal usage is considered for running per month is as

follows :

1.3 Normal usage of the vehicle 24 hours. 1.4 The contract will be for periods of 1 year from the date of commencement of the

contract i.e. date of deployment of vehicles. However, the term of engagement may be extended by one year on the same terms & condition, rates, etc. on mutual consent basis provided the services are found to be satisfactory.

1.5 The contractor shall be responsible for payment of compensation to his worker or supervisor in

case of accident. In case he fails to give compensation, the Corporation reserves the right to make

payment and recover the same from any of the bills or from security deposit. Moreover, the

contractor has to give medical coverage in case of accident/otherwise. The contractor shall make

arrangement for provision for workers compensation policy, insurance policy for the workers

engaged by him for covering compensation for fatal accident or accident involving permanent

disabilities.

6.1 The requirement of number of vehicles may be increased or decreased.

2.1 After entering into the contract, the vehicles identified for CCI Tandur Cement Factory

contract shall be at sole disposal of CCI Tandur only and shall not be let or sublet to

others. If any vehicle required to be replaced in special conditions, it shall be replaced

with the same vehicle with same model.

2.2 The service of vehicles is to be provided round the clock 24 hours.

2.3 In the event of the breakdown/maintenance of the vehicle, alternative arrangement of similar vehicle shall be made within reasonable time by the contractor. In the event of contractor failing to provide the vehicle as above, CCI Tandur shall be at liberty to make alternative arrangements, the expenditure for such arrangements and for the loss / damage incurred by CCI Tandur Cement Factory as a result of such noncompliance will be deducted from the monthly running bill or security deposit of the contractor. CCI Tandur Cement Factory reserves the right to determine the cost of deduction at its sole discretion.

2.5 Dedicated vehicles and drivers must be provided since security passes / labels for CCI, are to be arranged by this office. Any change in vehicle or drivers will be allowed only in exceptional circumstances and that too with prior information / approval.

2.6 The vehicles will normally be utilized at Tandur Cement Factory/Mines /Tandur/AP

State,Telangana State &Karnataka State.

2.7 The vehicles deployed for the contract should not be owned by any employee of CCI

Tandur Cement Factory or their dependents. The ownership details of the vehicle to be submitted by the successful bidder before deployment and if there is any contravention of this clause, the contract will be terminated immediately and the Security Deposit will be forfeited.

2.8 Contractor shall have valid permit(s), fitness certificate, pollution under control

certificates, and any other certificates required in respect of the motor vehicle with comprehensive insurance.

2.9 Proof of having paid all taxes insurance etc. shall be furnished by the contractor as and when called for.

2.10 The vehicle deployed for the contract shall not more than 02 years old model and only

such vehicles are to be provided. 2.11 The vehicle should have been registered u/s 2(35) of the Motor Vehicles Act for

commercial use with RTO under taxi permit. Successful bidder shall submit documentary proof of the same before deployment.

2.12 The vehicle deployed shall be well maintained, in good running condition and road

worthy to ensure smooth and trouble free service during the entire contract period.

2.13 The deployment of vehicle shall be punctual always. Late reporting and absence will attract penalty as per clause 16 of Instructions to Bidders.

2.14 Any unauthorized journey undertaken by the driver / contractor during the contract period shall not be allowed.

2.15 While deploying the vehicle, the contractor shall always ensure the following:

a. Valid and relevant documents for the vehicle and driver viz., Registration Certificate, Tax paid Challan / endorsement, insurance PUC Certificate , fitness certificate, driving license, commercial use permit, emission test certificate etc.

b. Vehicle shall be in full preparedness for the full day service including the fuel in the

tank, preparedness of the driver and reasonable money with the driver for meeting

contingency requirements.

c. Vehicle should have Inter State Permit to travel AP ,TELANGANA &

KARNATAKA STATES.

d. Portable fire extinguisher in vehicle.

e. Service Tax registration number.

f. Mobile phone with the driver in working and charged condition.

g. A first aid kit in the vehicle.

h. Good upholstery for the seats and with cotton cloth covering on the top. The cotton

cloth shall be regularly washed and maintained in hygienic condition.

i. Vehicle washed daily and maintained cleanly both exteriors and interiors.

j. Essential minimum spares viz., fan belt, Stephaney (spare tyre) properly inflated, spare bulb & fuses, jack, standard tools and tackles to attend the emergencies.

