Ahoy! Calling all potential yacht charterers to participate, and have a great deal of fun, in Phuket’s internationally acclaimed Six Senses Phuket Raceweek from 20-24 July, 2011.

More Charter Entries In Six Senses Phuket Raceweek

Wanted:

This famous regatta attracts serious and not-so-serious sailors in big, small, fast and slow yachts across six or seven classes, which already includes cruising yachts, bareboat and skippered charter yachts.

But Raceweek’s Grenville Fordham, Managing Director of IMAGE asia, rights holders and organisers of the event, wants more charter boat entries for the this year’s eighth running of the regatta.

“Six Senses Phuket Raceweek off ers a genuine opportunity for non-boat owners, as well as those who keep their yachts elsewhere, to join in the fun and revelry – on shore and on the water – at one of

Asia’s best-loved regattas, by entering a chartered boat. For groups of family and friends, corporate groups, competitive overseas yacht club members or those just looking for a sailing holiday with a diff erence, Raceweek off ers a superb combination of fun, festivities and challenge,” said Fordham.

“We’d like to see our charter boat entries grow, especially with visitors from overseas, as it’s a rare opportunity for people interested in boating, but who don’t own a yacht in Phuket, to experience the magic of an Asian regatta. Who knows? The experience might lead them to owning a boat here as well,” he added.

The Six Senses Phuket Raceweek website: www.phuketraceweek.com has a charter section with samples of available boats and hiring conditions. Additionally, Phuket has many professional yacht

Phuket based publishing and event management company Six Senses Phuket Raceweek’s eighth regatta will be run over fi ve days from 20-24 July, 2011 with headquarters at Title Sponsor Six Senses’ Evason Phuket & Bon Island in Rawai, southern Phuket. Six Senses Phuket Raceweek has an ‘early bird’ entry scheme with great savings on boat and crew fees for those who register and pay online. www.phuketraceweek.com

Some random comments on the 2010 Raceweek:

“I must say it was an exceptional regatta! The whole of our crew thoroughly enjoyed the week. Congratulations to you and your team on putting on one of Asia’s fi nest regattas. We will defi nitely be returning next year.” Anthony Hastings, Baby Tonga

“We've been to many international regattas and this was world class standards. It's an excellent regatta - one of the best in the world - both for the sailing and bunch of people it attracts.” Neil Ayre, Shanghai Baby

charter companies, large and small, who can tailor packages to suit individuals, while the regatta’s host venue – the 5-star Evason Phuket & Bon Island – off ers very attractive special regatta rates in sumptuous surroundings for non-competing members of a group.

Charter options include fully equipped catamarans and monohulls, both cruising and racing, and are available bareboat, with a skipper/instructor or fully crewed. Prices vary according to the type of charter, size of the group and the number of days. Details on the website.

The Andaman Sea’s ideal southwest monsoon sailing conditions make it perfect for chartering a boat. Add in the professional management, four days of exhilarating racing, the natural camaraderie that surrounds the boating fraternity and attending the legendary Raceweek parties each night – and the temptation

to gather a group of friends together to ‘give it a go’ is irresistible.

“For the inexperienced sailor, what could be more stimulating than helping – with an experienced crew or captain in charge – to race a yacht on the stunning Andaman Sea, being a genuine competitive sailor for four days and a genuinely competitive partygoer for fi ve nights?” said Fordham.

Phuket’s boating industry is well geared to making chartering easy. Said Fordham: “Anyone can charter a yacht to race. The thing is that there are enough variations of both boat and charter package on off er to make it competitive and enjoyable for everyone – from experienced yacht racers whose own boat is on the other side of the world to the most inexperienced novice.”

Before or after the regatta, there are countless anchorages around Phuket for chartered boats to extend their sailing holiday. Boasting some of the best cruising waters in the world, the ‘Pearl of the Andaman’s’ magnifi cent scenery, idyllic tropical islands and beaches, ideal sailing conditions – all combined with the famous Thai hospitality – make for an unforgettable holiday.

Information on marinas and anchorages, most within a short sail from the regatta base on Phuket’s southeast coast, is available on various websites, such as www.myphuketinfo.com and www.southeastasiapilot.com.

Patong to Amanpuri Bay

PATONG BAY18 miles from Ao Chalong

A

Its gradually sloping, sandy bottom permits anchorage in 5 -15 metres anywhere in this broad bay.

