Dear Dan, following on from your email the report states that access is provided by the 10ft strip of

With reference to our telephone conversation, we are referring to PA031 plot AY1206.
It states the following:-
UNDER IS THE SITE ACHIEVABLE
"Access is provided by 10ft right of way to the east of the site on land in private ownership. Through
summary investigation, right of way providing access to the site is confirmed."
ANY OTHER COMMENTS
"Drawings provided illustrating the right of way."
The private road at Les Rochers (road in yellow.pdf) is governed by a covenant (please see the
attached deed) which allows plots to the east (being the original plots 141 & 143 as per the attached
diagram 5) of the road a right of way for access and services purposes.
No covenant, dealing with access and service rights, exists between Plot AY1206 (previously plot 140
as per the attached diagram 5), and Plot AY1213, the private road.
Please can you provide the information showing the drawings giving the right of access to Plot
AY1206 and also what summary investigations were done which confirmed this right of access to the
site as per the Call for Sites Assessment dated 11 March 2016.

Dear Mr Langton With reference to the Public Enquiry into the Land Use Plan (LUP) we would like to comment on the proposed changes to Zone 12 of the 2011 LUP.
In the 2006 LUP Les Rochers was considered to be for low density housing ie each plot had to be a quarter of an acre. In the 2011 the LUP was updated to include the requirement that proposals for roads and services to adoptable standards were required to be submitted with any proposed development. This was included in the 2011 LUP to ensure roads were of an acceptable standard. In the latest proposal Zone 12 Les Rochers has been merged into HCA11 does this mean the criteria contained within the 2011 LUP are no longer applicable and are now replaced by the LUP Section 1 Policy Guidelines. Dealing with Les Rochers and the Call for Sites review we would like to obtain the Inspectors opinion as to whether ARUP has taken into account Sections 2.6.5 Design, 2.6.6 Character & amenity and 2.6.12 effect on adjoining property when the report was compiled. Another area we would like clarification on is the issue relating to access and whether the Building and Development Control Committee has to take legal access issues into considerations in future applications.

With reference to the recent Land Use Plan Review, Call for Site Assessment, issued 11 March 2016 we
would like to draw your attention to inaccuracies which are contained within the report drawn up by AURP
under Appendix B, Assessment of Sights Submitted under reference PA031.
1) Under the heading "IS THE SITE ACHIEVABLE" the report states “Access is provided by 10ft right of
way to the east of the site on land in private ownership. Through summary investigations right of way
providing access to the site is confirmed”
We would like to ascertain what summary investigations were undertaken that resulted in ARUP arriving at
their conclusion. The Right of Way which the report refers to is governed by a covenant, ARUP have failed
to take this into account when they compiled their report. As the owners of Plot AY1213 we have not
entered into correspondence with the owners of Plot AY1206 (ref PA 031) with regards to access rights.
2) Under the heading "ANY OTHER INFORMATION" the report states “Drawings provided illustrating
the right of way”
How did AURP arrive at their conclusion as there are no drawings at the Land Registry which supports
their findings.
The information which is at the Land Registry is as follows:-
a) Ordinance Survey Map showing the access route to Plot AY1206 reference PA031
(previously plot 140) via the tilde marking.
b) The 1969 Covenant which deals with how Plot 141 was subdivided and how the right of way
came into existence.
c) A copy of the original John Doyle conveyance map for Plot AY1213, and an extract from the
Land Registry showing how the plots at Les Rochers have since been developed.
Please can you advise what is going to be done to rectify these inaccuracies.
