The Sullom Voe Harbour Authority shall be committed to operating to the standards of

marine safety required to achieve compliance with the International Safety

Management (ISM) Code and Port Marine Safety Code and in accordance with the

guidance provided in the Guide to Good Practice for Port Marine Operations.

In exercising its functions as the Harbour Authority the need for nature conservation

and regard for other environmental considerations, including Habitats Directives

requirements, will be recognised at all times.

The Sullom Voe Harbour Authority will fully meet its obligation to conserve, and

facilitate the safe use of, the harbour, and its duty of care against loss caused by the

authority’s negligence.

The Sullom Voe Harbour Authority Board will meet its responsibility for ensuring that

sufficient resources are provided to enable the effective operation of policies,

procedures and systems.

The Sullom Voe Harbour Authority – Towage Operations is committed to ensuring the

safe and environmentally friendly completion of operations within the Sullom Voe

Harbour area. In achieving this it will;

Health and Welfare

Make sufficient and suitable assessment of the risks to the health and safety of

its employees to which they are exposed whilst they are at work.

Safety

Operations will be conducted in accordance with the Health and Safety at Work

as amended Act 1974 and any other relevant current codes and legislation.

If any conflict arises between SIC policy and maritime or regulatory policy then

the maritime / regulatory policy will be followed.

Recognise that the safety of employees is paramount.

Ensure that all employees are aware of their responsibilities.

Environmental

Promote the awareness, protection and conservation of the environment by

minimising environmental degradation by actively preventing the discharge of

oil, oily water, garbage and other contaminants into the sea.

Objectives

To prevent incidents and protect personnel.

To ensure that all operations are undertaken safely.

To develop a sense of personal responsibility for health, safety and protection of

the environment in all employees.

To demonstrate that safe systems of work are essential to efficient operations.

To demonstrate preparation for handling safety and environmental

emergencies.

To demonstrate through satisfactory records that operations are conducted in

accordance with these policies.

Implementation

Responsibility for implementation of these policies rests with line management.

The nominated "Designated Person Ashore" (DPA) on matters relating to ISM

Code compliance is shown in Section 13.

Employees are required to comply with all safety rules and regulations.

When considering new business or operational routines, full account will be

taken to ensure that standards are maintained.

All operational procedures and work instructions will be properly supervised.

Management will respond positively to changes in policies, procedures or

equipment necessary to improve health and safety.

All major accidents, dangerous occurrences and incidents shall be reported

through line management to the Harbour Board and also the MAIB, if necessary.

All incidents of a serious or potentially serious nature and all dangerous

occurrences shall be investigated, and recommendations communicated where

appropriate.

Employees will participate in training, including exercise drills for emergency

preparedness, which may be required to comply with the Merchant Shipping Act

or any other compulsory legislation.

These policies will be reviewed and updated in the light of new legislation

coming into force.

Compliance with the International Maritime Organisation's "International Safety

Management Code" is a condition of Employment.

The HEALTH AND SAFETY AT WORK ACT 1974 places duties on both employers

and employees. Under s.2 employers are required to ensure as far as is reasonably

practicable, the health, safety and welfare at work of all employees. Section 7 of the

Act requires employees to take reasonable care of the health and safety of themselves

and others who may be affected by their acts and omissions at work.

The MERCHANT SHIPPING SAFETY AND HEALTH REGULATIONS 1998 place

general duties on employers, employees and others in respect of health and safety on

board UK ships. The main duties are as follows:

(a) On employers – to ensure, so far as is reasonably practicable, the health

and safety of their employees and other persons aboard ship;

(b) On employees – to take reasonable care for their own health and safety and

for others aboard ship and to co-operate with their employers with regard to

their statutory health and safety duties.

These regulations also make it an offence for any person to intentionally or recklessly

interfere with or misuse anything provided in the interests of health and safety aboard

a UK ship in pursuance of Merchant Shipping legislation.

Key Staff Responsibilities Policy No: P4

Summary key staff responsibilities are listed below. Detailed “Job Descriptions” can

be found in Section 13 of this Manual.

Shetland Islands Council The Shetland Islands Council (SIC) has overall responsibility for all sections of the

Council. The SIC approves policies and monitors implementation. The SIC also agrees

budgets, monitors performance and approves and regulates Service Specification.

Chief Executive The Chief Executive, as the senior official of the Council has, inter alia, overall

responsibility for the safe and efficient operation of Ports and Harbours.

Chairman (Harbour Board) The Chairman of the Harbour Board is responsible for directing that standards and

operational policies are implemented through line management in accordance with

legislation and corporate requirements.

Designated Person Ashore (DPA) The person appointed as “Designated Person Ashore” (DPA) is shown in Section 13.

The DPA is responsible for implementing appropriate organisational structures to

provide safe and efficient shipboard operations, with particular regard to safety, crew

standards, training and quality assurance. On matters relating to compliance with the

ISM Code these responsibilities include monitoring safety and pollution aspects of

shipboard operations and ensuring that adequate shore based support is provided.

While all safety matters should be raised with the Operations Manager - Marine in the

first instance, Tug masters have direct access to the DPA for delegated

responsibilities.

