PUBLIC ANNOUCEMENT INVITATION TO BID

SELF-PROVISIONED FIBER NETWORK and Services Provided Over Third-Party Networks

for CENTERVILLE CITY SCHOOLS, WASHINGTON TOWNSHIP, AND

WASHINGTON-CENTERVILLE LIBRARIES Sealed bids are being solicited from general contractors in connection to furnishing all labor, materials, and equipment necessary to complete Self-Provisioned Fiber Network Project and Services Provided Over Third-Party Networks Project as specified, will be received by the Director of Technology, Centerville City Schools Board of Education located at 111 Virginia Avenue, Centerville, Ohio 45458, March 2, 2018 at 10:00 AM (local time) and will be opened and read aloud at that time at 111 Virginia Avenue. ` A Pre-Proposal Conference will be held on February 14, 2018 (local time) at 9:00 am at 111 Virginia Avenue, Centerville, Ohio 45458 (Board Office). Bids may be mailed or delivered in person to Mr. Shannon Morgan, Director of Technology, at 111 Virginia Avenue, Centerville, Ohio 45458, on or before March 2, 2018. Bids received after 10:00 AM (local time) will be returned unopened. No bids received through FAX transmission will be accepted. Copies of bidding documents may be examined during regular business hours at the Dayton Builders Exchange; F.W. Dodge; the offices of the Architect, Levin Porter Associates, Inc. 3011 Newmark Drive, Miamisburg, Ohio 45342. Bidders may obtain the electronic copy of the bidding documents by registering their company name, bid contact information and e-mail address to [email protected]. A bid security in the form of a Bid Bond in accordance with Chapter 153.54 of the Ohio Revised Code in the amount of 100 percent of the total bid shall accompany each bid, or a certified check, cashier’s check, or letter of credit pursuant to Chapter 1305 of the Ohio Revised Code in the amount of 10 percent of the total bid shall accompany each bid. The successful bidder(s) will be required to furnish a satisfactory performance bond for one hundred (100%) of the contract price. No bidder may withdraw his bid within 60 days after the actual date of the bid opening. The Board of Education reserves the right to reject each and every bid, and to waive informalities and errors in bidding to the extent permitted by law. INSTRUCTIONS TO BIDDERS 1. EXAMINATION OF DOCUMENTS AND SITE CONDITIONS A. Study all Contract Documents. Direct all inquiries to the Architect in writing. Clarifying

addenda, which will become part of the Contract Documents, will be printed and distributed to all persons holding Bidding Documents. The Architect will not be responsible for oral instructions.

B. Prior to submitting Bid Proposal, the Contractor shall examine site to obtain first-hand

knowledge of existing conditions and filed verify existing conditions and area. No allowance will be made subsequently on behalf of the Contractor for any error or negligence on his part in this connection.

C. Sets of documents for on-premise use of sub-bidders are available at the plan rooms

listed in Notice to Bidders in addition to the Architect's office. 2. BASIS FOR BIDS AND AWARDS A. Bidders shall submit separate LUMP SUM proposals for any or all divisions of work

requested on the Form of Proposal. If space is provided on the Form of Proposal for bidding combinations of bid items or divisions of work, bidders may submit a LUMP SUM proposal for any combination or all bid items shown. Bidders are encouraged but are not required to submit separate LUMP SUM proposals for those bid items included in any such combination bid.

B. Include all unit cost items and Alternates requested on the Form of Proposal that pertain

to the bid items, divisions of work, or combinations thereof that you bid. C. Awards will be made upon the basis on the lowest responsible bid. Low bid will be

determined by the sum of base bid plus alternates selected. Substitutions and Unit Prices will not be considered in determining low bid.

D. The Owner reserves the right to waive informalities and reject any or all bids or to accept

the bid which embraces such combination of alternate proposals as may be in the best interest of the Owner.

3. STANDARDS - SUBSTITUTIONS A. The name or make of any product(s) named in the Specifications to denote the kind and

quality required as a STANDARD, whether or not the words, "or equal" or "approved equal" or other synonymous terms are used, shall be known as "Standards". Where two or more standards are listed together Bidders may bid on any of the "Standards" named. All Bid Proposals shall be based on standards specified.

B. Bidders desiring consideration for the use of products not named in the Specifications

may submit proposals for the substitution of same for Standards as specified, providing the Substitution List included in the Bid Proposal is used. Complete Specifications and descriptions of the substitution being submitted shall be furnished to the Architect, if the substitution is to be considered for acceptance. Any substitution as approved by the Architect and accepted by the Owner will be incorporated in the formal contract. If the Bidder offers no substitutions on the Substitution list, the "Standard" specified shall be used.

4. BID SECURITY A. Each Proposal shall be accompanied by a certified check or cashier’s check upon a

solvent bank or a letter of credit pursuant to Ohio Revised Code Chapter 1305 executed by a surety company authorized to do business in the State of Ohio, for a sum equal to ten percent (10%) of the amount of the bid submitted, or, in the alternate, the bid can be accompanied by a Bid and Performance Bond for a sum equal to one hundred percent (100%) of the amount of the bid submitted, all pursuant to Revised Code Section 153.54, as guarantee that if the bid is accepted, a Contract will be entered into and its performance properly secured. Should any proposal be rejected, such certified check, cashier’s check or letter of credit will be returned to the bidder, and should any proposal be accepted, such check or letter of credit will be returned to the bidder upon the proper execution and securing of the Contract and Performance Bond pursuant to Revised Code Section 153.54.

B. If the bidder fails to furnish an appropriate bid guaranty with the bid, the bid shall be

rejected as non-responsive. Telegraphic notification of execution of a bid bond does not meet the requirements of a bid guaranty accompanying the bid. Use of a form containing additional materials language from that required by statute will not be accepted and bidders are urged to use the bond form contained in the bid documents.

C. If a surety company bond is furnished, each bond must be accompanied by a Power of

Attorney of the agent of the company signing same, showing that said agent is authorized to execute bonds in a sum sufficient to cover the amount of the bond in each particular case. The bond must also be accompanied by a certificate signed by the Superintendent of Division of Insurance, State of Ohio, showing that said company is authorized to do business in Ohio.

5. PERFORMANCE BOND AND LABOR AND MATERIAL BOND A. Any bidder to whom a Contract is awarded that secured his Proposal with a certified

check, cashier’s check or a letter of credit, within 10 days after notification of award, shall furnish a Performance Bond pursuant to the Ohio Revised Code Section 153.54.

B. The surety company bond shall be accompanied by a Power of Attorney of the agent of

the company signing same, showing the said agent is authorized to execute bonds in a sum sufficient to cover the amount of the bond. The bond must also be accompanied by a certified check signed by the Superintendent of Division of Insurance, State of Ohio, showing that said company is authorized to do business in Ohio.

6. FORM OF PROPOSAL A. Submit two (2) copies of the Form of Proposal. All proposals shall be submitted upon

the blank "Form of Proposal" furnished by the Architect. The wording of the Form of Proposal shall be used without change, alteration or addition.

B. The bidder must state both in words and figures all specified lump sums and other specific

items when and as noted and provided in the Form of Proposal. In case of discrepancy, the amount in words shall govern.

C. Signatures shall be legibly written in longhand, and name typed or printed below

signature. In case of partnership, the name of each individual shall be given; in case of corporation, the signature of the officer duly authorized to sign shall appear under the corporate name and seal.

D. Proposals shall be enclosed in a sealed opaque envelope with Bidder's name in the upper left hand corner, and shall be endorsed "Proposal for SELF-PROVISIONED FIBER NETWORK”.

E. No bidder may withdraw his proposal for a period of 60 days after the date of bid opening. F. The attached Form of Proposal is for reference only. Loose copies are available from the

Architect upon request. 7. FORM OF CONTRACT A. Form of Contract: AIA Document A101, "Standard Form of Agreement Between Owner

and Contractor” -2017 Edition shall be form used for all Contracts with the Owner. 8. AWARD OF CONTRACT A. The Contract shall be considered as awarded when formal notice of award or letter of

intent has been served upon the successful bidder by the Owner or the Architect, but the Agreement shall not be complete until the signed Agreement, satisfactory surety bonds and insurance certificates have been furnished by the successful bidder at his own expense, to the Owner.

B. It is the intent of the Owner to award the contract immediately. Contract award will be

based on the lowest and best combined total of Base Bid plus or minus the bids of any Alternates that may be accepted. Definition of lowest responsible bid shall be the lowest for the combination of base bid and alternates that is in the opinion of the Owner in the best interest of the Owner.

