SpecificitemsofworktobeperformedbytheEngineeraredescribedinthefollowingtasks:

Task1:Plansandspecifications

Task1.1:ProjectKickͲoffMeetingTheEngineerwilldevelopaphasingplanandprojectschedulethattakesintoaccountconstructionfeasibility,environmentalconstraints,andtimingofobtainingenvironmentalpermits.TheEngineerwillpresenttheplantotheDistrictataKickͲoffMeeting.Theresultofthemeetingwillbeafinalscopeofworkandschedulefromdesignthroughprojectimplementation.

Task1.2:UpdatetopographicmappingTheEngineershallupdatetheexistingtopographicsurveysofportionsoftheleveesthatwereraisedbetweenthetimeoftheaerialtopographicsurveyandtheFallof2011.TheNAVD88datumwillbeusedforallsurveyactivities.Theupdatedsurveywillbeperformedinconjunction

withlocatingpropertymonumentsontheparcelstobeencumberedbyeasements,asdescribedinTask2.2.

Inadditiontocollectinglocalizedsupplementaltopographicdata,theEngineerwillupdate,wherenecessary,thetopographicdataforthebedofArroyoGrandeCreekbetweenthetoesofthelevees.Thesedatawerelastsurveyedin2004whentheaerialtopographicdatawascollected.Subsequenthighflowevents,aswellassedimentationassociatedwiththepresenceofbeaverdams,havelikelyalteredthebedtopographysignificantinsomeareas.Becauseitislikelythatsedimentationislocalized,theEngineerhasproposedaniterativeapproachtolimitthecostassociatedwithacompleteresurveyofthechannelbed.Theapproachisasfollows:

1. Locateandsurvey1/3rdofthechannelbedportions(leveetoetotoe)oftheHECͲRAScrossͲsections(totalof22outof66crossͲsections).

2. ComparethenewcrossͲsectiondatatotheoldcrossͲsectiondata.3. Identifyregionsofthebedwheresignificantaggradationhasoccurred.4. SurveyadditionalcrossͲsections,wherenecessary.Thiswasassumedtobean

additional1/3rdoftheHECͲRAScrossͲsectionsandisincludedasaSupplementalTask(TaskSͲ1.1).ThebudgetinthistaskwillonlybeutilizedifitisnecessaryandisapprovedbytheDistrictinwritinginadvanceofundertakingthework.

Followingcompletionofthesurveys,Waterwaysshallupdatecurrentbasemapwithsupplementaltopographyandrecordpropertyboundariesforuseinfinalprojectdesignandmodeling.Topographicsurveysshallprovideenoughinformationtogenerateaccuratehydraulicmodelingresultsandearthworkquantities.

Tosupportahydraulicevaluationofthemaximumfloodprotectionthatcouldbeachievedalongthenorthsideofthefloodcontrolchannel,crossͲsectiondatawillbecollectedonArroyoGrandeCreekupstreamoftheZone1/1A.TheEngineerwillworkwiththeDistricttogainaccesstothisareawiththeintentofextendingthemodelupstreamforapproximately1,200feet.Thesedatawillbeintegratedintothehydraulicmodeltoevaluatechannelcapacityupstreamofthefloodcontrolchannel.

Task1.3:GeotechnicalSurveyandReportTheGeotechnicalEngineerwillprepareahealthandsafetyplanforthefieldwork,andvisitthesitetocoordinateaccessforfieldexploration.AnencroachmentpermitwillbeobtainedfromtheDistrictforthefieldwork.Anyenvironmentalstudies,permits,ordocumentsrequiredforthefieldworkwillbeprovidedtotheGeotechnicalEngineerbytheDistrict.TheGeotechnicalEngineerwillmarkthelocationsoftheplannedexplorationsandcontactUndergroundServicesAlert(USA)toreviewthelocationsrelativetoundergroundutilities.TheGeotechnicalEngineerwillnotbe responsiblefordamagesresultingfromburiedstructuresorundergroundutilitiesthatarenotbroughttotheattentionoftheGeotechnicalEngineerandproperlymarkedatthesite.

