2. The procedure for the grant of Langar permissions in

respect of Yatra 2014 will be as follows:

i) an LO will be given permission to set up only one Langar

in the Yatra area/ outside the Yatra area even if it has

been setting up two or more Langars during the past

Yatras;

ii) the LOs which have been setting up two or more Langars

in the Yatra area will be given permission to set up only

one Langar in the Yatra area at the place of their choosing

(this choice shall be limited to locations where the LO has

been setting up Langar in the past) This choice shall be

indicated by the LO in its reply to the EOI;

iii) The LO may be given permission to set up Langar at a

location which may be different from the place at which it

had been setting up Langars during the past Yatras;

iv) the LOs, to be shifted to new location in the Yatra area/

outside Yatra area, will be chosen in the following order –

the LOs which set up their Langars for the first time during

Yatra 2013, followed by those LOs which set up their

Langars for the first time during Yatra 2012 and so on;

v) Langar Permission shall be issued to the eligible LO for

setting up their Langar in the Yatra area or outside the

Yatra area provided:

a) the reply to the EOI is received by 22nd March 2014

latest;

b) the documents/ reply to the EOI is in order;

c) no fine/ disciplinary proceeding is pending against

the LO concerned

3. To enable us to timely issue the Permission Letters to the eligible LOs, for setting up Langars in the Yatra area/ outside the Yatra area, for Yatra 2014, we would request the LOs to send the following information/ documents afresh at the address mentioned above:

i) Name, full address and contact details of the Head of the LO.

ii) A copy of Terms and Conditions for setting up the Langar duly signed and accepted by the President/ Chairman/ Secretary of the LO/ NGO.

iii) A certified photocopy of the Registration Certificate of the NGO/ LO clearly showing the Date of Registration.

iv) Objectives of the Organization as per its Bye-laws/ Memorandum of Association, along with a certified copy of the Bye-Laws.

v) NoC obtained from the Camp Director(s) of the Camp(s) during Yatra 2012 and Yatra 2013.

vi) An affidavit by the President/ Chairman/ Secretary of the LO/ NGO that no criminal/ civil proceedings are lying against any member of the LO/ NGO in any Court/ Police/ any other Statutory authority.

4. The LO is further requested to deposit an amount of Rs. 10,000 (Rs. Ten thousand only) in the form of an Account Payee Demand Draft in favour of Shri Amarnathji Shrine Board. (in case, the LO has not taken refund of the deposit or the deposit has not been forfeited by SASB, the LO is not required to deposit Rs.

5. If it is decided to issue a Permission Letter in favour of the LO, the LO concerned will be timely informed so that the LO has at least 20 days time to send us the names, residential address, contact numbers, two passport size photographs, Compulsory Health Certificate, in respect of all the Sevadars to be deployed by the LO, issued by the doctors/ institutes nominated by the respective State Government along with an affidavit from the President/ Chairman/ Secretary of the LO listing the names of the Sewadars and affirming that:

i) he personally knows each Sewadar to possess a god moral character;

ii) none of the Sewadars has been involved in any criminal case;

iii) he will be personally responsible in case the Sewadar is found indulging in any incriminating/ immoral activity during the Yatra period; and

iv) the information furnished at clause (i) and (ii) is true to best of his knowledge an d belief.

SHRI AMARNATHJI SHRINE BOARD (SASB)

TERMS AND CONDITIONS FOR RUNNING THE FREE LANGAR SERVICE

DURING YATRA 2014.

1. In case the LO is accorded permission to set up its Langar at Baltal/ Chandanwari/ Nuwan, it shall proceed to the designated location 10 days prior to the commencement of Yatra 2014. In case the LO is accorded permission to set up its Langar at any other location in the Yatra area i.e., at any location from Domail (excluding Domail) to Holy Cave and from Chandanwari (excluding Chandanwari) to Holy Cave, it shall proceed to the designated location 15 days prior to the commencement of the Yatra. The LO shall reach the designated location with the required material and a maximum of fifty Sewadars and contact the Camp Director nominated by SASB. The Camp Director will allot the site for establishing the Langar Service as per the pre-defined site plan. The LO shall not erect any permanent structure and establish Langars in double fly tents or temporary structures with adequate fire gap with the adjoining Langars, in consultation with the Camp Director. In no case, the pitching of polythene based or choldari tents would be permitted.

