Introduction

Shippensburg University (SU) has partnered with WMF to study the current Intercollegiate Athletics locker rooms and facilities to identify issues with Title IX compliance.

The study team includes:

WMF has met with SU stakeholders during summer 2019 to identify and propose corrections to Title IX issues and deficiencies. The study steps included:

1. Inventory existing facilities 2. Review current enrollment and team rosters to evaluate current space requirements including

issues with Title IX regulations within the existing locker room and facility arrangements 3. Identify issues pertaining to inequalities within athletics team locker rooms 4. Plan for correcting existing issues and determine desire for excellence above and beyond

existing facility arrangement 5. Determine existing capacity to accommodate both required and desired goals through

renovation and addition of spaces at existing SU athletic facilities

The following report contains the results of the study findings and recommendations for addressing Title IX issues and disparities that were found during the study process.

EXECUTIVE SUMMARY

Title IX of the Education Amendments of 1972 prohibits discrimination based on sex in any program or activity receiving Federal financial assistance.

Title IX regulations require schools to achieve parity in terms of facilities that are provided for students. The focus of this study includes facility elements such as locker rooms, bathrooms, showers, team rooms and lockers/furniture at the 3 campus facilities used by student athletes: Seth Grove Stadium (SGS), Heiges Field House (HFH) and Henderson Gymnasium (HG). The criteria pertain to both quantity and quality of space and proximity to playing and practice fields.

The study examines and proposes corrections for issues pertaining to exclusive use and comparative quality of the locker room facilities. Ultimately the University will be able to incorporate this into a facilities development and management plan. Standards and guidelines from the Title IX Amendment, the Equity and Title IX in Intercollegiate Athletics Manual (2012), NCAA standards, and the Americans with Disabilities Act (ADA) were references in making recommendations.

Existing ‘General Facility’ Disparities: Shippensburg’s athletics facilities do not meet Title IX or NCAA expectations in several ways as follows:

1. Shared Spaces vs Exclusive Use:There is no equivalency in the numbers of athletes who have exclusive use of their locker rooms by gender:

2. Access to Training and Sports Medicine Facilities:The team locker rooms and sports medicine suites are located in 3 facilities; Henderson Gymnasium, Heiges FieldHouse, and Seth Grove Stadium. There is considerable gender disparity as far as access to these facilities goes.

3. Disparity of Space per Student Athlete:Overall SU has a total of 9,694 sf devoted to Intercollegiate Athletics locker room area (including showers and toiletrooms) and 474 students athletes projected for 2019/20. This averages to 20 sf of locker room per athlete.

There are no men’s teams that have less than the average sf per athlete, but every women’s team (except forwomen’s swimming) has below the average.

4. Disparity of Plumbing Fixtures Per GenderThere is startling disparity when comparing the distribution of plumbing fixtures per gender. A summary is asfollows for the three facilities together. Total men’s plumbing fixtures: 66 Total Women’s plumbing fixtures: 25

It should be noted that there is no provision for private change area in any of the team facilities and private shower are not provided for all current team locker rooms. Due to this situation Shippensburg is not in conformance with NCAA recommendations for transgender student athletes.

SU is deficient in space allocated to Athletic/ Physical Education Service per PASSHE space guidelines.

• This suggested ASF per guideline for current student population is 30,634 ASF• The three buildings within the parameters of this locker room study contain a total of 18,092 ASF• Overall SU reports 19,793 ASF for space type #525 for the 2019-20 school year.

Existing Locker Room Deficiencies and Proposed Corrections: Each of the three facilities could be repurposed for more equitable allocation of spaces for Shippensburg’s Athletic Teams. To provide a similar locker room experience for all teams, there would need to be significant renovation and/or new construction at each facility.

One (exclusive use) locker room per team is proposed - not to be shared by other home teams or visiting teams – this would be in response to current needs for teams to train throughout the school year, not just during their championship season. The one exclusion to this approach would be for a visiting football team- who would be proposed to share with the (M&W) track &field and cross-country locker rooms. This would not create a compliance issue as both a men’s and women’s team would be displaced equally.

3 Lack of standardization of locker rooms in terms of size per person, allocation of plumbing fixtures and quality/aesthetics of space- Comparative quality of the facilities, including HVAC and plumbing) is not equitable between genders.