C. Allow 60 days after receipt of bids for Owner's review of bids and preparation of Contract. 9. COMPLETION DATE

A. The work shall begin no later than seven (7) days after Owner's signing of the Contract

and/or issuance of Notice to Proceed and shall achieved Substantial Completion no later than the specified Substantial Completion date, and shall achieve Final Completion by the specified Final Completion Date. These Substantial Completion and Final Completion Dates are as shown below unless there is a modification of the date(s) formally agreed to by Owner and Contractor(s).

B. Substantial Completion of all work by July 1, 2018.

C. The actual date the Contractor achieves Substantial Completion shall be the date the

Architect determines the work has achieved Substantial Completion and subsequently issues the Certificate of Substantial Completion to Owner and Contractor.

E. The actual date the Contractor achieves Final Completion shall be the date the Architect

determines all work has been completed and subsequently approves the Final Application for Payment of the Contractor.

10. LIQUIDATED DAMAGES A. Time is of the essence of the Contract, and dates of Substantial Completion and Final

Completion are essential. Failure to meet these dates will cause damage to the Owner. B. Failure of the Contractor to achieve Substantial Completion and/or Final Completion by

the dates specified will result in Liquidated Damage being assessed against the Contractor as prescribed in the Contract Documents.

C. Key Project Dates: As listed in paragraph 9 above. 11. PRE-BID CONFERENCE A. A Pre-Bid Conference for all interested contractors will be held at 111 Virginia Avenue,

Centerville, Ohio 45458 on February 14, 2018 at 9:00 am. All prime bidders and major subcontractors are requested to have representatives attend.

12. SUBCONTRACTING A. The Contractor may utilize the services of Subcontractors, however the successful bidder

shall submit to the Architect, for approval before contract is entered into, a complete list naming all proposed Subcontractors.

B. The Owner reserves the right to accept or reject the employment of any or all

Subcontractor(s).

C. The Contractor shall be fully responsible to the Owner for the acts and omissions of his Subcontractors as he is for the acts and omissions of persons directly employed by him.

13. QUALIFICATIONS

A. Contractor shall submit with Bid a list of similar projects (size, scope and schedule) completed within the last 10 years and a list of references.

14. QUESTIONS

A. Submit all questions about Documents to Architect in writing. Replies will be submitted to all qualified bidders in writing. Such written clarifications shall be considered Addenda and also shall become part of the Contract. The Architect and Owner will not be responsible for oral clarification. Questions received less than three (3) days before Bid Opening cannot be answered.

15. OHIO SALES TAX EXEMPTION A. Materials for this building are not subject to the State of Ohio Sales Tax. Contractor will

be a licensed vendor in State of Ohio and will purchase material for this work without payment of Sales Tax. Owner will furnish Contractor with Certificate of Exemption.

16. DELINQUENT PERSONAL PROPERTY TAX STATEMENT A. Prior to entering a Contract for the Work, Contractor shall furnish a signed and notarized

“Delinquent Personal Tax Statement” per requirements of Ohio Revised Code Section 5719.042. This form shall be submitted with the Form of Proposal.

17. NON-COLLUSION AFFIDAVIT

A. Prior to entering a Contract for the Work, Contractor shall furnish a signed and notarized “Non-Collusion Affidavit” included in this Specification. This form shall be submitted with the Form of Proposal.

Project Description

Centerville City Schools, Washington Township and Washington-Centerville Public Library are accepting bids for the Self-Provisioned Fiber Network Project. The project consists a development of a fiber network comprised of three components. Centerville City Schools’ network includes fifteen (15) facilities. Washington Township’s network includes seven (7) facilities. Washington-Centerville Public Library’s network include two (2) facilities. CCS, WT, and WCPL are seeking two options for the bids for the fiber network.

Option 1 – Lit Fiber – Fully managed, leased lit fiber transport service from the designated agency hubs to the specified eligible agency sites. Option 2 – Self-Provisioned Fiber – District-Owned (self-provisioned) fiber to the designated locations.

bandwidth requirements from an e-rate eligible provider. Any proposal will need to be able to provide 50Mbps and up to at least 10 Gbps Ethernet connections for connectivity and pricing.

State Prevailing Wage requirements do NOT apply to this project.

B. Scope of Services The selected contractor, will be expected to provide design, engineering and construction

services to provide the fiber network based on the fiber network specification requirements.

Pricing Worksheets for Connections

As E-rate funding is sought for this project, Centerville School and the Library must follow E-rate rules in regards to construction and service costs as they relate to leased lit fiber and self-provisioned. Each offeror should show construction costs associated with getting leased lit fiber to the building (if applicable) along with a separate construction cost (if applicable) for terminating the fiber in a Centerville School’s, or Washington Libraries or Washington Township equipment closet rack at each site. The overall cost to Centerville City Schools, Washington Centerville Library and Washington Township will be considered in awarding a contract from this bid.

SECTION 1A – SUPPLEMENTARY GENERAL CONDITIONS SGC-1

SECTION 1A - SUPPLEMENTARY GENERAL CONDITIONS 1. SCOPE Except as modified by other parts of the Contract Documents, the original provisions of "General

Conditions of the Contract for Construction," AIA Document A201-2017 Edition, shall remain in full effect. The following Supplementary General Conditions shall be considered as additions or modifications to the original provisions.

2. DOCUMENTS REQUIRED PRIOR TO SIGNING OF CONTRACT Immediately upon the award of, and prior to the signing of the contract, the successful Bidder

shall furnish to the Architect: A. If Contractor’s Proposal is secured by a means other than a Bid Guarantee and Contract

Bond, a Bond meeting the requirements of Ohio Revised Code Chapter 153. Said Bond shall:

1. Be written for an amount not less than 100% of the Contract Amount. 2. Be accompanied by a Power of Attorney of the Agent of the Company signing same,

showing that said agent is authorized to execute a bond in a sum sufficient to cover the amount of the bond.

3. Be accompanied by a certificate signed by the Superintendent of Division of

Insurance, State of Ohio showing that said company is authorized to do business in Ohio.

B. A signed and notarized copy of a “Delinquent Personal Property Tax Statement” for the

Contractor per the requirements of Ohio Revised Code Section 5719.042. C. Certificates of Insurance Coverage. D. Workman's Compensation Certificates. E. List of proposed materials and Subcontractors shall be approved by the Architect and no

departure from such lists shall be made subsequently by the Contractor, without the Owner's consent.

F. The full name, address and phone number, including residential phone number, of the Job

Superintendent for each Contractor and major Subcontractor, who will be in charge during the entire duration of the project.

G. Schedules of Values (Division of Contract). The schedule of values cost breakdowns shall

follow the Construction Specification Institute (CSI) sixteen part division of work/sequence. In addition to the CSI cost breakdown listing, the following additional cost breakdowns are required:

All costs shall indicate the labor and material cost associated with each items noted on the cost breakdown.

I. Time-progress schedule of the Work. Contractor shall develop and submit a time-

progress schedule in conformance with the Time requirements of the Project that shall include all critical mile-stones of construction activity, Contractor submittal dates and proper review time for submittals by the Architect. In the event that Work shall be performed by multiple contractors, the contractor designated as the General Contractor, or as Lead Contractor, shall be responsible for coordination of development of the time-progress schedule. This coordination shall include provision of requirements as furnished by the other contractors into the schedule. Each contractor shall approve and sign the time-progress schedule prior to its submittal to the Architect.

The General Contractor shall furnish copies of the schedule to all Prime Contractors and

the Owner and Architect. 3. CONTRACT DOCUMENTS A. Contract documents as indicated in Paragraph 1.1.1 of the General Conditions, shall be

modified to include the following documents: 1. Drawing sheets 2. General Conditions (AIA Document A201-2017) 3. Supplementary General Conditions. 4. Additional Conditions 5. General Requirements (Division 1). 6. Owner/Contractor Agreement 7. Bid Guaranty and Contract Bond 8. Specifications

9. Addenda, as issued prior to the receipt of Bids. B. Drawings and Specifications 1. The Owner will furnish each prime Contractor, free of charge, 3 copies of the

Drawings and Specifications. 2. Each Contractor shall keep one (1) complete clean copy of all drawings and

specifications for the work, in good shape, available to everyone engaged on the job, see Paragraph 3.11 of the AIA Document A201-2017. In addition one (1) complete copy of all Drawings and Specifications shall be maintained to record all changes made during the execution of the Work.

3. The Drawings are divided by category and the Specifications are divided into

Divisions and Section for the purpose of providing order to the many elements of the work. The Contractor is responsible for a complete familiarity of all of the Contract Documents and the complete understanding of the Scope of responsibility of the Contractor’s work. The Contractor is also responsible to establish the Scope of any subcontractor’s work; the division of the Construction Documents is not intended to establish such divisions of responsibility.

4. Unless specifically indicated otherwise, all elements of the Work shall produce a

complete installation. Contractor is responsible to provide the materials, labor and services necessary to produce a complete installation regardless of the inclusion of all necessary components of the installation in the Contract Documents.

