COMMON TYPES OF NURSING HOME ABUSE AND NEGLECT:PRESSURE SORESPressure sores (also known as bedsores, pressure ulcers ordecubitus ulcers) are lesions on the skin that typically formdue to constant pressure on bony parts of the body. Thispressure decreases the blood flow to those areas, causingthe tissue to die. Bedsores can occur anywhere, but arecommonly found on the following body parts:

• Sacrum • Coccyx (Tailbone)• Ankles• Elbows• Heels

PRESSURE ULCERS ARE OFTEN PREVENTABLE.Nursing homesand hospitals are obligated to assess each resident todetermine if they are at risk for bedsores. When a resident isat risk for pressure sores, nursing home staff must develop acare plan to prevent sores from forming or worsening andthen implement that plan. Conscientious staff mustfrequently reassess plans to make necessary changes,dependent on each resident.

Nursing home residents at certain stages of incapacity areat risk for developing pressure sores. There are numerousrisk factors. Some of the most common include:

• Immobility (often as a result of fractures sustained during falls)• Poor Nutrition And Hydration• Peripheral Vascular Disease• Diabetes

All long-term care facilities are required to have measures inplace to prevent the development or worsening of bedsores.When a resident develops bedsores because nursing homestaff failed to take all possible steps to prevent them, familiesmay be able to hold the facility accountable.

COMMON TYPES OF NURSING HOME ABUSE AND NEGLECT:NURSING HOME FALLSFALLS IN NURSING HOMESAccording to the Centers for Disease Control and Prevention,1,800 nursing home residents die from fall-related injuriesevery year, and those who survive often suffer debilitatinginjuries from which they never fully recover. Nursing homefalls are common because residents are typically older andhave difficulty walking due to muscle and bone density loss,medication side effects, poor vision and gait problems.However, nursing home falls are often preventable ifemployees take the proper steps to supervise and protectresidents under their care.

Nursing home staff play an important role in protecting thesafety of residents as they move about the facility. When apatient is admitted into a nursing home, staff must assess hisor her risks for falls and identify and implement interventionsto address these risks. Reassessments should occur after anyfall or change in medical condition. Residents at risk shouldbe monitored closely and receive assistance with transfers toprevent them from falling. Bed rails, nonskid footwear,appropriate wheelchairs and comfort chairs with wheelslocked at bedside, walkers and canes can be used to helpprevent falls.

Falls in nursing homes may lead to serious injuries including:

• Brain Injuries• Skull or Facial Fractures• Fractured Limbs• Hip Fractures

Oftentimes these injuries result in further medical issues andpermanent disability. For older people, fall injuries can greatlyreduce their quality of life and cause their overall medicalcondition to deteriorate rapidly. Although some falls areunavoidable, falls in nursing homes are often a sign ofnursing home negligence and understaffing. When nursingstaff cannot properly supervise and monitor residents, fall-related injuries are more likely to occur.

COMMON TYPES OF NURSING HOME ABUSE AND NEGLECT:PHYSICAL OR SEXUAL ABUSENursing home residents are easy targets of physical orsexual abuse because of their dependence on others. Manyresidents cannot communicate, and therefore cannot reportabuse themselves. Maltreatment of the elderly is absolutelyunacceptable, and deserves severe punishment to both theperpetrator and the nursing home that allowed the abuseto occur. Physical abuse encompasses both sexual assaultand any form of physical assault or maltreatment.

A resident may not be able to speak for themselves, buttheir physical condition can reveal warning signs of nursinghome abuse. Signs of physical or sexual abuse include:

• Unexplained Cuts• Bruises• Burns• Broken Bones

Along with physical signs, victims of abuse may becomewithdrawn or anxious.

Abuse may occur between two residents or between anursing home staff member and a resident. No matter whothe abuser is, nursing homes are responsible for protectingthe safety and well-being of residents under their care andcan be held accountable when employees or other residentscause serious harm to a resident.

COMMON TYPES OF NURSING HOME ABUSE AND NEGLECT: MEDICATION ERRORSMisadministration of medicine and medication errors arefrequent and serious problems at nursing homes. Residentsare often given the wrong medication or not given themedication in the dosage or frequency as required by thephysician’s order. This occurs as a result of carelessness onthe part of the staff, lack of supervision of the nursesadministering medications or not having enough properlytrained and supervised to staff to administer medications.

Studies have shown delayed or missed doses of medicationand the administration of the wrong dose or the wrongmedication are the two most common medical mistakesmade in the medical setting. Studies also show that nursinghome medication error occurrences are widelyunderreported. It is estimated that only 1.5% of allmedication errors are actually reported.

Medication error risks in nursing homes can be considerablebecause most patients are required to take a number ofprescriptions and already have compromised physicalhealth conditions.