Patong is the busiest bay on the west coast, particularly around Christmas, New Year and the Songkran water festival. It is also the main high season anchorage for cruise ships, live-a-board dive boats and in recent years the growing number of visiting superyachts.

To the south end of Patong bay is a fixed jetty and a floating jetty which is used during the high season as a transit point for visiting cruise ships and Superyachts.

On the northern rocky side of the bay are three landmark restaurants, Baan Rim Pa, Da Maurizio's and Joe’s Downstairs, all founded by Tom McNamara, an American entrepreneur who, over 20 years ago, set the standard for Phuket.

SOUTH POINT17 miles from Ao Chalong

B

Anchor in 8-10 metres on a sandy bottom off one of the small beaches. This is a good stop for the night if a southwesterly swell is running early or late in the season. South Point is also a favourite daytime excursion for longtails operating from the main beach. Many divers and snorkellers come to enjoy the underwater sights within easy range of the beach facilities of Patong.

NAKA LAY BAY19 miles from Ao Chalong

C

Look for a small bay just east of the Thavorn Beach Village resort’s concrete jetty. You’ll find a water hose has been laid from a hillside spring to a buoy offshore. Good tank water is usually available for a modest fee, even at the end of the dry season.

LAEM THAI PAO19 miles from Ao Chalong

D

Just inside the northernmost point in Patong, this bay has a steep coral shelf rising from a sandy bottom in about 12 metres. Lots of colourful corals and fish await the underwater explorer. This is a good haven from the northwesterly swell, common in February and March. Access to the beach, now overlooked by a villa housing development, is best at high water.

WATERFALL BAY19 miles from Ao Chalong

E

This mere indentation in the headland affords shelter for one or two boats. Anchor in about 12 metres on a sandy bottom with scattered coral in front of the residential villas.

In the corner of the bay you will find a spring which is accessible by dinghy – bring your jerry cans. The spring often dries up by the end of the dry season, so don’t rely on it.

KAMALA BEACH5 miles from Patong Bay

A

Kamala Beach lies in a pretty bay, with several hotels. There are plenty of restaurants ashore in a busy village atmosphere on the south end of the beach. The bay is easily recognised from seaward by the large structures of the Phuket Fantasea Park and the developments on the southern hill.

Kamala Dreams fronting the beach in the centre of the village is owned by a yachting veteran of 26 years in Phuket, Jan Jacobs, who has many tales of sailing the local waters.

Care should be taken when coming from the south to avoid the rocky patch 300 metres off the headland. Anchor anywhere well out in the bay in 6-8 metres on a sandy bottom.

LAEM SING / SURIN6 miles from Patong Bay

B

Laem Sing is a beautiful bay framed by two rocky headlands. It is the favourite spot for paradise seekers and ageing hippies who prefer the short longtail ride from Patong to the gruelling bus ride to Krabi. Look for the famous Sunday afternoon parties at Ott’s Bar in the very south of the beach.

Anchor in 10 metres on a sandy bottom. In the south part of Surin Bay is a floating high season jetty. There are several daytime restaurants here, in the high season, with more in nearby Surin Beach, around the headland, which is one of the island’s only zoned public beaches.

As such, all the resorts are situated behind the park, but there are many restaurants, bars, beach clubs and food stalls along the beach, some of which have become transformed into trendy beach clubs for the 4 and 5 star resorts a few hundred metres away.

You should anchor outside the hotel moorings (which are not available for public use) in 10 metres on a sandy bottom. This anchorage is uncomfortable when the northwesterly swell is running in February or March.

This secluded spot is one of the nicer bays on the west coast and is home to The Chedi Phuket and Amanpuri exclusive resorts. Yacht crews may use the hotel restaurants for that special occasion, but it is wise to make a reservation.

There is an excellent sandy beach, and good snorkelling is to be had on both points.

People Profi le

When did you come and live in Phuket? I came here 22 years ago from my native Sardinia, in Italy after living in The Hague, the capital of Holland, for four or fi ve years where I opened an Italian restaurant, Costa Smeralda, and a pizza/takeaway. Previously I’d undertaken a hotel management course at the Hotel St Michel for three years in Lausanne, Switzerland, before going to Holland. I visited Thailand four or fi ve times on holiday before deciding to come and live in Phuket. I liked the place.