5. In event of inconsistencies within or between the Contract Documents, the Contractor shall provide the better quality or greater quantity of Work, and shall comply with the more strict requirement.

6. Contractor shall be responsible to field verify all existing conditions. Any deviations

found between the existing conditions and the Contract Documents, including dimensions, that affect the Work in any way shall be brought to the attention of the Architect immediately. 3.2.3 of the General Conditions (AIA Document A201-2017) is modified such that the Contractor shall be responsible for any corrective Work required as a result of failure to obtain guidance from the Architect for such deviations between existing conditions and the Contract Documents.

7. The Contractor shall only forward a “Request for Information” to the Architect for

elements of the Work where there is reason to believe there are errors, inconsistencies or omissions in the Contract Documents or there is reason to believe that there are deviations between existing conditions and requirements of Work represented in the Contract Documents. Requests for consideration of a substitute product or consideration of a product as an “equal” shall not be submitted as a Request for Information; such request shall be submitted under the conditions prescribed in the Specifications for Submittals. See Specification Section 1B-Additional Conditions for requirements associated with “Request for Information”.

8. For reference and to facilitate awarding of contracts and subcontracts, the Technical

Specifications are divided into titled Divisions and Sections. Such separations shall not, however, operate to make the Owner or the Architect an arbitor to establish limits of the Contracts between Prime Contractor and Subcontractors. It is not the intention of the individual sections of the Specifications to mention or otherwise enumerate each and every item of work or appurtenances required for the particular section.

4. INSURANCE A. Each Contractor shall furnish and maintain insurance as follows, in accordance with

Article 11 of the AIA General Conditions, except as modified herein. B. All policies shall be subject to the approval of the Owner. C. The Owner shall be listed as co-insured on all policies. D. The form and adequacy of Protective Liability Insurance shall be written, unless otherwise

provided with minimum limits of $2,500,000 for injury to one (1) person and $2,500,000 limit for total injury in any one occurrence and the minimum for property damage in policies shall be $2,500,000 in each case. Vehicles operated in connection with the project shall be included in the coverage. Coverage shall be written on the Comprehensive Form.

E. Each Contractor shall furnish and maintain a Builder's All Risk Policy in the amount of the

Contract. F. Certificate of such insurance shall be filed with the Architect prior to signing the Contract. 5. PERMITS A. All permits shall be obtained and paid for by Contractor for which work applies.

B. Each Contractor shall be responsible for paying any charges, if any, related to inspections and re-inspections related to permits.

C. All permits shall remain in force for the period necessary to complete work under the

Contract. 6. NOTICE OF COMMENCEMENT A. Pursuant to Section 1311.252, Ohio Revised Code, the Owner shall prepare a Notice of

Commencement in affidavit form identifying the name and address of the Owner, the Project number, the name, address and trade of all Contractors, the date of execution of the Contracts, and the name and address of the Surety for each Contract, in addition to the name and address of the Owner’s representative upon whom a Claim Affidavit may be served.

B. The Notice of Commencement shall be made available upon request. The unavailability

of a Notice of Commencement or incorrect information in the Notice of Commencement does not adversely affect the right of claimants, pursuant to Section 1311.252 (C), Ohio Revised Code.

7. JOB CONDITIONS A. The commencement of work by any each Contractor or Subcontractor shall indicate his

acceptance of all surfaces that his work will adjoin or cover, and of all job conditions. Each Contractor and Subcontractor shall be responsible for the satisfactory installations of his own work, regardless of contributory causes, once he has accepted job conditions. Any necessary corrections to said surfaces shall be reported immediately to the Architect prior to commencement of said work.

8. CONTRACTOR'S SUPERINTENDENCE A. Each Contractor shall keep the same competent superintendent and any necessary

assistants, on the work during its progress. All shall be satisfactory to the Architect. B. Superintendent shall have previous experience in this type of work and shall maintain

progress schedule and be authorized to make field decisions in the absence of the Contractor. He shall not be required to perform work not related to administering, expediting or coordinating the work under this Contract.

C. The Contractor shall attend to every part of the work personally, or through his competent

foremen, who shall be constantly on the work, lay it out and give all necessary lines, levels, patterns and dimensions according to the accompanying drawings and these Specifications, and shall verify that Drawings and Specifications are observed by all Subcontractors and employees.

D. The Contractor shall inspect all materials when delivered and see that it is properly stored

and protected from damage until used and must keep himself familiar with the working drawings, scale and full size details and Specifications concerning all parts of the work at all times, and must report to the Architect for correction of apparent errors, either in the drawings or specifications, as soon as discovered.

9. MATERIALS AND WORKMANSHIP A. The Architect or their authorized representatives shall have the right to reject work and

materials not in accordance with the true intent and meaning of the Drawings and Specifications.

B. Each Contractor shall accept responsibility for any changes or deviations from the

Drawings and Specifications made without authorization from the Architect. 10. MANUFACTURER'S DIRECTION A. All manufactured articles, materials and equipment shall be applied, installed, connected,

erected, used, cleaned, adjusted and conditioned as directed by the manufacturer, unless herein specified to the contrary.

11. REVISIONS AND EXTRAS A. Each Contractor will accept orders for extra work or make changes in this Contract as per

provisions of the General Conditions. B. If satisfactory resolution is not reached in Item "A" above, then all extra work or changes

in the work shall be paid for on the basis of 10% in addition to the actual cost of labor as submitted by the Contractor and 10% on materials in accordance with suppliers' invoices.

12. RELEASE OF LIENS A. The lien laws of the State of Ohio shall govern all work and materials. B. Each Contractor shall furnish the Owner with each estimate for payment and before final

payment is made, a full Release of Lien signed by all Subcontractors and Materialsmen associated in any way with the work.

C. If any Subcontractor refuses to furnish a release or receipt in full, the Contractor may

furnish a bond satisfactory to the Owner to indemnify the Owner against any lien. D. If any lien remains unsatisfied after all payments are made, the Contractor shall refund to

the Owner all the monies that the latter may have been compelled to pay in discharging such lien including all costs and a reasonable Attorney's fee.

13. PAYMENT TO CONTRACTOR A. Payment to the Contractor will be made in accordance with the General Conditions. B. At the end of each calendar month, the Contractor shall prepare and present to the

Architect an estimate of work completed and materials which have been delivered on the site or secured for the job and stored during such month or subsequent to making of the last preceding estimate. Estimate forms will be AIA Documents G702 and G702A, Application and Certificate for Payment.

C. Until all work is completed, the Owner shall make partial payments to the Contractor

based on estimates prepared by the Contractor and approved by the Architect. These partial payments shall be governed by the following:

1. Partial payments to the Contractor for labor performed shall be made at the rate of

ninety-two percent of the approved estimates until the work of the Contract has achieved fifty percent completion. All payments for labor performed after the work

of the Contractor has achieved fifty percent completion shall be paid based on one hundred percent of the approved estimates.

2. Partial payments to the Contractor for materials shall be made at the rate of ninety-

two percent of the approved estimates for materials delivered until the work of the Contractor has achieved fifty percent completion. All payments for materials delivered after the work of the Contractor has achieved fifty percent completion shall be paid based on one hundred percent of the approved estimates.

3. The balance of labor estimates retained by Owner in 1, above, shall not be paid to

the Contractor until the work of the Contractor meets the condition of Final Completion.

4. The balance of material estimates retained by Owner in 2, above, shall not be paid

until all materials required by the work have been properly installed by the Contractor.

D. All materials and work covered by partial payments made shall thereupon become the

sole property of the Owner, but this provision shall not be construed as relieving the Contractor from the sole responsibility for the care and protection of materials and work upon which payments have been made or the restoration of any damaged work, or as a waiver of the right of the Owner to require the fulfillment of all the terms of the Contract.

E. Monthly estimates shall be proportioned to the Division of Contract. (Schedule of Values)

prepared by the Contractor and approved by the Owner. Such monthly estimates shall be adjusted proportionately by item to agree with the total amount of the Contract

F. Partial payments made as the work progresses shall in no way be construed as

acceptance of any portion of the completed work embraced in the Contract. 14. DEFINITIONS A. "Provide" - means furnish, fabricate, complete, deliver, install and erect, including labor,

materials, equipment, apparatus, appurtenances extra expenses necessary to complete in place, ready for operation and/or use under the terms of the Contract Documents.

B. "As Shown" - "As Indicated" - "As Detailed" - "As Noted" or words of similar import refer to

Contract Drawings accompanying Specifications. C. "As Directed" - "As Ordered" - "As Designated" - "As Required" or words of similar import

refer to the Architect's instruction. D. "Approved" - "Acceptable" - "Satisfactory" - or words of similar import refer to approved by,

acceptable, or satisfactory to the Architect based on the best professional judgment of the Architect upon his review of conditions, data, and other information made available to him.

