The Government of India being concerned about the difficulties faced by such working women, introduced a scheme in 1972-73 of grant-in- aid for construction of new/ expansion of existing buildings for providing hostel facilities to working women in cities, smaller towns and also in rural areas where employment opportunities for women exist. Based on an evaluation of the existing scheme and suggestions received from the Standing Committee of Parliament on Empowerment of Women, the scheme has been revised to promote availability of safe and conveniently located accommodation for working women who need to live away from their families due to professional commitments.

1. Introduction

With the progressive change in the socio-economic fabric of the country more andmore women are leaving their homes in search of employment in big cities as well as urbanand rural industrial clusters. One of the main difficulties faced by such women is lack of safeand conveniently located accommodation. The Government of India being concerned aboutthe difficulties faced by such working women, introduced a scheme in 1972-73 of grant-in-aid for construction of new/ expansion of existing buildings for providing hostel facilities toworking women in cities, smaller towns and also in rural areas where employmentopportunities for women exist. Based on an evaluation of the existing scheme andsuggestions received from the Standing Committee of Parliament on Empowerment ofWomen, the scheme has been revised to promote availability of safe and conveniently locatedaccommodation for working women who need to live away from their families due toprofessional commitments.

2. Objectives

The objective of the scheme is to promote availability of safe and convenientlylocated accommodation for working women, with day care facility for their children,wherever possible, in urban, semi urban, or even rural areas where employment opportunityfor women exist. To achieve this objective, the scheme will assist projects for construction ofnew hostel buildings, expansion of existing hostel buildings and hostel buildings in rentedpremises.made available to all working women without any distinction with respect to caste, religion,marital status etc., subject to norms prescribed under the scheme. While the projects assistedunder this scheme are meant for working women, women under training for job may also beaccommodated in such hostels subject to the condition that taken together, such traineesshould not occupy more than 30% of the total capacity the hostel and they may beaccommodated in the hostels only when adequate numbers of working women are notavailable. Children of working women, up to the age of 18 years for girls and up to the age of5 years for boys may be accommodated in such hostel with their mothers.

3. Beneficiaries

Following categories of working women and their will be covered under this Scheme:

(i) Working women, who may be single, widowed, divorced, separated, marriedbut whose husband or immediate family does not reside in the same city/area.Particular preference may be given to women from disadvantaged sections ofthe society. There should be also provision for reservation of seats forphysically challenged beneficiaries.

(ii) Women who are under training for job provided the total training period doesnot exceed one year. This is only on the condition that there is vacancyavailable after accommodating working women. The number of women undertraining for job should not exceed 30% of the total capacity.

(iii) Girls up to the age of 18 years and boys up to the age of 5 years,accompanying working mothers will be provided accommodation, with theirmothers. Working mothers may also avail of the services of the Day CareCentre, as provided under the scheme.

4. Income Limit, Rent and Period of Stay

Working Women will be entitled to hostel facilities provided their gross income doesnot exceed Rs. 30,000/- consolidated (gross) per month in metropolitan cities, or Rs 25,000/-consolidated (gross) per month, in any other place. When the income of any working womanalready residing in a hostel exceeds the prescribed limits, she will be required to vacate thehostel within a period of two months of crossing the income ceiling.

The implementing organisation will charge from the inmateshostel reasonable rent not exceeding 15% of their total emoluments/gross salary in the case ofsingle bed rooms, 10% in case of the double bed rooms and 7 ½ % in the case of thedormitories. Fees charged from the children in the Day Care Centre should not be more than5% of the emoluments of their mother, or the actual expenditure whichever is less. The rentfor women under training for job shall not exceed the rent to be charged from the for working

women. The rent for such trainees may be charged from the institution/organizationsponsoring the training or from the woman herself. The rent does not include use of the messand other facilities like washing of clothes and ironing etc.

As far as practicable, women with children will be accommodated in single/doublebed rooms instead of dormitory.

No working woman will be allowed to stay in a hostel, assisted under this scheme formore than three years. In exceptional circumstances, the DistrictCommittee (DWWC) may, for reasons to be recorded in writing, allow working women tostay in a hostel, beyond the three year period, subject to the condition that the period ofextension, shall not exceed six months at one time, and that the total stay of the woman, withextensions, shall not exceed five years.

5. Financial Assistance Components

(a) 75% of the cost of construction of the building of working women hostel only onpublic land.

(b) Financial assistance for hostels to be run in rented premises. Amount of rentshall be as assessed by the State PWD/District Collector. The rent received from the inmatesshall be utilized for maintenance, house-keeping, security service, office establishment,expenditure towards water and electricity charges and any other support services other thanmess.

(c) One-time non-recurring grant at the rate of Rs.7500/- per inmate at the time ofcommencement of the hostel for purchase of furniture (including bed, table, chair, almirahetc.) and furnishings.

(d) Grant of up to Rs.5.00 lakh for the purposes of maintenance and repair of hostelbuilding constructed under the scheme, subject to the satisfactory performance of the hostelfor more than 5 years immediately preceding the application for such grant.

(e) A matching grant (50:50) for building construction may be offered to thecorporate houses under the Scheme on public land only. For the component of corporatepartnership, a Tripartite MoU indicating financial contribution of each partner along withresponsibilities of monitoring and periodic evaluation of the scheme shall be signed amongthe Govt. of India, State Govt. and the partner organisation as and when such proposal isreceived. A model tripartite MoU will be developed in due course in this regard .

(f) The inter-se allocation for plan fund under this scheme shall be in the ratio of87% for construction grant including furnishing, 10% for rented accommodation, 2.50%maintenance and 0.5%evaluation of scheme. However, Ministry of WCD shall havediscretion to change inter-se allocation, if required.

6. Additional grant on account of escalation in construction cost

In case, there is a time gap of more than 6 (six) months from the date of applicationand the date of approval, an additional grant towards the construction cost may be sanctionedby the Project Sanctioning Committee, on account of cost escalation. During the execution of

the construction work, an additional grant towards the construction cost over and above theoriginally approved grant on account of cost escalation may also be considered by the PSC.However, this grant will be sanctioned provided there is no delay in the progress of theconstruction work on the part of the Implementing Agency, and no change in the architecturalplans of the hostel building, as per the norms prescribed and approved under the scheme. Theadditional grant shall be considered on the basis of PWD certified rates and shall, in no case,be in excess of the applicable PAR of CPWD for the area of construction.

7. Agencies/Organizations which can apply for assistance under the Scheme and theirEligibility Criteria

The following agencies/organisations can apply assistance under the scheme:

(i) State Government agencies including Women Development Corporations, WomenFinance Corporations etc.