When did you decide to become a chef and open your own restaurant? About 38 years ago while working in Holland I decided I liked the job of being a chef. When I came to Phuket I opened three restaurants in Patong: Marco Polo in 1990, my fi rst Cassanova in 1991 and the second Cassanova in 1995. Ten years ago I opened Salvatore’s Restaurant in Phuket Town.

What changes in the business environment on Phuket have you noticed? The last year business was down by around 25 percent but I’m optimistic that this year and next year will be better. Seventy percent of my customers are Thais and around 30 percent a mixture of locals and tourists. Thai customers have become more open over the years. They trust me and will ask me to choose one of the fi ve set menus we off er each day.

What other trends have you noticed? In the last 10 years I’ve noticed that Thai customers now almost always order wine rather than whisky or beer; they like the expensive wines which suit us as we stock mainly Italian and French wines. Their favourite dishes are seafood and New Zealand lamb. I must be careful as Thai customers are very particular about everything being very fresh.

Why do you think Salvatore’s Restaurant has been successful? Hard work. I do everything myself. I go to the market every day to buy fi sh and meat and my wife and I buy all the vegetables and other ingredients ourselves.

What is your favourite dish? I like a simple dish of spaghetti, fresh tomatoes and basil with some olive oil. I cook only with olive oil. No butter. Many of my dishes come from my 80-year-old mother’s recipes. I go home to Sardinia every year to see her and my two brothers and three sisters and bring back some of her recipes to serve in the restaurant. The recipes have a lot of fi sh, vegetables and also some specialist Sardinian dishes such as sardines, pork, rabbit and duck.

Where do you live on Phuket? We’ve lived in Kathu near the golf course for 15 years in the same house. I like it there. There are only 30 or 40 villas. It’s quiet. We have a very good life there.

What about your family here in Phuket? I’ve been married to a Thai, Sombon, for 17 years and we have a 16-year-old daughter, Monica, who’s been at high school in Italy for two years and has another three years to go. She’s learning Italian but is also very interested in art of all kinds. I hope she’ll go to university in Italy but she wants to go to America after fi nishing high school. I hope she changes her mind…

Is your family involved in running the restaurant. Yes, Sombon helps out with many things in the restaurant.

What type of car do you drive? I have a Toyota Fortuner, although I’d prefer a Ferrari, of course. I like Formula 1. Sombon also has a Toyota.

What do you like most about living on Phuket? I like the Thai people. This is now my home. And I like the weather – it’s great!

How old are you and how long do you plan to keep working? I’m 60 years old. I plan to work for another fi ve years in the restaurant business. I will defi nitely stay in Thailand but instead of going to Italy for one month a year, I’ll go for two or three months to see my family.

So what do you do in your spare time? I don’t have much spare time. I once played golf but not any more. Now I intend to start going to the gym to lose some weight.

Are you involved in any charitable work? Not directly, but each year I give a voucher to the Phuket International Women’s Club and I’ve helped poor Thais who need food with some food from the restaurant from time to time.

With an Italian and two Thais in your family you must speak a number of languages. Yes, I speak seven languages: Italian, Thai, English, German, Dutch, French and Spanish with some Portuguese and Greek. My daughter speaks Thai, Italian, English, French and some Japanese and my wife speaks Thai, English and Italian.

What do you think the future holds for businesses like yours on Phuket? I think business will improve over the next couple of years. I hope the next year will be better for everyone.

Interior designer and owner Pimpinun Angkullbee has stamped her own imprint on Phuket’s newest top line spa, Chadasai Spa, with its clean, uncluttered décor based around large, white, light as air, Southern Thai silk drapes that truly capture her vision of conjuring up a feeling of fl oating while in contented sleep. Opened in late January, and located along a wide road front in Cherng Talay, Thalang, an area with few spas, Chadasai Spa’s raison d’être is a clean and simple environment, refl ecting Khun Pim’s own tastes as a professional interior designer.

Guests are shown into a reception area of white painted concrete fl oor, silk drapes and simple wooden furnishings. Massage oils called Anti-stress, Relaxing, Jasmine Rice, Green Tea, Lemongrass and Energizing are off ered as are body scrub creams of the same names, plus Mandarin Orange and Coconut Butter. The foot cleaning room is a spacious revelation, resembling the inside of a Sultan’s tent with its white, Southern Thai silk drapes gently fl oating above, along walls and across open doorways.