15. ASSIGNMENT A. Assignment of this Contract or any part thereof, or any funds to be received thereunder,

by the Contractor will be subject to the approval of the Owner. Such assignment shall contain a clause to the effect that it is agreed the funds to be paid the assignee under this assignment, are subject to the prior lien for services rendered or materials supplied for the performance of the work called for in said Contract in favor of all persons, firms and corporation, rendering such services or supplying such materials.

16. GUARANTEE A. For a period of one (1) year from the date of Final Acceptance by the Owner, all

Contractors unconditionally shall warrant all material, equipment, design and workmanship to be free from inherent defects, and warrants against any malfunction caused thereby. Contractor shall at his own expense, cause all defects discovered during period to be removed, repaired and/or replaced to the complete satisfaction of the Owner.

B. The Owner shall notify the Contractor in writing stating such defects and repairs to be

made and the Contractor agrees to remedy such defects and make such repairs as directed by the Owner and to start the work not more than five (5) days from date of said notification. If the Contractor fails to make such repairs within five (5) days of said notification. Owner may cause said repairs to be made and charge said expenses to the Contractor.

C. This guarantee shall not serve to reduce any otherwise longer guarantees and warranty

periods under which any units or components are regularly sold, or which require longer guarantees under the Specifications.

D. Each Contractor shall be responsible for making corrections of any work found to be not in

conformance with the Contract Documents regardless of when discovery of such non-conformance is discovered.

17. CODE COMPLIANCE A. The Contractor shall give all requisite notices to the proper authorities, obtain all official

inspections, permits and licenses made necessary by the work and shall comply with all laws, ordinances, rules and regulations pertaining thereto.

B. Before submitting a bid, the Contractor shall familiarize himself with the rules of all

organizations having jurisdiction over this work and he shall notify the Architect if, in his opinion, any work or materials specified are contrary to, or not in accordance with, such rules. Otherwise, the Contractor shall be responsible for the approval of all work covered by these Specifications and any changes or additional work necessary to meet such rules shall be done by the Contractor without cost to the Owner.

18. WAGES A. Per the Ohio Revised Code, as a project for a Public School District, Prevailing Wages

need not be paid. 19. OHIO SALES TAX EXEMPTION:

A. As a public body, the Owner has a sales tax exemption status, and Work performed for this Project is exempt of such tax. Owner shall furnish Contractor proper sales tax exemption certification for use by the Contractor to avoid the need to make sales tax payments for materials, services and equipment related to the Work.

SECTION 1B - ADDITIONAL CONDITIONS 1. GENERAL The following shall supplement the General and Supplementary Conditions of the Contract. 2. LAYOUT AND SURVEY A. The General Contractor shall, from bench marks available at the site, verify all lines, levels

and dimensions as shown on the Drawings, and shall report promptly any errors or inconsistencies to the Architect before commencing work. The General Trades Contractor shall be responsible for the proper location and level of all work.

3. MEASUREMENTS A. Before ordering any materials or doing any work, each Contractor shall verify all

measurements at the site of the work and shall be responsible for the corrections of the same. Any discrepancies which may be found shall be promptly reported to the Architect for consideration before proceeding with the work.

4. ELECTRONIC FILES OF THE CONSTRUCTION DOCUMENTS A. The Architect, at his sole discretion and without obligation, can make graphics portions of the

contract documents available for use by the Contractor in electronic format upon request and completion of a Wavier Agreement and review fees payable to the Architect.

B. Electronic files shall be provided only after bids have been received for the project and

contracts have been signed with the contractors.

C. The electronic file formats provided by the Architect to the Contractor shall be as follows: CADD Drawing Files: AutoCAD 2007 Word Processing Files: Microsoft Word 2000 Spreadsheet Files: Microsoft Excel 2000

D. The Waiver Agreement provided by the Architect must be signed by the contractor making

the request for the electronic files indicating the following conditions for the release of the electronic files.

1. The Contractor requesting these drawings solely for the purpose of coordinating and

expediting the contractor’s work on this specific project and for no other purpose. 2. The files on these diskettes are not Contract Drawings; they are work product tools used

to produce the Contract Drawings. As such, they may contain information that may or may not be consistent with the Contract Drawings.

3. Ownership of the information to be provided to you as herein set forth is and shall remain

the sole and exclusive property of the Architect. 4. The Architect makes no representation or warranty, expressed or implied, as to the

quality or content of the information of these files.

5. CONTRACTOR ACCESS TO THE SITE A. All construction activity including storage of materials and employee parking, access to

construction site, etc., shall be limited to the area of the construction unless approved by the Owner.

B. Each Contractor shall verify with the Owner the location of, and area available for the storage

of material and tools, and the placement of the construction office and temporary storage. The Contractor shall clean up and restore such area, surfaced or unsurfaced, to their original conditions upon completion of the work.

6. DEMOLITION AND REMOVAL OF EXISTING MATERIALS A. All existing materials to be removed shall be done so in a manner to insure the safety and

protection of the existing structure, the grounds, employees, and visitors. B. Each Contractor and Subcontractor shall comply with all safety rules and regulations

pertaining to this project as required by the Governing Agencies. C. Demolition shall include debris removal and hauling away of all material to a place of legal

disposal. D. Loose material shall be promptly removed from the site, and containers of refuse material

shall not be allowed to accumulate but shall be removed from the site at regular intervals. E. Site shall be kept in neat, clean and orderly condition. 7. PROTECTION OF EXISTING FACILITIES A. Extreme care shall be taken to properly protect all existing items to remain. B. Properly protect all components and surfaces of the existing structures. C. All existing items and surfaces damage during the work are to be repaired/replaced as

required to equal or better condition than previously existed. 8. ASBESTOS CONTAINING BUILDING MATERIALS: A. The Owner shall make the Contractor aware of all suspect and confirmed asbestos

containing building materials present at the project site as have been identified per the requirements of the Asbestos Hazard Emergency Response Act.

B. Contractor shall be responsible to inform each of his employees and subcontractors of the

location of asbestos containing building materials and require his subcontractors to do the same.

C. Any Work associated with existing roofs may involve cutting or removal of asbestos

containing roof felts and/or flashing membrane. Contractor shall use only craftsmen meeting governing agency requirements for training to perform such Work. In addition all Work of this nature shall conform with prevailing regulations.

9. COMPLETION DATES A. The required dated of Substantial Completion – as defined in the General Conditions of the

Contract for Construction, July 1, 2018. 10. LIQUIDATED DAMAGES A. If any contractor fails to achieve Substantial Completion and Final Completion by the

required dates, the Contractor(s) determined by the Architect as responsible for failure of any Contractor to meet the required dates, shall be assessed liquidated damages.

B. The Architect, based on his best professional judgment, shall determine the part of liability

each contractor shall incur, if any, for liquidated damages based on the performance and/or failure to perform by each Contractor.

C. The maximum daily amount any Contractor shall be held liable for liquidated damages shall

If more than one Contractor is determined liable for liquidated damages, each liable

Contractor shall be assessed the percent of their maximum daily liability equal to the percent of their determined liability.

E. Contractor liability to the Owner for Liquidated Damages shall entitle the Owner to retain from

the amount owed the Contractor and/or recover from the Contractor Liquidated Damages, and not as penalty, amounts as set forth above for each and every calendar day thereafter until the condition causing the Liquidated Damages has been corrected. The Contractor acknowledges by submitting its bid and entering into a contract with Owner, that such amounts of Liquidated Damages represent a reasonable estimate of the actual damages that the Owner would incur if the work is not substantially and finally completed by the foregoing dates. These Liquidated Damages are damages for loss of use of the project. The Owner’s right to recover Liquidated Damages shall not substitute for any other right of recovery for additional costs incurred should the Contractor fail to complete the Contract according to the Contract Documents.

11. REQUESTS FOR INFORMATION (RFI’s)

A. In the event that the contractor or subcontractor, at any tier, determines that some portion of the drawings, specifications, or other contract documents requires clarification or interpretation by the Architect, the contractor shall submit a Request for Information in writing to the Architect. Requests for Information may only be submitted by the contractor and shall only be submitted on the Request for Information forms provided by the Architect. The contractor shall clearly and concisely set forth the issue for which clarification or interpretation is sought and why a response is needed from the Architect. In the Request for Information, the contractor shall set forth an interpretation or understanding of the requirements along with reasons why such an understanding was reached.

B. The Architect acknowledges that it is a complex project. Based upon the Architect’s past experiences with projects of similar complexity, the Architect anticipates that there will probably be some Requests for Information on this project.

