I. INTRODUCTION
A. Report Purpose and Scope
1. This report describes implementation status of occupational safety and environment works
the Support to Border Areas Development Project, including sub-projects in Kon Tum, Gia Lai, Dak
Lak, Dak Nong, Binh Phuoc in reporting period from July to December 2019. Contents of the
monitoring report include: Implementation of environmental management and monitoring programs;
Compliance with regulations of the Government of Vietnam, policies of ADB as well as the Loan
Agreement on environment; Organization of public consultations and information disclosures;
Received grievances and feedbacks. By these, problems arising can be identified and specific
solutions and plans for the next actions can be suggested in order to mitigate impacts to
environment and affected people as well as comply with environmental regulations, policies.
B. Project Objective
2. In 2016, the Prime Minister of Vietnam ratified the Support to Border Areas Development
Project implemented under the Loan Agreement No. 3499-VIE (COL) signed between the Asian
Development Bank and the Government of Vietnam on 04/05/2017. On the same day, a Project
Agreement was signed between ADB and the People's Committees of five provinces in Vietnam in
the Vietnam Development Triangle Area (VDTA) including Kon Tum, Gia Lai, Dak Lak, Dak Nong,
Binh Phuoc.
3. The long-term objective of the project aims to create a favorable environment for the flow of
goods, people, capital and potential exploitation of agriculture, forestry and tourism by promoting
economic growth, hunger eradication and poverty reduction, narrowing the gap between provinces
in VDTA.
4. Main outputs of the project:
• Output 1: Infrastructure in five VDTA provinces rehabilitated.
• Output 2: VDTA plans and facilities for transport and trade facilitation, with a focus on inclusive growth developed.
• Output 3: Institutional capacity for VDTA investment planning, project design and implementation, and resource management strengthened.
C. Project Benefits
5. The Project will help VDTA to overcome current hurdles and contribute to carry out
Cambodia - Lao PDR - Vietnam Development Triangle Area (CLV-DTA)'s objectives through: (i)
building greater and safer transport connectivity by upgrading critical roads linking producers to
markets, and rural communes to commercial and administrative centers; (ii) improving access to
schools and health care services; (iii) supporting transport and trade facilitation; (iv) promoting
inclusive community based tourism to improve the livelihoods of rural people, especially ethnic
minorities marginalized by recent economic development; and (v) strengthening provincial capacity

for more strategic investment planning and efficient project management. This integrated area
approach will help rural communes to diversify economic and employment opportunities by
connecting them to increasing trade and passenger flows.
6. The Project will create more motives for ADB's long-term commitments to the economic
partnership programs of the Greater Mekong Subregion (GMS) through more cooperation and
integration between border regions of 3 CLV countries. This project is also in line the Transport
and Trade Facilitation Action Plan for the GMS, the CLV-DTA's Master Plan and the National
Transport Development Strategy. The project is also in line with the ASEAN Tourism Strategic Plan
2016-2025, the GMS Tourism Strategy, and the Vietnam Tourism Development Strategy until 2020,
with a vision to 2030. Overall, the project will contribute expand market access opportunities as
proposed by the ASEAN Economic Community.

II. PROJECT IMPLEMENTATION PROGRESS
7. During the reporting period, no road construction works have had contractors selected but
is heading to soon have contractor recruited to commence the construction. On the other hand,
there are 02 construction packages on-going in tourism subprojects are KT-Cw-03 in Kon Bring
and Kon K'Tu villages, Kon Tum province and BP-Cw-04 in 3 hamlets in Binh Phuoc (Table 5).

8. ADB Mission: From 10 to 15 November 2019, the 05 PMUs and the PISCs fully attended
the Mission of ADB.

A. Kon Tum Province Subproject
9. In the reporting period, Kon Tum PMU has conducted: (i) Opening of bids for 02
construction package under the upgrade of provincial road 675A construction KT-Cw-01 and KT-
Cw-02. Currently, it is in the process of selecting contractors; (ii) held evaluation of technical
proposals of the bidders participating in the KT-Cs-10 package: Construction Supervision
Consultant for Output 1.
10. Bidding results of investigation, survey, planning and cost estimates consultant package for
bomb and unexploded ordnances demining of PR.675A have been approved in Decision No.313/
QĐ-SKHĐT dated 11/12/2019 and a contract was signed. The consultant has conducted the tasks
complying with Decree 18/2019/NĐ-CP. The preparation procedures for demining work is ongoing.
11. PMU coordinated with design consultant of 02 villages of Kon Bring and Kon K'Tu in
adjusting some items aimed at preserving cultural identity, ethnicity and in consensus with the
authority, local people and the adjusted documents are being submitted to the competent authority
for approval and the unchanged items are continuing on construction.
B. Gia Lai Province Subproject
12. Detailed designed - Cost estimates documents for work Upgrade of provincial road 665
(Gia Lai) has been appraised and approved on 21/10/2019.