(ii) Urban Municipal Bodies including Cantonment Boards

(iii) Panchayati Raj Institutions

(iv) SHGs (Self Help Groups)

(v) Recognized Colleges/Universities

(vi) Civil Society Organisations having proven track record of working in the fields ofwomen's welfare/social welfare/ women's education subject to the condition that suchorganization is registered under the Indian Societies Registration Act, 1860 or any relevantState Act; Public Trusts registered under any law for the time being in force, and Co-operative institutions meeting the following criteria:

(a) It should be either recognized by the State/UT administration under any existingscheme/law or should be well known with the experience of working in the field for at least 3years, and its work should be reported to be satisfactory by the State Government/UnionTerritory Administration concerned,

(b) It should have a properly constituted Managing Body with its powers, duties andresponsibilities clearly defined and laid down,

(c) It should ordinarily have been engaged in the field of women's welfare/socialwelfare/women's education for a minimum period of three years prior to the request for grant-in-aid under the scheme,

(d) Its financial position should be sound and it should have facilities, resources,personnel and experience to undertake the management of such a project,

(e) It should run the hostel and the Day-care Centre for pre-school children on a no-profit basis.

(vii) Corporate or associations like CII, ASSOCHAM, FICCI etc., subject to the conditionthat the other working women are also provided accommodation in the hostel under thisscheme in addition to their female employees.

(viii) Ministry of Women and Child Development and the State Governments may constructhostels on their own, and lease them to organization(s) having experience for such period(s)as deemed sufficient, for managing its operations as per norms of the scheme. State Govt.may seek assistance as per the prescribed norms of the scheme.

8. Guidelines for Implementing Agencies

(i) Application for assistance under the scheme should be made keeping in view the numberof expected beneficiaries in the area.

(ii) Meaning of public land for the purpose of scheme is the land owned byCentral/State/Local Government which would also include public land obtained by anyorganisation from Government or Government organization on lease hold basis for at least aperiod of 30 years and on renewable terms for construction of working women hostel.

(iii) Before making an application for construction of hostel building on public land, it shouldbe ensured that the applicant organization has available public land which is suitably locatedfor a Working Women's Hostel. The State/UT government should certify that the land for theproposed hostel is suitably located and demand for the same exits as mentioned in theapplication.

(iv) Financial assistance for hostels to be run in rented premises shall be provided under thescheme, subject to the condition that such premises are not constructed with Governmentalassistance. The quantum of assistance sought as rent shall be approved, subject to thecertification of the State PWD or the District Collector. The rent received from the inmatesshall be utilized for maintenance, house-keeping, security service, office establishment,expenditure towards water and electricity charges and any other support services other thanmess. All such projects shall be approved first for a period of two years at a time, theircontinuation will be approved for period of two years every time subject to evaluation of theirperformance and functioning.

(v) The organisations shall have to execute a bond in the approved form for an amount to thegovernment grant in every time of release of grant securing to the government of India for therecovery of the amount paid as grant with the penal interest in the event of the granteefailing to comply with the conditions or committing breach of the conditions of the bond, thesignatories to the bond shall be jointly and severally liable to refund to the President of India,the whole or a part amount of the grant with interest at ten percent per annum thereon or thesum specified under the bond.

(vi) The applicant should be clear that the hostel is meant for use by working women whoseincome does not exceed Rs. 30,000/- consolidated (gross) per month in metropolitan cities orRs. 25,000/- consolidated (gross) per month in any other city/ town /place. Women fromdisadvantaged sections of the society falling within this category should be given preference.

(vii) Maximum economy in the layout and building specifications should be exercised whilepreparing the plan. Building Pl

prepared as per the norms prescribed under the Scheme and certified by a registered architect,in case, it is not approved by the local authority. Once the project is approved by the PSC forthe proposed building plan, the organisation should have to submit the same building planbefore the release of First installment approved by the local authority within six months ofthe approval of the project alongwith the building permission certificate stating that itsconstruction of the hostel building has been permitted. Plan & Estimate received after sixmonth of its approval by PSC may require fresh approval of the Committee.

(viii) The rates of various items/services for construction to be adopted in the detailedstructural /financial estimates shall not be in excess of the schedule of rates of the PWD ofthe State concerned and a certificate to that effect shall be furnished by the State PWD or anyother authority authorized/prescribed by the State for such purpose.

(ix) Normally, once the proposal is sanctioned, the hostel building shall be constructed inaccordance with the plan approved by the Ministry (PSC), and no change in the plan shall bemade. The organization should therefore fully assure itself about the building plan beforesubmitting proposal to the Ministry. However, in unavoidable circumstances, if the change of thebuilding plan is necessary the same by giving justified reason for changes of building plan properlycertified by the State PWD may be forwarded to the Ministry for consideration of the PSC. In case thePSC is not satisfied with the reasons for the change of plan, the Ministry may withdraw the projectfrom the organization and ask it to refund of grant with interest.

(x) The applicant must keep in view that the hostel and Day-Care-Centre under the Schemehave to be run on a no-profit basis.

(xi) In the event of any violation or breach of any provision of the scheme or theimplementing agency/hostel ceases to exist at any time, all assets created out of Governmentgrant shall revert to the Government of India or the amount involved would be recovered asarrears of land revenue from the implementing agency in case of hostels constructed onpublic land or under the relevant Rent Control Act in case of other hostels, or under theIndian Penal Code, as may be applicable.

(xii) In addition to this, in case of any violation or breach of any provisions of the scheme bythe civil society groups/public trusts/cooperatives/corporate bodies, the StateGovernment/District Committee may also initiate criminal proceedings bylodging an FIR against the defaulting implementing agency, and take strict legal action inorder to recover the grant with a penal rate of interest as agreed in the bond furnished beforethe release of grant.

(xiii) In case, the implementing agency misutilizes the financial assistance or use the hostelbuilding for any other purpose the Government of India through the Ministry or StateDepartments will be entitled to take over the hostel building and/or assets created by the grantprovided under the Scheme.

(xiv) The grantee organization/agency/individual shall, on its application being sanctionedunder this scheme, furnish a bond in the approved form, to the effect that the hostel for whichassistance is being provided, shall not be sold or leased out or used for any other purpose than

(xvi) In case the hostel building is proposed to be sold or leased out to any other

Hostel under this scheme, prior written approval of the Ministry shall be obtained before suchchange in ownership/title/possession.

(xvii) Construction of the hostel building shall be completed as soon as possible and in anycase, not later than 24 months, from the date of receipt of the first installment of grant-in-aidunless extension is granted by the Ministry of Women & Child Development.

(xviii) Competitive rates should be obtained before construction work is entrusted to anyindividual or body.

(xix) An additional grant on the ground of cost escalation for construction of hostel buildingunder Clause 8 shall only be considered on condition that there is no delay in the progress ofthe construction work and no change in the architectural plans of the hostel building, as perthe norms prescribed and approved under this scheme. In no case, shall the additional grantsought exceed the CPWD approved rates.

(xx) If a voluntary organization/institution has already received or is expected to receive agrant from some other official sources including such bodies as the Central Social WelfareBoard etc. as are mainly financed by the Govt., the assessment of the Central grant willnormally be made after taking into account the grant received from such official sources.

(xxi) The implementing agency shall prominently display on the building, the name of thehostel and the endorsement "Assisted by the Ministry of Women and Child Development,

(xxii) The implementing agency shall prominently display on the Notice Board and on itsapplication forms the conditions of admission in the hostel.

(xxiii) The hostel shall be open to working women of all categories without anydiscrimination on the grounds of religion, caste, race, place of birth or language. Womenunder training for job will also be entitled to stay in the hostel but preference will be given tothe working women.