Spas treatments range from two hour foot spa sets, including manicure, pedicure, scrubs, mask, massage, an aromatic milk bath and nail polish; the

three hour “Sport Retreat” sport, herbal ball and cucumber fresh mask treatment to the four hour “Chadsai Signature Synchronized Massage by 4 Hands.” They may seem like long spas, but the standard of treatment makes them pass all-too-quickly.

A choice of waist high, or fl oor massage mattresses in simple, but comfortable single and couples treatment rooms are off ered, as are outdoor spa baths. An alfresco shower between body scrub and oil massage is a stimulating change from the normal. The quietly effi cient, orderly and discrete masseuses are from Phuket and trained by the spa’s own personnel. A three hour massage passes in a dream of blissful relaxation, expelling all stress for a brief moment in time. The

Sukko means "Beyond Happiness". My fi rst feeling when I stepped through the impressive gates of the Sukko spa was, "I’m in paradise". The Sukko staff are dressed beautifully in traditional Thai style and the spa design, infl uenced by the ancient Siamese capital, creates a haven of calm yet regal serenity. I felt I had left all my troubles behind.

Chilled out by the soothing background music, my mind was fi lled with a peaceful wellbeing as I enjoyed the warm traditional welcome (again from Sukko culture) of the ‘Flower Floating Ritual’ – similar to ‘Loy Kratong’, where the idea is to fl oat away past stresses and wish for luck and joy from that moment on.

A variety of 40 spa treatments – prepared by Sukko's certifi ed Thai Herbalist and based on ancient Thai medical theory – is off ered at Sukko, in packages lasting from 2 hours to 4 hours. Each package has a specifi c purpose and can be selected to suit your lifestyle or the way you feel on the day. These herbal recipes and procedures have been handed down through generations and are totally free of petrochemicals, synthetic perfumes or colouring. Some of the herbs and spices are grown in Sukko’s own herb garden and picked just for your treatment, ensuring they are as fresh as can be.

I was pampered with the ‘All-Soother’ package, a 2 1/2 hour experience that left me feeling relaxed and refreshed. This four-treatment combination began with 30 minutes in the steam room and the Jacuzzi, followed by a Thai Turmeric Body Scrub designed to soften your skin and awaken your senses. The scrub was followed by a traditional Thai massage, the pressure applied gently but fi rmly. "Is this pressure okay? Too strong? How are you feeling?" my therapist asked me from time to time. “Mmm… perfect…” were the only responses that seemed to suit how I felt. My last step, which came all too soon, was the Thai Herb Purifying Facial Treatment, using creams and herbs that left my face feeling smooth and glowing – and even looked good enough to eat!

Sukko Spa’s restaurant, Suk Savoey Spa Cuisine, presents a unique concept: "Menu by Blood Types" and "Menu by Element". For those who want to exercise, the Suk Sanan Club provides a myriad of fi tness opportunities,

including ‘Rue Sri Dat Ton’ (the hermit self stretching), a traditional Thai exercise or, for something more strenuous, try ‘Muay Thai Chaiya’, a traditional and eff ective art of self-defense. Parents who come to Sukko to relax can leave their kids at Suk Zon Kid's Club, where they will enjoy with a variety of fun yet safe activities.

Sukko Spa, one of Phuket’s most luxurious spas, is located on Chaofa Road just 30 minutes from Phuket International Airport, 10 minutes from Phuket Town, 30 minutes from Kata or Karon Beach and 20 minutes from Patong Beach. It is creatively designed in a contemporary Thai style, set amongst 15 rai (6 acres) of luxuriously landscaped tropical forest.

Bobby Duchowny studied aromatherapy – a healing art that promotes massage, when combined with specifi c herb and spice oils, as a method to reduce stress, boost energy and heal certain physical ailments – at the American Aromatherapy Association.

Some years ago while on holiday in Thailand, he visited an organic farm in Petchaboon province and became interested in the natural healing properties of Thai herbs and spices.

“I was particularly attracted to lemon grass as it was used in many popular Thai foods, as a medicine for stomach disorders and even as a repellent for mosquitoes,” he recalls.

Bobby used lemon grass as his signature herb to create a line of essential oils, face and body creams, shower gels and bath crystals, which he and his wife Palita sold at Bangkok’s world-famous Weekend Market.

What started, several years ago, as a modest enterprise has blossomed into a successful operation off ering over 90 oils and a wide range of body care products through many outlets, as well as supplying many of Thailand’s top resorts and spas with aromatherapy oils.

