NPT Homes Ltd. invites you to submit an application form for inclusion on a Select list of
Contractors/Consultants. For your guidance, instructions for submission of your application
are detailed below:

other distinguishing mark revealing the identity of the sender) clearly marked

SECTION 1 – TERMS OF REFERENCE
INTRODUCTION
Applications are invited from suitably experienced contractors who would like to be
included on a Select list of Contractors/Consultants to be used by NPT Homes Ltd. for all
building and construction works within designated categories as specified in the
Questionnaire document.
Only those contractors who can demonstrate a detailed knowledge as a main contractor for
these types of works, who have successfully completed schemes/works of a similar nature
and have the relevant qualifications and expertise should apply.
Contractors must have completed a Health & Safety pre-qualification assessment by a
Registered Member of the SSIP (Safety Schemes in Procurement) Forum. Contractors must
provide their consent for NPT Homes Ltd. to conduct financial checks through the use of
CreditSafe, and all Applicants must have a CreditSafe Score higher than the clearly defined
Thresholds set by NPT Homes Ltd.

The anticipated timescale for appointment to the Select List is as follows:

Tender. . Responsibility to provide references sits with the Applicant and failure to provide
references will result in a “Fail”.

A.2 - INSTRUCTIONS AND GUIDANCE NOTES FOR COMPLETION
1. The questions which follow are designed to give NPT Homes Ltd. all the information needed
to assess your organisation’s capability to carry out any potential tenders that you may or
may not be invited to Tender.
2. All questions should be answered in the spaces provided. DO NOT alter the layout of the
form in any way or print/write details outside the boxes provided. All writing must be clear
and legible.
3. Only where it is specifically requested should documents be enclosed and returned with the
Questionnaire. CV’s, Company Profiles, Letters or any other supplementary materials etc.
should not be returned with the application documentation.
4. The completion and return of this Questionnaire qualifies contractors and suppliers for
consideration for inclusion on NPT Homes Ltd. Select list of Contractors/Consultants . No
other form of application will be considered.
5. All questions are to be answered in English with monetary values given in pounds sterling (£)
excluding VAT.
6. The completed Questionnaire of companies admitted to the Select list of
Contractors/Consultants may be incorporated into the Form of Agreement for any possible
awarded Contract arising. If any information submitted in the Questionnaire changes then
NPT Homes Ltd. must be informed immediately. Failure to do so may result in your company
being suspended or removed from the Select List, or termination of any contract that has
been granted.
7. NPT Homes Ltd. reserves the right to contact organisations’ technical referees. Referees
should be informed in advance so as not to cause delay and, should references be either not
returned or do not provide comfort of an organisation’s technical abilities then it will result
in the Application not being considered further.
8. Please read all the notes in this application form. If you have any questions or need help
filling in the form, please contact the officers mentioned previously.
9. Please ensure that you complete the Declaration at the end of this document before
returning the form and any enclosures.
10. The provision of false or misrepresented information will result in your application being
rejected.

A.3 - GENERAL TERMS & CONDITIONS
1. The information disclosed in this Questionnaire will be used in an evaluation of
your company’s suitability to be included on NPT Homes Ltd Select list of
Contractors/Consultants . Inclusion onto the Select List does not imply or
guarantee any volume of work nor does it guarantee a minimum or maximum
number of invitations to tender.
2. Companies responding to this Questionnaire are asked to provide the
information requested in as much detail as possible in order to enable NPT
Homes Ltd. to assess the technical ability and capacity of organisations
expressing an interest in working for NPT Homes Ltd.
3. NPT Homes Ltd. reserves the right to request applicants to clarify their
submissions in writing. Any such request shall be made in writing to the
applicant.
4. NPT Homes Ltd. reserves the right to reject or suspend any applicant who is
found to be guilty of a serious misrepresentation in supplying any information
requested.
5. Unless instructed otherwise when answering the questions, please give details
that specifically relate to your Company, not to the whole of the group if your
company forms part of a Group structure.
6. Please note that NPT Homes Ltd. will not be responsible for Applicants’ costs
relating to expenses incurred in preparation and submission of the application.
7. Successful applicants should note that, for any contracts awarded, a post-
completion evaluation is carried out including contractor performance and
unsatisfactory performance may lead to a suspension or in some cases may lead
to removal from the Select list of Contractors/Consultants.

