NOTICE INVITING QUOTATIONS

The National Highways Authority of India (NHAI), through Project Director, Project Implementation Unit, Agra hereby invites Quotations from experienced firms / organizations / individuals having experience for work of incident management & plantation work for at least of one year in NHAI or in other Government department, to bid for work of incident management & plantation work in the stretch of Agra Shikohabad Section from Km 199.66 to Km 250.50 of NH-2 (New No. NH-19), in the state of UP on short-term contract for three months or till new agency is in place whichever is earlier. The Quotation document may be purchased from PIU office on a payment of Rs 1000/- by D.D. in favour of NHAI payable at Agra on any working day from 20.11.2012 to 26.11.2012 or can also be downloaded from the NHAI website www.nhai.org. The quotation shall be received in the office of Project Director, PIU Agra upto 15:00 hours on date 27.11.2012 and shall be opened on the same day at 15:30 hours in the presence of the quotationers or their representative who may like to be present. Quotations received after stipulated date and time shall not be entertained. The quotation should be submitted in hard bound form with page numbering and index. Any additional information shall also be furnished by the Quotationers in hard bound form with proper indexing and page numbering. The details submitted in other forms like spiral bound form, loose form etc would be rejected. Bid must be accompanied by a Bid Security of Rs. 10,000/- for Bid Document in the form of Demand Draft payable at Agra and drawn in favour of National Highways Authority of India. 1) Details of Scope of Work :

1.1 Horticultural Maintenance

The contractor shall maintain all existing trees, plants, shrubs and other suitable vegetation in the median and right of way strictly according to the desired density and ensure the conservation of all trees, shrubs and similar vegetation, in the median and within the right of way by promptly replacing the casualties. The Contractor shall also take adequate and appropriate measures, during the various seasons, to ensure the survival of the vegetation.

2.1 Incident Management implies a set of coordinated activities initiated by the Contractor when an incident (an extraordinary event resulting in the reduction of road capacity or creates a hazard for users) occurs, in order to minimize the effects of the incident and restore normal capacity and safety levels to all affected road facilities as efficiently as possible. The Contractor entrusted for Incident Management shall initiate, co-ordinate and maintain an Incident Management System (IMS) and supply regular incident statistics to NHAI. To achieve this procurement of the Patrol Vehicle, Ambulances and Cranes are intended with purposes and requirement as follows:

2.1.1 Patrol Vehicle The intending Quotationers is required to provide 24 hours per day route Patrol to assist the road users of the highways, to provide information, feedback and perform function in relation to Incident Management. The hire charges shall include the cost of P.O.L, operation charges and payment of driver and helper. The Driver / helper should remain ready in performing duties round the clock. The purpose of route Patrol Vehicle is to

i) Provide the users of the highway with basic mechanical help for vehicles that break down on the National Highway Section, and protect other motorists from such vehicles

ii) Immediately identify traffic hazards of whatever nature, such as unauthorised

parking, public transport vehicles obstructing traffic during passenger loading and unloading, debris, stray animals and the like. The Contractor shall take the necessary measures to remove such obstructions.

iii) Provide emergency management at accident scenes until such time as the appropriate authorities arrive,

iv) Assist with the removal of damaged or mechanically impaired vehicles from the highway,

v) Provide road user information and to further improve the image of the National Highway Section in a professional and friendly manner.

vi) Maintain daily records of assistance provided to motorists

vii) Quotationers will remove dead animals/birds from the project roads and bury them at a suitable location as directed by the Engineer/Employer within two hour of the incident. If contractor fails to remove the dead animals/birds from the project road within two hours of the incident, it will be treated as a case of issuing of Non Compliance Report and accordingly the penalties will be imposed.

viii) Observe, record and report suspect aspects of the highway, hazards and incidental damage caused by vehicles, floods, storms, or other random events, such that the highway maintenance records and data base are continuously improved.

2.1.1.1Requirements, duties and services for Patrol Vehicles.