Lemongrass HouseTo visit this home of award-winning spa oils, creams, soaps and so many other exquisite products is a delight. The aromas are enchanting. At Lemongrass, you can enjoy a spa treatment to sample and choose from their huge range, then take home your choice to enjoy at your leisure. They even have a great range of kid’s spa products.

“Our advantage is that we produce the freshest spa products and our stock is never kept longer than three months; using fresh spa products can be likened to eating fresh food rather than processed food.”

Based on his years of experiences at some of the top spas in Southeast Asia, Bobby has developed a full line of healthy skin care products. For example, his hydrating face and body creams have 25 per cent aloe vera, white orchid and cucumber extracts. And he’s developed a revitalizing mineral muscle soak made from Andaman Sea salt crystals, blended with white orchid and chamomile extracts, to help draw out impurities and soothe and revive tense muscles.

“People are sensitive to diff erent scents at diff erent times of day. It’s a good idea to get a variety of essential oils and experiment with what smells and feels good to you,” he says. “Our aromatherapy massage and body oils can be either uplifting or calming to the spirit. They’re carefully balanced hand-blended oils created by adding pure essential oils to nourishing, vitamin E enriched, sweet almond and jojoba base oils.

Lemongrass has won many awards, including Condé Nast Hot List 2007, and has been featured in several top magazines, including Time Magazine’s “Best of Asia”. According to Time, “If you want to smell like no one else, try mixing a selection from the more than 90 natural scents at Lemongrass House.”

Lemongrass House is located in Cherngtalay, Surin Beach and Chalong, where you can buy their full range of spa products at modest prices, making perfect gifts for friends and family who can enjoy the aromatic scents of Asia in the privacy of their homes – no matter where in the world they live.

The Royal Spa and Health Club

In the heart of bustling Phuket Town lies a quiet haven of heavenly peace. With the continuous sounds of water, trickling, bubbling and steaming, and with the sweet fruity scents that fi ll the air, the being is enticed into a fl owing stillness of body and mind.

The Royal Spa and Health Club is a popular tropical day spa with both locals and visitors alike, which is managed by the Royal Spa Development and Management Company. With an excellent reputation in the spa development industry through its experience and attention to detail, the Royal Spa and Health Club off ers a distinctly personal experience.

Of the signature treatments, the Royal Stone Therapy is one that is particularly interesting. The Hot Stone massage technique, founded 5000 years ago, uses black volcanic stones, which are heated and placed on the body, producing a profound eff ect, stilling the mind and easing the body.

Unlike many of the high-end spa complexes on the island, which market themselves exclusively to tourists, the reasonable prices and relaxed but professional staff at the Royal Spa, means that many local Thais, as well as tourists, are beginning to use the spa. This has helped to erase the often stiff , and over-formal atmosphere at many of Phuket’s spa resorts, giving the Royal Spa an ambience of authentic relaxation and pleasure.

All the therapists working at the Royal Spa have been trained at the in-house 'Phuket Spa Academy', established in 2004, to provide a comprehensive spa training course. The curriculum and assessments provide a measurement of therapist expertise and knowledge within the Thai spa industry. Since then, the Royal Spa Development and Management Company have provided comprehensive and professional spa management, and development programs, for spa retreats throughout Thailand. Their aim is to provide a standard of service and expertise throughout the Thai spa industry, to ensure a high quality of service and standard of treatment, throughout Thailand. It truly off ers the ‘one stop services for Thai spa business’ and a quality of relaxed professionalism, rarely found in luxury spa resorts.

Right now The Royal Spa have 12 branches that are managed in resorts in Patong, Kata, Karon, Panwa, Ao Chalong and Phuket Town and you are welcome to experience our spas with us anytime. As a special for our 8th year anniversary, we off er 'BUY ONE GET ONE FREE' value.

Feature: Phuket Community Foundation Race Day

The Phuket Community Foundation celebrated the success of its 2011 Race Day Fundraiser, held at Laguna Phuket on Sunday January 23.

While the bean-counters were still at work, PCF Director Janyaporn Morel said, "We know that income from donors and sponsors, and from the public on the day, was well over 800,000 baht. That's a big number for us.

"We had more than 30 sponsors for the event. We were overwhelmed by their generosity. I'd like to thank in particular Laguna Phuket for giving us such a wonderful venue, Dream Gallery for sponsoring the entire duck race, and our top prize donors, Silolona, Banyan Tree and Wahoo."