(xxv) Formal rules and regulations for admission of beneficiaries to the hostel, admission ofchildren to the day-care-centre, and for the hostel administration detailing the form ofapplication, procedure, rent and other charges etc. should be clearly laid down by theimplementing agency.

(xxvi) The accounts of the hostel shall be maintained properly and separately and submittedas and when required. They shall always be open to check by an officer of the Central orState Government deputed for the purpose. The account shall be open to a test check by theComptroller and Auditor General of India at his discretion.

(xxvii) The implementing agency shall maintain record of all assets acquired wholly orsubstantially out of Government Grant. Such assets shall not be disposed of or encumbered orutilized for purposes other than those for which grant was given without prior sanction of theGovernment of India. In case the organisation/institution/agency ceases to exist at any time,

after sanction and during implementation of the project under the Scheme, such propertiesshall revert to the Government of India.

(xxviii) Any unspent portion of the grant shall be refunded to the Government of India atonce.

(xxix) The implementing agency shall ensure that the hostel is open for inspection by anofficer of the State PWD or of the CPWD or any other officers/agencies/persons designatedfor the purpose by the Central or State Government both during the period of construction aswell as after the construction is completed. It shall be the duty of the head of theimplementing agency to carried out instruction, if any, which may be issued in this behalf bythe Central Government or the State Government as the case may be.

(xxx) Inspection of the hostel premises shall also be made by the DWWC, as and when it isfelt necessary.

(xxxii) The implementing agency, through the hostel staff, should encourage group activitiesfor the residents and attempt to provide guidance to them as and when needed.

The Day care centre should be clean and well-ventilated. Adequate and safe play areaoutside the centre, with some play and reading materials for the children;Medical first aid, and arrangements to reach a doctor/medical practitioner in case ofneed/emergency;Attendance registers of the inmates and contact details of the mothers of the children

9. Procedure for Submission of Applications

(a) First time, application in the prescribed form complete in all respect and dulyapproved by the Committee, should be submitted to the Ministryof Women and Child Development, Government of India, Shastri Bhavan, New Delhithrough the concerned State Level Empowered Committee(SLEC).

(b) Each application for construction of hostel on public land should be accompanied bythe following documents:

(i) Prospectus of the agency/association/voluntary organization/institution alongwith abrief description of its objects and activities;

(ii) Constitution of the agency/association/organization/Institution details ofManagement Committee giving names of its members and their PAN Card Details;

(iii) Copy of the Annual Reports for the last three years;

(iv) Audited accounts of the organization including auditors report, receipt & paymentstatement, income & expenditure statement and balance sheet for the last three years certifiedby Govt. auditors/chartered accountant;

(v) Detailed item-wise estimate of the cost of construction of hostel building certifiedby PWD/any other competent authority/certified by a registered architect and the sourcesfrom which the remaining funds will be obtained;

(vi) A copy of site-in accordance with the norms prescribed under this scheme, as certified by a registeredarchitect in case it is not approved by the local authority. Once the project is approved by thePSC for the proposed building plan, the organisation should have to submit the same buildingplan before the release of First installment approved by the local authority within six monthsof the approval of the project alongwith the building permission certificate stating that itsconstruction of the hostel building has been permitted. Plan & Estimate received after sixmonth of its approval by PSC may require fresh approval of the Committee.

Maximum economy in the layout and building specifications should be exercisedwhile preparing the plan. Once the project is approved by the PSC for the proposed buildingplan the organisation should have to submit before the release of First installment, the samebuilding plan approved by the local authority within six months of the approval of the projectby the PSC alongwith the building permission certificate stating that its construction of thehostel building has been permitted. Plan & Estimate received after six month of its approvalby PSC may require fresh approval of the Committee.

(vii) Documentary proof of the plot, on which the building is proposed to beconstructed being a public land. Documents of lease deed of proposed land for theconstruction of working women hostel building signed between the Govt. authority (lessor)and the lessee (the applicant organization), shall be submitted along with the application.Apart from the other conditions of lease agreement, there must also be a condition included in

(c) Applicant agencies seeking financial assistance for hostels in rented premises under thisscheme shall submit following apart from the documents prescribed in 9(b) i to iv above:

(i) Copy of the intention of rent agreement with the land lord. Once the project isapproved, the organisation shall submit fresh rent agreement certified by the competentauthority;

(ii) Detailed building plan along with financial estimates of the rented premisescertified by State PWD/District Collector, on which it is proposed to run the hostel, givingitems wise details of recurring and non-recurring expenditure. Amount of rent providedyearly to the agencies running the hostel will be as assessed by the State PWD/DistrictCollector. The rent deed to be entered into will be valid for two years after which the agencywill have to apply for renewal. Revised rate of rent, if required, shall be made only at the timeof submission of application for the renewal of the project.

10. Authorities concerned with the Scheme

(a) The Project Sanctioning Committee (PSC) of the Ministry of Women & ChildDevelopment shall be the final authority for accepting, reviewing, and sanctioning ofproposals for assistance under the scheme. The final decision as to the release of grants shallalso be taken by the Project Sanctioning Committee. The Committee would comprise offollowing members:

1. Secretary, Ministry of Women and Child Development (Chairman)2. Financial Advisor, Ministry of Women and Child Development3. Secretary in charge of Women and Child Development Department/relevant

(b) The State Government, through a State Level Empowered Committee(SLEC) whichmay be constituted for this purpose by the State , will be responsible for undertaking needs

the scheme in their state, recommendingproposals suo moto, and dissemination of information on availability of hostels under thescheme. The State Level Empowered Committee shall be constituted under the chairmanshipof Secretary, Department of women and child development or the Department dealing withthe subject matter of welfare of women and children. Other members of SLEC shall beselected by the concerned Secretary of the State Govt. (i.e. Chairman of the SLEC.)

(c) District Wome Committees (DWWC) shall be established by every state inevery district, with the responsibility of assisting the State Governments in conducting theactual gap analysis by doing need assessment and mapping of existing facilities in theirrespective districts to identify public land/locations fit for establishment/running of hostels,forwarding and recommending proposals, sending recommendations for release ofinstallments of the grant, and undertaking periodic monitoring of the functioning of hostels intheir district, as provided under the scheme. The DWWC shall be headed by the DistrictCollector/District Magistrate/Municipal Commissioner as the case may be, and shall have 6other members, including

Superintendent of PoliceDistrict Social Welfare Officer/Probation Officer/any other State Governmentrepresentative,PWD EngineerRepresentative of District Legal Services AuthorityRepresentative of an NGO working in the district, which has not proposed or isimplementing a project under this SchemeOther eminent persons of the district at the discretion of District Collector/DistrictMagistrate/Municipal Commissioner or the competent district authority.

Provided that at least two members of the DWWC shall be women

For construction of hostel building- The pattern of release of the approved grant forconstruction cost for new hostels shall be in 3 installments, in the ratio of 50:40:10. The one-time grant for purchase of furniture and common area facilities shall be released with thefinal installment of 10% of the construction cost.