OVERMEDICATIONNursing home residents are often given antipsychoticmedications despite having no diagnosis to call for their use.Medicare statistics showed that in 2010, over 17% of peopleliving in nursing homes were receiving antipsychoticmedications on a daily basis at doses that exceeded therecommended level.

When nursing homes are understaffed, employees mayovermedicate residents to sedate, “manage” or “control” them.Signs of overmedication include:

• Personality Changes• Lethargy or Exhaustion• Oversleeping• Confusion • Withdrawn or Reclusive Behavior

Antipsychotics are often prescribed to treat younger residentswho suffer from mental illnesses. However, when nursinghomes administer antipsychotics to elderly residents whosuffer from dementia, it is considered an off-label use. Theuse of these medications in elderly residents commonlycauses lethargy and can lead to other serious medical issues.

DEHYDRATION/MALNUTRITIONMaintaining appropriate nutritional and hydrational status isimportant in the nursing home setting. Residents who do notreceive adequate nutrition and hydration in their diets aremore at risk for the development of pressure ulcers, infection,muscle weakness leading to immobility and falls. Malnutritionand dehydration also make it more difficult for existingpressure ulcers and infections to heal.

Elderly nursing home residents are at risk for dehydrationbecause they have less water content in their bodies anddecreased thirst. It is important for nursing home staff toassess these risks, and develop and implement plans tomonitor those in their care. Nursing home staff should bewatchful of residents’ fluid intake to ensure they areproperly hydrated.

There are a variety of factors that can lead to malnutrition.Depression is a potential cause of malnutrition becauseindividuals suffering from depression have a tendency to eatless and in turn to do not receive appropriate vitamins andminerals to prevent malnutrition. Other causes ofmalnutrition include difficulty swallowing and adverse drug

effects such as vomiting and diarrhea. Nursing homes oftenfail to take steps to prevent malnutrition by not monitoringresident food intake and output, not providing a comfortableenvironment to promote eating and not providing food thatis appetizing.

CHOKING Nursing home residents often have medical problems or takemedications that make it difficult to properly chew orswallow food. Due to this, many are at high risk for chokingand require special food preparation or diets to ensure thatthey receive the proper nutrition. Residents who are at riskshould also be closely monitored during mealtimes.

Choking, by depriving oxygen to the brain, can cause braindamage, and even death. While such an injury may appear tobe accidental, in some instances choking is a result of nursinghome negligence. This includes giving residents the wrongfoods or failing to monitor them as they are eating. When thisis the case, it is important that nursing homes are heldaccountable for their fatal mistakes.

COMMON TYPES OF NURSING HOME ABUSE AND NEGLECT: WANDERING/ELOPEMENT Elopement and wandering are related concepts. Elopement refers to a resident’s ability to leave the nursing homeunsupervised and unnoticed, putting their safety in danger. Wandering refers to aimless movement throughout the facilitywhere the resident puts his or her safety at risk due to an inability to appreciate danger.

Elopement and wandering are risks that the nursing home staff must recognize and plan for in order to prevent residentsfrom leaving the facility or entering into an unsafe area. Staff must provide each resident with the appropriate level ofsupervision to prevent elopement and wandering behavior. Exit doors should be alarmed to notify staff when residentsleave the facility unsupervised, and the staff must know how to appropriately respond to alarms. Failure to do preventelopement and wandering puts residents at risk for falls, exposure to harsh weather and other significant danger.

S.A. v. HCR MANOR CARE HOMEWOOD A $2.9 million Cook County record nursing home juryverdict against a suburban Homewood nursing home for thefamily of a deceased 57-year-old resident who was suffocateddue to the home’s negligent care of her tracheostomy tube.

J.M. for M.M. v. KINGSLEY PLACE, et al.A $2.3 million settlement against an assisted living facilityfor the family of an 88-year-old resident who developedsevere and infected bedsores, which ultimately broughtabout her death. Her doctor was criminally indicted for hisconduct and charged with involuntary homicide.

P.C. for A.R. v. RIDGEVIEW PAVILION, et al.A $1.5 million settlement against a nursing home for violatingthe Nursing Home Care Reform Act by failing to monitor aresident’s cigarette smoking, leading him to suffer severeburns and death.

J.F. v. WEDGEWOOD PAVILION NURSING HOME A $1.4 million verdict against a nursing home for its failureto manage a resident’s aggressive behavior. This residentbecame involved in a clash with a fellow resident who,during the altercation, fell and suffered a hip fracture,which led to his death.

JANE DOE V. CONFIDENTIAL NURSING HOMEA $1.4 million settlement against a nursing home locatedin a northern suburb for injuries sustained as a result of apressure ulcer.

C.M. for H.M. v.
