Greetings Dealers! I would like to share with you information about our recent trip to the 2017 NADA Washington Conference. Attending for SDADA were Karris McKie-Kaiser, Past Chairman Dutch VanSanten, our NADA Director Doug Knust, President Myron Rau and myself.
We met with Senator John Thune and Senator Mike Rounds. Representa-tive Kristi Noem was not able to meet with our delegation because of impor-tant voting on the Hill.
Karris made the case against the proposed legislation on open recalls that would be devastating to the consumer and the dealers. Thank you Karris. You did an ex-cellent job presenting the dealers position.
Dutch presented the heavy truck industry’s stance on the 12% Federal Excise Tax of over-the-road trucks. He added this both hampers the sale of new trucks as well as the replacement of older, less fuel efficient and environmentally outdated trucks. Great job Dutch!!
Director Doug Knust covered the following NADA issues: pending tax reform and the importance of keeping the interest deduction; the advertising deduction; the LIFO inventory accounting method; and the elimination of the Federal Estate Tax. Doug has been go-ing to Washington as our NADA Director for many years. He is very good at what he does. Thank you Doug for your insight into how Washington works.
My thoughts is things have changed a great deal since my last visit to DC. The last time I was there was two years ago. All the talk and worry was about the Consumer Protection Agency. Now we are waiting for the Director of the Agency to step down and for Con-gress to put in place meaningful controls over the Agency's power.
I would like to thank Myron for all the guidance on our trip. In closing, I hope that many more dealers go to Washington, DC. It is truly educational to see how the nation is run.

I hope everyone is having a great summer. It sure seems to have gone past in a hurry again. We have cer-tainly had a variety of weather across the state. Some areas are very dry while others seem to have adequate moisture for farm crops.
Sometimes, your SDADA Office is a bit remiss in advertising the services
that are provided to the members. Two of those services partic-ularly come to mind, they are notary bonds and dealer bonds. Please check where you currently get these bonds, then give us a call for a quote. I am sure the rate we have available will be of benefit to every dealership.
As I grow older, I recognize how life can change in a moment. A couple of weeks ago, SD Senator Brock Greenfield went to the hospital for some tests and found blockages around his heart that led to multiple bypass surgery (boy, that sounds familiar). He came through the surgery just fine and is now convalescing in Clark. Also about that same time, Shawn Lyons who is the Executive Director for the South Dakota Retailers Association, suffered two strokes while he was attending a conference of his peers in Portland, OR. Shawn is still not completely out of the woods, but is improving at the time of this writing.
Both of these gentlemen are much younger than I am. These examples, as so many others, remind me just how life can change in a moment. It also reminds me that we are not in charge of our destiny. I recommend we all live our lives each day as it may be our last. Live, love and laugh!
Many of you have had conversations with my wife, Anita, or myself regarding our changes to our living quarters. For those who have not, here goes. In July of 2015, we bought a piece of a warehouse (built in 1909) in downtown Sioux Falls. Another structure was added to this warehouse with the whole develop-ment to be subdivided into individual lofts. For those of you that have done something similar, this is a life altering experi-ence in that you need to downsize - there goes my lawn mower and tools that I have accumulated over the years. We sold our home in southern Sioux Falls in the spring of 2016 and moved to a rental loft on north Phillips Avenue and not so patiently waited and watched the warehouse remodel. Well, it has been a long wait but we finally moved into our new loft at 421 North Phillips Avenue on September 15th. We are now downtown residents!