(a) First installment will ordinarily be released with the sanction of the Project butbefore that, the implementing agency shall submit the building plan consideredand approved by the Project Sanctioning Committee of the Ministry, dulyapproved by the local authority along with the building permission.

(b) The second installment will be released when the implementing agency hasalready spent the previous installment along with its own proportionate share ofcost in the construction of the building.

Requests for release of next installment will be accompanied by:

i) Utilization Certificate(UC) of the previous installment(s) and an up to dateconsolidated statement of the actual expenditure incurred on execution of theapproved plans and estimates, duly certified by a Chartered Accountant/Government Auditor. The expenditure reflected therein should not be below 50 %of the approved estimates (in case of request for release of the second installment),and 90% of the approved estimates (in case of release of third installment). Itshould be clearly certified in the UC by the competent/authorized authority thatthe stage of construction has been completed for which the previous grant wasreleased.

ii) A statement indicating Half Yearly physical progress on the construction workin the format (Annexure-I)

iii) Dated Postcard-sized colour photographs showing detailed physical progressof the construction work from at least four corners, including one photo with thename board of the implementing agency mentioning that the hostel building isbeing constructed with the financial assistance of the Ministry of Women andChild Development in both Hindi/Official language of the state and English.

(c) The final 10% along with the one-time grants mentioned above will bereleased on the completion of the construction, provided the following documentsare produced:

i) A Completion certificate from State PWD/CPWD/Housing Board tothe effect that the building has been completed in accordance with theapproved plans and estimates; and

ii) Consolidated Utilization Certificate and Statement of Expenditureincurred on the construction of building duly audited by the authorizedauditors/Govt. auditors/Chartered Accountant.

iii) Dated photographs of atleast four corners of the building, frontelevation, side elevation and one close up showing the name boardmentioning that the hostel building has been constructed with thefinancial assistance from the Ministry of Women and ChildDevelopment.

iv) Inspection Report from the DWWC, giving the details of generalcondition of the hostel and facilities provided in the hostel along withthe details of present occupancy, if any, against the approvedoccupancy of the hostel

v) Copies of the working women hostel bye-laws framed in accordancewith the guidelines and norms prescribed in the Scheme.

For the Hostels in Rented Premises- release shall be made on yearly basis. One-timegrant for purchase of furniture as prescribed in Clause 6(c) above, shall be releasedwith the installment of first year only.

(a) First installment will ordinarily be released with the sanction of the Project, alongwith fresh rent agreement with the land lord and two colour photographs of thehostel with the name board mentioning that the working women hostel is beingrun with the financial assistance of the Ministry of Women and ChildDevelopment.

(b) Second year installment will be released on submission of following documents:

i. Utilization Certificate alongwith audited accounts of the previousinstallment

ii. Inspection Report by the DWWC giving the details of general condition ofthe hostel and facilities provided in the hostel along with the details ofpresent occupancy against the approved occupancy of the working

, Half Yearly Reports of the previous year andrecommendation of the State Government for the release of the secondinstallment to the organisation.

iii. The DWWC may also send directly to the Ministry a report recommendingthe release of the next year installment alongwith the documents asprescribed in (b) (i) & (ii) above, with copy endorsed to the StateGovernment.

The project will be reviewed after every two years and if approved by the ProjectSanctioning Committee for continuation in the next block of two years, the financialassistance for the hostel in rented accommodation shall be continued for the next block oftwo years on the submission of same documents as mentioned above.

12. Guidelines for District, State and Central State and District Authorities

earmarked in all new institutional areas and economic zones being set up in the states,keeping in view the employment potential for women in the area. For this purpose, the StateGovernment may direct all Development Authorities to undertake this exercise of earmarkingpublic land for such hostels in new/existing colonies, as the case may be;

(ii) State/UT government shall undertake needs based assessment for ascertaining demand ofhostels. On the basis of these assessments, land for hostels under this scheme shall beearmarked in smaller towns/non-metropolitan areas as part of town and country planning by

the State/UT Government through the district administration. Recommendation for thispurpose may be made by the DWWC to the State Government/District administration;

(iii) The earmarked public land may be leased out to eligible agencies/organisations includingNGOs with an established record of providing support services to women or working fordisadvantaged sections of the society, for at least a period of 30 years and on renewable termsfor the construction of working women hostel.

(iv) State Governments should consider enactment of legislation or amendment to existinglaws, if deemed necessary, to ensure earmarking and availability of public land for thehostels;

(v) The Central Government may also undertake or request the concerned StateGovernment to undertake needs assessment, and ensure earmarking and allocation of publicland for the purpose of construction of hostel or hostel on rented premises.

13. Evaluation and Monitoring of the Scheme

Regular monitoring of the functioning of the hostels under this scheme shall be theresponsibility of the District Committee. Half-Yearly report on theimplementation of the scheme as prescribed in the scheme shall be sent to the Ministry by theDWWC, with a copy to the State Government. Monitoring of management of the hostels onday to day basis, shall be done by the Hostel Management Committees (HMCs), which shallsend its recommendations and quarterly reports to the DWWC. The HMC shall meet once ona fortnightly basis or in case an issue arises for immediate resolution.

The Hostel Management Committee shall comprise of the following:

Resident SuperintendentOfficial from the District Administration/Distt. Social Welfare Officer/ProbationOfficerProtection Officer/rehabilitation Officer of that areaTwo of the senior residentsProminent social worker/representative from prominent organisation in that area

The Ministry of Women and Child Development may undertake evaluation of the scheme atall India level after every 5 years. The State Governments may also be allowed tocommission any evaluation study for which a need is felt by the State Government. The StateGovernment may submit a proposal for the evaluation study in advance to the Government ofIndia for approval and funding under the scheme.

(e) If the Central Government or the State Government has reason to believe that thegrant is not being utilized for the purpose for which it has been sanctioned, theGovernment of India may stop payment of further installments of the grant and willbe free to recover the grants already sanctioned alongwith penal interest in suchnumber of instalments, as it may deem appropriate or may take over the building ofthe hostel constructed with the grant in-aid under the Scheme.

(f) The organisation shall exercise reasonable economy in expenditure onconstruction/expansion/maintenance/strengthening of the hostel building( as thecase may be);

(g) The building shall be completed not later than 24 months from the date of sanctionof the first installment of grant-in-aid unless extension is granted by theGovernment of India.

(h) There shall not be any Change in building plan once approved by the Ministry;(i) Progress Reports on the construction/maintenance/expansion/ strengthening of the

hostel project shall be furnished regularly to the Central Government and the StateGovernment. The organisation shall also furnish progress reports on the running ofthe Hostel to the Central Govt./State Govt. on regular basis or as prescribed in thescheme.

(j) The organisation will bear the balance of the estimated expenditure on the projecteither from its own resources or with the help of the State Government.