Apart from the duck race, PCF Race Day featured dragon boat races, a kayak race and a cardboard box race for children.

On stage, the crowd - estimated to be about 1,500 - were entertained by songs from a schoolchildren's choir, a magic show, several dance shows and a duckling costume contest for small children.

"The feedback we had was overwhelmingly positive," said Ms Morel. "We're very grateful to all who supported us, and to everyone who came to enjoy the fun. We look forward to doing it again next year."

Potential foreign investors in the Kingdom of Thailand should have an overview understanding of the legal structures of various entities in addition to their business knowledge in order to ensure their business methods and dealings are supported by knowledge of the basic diff erences of entities. In this article we would like to give an overview of business organizations which exist in the Kingdom of Thailand.

Business in Thailand can be widely conducted in the following forms:

Limited Liability Company:In Thailand, the most common structure for conducting business is a limited liability company. A limited liability company, by law, is regarded as a juristic person with the right to own property (although with restrictions to ownership of real property for most limited liability companies with a majority foreign ownership) to and carry on business under its name. Limited liability companies have liabilities with respect to third parties which is separate from the individual liability of its shareholders. Shareholder liability in a limited liability company is limited to the value of an individual shareholder’s unpaid share capital. A limited liability company could be used for example for real estate business.

Public Company:A public company is an entity incorporated for the purpose of off ering shares to the public. The liability of shareholders is limited to the amount of the capital which remains unpaid on the shares held by them. The purpose of off ering shares of the public company and the liability limit of its share holders must be clearly and specifi cally stated in the memorandum of association. As a public company receives money by off ering its shares to the public a public company could be a preferred form of business for major enterprises or for companies which want to achieve fast growths in new economies.

Partnerships:Unregistered Ordinary Partnerships:An ordinary partnership is based on a contractual relationship between two or more persons to jointly invest and undertake a business with a view of sharing profi ts and loss derived wherefrom. All partners in an ordinary partnership are jointly and without limit, liable for all obligations of the partnership. The unregistered ordinary partnership could be used for various businesses but is not the preferred business form for real estate as it is not entitled to own property.

Registered Ordinary Partnerships:An ordinary partnership can become incorporated as a juristic person by registering with the Minister of Commerce. A registered ordinary partnership is entitled to own property and is taxed as a corporate entity.

Limited Partnerships:A limited partnership is a juristic person consisting of two groups of partners one of which comprises those whose liabilities are limited to the capital contributed and the other comprises those who are jointly and without limit, liable for all of the partnership’s obligations. Only an unlimited partner can manage a limited partnership. If a limited liability partner participates in the management, then he becomes an unlimited liability partner.

Joint Venture/Consortium:Joint Venture:An unincorporated joint venture is a contractual relationship between two or more parties, one of which must be a juristic person. It is generally organized to conduct a particular business project within a limited period. The joint venture is not recognized as a juristic entity under the Civil and Commercial Code. However, it is recognized under the Revenue Code. A joint venture could be used for example for projects in the real estate sector.

Consortium:A consortium is also a contractual relationship between two or more parties. The distinction from a joint venture is that each party to a consortium maintains its separate identity relating to the business and is responsible for its own profi ts or losses. The consortium is not recognized as a legal entity under Thai law.

Branch of a Foreign Company:Where a foreign company has a contract with a Thai government agency or a private organization to carry out a business project in Thailand, the

foreign company may choose to perform such a project through a branch offi ce. However, if the nature of the business falls within any of the restricted categories of the Foreign Business Act, a permit will be required before commencing the business activities. A branch offi ce is regarded as the same legal entity as its head offi ce. The head offi ce, therefore, will be held responsible for all liabilities of the branch in Thailand.

Representative Offi ce:A representative offi ce is considered as a non-trading offi ce which is not permitted to conduct business with a view of profi t. It is merely for the purpose of serving its head offi ce overseas for the provision of information.

Regional Offi ce:A regional offi ce is also considered as a non-trading offi ce which is not permitted to conduct business with a view of profi t. The regional offi ce is a business organization established by a multinational company for the following purposes;

(a) Coordinating among branches or affi liates in the same region;(b) Controlling the operation of branches or affi liates situated in the same region on behalf of the parent company; and(c) Giving advice and services such as training of personnel, fi nancial management, marketing control and sale promotion strategies, product development and research and development.