TheGeotechnicalEngineerwillprovideaoneͲdayfieldexplorationprogramtodrillfive(5)boringsalongthenorthleveeintheproposedfloodwallareas.Fourboringswillbetodepthsofapproximately20feetbelowthetopoftheexistinglevee,andoneoftheboringsintheareaof

theproposedfloodwallbetweenHighway1andtheUPRRBridgewillbetoadepthofapproximately40feetbelowthetopoftheexistinglevee.ProposedboringlocationswillbeprovidedtotheDistrictinaFieldExplorationPlan.TheboringswillbedrilledusingatruckͲmounteddrillrigequippedwithhollowstemaugers.Waterwillbeaddedtotheaugerstohelpstabilizetheholeifneeded.Theboringsmaybedeepenedorterminatedatshallowerdepthsdependingontheconditionsencounteredduringdrilling.TheGeotechnicalEngineerwillinitiallysampletheboringsatapproximately5Ͳfootintervalsusingstandardpenetrationtest(SPT)splitspoonandmodifiedCaliforniasplitspoonsamplers.Thesampleswillbeusedtoclassifythematerialsencountered,andberetainedforsubsequentlaboratorytesting.Theboringswillbebackfilledwith2Ͳsacksandcementslurryuponthecompletionofthedrilling.

Laboratorytestswillbeperformedonselectedsamplesobtainedfromthesitetoassistincharacterizingtheclassification,permeability,compactionandstrengthoftheexistingleveeandfoundationmaterials.Theactualtypesandnumbersoftestswillbedeterminedbasedontheresultsofthefieldexplorationprogram.

TheGeotechnicalEngineerwillevaluatethepotentialforseepageandslopeinstabilityfortheproposedleveeimprovements,andevaluatetheneedformitigationrequirements.Atleast2crosssectionswillbeevaluatedalongthenorthlevee.TheseepageanalysiswillfocusonwhetherornottherearesectionsoftheleveereachwhereeithertheproposedimprovementsorfoundationsoilconditionswouldnecessitatedrainageorcutͲoffwallprovisionstomitigatethroughseepageorunderseepageofthenorthlevee.TheseanalyseswillbeevaluatedinassociationwithslopestabilityanalysesandwillconsiderthepotentialforseepagetoimpactthestabilityofthenorthleveerelativetosteadyͲstateconditionsatdesignfloodelevations,andrapiddrawdownconditionsassociatedwiththedesignfloodelevationswithinthechannel.TheGeotechnicalEngineerwillalsoprovideanalysesforthebasisofrecommendinggrading,finishedslopes,andfloodwallparameters.BasedontheresultsoftheseanalysestheGeotechnicalEngineerwillprovideopinionsandrecommendationsregarding:

x Soilandgroundwaterconditionsencountered;x Generalcondition,history,andmaterialcompositionoftheexistingleveesrelativeto

seepageandstability;x Suitabilityofonsitesoilsforuseascompactedfill;x MaterialsrequirementsforonͲsiteorimportedfillandaggregates;x Sitepreparationandgradingforfloodwallareas;x Fillplacementandcompactionrequirementsfortheleveeimprovements;x Slopestabilityandseepageconsiderationsfortheproposednorthleveeslopesand

floodwallsbasedontheseepageconditionsanalyzedandthedesignfloodevent;x Bearingpressures,minimumfoundationembedmentandwidth,lateralloadresistance,

andestimatedsettlementforfloodwalldesign;x Additionalfoundationembedmentorwidth,ifneeded,tocontrolseepagebelowthe

floodwall(s);x NeedforandestimateddepthofsheetͲpilecutoffwalltomitigateseepage;x Subsurfacedrainageforcontrolofseepagetomitigateadverseseepagethroughor

beneaththelevee(ifneeded);and

x Constructionconsiderationsfortemporaryslopes,excavation,andsubgradepreparation.