Standardization of locker rooms so that all teams have more similar locker rooms in terms of size per person, allocation of plumbing fixtures and quality/aesthetics of space.

4 Proximity of team locker room to practice and or playing facility could be optimized

Proximity of team locker room to practice and or play facility is optimized or retained as required.

5 Proximity to training and equipment facilities Proximity to training and equipment facilities is enhanced with addition or renovation of existing facilities and Henderson and Seth Grove.

6 Coach’s offices and proximity to team locker rooms and practice facilities

Coach’s offices are minimally added to Heiges in order to equalize the access for an equal number of female and male athletes.

7 Limitations of facilities in terms of ADA and private change areas.

ADA upgrades and private change areas are proposed to all locker rooms.

8 Lack of separate public and or visiting team and official’s locker rooms.

Public and or visiting team locker rooms are proposed to limit or eliminate sharing of locker room and team spaces. The exception to this would be limited use of general locker rooms by baseball and M/W Track & Field and XC, outside of their championship season, as these are teams whose locker rooms are proposed to be in Seth Grove stadium, but practice indoors during this time period.

Recommended Corrections and Implementation Plan This study of Title IX Issues recommends a phased implementation plan to correct deficiencies at the facilities that are used by the athletics teams at SU; Henderson Gymnasium (HG), Heiges Field House (HFH) and Seth Grove Stadium (SGS).

The study process investigation determined that SU should make corrections of disparities in 3 main areas: exclusivity of team use, square footage of space per athlete and fixtures per athlete. These corrections would make a meaningful impact in the equitable treatment of SU’s student athletes.

The study further outlines specific renovations, additions and new structures to correct the issues, as well as a sequence or phasing recommendation for accomplishing these goals.

Title IX Issues Facing Shippensburg University

The methodology for the study has included taking inventory of all athletic locker rooms including locations and facilities, and analyzing them in the context of SU’s current student population, athletic teams, and relevant existing laws and regulations.

Relevant Laws, Regulations and Authorities:

The following are laws and regulations that are relevant to the study of the allocation of spaces for student athletes.

Title IX

Title IX of the Education Amendments of 1972 prohibits discrimination on the basis of sex in any program or activity receiving Federal financial assistance.

Title IX regulations require schools to achieve parity in terms of facilities that are provided for students. For the focus of this study, this includes facility elements such as locker rooms, bathrooms, showers, team rooms and lockers and pertains not only to quantity but also to quality of space and proximity to playing and practice fields.

TITLE IX COMPLIANCE

Title IX mandates gender equity in three separate areas of an institution’s athletics program. This includes: effective accommodation of interests and abilities (athletic participation), financial aid (athletic scholarships), and treatment of student-athletes (other benefits and opportunities). Compliance with the law requires full compliance with each of the three areas individually.

Regarding the first item (accommodation) , SU must meet one of the following criteria (prongs)

1: Provide participation opportunities for male and female students that are substantially proportionate to their respective full-time undergraduate enrollments;

2: Demonstrate a history and continuing practice of program expansion for the underrepresented sex;

3: Fully and effectively accommodate the interests and abilities of the underrepresented sex.

The following checklist is from the Equity and Title IX in Intercollegiate Athletics Manual (2012) with the key items for this study being in regard to the locker room facilities.

benefits provided equally to male and female teams? e) Are the conditions of playing fields, courts and pools equal for male and female

teams? f) Do any facilities have limitations on their use? g) If so, what are the limitations? Why? h) Which teams have the newest and best-equipped facilities? i) Do we have a facilities development and management plan?

The study examines and proposes future facility additions and renovations that allow Shippensburg University to comply with Title IX standards that support the participation opportunities for male and female students relating to point ‘a’ above “locker rooms and team rooms” and considering points ‘f’, ‘g’ and ‘h’ relating to the existing facilities.

Most importantly the study will examine and propose corrections for issues pertaining to exclusive use and comparative quality of the locker room facilities. Ultimately the University will be able to incorporate this into a facilities development and management plan.