Sole proprietorship:A sole proprietorship is normally a small business, as sole proprietorships are owned by a single person. The owner is solely responsible and liable for all obligations and liabilities of the sole proprietorship,. Sole proprietorships are not registered with the Ministry of Commerce.

ConclusionMost foreign investors look at limited liability companies as their preferred method of investment, but perhaps don’t consider or are not familiar with the alternative modes of legal entity. It is certainly worth being familiar with the options, so that any choice can be made on an informed basis, and not necessarily following the majority for the sake of familiarity.

“Please be advised that all electronic devices must be switched off and remain switched off until further notice.”

This is one of the best known aircraft cabin announcements these days, and one which is increasingly receiving 'pushback' as technology around iPhones, Blackberries, iPads, Kindles, laptops and even kids’ electronic computer games, advances – like the aircraft – into the stratosphere.

This explosive [no pun intended] use of personal electronic devices [PEDs]of all kinds has focused more attention on possible interference with the aircraft’s avionics as it takes off and lands. PEDs include cell phones, Palm Pilots, Blackberries, CD/MP3 players, laptops and iPads. With the growth in the range and sophistication of such devices more versions of PEDs are assured.

Consequently, complaints, especially in places like the United States, are rising against the need to switch off the devices, as instructed on virtually every commercial airliner – particularly as no overriding, conclusive evidence confi rms that use of such devices leads to life-threatening interference.

So far few incidents have been attributed to switched on electronic devices at take off or landing, the two parts of the journey where the aircraft would be most vulnerable. The reasons are simple: this is when traffi c between the cockpit crew and air traffi c control is highest; when the crew has to concentrate the most and when their instruments must be working perfectly.

The only exception recorded appears to be the crash of a Crossair fl ight near Zurich, Switzerland in January 2000, where investigators found false readings given by aircraft instrumentation were later traced to the exact time of a text message received by a passenger.

Pilots also continue to fi le incident reports documenting experiences with in-fl ight cell phone usage and speculate on what impact they may have on the pre-fl ight checklist.

Not surprisingly, PED usage is now considered the second most likely cause of air rage, second only to alcohol.

It takes about 10-15 minutes for a commercial aircraft to climb to 10,000 feet, which is considered cruising altitude, so supporters of the ban argue that it is not unreasonable for passengers to turn off personal electronic devices during the fi rst 20 minutes and last 10 minutes of a fl ight to ensure safety.

Take off and landing are the crucial times. Aircraft rarely crash when at cruising altitude so opening up the Kindle or pocket video games is OK. Of course, after much experimentation, the technology now exists for cellphones and computers to be used in fl ight and many larger airlines are already off ering these services.

So why the continued ban? It is very much a matter of governments enforcing the ban to be safe rather than sorry. A blanket ban is the best way of achieving this outcome. For example, portable CD players have been known to cause interference in communications or navigations systems of older, pre-1984 aircraft.

As airlines routinely keep their aircraft in service for 20, even up to 30, years, it's possible that electronic devices could cause problems in these older aircraft.

Another issue is that fl ight attendants cannot monitor every single electronic device on board, nor do they have the training to ascertain if an electronic device might be an interfering agent or not. Many passengers sympathise with the attendants' dilemma, particularly as there have been notable incidents of passengers blatantly ignoring requests to shut down cell phones.

Technology, though, is now playing a major part in reducing the risks, to the point where some aircraft now allow cell phone calls while the plane is taxiing for takeoff and landing, although many still enforce bans, which has led to air rage incidents as people seek to switch on their phones as soon as the plane has landed.

Overall, passengers still support the ban because of the possibility of dangerous incidents, terrorist threats and potential navigational problems. As the technology allows for PED use at cruising altitude, some airlines have also adopted a 'tap not talk' policy so passengers only use texting or email via wireless networks. No talking please!

Some pretty bad incidents do occur, though. In 2004, a passenger on a Japan Airlines fl ight refused to stop e-mailing on his cell phone and assaulted the fl ight attendant who asked him to stop. He stayed on board after promising to behave himself.

Oh, and who are most likely to throw a hissy fi t in the air? According to the author of a book Air Rage: Crisis in the Skies, famous people have a higher likelihood of air rage. This leads to a disproportionate number of air rage incidents occurring in fi rst and business class.