TheGeotechnicalEngineerwillprepareaGeotechnicalReportforthedesignoftheleveeimprovements.Thereportwillsummarizetheresultsoftheseepageandslopestabilityevaluationsaswellasthepreviousstudies,andincludefieldandlaboratorydatacollectedduringthecurrentandpreviousphasesofwork.Thereportwillprovidegraphicsshowingthelocationsoftheexplorations,subsurfaceprofiles,andtypicalsectionsforgradingandfloodwalldesign.Adraftcopyofthereportwillbesubmittedinelectronic(pdf)formatforreviewbytheDistrictandtheEngineer.TheGeotechnicalEngineermayrecommendthatadditionalstudiesbeperformeddependingontheresultsofthefindings.AfinaldraftofthereportwillbepreparedoncecommentsfromtheDistrictandtheEngineerhavebeenreceived.Fourcopiesandadigital(pdf)copyofthefinalreportwillbesubmitted.

Withintheproposedlevelofeffort,theGeotechnicalEngineerwillreviewtheprojectplansandspecificationsforconformancewiththerecommendationsoftheGeotechnicalReportandprovideinputtopreparationofthegeotechnicalportionsofthespecifications.Thereviewwillbesummarizedinanemailormemorandum.Alettersummarizingtheplanreviewandastatementofconformancecanbeprovided,ifrequested.

Inadditionaltotheworkdescribedabove,theGeotechnicalEngineerwillperformanoptionaltask(Task3.6),ifrequestedbytheDistrict,todrilltwo(2)additionalboringswithassociatedcoordination,laboratorytesting,seepageandstabilityanalyses,andreporting.Theadditionalboringswouldbelocatedonthesouthleveecrest,downstreamofthe22ndSt.Bridge,inthevicinityofexistingstructuresadjacenttothelevee(BejoSeeds).TheoptionalserviceswouldbeprovidedaspartoftheProposition1Eproject,andwouldbeperformedsubsequentto,and/orseparatefrom,thebasicscopeofservicesoutlinedabove.Districtauthorizationforthisworkshallbeprovidedpriortostartingthefieldwork.

Task1.4:HydraulicModeling(updatesandrevisions)TheEngineercurrentlymaintainsaHECͲRASmodelfortheprojectandhasbeenworkingwiththeDistrictoverthepastyearupdatingthemodelwithsitespecificroughnesscoefficientsandrunningarangeoffloodingscenariosfortheDistrict.Forthistask,theEngineerwillcontinuetoutilizeandupdatetheHECͲRASmodelthroughallphasesofthedesignprocesstoensurethatthefloodcontrolandfreeboardobjectivesarebeingmet.

ItisalsothedesireoftheDistricttoprotectthenorthleveefromfloodsthatsignificantlyexceedtheleveloffloodprotectionprovidedunderAlternative3a.Thehydraulicmodelwillbeacriticaltoolindeterminingtheoptimumleveeelevationonthenorthsidetoachievethisobjective.ThefirststepintheprocesswillbetoevaluatethecapacityofArroyoGrandeCreekupstreamofthefloodcontrolchannel.OncethisisdeterminedtheEngineerwillusethehydraulicmodeltoassistinthedesignofappropriateactionsonthenorthleveetoprovidetheassociatedleveloffloodprotection.ToconductthisanalysisitmaybenecessarytorunanunsteadymodeltodeterminethevolumeofwaterthatwouldovertopthesouthleveeandreͲenterthefloodcontrolchannelnearthedownstreamendoftheprojectarea.Theresultsofthisanalysiswillassistinthedesigntaskandidentifyoptionstomeetthedefinedfloodcontrol

objectives.DesignoptionsmayincludefloodwallsorraisingtheleveesandconstructingretainingwallstolimitimpactstopropertiesoutsideoftheexistingDistricteasements.