When the DPA is absent or unavailable another suitably qualified person will deputise

as the DPA. All relevant persons will be informed by means of memo or by email of the

change and contact details.

Harbourmaster The Harbourmaster is responsible to the Harbour Board for the safe and efficient

operation, in compliance with the ISM Code, of towage operations at Sullom Voe

Operations Manager - Marine The Operations Manager - Marine is responsible to the General Manager for the safe

and efficient operation, in compliance with the ISM Code, of vessels under his control.

Superintendent Engineer - Marine The Superintendent Engineer- Marine is responsible for ensuring maintenance of all

technical / safety equipment and investigation of failures on technical issues relating to

operational requirements.

Tugmasters Tugmasters are responsible for undertaking towage in accordance with operating

procedures and maintaining the day-to-day operation of the Safety Management

System on board their tug, in compliance with the ISM Code.

The Tugmaster’s key responsibilities for ISM Code compliance are:

1. Implementing the safety and environmental protection policies of the SVHA –

Towage Operations.

2. Motivating tug crew in the observation and compliance of these policies.

3. Issuing appropriate orders and instructions in a clear and simple manner.

4. Verifying and checking that procedures, work instructions, drills and towage

routines are carried out correctly.

5. Reviewing the onboard Safety Management system (SMS) and reporting

deficiencies and improvement opportunities.

6. Monitoring and recording of hours worked and rest periods of individual crew

members. Also, reporting to shore staff if it becomes apparent that an individual

is not sufficiently rested.

The Tugmaster has overriding authority, whilst on board, for the vessel under his

command. In particular, the authority to deviate from this Operations Manual and

make decisions in respect of safety and pollution prevention and request

assistance should this be necessary.

Tug Engineers

Tug Engineers are responsible for maintaining and operating plant and

machinery on board, in a safe and efficient manner. The Chief Engineer is

responsible for advising and assisting the Tugmaster on the management of

technical aspects relating to the operation of the onboard Safety Management

System (SMS).

Tug Crew

Tug crews are responsible for assisting the Tugmaster and Engineers, as

directed, in the day-to-day management of the Safety Management System on

board their tug. It is a fundamental duty of all crew to observe and comply with

SVHA – Towage Operations operating instructions and the requirements of the

ISM Code.

Working Language Policy Policy No: P5

The English language is the official working language spoken on board all SVHA –

Towage Operations vessels, when complying with the ISM Code and operational

duties.

Distributed Operational Manuals, Procedures and Work Instructions are printed and

published in the English language.

All written reports, log books and other correspondence are to be completed legibly in

the English language.

Medical Requirements Policy Policy No: P6

All crew employed on SVHA – Towage Operations vessels are to be in possession of

an in date medical certificate as approved by Flag state legislation. For British flag

vessels this will be an ENG 1 certificate.

Safety Management System Policy Policy No: P7

The SVHA – Towage Operations, Safety Management Policy shall be available to all

staff.

Tugmasters are to be knowledgeable and fully conversant with operating the Safety

Management System (SMS) on board vessels that they command. Assessment of their

understanding and proficiency in operating the system will be carried out during

Personnel - Policies internal audit, by informal interview and observation of standards

maintained. It is also the responsibility of the Tugmaster to ensure that their crews are

fully conversant with all aspects of the SMS.

The General Manager, Harbourmaster and Operations Manager – Marine shall review

draft changes to the SMS before documents are issued. When approved the DPA, or

person nominated by the DPA, will commence distribution. A summary of changes is

recorded in the “Introduction” section of this manual.

Qualification for Command Policy Policy No: P8

SVHA – Towage Operations will formally appoint, for harbour towage duties, selected

personnel to the position of “Tugmaster”.

Selection for the post will follow Shetland Islands Council Recruitment & Selection

policy. A copy of this policy is available on the Intranet

http://www.sic.gov.uk/services/personnel/policies/

Masters’ should encourage their Mates to progress their skills and qualifications

towards achieving the rank of Master.

Management Review of Safety Management

System

Policy No: P9

The General Manager, DPA, Harbourmaster, Engineer Manager – Marine and

Operations Manager – Marine will review the effectiveness and suitability of the Safety

Management System annually. The Harbour Board Chair and Director will be invited to

attend.

It is the responsibility of the Harbourmaster to advise Harbour Board Members on the

implications of safety matters being reviewed.

If necessary, a Management Review may be held at any time, if urgent safety

management matters require discussion.

The Tugmaster is responsible for facilitating and reporting all matters relating to safety

to the Operations Manager – Marine, in particular any accident (reportable or

otherwise) and exercise drills.

Likewise, the Operations Manager – Marine will report to the DPA, a summary of

monthly safety activities (including all exercise drills) and immediately in the event of a

reportable accident occurring.

Training and Qualification Policy Policy No: P10

As a minimum, the qualifications of crews on board tugs shall meet the requirements

(dependent on the nature of the voyage) of flag state and the Maritime and Coastguard

Agency. This may be in the form of a Safe Manning Document.

Guidance can be found in Maritime and Coastguard Agency Merchant Guidance

Notes, Merchant Shipping Notices and STCW or any subsequent publication that

supersedes these.

Detailed instructions for Crew and Staff, including review requirements, are contained

in Section 7 of this Manual, procedure STP 006.