2.16 Duties and responsibilities of the driver:

1. Driver shall have valid driving license for the type of vehicle and keep it updated

as when required.

2. Driver need to be punctual & well dressed always.

3. Consumption of alcohol by driver while on duty is strictly prohibited.

3.0 LOG BOOK ,& INSURANCE :-

1.1 A logbook shall be maintained by the contractor for the vehicle for entry of mileage travelled, in the manner decided by the Officer-In-Charge. In case of

defective odometer during a small specific period, the distance covered by vehicle for official purpose, shall be assessed by the Officer-In Charge whose

decision shall be final and binding. The defective odometer should be reported

to the OIC and should be replaced within seven days. Logbook shall have to be produced before the Officer- In-Charge regularly for observation and checking

etc. Non submission of logbook on regular basis shall be strictly viewed as violation of contract.

1.2 All vehicles shall have to run during Sundays/holidays as per the requirement of CCI. Monthly fixed charge of vehicles covers all these expenditures. There

is no provision for overtime or night stay for vehicles under this tender. For outstation duty beyond Tandur and in case the stay outside is more than 6 hours

an allowance of Rs.50/- per day will be paid . No extra payment for night stay etc. shall be allowed.

1.2.1 The contractor shall not assign and/or sublet the work or any part of it

to any other person or party. The bidder shall not sublet vehicles

deployed to Tandur Cement Factory any time during the entire contract

period. Instances found, if any, shall be viewed seriously and the contract is liable for termination and black listing of the contractor. No

correspondence shall be entertained in this regard and the decision taken by CCI Tandur is final and shall be binding on the contractor.

1.2.2 Only authorized staff attached to the contractor and driver nominated shall be allowed entry inside the premises of Tandur Cement Factory or any other premises during the course of contract. The successful bidder shall provide the details of the drivers and authorized representatives for this purpose before commencing the work.

1.2.3 The contractor shall ensure that all their vehicles under the contract are covered by a comprehensive insurance by a leading / reputed insurance provider. The insurance policy shall cover compensation for the loss / damage to the vehicle, driver and co passengers as well. Under no circumstance shall CCI Tandur be liable to compensate any loss / damage that may be caused to / by the vehicle while engaged in discharge of the contractor’s obligations under this contract.

1.2.4 As and when required clearance from RTO or any other authority

concerned and compliance of any other legal formalities connected with

the contract have to be arranged by contractor at his own cost. CCI Tandur Cement Factory will not take any responsibility and will not bear

any additional expenses in this regard.

1.2.5 Contractor will not be allowed to sale the vehicle deployed under this

contract without prior written permission of the CCI.

4.1 Two shift ( 16 hrs) off shall be provided once in a month for repair and maintenance

work etc

5.0 CONTRACTOR TO BE FULLY RESPONSIBLE IN CASE OF ACCIDENTS:-

5.1 Accidents during the course of the work shall be reported by the contractor /driver immediately to the officer-in-charge. Contractor shall submit detailed report of any

such accident or incident. The contractor will operate their vehicles entirely at

their own risk and CCI Tandur Cement Factory shall not be held responsible

for any damage / losses incurred both for the vehicle or persons traveling in

the vehicle any time.

5.2 The contractor at his own expense reinstate and make good to the satisfaction of Cement Corporation of India and pay compensation for any injury to any person, loss / damage occurred to any property or rights whatever including property and rights of Cement Corporation of India and its bona fide users of the vehicle, for the injury, loss /damage arising out of or in connection with or during the execution of the contract and further contractor shall indemnify the Tandur Cement Factory against all claims for CCI against Tandur Cement Factory or its bona fide users of the vehicle.