Annexure-III

Area norms for the hostels to be constructed as well as hostels in rented premises

a) Types of accommodation in the hostel may consist of single rooms, 2/3/4-seaters, anddormitories. The single and double-seater rooms may have bathroom-cum-toilet, attached oras part of the common facilities. Hostel should also have the provision of modern installationsand amenities;

b) Common facilities should include a common lounge/recreation room, dining room/hall,kitchen and store, and a separate block of toilets and bathroom;

c) Accommodation for the warden, office, and any other staff if required, should be providedwithin the hostel building itself to facilitate supervision and guidance.

d) Following norms should be followed for construction of hostels under this scheme:

SWADHAR GREH - A SCHEME FOR WOMEN IN DIFFICULT CIRCUMSTANCES

A. Background:

Recognizing the need to prevent women from exploitation and to support their survival andrehabilitation, the scheme of Short Stay Home for women and girls was introduced as a social defensemechanism, by the Department of Social Welfare in 1969. The scheme is meant to provide temporaryaccommodation, maintenance and rehabilitative services to women and girls rendered homeless due tofamily discord, crime, violence, mental stress, social ostracism or are being forced into prostitutionand are in moral danger. Another scheme with the similar objectives namely Swadhar A Scheme forWomen in Difficult Circumstances was launched by the Department of Women and ChildDevelopment in 2001-02. The scheme through the provisions of shelter, food, clothing, counseling,trainings, clinical and legal aid aims to rehabilitate such women in difficult circumstance.Centre for Market Research and Social Development, New Delhi conducted an evaluation in 2007 toassess the performance of both the schemes. The evaluation report while citing the effectiveness andpositive impact of measures adopted under the schemes for counseling and rehabilitation found thatthe profile and category of residents, admission procedure, counseling, quality of service, vocationaltraining, rehabilitation and follow up procedure are almost similar in both the schemes. It, therefore,recommended merger of these two schemes for better functioning and outcomes with lesseradministrative burdens and procedures. It also recommended that the new scheme should focus onestablishing one such home in every district.

The positive findings of the evaluation study has encouraged the Ministry to propose this new schemethat would target the women victims of unfortunate circumstances who are in need of institutionalsupport for rehabilitation so that they could lead their life with dignity.

B. Vision:

The scheme envisions a supportive institutional framework for woman victim of difficultcircumstances so that she could lead her life with dignity and conviction. It envisages that shelter,food, clothing, and health as well as economic and social security are assured for such women. It alsoenvisions that the special needs of these women are properly taken care of and under no circumstancesthey should be left unattended or abandoned which could lead to their exploitation and desolation.

C. Objectives:

Under the scheme, new swadhar greh will be set up in every district with capacity of 30 women withthe following objectives:

To cater to the primary need of shelter, food, clothing, medical treatment and care of thewomen in distress and who are without any social and economic support.To enable them to regain their emotional strength that gets hampered due to their encounterwith unfortunate circumstances.To provide them with legal aid and guidance to enable them to take steps for theirreadjustment in family/society.To rehabilitate them economically and emotionally.To act as a support system that understands and meets various requirements of women indistress.To enable them to start their life afresh with dignity and conviction.

For big cities and other districts having more than 40 lakh population or those districts where there isa need for additional support to the women, more than one swadhar greh could be established. Thecapacity of swadhar greh could be expanded up to 50 or 100 on the basis of need assessment and otherimportant parameters.

D. Strategies:

The objectives cited above would be pursued adopting the following strategies:

Temporary residential accommodation with or without the provision of food, clothing,medical facilities etc.Vocational and skill up gradation trainings for economic rehabilitation of such womenCounseling, awareness generation and behavioral trainingsLegal aid and GuidanceCounseling will also be provided through telephone.

E. Beneficiaries:

The benefit of the scheme could be availed by women above 18 years of age of the followingcategories:

Women who are deserted and are without any family support;Widows survivors of natural disaster who have been rendered homeless and are without anysocial and economic support;Women affected by HIV/AIDS;Women prisoners released from jail and are without family, social and economic support;Women victims of domestic violence, family tension or discord, are made to leave their homeswithout any means of subsistence and have no special protection from exploitation and/ orfacing litigation on account of marital disputes; andTrafficked women/girls rescued or runaway from brothels or other places where they faceexploitation. However such women/ girls should first seek assistance under UJJAWALAScheme in areas where it is in operation.

Women affected by domestic violence could stay up to one year. For other categories of women, theperiod of stay could be up to 3 years. The older women above the 55 years of age may beaccommodated for maximum period of 5 years after which they will have to shift to old age home orsuch other institution.

Swadhar greh facilities could also be availed by the children accompanying women in the abovecategories. Girls up to the age of 18 years and boys up to the age of 12 years would be allowed to stayin the swadhar greh with their mothers. (Boys of more than 12 years of age will be shifted to theChildren Homes being run under JJ Act.).

Any of the following agencies/organizations can seek assistance under the scheme:

Departments of Women and Child Development/Social Welfare in the State Governmentswhich may construct swadhar greh, and lease them to organization(s) having requisiteexperience for such period as deemed fit, for managing the operations under this scheme.Public Trusts registered under any law for the time being in force.Civil Society Organizations such as NGOs etc. having proven track record of working inthe fields of women's welfare/social welfare/ women's education subject to the conditionthat such organization is registered under the Indian Societies Registration Act, 1860 orany relevant State Act;

The organization should meet the following criteria:

o It should be either recognized by the State/UT Administration under any existingscheme/law or should be well known with the experience of working in the field forat least 3 years, and its work should be reported to be satisfactory by the StateGovernment/Union Territory Administration concerned,

o It should ordinarily have been engaged in the field of women's welfare/socialwelfare/women's education for a minimum period of two years prior to the requestfor grant-in-aid under the scheme,

o It should have facilities, resources, personnel and experience to undertake themanagement of such a project,

o Its financial position should be sound to take care of expenditure for a few months incase the grant is delayed.

o It should run the swadhar greh on a no - profit basis.

The organization should have facilities like computers, internet connections etc. at swadhargreh.

Organization will be given sanction for swadhar greh for a period of five (5) years tobegin with. After the expiry of 5 years period, it will be renewed for a further period offive (5) years each time.

G. Components of the Scheme:

Construction grant for construction of the building will be admissible to State Governments,Municipal Corporations and Panchayati Raj Institutions only. Land for this purpose is to beprovided by the implementing agency free of cost.Rent for swadhar greh, if runs in a rented building.Assistance for recurring and non recurring expenditure for management of swadhar grehProvision for food, shelter, clothing, medical care, pocket expense for residents and childrenProvision of counseling, legal aid, vocational training and guidance.Provision of helpline.

H. Pattern of Assistance:

The implementing agencies may seek assistance for all the components as mentioned above under thescheme. However, assistance can be sought for a few components provided that the other facilities areavailable to assist the women in difficult circumstances. Government shall provide following type offinancial assistance to the implementing organizations for setting up/ running of swadhar greh:

i. Assistance for Construction: Government shall grant assistance for construction ofrooms/cottages/ huts for the shelter of the residents and common facilities like kitchen,bathroom, training hall, recreation room, dining hall office room etc and infrastructure facilitieslike water, electricity, approach road, boundary wall etc. The cost of construction would beshared by Central Government and the State Government in the proportion of 75% and 25%

- perresident. Construction grant will be given to State Governments agencies including WomenDevelopment Corporation, Municipal Corporations and Panchayati Raj Institutions only.

ii. Assistance for Rent: The amount of rent of the building would be shared between Centre andthe implementing organization in proportion of 90% and 10% respectively subject to a maximumof Rs.25,000/- per month for a swadhar greh intended for 30 residents. It would however, beensured that the building is not located in high rent areas. Reasonableness of the rent should becertified by the District Collector/State PWD.