13. Bidding documents (BD) of PR.665 construction package is being drafted by the
Procurement Consultant and soon submitted to ADB. Construction supervision package are
ongoing at evaluation of proposals submitted by interested bidders in bidding system CMS of ADB.
14. Documents on requesting assigning of demining contractor for PR.665 (Gia Lai) is being
prepared.
15. The new tourism attraction Chu Dang Ya is being prepared the social-economic evaluation
report of the tourism site; Rapid Environmental Assessment report (REA) and shall need to carry
out preparing the tourism feasibility study report for ADB review.
C. Dak Lak Province Subproject
16. Detailed designed - Cost estimates documents for work Upgrade and rehabilitation of
NR.29 (Dak Lak) has been appraised and approved in September 2019.
17. BD for 01 construction package upgrade of NR.29 (DL-Cw-01) was submitted to ADB for no
objection and BD for DL-Cw-02 are being updated following the former one. Package DL-Cs-10:
Construction Supervision Consultant for output 1 filed the first submission to ADB.
18. Bidding results of DL-Cw-06 package: Construction for bombs and unexploded ordnances
demining and consultant package for demining supervision were approved by the provincial DPI in
Decision No 30/QĐ-SKHĐT and in Decision No 31/QĐ-SKHĐT, both dated on dated 25/12/2019.
was also approved by the DPI. Demining unit of the NR.29 upgrade segment is being performed at
the scene under the supervision of the supervision consultant.
19. Construction drawings design, cost estimates documents for the 03 tourism villages have
been sent to the provincial Department of Construction for appraisal.
D. Dak Nong Province Subproject
20. 02 construction packages DN-Cw-01 and DN-Cw-02 conducted bids opening. Currently,
Package DN-Cw-01 has submitted to ADB the bid evaluation report for NOL. Package DN-Cw-02
bids are being evaluated. A contract with the winning bidder of DN-Cs-10 package: Construction
supervision consultant for output 1 has been signed on 14/11/2019.
21. Demining supervision package and demining construction package for the Upgrading and
expanding the road from NR.14 to the Bu Prang border gate in Dak Nong subproject is having the
contractor selection plan soon submitted for appraisal and approval.
22. The Dak Nong's tourism sites are waiting for the approval of the feasibility study to be able
to deploy the detailed design and construction packages, expected in the Quarter I/2020.
E. Binh Phuoc Province Subproject
23. Construction package BP-Cw-01: Repair and upgrade of PR.756 - the section from Km0-