The intending Quotationers shall provide a vehicle of make Mahindra Bolero Camper or equivalent in good condition with not more than 3 years old registration capable of negotiating the highways in all weather conditions, having permit for commercial use and having sufficient rear space for the required equipment storage, fitted with rotating light and hooter, and painted with a unique colour pattern for quick recognition as per the standard specification of NHAI which is also available at NHAI web site www.nhai.org. The typical sketch is also enclosed.

i) Equipments :-

The following equipments shall be carried with the patrol vehicle

a) Fire extinguisher 1 no. b) Gas cutter with protective glass (2 nos) c) Li quid container 2 no., Water container with fresh water 1 no., Funnel. d) Rubber Gloves, Leather Gloves (1 pair each) e) Brooms one hard bristle, other soft-2 no. f) Gum boot 4 pr, Rain coat 4 pr., Blanket 1. g) Torch lights – 4 nos., Spare Batteries., Flashing light 1 no. h) Hydraulic jack, towing chain, Animal hook, rope. i) Tool set (with standard set of spanners, pliers hammer etc), shovels. j) Digital Camera, measuring tape. k) Paper pad, Forms, pen/pencils, folders. l) First aid kit, Rain Coat, water proof sheets m) List of hospitals n) Sign boards – “Accident ahead” – 3 Nos. “Lane merging” – 3 no. “Direction Arrows” – 3 no,

“Speed Limit” (80/60/40)-3 no, “Keep left / right” – 2 no (all signs 1200 mm size) o) Sign Stand set (one for triangular and other for circular sign) 6 sets. p) Flags, whistle, reflective hand signal. q) 20 nos Traffic cones 500 mm size. r) Barricades, tape, stands, Flags of 600 mm by 600 mm made of good red cloth secured to a

staff of 1 M length, Paddles of at least 600 mm wide and provided with rigid handle with markings SLOW, STOP.

s) Reflective jackets. t) As a minimum, patrol vehicle should carry sufficient communication equipment to render its

passengers capable of direct communication with the incident Management Control Center established.

ii) Manpower :

For the Manpower to be deployed with the patrol vehicle, a team having been adequately trained for their task especially in first aid, vehicle maintenance and minor repairs shall be employed to work in shifts for each patrol vehicle. Typical staffing might be :-

a) Route Patrol Officer with first aid training and having basic automobile knowledge. b) Route patrol assistant having basic automobile knowledge and first aid training besides

having the capacity to function as rescue man. c) Driver, with knowledge of vehicle repairs, first aid training.

At all times, the Route Patrol Officer should have available a list of telephone numbers and address of all concerned in providing the Road Users Services. On duty, all staffs are to wear distinctive standard jackets having company LOGO, with night visibility. They are to deal with public and hence should be well trained to be courteous and helpful.

iii) Duties and Services :

The mission of the Route Patrol is to achieve the ultimate objective of enhancing the safety of the

road users and to provide the road users with a service that is informative, helpful and crucial in

an emergency situation. All tasks must be performed in a professional, courteous and efficient

manner that will enhance the safety of the road and promote a positive image of the National

Highway. The role of the patrol officer, as the first point is to supply assistance in breakdown,

medical and emergency situations, and is not to provide expert know-how, but to recognize the

need for and identify the correct course of action for each incident or situation. The typical duties

of the Route Patrol In-charge are :

a) Patrol the corridor to ensure obstruction free flow as pershift standards. b) To report to police and assist injured at accident scene and remove all obstructions from

road when the vehicles are cleared. c) To provide first aid to injured, contact control room and ambulance service if needed,

assist police. d) Report all incidents on radio control, to control room. e) To ensure safety of traffic with minimal delay at accidents. f) To assist motorists on broken down vehicles and to ensure that they do not obstruct free

flow. g) Maintain relations with all emergency services, and local safety councils. h) To report carriageway condition, especially traffic guidance aids, signs, markings condition, condition of drainage, ROW plantations, medians plantation etc. i) Check on Encroachment irregularities taking place within ROW, and prevent unauthorized entry into the corridor. j) Prevent theft of assets and report k) Attend to urgent maintenance for safety requirements.

