THE CONDITIONS OF SALE FOR REAL ESTATE

ALL BIDS DUE BY THURSDAY, DECEMBER 5, 2013 AT 3 PM

THE property of The Estate of Grace A. Johnstone is now being offered for sale under and

subject to the following conditions and stipulations.

SAID property to be sold is 183 Meeker Outlet Road, Dallas, Lake Township, Luzerne County,

Pennsylvania, containing 2.32 acres more or less with all buildings and improvements and

known as Tax Parcel #37-E6-00A-051-000.

SAID property shall be offered via Sealed Bid Auction with a Minimum Acceptable Bid of

$35,000.00. The highest and best bidder shall be the Buyer or Buyers. Successful Bidder will be

notified within 24 hours of the end of the bidding period.

BUYER’S PREMIUM & DEPOSIT REQUIREMENTS: A ten percent (10%) Buyer’s

Premium will be added to the bid price to obtain the final sale price. BUYER or BUYERS shall

pay down within 48 hours of notification of winning bid, a deposit of 10% of the final sale price

in the form of cash, certified funds, a bank letter of guarantee to accompany a personal or

business check, or acceptable check. Said deposit to be held in the Escrow Account of Chuck’s

Auction Service to conform with the Pennsylvania Real Estate License Law. Parties to sign an

Agreement of Sale form accompanying these Conditions.

Should Buyer fail to make any additional payments OR furnish false or incomplete information

to Seller or any other party identified in this Agreement concerning the Buyer’s legal or financial

status OR violate or fail to fulfill and perform any other terms and conditions of this Agreement,

Seller may hold the Buyer in default.

In the event of default, Seller is limited to retaining sums paid by the Buyer, including deposit

monies, as liquidated damages.

If Seller retains all sums paid by the Buyer, including deposit monies, as liquidated damages

pursuant to this Agreement, Buyer and Seller are released from further liability or obligation and

this Agreement is VOID.

Seller offers no financing and sale is not contingent upon the successful Bidder obtaining

financing or the sale of another property.

available for review and inspection during the On-Site inspections or by appointment. All

information contained in the brochure and all other auction-related material is subject to and

superseded by the Contract.

CLOSING DATE: Settlement is to be on or before Friday, December 20, 2013 at which time

the purchaser will pay the balance of the purchase price. Possession will be transferred upon

recording of the deed. Taxes will be prorated to the day of closing.

PROPERTY CONDITION: The property is being offered for sale “AS-IS, WHERE-IS” and

without warranty, expressed or implied. Pursuant to local and federal disclosure laws, you are

invited to perform lead based paint testing prior to the submittal of any bid as well as any other

inspections of the property. Bidder understands that he will be relying solely on bidder’s own

information when bidding and that bidder has conducted sufficient due diligence to honor all

bids, execute the Agreement of Sale, and close the sale if bidder is the successful bidder for the