Task1.5:50%PS&ETheEngineershallprepare50%leveldrawings,technicalspecificationsandcostestimate.The50%drawingsshallbesufficientlyaccurateandcompletetodetermineprojectlayout,impacts,opportunities,constraintsandquantities.The50%costestimateshallbeinaformatthatrepresentsthefinalbidform,withmeasurementandpaymentspecifiedforindividualworkitems.The50%specificationsshall,ataminimum,consistofatableofcontentsoftheanticipatedtechnicalspecifications.

Task1.6:95%PS&ETheEngineershallprepare95%leveldrawings,technicalspecificationsandcostestimate.The95%drawingsshallbeclosetocompletion,includingdetails,andshallincorporateDistrictcommentsmadeonthe50%drawings.The95%costestimateshallbeinaformatthatrepresentsthebiditemsandshallaccuratelyreflectthedesign.Adescriptionofallworkincludedineachpayitemshallbeincludedinthecostestimate.The95%specificationsshallincludealltechnicalspecificationsfortheproject.AllPS&Eitemsatthe95%levelofcompletionshallbeformattedforuseinthepublicbiddingprocessandinaccordancewiththeCountyofSanLuisObispo’sbiddingproceduresandformats.

The95%leveldrawingsandspecificationsshallincorporateenvironmentalmitigationmeasures,asrequiredbytheEnvironmentalImpactReport,WMPandanyregulatoryagencypermitsthathavebeenobtainedatthetimeof95%designreview.RegulatorypermitsfromCDFG,ACOE,RWQCB,andthelocalCostalDevelopmentPermitareanticipatedtobeobtainedbyDistrictstaffbyDecemberof2012.EncroachmentpermitsforworkwithintheStateHighwaysystem(Hwy1Bridge)andUPRRwillberequiredandobtainedbytheDistrictandthedesigndrawingsshallincorporateanyrevisionsnecessarytomeetUPRRencroachmentandCaltransHighwayDesignManualcriteriaand/orencroachmentrequirementsasrequestedbytheDistrict.

TheDistrictwillcoordinatewiththeutilitycompaniestodetermineandidentifypotentialconflicts.TheDistrictwillalsomeetwithutilitycompaniesandverifylocationofutilityconflictsinthefieldbypotholingandsurveyingutilitiesanticipatedtobeinconflictwiththeproposedprojectaftertheDistrictreceives50%designdrawings.ThedataprovidedbytheDistrictshallbeincorporatedinthe95%PS&Eset.TheDistrictwillprovidetheutilitylocationinformationtotheEngineerforpurposesofcompletingthefinalconstructionplans.

Task1.8:PhasingRevisions(OptionalTask)IntheeventthatconstructionoftheleveeraiseportionoftheprojectoccursovermorethanoneseasonandtheDistrictdecidestoseparatetheworkintomorethanonebid,theEngineerwillseparatethefinalconstructiondrawingsintotwoseparatedocumentsthatrepresenttheworkbeingcompletedundereachphase.ThebudgetinthistaskwillonlybeutilizedifitisnecessaryandisapprovedbytheDistrictinwritinginadvanceofundertakingthework.

Task1.9:HydraulicStudy/DesignReportTheEngineershallprepareadesignreportsummarizingtheresultsofthehydraulicanalysisaswellasthedesignapproachanddesignelements.Basedonourpastexperience,preparingareporttoaccompanythedesignprovidesanimportantcommunicationtoolwhendiscussingtheprojectwithaclientaswellasregulatoryagencystaff.TheEngineerwillsubmitaDraftDesignReportwiththesubmittalofthe50%engineeringdrawingsforreview.Followingcomment,theDesignReportwillberevisedandaFinalwillbesubmitted,inPDFformat,withthe95%submittal.

Task2:RightofWayAcquisitionDocumentsTheobjectiveofthistaskistodetermineandidentifylandareaandtypeofpropertyrightsneededfortheProject.TheEngineershallpreparefinaleasementdocumentsforacquiringtherequiredpropertyfortheproposedprojectwhichincludespermanenteasementfiguresandlegaldescriptionsfornecessarylandacquisitions,aswellastemporaryconstructioneasementfiguresforeachimpactedparcel.