6.0 INSPECTION & CHECKING :-

CCI Tandur Cement Factory reserves the right to check the speedometer /odometer of the

deployed vehicle at any point of time and if it is found inaccurate / tampered, suitable

action deemed fit will be taken. Repeated offence may lead to termination of contract

and forfeiting of security deposit.

7.0 CLAIMS FOR COMPENSATION:-

Under no circumstances, whatsoever, shall the contractor be entitled to any

compensation from the Corporation on any account nor will the Corporation entertain

any claim for compensation except for the work done under this contract.

8.0 PENALTY:-

For supply of vehicle other than stipulated vehicle during the month including off- days, penalty per day at a rate of 1.5 times the normal rate (quoted monthly rate / no. of days of the month) shall be imposed. For late reporting of the vehicle: Rs.100/= per hour for each instance for the first three instances in a month, which will be Rs.200/= per hour per instance thereafter.

9.1 The actual taxi parking charges/toll charges incurred at check posts or any other places

will be reimbursed on production of actual receipt without any corrections or overwriting.

9.2 Proof of having paid all taxes insurance etc. shall be furnished by the contractor as

and when called for. 10.0 SUBMISSION & PAYMENT OF BILLS:-

The contractor shall submit the bill on monthly basis to HOD (P&A), Personnel deptt. Will check the

bill with MB record and forward to Finance Deptt. With note which shall be paid within 15 days on

receipt of Bill by Finance deptt. Payment will be made by A/c payee cheques only & the paying authority

is HOD (Finance), CCI Tandur. The settlement of bills shall be subject to deductions as may be

applicable under the rules and laws in vogue.

11.0 RATE:-

11.1 The rate quoted shall remain firm for the entire period from the date of award of contract

except for diesel price increase/decrease. The rate quoted shall monthly fixed charges

for Ashok Leyland/Tata Bus, Ashok Leyland/Tata Trucks,Mahindra/Commender jeep,

Swift Dzire,Tata Sumo Gold & Tata Sumo Ambulance and average mileage per litre .

11.2 The quoted price shall be inclusive of all expenses like payment to driver / staff, maintenance charges for vehicle, taxes, /PUC Certificate/ Insurance/fitness/ etc. except service tax , VAT and State entry tax.

11.3 The contractor may not add service tax liability in their quoted rates. Service Tax if applicable will

be borne by the Corporation.

11.4 Diesel shall be provided by the Corporation or reimbursed by the CCI and fuel

consumption shall be calculated as per Annexure – V.

12.0 Special Condition for Ashok Leyland / Tata Truck for use in MM deptt.:

1. To & fro Transportation of materials required for plant from different

places to CCI Tandur.

2. The engagement of the vehicle will be 24 hrs.

3. The Driver must be having HMV license and should be able to follow

instruction of the maintenance personnel to the last details.

4. The truck will not be allowed for any major repairs /maintenance in the

company garage. However minor repair with prior permission of the

authority may be allowed. No consumable spares will be allowed in

account of maintenance from CCI.

13.0 Requirement for Ashok Leyland/Tata Truck for Civil deptt.:

1. The self starter, clutch, Brakes, the front tow hook and the back tow hook

along with the grip of the tyres should be always in a very good condition.

2. The Driver must be having HMV license and should be able to follow

instruction of the maintenance personnel to the last details.

3. The truck must be placed inside the factory as and when required. If

required the truck may have to be placed for more than 12 hrs in stretch

during B/D emergencies.

4. The truck will not be allowed for any major repairs /maintenance in the

company garage. However minor repair with prior permission of the

authority may be allowed. No consumable spares will be allowed in

account of maintenance from CCI.

14.0 TERMINATION OF THE CONTRACT:-

The Corporation may terminate the contract at any time within their discretion, without

assigning any reason thereof by giving 15 (Fifteen) days notice and without any liability

to pay any compensation.

15.0 NOTICE:-

a) All notices, communications, references and complaint of the contractor addressed to

the General Manager of the Unit of the Corporation or to any official of the Corporation

concerning the work, shall be in writing only.

b) Any notice hereunder may be served on the contractor by Registered Post/Mail at his

last known address. Proof of issue of any such notice should be conclusive to the

contractor having been duly informed.