C. The Architect will review all Requests for Information to determine whether they are Request

for Information within the meaning of the term. If the Architect determines that the document is not a Request for Information, it will be returned to the contractor, un-reviewed as to content, for re-submittal on the proper form and in the proper manner.

D. Responses to Requests for Information shall be issued within two (2) working days of receipt

of the request from the contractor unless the Architect determines that a longer time is necessary to provide an adequate response. If a longer time is necessary by the Architect, the Architect will, within two (2) working days of receipt of the request, notify the contractor of the anticipated response time. If the contractor submits a Request for Information on an activity with two (2) working days or less of float on the current project schedule, the contractor shall not be entitled to any time extension due to the time it takes the Architect to respond to the request provided that the Architect responds within the two (2) working days set forth above.

E. Responses from the Architect will not change any requirement of the contract documents. In

the event the contractor believes that a response to a Request for Information will cause a change to the requirements of the contract documents, the contractor shall immediately give written notice to the Architect stating that the contractor considers the response to be a Change Order. Failure to give such written notice immediately shall waive the contractor’s right to seek additional time or cost under the appropriate articles of the General Conditions.

F. Copy of the RFI Form will be distributed at the Pre-Construction Meeting.

83412.00 2. TWO BID OPTIONS

2.1. Schools and Library are seeking the most cost-effective method to meet their bandwidth requirements from an e-rate program eligible provider.

2.2. Any proposal will provide a minimum of 50Mbps and up to at least 10 Gbps Ethernet connections for connectivity and pricing.

2.3. The circuits shall be capable of carrying multiple protocols such as IP Data, Voice over IP (VoIP) telephony, streaming digital video, teleconferencing, etc. Jitter and latency shall be within industry accepted limits for typical services of these types. The WAN must support the transmission of QoS (“Quality of Service”) and VLAN tags between endpoints.

2.4. Centerville City Schools, Washington Centerville Library and Washington Township is seeking two options for bids. Respondents may bid one, or both options.

2.4.1. Lit fiber. The first option is a fully managed, leased lit fiber transport service from the designated agency hubs to the specified eligible agency sites. One-time special construction can be bid separately from the vendors proposed monthly recurring cost for the fully managed leased lit service.

2.4.1.1. Dedicated Lit Transport Bandwidth throughput (upload and download) of 50Mbps to 10Gbps with Service Level Agreement of 99.99% uptime (SLA) guaranteed to all specified sites. The solution must be scalable from 50Mbps to 10Gbps over 1, 5 and 10 year period. All respondents must be capable of providing telecommunication services under the E-Rate Program.

2.4.1.2. Each offeror is required to complete the Lit Fiber pricing worksheets below including one time construction costs, construction from property edge to demarcation, total construction cost, one time setup charges, and monthly recurring charges. Pricing is for symmetrical service from the appropriate agency hub to each eligible entity location and should be all inclusive. All inclusive in this case means, including all special construction or non-recurring costs (NRC) and all monthly recurring costs (MRC). No increased pricing will be allowed during the term of the quoted special construction/NRC and MRC

2.4.1.3. Internet Services can be bid “bundled” with a Leased Lit fiber solution, or bid as a stand-alone service and must be described as such.

2.4.1.4. Centerville Schools, Library and Township do not require firewall and/or content filtering services

2.4.1.5. Each lit service response must also include description of proposal, SLA, timeline, network diagram, demarcation, and references.

2.4.2. Self-provisioned fiber. The second option is for Agency-owned (self-provisioned) fiber to the designated locations and includes all eligible special construction charges. Maintenance and operations monthly fees should be bid separately from the special construction charges.

2.4.2.1. Centerville City Schools, Washington Centerville Library and Washington Township requests that respondents propose design/engineering and pricing for a self-provisioned new build of fiber between each agency hub and each eligible agency location. Preferred strand counts of single-mode new build fiber are specified in Table 1.2 above.

2.4.2.2. Respondents are requested to provide a proposal for a self-provisioned fiber network based on a special construction project. New eligible fiber special construction charges as defined by the order include construction, design, engineering and project management. Project management should include all necessary paperwork and permits including but not limited to rights of way, easements, and pole attachments. Centerville City Schools, Washington Centerville Library and Washington Township desires a fully “turn-key” project so respondents should provide explanation for Centerville City Schools, Washington Centerville Library and Washington Township involvement in the process including ownership and sourcing of permits, etc.

2.4.3. Each offeror is required to complete the Self-Provisioned Fiber pricing worksheets below including one time construction costs, construction from property edge to demarcation, and total construction cost. Preference will be given to proposals that offer pricing with most of the costs being paid up-front and minimal annual maintenance costs. The solution should include all costs related to the deployment of the proposed circuit, such that there are no additional costs that are expected to be incurred by the Centerville City Schools, Washington Centerville Library or Washington Township.

2.4.3.1. Centerville City Schools is also seeking proposals for network equipment to light the network once the fiber construction is complete. A list of equipment is

2.4.4. The annual maintenance, equipment and the operations of the high-speed broadband network may be by a third party.

2.4.5. Each self-provisioned fiber build response must also include description of proposal, timeline, network diagram, demarcation, references, and Connect America Fund status as described in later sections. Maintenance and/or operations and/or Internet Services can be bid “bundled” with a self-provisioned fiber construction bid, or bid as a stand-alone service and must be described as such.

2.4.5.1. Self-provisioned Fiber Construction Specifications

2.4.5.1.1. Centerville City Schools, Washington Centerville Library and Washington Township’s specifications for a newly constructed fiber infrastructure are contained in section labeled OSP INSTALLATION SPECIFICATIONS.

2.4.5.2. Self-provisioned Fiber Project Management:

2.4.5.2.1. Selected respondent and its subcontractors will provide all project management to accomplish the installation of all project work as outlined in this document.

2.4.5.2.2. The respondent will provide engineer(s), certified on selected fiber system specifications and procedures to manage all phases of project as outlined in this proposal. This includes ordering and managing the bill of materials as outlined in this document, directing and managing cable placement and restoration, directing and managing splicing crews and providing detailed documentation at the end of the project.

2.4.5.2.3. Selected respondent and its subcontractors will develop a project management plan, which will include a milestone chart. The milestone chart will outline any critical path events and then track these with the appropriate agency/organization whether; selected respondent, subcontractor or the agency.

2.4.6. In E-rate program terminology, Special construction refers to the upfront, non-recurring costs associated with the installation of new fiber to or between eligible entities. Applicants may seek funding for special construction charges in connection with leased lit fiber and

self-provisioning. Special construction charges eligible for Category One support consist of three components:

2.4.6.1. Construction of network facilities;

2.4.6.2. Design and engineering; and

2.4.6.3. Project management

2.4.6.4. The term “special construction” does not include Network Equipment necessary to light fiber, nor the services necessary to maintain the fiber. Charges for Network Equipment and fiber maintenance are eligible for Category One support as separate services, but not as special construction.

2.4.6.5. All options can include special construction or one-time E-rate program eligible non-recurring costs as well as E-rate program eligible recurring circuit costs. Based on the bids and both a short term and long term cost effectiveness analysis, Centerville City Schools, Washington Centerville Library and Washington Township will determine which, if any, of the lit service or self-provisioned fiber construction.

3. GENERAL TERMS FOR SELF-PROVISIONED PROJECTS

3.1. The following are general terms that apply to self-provisioned fiber builds. Respondents may offer maintenance and operations services, and network equipment purchase (if applicable), installation, and operations either themselves or through 3rd party subcontractors. In the case that respondents use external 3rd party service providers or contractors to deliver some or part of the solution, these should be clearly indicated in the response.

3.2. Fiber Specification

3.2.1. All self-provisioned fiber solutions must comprise of single mode OS/2 fiber. Single mode fibers must meet the following minimum requirements:

a. Core / Cladding Diameter: 9.2/125 b. Loose tube or tight buffer construction c. Maximum Attenuation 1310nm/1550nm .3/02 dB/km d. 40/100Gbe Transmission distance >10,000 @ 1310nm e. Water-blocking, sunlight resistant f. Tension Rating 600 lbs. g. Outdoor use fiber shall be dual OFNP/OSP rated. h. Building Entry fiber segments, shall be rated as required by NEC.

3.2.2 All termination will be completed utilizing fusion splice LC pigtails.

All equipment material provided shall be from single manufacture and Installation shall qualify for minimum of 20 year manufacture performance Warranty upon completion of project.

3.3 Maintenance 3.3.1 Centerville City Schools, Washington Centerville Library and Washington

Township requires on-going maintenance of the fiber on self-provisioned fiber solutions. Maintenance responses are required as follows:

3.3.2 Self-provisioned fiber construction responses are not required to include a maintenance response. Maintenance on self-provisioned fiber may be bid as a stand-alone service, however, “bundled” holistic solutions will be preferred, as outlined in the evaluation criteria. Responses for maintenance on self-provisioned fiber must include scheduled routine maintenance as a monthly cost as well as unscheduled break/fix maintenance as an annual time and material cost estimate. Explanation of how the annual scheduled and unscheduled maintenance was estimated should be included.