Norms for Residential Space: The swadhar greh should provide such residential facilities thatwould ensure a respectable and dignified standard of living for residents. Accordingly everyswadhar greh should provide a residential space of not less than 80 sq. ft. excluding commonspace and utilities. Besides, every swadhar greh should be properly ventilated with adequatefacilities of bathrooms, toilets, and dining hall. Premises for swadhar greh should be clearlydefined and no other residential programme should operate in the premises demarcated forswadhar greh.

iii. Administration and Management: The indicative provision of staff for a 30 residents swadhargreh with women helpline would be as under:

# For the women in the age group of 25 to 35 and their children will get all the benefits onlyfor a period of 6 month and after that they will get the facilities of accommodation onlyand arrange all their expenses from their own resources.

* Expenditure for Vocational Training has been calculated @ Rs.1800/- per resident for the coursesapproved by NCVT, training fee for which ranges from Rs.500/- to Rs.2000/- depending upon theduration of training. It is estimated that the average training fee will be Rs.1000/- per resident(after adjusting the available 25% relaxation in training fee for women). After including the testfee of Rs.800/- per woman, the tentative training cost comes to Rs.1800/- per resident.

** It is estimated that 50% of the residents will avail training facilitating their rehabilitation. Theestimated yearly expenditure on vocational training head for a swadhar greh having capacity of 30women will therefore be Rs.27000/-. The organiztion will however be given reimbursement fortraining fees on actual basis.

Provision for Children: For the children of swadhar greh, expenditure will be given @ 2/3 ofthe recurring expenditure applicable to women on each head.

Quantum of Periodic Increase in the Financial Assistance:

Annual increment in the salary of the staff @ 5% per annum.Annual Increment in the recurring expenditure @ 5% per annumAn increase up to 5% in the rent would be considered after every two years subject tothe actual.A provision of 10% increase in the construction cost after every three years from thedate of notification of the scheme.Implementing agencies that have their own buildings would be entitled formaintenance cum upkeep grant of 25% of the amount of rent of a swadhar greh ofequivalent capacity.

v. Non Recurring Expenditure:

There would be a provision of onetime non-recurring grant of Rs.5000/- per women forpurchase of necessary items including furniture, beds, bedding utensils etc.

vi. From the 12th Five year Plan, 25% of the costs(10% for North-Eastern States)towards running of swadhar grehs shall be shared by the respective StateGovernments/UTs Administration

Duties of the Staff of Swadhar Greh:

Resident Superintendent: She will be the overall incharge/administrative head of the swadhargreh and ensures smooth functioning of swadhar greh so that problems of residents of swadhargreh could be sorted out by her.

Counselor: She will provide counseling to the residents of swadhar greh as well as needy womenthrough telephone. She will also assist Resident Superintendent in managing swadhar greh.

Multipurpose Workers: These workers will look after various responsibilities of swadhargreh such as accompanying the residents to vocational training programmes, hospital, court andother places as required. They will also arrange general maintenance and the grossary items for theswadhar greh.

Qualification:

Superintendent - Post GraduateCounselor - Masters in Social Work/ Psychology/SociologyOffice Assistant - Graduate (with proficiency in Computer operation)Multi Purpose Worker - Class 12th

Guard/Watchman/Peon Middle Level

The relaxation in educational qualification would be permissible to the staff of existing homeswho have been working for more than five years.

Support Services:

Legal Service: The legal assistance requirements of the beneficiaries shall be met through theDistrict Legal Services Authority. Where ever District Legal Service Authority is not available,the implementing organization will arrange alternative suitable legal assistance.

Vocational Training: Arrangement would be made by the organization for providing vocationaltraining to the women through the Vocational Training Institute recognized by DirectorateGeneral of Employment and Training under the Ministry of Labour and Employment. Trainingand examination fee would be reimbursed on submission of the certificate issued by thevocational training institute on successful completion of training. The expenditure incurred by theorganization on the transportation of residents in course of vocational training etc. may be metfrom the contingencies head.

Medical Facilities: Health Check up and medical facilities will be tied up with local civilhospital/CHC/PHC. However, implementing organization may arrange a part time doctor for

medical care and personal

Counseling: The staff proposed under Swadhar Greh scheme will provide the telephoniccounseling to the needy women and the expenses towards the telephone calls will be met from the

During the course of implementation of the merged scheme, State Governments as well asimplementing organizations will establish necessary linkages with other programmes such as NonFormal Education, Skill Development and other programmes of the States as well as of the Govt.of India.

All the implementing organizations will coordinate with NACO, State AIDS Control Societiesand districts hospitals to take care of the needs of the of the residents infected/affected byHIV/AIDS.

State Governments will nominate suitable agencies for orientation programme for thefunctionaries of swadhar grehs to improve the quality of services to be provided in swadhar greh.

I. Sanction of the proposal:

(I) The State Government will send a consolidated proposal containing all the applications ofsuitable organizations in the prescribed format, complete in all respect duly approved by theState Level Empowered Committee to the Ministry of Women and Child Development,Government of India, Shastri Bhavan, New Delhi.

(II) Each proposal will be scrutinized as per the norms of the scheme and the proposals whichfulfill the norms will be placed before the Project Approval Board which will be constitutedunder the Chairpersonship of Secretary(WCD) with the following composition:-

(III) The PAB shall be the final authority for accepting, reviewing, and sanctioning of proposalsfor assistance under the scheme.

J. Procedure for Release of Grant:

For Construction of Swadhar Grehs:

The grant for construction cost for new swadhar greh shall be released in three (3) installments,in the ratio of 50:40:10. The one-time grants proposed to be introduced for purchase offurniture and common area facilities may be released with the final installment of 10% of theconstruction cost.

(a) After the proposal is approved, the implementing agency shall submit the building planapproved by the local authority along with the building permission for release of thegrant. After that first installment of grant will be released to the implementing agency.

(b) The second installment will be released after the implementing agency has spent theprevious installment along with its own proportionate share of cost in the construction ofthe building. The Request for release of next installment will be accompanied by:

i) Utilization Certificate of the previous installment and an up to date consolidatedstatement of the actual expenditure incurred on execution of the approved plans andestimates, duly certified by a Chartered Accountant/ Government Auditor. The

expenditure reflected therein should not be below 50% of the approved estimates (incase of request for release of the second installment), and 90% of the approvedestimates (in case of release of third installment).

ii) The implementing agency should furnish a statement indicating up to date physicalprogress of the construction work to this Ministry regularly at the end of each quarterand the quarterly progress report on the construction work till the building iscompleted.