Becauselandacquisitionnegotiationscantakealongperiodoftime,thisisacriticalpathtaskandshallbethefirstorderofworkonceenoughofthedesigniscompleted/knowntoeffectivelymoveforwardandcompletethistask.Drafteasementdocumentsshallbesubmittednolaterthanthe50%designsubmittal.FinaleasementdocumentswilladdressallDistrictcomments.

Task2.1:ResearchRecordPropertyBoundariesThistaskcoverstimespentresearchingrecordpropertyboundaryinformationfortheexistingArroyoGrandeCreekchanneleasementandtheestimatednine(9)parcelstobeencumberedbytemporaryconstructionandpermanentleveeeasements,includingrecordmapsandvestingdeeds.Recordpropertyboundarywillbelaidoutelectronically.

Task2.2:LocatePropertyMonumentationTheEngineershallfieldlocatesufficientpropertymonumentationtoaccuratelypositionrecordboundarieswithrespecttotheAlternative3aleveedesign.ThiseffortwillbecoordinatedwiththesupplementaltopographicsurveyworkdiscussedinTask1.2.Thiswillnotconstituteafullyresolvedboundarysurvey.

Task2.3:PrepareLegalDescriptionsandPlatMapsPreparemetesandboundslegaldescriptionsforeight(8)temporaryconstructioneasementsandone(1)permanentleveeeasement.Preparenine(9)platmapstoaccompanylegaldescriptions.

Task3:TechnicalMeetingswithDistrictThisisamultiͲfacetedprojectwithmanystakeholdersandenvironmentalconditions.Inordertoensurecoordinationduringthedesignphase,theEngineerwillattenduptofive(5)meetingswiththeDistrictandothernecessarystakeholderstoreviewthedesignconceptsanddetails,astheyaredeveloped.TheDistrictwillarrangethemeetingandthestaffassignedtothemeetingwillbeagreeduponbytheDistrictpriortoscheduling.

Atleastonemeetingshallbeattheprojectsite.Ataminimum,meetingsshouldbemadeatprojectkickͲoff,at50%designsubmittal,andatthe95%designsubmittal.TheremainingmeetingsshallbereservedforworkingoutanydesignissuesthatcomeupandthatarenotabletobeaddressedatthekickͲoff,50%design,or95%designstages.

Task4:BidPeriodAssistanceThistaskislimitedtoprovidingassistancetotheDistrictfollowingcompletionoftheFinalDesignDrawingsandpriortoselectionofthecontractor.

Withrespecttotheplansandtechnicalspecifications,theEngineerwillassisttheDistrictduringthebidperiodwithissuessuchasansweringcontractorquestions,interpretingbiddocumentsforprospectivebidders,andpreparinganynecessaryaddenda.TheDistrictwillberesponsibleforpreparingthefinalbidpackage,includingtheGeneralProvisions,finalbidformsandAgreement.

WorkonthistaskbytheEngineershallnotbeundertakenwithoutwrittendirectionfromtheDistrict.

Task5:ConstructionSupportServicesThistaskitemisprimarilyfocusedonprovidingfieldinspectionservicesduringtheconstructionphaseofthesedimentandvegetationmanagementportionoftheproject,aswellasinstallationoflogstructures.TheDistrictisnotrequestingfullresidentengineerandcontractadministrationservices.ConstructionphasesupportservicesduringtheleveeraiseandspillwaymitigationconstructionwillberequiredonlyasnecessaryandrequestedbytheDistrict.Serviceswillbeperformedoveratwotothreeyearphasedconstructionwindow,dependingontheresultsofthefinalphasingplan.Requestedservicesmayinclude,butarenotlimitedtothefollowing:

x Attendkeyconstructionmeetings;x Prepareanynecessaryplanrevisionsduetounforeseencircumstancesencountered

duringtheconstruction;x ProvidetechnicalassistanceinansweringcontractorandDistrictquestions;x Fieldobservation,asrequestedbytheDistrict;x Staking,andx PreparationofrecordͲdrawings.