3.3.3 Respondent shall maintain the applicable fiber seven days per week, twenty-four hours per day. Upon notification from the Owner of a malfunction relating to the applicable fiber, respondent shall respond to such malfunction within one (1) hour and thereafter proceed to correct the malfunction with reasonable diligence.

3.3.4 When pricing maintenance, the respondent should include an overview of fiber maintenance practices including.

3.3.4.1 Routine maintenance and inspection 3.3.4.2 Scheduled maintenance windows and scheduling practices for

planned outages 3.3.4.3 Marker and handhole inspection and repair 3.3.4.4 Handling of unscheduled outages and customer problem reports 3.3.4.5 What service level agreement is included, and what alternative

service levels may be available at additional cost 3.3.4.6 What agreements are in place with applicable utilities and utility

contractors for emergency restoration 3.3.4.7 Repair of fiber breaks 3.3.4.8 Post repair testing 3.3.4.9 Mean time to repair 3.3.4.10 Replacement of damaged fiber 3.3.4.11 Replacement of fiber which no longer meets specifications 3.3.4.12 Policies for customer notification regarding maintenance 3.3.4.13 Process for changing procedures, including customer notification

practices 3.3.4.14 Process for moves adds and changes 3.3.4.15 Process for responding to locate requests 3.3.4.16 Include itemized costs for annual scheduled maintenance and

annual estimated unscheduled maintenance in one (1), three (3) and five (5) year terms.

3.4 Equipment, Installation and Operations

3.4.1 Centerville City Schools, Washington Centerville Library and Washington Township does not request respondents to provide a quote for an annual

operations cost to oversee the technical support of the circuit including installation and configuration of end equipment once the self-provisioned fiber is available for service.

3.5 DESCRIPTION OF PROPOSAL

3.5.1 Respondent will provide a description of their proposal for all services and solutions. Description will include an overview of the proposal, any deviations from the requested architecture, design or requirements, assumptions made, other detail Centerville City Schools, Washington Centerville Library and Washington Township may find useful or necessary (or could differentiate the solution from a competing proposal).

3.6 SERVICE LEVEL AGREEMENT

3.6.1 Respondent will provide a description of the proposed services and service levels provided with the lit fiber responses. The respondent will provide a proposed Service Level Agreement (SLA) with the RFP response. The proposal must include a description of the following services and how these services will be measured.

3.6.1.1 Fiber Network Availability: the provider will make all reasonable efforts to ensure [99.9-99.99]% network availability of each circuit.

3.6.1.2 Lit and Operations proposals only: Frame/packet loss Commitment

3.6.1.3 Lit and Operations proposals only: Network Latency Commitment

3.6.1.4 Lit and Operations proposals only: Network Jitter Commitment

3.6.1.5 There is no right of provider to limit or throttle the capacity of the circuit at any time for any reason

3.6.2 In addition to the required services, the proposal may include but is not to be limited to the following services:

3.6.2.1 Network Operations Center: Solution will provide customer support functions including problem tracking, resolution and escalation support management on a 24x7x365 basis. Customer has the right and is encouraged to call concerning any problems that may arise relative to its connection with Vendor provided services.

3.6.2.2 Trouble Reporting and Response: Upon interruption, degradation or loss of service, Customer may contact Vendor by defined method with a response based on trouble level. Upon contact from the Customer, the Vendor support team will initiate an immediate response to resolve any Customer issue. Customer will receive rapid feedback on trouble resolution, including potential resolution time.

3.6.2.3 Escalation: In the event that service has not been restored in a timely manner, or the Customer does not feel that adequate attention has been allocated, the Customer can escalate the trouble resolution by request. A list of escalation contacts will be provided when implementation schedule is completed.

3.6.2.4 Resolution: The Customer will be notified immediately once the problem is resolved and will be asked for verbal closure of the incident.

3.6.2.5 Trouble Reporting, Escalation and Resolution: A detail trouble reporting, escalation and resolution plan will be provided to Centerville City Schools, Washington Centerville Library and Washington Township.

3.6.2.6 Measurement: Vendor stated commitment is to respond to any outage within two (2) hours and a four (4) hour restoration of service. Time starts from the time the Customer contacts Vendor and identifies the problem. Credits for Outages of shortage will be identified.

3.6.2.7 Reports: Upon request, an incident report will be made available to the Customer within five (5) working days of resolution of the trouble.

3.6.2.8 Link Performance per segment: The service will maintain the proposed Link Performance throughout the term of the contract.

3.6.2.9 Historical uptime: Provide aggregate uptime statistics for your proposed service in the geographic area encompassing Centerville City Schools, Washington Centerville Library and Washington Township.

3.7 TIMELINE

3.7.1 For each response, respondents must include a construction roadmap timeline. For lit fiber and self-provisioned responses preference is given to responses with a service start for all sites on July 1, 2018. For self-provisioned fiber construction responses, use April 1, 2018 as the construction start date and base the roadmap timeline off of that date. Include how the timeline changes per site given an earlier or later start date.

3.8 DEMARCATION

3.8.1 All solutions whether lit fiber or self-provisioned fiber construction must terminate service or infrastructure to an existing rack in a Centerville Schools, Library, and Township facility’s network closet designated by the Centerville City Schools, Washington Centerville Library or Washington Township. Solutions bringing service to the property line but not inside of the demarc address are not acceptable.

3.8.2 Respondent must specify the demarcation configuration for each individual site in the proposal.

3.9 NETWORK DIAGRAM

3.9.1 For each response, respondents must include a network diagram displaying the paths to be used to serve the specified site. For self-provisioned fiber responses, respondents must include identification of aerial vs. buried fiber segments, detailed drawings showing fiber and equipment locations, and any other pertinent details.

3.10 REFERENCES

3.10.1 For each response, respondent must provide 3 references from current or recent customers, preferably K-12 with projects equivalent to the size that also includes joint partnerships. If respondent responds to more than one option provide 3 references for each.

3.10.2 Please list the references on the references worksheet below.

3.11 SPECIAL CONSTRUCTION AND NON-RECURRING COST

3.11.1 Respondents providing lit fiber proposals which require an upfront payment may include a special construction cost or non-recurring cost. This upfront payment is considered special construction if any new fiber is being installed. If new fiber installation is not necessary, the payment is considered a non-recurring cost and must be entered into the pricing sheet accordingly.

3.11.2 The amount of special construction capital requested will be reviewed based on the cost of historical fiber builds in the region. Respondents should consider other business that may be generated by building fiber into the region and request only the special construction capital allocable to the Centerville Schools, Libraries and Township service.

3.12 REQUIRE NOTICE TO PROCEED AND FUNDING AVAILABILITY

3.12.1 Centerville City Schools, Washington Centerville Library and Washington Township will follow the purchasing policies of Centerville Schools Public Schools and requirements and procedures of the FCC’s E-rate program as administered by the Universal Service Administrative Company to be eligible for all available funding. The implementation of any associated contracts resulting from this competitive bid process will be dependent on the agency's’ issuance of a written Notice to Proceed. E-rate program funding notification alone will not signify Notice to Proceed. Centerville City Schools, Washington Centerville Library and Washington Township will have the right to allow the contract to expire without implementation if appropriate funding does not come available.

3.12.2 All responding vendors must be a registered vendor with USAC and have a USAC issued Service Provider Identification Number-SPIN. Responding vendors who do not have a USAC issue SPIN must demonstrate reasonable efforts to obtain a SPIN before the service start date.

3.13 ERATE MODERNIZATION ORDER NOTE

3.13.1 Special construction and service eligibility for reimbursement have changed starting funding year 2016. See the Federal Communications Commission E-rate program modernization order 2 (WC Docket No. 13-184) (https://www.fcc.gov/document/fcc-releases-order-modernizing-e-rate-21st-century-connectivity) for more information.