NCAA:

“Title IX compliance is assessed through a total program comparison. In other words, the entire men's program is compared to the entire women's program, not just one men's team to the women's team in the same sport. The broad comparative provision was intended to emphasize that Title IX does not require the creation of mirror image programs. Males and females can participate in different sports according to their respective interests and abilities. Thus, broad variations in the type and number of sports opportunities offered to each gender are permitted.”1

Q. Does Title IX require that equal dollars be spent on men and women's sports?

No. The only provision that requires that the same dollars be spent proportional to participation is scholarships. Otherwise, male and female student-athletes must receive equitable "treatment" and "benefits."2

The study will examine and propose renovations that comply with NCAA standards regarding Title IX.

Americans with Disabilities Act (ADA)

All new buildings shall be designed to be compliant with ADA regulations. This includes path of travel to and within facilities and access to a determined number of aspects within facilities such as lockers, toilets and showers. Any facility that is to be renovated should have the goal of reaching compliance and the International Building Code requires that building owners allocate a minimum of 20% of their renovation budgets towards this end goal.

The study will examine and propose renovations that comply with ADA and the International Building Code (2015).

PASSHE Space Guidelines: The PASSHE Facilities Manual space guidelines classify locker rooms as #525, Athletic/ Physical Education Service. This guideline indicates that SU should have 10,000 assignable square feet (ASF) for the first 2,000 FTES (FULL TIME EQUIVALENT STUDENTS) (Fall) + 6 ASF per FTES above Core.

Fall 2018- SU had 5,439 FTES

Core: 2,000 students- 10,000 ASF

3,439 x 6 ASF= 20,634 ASF

Total ASF suggested per guideline 30,634 ASF

Note:

• This square footage varies slightly per year, as the FTES varies each year. • The three buildings within the parameters of this locker room study contain a total of 18,092 ASF • Overall SU reports 19,793 ASF for space type #525 for the 2019-20 school year.

Currently SU has a shortfall of space classified as #525 Athletic/ Physical Education Service and therefore does not meet the guideline used by PASSHE to determine space required to “accommodate the mission requirements of the institution”.

This shortfall contributes to a general overcrowding of locker rooms and related service facilities and makes it difficult for SU to strive for equality for student athletes.

The square footage area used for examination of ASF per athlete in this report only looks at the locker rooms and shower/ toilet areas that are included in category #525 and does NOT include functions like storage and press boxes.

Existing Facilities Shippensburg University (SU) has three existing facilities that are located at two ‘Athletics Nodes’ on campus.

The northern node includes Seth Grove Stadium (SGS), Heiges Field House (HFH) and Fairchild Field.

Seth Grove contains a locker room and sports medicine room for the Football Team with use by other teams in the spring season. It is adjacent to both the practice field and the stadium (competition field).

Heiges Field House houses sports facilities including an indoor court, the campus indoor swimming pool and racquetball courts.

Teams housed in this building include Women’s and Men’s Basketball, Track and Field and Cross Country, Swimming, as well as Women’s Volleyball, and Men’s Wrestling and Baseball.

The Second (south) node include the Robb Sports Complex and Henderson Gymnasium (HG).

Robb Sports Complex contains practice and competition facilities for Men’s Soccer and 5 women’s teams: Soccer, Field Hockey, Lacrosse, Softball and Tennis.

The existing team locker rooms are generally in proximity to the practice and competition facilities for each sport.

The existing locker rooms are overcrowded and in the case of Heiges locker rooms, are shared with the public.

It should be noted that correcting the general use of the locker rooms at Heiges will help with the equitable experience for the student athletes and simultaneously reduce the universiy’s liability while creating a more enhanced situation for the general campus population in use of the Heiges facilities.

Observations Regarding Locker Rooms:

SU is required by Title IX to provide equivalent benefits and opportunities for student athletes including locker rooms of equivalent quality, size and amenity- including size and quality of lockers and team rooms, and proximity and access to shower and toilet rooms.