2.1.2 Ambulance:

Ambulance forms the important category of commercial vehicle. The intending Quotationers

shall provide ambulances having all facilities of emergency system required. The ambulance

vehicle shall be Matador Van/ Swaraj Mazda/ Tempo Traveller or equivalent with not more

than 3 years old registration as per colour scheme standardized by NHAI as available at NHAI

web site www.nhai.org and also enclosed herewith for reference. The hire charges shall include

the cost of P.O.L, operation charges and payment of driver and helper/ para medic staff. The

Driver / helper/para medic staff should remain ready in performing duties round the clock.

With each ambulance the following staff shall be made available with proper uniform and

name of the person written on the uniform, the ambulance is required to have the

following medicines and equipments and also the paramedical staff: A) General Ambulance:

Folding Doctor Seat with Belt with adequate height in relation to the stretcher, Antistatic, water proof ply board vinyl/flooring, Channel/Locking system for rolling stretcher, High intensity blinkers, light bar/siren/beacon, Electronic siren with Public Addressing System, Internal lighting with three spot light embedded in ceiling, AC/DC connection and outlet points, Wash basin with Stainless Steel Tank, SS Trash bin Cabinet integrated with interiors, Head racks and cupboard, Attendant seat with seat belt to double as second stretcher for stable patients, Provision for communication system where the location of ambulance can be located, Provision for fog light on sides, Cool/Warm

boxes, Provision of Fire Extinguishers, Handheld Spotlight, Inverter with the facility re-charging from 220V AC and Vehicle’s alternative. Oxygen delivery system comprising of Cylinder Trolley, pressure tubing

with regulators, Roof mounted Air-conditioner with appropriate cooling capacity with additional blower for Patient Cabin, Extrication equipment and Good Suspension to cater for smooth transportation.

B) Basic Life Support system Automatic loading stretcher, Scoop stretcher, Folding stretcher, Spine board full, Vacuum splint kit/foldable splints, C-Collars, Oxygen Cylinder with accessories mounted/with manifold and pressure indicators, Oxygen Cylinder (aluminum portable), BP Instruments (Wallmounted-Aneroid), Stethoscope, Automatic defibrillator, Resusciatation bag (ambu bag, laryngoscope, airways and mask of different size including pediatric), Manual foot operated suction pump. I.V Fluid and I.V Sets, Tourniquet, First-Aid Box (Dressing material/Antisceptic lotion/Analgesic etc), Linen/Blanket, Laryngeal mask airway of all sizes.

The following paramedical staff is required with proper uniform and name of the person written on the uniform: a) Trained Paramedical staff 1 c) Nursing staff with knowledge of first aid 1 d) Driver for ambulance 1

Number of Ambulance: One

PERFORMANCE STANDARDS

The successful Quotationers shall observed the following performance standard for operating the facility

i) The highway shall be kept clear of all obstructions to traffic. Broken down vehicles, accident remnants, fallen trees, or any other obstructions should be cleared at once, after completing any legal formalities. The availability of Tow-trucks / cranes, and other equipment required for this purpose has to be ensured.

ii) Accident relief measures, including an ambulance, shall be available round the clock. The response time should be the minimum. Action to ensure traffic regulation and management to minimize the disturbance due to accident to other traffic shall be taken.

iii) The intersections at either end or in-between shall be managed such that delays to through traffic are minimized.

iv) Regular patrolling shall be done to ensure smooth traffic movement on the highway. The frequency of the patrol shall be at least once in 4 hours for the entire length of highway.

v) In respect of route operation like patrol vehicle, ambulance and towing of vehicle, any case of non compliance for the 'Performance Standard' penalty of Rs. 5000/ for each non compliance incident will be levied.

vi) The log books for route Patrols, cranes and Ambulances shall be maintained as per “Logging System”. i.e. exact time reached at particular incident and time at which the spot of incidence left out. Both vehicles should not waste time unnecessarily. From the entries of log book, if it is found that time is exhausted unnecessarily / arbitrary, reduction in the rate of concern BOQ item shall be made. Engineer’s / Project Director decision in this regard shall be final and binding.

vii) Signed muster rolls of staff pertaining to route patrols, cranes and Ambulances shall be maintained. Any absenteeism of route patrol and crane staff shall attract a penalty of Rs. 300 / day / incidence and Rs. 500 / day / incidence in case of Ambulance Staff. The decision of Project Director shall be final and binding in this context.