4 RFP SCORING RUBRIC

4.3.1 The Purpose and Intent of this Request for Proposal (RFP) is to establish an experienced and qualified offeror whose proposal is determined to be the most advantageous, “most cost effective” to the Centerville City Schools, Washington Centerville Library and Washington Township Broadband Project. Centerville City Schools, Washington Centerville Library and Washington Township's preference is for a self-provisioned fiber network if such can be accomplished within available funds. Centerville City Schools, Washington Centerville Library and Washington Township will compare any proposals for a self-provisioned broadband network against the cost of Lit service to evaluate the total cost of ownership over a 10 year life of the fiber network. Preference will be given to the vendor that provides a comprehensive, cost effective solution for current specifications, future capacity requirements, and ongoing service and support that best meets the Centerville City Schools, Washington Centerville Library and Washington Township’s needs. Award shall be made to the offeror whose proposal is determined to be the most advantageous, “Most Cost

Effective” after taking into consideration all of the evaluation factors set forth in the RFP. The award of a contract shall be at the sole discretion of Centerville City Schools, Washington Centerville Library and Washington Township. Centerville City Schools, Washington Centerville Library and Washington Township and its members including Centerville City Schools, Washington Centerville Library and Washington Township reserve the right to enter into a contract deemed to be in its best interest. The Evaluation Committee will select a minimum of two (2) vendors best suited to meet the needs of the Centerville City Schools, Washington Centerville Library and Washington Township based on the scoring of the evaluation criteria. Negotiations shall then be conducted with each of the offerors so selected. Price shall be considered, but need not be the sole determining factor. After negotiations have been conducted with each offeror so selected, the Evaluation Committee shall select the offeror which, in its opinion, has made the best proposal, and shall award the contract to that offeror. Should the Evaluation Committee determine in writing and in its sole discretion that only one offeror is fully qualified, or that one offeror is clearly more highly qualified than the others under consideration, a contract may be negotiated and awarded to that offeror. Centerville City Schools, Washington Centerville Library and Washington Township may request additional information or clarification of proposals and hereby reserves the right to select the particular response to this RFP that it believes will best serve its business and operational requirements. Evaluation of the offerors responding shall be based upon the RFP Scoring Rubric located in this document when determining the “Most Cost Effective” proposal. Centerville City Schools, Washington Centerville Library and Washington Township reserves the right to accept or reject any or all bids, in whole or in part, even with SLD funding approval, to waive any informality and to delete items prior to making the award, whenever it is deemed in the sole opinion of Centerville City Schools, Washington Centerville Library and Washington Township to be in its best interest.

4.3.5 Notes 1: E-rate program eligible circuit cost is the total cost of ownership that includes special construction and NRC in addition to MRC and includes any and all services that will be applied on a monthly recurring basis. E.g. for self-provisioned fiber, recurring circuit costs will include operate, maintain, ISP, and any other monthly service fees. E-rate program special construction costs should be clearly indicated and separated from any other E-rate program eligible NRC cost. All services offered must be eligible for E-rate program Category 1 discounts.

4.3.6 Note 2: Timing of build: all bidders are advised to commit to an initial roadmap for rollout of their solution per circuit, based on the E-rate program and District & Library timeline. The roadmap should include all steps towards deployment and “go live” of all circuits within this RFP. Any risks or contingencies on the timing should be clearly highlighted in the response.

4.3.9 Note 5: Fiber optic solutions: preference will be given to solutions based on fiber optic technologies, as the Centerville City Schools, Washington Centerville Library and Washington Township believes that this will provide maximum future scalability. Bidders are encouraged to outline how fiber optic solutions could be scaled into the future, including potential pricing increments for additional bandwidth that may be likely during the contract period.

4.3.10 Note 6: References: preference will be given to bidders who are able to demonstrate a track record of successfully working with K-12 school districts, libraries or similarly sized customers within the state to provide high-quality, affordable solutions and exemplary ongoing service. Bidders should be able to provide access to up to 3 references as part of the evaluation process, as and when requested by Centerville City Schools, Washington Centerville Library or Washington Township.

5 OSP INSTALLATION SPECIFICATIONS

5.1 Material Requirements

5.1.1 Material will comply with those standards as established by UL or NEMA and shall be commercial grade. All materials will be new and free from defects.

5.1.2 Selected contractor and its subcontractors will provide all material management to ensure that the project remains on track according to the project milestones.

5.1.3 All due caution will be exercised in transporting and off-loading all materials to prevent any damage during shipping or placement. Any damage to any materials after their initial receipt and inspection by the respondent will be the sole responsibility of the respondent, who will replace such damaged hand holes at no additional expense to the agency.

5.1.4 Buried conduit shall be 2” or greater of either PVC schedule 40/HDPE SDR 13.5 equivalents or better or EMT (Electrical Metallic Tubing) multiduct with at least three innerducts.

5.1.4.1 Large-radius sweeps shall be provided where required for offset or change in direction of conduit. Bend radius rating of the cable must be adhered to for all conduit bends, pull boxes, and hand holes.

5.1.4.2 Pipe sweep must not exceed 90 degrees at any one point and a bend radius of 40 inches or greater must be maintained for all HDPE pipe.

5.1.4.3 EMT fitting shall be gland or set screw type

5.1.6 All Hand Holes shall be Ohio Department of Transportation (VDOT) approved, 45,000 lb. load rated CDR or comparable enclosures on roadways and railways, and pedestrian rated hand holes for non-roadways and railways.

5.1.7 All fiber optic cable installed shall be of armored outside plant grade, loose-tube construction, with moisture protection; consisting of single mode 9/125/250 micron class fiber, low loss water band capable, 0.25dB/km@1550nm, 0.35dB/km@1383nm, 0.35dB/km@1310nm, ITU-T G.652.D or superior. Small cross-section cable is preferred.

5.1.10 All cables brought into buildings shall be terminated in an existing network closet rack designated by Centerville Schools, Libraries and Township.

5.2 Specifications

5.2.1 General

5.2.1.1 All construction shall occur in the ODOT right-of-way or on Centerville City Schools, Washington Centerville Library or Washington Township owned property unless, as agreed by Centerville City Schools, Washington Centerville Library and Washington Township, no option can be determined to meet this requirement; the contractor will secure all necessary permits and easements before construction.

5.2.1.2 All work areas must be protected by proper signage and physical barriers. Leaving of open excavation areas is discouraged but where absolutely necessary proper barriers, temporary cover and signage/flagging must be provided per local/state/federal regulation.

5.2.1.3 Any utility or property damage must be reported to the facility owner and Centerville City Schools, Washington Centerville Library and Washington Township’s project manager immediately and repaired by contractor or at contractor’s expense.

5.2.1.4 Pull line shall be installed along with the cable to facilitate future expansion.

5.2.1.5 Cable ID-tags shall be required at every hand-hole or vertical transition.

5.2.1.6 In the case of building entries, the Contractor shall work with each building owner to ensure proper requirements are met prior to any work being done on site. It is the responsibility of the Contractor to meet all building codes for placing conduit and cables following IEEE, BICSI, and NEC standards. No armored cable should be brought into the building without proper grounding. In cases where new building core bores are required, these will be handled under a separate contract.

5.2.2 Survey

5.2.2.1 Comply with all ordinances and regulations. Where required, secure permits before placing or excavating on private property, crossing streams, pushing pipe or boring under streets and railways. Pre-survey shall be done prior to each job.

5.2.2.2 The contractor is required to notify OUPS for the location of any proposed excavation in order to have all existing utilities marked appropriately. Excavation on any Centerville Schools, Libraries or Township property or and other private property requires notification of that owner in order to locate private utility lines. The contractor shall be bound by the marking time standards for private/public utilities as those marked under OUPS.

5.2.2.3 Respondent will locate underground lines of third parties in cable route area

5.2.3 Permits and Traffic Control

5.2.3.1 The respondent must adhere to all applicable laws, rules and requirements and must apply for permits to place infrastructure per specification per county or city ordinance applicable to where the infrastructure is being placed.

5.2.3.2 All traffic control, in accordance with local, state, county, or permitting agency laws, regulations, and requirements, will be the respondent’s responsibility. The respondent’s construction schedule will take into consideration sufficient time for the development and approval of a traffic control plan.

5.2.4 Tracer Wire Installation

5.2.4.1 Tracer wire shall be placed with all conduit installed unless armored or traceable cable is used. The respondent will provide the tracer wire and shall install, splice and test (for continuity) the tracer wire. If the tracer wire is broken during installation, the wire should be repaired and tested for continuity after repair.

5.2.4.2 For multi-duct installation, install a 5/8” X 8” copper clad ground rod in the hand-hole located on public right–of-way. Place a #12 insulated copper locate wire from the ground rod to the fiber optic termination room or to the outside of the building directly below the pull box and terminate on one side of an insulated indoor/outdoor terminal block to the master ground bar in the fiber optic termination room or place a ground rod on the outside of the building. Locate block in an accessible location. This is for “locate purposes only,” not for grounding purposes. Note on as-built where ground is placed and tag located wire as “locate wire.”

5.2.5 Depth of Burial

5.2.5.1 Except where otherwise specified, the cable shall be placed to a minimum depth of 36” along roadways and 24” on private property. Greater cable depth will be required at the follow locations.

5.2.5.1.1 Where cable route crosses roads, the cable shall be placed at a minimum depth of 48” below the pavement or 36” below the parallel drainage ditch, whichever is greater, unless the controlling authority required additional depth, in which case the greatest depth will be maintained.