(c) The 3rd and final installment will be released on the completion of the construction ofthe building, along with the one-time grants mentioned above, provided the followingdocuments are produced:

i) Completion certificate from State PWD/CPWD/Housing Board to the effect that thebuilding has been completed in accordance with the approved plans and estimates;and

ii) Consolidated Utilization Certificate (which would also include Utilization Certificatesof first and second installments clearly and separately indicated) and Statement ofExpenditure incurred on the construction of building duly audited by the authorizedauditors/Govt. auditors/Chartered Accountant.

iii) Dated photographs of at least the four corners, front elevation, side elevation and oneclose up showing the name board mentioning that the swadhar greh has beenconstructed with the financial assistance from the Ministry of Women and ChildDevelopment, Government of India.

The detailed guidelines regarding the procedure to be followed for construction grant is atAppendix-I.

Swadhar Grehs in Rented Premises

Where assistance is sought towards swadhar greh on rent, release shall be made in two equalinstallments every year. The one-time grant for non-recurring items shall be released with the firstinstallment.

(a) First installment will ordinarily be released along with the sanctioning of the Project. Theimplementing agency will furnish two colour photographs of the swadhar greh with thename board, mentioning that the building is being run with financial assistance of theMinistry of Women and Child Development, Government of India.

(b) The second and subsequent installment will be released after the implementing agencyfurnishes proof that it has spent the previous installment for the purpose for which it wasgranted. Release of the second and subsequent installment shall be accompanied by thefollowing documents:

i. Utilization Certificate of the previous installment and an up to date consolidatedstatement of the actual expenditure incurred

ii. Inspection Report by the District administration giving the details of generalcondition of the swadhar greh and facilities provided in the swadhar greh along withthe details of present occupancy alongwith break-up of actual number of childrenfound present at the time of inspection against the approved occupancy of theresidents.

In case of subsequent request for continuation of the grant, State Governments will submitconsolidated proposal including applications of all the implementing agencies which are runningswadhar greh in their States with specific recommendations about the functioning of each and everyswadhar greh keeping in view all the aspects of the scheme. PAB will consider all the proposals forcontinuation of grant. Only after the approval of PAB, further instalment of grant will be released tothe implementing agencies.

State Governments are required to furnish the consolidated proposal for release of first instalment ofannual grant by 30th April and by 31st October for the second instalment of the respective financialyear so that the funds could be released to implementing agencies on time.

The detailed guidelines regarding the procedure to be followed for grant for rented building are atAppendix-II.

The guidelines/Instructions for Admission Policy, Services to be provided and Maintenance ofRecords of the Swadhar Greh is at Appendix-III.

K. Monitoring of Scheme:

i) Monitoring at the District Level

All the swadhar grehs established under the scheme whether newly constructed or running in rentedpremises or otherwise, would be monitored continuously by the District Administration in order toensure their smooth functioning, identifying groups and suggesting steps that would lead to theirbetter functioning.

For this purpose, a would be constituted in everydistrict to look after the affairs of every swadhar greh in the district. DWWC will conduct needassessment in their respective districts and inform State Government about the magnitude ofprevalence of such cases so that the proposed swadhar greh could accommodate the estimateddestitute women. Further, it would be responsible for providing accreditation, forwarding andrecommending proposals, sending recommendations for release of installments of the grant,undertaking periodic monitoring of the functioning of swadhar grehs in their local area, as providedunder the scheme and facilitating for generating awareness about the scheme. The DWWC shall beheaded by the District Collector/District Magistrate as the case may be, and shall have following asmembers:

Chief Medical OfficerSuperintendent of PoliceDistrict Social Welfare Officer/Women and Child Development OfficerRepresentative of District Legal Services AuthorityNoted social worker in the field of women welfareRepresentative of the Municipal Corporations/Panchayati Raj InstitutionsOther eminent persons of the district at the discretion of District Collector

It should be ensured that at least two members of the DWWC shall be women. The DWWCshall meet at least once in six months or in case an issue arises for immediate resolution.

Each implementing agency will submit the Quarterly Progress Report (QPR) of swadhar greh, list ofRehabilitated Women and list of present women etc. in the prescribed format to the DWWC. Forsecond time, applications for continuation of the grant-in-aid following review of the swadhar greh,the DWWC would send its recommendations to the State Government.

ii) Monitoring at the State Level

The Secretary in charge of Social Welfare/ Department of Women and Child Development in theState Government/UT Administration shall be the chairperson of the State Level/ UT AdministrationMonitoring Committee for the scheme. The other members of the Committee would be nominated by

the Secretary. The Committee at the State Level/UT Administration shall meet at least twice a yearand monitor the projects. The continuation of grant to the agency would be based on the satisfactoryperformance reported by the State Government/UT Administration.

iii) Monitoring at the Central Level

MWCD shall also review the functioning of the swadhar greh in every five year. Wherever feltnecessary, the implementation of the project is got inspected by the officers of the Ministry of WCD.

L. Evaluation of the Scheme:

The scheme would be evaluated after 3 years by an independent agency identified for this purpose.The evaluation would be done to monitor the impact of scheme on the intended beneficiaries as wellas identifying the gaps, if any, in the implementation of the scheme and suggest remedies thereof.

M. In case of default

(a) In the event of any violation or breach of any provision of the scheme or the implementingagency/swadhar greh ceasing to exist at any time, all assets created out of Government grantshall revert to the Government of India or the amount involved would be recovered as arrearsof land revenue from the implementing agency in case of swadhar grehs constructed on publicland or under the relevant Rent Control Act in case of other swadhar grehs, or under theIndian Penal Code, as may be applicable.

(b) In addition to this, in the case of any misappropriation of funds by civil society groups/publictrusts/cooperatives/corporate bodies, the State Government would initiate criminalproceedings by lodging an FIR against the defaulting implementing agency, and taking strictlegal action in order to recover the grant with a penal rate of interest as agreed in the bond tobe furnished before the release of grant.

(c) The Government of India through the Ministry or State Departments may be entitled to takeover the swadhar greh building and/or assets created by the grant provided under the Scheme,if the implementing agency mis-utilizes the financial assistance or wrongly use the swadhargreh building for any other purpose.

(d) In case of any minor default (like keeping less residents and reporting higher number, treatingbadly with the residents, making wrong entry in the book of records and keeping such womenwho does not cover under the scheme) by the implementing agencies, the PAB of theMinistry on its own or on recommendation of the State Govt. shall be empowered todeduct up to 10% of the sanctioned amount as penalty. For a major default (like siphoningof funds for some other purpose and submission of forged documents), besides the actionproposed in the preceding paras, the swadhar greh will be de-recognized and name of theorganization will be listed as a blacklistedMinistry shall also refuse grants/assistance to an organization in which the person, who is inthe Board of Management of the blacklisted organization, is also a trustee/member of theBoard of Management.

N. Transitional Provisions:

The State Government/UT Administration would undertake a comprehensive review of the allexisting shelter homes in the State/UT through District Administration within a period of threemonths of the notification of the Scheme. The State Government would follow the certaincriteria/instructions, included in the Scheme, while furnishing the report for shelter homes. The followup action to be taken by the Ministry is as under:

State Governments will undertake a comprehensive review of the all existing SwadharHomes and SSHs with in a time-bound manner through a well defined mechanism andcriteria. The criteria for furnishing the report by State Government would include but not belimited to:

Location of the Home and need assessment;Condition of the building where it is situated and the size of the Home;The number of residents existing and could be accommodated within the home in future;Strength of the staff and the manner in which the Home is being managed;Facilities available to the residents of the Home;Number of women got shelter during last five years or since the inception of the home;Number of women got rehabilitated during the entire period of functioning of shelterhome; andExtent the rehabilitation of women.