Km28 is currently updating BD in the form of online bidding and construction package BP-Cw-02:
Repair and upgrade of PR.756 - the section from Km28 - Km49,99 currently has no plans to deploy
due to unqualified medium term capital. Construction supervision consultant package BP-Cs-03
had submission 1 sent to ADB and waiting for No-objection.
24. Binh Phuoc subproject will not carry out demining.
25. BD of construction package BP-Cw-03: Repair and upgrade of road to Soc Lon temple and
road the Cong Dong pond in Khanh Loc Commune, Loc Ninh District is currently updated to submit
to ADB for No objection. Construction package BP-Cw-04: Repair of 02 community houses of Cha
Don and Soc Lon II hamlets; construction of new community house of Soc Lon I hamlet are having
changes in the design, supplementing of a number of items incurred during the construction
process. Adjustment documents are being prepared by the design consultant to submit to the
competent authorities for approval. Construction of items not included in the scope of adjustment is
being continued as well as coordination with the design consultant to review, adjust additional
adjustment items.
III. INSTITUTIONAL SETUP AND RESPONSIBILITIES FOR EMP IMPLEMENTATION AND SUPERVISION
26. To reporting period, the project has gone through almost half of its implementation period,
almost all subprojects are scheduled to commence construction in 2020. The provinces have had
certain institutional set-up to for environmental management: As implementing units, PMUs was
established in all 5 provinces to oversee the project implementation as well as monitor the
implementation of the EMP. Environmental safety officer within PMU who is responsible for
supporting PMU in these tasks in environmental aspects has been assigned in Kon Tum, Dak Lak,
Dak Nong and Binh Phuoc PMU (specialized/concurrent). Environmental Safeguard Specialists
(ESS) within Project Implementation Supporting Consultant (PISC) also have been mobilized to
carry out supporting tasks for all PMUs. From the Donor side, ADB has had supports, guidance as
well as requests in environment management during the project implementation to meet the
Donor's requirements and policies. It can be seen that the project is having a sufficient
organization to implement EMP requirements.
27. PMUs is in the process of recruiting construction contractors and Construction Supervision
Consultants (CSC) for road subprojects. CSC will ensure that contractors carry out the provisions
of sub-project on environmental management.
28. Construction contractors shall perform construction activities at construction sites. Chief of
Construction Work (CCW) of the construction contractor is responsible for all construction activities
at the construction site, including compliance with EMP. CCW will appoint an Environment/Safety
Officer (EO) responsible for preparing the Contractor's Environmental Management Plan
(CEMP/SEMP) to submit to the PMU before construction commencement. Contractors are
responsible for providing sufficient resources to implement the required mitigation measures in the
EMP.

IV. COMPLIANCE WITH ENVIRONMENT RELATED PROJECT COVENANTS
A. Progress of Environment Related Documents
29. Updated environmental management plan (UEMP): Till January 2020, the UEMPs that
been completed and there are no objections from ADB for the works upgrade and renovation of
roads are of PR.686 and PR.681 (Dak Nong subproject) (18/3/2019), PR.756 (Binh Phuoc)
(24/6/2019), PR.675A (Kon Tum) (10/9/2019), NR.29 (Dak Lak) (03/01/2020). UEMP draft of
provincial road 665 are being made and submitted to ADB in December 2019.
30. Demonstrating the commitment to the Loan Agreement, the People's Committee of Kon
Tum province has Document No. 2152/UBND-KTTH dated on 19/08/2019 sent to the ADB on the
commitment to implement the safeguards requirements in Loan Agreement, namely to ensure the
establishment of a natural protection forest band along the PR.675A as specified in UEMP. After
ADB's consideration, on 10/9/2019, ADB has no objection opinion on the UEMP for the subproject
Upgrading provincial road 675A. People's Committee of Kon Tum province has also issued
approval of the UEMP (Decision No.1236/QĐ-UBND dated 04/11/2019) to implement the
Subproject as planned.

31. Thus, the 04 subprojects with the UEMP has ADB's no objections have prepared the
environmental and safety requirements in the BD for construction and the draft contract as
conditions for contractors to implement the commitments and obligations with the Project Owner
and with the donor. PR.665 in Gia Lai soon when there is no objection for the UEMP, PMU will
conduct incorporating the requirements of UEMP and IEE in BD for the construction and
installation of road works will be submitted to ADB consider no objection to the content as well as
in terms of the construction contract.
32. In the future, construction supervision consultant will be provided with the UEMP to monitor
environmental implementation process of the contractors.
33. Government Environmental Impacts Assessment/Environmental Protection Plan
(EIA/EPP): All road subprojects in the project have ensured obtained EIA/EPP prepared and
approved pursuant the Government's laws (Law on Environmental Protection 2014, Decree No.
18/2015/ND-CP, Decree 40/2019/ND-CP, Circular No. 27/2015/TT-BTNMT) (Table 7). For tourism
subprojects, all 3 community tourism subprojects in Dak Lak had EPP prepared and approved in
2019 while the remaining subprojects have not been prepared or not of the items to prepare
EIA/EPP according to Appendix II, Decree 40/2019/ND-CP).

