QUALIFICATION AS SOLICITOR OR BARRISTER IN ENGLAND AND WALES

In order to obtain a Qualifying Law Degree (‘QLD’), students must take and pass (i.e. attain a mark of at least 40% in) the modules listed below (hereafter referred to as the ‘exemption modules’) over the course of your degree: LW315/LW325 Introduction to Obligations

LW592 Public Law 2 LW593 European Union Law LW598 Equity and Trusts LW599 Land Law LW650 The Law of Contract LW651 The Law of Tort The Law School will assume that all students will want to obtain a QLD, therefore students will be automatically registered for these modules. Students must also study a further 60 Credits of Law to obtain the 240 Credits needed for a QLD1. Students who successfully meet these requirements are exempt from the need to undertake the Common Professional Examination and can therefore proceed directly to the Legal Practice Course (for solicitors) or the Bar Professional Training Course (‘BPTC’) (for barristers). Note however, that students who wish to proceed to the BPTC must obtain an overall degree classification of at least 2.2. i) Implication of failure in exemption modules It is vital that students PASS ALL the exemption modules listed above; there may be serious consequences for failing to do so. Prospective solicitors Although University rules governing compensation may permit a student to progress to the next Stage of their degree, or even pass their degree as a whole, the exemption module will still have been failed. As a result, the student will not have obtained a QLD. However, the Solicitors Regulation Authority (‘SRA’) grants the Board of Examiners the discretion to award a student a QLD (following a decision to compensate a single failure of an exemption module) but only in exceptional circumstances and if specific criteria are met. Students should contact the Student Advice Office for guidance on the process of submitting concessionary evidence to the Board of Examiners. Prospective barristers The Bar Standards Board (‘BSB’) rules are more complex than those of the SRA, therefore students should contact the Student Advice Office for further guidance.

ii) Number of attempts The professional bodies allow a maximum of three attempts at an exemption module (one initial attempt followed by a further two attempts). Attempts treated “as for the first time” do not count for this purpose. If a student is compensated before being given three attempts to allow them to progress:

- The student can sit the module for exemption purposes alongside their programme of study or, if they have graduated, as an external candidate at the first available opportunity. For example, for a student who graduates with a compensated mark in an exemption module in July 2016, the first available opportunity to sit for exemption purposes will be in August 2016.

iii) Time limits for Qualifying Law degrees

Note: Discretion is afforded to the Board of Examiners by the SRA to grant a QLD to a student exceeding the prescribed time limits but only in exceptional circumstances and if specific criteria are met. BSB rules differ from those of the SRA and therefore, students seeking qualification as a barrister are advised to contact the Student Advice Office for further guidance. Joint Honours Law Students Students undertaking a Joint Honours law degree who; take and pass the exemption modules; undertake the additional legal study required and; in the case of aspiring barristers, achieve an overall 2:II degree classification; will obtain a Qualifying Law Degree. These students will be similarly exempt from the Common Professional Examination and can proceed directly to the Legal Practice Course or the Bar Professional Training Course. NOTE: In week zero and week one there are introductory events and all joint honours students should attend as many of these as possible. The compulsory module (The English Legal System and Skills), which is required for a Qualifying Law Degree, will have some sessions taught during week one. All programmes, unless specified in the rubric for that programme, require that you take modules amounting to 120 LEVEL 4 Credits in total, 60 Credits in the Autumn term, and 60 Credits in the Spring term. SSPSSR DEGREES WITH A YEAR ABROAD The School of Social Policy, Sociology and Social Research offers their undergraduate students the chance to add an optional year or term abroad to their programme of study. Please see the SSPSSR Study Abroad pages at https://www.kent.ac.uk/sspssr/studying/study-abroad/index.html for available programmes.

To be eligible for study abroad, you would normally need to have achieved an average of 60 or above in your first year of study and two of your tutors will need to support your application. You will also need to attend a series of talks and workshops. SSPSSR students on a UG programme ‘with a year abroad’ will spend one academic year studying in a University with whom Kent has agreements for such exchanges. The specific institutions will change over time but will normally include a range of institutions across Europe and in selected countries elsewhere in the world. At present they include:

University of Amsterdam, Netherlands

University of Granada, Spain

University of Trento, Italy

University of Hong Kong, China

University Maynooth, Ireland Students must achieve an average of at least 60 % in the first and second year of study to be eligible to proceed with their Year Abroad. Students most show language proficiency for those programmes where the language of instruction is not English (ie.Trento and Granada). Students will undertake study as directed by programme directors and module convenors in the institutions where they are enrolled and be assessed accordingly. In addition, students will retain contact with staff at Kent whilst abroad. A student who successfully completes the ‘year abroad’ will gain 120 credits through the ‘Year Abroad’ module and graduate with a degree ‘with a year abroad’. Students undertaking Criminology degrees also have an opportunity to spend one term during the third year at San Diego State University in California as part of an international exchange programme.