2. The LO shall install adequate fire-fighting equipment viz. 3 Soda acid fire extinguishers of 9 litres each and 3 foam fibre (FB 2) extinguishers of 9 litres each at site before commencing the cooking activities. Each LO will have to obtain an NoC from the Fire and Emergency Department, J&K to the effect that it possesses the aforesaid fire fighting equipment and has taken adequate measures to ensure preparedness for fire safety. In addition, the representatives of the State Fire Service Department/ SASB would be at liberty to inspect, in the presence of Camp Magistrate concerned and one authorized representative of BSF or CRPF to ascertain whether the LO has made adequate arrangements for fire fighting. The LO would be obliged to comply with the directions/ advice in this behalf.

3. The LO shall under no circumstances deploy more than fifty sewadars at any point of time during the period of Yatra.

4. The LO shall display the actual name and style in whose favour the Permission Letter has been issued, at a prominent place at the allotted Langar site, and shall under no circumstances sub-let the permission granted by the SASB or allow any commercial use by other private agency or change the location assigned to it.

5. The LO shall restrict its activities within the space allotted to it by the concerned Camp Director, SASB.

6. The LO shall submit all documents/ information to CEO, SASB required for issuing I-Cards to sewadars before the last date mentioned in the Permission Letter. In case the LO does not furnish the requisite documents to CEO, SASB before the last date mentioned in the Permission Letter, the Permission Letter shall stand cancelled. The Sewadars shall prominently display their Identity Cards issued by the SASB round their neck.

7. The LO shall maintain updated list of the inflammable materials like K. Oil, Ghee, Gas Cylinders, etc being stored at the designated site at all times.

8. The LO shall not under any circumstances, indulge in selling their left over provisions.

9. The LO shall not collect on spot donation during the entire period of Yatra, including the chadawa that may be received from Yatris when prayers are offered at the Langar site/ elsewhere in the Yatra area.

10. The LO shall keep 50 blankets or quilts of good quality earmarked as disaster management stores for immediate release on loan basis to SASB, as and when required

11. The LO shall not provide the facility for night stay to any Yatri on payment basis. They shall, however, make arrangements to house a minimum 10 sadhus/ poor persons per day.

12. The LO shall maintain proper hygiene and cleanliness around the Langar during Yatra and shall ensure that the area left by them at the conclusion of the Yatra is completely clean to avoid penal deductions from their Security Deposits. They shall also ensure that the cooks/ sewadars employed by them maintain proper hygiene and use disposable gloves while preparing/ serving food to the Yatris.

13. Each Langar/ Food Stall Owner/ Shop Owner, etc., should provide proper hand washing facilities for the Yatris at their allotted site.

14. The LO shall:

i) setup facilities for water filters for drinking water at their Langar sites, to avoid the use of plastic water bottles in the Yatra area

ii) not use plastic material/ utensils to serve food/ beverages to the Yatris. They shall also not bring water stored in plastic containers or plastic packaging material.

15. It shall be the responsibility of the LO to obtain required clearance/ permission, as and when required, from the Excise Sales Tax Department or any other statutory Authority or Government Agency in J&K, to get their provisions to the Langar site.

16. The sewadars/ other workers of the LO shall not indulge in any activity inimical to the interests of Shri Amarnathji Yatra/ Shri Amarnathji Shrine Board, or resulting in the disturbance of the law and order situation, including the consumption of liquor, tobacco and other intoxicating materials.

17. In view of the security scenario in the state and the sensitivity of the Shri Amarnathji Yatra, all the sewadars/supervisors/management at Langar site shall co-operate with all Law Enforcement Agencies.

18. In case the LO wishes to close down its activities prematurely, due to

unavoidable reasons, it would be allowed to do so, but only if the President of the LO requests personally in writing to the Camp Director, SASB with a Demand Draft @ 500/- per day for each day the Langar would not be

functional, and the permission to close the Langar is accorded by CEO, SASB.

19. The LO shall not organize any medical services in the Langar, except when specifically permitted by CEO, SASB, in writing.

20. The LO shall ensure that its sewadars wear the prescribed uniform, (to be provided by the LO) when on duty, during the entire period of Yatra.

21. The LO shall comply with all the directions which are issued for the smooth conduct of Yatra, by the Camp Director or any other senior functionary of the SASB from time to time, during the period of the Yatra and the LO shall comply with the such instructions/ guidelines as are issued from time to time by the CEO/ Additional CEO, SASB/ concerned Camp Director.

22. The LO shall, at its own cost, provide an Insurance Cover of at least Rs. One lakh to its sewadars deployed during the Yatra and in the event of any incident, accident, mishap, etc., resulting in death/ injury to any such staff/ sewadar, neither the LO shall raise any claim against the SASB nor the SASB would be liable to pay any compensation whatsoever.