WorkonthistaskbytheEngineershallnotbeundertakenwithoutwrittendirectionfromtheDistrict.

Task5.1:MeetingsForthistask,theEngineerwillbeavailabletoattendthreeconstructionͲrelatedmeetingsthatoccuroutsideofthetimethattheEngineerisonsiteforconstructionobservationservices.ThosemeetingsmayincludeapreͲconstructionmeeting,interimmeetingswiththeDistrictand/orregulatoryagencystafftoreviewsiteconditionsandprogress,orfinalinspectionpriortothecontractorremovingequipmentfromthesite.

Task5.2:ReviewSubmittals,IssueRFI’s,IssueAddendaThistaskrelatestoreviewanddesignservicesthatoccurfollowingselectionofthecontractorandduringprojectconstruction.TheEngineershallbeavailabletoreviewcontractorsubmittals,issueRFI’s,orissueaddendatothedesign,asnecessary.ThebudgetassumptionisbasedonpastexperiencewithsimilarprojectsandassumestheEngineerwillissueaddendaforuptofive(5)revisions.TheEngineershallbeavailableonatimeandmaterialsbasisforservicesoutsidethisbudgetanddirectlyrequestedbytheDistrict.

Task5.3:TechnicalAssistanceandObservationForthistaskitisassumedthatmostoftheeffortoftheEngineerwilloccurduringsedimentremovalandconstructionoftheinstreamenhancements(i.e.logstructures).Thebudgetassumesthatconstructionwilloccurovera2monthperiodandthattheEngineerwillbeonsite

anaverageof1.5daysperweekoverthatdurationtohelpensurethattheworkisprogressinginaccordancewiththeintentoftheconstructiondocuments.Ifworkisextendedoradditionalsitevisitsarerequired,theEngineershallperformthismonitoringonatimeandmaterialsbasisattherequestoftheDistrict.Dailyphotologsandsitejournalsshallbepreparedtodocumentprogressinaccordancewithgrantagreementconditionsandverifyrequestsforpayment.

Hubandlathwillbesettostakethetemporaryconstructioneasementsonthelandsideofthelevee.Offsetstakeswillbeprovidedapproximatelyevery200feetalonglineͲofͲsightthroughouttheprojectreach.AlimitofdisturbancestakingdiagramwillbeprovidedtotheDistrictandContractor.(Approximately170stakes)

Task5.5–ProvideRoughGradeStakesHubandlathwillbesettostakeleveeandfloodwallalignmentsforroughgrading.Offsetstakeswillbeprovidedapproximatelyevery100feet,atgradebreaksandanglepoints.Offsetstakeswillbesetforboththelandandwatersidesofthelevee.Cutsandfillswillbegiventotopsandtoesofleveesandfloodwalls.AroughgradestakingdiagramwillbeprovidedtotheClientandContractor.(Approximately400stakes)

Task5.7ͲMonumentCrossͲSectionMonitoringLocationsandEstablishBaselineDataPermanentcrossͲsectionlocationswillbeestablishedandmonumentedalongtheprojectreachpertheinitialmonitoringapproachoutlinedintheWaterwayManagementProgram.Thistaskisintendedtoprovidethenecessaryinformationfordevelopmentoftherecorddrawings(seeTask5.8)aswellassetuptheinitialcrossͲsectionmonitoringsitestocomplywithgrantandregulatoryagencymonitoringrequirementsestablishedfortheproject.

