Introduction

Almost one person in every five in New South Wales lives with a disability.

Under the Commonwealth Disability Discrimination Act 1992, it is unlawful todiscriminate against a person with a disability in many areas of daily livingincluding education, access to public premises, provision of goods, servicesand facilities, accommodation, purchasing land or premises, activities of clubsand sport, the administration of Commonwealth laws and requests for certaininformation.

The Act takes into consideration the disadvantages that occur when peoplewho live with a disability encounter barriers that prevent their access toservices that are available to other citizens.

People who live with disabilities are equal members of our community, andShellharbour City Council has a responsibility to identify any potentialdiscrimination and to ensure equality in the services it provides.

After reviewing its services, Council’s Disability Services Advisory Committeehas identified a number of areas that need to be addressed. Those needshave been the basis for this plan.

This Disability Strategic Plan follows the publication in 1999 of ShellharbourCity Council’s Social Plan. It has been developed by working with staff andcustomers in accordance with the NSW Government Disability PolicyFramework and reflecting the Commonwealth Disability Discrimination Act1992 and the NSW Disability Services Act 1993.

Buildings and Facilities Audit

Council commissioned an audit of its facilities to assist the completion of thisStrategic Plan.

All council buildings and facilities were inspected to determine whether theycomplied with the Australian Standard 1428.1.

The audit was conducted by Noel Hiffernan, a recognised Access Facilitatorand member of the Access Institute of New South Wales. Work on the auditstarted in August 2000 and was completed in February 2001.

Council received a written report of Mr Hiffernan’s findings in June 2001.

The Australian Quadriplegic Association was engaged early 2002 to conductfurther inspections on selected buildings and facilities located in the CroomeRoad Sporting Complex.

Council received a written report on these findings in June 2002.

Why Have A Plan?

Shellharbour City Council wants people who have a disability to have equalaccess to services.

Equal access means that rather than put in place special or parallel disabilityservices, discrimination in general services will be eliminated, and that overtime, people with a disability will have equal access to services.

This Disability Strategic Plan clearly shows Council’s goals, the actionsnecessary to achieve those goals, and the timeframes that Council has setitself. It ensures that Council is addressing the requirements of The DisabilityDiscrimination Act 1992.

The plan is a public statement of Council’s commitment to achieving fullaccess to services for people with a disability. The Strategic plan builds onand gives structure to the Social Plan published in 1999 and formalisesCouncil’s existing plans which have developed over more than five years.

The Disability Strategic Plan moves Shellharbour City Council into a newproactive phase, actively considering and addressing the needs of peoplewith disabilities.

What is Disability?

The Disability Discrimination Act 1992 gives a broad definition of “disability”as it applies to a person. The Act defines disabilities as including

• Physical• Intellectual• Psychiatric• Sensory• Neurological• Learning disabilities• Physical disfigurement• The presence in the body of a disease causing organism.

The definition in the Act means that everyone with a disability, regardless ofseverity is protected.

It includes disabilities that a person may have now; that they have had in thepast - such as a mental illness; that they may develop in the future - forexample where there may be a family history of a disability that could developin the future; and where a person is believed to have a disability such as HIV /AIDS.

What is Access?

Access is all about allowing equal opportunities for everyone.

There are a number of different definitions of access.

For people with a physical disability, access may mean being able to movealong or cross a street, use a public toilet, an ATM or public telephone. It isabout being able to enter a building and move to all areas of that building.

Captioned television, listening systems and visual aids are facilities that mayprovide access to people with a vision or a hearing impairment.

People who have an intellectual disability gain access with clear signing inbuildings and streets, and considerate assistance from other people.

And all people with a disability, including a psychiatric disability, gain a broadaccess by acceptance and inclusion in the community.

Background

To create and promote opportunities, services and facilities to enable peoplewith disabilities to participate fully in the community it is necessary todetermine areas of priority.

The priority action areas are broadly grouped under the following headings.

Physical Access

There are two critical aspects for access and mobility of people withdisabilities:

• Being able to pursue a path of travel in the same uninterrupted was asother people, and

• Being able to take advantage of what is generally offered to other peoplein the community.

Shellharbour City Council recognises that all people should have access toservices and facilities on an equitable basis. Council will provide services in away that meets the needs of all members of the community.

Promoting Positive Community Attitudes

Changes in attitude are often linked to changes in behaviour, and as peoplewith disabilities are seen using community services more often, theirpresence will become accepted, then expected, and in time, unremarked.Change in attitude can be gradual, but is helped by accurate information andeducation.

The Community Services Department has clear goals which include fosteringan informed community in the Shellharbour City area encouraging harmony,tolerance and acceptance of all members of our community.

This goal is assisted by the Disability Services Advisory Committee whichprovides an accessible link for members of the community to all levels ofCouncil. The committee oversees, plans and advocates for the needs ofpeople with disabilities to maintain and enhance access and equity toservices and facilities.

Council is already demonstrating its commitment by taking on roles andoffering services such as HACC Services, Respite Care and CommunityTransport.

Training Staff

Shellharbour City Council is committed to ongoing training for staff tomaintain a skilled and harmonious workforce which will ensure a continuallyimproving high level of service to all members of the community.

New Council staff members undertake a brief overview of key disability issuesduring their induction course. One-day disability awareness training coursesare now available for Councillors, Senior Managers and other staff withspecialised courses available for specific staff members.

Information About Services

Council offers a wide range of services and facilities.

In line with the policy that everyone should have access to services andfacilities on an equitable basis, there is printed information in a number ofdifferent languages and personal assistance is available from LanguageAides employed by Council. To help communication with deaf people,Council has adopted policy to use ACE – National Relay Service.

To find the best applicants for the positions, Council focuses on therequirements of the job rather than questions or assumptions about theapplicant’s circumstances or background.

Council has put policies, practices and procedures into place to monitoremployment to ensure that all areas of staff management follow equalopportunity principles.

Complaints procedures

Shellharbour City Council welcomes feedback from the community which willenable it to improve the quality of its services.

A formal and informal complaints procedure has been recommended whichwould entail recording written and verbal complaints and then taking theappropriate action. It has been further suggested that complaints specificallyrelating to access / disability should be recorded to keep track of individualand structural issues.

Where To From Here?

The next section of this Disability Strategic Plan lists areas identified in theAccess Audits as needing attention.

After a process of consultation, Council Disabilities staff have prioritised thework that needs to be done to ensure equality in the services Councilprovides.

Council will address some aspects of the Disability Strategic Plan within thescope of day to day maintenance work. Other work will be performed overtime within the budget set by Council.