viii) The route patrol vehicles, cranes and Ambulances shall be equipped (for 24 x 7 period

and total duration of contract) with prescribed equipments / medicines. Any shortage of equipments / medicines shall attract penalty. The penalty in the range of Rs. 500 to Rs. 2000 / incidence shall be imposed on contractor. The decision of Project Director shall be final and binding on the contractor.

iv) The contractor shall submit following documents along with each monthly statement of

work done.

a) The photographs in hard and soft copies of all accidents and in soft copies for all other incidences. The photographs in hard and soft copies shall be supplied free of cost.

b) The undertaking of route patrol Incharge and driver of each damaged toed vehicle stating

that “no charges have been levied" i.e. the services of crane made freely available to damaged vehicle.

c) The claim for BOQ item, “use of crane” shall not be entitled in absence of above

mentioned data.

d) The reports as per IRC 53 – 1973 and formats approved by Engineer / Project Director in respect of accidents occurred during the month.

e) The contractor shall submit the daily report of each accidents / accidences occurred on any day on the very next day. Failure of which shall attract penalty of Rs. 100/ incidence.

v) The following performance standard shall be observed

2) Terms and Conditions :

2.1 The work done under this contract shall conform to the standards mentioned in the NIQ.

2.2 Immediately after, on acceptance of the quotation or within a maximum period of Seven Days, the successful agency shall have to deposit Performance Guarantee of an amount equal to 5% of the total contract price either through a crossed Bank Demand Draft issued by any nationalized or scheduled bank drawn in favour of National Highways Authority of India payable at Agra (U.P.) or Bank Guarantee in the form acceptable to the NHAI.

2.3 Bid must be accompanied by a Bid Security of Rs. 10,000/- (Rs. Ten Thousand only) in the form of Demand Draft payable at Agra and drawn in favour of National Highways Authority of India. The Bid submitted without Bid Security will be rejected. After submission of Performance Guarantee and verification of the same, the Bid Security would be released. The Bid Security of unsuccessful bidders will be returned after 3 weeks.

2.4 The Employer will retain 5% percent from each payment due to the contractor as retention money over and above the amount prescribed in condition 2.2 which will be refunded within 3 months after satisfactory completion of work.

2.5 All taxes as applicable will be deducted at source. However, if any tax deduction remains un-noticed, shall be the entire liability of the successful Quotationers. He will also be responsible for the penalty, if any, is imposed by the concerned department/authority.

2.6 The contractor shall follow minimum wages act of state government/ central government issued from time to time.

2.7 The Competent Authority reserves the right to reject tender or quotation process without assigning any reasons thereof.

2.8 The work shall be started as per the direction given in the letter to proceed. Failure on the part of successful Quotationers to start the work within the scheduled time will result in cancellation or allotment of contract as well as blacklisting of the firm.

2.9 (a) The contract can be terminated by the Employer unilaterally without any notice in case of unsatisfactory services. The earnest money shall be forfeited in that case or in the event of withdrawal of services unilaterally by the Quotationers before contract period.

(b) The period of the agreement may be extended if needed, based on the performance of the agency and by mutual consent.

2.10 In case of any damage/ loss of life on account of accident with the vehicles deployed by the Quotationers, it will be the entire responsibility of the successful Quotationers.

2.11 Any works not attended by the contractor in a reasonable period of time shall be got done by engaging a third party at the risk and cost of contractor.

2.12 The Employer is responsible for the accepted risks which are (a) in so far as they directly affect the execution of the works in the Employer's country, the risks of war, hostilities, invasion, act of foreign enemies, rebellion, revolution, insurrection or military or usurped power, civil war, riot commotion or disorder (unless restricted to the Contractor's employees), and contamination from any nuclear fuel or nuclear waste or radioactive toxic explosive, or (b) a cause due solely to the design of the works, other than the contractor's design.

2.13 All risks of loss of or damage to physically property and of personal injury and death which arise during and in consequence of the performance of the Contract other than the accepted risks are the responsibility of the contractor.

2.14 All the necessary insurances shall be provided by the Quotationers, all such insurances shall provide for compensation to be payable in the types and proportions of currencies required to rectify the loss of damage incurred.