CrossͲsectionswillbeestablishedevery500feetalongthechannelandattheupstreamanddownstreamsidesofeachofthebridges.Theendsofeachcrosssectionwillbemonumentedwitha2Ͳfootlong,¾”diameterironpipedrivenflushwiththegroundandcappedwithaplasticplug.Themonumentswillbeflaggedandidentifiedwitha“Carsonite”orequivalentfiberglassmarker.Datacollectedwillincludechannelgeometry,channelsubstrate,andhydraulicroughnessparametersofvegetation.(Approximately50crosssections)

Task5.8–PostͲconstructionRecordDrawingsPostͲconstructionrecorddrawingswillbecompiledtodocumentasͲbuiltdeviationsfromtheconstructionasprovidedbytheContractortotheEngineer.TherecorddrawingswillalsoincorporatethecrossͲsectiondatacollectedinTask5.7above.

1 Thisscopeitemandbudgetisbeingpreparedpriortocompletionoffinaldesigndrawingsandisbasedonassumedfinalprojectlayoutanddetails.TheEngineerwillprovideonesetofstakesfortaskitems5.3Ͳ5.5.Replacementofstakesthatarelostordestroyedduringconstructionactivitiesisnotincludedinthisbudget and will incur an additional cost. This preliminary scope and budget should be reviewed andupdatedafterfinaldesigndrawingsareprepared.

Task6:PermitSupportTheEngineerwillbeavailabletoprovidepermitͲrelatedsupportservices,attherequestoftheDistrict.Ourbudgetassumesourrolewillbelimitedtoprovidingcutandfillquantities,estimatesofdisturbanceareas,reviewoftheprojectdescription,reviewoftherequiredconstructionequipment,reviewoftheconstructionschedule,andrespondingtodesignͲrelatedquestionsfrompermittingagencies.AdditionalassistancewithpermitswillbeprovidedonaTimeandMaterialbasisatthehourlyratesspecifiedinExhibitB.

Task7:ProjectAdministrationThistaskcoversprojectcoordinationbetweentheEngineer,theDistrict,andotherProjectTeammembers.Inaddition,theEngineerwillprepareandsubmitmonthlyupdatestotheDistrictontheprogressoftheproject,whichwillbesubmittedwithourmonthlyinvoice.

PROPOSEDCOSTAllworkshallbeperformedonatimeandmaterialsbasis.RefertoattachedExhibitBforadetailedbreakdownofourestimatescostsbytaskandfeeschedulelistingprevailingrates.

ADDITIONALSERVICESTheEngineershallbeavailableforadditionalservicesonatimeandmaterialsbasis,attheprevailingrateslistedinExhibitB.Additionalservicesaredefinedasthosethatarenotspecificallyidentifiedunderthescopeofproposedservicesorthosethatarerequiredasaresultofunforeseencircumstancesthatariseduringthepermittingprocess.

ASSUMPTIONSANDEXCLUSIONS1. The Engineer and its Subcontractors shall not be held responsible for the accuracy of

existing mapping or data collection performed by others and made available by theDistrict. If existing products made available by others are found to be inaccurate orincomplete,duringtheprocessofourwork,ourbudget,scope,and/orscheduleshallbeadjusted to account for unexpected expenses or delays incurred as a result of thesedeficiencies.

2. A complete boundary survey of the project site, if required, shall be supplied by theClient,atnocosttotheEngineer,inACADformat.

3. The District is aware that differences may exist between the electronic files deliveredand the printed hard copy construction documents. In the event of a conflict betweenthe signed construction documents prepared by the Engineer and electronic files, thesignedandstampedorsealedhardcopyconstructiondocumentsshallgovern.

4. After the Districts acceptance of the preliminary drawings, should new information,changed conditions, agency/public comments on the preliminary drawings, or otherfactorsrequireadditionalmapping,datacollection,graphicmodifications,orconceptualchanges,thebudgetmayneedtobeamendedtocovertheseunanticipatedcosts.

5. The Districtshallbe responsiblefor obtainingall necessaryeasementsfor bothtemporary constructionͲrelated access and for permanent access and parking, whererequired.