A.4 - HOW ARE TENDERS ISSUED?
Invitations to Tender (below OJEU Thresholds) shall only be sent to Companies that are
included on NPT Homes Ltd. Select list of Contractors/Consultants.
A minimum number of six companies will be invited to Tender for each contract.
If NPT Homes Ltd. feels that a more competitive bid will result, the number of Companies to
be invited to Tender may exceed the number prescribed above.
Companies will be invited to Tender in alphabetical order in relation to the Works Category
that the Contract deems to satisfy, with the three lowest (priced) tenderers from the
previous contract awarded within the Works Category automatically receiving an invitation
to Tender.
NPT Homes Ltd. reserves the right to exclude a contractor from an invitation to Tender if
they fail to meet the minimum requirements as described in ‘Reasons for
Suspension/Exclusion’ on page 13.
Inclusion onto the Select List does not imply or guarantee any volume of work nor does it
guarantee a minimum or maximum number of invitations to Tender.
The purpose of this section is to provide Applicants with information on how NPT Homes
Ltd. conducts its procurement process for issuing Tenders.

A.5 - REASONS FOR SUSPENSION/ EXCLUSION
1. Unsatisfactory work or performance on a contract for NPT Homes Ltd. within the last
5 years.
2. Unsatisfactory work or performance on a contract for any other company.
3. No previous experience in the category of work applied for.
4. Habitually submits excessive claims.
5. Declined invitations, or did not submit a tender on the last three occasions within
the previous 12 months.
6. Inadequate plant resources.
7. Likely to cause additional cost to NPT Homes Ltd. in supervision of contracts because
of inadequate arrangements from Head Office or Site Management.
8. Disregard for the Conditions of Contract or instructions given by, or on behalf of, the
acting Supervisor.
NPT Homes Ltd. reserves the right to suspend or exclude a contractor from the Select List
if they fail to meet minimum requirements. Reasons for possible suspension or exclusions
are listed below.

B.4 - TARGETED RECRUITMENT & TRAINING
Targeted Recruitment & Training Requirements Skills & Training Opportunities
NPT Homes believes that all work related tenders it awards is an opportunity to help meet the aspirations of the Welsh Government and NPT Homes in terms of improving employment and training opportunities through apprenticeships and other training opportunities. Additionally, NPT Homes is committed to ensuring that the local communities it serves
benefit both socially and economically from the Association’s significant investment
programme, to both improve and maintain its properties to the Welsh Housing Quality
Standard.
To maximise training opportunities, NPT Homes requires all of our delivery partners to
provide training and employment opportunities, as appropriate, to the work being
undertaken. Specific requirements will be included within individual tenders or requests for
quotations that will form part of the tender process and be monitored for implementation
during the delivery of the works.
Contractors who are selected for inclusion on the NPT Homes Select List of
Contractors/Consultants will, when undertaking work for the Association, be expected to
provide placement opportunities for apprentices employed by South West Wales Regional
Shared Apprenticeship Ltd; a company that NPT Homes is firmly committed to supporting.
Where appropriate, Contractors/Consultants will be obliged to provide a minimum of 2.5 days of Shared Apprentice placements or other training opportunities for every £10k of contract spend. NPT Homes will monitor, in conjunction with South West Wales Regional Shared
Apprenticeship Ltd, the number of shared apprenticeship placement training days provided.

B.11 - DATA PROTECTION ACT
(i) Where ‘the contractor’ receives any personal data, as defined by the Data
Protection Act 1998 (the Act) from NPT Homes Ltd, it shall ensure that it fully
complies with the provisions of the Act and only deals with the data to fulfill
its obligations under the contract.
(ii) The contractor shall indemnify NPT Homes Ltd, for any breach of the Act
which renders NPT Homes Ltd, liable for any costs, claims or expenses.
(iii) In fulfillment of its obligations under the Act the Contractor shall have
systems in place to ensure:
a) Full compliance with the Act.
b) In particular, compliance with the Seventh Data Protection Principle which
deals with the security of personal data.
c) The reliability of all its employees who may be involved in processing the
personal data.
(iv) The Contractor shall take all reasonable steps to ensure that all its partners,
contractors and agents comply with this clause where they are processing
any personal data on behalf of NPT Homes Ltd.
(v) The Contractor shall allow NPT Homes Ltd, reasonable access to such
information as is necessary to ensure that it is complying with the above
provisions and the Act as a whole.