As I write this, Senator Thune and the Senate Commerce Committee are prepar-ing legislation to advance self-driving vehicles or Highly Automated Vehicles (HAVs). As dealers, our concern is that this legislation could preempt certain state laws including our South Dakota franchise law.
While Congress seeks uniform regulation of self-driving vehicles to avoid a state patchwork that would hamper deployment of these vehicles, Congress must also ensure that the states’ traditional role to regulate motor vehicle commerce within
its borders is preserved as applied to self-driving vehicles.
On Sept. 6, the House approved H.R. 3388, the “SELF DRIVE Act” by voice vote. Bipartisan lan-guage to clarify that Congress does not intend to preempt state vehicle licensing/franchise laws as applied to self-driving vehicles was included in the bill.
The Senate Commerce Committee must ensure that their legislation explicitly preserves state vehicle licensing and franchise laws as well. Hopefully, by the time you read this, we will have crossed this threshold without incident.
NADA will be watching to ensure state laws are protected!
Washington Conference: In September, I was once again part of the South Dakota delegation (with Jim Burgess, Dutch Van Santen, Myron Rau, and NextGen delegate Karris McKie-Kaiser) to the NADA Washington Conference. Thanks to each of them for taking time to go to DC to represent South Da-kota's dealers. I'm always proud to be part of this delegation.
We are very fortunate to have two Senators (Thune and Rounds) and a Congresswoman (Noem) who un-derstand and support small business issues. I can assure you that this is not universal. As I visit with directors from other states, they are increasingly frustrated with their representation and how Washing-ton works (or doesn't work!).
I have enjoyed my two years as NADA Legislative Affairs Chairman. The Washington Conference is the pinnacle of that committee's work. When we have 200+ dealers take to the Hill to make 350+ visits, it definitely moves the needle for the nation's dealers.
NADA has the best legislative team of ANY trade organization in Washington. It has been a true plea-sure to serve with and learn from them the past two years. I can assure all South Dakota dealers that our interests are well represented by these professionals.

Shawn Chase Ford Welcomes New OwnershipBy Kennedi Ford
After 26 years of business in Redfield, Shawn Chase Ford is welcoming new ownership and management this fall.
In the beginning of 2017, owner Shawn Chase received a call from Matt Harr of Harr Motors in Aberdeen who expressed interest in purchasing the dealership. Although he had not been planning on selling, the interest got Chase thinking.
“Unquestionably, I would have rather it been a few years down the road five, six years from now instead of now, but I just hon-estly didn’t know if I would get an opportunity like this again,” said Chase. “It was probably my single biggest fear.
We’ve had a very successful run and it’s still successful. I didn’t need to sell, but my biggest fear was ‘Will somebody want to buy this dealership someday when I do want to get out?”
When considering the sale, Chase also had the interests of his current employees and the community in mind. “I knew it would be good for the employees because they’ll [Harr Motors] not only keep the dealership going, they’ll grow it. That’s good for the employees and it’s good for the community,” said Chase.
“There used to be five car dealerships in this town at one time; now I’m it. And I want to make sure there’s a new car dealership in this town for generations to come and this will make sure that happens.”
According to Chase, the buyer was another major factor in his decision. “I’m very excited that it’s Harr’s. They’re a family owned dealership like me,” Chase said. “This is their first acquisition outside of their original dealership and so I’m happy about that. I knew that they would see things a little more the way I do when it comes to my employees and whatnot.”
What was expected to be a quick sale changed when time delays arose due to the lengthy process of approval required from Ford Motor Company. “With Ford Motor Company, they have to approve the new buyers so they do all kinds of background checks they have to have financial obligations, all these other things,” said Chase. “We figured it was going to happen in June or July but the process through getting every thing done with Ford Motor Company took a little more time than we thought.”
Conditions of the sale include a six month transition period in which Chase will be required to assist new management and the signing of a no-competition agreement. This agreement states that Chase cannot open a new dealership in South Dakota, North Dakota, or Minnesota.
Chase has had a lifelong history with dealerships, having gained experience from working with his father. “From the time I was old enough to hold a broom in my hand,; I was sweeping floors or shoveling snow or cleaning up cars or mowing grass or what-ever. So I’ve been in the car business in one form or fashion for 45 years. It’s a big part of who I am.”
Chase purchased Service Motor Company from Don Bradley in 1991 and changed the name to ‘Chase’s Service Motors’ un-til 1999, when the new dealership building was constructed and the Mercury line was dropped. The name was permanently changed to ‘Shawn Chase Ford’ at that time.
The sale of the business is bittersweet to Chase, following the passing of his father in December of 2016. “I would’ve loved nothing more than to have picked the phone up and called him to say ‘Hey, I’ve got some exciting news, tell him about it, and get his feedback too, because it was one of the biggest decisions of my life and he had already been through it 15 years ago. But it didn’t work out that way.”’
Looking forward, Chase has no other major changes planned. “We have no immediate plans to move. I’m not going to say never, but not right away.”
Then the other question I’ve been getting is ‘Well, what’re you going to do? I honestly don’t know what I’m going to do. But I am going to look for other opportunities. I don’t have to rush out and take the first job that comes along, but if I find a good oppor-tunity of either owning another business or some other kind of an occupation, it’s definitely a possibility.”
The sale will be finalized by the end of August.
Federated Insurance's "Claim of the Month"- Could it happen to you?A dealer's sales rep accompanied a customer on a test drive. When they returned to the dealership, the cus-tomer parked the vehicle, took the keys out of the ignition, and walked inside with the salesperson. The cus-tomer handed over the keys, then said he needed to go home and contemplate the purchase. The vehicle was gone the next morning. The theft investigation revealed that the customer had switched the keys with another set after the test drive. The vehicle was never recovered.