6. All permitting shall be handled by the District. The Engineer shall be available forpermittingassistanceonatimeandmaterialsbasis,atthefirm’sprevailinghourlyrates.If permitting agencies request submittal of design reports, detailed hydraulic modelingor calculations, beyond what is deemed by the Engineer to be necessary to completethedesign,thisworkshallbeconsideredextra,unlessspecificallyoutlinedinthescopeofservices.

7. Where the Engineer’s scope includes preparation of specifications, the Engineer willonlyberesponsibleforpreparationoftechnicalspecifications.TheDistrictshallpreparegeneralandfrontendprovisionsfortheproject,ifrequired.

8. Costshavebeenallocatedtoindividualtaskstodeterminethe totalestimatedbudget.TheEngineermayreallocatecostsamongtasks,asneeded,aslongasthetotalpriceisnotexceededforthescopeofworkproposed.CostreallocationshallnotbeundertakenwithoutpreviouswrittenauthorizationfromtheDistrict.

9. IftheEngineer,pursuanttothisagreement,producesdrawings,specifications,orotherdocuments and/or performs field services, and such drawings, specifications, or other

documents and/or field services are required by any governmental agency, and suchgovernmentalagencychangesits ordinances,codes, policies,proceduresorrequirements after the date of this agreement, any additional office or field servicestherebyrequiredshallbepaidforbyDistrictasextraservices.

10.The Engineer shall notbe held responsible for the performance of other project teammemberscontracteddirectlybytheDistrict.TheEngineer’sfeesshallnotbewithheldasaresultofunacceptableperformanceonthepartofothers.

11.In applying for governmental permits or approvals, the Engineer’s assistance shall notconstitute a representation,warranty or guarantee that such permits or approvals willbeacteduponfavorablybyanygovernmentalagency.

12.Design services performed pursuant to this agreement are based upon field and otherconditions existing at the time these services were performed. The District furtheracknowledgesthat field and other conditionsmay changeby the time projectconstruction occurs and clarification, adjustments, modifications and other changesshallbepaidforbytheDistrictasextraservicesinaccordancewiththeagreement.

13.Theconstructioncontractorandconstructionsubcontractorswillberequiredtoassumesoleandcompleteresponsibilityforjobsiteconditionsduringthecourseofconstructionof the project, including safety of all persons and property, and that this requirementshall apply continuously and not be limited to normal working hours. Neither theprofessionalactivitiesoftheEngineernorthepresenceoftheEngineer’semployeesorsubconsultantsataconstructionsiteshallrelievethecontractoranditsubcontractorsof their responsibilitiesincluding,not limitedto, constructionmeans,methods,sequence,techniquesor proceduresnecessaryfor performing,superintendingorcoordinating all portions of the work of construction in accordance with the contractdocumentsandapplicablehealthorsafetyrequirementsofanyregulatoryagencyorofstatelaw.

14.TheEngineershallhavenoresponsibilityforthediscovery,presence,handling,removalor disposal of hazardous or toxic materials or substances in any form at Project sites,including but not limited to, asbestos, asbestos products or polychlorinated biphenyl(PCB) except for such hazardous or toxic materialsor substances introduced on to theproject site by the Engineer or any damage or injuries resulting from the Engineer’snegligence.

15.TheDistrictshallinformtheEngineerofanyhazardousortoxicmaterialsorsubstancesknown by the Distirct to exist at a Project site on which the Engineeris providingservices.

16.IfduringtheperformanceofServicesonaproject,theEngineerdiscoverstheexistenceof unanticipated toxic or hazardous materials or substances which are unsafe andpresent a risk to the Engineer or the Engineer’s employees, the Engineer may, and

without liability therefore, suspend further Services on the project and shall notify theDistrictoftheEngineer’sdecisionandthereasonforsuspensionofServices.

17.The Engineer is not responsible for: continuous inspection or supervision, constructionmeansand methods,projectsite safety,or contractor’sfailureto perform. TheEngineerisnotauthorizedtostoptheworkoftheContractor.