23. The LO will secure No Objection Certificate (NOC) from the Camp Director before leaving the site/ camp. The NOC will form part of the eligibility for setting up of Langar in the next Yatra. The NOC shall be provided by the Camp Director after he: (i) ensures that the LO has returned all articles issued by the SASB to the LO; and, (ii) is satisfied that the LO has adequately cleaned the Langar site.

24. The LO shall display the prescribed Food Menu at prominent place at the Langar site. They shall serve food items which are strictly in accordance with the prescribed Food Menu and other guidelines, prescribed separately by CEO/ Addl. CEO, SASB, keeping in view the nutritional requirements of Yatris trekking at high altitudes and in difficult climatic conditions. To check adherence to the prescribed Food Menu and food quality, cleanliness etc, representatives of Food and Drug Control Department/ SASB may inspect the Langar in the presence of Camp Magistrate concerned and one authorized representative of BSF or CRPF and it shall be incumbent on the LOs to adhere to the instructions issued in this behalf by inspecting officials. No item mentioned under Banned Menu shall be served/ sold/ stored in the Yatra area to serve/ sell food/ beverages to the Yatris/ Service Providers.

25. Without prejudice to other provisions of the Terms and Conditions, a monitoring team comprising officials of Food & Drug Control Department and Camp Magistrate concerned (to be constituted by the Deputy Commissioner concerned) may visit to monitor whether the LO is: (i) adhering to the prescribed Food Menu, (ii) maintaining hygienic conditions around their Langar sites, (iii) providing proper hand washing facilities to Yatris/ other Service Providers, and (iv) ensuring that cook/ sewadars are maintaining high degree of hygiene and using disposable gloves while preparing/ serving the food. The District Magistrates of Ganderbal and Anantnag may impose appropriate penalties for violation of Food Menu as per the orders issued by them under Ranbir Penal Code.

26. SASB shall provide four dustbins (of at least 100 litre capacity each) to each LO: two of green colour and the other two of blue color. The LO shall segregate bio-degradable and non-biodegradable waste and collect the segregated waste in the green colour dustbin and blue colour dustbin, respectively. The LO shall collect and bring all non bio-degradable generated by them to the designated garbage collection site at the Base Camp (Baltal/ Pahalgam), at their own cost.

27. If the LO violates any of the above Terms and Conditions, particularly those mentioned at Clauses 2,14, 24, 25, 26, & 27 the CEO, SASB may forfeit Rs 10,000 (which the Langar Organisation has deposited with SASB), and/or impose a fine of Rs 5,000 for each instance of violation. In case the LO repeats a violation, CEO, SASB may impose a higher fine of Rs 20,000 for each instance of violation and/or close the Langar forthwith and may also blacklist the Langar for at least the next three Yatras.

28. In the event of breach, violation or failure of strict adherence to any or all of the Clauses of these Terms & Conditions the LO undertakes to abide by such orders as the Competent Authority may pass revoking the permission so granted including imposition of penalty to the tune of Rs. 5000, or Rs. 20,000, as the case may be, and the order shall be binding on the LO. However such order shall be passed only after issuance of advisory, warning or Show Cause Notice, as the case may be.

29. All disputes/ doubts and difference of opinion or otherwise relating to, arising therefrom or relating to these Terms & Conditions shall be resolved through amicable discussions by and between CEO, SASB, or his representative and the concerned party. However, in the event of such doubts, disputes, difference of opinion and meaning interpretation shall be referred to the sole Arbitrator to be nominated by Chairman SASB (Hon’ble Governor of J&K) whose decision shall be final and binding on all the parties. The cost of Arbitration shall be borne by the respective parties in equal proportions. During the pendency of the arbitration proceedings and currency of Terms & Conditions, the LO shall not be entitled to suspend the service to which the dispute relates until, CEO, SASB otherwise decides. The arbitration proceedings will be held at Srinagar/ Jammu only. The arbitration proceedings shall be governed by the provisions of the J&K Conciliation & Arbitration Act, 1997, as amended from time to time. The decision/ award of the Arbitrator shall be binding upon both the parties. All matters arising out of arbitration shall be subject to jurisdiction of the Courts in the State of J&K only.

1. The above Food Menu shall apply to Langar Organizations/ Food Stalls/ Shops/ other establishments which come up in the Yatra area to serve / sell food to the Yatris/ Service Providers. No item mentioned under ‘Banned Menu’ shall be served / sold/ stored by the Langar Organizations/ Food Stalls / Shops/ other establishments.

2. District Magistrates of Ganderbal and Anantnag Districts shall issue appropriate orders under Ranbir Penal Code specifying penalties to be imposed for violation of the Food Menu prescribed above.

3. To prevent dehydration, plain water should be served in large quantities to the Yatris/ Service Providers.