These are not directly related to PEDs, but some of the famous people locked in air rage incidents include Naomi Campbell, who else? Little Naomi went ballistic when her luggage got lost (some might sympathise with the diva on this one); Icelandic singer Bjork lashed out a at a reporter at a Thai airport for just welcoming her to the country. Duh! Snoop Dogg, pretty well known for behaving badly at the best of times, was asked to leave a business class lounge.

But the most famous recent meltdown was Jet Blue fl ight attendant Steven Slater going ballistic when a female passenger opened the overhead luggage compartment, hitting him in the head with the door without apologising. Incensed, Slater made an in-fl ight announcement, grabbed a can of beer, opened the emergency shoot (fortunately the plane was still on the ground) and slid down to the tarmac and his 15 minutes of fame.

As for the PED ban? Overall it will continue to have its have critics, but it's highly likely to stay in place for a long time yet, particularly at large, busy airports and those with frequently poor weather conditions. PED will, increasingly, fi gure in the lexicon of air rage going forward.

Prostate Cancer

Useful info

Prostate cancer is the most commonly diagnosed cancer in men, the leading cause of cancer-related deaths in men, and ranks eleventh in terms of life expectancy lost from any disease.

Initially a taboo subject, not discussed amongst men when having a beer, prostate cancer has been under the medical research spotlight in a big way for a little more than a decade, and the fl urry of activity is starting to show good results through testing and diagnosis refi nements and the development of eff ective new drugs.

The primary function of the prostate gland is to secrete the fl uid that moves sperm forward during ejaculation. The prostate is highly prone to cancer, and the American Cancer Society estimates the number of deaths resulting from prostate cancer at 30,000 each year. But recent years have shown a dramatic drop in the number of men present with the disease in its advanced stages.

Changes in the way prostate cancer is diagnosed are hot topics for study and discussion among health care practitioners. PSA (prostate specifi c antigen) blood testing is the front line screen for prostate cancer. As prostate cancer develops, a protein measured by the PSA test goes up. The optimal age to begin PSA testing, the frequency of testing, as well as the optimal value to detect cancer, remain under investigation. At present, it is recommended that men over 50 be checked annually.

According to Dr See, a leading researcher, "Historically, 50% of men with prostate cancer presented a disease that had already spread throughout the body. Today, fewer than 5% present what we would

Peter Davison is the Manager International Services at Phuket International Hospital.

term advanced disease. The reasons for that are twofold. One is the heightened public awareness. The second is the availability of the PSA blood test. Widespread use of PSA screening has really shifted the stage of disease which men present."

PSA testing is available in Phuket at most hospitals and costs around 900 baht. It is a simple blood check, and whilst it does not replace the older method of testing the prostate, the digital examination, it is a very useful diagnostic tool. PSA is an enzyme produced in the prostate that is found in the seminal fl uid and the bloodstream. An elevated PSA level in the bloodstream does not necessarily indicate prostate cancer, since PSA can also be raised by infection or other prostate conditions. Many men with an elevated PSA do not have prostate cancer. Nonetheless, a PSA level greater than 4.0 nanograms per milliliter of serum was established initially as the cutoff where the sensitivity for detecting prostate cancer was the highest and the specifi city for detecting non-cancerous conditions was the lowest. A PSA level above 4.0 ng per milliliter of serum may trigger a prostate biopsy to search for cancer.

It is important to note that the PSA test is an imperfect screening tool. A man can have prostate cancer and still have a PSA level in the “normal” range. Approximately 25% of men who are diagnosed with prostate cancer have a PSA level below 4.0. In addition, only 25% of men with a PSA level of 4–10 are found to have prostate cancer. With a PSA level exceeding 10, this rate jumps to approximately 65%.

More sophisticated forms of the PSA blood test can be used to further improve the precision of the test.

There are other factors that can infl uence the development of prostate cancer, age being an important one. It is extremely rare for a man under the age of 40 to have prostate cancer, but the likelihood

increases considerably after the age of 50. About 80% of prostate cancers are diagnosed in men over 65. Other factors include race, with a higher rate in Caucasians than Asians. Family history also plays a part, with a higher occurrence if the disease is within the family. Diet and obesity may also play a role.

What is clear, and what the medical experts are telling us men is that PSA testing remains the most widely used screening assay for prostate cancer. If you are male, near or over 50 years old, and you do not know your PSA level, you should immediately have the test.