5.2.5.1.2 Where cable crosses existing sub-surface pipes, cables, or other structures: at foreign object crossings, the cable will be placed to maintain a minimum of 12” clearance from the object or the minimum clearance required by the object’s owner, whichever is greater.

5.2.6 Highway, Railroad, and Other Bored Crossings

5.2.6.1 All work performed on public right-of-way or railroad right-of-way shall be done in accordance with requirements and regulations of the authority having jurisdiction there under.

5.2.6.2 Respondent shall give all notices and comply with all laws, ordinances, rules and regulations bearing on the conduct of the Work as drawn.

5.2.6.3 Where the cable route crosses railroad right-of-way, the cable shall be placed at a minimum depth of 60” below the railroad surface or

36” below the parallel drainage ditch, whichever is greater, unless the controlling authority requires additional depth, in which case the greatest depth will be maintained.

5.2.7 Roadways, Parking Lots and Sidewalks

5.2.7.1 Installation under roadways/parking lots/sidewalks will be performed by directional boring. Pavement cuts shall only be allowed where absolutely necessary and require agency approval. Paved surfaces must be properly repaired; compacted fill or equivalent, and replacement surface to match existing surface.

5.2.8 Cable Markers

5.2.8.1 Cable markers shall be placed within 48 hours of cable installation. Unless the right-of-way or property owner specifies otherwise, cable markers shall be placed at all change in directions, splices, fence line crossings, at road and stream crossings, and other points on the route not more than 1,000 feet apart.

5.2.8.2 In addition, on highway right-of-way, the markers shall be located at the highway right-of-way line. Markers shall always be located so that they can be seen from the location of the cable.

5.2.9 Hand Holes and Vaults

5.2.9.1 Hand holes will be placed in accordance with standard industry practice following the specifications provided in the construction plans, typical drawings, and detail drawings. Special attention and planning must be exercised to ensure accessibility by other groups after construction has been completed.

5.2.9.2 In-ground pull/splice vaults/handboxes shall be placed at reasonable intervals. This is typically in the range of 400-800 feet based on the amount of turn in the conduit. On exceptionally straight conduit runs 1,200 feet may be possible; at no time should 1,200 feet be exceeded except where approved by project manager. All installations shall be proposed to Centerville Schools, Libraries and Township for approval prior to installation.

5.2.9.3 Hand-holes placed will be a minimum of 17” x 30” x 18”, with open bottom, constructed of polymer concrete consisting of sand and aggregate bound together with polymer resin, or plastic hybrid in non-traffic areas. Upsizing of hand-hole will be determined to accommodate anticipated splice cases and cable slack.

5.2.9.4 Mesh shall be placed in the bottom of the hand-hole with 6” of pea gravel. Hand-holes placed along any right-of-way shall be AASHTO H-20 rated with 20K lids where traffic loading is anticipated, otherwise TIER 15 is acceptable. All hand-holes and

lids shall comply with the NESC for loading. Hand-holes shall not be installed on steep banks or slopes where the cover cannot be leveled within a tolerance of one inch (1”) of drop to twelve inches (12”) of grade. Placement locations will be provided in the Contract Documents.

5.2.9.5 All hand holes unless otherwise stipulated by the drawings will be buried with 12” to 18” of cover at final grade.

5.2.9.6 Immediately after placement, the soil around and over the hand hole will be tamped and compacted. Should any washouts occur, the respondent will be responsible for correcting the problem immediately without additional cost to Centerville City Schools, Washington Centerville Library or WashingtonTownship.

5.2.9.7 After cable placement all ducts will be sealed.

5.2.9.8 All splice hand holes/manholes will be grounded

5.2.9.9 A minimum of 100’ coil of cable shall be left in each hand hole/building for splicing use.

5.2.9.9.1 Slack in the cable sufficient to reach into a splice van shall be required at each vault, this will typically be a minimum of 100 feet as specified in the latest VDOT fiber requirements, but may vary by site location.

5.2.10 Splicing

5.2.10.1 Fiber to fiber fusion splicing of optical fibers at each point including head ends is required.

5.2.10.2 Complete testing services, such as end to end, reel testing, and splice loss testing, ORL, power meter/laser source testing and WDM testing is required.

5.2.10.3 Individual splice loss will be 0.10 dB for single-mode unless after 3 attempts these values cannot be achieved, then the fibers will be re-spliced until a splice loss within 0.05 dB of the lowest previous attempts is achieved. Splice loss acceptance testing will be based on the fusion splicer’s splice loss estimator.

5.2.11 Aerial Plant

5.2.11.1 Centerville City Schools, Washington Centerville Library and Washington Township prefers buried fiber but is open to aerial fiber runs under special circumstances using existing utility poles. Respondent must include aerial fiber run details in the proposal and adhere to pole owners’ requirements for clearances, spans, grounding, guys and attachments.

5.2.11.2 In the case of an aerial transition to avoid a construction obstacle, the Contractor shall provide the strand and all

hardware to lash the cable in place and set anchors in all required locations. The strand shall be grounded at every pole per NESC standards.

5.2.12 Testing Cable

5.2.12.1 The respondent shall be responsible for on-reel verification of cable quality prior to placement.

5.2.12.2 Completed test forms on each reel shall be submitted to the Centerville City Schools, Washington Centerville Library and Washington Township.

5.2.12.3 Respondent assumes responsibility for the cable after testing. This responsibility covers all fibers in the cable.

5.2.12.4 The respondent shall supply all tools, test equipment, consumables, and incidentals necessary to perform quality testing.

5.2.12.5 The cable ends shall be sealed upon completion of testing.

5.2.12.6 In addition to splice loss testing, selected respondent will perform end-to-end insertion loss testing of single-mode fibers at 1310 nm and 1550 nm from one direction for each terminated fiber span in accordance with TIA/EIA-526-7 (OFSTP 7). For spans greater than 300 feet, each tested span must test to a value less than or equal to the value determined by calculating a link loss budget.

5.2.13 Restoration

5.2.13.1 The contractor shall not open a work area greater than that which can restored in the specified time.

5.2.13.2 All work sites will be restored to as near their original undisturbed condition as possible, all cleanup will be to the satisfaction of the agency and any permitting agencies.

5.2.13.3 Respondent shall provide a brief description of restoration plan in the response, with the expectation that a more detailed restoration plan will be delivered prior to construction begins.

5.2.13.4 Work site restoration will include the placement of seed, mulch, sod, water, gravel, soil, sand, and all other materials as warranted.

5.2.13.5 Backfill material will consist of clean fill. Backfilling, tamping, and compaction will be performed to the satisfaction of the agency, the representative of any interested permitting agency, and/or the railroad representative.

5.2.13.6 Respondent will be responsible for any restoration complaints arising within one year after the agency’s final acceptance.

5.2.13.7 Excess material will be disposed of properly.

5.2.13.8 Debris from clearing operations will be properly disposed of by the respondent/subcontractors as required by permitting agencies or the railroad. Railroad ties, trees, stumps or any foreign debris will be removed, stacked, or disposed of by the respondent as per requirements by other interested permitting agencies, and/or the agency.

5.2.13.9 Road shoulders, roadbeds, and railroad property will be dressed up at the end of each day. No payment for installation will be permitted until cleanup has been completed to the satisfaction of the any permitting agencies, and/or the agency.

5.2.13.10 Site clean-up will include the restoration of all concrete, asphalt, or other paving materials to the satisfaction of the other interested permitting agencies, and/or the agency.

5.2.14 Documentation

5.2.14.1 As Built Drawing will include:

5.2.14.1.1 Drawings, site drawings, permit drawings, and computerize design maps and electronically stored consolidated field notes for the entire route must be included in the documentation. The method of installation will dictate the additional types of documentation that should be provided. For example, documentation of aerial installation should include pole attachment inventories, pole attachment applications, pole attachment agreements between respondent and other utilities, GPS points of reference for utility poles, and photo images of poles to which fiber is attached. Documentation of underground installation should include conduit design, conduit detailing, conduit path, conduit depth, manhole detailing, hand hole location, vault location, cabinet location, preparation of all forms and documentation for approval of conduit construction and/or installation, verification of as-built and computerized maps.

As E-rate program funding is sought for this project, Centerville School and the Library must follow E-rate program rules in regards to construction and service costs as they relate to leased lit fiber and self-provisioned. Each offeror should show construction costs associated with getting leased lit fiber to the building (if applicable) along with a separate construction cost (if applicable) for terminating the fiber in a Centerville School’s, or Washington Libraries or Washington Township equipment closet rack at each site. The overall cost to Centerville City Schools, Washington Centerville Library and Washington Township will be considered in awarding a contract from this bid.
