Notification No: 39-2020

Ministry of Commerce issued this procedure in exercising of power conferred under
Section-13 (b) of the Import and Export Law.
Chapter (1)
Title and Definitions
1. This procedure shall be called “Procedures for Importing Liquor form Abroad”.
2. The followings shall have meanings hereunder mentioned in this procedure;
a) “Liquor Importing Registration Certificate” means the registration certificate issued by
the Department of Trade in accordance with the stipulation.
b) “The Relevant Ministry” means the Ministry of the Office of the Union Government,
Ministry of Commerce, Ministry of Planning, Finance and Industry and Ministry of
Health and Sports
Chapter (2)
Objectives
3. The objectives of this procedures are as follows-
a) To sell and consume quality products;
b) To control the illegal trade;
c) To levy all the revenue;
d) To supply the needs of the local market.
Chapter (3)
Companies eligible for the importation of liquor and the Import Process
4. Companies applying to import liquor form the abroad;
a) Shall be a Myanmar company established under the Myanmar Company Law;
b) Shall have an export/import registration certificate;
c) Shall have one director holding an FL-11 license (license for the wholesale of foreign
alcoholic liquor);
d) Shall be an Exclusive Distributorship or Exclusive Dealership for one or more different
brands of foreign liquor distributors;

e) Shall have a premise for the distribution or a warehouse permitted by the relevant
District General Administration Departments;
5. Companies which is met with the qualification in paragraph (4) shall apply for a liquor
import registration certificate and an import license at the Department of Trade under the
Ministry of Commerce in order to be permitted to import liquor from abroad.
Application for a Liquor Importing Registration Certificate
6. When applying for a Liquor Import Registration Certificate;
a) A company wishing to import ready-to-drink liquor form abroad shall apply with the
following documents;
1) Application with company letter head (including Company name and Registration
Number)
2) The original FL-11 License (license for the wholesale of foreign alcoholic liquor)
3) The original or copy of the Exclusive Distributorship Contract or Exclusive
Dealership Contract
4) If the applicant is not a director of the company, power of the attorney and copy
of the Registration Certificate
5) Information about the liquor to be imported;
(aa) Percentage of alcohol
(bb) Product name, type, brand, ingredients and packaging style
(cc) Manufacturing Date and Age
(dd) Country of origin, name and address of the manufacturing company
6) Liquor Storage Certificate or Distribution License issued by the relevant District
General Administration Department
7) Address of the liquor warehouse and shop
b) A company wishing to import rectified spirits shall apply with the following documents;
1) Application with company letter head (including Company name and Registration
Number)
2) Original liquor license FL-4 (license to compound, blend, flavor or color) and FL-5
(bottling) of the rectified spirits which is imported from the abroad in the name of
the one of the directors of the company
3) If the applicant is not a director of the company, power of the attorney and copy
of the Registration Certificate
4) Information about the rectified spirits;
(aa) Percentage of alcohol
(bb) Product name, type, brand, ingredients and packaging style
(cc) Country of origin, name and address of the manufacturing company
5) Address of the manufacturing and bottling premise

7. The Liquor Import Registration Certificate is valid for (1) year.
8. Any person wishing to extend the term of the Liquor Import Registration Certificate shall
apply for renewal at least (3) months prior to expiry as specified in paragraph 6.
Application for an Import License
9. A license to import liquor shall be applied with the following documents;
a) Application with company letter head (including Company name and Registration
Number)
b) Origin of Proforma Invoice or Sale Contract (complete information about the imported
liquor shall be provided)
c) Liquor Import Registration Certificate (Origin and Copy)
d) Sample where the name of the importer company is shown on the bottle
e) Origin of the recommendation from FDA
f) If the applicant is not a director of the company, power of the attorney and copy of the
Registration Certificate
10. The term of the Liquor Import License is specified by the Ministry of Commerce
Chapter (4)
Terms and Conditions of the Liquor Import Permit
11. Liquor from abroad shall only be imported through the Yangon Port and Yangon Airport.
12. The minimum CIF Value is USD 8 per liter
13. A company holding a Liquor Import Registration Certificate;
a) Shall display the liquor type, net volume, percentage of alcohol, name of the importer
company and address of its registered office or main business premises on the
container
b) Shall attach and distribute the Tax Paid as administered by the Internal Revenue
Department within 21 days before the liquor is moved from the Custom Department’s
warehouse
c) The list of incoming, outgoing and remaining goods shall be inspected by the relevant
departments
d) The liquor shall only be stored at licensed premises or warehouse permitted by the
District General Administration Department

Payment of applicable of taxes
14. A company permitted to import liquor shall pay applicable taxes as specified in the relevant
laws, rules, procedures and guidelines
15. A company applying for permission to import liquor shall pay Liquor Import Registration
fees, renewal fees, fees for amending the registration certificate and import license fees
as specified by the Ministry of Commerce
Distribution and Opening of Shop
16. A company permitted to import liquor shall comply with the relevant laws, rules,
guidelines, orders, directives and procedures with regards to transportation, distribution
and sale of liquor and the opening of liquor shop
Chapter (5)
17. A company permitted to import liquor shall be inspected by the relevant ministry from
time to time for the compliance with the directives issued for the import, distribution and
sale of liquor
18. A company permitted to import liquor violate any of the terms and conditions in this
procedure shall be suspend the importation of liquor or revoke the Liquor Import
Registration Certificate.
Chapter (6)
Miscellaneous
19. The import of liquor from the duty-free shop and hotels shall be permitted in separate
procedures issued by the Ministry of Commerce
20. The terms and conditions for foreign liquor import permit shall be amend in accordance
with the changing cirumstances.