The need to address these issues is further called out in the 2012 Equity and Title IX Intercollegiate Athletics Manual as follows:

Locker rooms and team rooms frequently are identified as areas where inequities exist. The number, size and quality of the lockers and the relative size and quality of the locker room as a whole must be evaluated in context with the size of the team. The locker room environment must be assessed, including the comparable number, size and quality of the shower stalls, restroom facilities, mirrors, chairs and benches. While locker rooms do not have to be mirror images of one another, the situation of the men’s teams should be comparable to the situation of the women’s teams. The football team ordinarily has the largest locker room, which is understandable given the participation numbers and equipment needs. However, problems inevitably arise when that locker room is disproportionately large in size or has the best and most recently acquired furnishings. The presence of entertainment equipment also needs to be considered as part of the overall assessment.3

Both the quality and quantity of the facility and its specific parts are of the utmost importance in determining equivalency.

Existing Team Rosters:

Shippensburg team rosters in 2019-20 are reflective of a growing population of female students and female athletes (223 female athletes in the 2018-19 roster as compared to 232 in the 2019-20 school year).

Although the exact team numbers change each year, roster expectations are communicated annually to each head coach and they have reflected a shift in a growing number of female athletes on the intercollegiate teams.

Existing ‘General Facility’ Disparities: Shippensburg’s athletics facilities do not meet Title IX or NCAA expectations in several ways as follows:

1. Shared Spaces vs Exclusive Use:

Due to both in-season games (the championship season) and off-season training needs, Shippensburg provides locker rooms for teams during the entire year. This situation forces sharing between both home teams and also with visiting teams. Almost every team shares a locker room with 1 or more home teams as well as visiting teams and/or officials.

There is no equivalency in the numbers of athletes who have exclusive use of their locker rooms by gender:

Men’s soccer and football both have exclusive use locker rooms (88+27= 115 male athletes) as compared to the women’s rosters, where only basketball has exclusive use (15 female athletes)

The situation at Henderson is particularly out of compliance for Title IX because the building has two locker rooms where five women’s teams (127 student athletes) share one locker room and one male team (27 student athletes) occupy the second locker room.

The lack of both team space and privacy for athletes places a large disadvantage on these five women’s teams. The shared condition also limits the same ‘team specific aesthetics that the single occupant men’s team is able to benefit from.

2. Access to Training and Sports Medicine Facilities:

The team locker rooms and sports medicine suites are located in three facilities; Henderson Gymnasium, Heiges Field House, and Seth Grove Stadium. There is considerable gender disparity as far as access to these facilities goes.

Henderson Gymnasium contains the oldest dilapidated training room in the lowest level of the building. It serves more than 50% of the SU female student athletes, but only 11% of the male athletes. It is too small for its intended purpose.

Heiges Field House contains the newest training room, the recently renovated weight room and the rehabilitation center. More than 50% of the SU female athletes must travel a considerable distance from their locker room facility to use these facilities. While almost 47% of the male athletes have locker rooms in other buildings, three quarters of these athletes have a much shorter travel distance to this facility.

Seth Grove Stadium houses an exclusive use training facility during the football championship season for a men’s team (88 athletes). No such exclusive use facility exists for an equivalent number of female athletes. While it is older than the sports medicine room in Heiges, it is in much better shape, a more suitable size and with more equipment than the training facility in Henderson.

3. Disparity of Space per Student Athlete:

Overall SU has a total of 9,694 sf devoted to Intercollegiate Athletics locker room area (including showers and toilet rooms) and 474 students athletes projected for 2019/20. This averages to 20 sf of locker room per athlete.

There are no men’s teams that have less than the average sf per athlete, but every women’s team (except for women’s swimming) has below the average.

The deficiencies of both team sf/ athlete and sharing situations are noted in red in the charts below.

The teams have even less exclusivity due to use by visiting teams and officials.

Sharing locker rooms with visiting teams, other home teams, and often the public or officials is an administrative / logistic issue. It likely interferes with the team’s being able to enjoy the benefits of a team room, including: a space to focus; a place to enhance a team’s pride and confidence; and a place where team memorabilia and coaching items can be safely shared and displayed.

It should also be noted that this sharing with the public is a major liability issue for SU.

4. Disparity of Plumbing Fixtures Per Gender

There is startling disparity when comparing the distribution of plumbing fixtures per gender. A summary is as follows for the three facilities together:

Although the university has supplied similar benches or folding chairs to each locker room, there is also an inequity of these furnishings due to the square footage of the locker rooms and the number of athletes sharing the rooms.

It should also be noted that the lack of individual shower stalls is an issue for NCAA standards.