34. Site Environmental Management Plan (SEMP/CEMP): As required in the UEMP, civil
construction contractors will have to prepare Site EMP of contractor (SEMP/CEMP) with the
support of the ESS to submit to PMU for approval at least 10 days before commencement. The
objectives of the SEMP are that the contractor aware of environmental issues and mitigation
measures from the environmental documents; aware of the regulations, policies and environmental
standards of the Government and donor; proposing and committing to implement the specific
measures appropriate to the specific site conditions to allocate budget and resources for
implementation; ensure reporting regime and internal monitoring. PMU will require the winning
bidder to prepare SEMP immediately after signing the contract with the contractor to ensure the
commence date.
35. During the construction process, SEMP is required to update whenever there are
modifications in design or change in construction methods or items arise which lead to adverse
effects on the environment and not within the scope of the approved environmental assessment,
environmental management plan to ensure that appropriate measures can manage and minimize
potential impacts.
36. Until the present, no SEMP is done due to that no construction contractors of road works
have been selected.
B. Loan Agreement Compliance Status of Subprojects
37. Loan Agreement No.3499 between the Socialist Republic of Vietnam and ADB on May 4,
2017 contains provisions, including Section IV - The specific provision, Article 4.01 requires the

borrower (the Socialist Republic of Vietnam) to perform or ensure the performance of all the
obligations set out in Schedule 5 of the Loan Agreement and the Project Agreement. The
Subprojects will have to comply with these obligations as a component of the Support to Border
Areas Development Project.
38. The provisions relating to the environment and safety of the Loan Agreement are listed in
table below.

VII. ENVIRONMENTAL AFFECT MONITORING
A. Monitoring Plan and Responsibilities
1. Compliance monitoring
42. For road subprojects, at pre-construction phase, PMU with the support from ESS will
prepare all environmental protection compliance certificates under Vietnam’s regulations as guided
through Law on Environmental Protection 2014. CSC and ESS will also need to confirm that
Contractors and their suppliers have complied with all statutory requirements for permits from
DONRE and provincial authorities. CSC and ESS will check that Contractors have all the
necessary valid licenses and permits in line with all environmental regulations.
43. At construction phase, CSC will be required to monitor the construction activities on daily
basis and monitor preparing CEMP based on the approved UEMP. They will ensure that the
contractors comply with all environmental regulations as specified in the Subproject EMP if
applicable. The PMU will provide logistical support to the PISC/ESS and CSC where necessary for
the implementation of environmental monitoring plan.
44. After construction is completed and the upgraded access road and tracks are in operation,
the provincial DOT will be in charge of EMP implementation in the operation phase such as
monitor the accidents along the Subproject road, impacts of vehicles to the route... for
implementation of road safety improvement measures. The natural environment along the road
should be monitored by DONRE.
45. The road and tourism subprojects are classified as B or C environment (no large impacts).
Thus, should not require the involvement of an independent monitoring unit.
2. Environmental quality monitoring
46. The date of the report, all Subprojects have not recruited the unit to perform environmental
quality monitoring of road subprojects nor performed any monitoring sessions. Later when a formal
decision is made, the monitoring unit shall conduct sampling 1 times before construction at the
location identified in the UEMP. During construction, the quarterly quality monitoring will be
conducted at the same location as pre-construction. Additional sampling may be required as
necessary to examine the complaints or the investigation of environmental contamination by
subproject. DOT will be responsible for monitoring air quality in the first 2 years of route operation
stage, primarily through sensory observation.

VIII. PUBLIC CONSULTATION, GRIEVANCE REDRESS MECHANISMS
A. Complaints and Grievances
47. PMUs have developed a compensation and settlement mechanism to resolve complaints,
handle complaints and feedback regarding EMP implementation for the project in general. Every
effort is made to establish a relationship between affected communities and implementing
agencies through regular and transparency interaction. Therefore, maximizing the resolution of
complaints at the commune level, a process of three proposed stages of grievance resolution is
based on the subprojects as follows:
• Stage 1: Complaints from affected people on any environmental damage caused by the project implementation will be lodged verbally or in written form by the affected people. The staff from Commune/Commune Supervision Board will assess the level of environmental damage and report to the PMU within 15 days of the receipt of the complaint.
• Stage 2: If no resolution can be reached or if no response is received from the liaison officer within 15 days of registering the complaint, the affected people can take their complaint to relevant District People Committee who will conduct a site investigation to assess the damage and discuss with a contractor during the construction stage to determine and immediately take the appropriate remedial measures within 30 days of the receipt of the complaint.
• Stage 3: If the affected people are not satisfied with the decision of the District People Committee or in the absence of any response, the affected people can appeal to Provincial People’s Committee (PPC). PPC will provide a decision on the appeal within 45 days but not exceeding 60 days1 from the day it is received by the PPC. In this stage, PPC will enforce PMU to take the strong corrective action to resolve the problems either though enforcement of contractor’s duties under the signed contract or providing necessary additional actions under its overall duties of project implementation.
• If efforts to resolve disputes using the grievance procedures remain unresolved or unsatisfactory, APs have the right to directly discuss their concerns or problems with the ADB Southeast Asia Department through the ADB Viet Nam Resident Mission (VRM). If