Ministry will obtain State-wise consolidated proposals for converting those swadharhomes/short stay homes into swadhar greh which are found functioning satisfactorily andneed for continuation is justified.A Project Advisory Board (PAB) will be constituted in the Ministry under thechairpersonship of Secretary, WCD. The PAB will give its approval/sanctions to eachproposal submitted by the State Government for setting up/running of swadhar greh;Proposals for setting up of new swadhar greh for uncovered districts justified with needassessment will also be obtained by State Governments with the recommendation of SLEC.

To Raise Awareness in Public:

The scheme will be publicized through the State Governments. Each implementing agency will alsodisseminate information about the swadhar greh to the people though various available modes

Appendix-I

Procedure to be followed for sanctioning of grant for construction of building:

State Govt./ UT Administration should submit the application including the followingsdocuments :

Detailed financial estimates of the construction of building, as approved by thePWD/any other competent authority/certified by a registered architect, and giving itemswise details of expenditure.A copy of site-plan and building plan of the proposed swadhar greh in accordance withthe norms prescribed under this scheme, as certified by a registered architect. Thebuilding plan approved by the Ministry for the construction of the building shouldinclude a certificate from the local Municipal Authorities that its building plan has beenapproved and construction has been permitted.Documentary proof of the plot on which the swadhar greh is proposed to be constructedbeing a public land. Documents of transfer of title/lease deed as signed by the DistrictCollector or any other officer of the Government entitled to do so, shall be submittedalong with the application.

Other Conditions to be followed by the State Govt.:

The building would be constructed in accordance with the plan approved by theGovernment of India. No change in the plan can be made without the prior approval ofMWCD, Govt. of India.However, if any change in the building plans is considered necessary by theimplementing agency, subject to the satisfaction of the Ministry, it may be authorized toproceed with the change, intimating full particulars thereof to the Government of India.This is subject to the implementing agency obtaining the approval of the local authority,as required under the relevant building bye-laws and the District Administration. Theimplementing agency must further ensure that there is no reduction in the living area,built up area or capacity of the swadhar greh.No additional financial liability will be devolved on the Government of India as a resultof the change in building plans, and no cost escalation on this account shall be eligiblefor further financial assistance under the scheme.The rates of construction to be adopted in the detailed structural/financial estimates shallnot be in excess of the Schedule of Rates of the PWD of the State concerned and acertificate to that effect shall be furnished by the Executive Engineer of State PWD. TheScrutiny Charges/Centage Fee levied by State PWD/CPWD would qualify for grant -in-aid under the scheme subject to overall ceiling.The building shall be completed as soon as possible and in any case not later than 18months from the date of release of first installment of the grant.Any unspent portion of the grant shall be refunded to the Government of India at once.The State Govt./UT Administration shall maintain record of all assets acquired wholly orsubstantially out of Government Grant. Such assets shall not be disposed off encumberedor utilized for purposes other than those for which grant was given without prior sanctionof the Government of India.

Procedure to be followed for sanctioning of grant for Swadhar Greh inRented Building:

the implementing agencies would submit the application with the followings documents:-

i. Valid Registration Certificate and Prospectus of the agency/voluntaryorganization/institution or a brief description of its objects and activities;

ii. Constitution of the agency/ organization/institution;iii. Constitution of its Board of Management, giving names of members and their PAN

Card details;iv. Annual Reports for the last three yearsv. Copy of the rent agreement as certified by the competent authority;

vi. A copy of the Rent Assessment Certificate duly issued by the State PWD/DistrictCollector/Municipal Authorities;

vii. A blue print of the site plan giving details of the swadhar greh in terms of no. ofrooms, their size etc.

viii. Guidelines/Instructions for Admission Policy, Services to be provided and Maintenance ofRecords of the Swadhar Greh

When women come to such swadhar greh either on their own or are referred by others, the first stepwill be to know their social background, the cause of their distress and the problem of adjustment.A specialized interview and case file would be developed by the counselor (until a standardprotocol is developed by MWCD and circulated), to assist her overcome her initial trauma as wellas to identify the suitability of services available at swadhar greh as per needs of the victim.The first series of interviews by the counselor/ superintendent and the primary stage of diagnosis ofthe problem are the most vital in deciding the rehabilitation programs for the women. If ondiagnosis, it is found that facilities provided at the swadhar greh are suited to meet the needs of thevictim, the applicant may be admitted and provided services for rehabilitation. If it is found that theservices offered at the swadhar greh would not meet the problem of the applicant, she should bereferred to other suitable institutions in the community, e.g., women victims of trafficking shouldavail the benefits under UJJAWALA scheme.On arrival, she should be registered in the admission register with details such as name, address,age, details of children (if any), description of the problem and source of reference.Each case should have a separate file with complete case record, addresses of relatives, referralletters and other letter pertaining to the court case, police etc. A record of assistance providedshould also be maintained like meetings held in connection of the case with various authorities,medical checkups conducted etc. These case files should be updated and open for inspection to anyofficer of the Government at any time.The case file should also contain a plan of action for the rehabilitation of each resident and herchildren (if accompanied) and the steps taken for their rehabilitation.The information of each and every victim admitted in the swadhar greh should be sent to the nearestpolice station within 48 hours and an acknowledgement/copy of FIR be kept on record.A separate case register is to be maintained for the children of beneficiaries, which will reflect theservices provided to them including the expenditure incurred on the activities.If the women brings any valuables with her (gold, silver, jewelry etc) the details should be enteredin a register meant for the purpose and counter signed by the Resident Superintendent and theresident. The valuables should be kept in safe custody and handed over to her when she leaves theinstitution.Every woman would be provided with a Photo ID Card till such time as the proposed UID Cardsare operationalised.A medical check- up of every woman would be undertaken within 3 days of her admission. Thearrangement of medical check-up should made by the organization in the nearest government runhospital/dispensary. Cases requiring urgent medical attention should be referred to nearestgovernment run hospitals.In case the resident is known to have contracted HIV/AIDS or is HIV+, she should be referred tothe VCTC centre of the nearest government run hospital for counseling and advice.Adequate medical facilities including medical kit should be maintained at each swadhar greh. Themedical kit should include basic items like antibiotics, burn creams, tape, bandages, strips forwound closure and management, scissors etc.There should be facilities for recreation and group activities. Facilities for indoor and outdoorgames should be provided. They should be taken out for cultural shows, outings, movies, picnicsand exhibitions etc. at least once a month. The swadhar greh should also celebrate differentreligious festivals, Republic Day, Independence Day and the birthdays of the children with activeinvolvement of residents. Each swadhar greh should have a provision of television for residents.The implementing agency would be responsible for the provision of vocational training of theresidents through Skill Development Initiative (SDI) scheme of Ministry of Labour andEmployment. The Ministry would reimburse the amount of fees as per the actual expenditureincurred in the training course