Good Reasons to Have a Drug- and Alcohol-Free Workplace Program In its simplest form, managed care describes a variety of techniques that, when properly deployed, can help support an effective risk management program. These strategies can be most effective when they concentrate on both injury prevention and post-injury techniques.
Testing May Equal Savings One effective managed care strategy is a drug-free workplace program, which, when used where appropriate, often includes pre-employment, random, or post-incident drug testing. An appropriately utilized and compliant program can help monitor and prevent drug and alcohol use. A drug-free workplace program can also offer benefits over and above its initial intent.
Direct savings may come in the form of premium credits. Some states offer work comp discounts for a certified drug-free workplace program. Insurance carriers in other states may have discretionary underwriting credits available.
Indirect savings are those realized by simply reducing the negative consequences of workplace drug and alcohol use. Intuitively, it makes sense that employees who are under the influence of drugs or alcohol are more likely to experience a workplace injury. These workers jeopardize their productivity, safety, and the safety of others. Estimates indicate more than 70 percent of illegal substance users are employed1. Few businesses are immune from this issue.
What Can a Drug/Alcohol Policy Impact? An effective drug-free workplace program can have an impact on your business in a few different ways.
Pre-employment drug testing can help sidestep the risk before you hire it into your business.
Random drug testing sends a strong message to employees that workplace substance abuse will not be tolerated. It may also help you identify and manage employees with risky behavior.
Post-incident drug testing can be a critical component of claims management. The mere presence of this type of test may result in fewer claims.
The End Result When using any of these drug testing measures, a worthwhile goal is to help eliminate negative consequences of drugs and alcohol. You’re not testing to “catch” anyone; in fact, it could be argued that the best testing program is one that catches no one. Success can be defined by the absence of these substances.
Taking appropriate measures to help reduce the number of claims could create a distinct competitive advantage, not to mention the overall positive effect on your business. A compliant and well-managed program is a technique you can use to enhance your work environment. It is important to note, however, that legal rules and restrictions may apply to policies that involve workplace drug use or testing; therefore, be sure to seek qualified legal counsel before developing and implementing a policy.