APs are still not satisfied with the responses of VRM, they can directly contact the ADB Office of the Special Project Facilitator (OSPF).
• A complaint or a case in the Court of Law may be filed separately or independently from the Project level Grievance Redress Mechanism filing process. Implementers of the mechanism should be guided by appropriate government decrees related to complaints such as: Law on Complaints No. 02/2011/QH13; Article 64 of Government Decree 84/2007/ND-CP; Clause 2, Article 40 of Decree 69/2009; and regulation on grievance at Government Decree 75/2012/ND-CP dated 20/11/2012.
48. Up to now, although the grievance resolution mechanisms have been established, the unit
responsible for stage 1 is only completing: Commune Supervision Boards have already existed in
all communes of the projects but only in Kon Tum subproject (Ia Dal, Ia Toi communes), Dak Lak
subproject (Pong Drang, Ea Ngai, Cu Pong, Ea Kueh, Ea Kiet, Ea Tar, Cu Dlie M'nong, Krong Na,
Hoa Son, An Lac communes/wards) that the CSC have been consolidated for the project only and
met the Project's requirements on female members. The establishment of CSC shall be
consolidated in the remaining.
49. The grievance resolution mechanisms have been disclosed to the public during public
consultations in detailed design and shall be introduced again at consultations during construction
phase.
50. During the reporting period, no complaints were reported, nor any complaint are pending for
resolve at the 5 subprojects.
B. Community Consultation
51. Public consultation and resident participation are key factors to achieve the objectives of
safeguards policy. ADB's current policies have different consultation requirements, all emphasizes
the need of consultation prior project implementation and provide information to affected people
and communities and ongoing consultations during project implementation to identify and
contribute to resolve safeguards issues that may arise. Meaningful consultation is a process (i)
begins early in the project preparation stage and is carried out on an ongoing basis throughout the
project cycle; (ii) provides timely disclosure of relevant and adequate information that is
understandable and readily accessible to affected people; (iii) is undertaken in an atmosphere free
of intimidation or coercion; (iv) is gender inclusive and responsive, and tailored to the needs of
disadvantaged and vulnerable groups; and (v) enables the incorporation of all relevant views of
affected people and other stakeholders into decision making, such as project design, mitigation
measures, the sharing of development benefits and opportunities, and implementation issues.
52. Related to environmental aspect in safeguards, UEMP also updates a public consultation
plan for road subprojects in the construction phase and the operation phase. At present time of the
report, the route was not put into the construction phase, there were some activities of public
consultation has taken place in detailed design phase of roads, particularly for PR.675A in January
and March 2018, PR.665 in February and March 2019, NR.29 in May 2019, PR.686 and PR.681 in
December 2017 and March and April 2018, PR.756 in October 2017.

53. Additional consultations on the adjustment of some items of the tourism subprojects was
also carried out at Kon Tum subproject in May 2019, Dak Lak in October 2019 and at Binh Phuoc
subproject in December 2019

During the period of the survey and design of construction drawings, design contractors have held consultations from 25/02/2019 from 05/3/2019. - The consultation was held at the cultural village and the commune of Ia Bang, Ia Tor, Ia Me, Ia Pia, Ga Ia, Ia Mor. - Consultation content: including questions concerning to survey, design, relocation, how compensation (if any), issues related to the environment. - Results: All participants in the consultation supported the project, hopes the design of the project will soon be approved and construction will begin. People have also expressed one of his opinions on the design, concerns they mostly problems that exist in relation to roads (mainly on the issue of drainage, waterlogging in the rainy season) and there are proposals. Detailed design consultant also went to see the actual scene and put out the technical analysis to make the design for the problem. Most of the people concerned have the solution incorporated into the design. People noted on the waste area, gathering materials by design unit need to ensure environmental requirements; items should be designed to ensure road safety.
Dak Lak province subproject