2.15 The agreement shall be governed by the laws in force in India. Any dispute arising in relation to the Agreement shall be subject to the jurisdiction of the courts at Agra/ New Delhi.

2.16 A prospective quotationer requiring any clarification of the NIQ documents may notify the department in writing, which should reach the Office of the Project Director, PIU – Agra at least three days before the closing date. Written copies of the department's response (including an explanation of the query) will be sent to all prospective quotationers and this shall from part of the quotation documents.

2.17 At any time prior to the deadline for submission of quotation, the department may for any

reason, whether at its own initiative or in response to a clarification requested by a prospective quotationer, modify the NIQ documents by amendment merely placing an addendum on the website of the authority i.e. www.nhai.org only, which will be binding on all the quotationers.

2.18 Prices shall be quoted in Indian Rupees only.

2.19 Arithmetical errors will be rectified on the following basis. If there is a discrepancy between the unit price and the total price that is obtained by multiplying the unit price and quantity, the unit price shall prevail and the total price shall be corrected. If there is a discrepancy between words and figures, the amount written in words will prevail. If the supplier does not accept the correction of errors, its quotation will be rejected.

2.20 The department will evaluate and compare quotations which have been determined to be substantially responsive, satisfactory & up to mark.

2.21 The department reserves the right to split the work and award the same to more than one quotationer.

2.22 The quotationer shall not contact the department on any matter relating to its quotation, from the time of the quotation opening to the time the Contract is awarded. If the quotationer wishes to bring additional information to the notice of the department, it should do so in writing.

2.23 The department reserves the right to increase or decrease by any amount the quantity of goods and services originally specified in the Schedule of quantities & Rates without any change in unit price or other terms and conditions.

2.24 The work done under this contract shall conform to the standards mentioned in the NIQ.

2.25 The department through its representative shall have the right to inspect and/ or to test the work done to confirm their conformity to the Contract specifications at no extra cost to the Department.

2.26 The payment shall be made on the successful completion of the work and submission of bill.

2.27 Any Corrections/cuttings in the quotation documents shall be initialed by the quotationer.

2.28 The contractor will provide suitable/ congenial conditions and atmosphere, and maintain law and order during the execution of work.

2.29 The contractor should be well conversant with any statutory rules, regulation as may be prevalent in the respective territory and the contractor shall indemnify and keep the project free from and against such liability.

2.30 The Quotation shall be valid for 120 days from date of opening.

2.31 The quantities mentioned in BOQ are indicative only to provide a common basis for bidding. NHAI reserves the right to change the quantities and shall not entertain any claims whatsoever arising thereof. The basis of payment will be actual quantities of work carried out and valued at the quoted rates in price bid.

Maintenance of median and the existing plants in it (with a density of 666 plants per km.) by making water basin, weeding-hoeing, cleaning, leveling and dressing of median, uprooting and removal of weeds, cutting grass, disposal of all muck outside ROW regularly to keep the median clean and plantation in healthy and good condition. The job also includes the cleaning and removal of spilled over earth from median to main carriageway in the portion adjacent to the kerbs all along the median besides cleaning of longitudinal and cross drains in the median.

Removing all types of broken down/vehicles which have met with accidents from the carriageway and toeing the same to proper locations i.e. nearest Police stations or some suitable location by using 15 tonne or of more capacity pick and carry crane, as per the requirement of the incident and as per clause 6.4 of Scope of Work and as per Clause 6.8 and 6.8.3 ‘Performance Standard’ of scope of work. The crane shall be equipped with precise vehicle tracking system (VTS) (of reputed ISO 9001 company) based on global provision system (GPS) and GSM / GPRMS technology. The system shall include micro, live, real time tracking web based software through which use of GIS maps and transit, stoppage idle, over speed reports of vehicle shall be obtained.

Patrolling by route patrol vehicle as per Clause 6.4 of scope of work and as per Clause 6.8 and 6.8.3 of Performance Standard of scope of work. The route patrol vehicle shall be equipped with precise vehicle tracking system (VTS) (of reputed ISO 9001 company) based on global provision system (GPS) and GSM / GPRMS technology.