Good Reasons to Have a Drug- and Alcohol-Free Workplace Program In its simplest form, managed care describes a variety of techniques that, when properly deployed, can help support an effective risk management program. These strategies can be most effective when they concentrate on both injury prevention and post-injury techniques.
Testing May Equal Savings One effective managed care strategy is a drug-free workplace program, which, when used where appropriate, often includes pre-employment, random, or post-incident drug testing. An appropriately utilized and compliant program can help monitor and prevent drug and alcohol use. A drug-free workplace program can also offer benefits over and above its initial intent.
Direct savings may come in the form of premium credits. Some states offer work comp discounts for a certified drug-free workplace program. Insurance carriers in other states may have discretionary underwriting credits available.
Indirect savings are those realized by simply reducing the negative consequences of workplace drug and alcohol use. Intuitively, it makes sense that employees who are under the influence of drugs or alcohol are more likely to experience a workplace injury. These workers jeopardize their productivity, safety, and the safety of others. Estimates indicate more than 70 percent of illegal substance users are employed1. Few businesses are immune from this issue.
What Can a Drug/Alcohol Policy Impact? An effective drug-free workplace program can have an impact on your business in a few different ways.
Pre-employment drug testing can help sidestep the risk before you hire it into your business.
Random drug testing sends a strong message to employees that workplace substance abuse will not be tolerated. It may also help you identify and manage employees with risky behavior.
Post-incident drug testing can be a critical component of claims management. The mere presence of this type of test may result in fewer claims.
The End Result When using any of these drug testing measures, a worthwhile goal is to help eliminate negative consequences of drugs and alcohol. You’re not testing to “catch” anyone; in fact, it could be argued that the best testing program is one that catches no one. Success can be defined by the absence of these substances.
Taking appropriate measures to help reduce the number of claims could create a distinct competitive advantage, not to mention the overall positive effect on your business. A compliant and well-managed program is a technique you can use to enhance your work environment. It is important to note, however, that legal rules and restrictions may apply to policies that involve workplace drug use or testing; therefore, be sure to seek qualified legal counsel before developing and implementing a policy.

It’s something everyone should know. However, if you are over 50, smoke, have high blood pressure or cholesterol, type 1 diabetes, or are overweight, it’s imperative.
This is because these are all risk factors for peripheral vascular disease (PVD), a condition caused by narrowing or blockage in arteries that affects one out of every 200 Americans over age 50. This narrowing or blockage in the arteries is caused by a buildup of plaque inside the artery walls. PVD – also known as peripheral artery disease (PVD) – increases the risk of having a heart attack or a stroke.
PVD may involve disease in any of the blood vessels outside of the heart including the arteries, veins, or lymphatic vessels. Organs supplied by these vessels, such as the brain, and legs, may not get enough blood flow for proper function. By limiting the blood flow to these parts of the body, it can lead to damage or death of tissue in the affected areas.
In addition to the risk factors, there are some signs and symptoms that could indicate you may have PVD. The most common first symptom is leg discomfort described as painful cramping that occurs with exercise and is relieved by rest. During rest, the muscles need less blood flow, so the pain disappears. It may occur in one or both legs depending on the location of the clogged or narrowed artery.
Other symptoms of PVD may include:- Changes in the skin, including decreased skin temperature, or thin, brittle shiny skin on the legs and feet- Diminished pulses in the legs and the feet- Gangrene (dead tissue due to lack of blood flow)- Hair loss on the legs- Impotence- Non-healing wounds over pressure points, such as heels or ankles- Numbness, weakness or heaviness in muscles- Pain described as burning or aching at rest, commonly in the toes and at night while lying flat- Paleness when the legs are elevated- Reddish-blue discoloration of the extremities- Restricted mobility- Thickened, opaque toenails- Cramping, pain or tiredness in the leg or hips while walking and/or climbing stairs
Approximately half the people diagnosed with peripheral vascular disease are symptom free, which is why it’s important to under-stand your risk factors and take appropriate steps to detect any current or potential problems as early as possible.

September 14, 2017 - Ring, ring. "This is Equifax calling to verify your account information." Stop. Don’t tell them anything. They’re not from Equifax. It’s a scam. Equifax will not call you out of the blue.
That’s just one scam you might see after Equifax’s recent data breach. Other calls might try to trick you into giving your personal information. Here are some tips for recognizing and preventing phone scams and imposter scams:
Don’t give personal information. Don’t provide any personal or financial information unless you’ve initi-ated the call and it’s to a phone number you know is correct.
Don’t trust caller ID. Scammers can spoof their numbers so it looks like they are calling from a particu-lar company, even when they’re not.
If you get a robocall, hang up. Don't press 1 to speak to a live operator or any other key to take your number off the list. If you respond by pressing any number, it will probably just lead to more robocalls.
If you’ve already received a call that you think is fake, report it to the FTC.
If you gave your personal information to an imposter, it’s time to change any compromised passwords, account numbers or security questions. And if you’re concerned about identity theft, visit Identity-Theft.gov to learn how you can protect yourself.