IX. HEALTH AND SAFETY
54. The Project's Loan Agreement contains provisions on occupational safety and health
requirements throughout the project implementation. Namely in Schedule 5, Paragraph 12 stated
requirements that contractors must comply with the labor laws of Vietnam and the safety rules the
workplace; do not use child labor; not discriminate workers; no use of forced labor; allow free trade
unions and collective bargaining; dissemination of information about the risk of sexually transmitted
diseases to the workers and the people surrounding the project. Schedule 5, Paragraph 13
requires the implementation of regular safety monitoring and periodic reports sent to ADB. BD of

provisions will also be in annex to the construction contract.
55. Safety monitoring will be the first part of the environmental monitoring in the construction
phase on the different levels:
• Safety monitoring will be done daily/weekly on site by environmental/safety officer of contractors, CSC. Monitoring results will be shown in the site diary, weekly/ monthly report of contractors and CSC.
• CSC report aggregate results in the week/month report and submit to PMU and PISC.
• PISC submits monitoring reports by monthly/quarterly for the PMU.
• ESO of the PMU prepares monitoring reports every half year submitted to ADB with ESS's support.

56. No fatal accidents and serious, serious incidents occurred when performing subprojects
during the reporting period.
X. INSTITUTIONAL STRENGTHENING AND TRAINING
57. In October 2019, the PMU staff and PISC attended training courses on environmental
safety policy organized by ADB. The training course includes the content of the requirements for
the classification steps of the project; main content of EIA/IEE, UEMP; types and process of
monitoring and reporting; environmental provisions in Loan Agreement, BD, contracts. This content
covers comprehensive environmental requirements of the donor.
58. In November 2019, the PISC joined with PMU to organize training sessions, dissemination
for people in 02 communes of Ia Tang, Ia me about the policies of the donor, the government of
Vietnam and how to prevent social evils (HIV/AIDS, human trafficking ...).
59. In December 2019, PISC organized training sessions, dissemination for Community
Supervision Board and the people in Khanh Loc on how to prevent social evils (Gender, HIV/AIDS,
human trafficking...).
60. In the next reporting period, PISC will train contractors on SEMP preparation and training
Supervision consultant before the construction on daily monitoring of EMP implementation.
XI. KEY ENVIRONMENTAL ISSUES
61. Through the monitoring activity, a few issues in environment implementation in the
subprojects have been identified, mainly related to preparation of bidding documents lacking few
clauses requested by the Loan Agreement and by UEMP. The other issue is organization and
management of materials and construction sites. The report gave recommendations for PMUs to
have actions correcting these issues (such as ensuring supplementing some clauses to
construction contracts, regularly checking and reminding the construction contractors):

XII. CONCLUSION
A. Overall Progress of Implementation of Environmental Management Measures
62. The internal environmental monitoring report has been built regularly in pre-construction
phase. All the preparatory activities to ensure the environmental protection during the preparation
phase of construction are underway and proceeding to the construction phase. All UEMP of road
subproject were approved except for PR.665. SEMP is not to implementation period. Capacity-
building programs, raising awareness about the environment have been carried out. Environmental
monitoring has not been taken place.
63. On construction sites, there are some non-compliance found. At the construction site of the
construction package for 02 tourism villages in Kon Tum, the contractor has implemented required
management measures and minimized environmental impacts, but the results have not been met
as required as: Unreasonable construction materials, not ensuring the safety of vehicles
participating in traffic and environmental sanitation. PMU, Supervision Consultants have worked
with contractors on the above content. Similarly, BP-Cw-04 contractor was required to cover/fence
the manhole to ensure human safety and environmental sanitation at construction site.
64. PMUs with assistance from PISC and the Procurement specialist to conduct regular
discussions to finalize the BD, contracts and bid evaluation.
65. REA for tourism villages Chu Dang Ya is being finalized for approval of ADB.
B. Problems Identified and Actions Recommended
66. PMUs continue to direct PISC, Procurement Specialist, contractors and supervision
consultant to comply with requirements of the project and contract in environmental protection and
safety aspects.
67. REA for Chu Dang Ya tourism village will soon be finalized for approval of the ADB.