Existing ‘Sport Specific’ Disparities:

In addition to the overall gender provisions and disparities, the ‘like sports’ shine a further light on this same problem of inequity.

Soccer:

The women’s soccer team is the most problematic from a Title IX standpoint:

• Their square footage per athlete and nonexclusive use of the room vis a vis home teams and visiting teams puts the women’s team far below parity for quality of facility provided.

• The women’s team shares a locker room with 4 other teams.

• The team space for the women is shared space. • The men’s soccer team has an exclusive use room,

except for visiting teams that acts as a team room/ meeting space.

• The shower facility is substandard with a poorly ventilated gang shower and old bathrooms.

It should be noted that both soccer team’s locker rooms are in equal proximity to their playing and practice field.

While this locker room is only one of three on campus with a private shower, these are not ADA compliant and likely suffer from ventilation issues.

Track &Field and Cross-Country:

The disparity issue is also high between men’s and women’s Track & Field and Cross-Country. They are both in shared spaces, but:

• The square footage per female athlete is less than one third of the square footage for the male team.

Swimming:

The women’s swimming team has a greater square footage per athlete than the male team, but:

• this space is poorly located compared to the men’s team in terms of direct access to the swimming facility.

Other Related Deficiencies:

It should be noted that there is no provision for private change area in any of the team facilities and private shower are not provided for all current team locker rooms.

Due to this situation Shippensburg is not in conformance with NCAA recommendations for transgender student athletes.

Future Teams:

If SU is to expand intercollegiate athletics offerings to include a future team sport, this will be done by following the Title IX participation prong that is decided on by SU (see p.5 for list of prongs).

There is no space available in any of the three existing facilities for a locker room to support such an endeavor. Without addressing the existing deficiencies that the addition of a new team sport would bring, this would only exacerbate the existing Title IX issues.

Existing Locker Room Deficiencies and Proposed Corrections: Each of the three facilities could be repurposed for more equitable allocation of spaces for Shippensburg’s Athletic Teams. To provide a similar locker room experience for all teams, there would need to be significant renovation and/or new construction at each facility.

Major issues that need to be addressed are:

1. SU does not meet Title IX compliance and does not have an approved plan to address these issues.

2. Shared locker rooms do not meet current athletic needs for teams to train throughout the school year or during their championship season.

a. Exclusive use of the existing locker rooms is not equitable 3. Lack of standardization of locker rooms in terms of size per person, allocation of plumbing

fixtures and quality/aesthetics of space- a. Comparative quality of the facilities is not equitable between genders. b. MEP (ventilation, general state of plumbing) issues exist as part of this inequity.

4. Proximity of team locker room to practice and or playing facility could be optimized 5. Proximity to training and equipment facilities 6. Coaches’ offices and proximity to team locker rooms and practice facilities 7. Limitations of facilities in terms of ADA and private change areas. 8. Lack of separate public and or visiting team and official’s locker rooms.

Proposed Corrections:

The following pages illustrates a strategy for each facility where there would be:

1. An approved plan to bring facilities into compliance with Title IX. 2. One (exclusive use) locker room per team is proposed - not to be shared by other home teams

or visiting teams – this would be in response to current needs for teams to train throughout the school year, not just during their championship season. The one exclusion to this approach would be for a visiting football team- who would be proposed to share with the track &field and cross-country locker rooms (men’s and women’s). This would not create a compliance issue as both a men’s and women’s team would be displaced equally.

3. Standardization of locker rooms so that all teams have more similar locker rooms in terms of size per person, allocation of plumbing fixtures and quality/aesthetics of space.

4. Proximity of team locker room to practice and or play facility is optimized or retained as required.

5. Proximity to training and equipment facilities is enhanced with addition or renovation of existing facilities and Henderson and Seth Grove.

6. Coaches offices are minimally added to Heiges in order to equalize the access for an equal number of female and male athletes.

7. ADA upgrades and private change areas are proposed to all locker rooms. 8. Public and or visiting team locker rooms are proposed to limit or eliminate sharing of locker

room and team spaces. The exception to this would be limited use of general locker rooms by baseball and M/W Track & Field and Cross Country, outside of their championship season, as these are teams whose locker rooms are proposed to be in Seth Grove stadium, but practice indoors during this time period.

Henderson Gymnasium- Proposed The study team has proposed two options for corrections to Henderson Gymnasium. Due to the inequities for the five women’s teams (representing more than 50% of the population of SU female athletes) addressing this facility is the highest priority for the university in addressing Title IX issues.

Option 1: Includes a renovation to the existing locker room area and a renovation to the existing pool area- a part of the facility that is currently used only for storage. It proposes that every team has its own locker room, with exclusive use showers and team rooms and that a new visiting team locker room, as well as a separate locker room for officials and coaches be built in the renovated area.

Phasing: this option could be realized in sequence as follows:

1. Renovate pool area into new locker rooms 2. Move teams into these rooms- shared spaces are acceptable for 1 season while

permanent locker rooms are constructed 3. Renovate current team locker room area 4. Move teams into new locker rooms and use the renovated pool locker rooms as

noted.

Option 2: Includes construction of a new locker room facility adjacent to Henderson and the playing fields. This new structure would include six locker rooms, an equipment/ laundry room as well as sports medicine.

Phasing: this option could be realized in sequence as follows:

1. Build new locker room building 2. Move teams into these rooms 3. Renovate current team locker room area for visiting team’s coaches and officials 4. Renovate pool area as budget permits

Both options address Title IX issues for existing teams. The resolution does not involve other facilities on campus as part of the solution.

Seth Grove Stadium- Proposed After review of several options for Seth Grove Stadium, the study team has proposed one option for corrections to this facility that allows maximum benefit for teams housed here as well as at Heiges Field House by relocating locker rooms for Baseball as well as Men’s and Women’s Track & Field/ X Country to a renovated Seth Grove.

Preferred Option: Includes a new structure for football locker room, sports medicine for six teams, and coaches and official’s locker rooms (6 teams). There would also be renovation to the existing football locker rooms into M/ W Track & Field and X-Country locker rooms and renovation of the existing training room for a baseball locker room.

Phasing: this option could be realized in sequence as follows:

Heiges Field House- Proposed

The study team has proposed 2 options for corrections to Heiges Field House. The goal for addressing inequities between genders and teams includes first moving locker rooms for Baseball and Men’s and Women’s Track & Field and Cross Country to a renovated Seth Grove Stadium.

Option 1: Includes a renovation to the existing locker room area on the main floor of the building, along with selective renovations to the second floor for offices and coaches’ locker room facilities and to select areas of the basement for locker rooms.

Phasing: this option could be realized in sequence as follows:

1. Renovate the basement area (racquetball courts) into three team locker rooms 2. Move teams into these rooms- shared spaces are acceptable for 1 season while

permanent locker rooms are constructed 3. Renovate 2nd floor classrooms for relocation of athletics offices 4. Renovate:

a. current first floor team locker room area (into six team locker rooms and sports medicine and equipment rooms) and

b. office area into public bathrooms c. second floor men’s room into coach’s locker room

5. Move teams into new ground floor locker rooms

Option 2: Includes a renovation to the existing locker room area on the main floor of the building, along with more encompassing renovations to the second floor for locker rooms offices and coach’s locker room facilities. The existing 2nd floor football office suite would be relocated to SGS. There would also be a smaller scope of renovations to select areas of the basement for offices. It should be noted that the addition of these offices to SGS will impact necessity for other office space for other sports.

Phasing: this option could be realized in sequence as follows:

1. Renovate one racquetball court for offices for Volleyball and Basketball teams. 2. Renovate 2nd floor classrooms for team / GP locker rooms- shared spaces are

acceptable for one season while permanent locker rooms are constructed a. Renovate the basement locker room into staff/official’s locker area

3. Renovate: a. current team locker room area (into five team locker rooms and sports

medicine and equipment rooms) and GP Swimming locker rooms b. office area into public bathrooms c. second floor men’s room into coach’s locker room d. Move teams into new ground floor locker rooms

Both options rely on first moving teams to Seth Grove. Option 1 allocates space for general purpose locker rooms to the basement of Heiges, while Option 2 allows for there to be GP swimming locker rooms on the main level in close proximity to the swimming pool. This is possible due to the football office suite and the second GP classroom being vacated and available to be renovated into locker rooms.
