Section 1. All agreements on the part of manufacturersof ice within the State of Florida, for the purpose of pre-venting the shipment of ice from one point to anotherwithin this State for the purpose of sale is hereby declaredto be unlawful and is hereby prohibited.

Section 2. Any manufacturer of ice within the State ofFlorida, who violates the provisions of Section one (1)of this act, or any one of such provisions, shall be punished bv fine not exceeding five hundred dollars, or by im-prisonment not exceeding three months, or by both sucifine and imprisonment in the discretion of the court.

Section 3. Any dealer in ice who knowingly and wilful-ly refuse or fails to give any purchaser of ice full and cor-rect weight shall on conviction be punished by a fine ofnot more than one hundred dollars, or by imprisonmluentfor not more than sixty days, or by both such fine and in-prisonment in the discretion of the court, provided, howev-er, before any one shall be punished for light weight in icehe shall be allowed to show that the said ice may ha.vemelted.

SIR-We, the undersigned three of the members of theJoint Committee of four, two on the part of the Senateand two on the part of the House, appointed to visit andreport upon the condition of the Florida Coast Line Canaland Transportation Company, also to report what pro-gress had been made by said company since the last ses-sion of the Legislature, submit this statement as a matterof personal privilege and in reply to a so-called supple-mentfryi report made by Hon. C. S. Noble, a member ofsaid committee, and a member of the House of Representa-tives.

Mir. Noble in said so-called supplementary report firststates that the report of the Joint Committee heretoforesubmitted is approximately correct. We presume that inhis using the word approximately, he intends to conveythat the report of the Joint Committee is very nearly cor-rec(, but in no part of his so-called supplementary reportdoes he show in any way, manner or particular where suchjoint report is incorrect. He then goes on to state that theJoint Committee in making its investigation disregardedits duty and slightingly performed the investigation. Ifhe had been familiar with the laws governing and apper-taining to the F. C. L. C. & T. Co., he would know that theState of Florida, through its Trustees of the I. I. Fundhad accepted every part of that canal as complete in ac-cordance with the specifications required by law, south ofthe 126 mile post, and said Trustees had after its accep-tance of that part of said canal lying south of the 126 milepost, conveyed to the Canal Company after inspection bythe State Engineer, lands granted to said Canal Companyin accordance with law, and the part of said canal that

w-as proper to investigate was that p)art commencing at

St. Augustine and going to the 126 mile post, but that theCanal Company being desirous of a complete, thorough in-vestigation, sought, asked and wished to obtain an investi-gation of its entire waterway, a distance of about threehundred and twenty miles.

Mr. Noble in said so-called supplementary report, states,1st-"The manner in which the investigation was rnlshled

of fact, two of the subscribers made frequent soundingsand measurements all through the canal; and at no place

during all of these soundings and measurements, Mr.Noble remained away from the part of the boat where thesoundings and measurements were being taken, and hedid not observe same and seemed to take no interest there-in, as a matter of fact, many times he was in his berthand apparently asleep.

He further states in his so-called supplementary report'- that what he terms a hasty investigation, implying slight-

ingly, "was not due to the canal management entirely."This language if it means anything, implies that the Ca-

mittee traversed said canal was traveling day and night.,for later on in Mr. Noble's report it is found that such isenot true for he states that the launch arrived at We-st-;Palm Beach at 10 p. m. and left there the next morningtBut it is true that your committee slept on the launchand some on the floor and others in bunks, but Mr. Nobletook very good care to select a most desirable bunk tosleep in on that launch.

Mr. Noble hlas deemed it proper to go outside of thedirections contained in the resolution under which yourcommittee were required to investigate the said CanalCompany. But the result of his investigation is reportedin said so-called supplementary report with the same con-sistent inaccuracies as when he attempts to relate themanner of the investigation by your subscribers as 'mem-bers of ihe Joint Committee of said canal. And these in-accuracies are now pointed out by your subscribers notfor the purpose of their relevancy to said investigationbut to demonstrate the amount of credibility that shouldbe given to the sn-called supplementary report by Mr-Noble. This Canal Company was never created by specialact of the Legislature, but was incorporated under Sub-Chapter 5, Articles 1, 2 and 3, page 730, Revised Statutes,which is a general act providing for the incorporation ofrailroad and canal companies. It was incorporated inJanuary 1881 and was authorized by its charter to cut awaterway'from Matanzas River to the Indian River. Ata subsequent time, the Company applied under said gen-eral act for additional powers and asked to be grantedthe right to cut the waterway from the Indian River toBiscayne Bay and later application was made for afurther amendment to its charter under the general actfor the power and authority to cut a waterway from theMatanzas River to the St. Johns River. This comprisedthe power granted by the State of Florida under the gen-eral act for this company to carry out its corporate pur-poses. But at no time, and there is no law that requiredthis company to cut an open waterway from the St. JohnsRiver to Biscayne Bay, yet we are assured it is the inten-tion of the company to cut a continuous waterway fromthe St. Johns River to Key West. This company hasnever made any contract to cut any such waterway ex-

there are twenty-five miles to be cut. The subscribers can

state positively there are between six and seven miles

only yet to be cut, and that they traveled this distance in

teams. The other muts mentioned by Mr. Noble in his so-

called supplementary report are only such cuts as the

Canal Company think it would be wise at some futuretime to make.

In reference to that part of Mr. Noble's report pertain-

ing to the expenditure by the Canal Company in employ-

ing attcerneys, your subscribers are unable to state any-

arose on a question of personal privilege and made thefollowing statement:

"On yesterday the gentleman from the 30tlh District read a document which was compiled from information obtained from information and idocuments out of the Comptroller's office. In this statement appeared an item of about $71,000.00 was paid in cash to S. I. Wailes.I STATED THAT NO MONEY HAD BEENPAID FOR SERVICES IN CONNECTION WITH THE LAND DEPARTMENT - BUTTHAT COL. WAILES WAS PAID IN LAND ONLY." ,

and in support of his assertion. lie presented a letter ;written by the Secretary of the Trustees, May 12, 1890, over fifteen years ago.

The several contracts of the Trustees of 'the InternalImprovement Fund of Florida with S. I. Wailes provide that he shall be paid as follows:

(1) "Twenty per cent. of all monies paid over to theState on account of swamp lands purchased from the AUnited States prior to the third day of March, 1857, underthe acts of March 2nd, 1855 and .)March 3rd, 1857." -

(2) "Twenty per cent. of all warrants or certificatesissued to the State under said acts."

(3) "Eight per cent. on all lands patented to the Statewhich were selected prior to 1861.

(4) Two cents per acre for every acre of land patentedto the State that was selecteCd since the war.

These contracts certainly contemplate the payment ofmoney and although a part of the compensation providedfor was invested by Mr. WTailes in land at the market priceit should be evident that the compensation was computedand adjusted on a cash basis.

Under one of his contracts the amount due S. I. Wailesin dollars and cents for obtaining patents for lands at twocents per acre wvas computed by the Commissioner of Ag-riculture at $111,372.21. Under another contract his coim-minissinis at 8 per cent. purchased 65,618.50 acres of land,and under the contract for obtaining swamp land indem-nity certificates his commissions at 20 per cen.t enabledhim to acquire 18,658.24 acres of land.

As to the total amount of the "twenty per cent. of allmoneys paid over to the State on account of swamp landspurchased from the United States prior to the third dayof March 1857, I am unable to state for the reason that Ihave r.ot suffcwient tinme to thoroughly investigate the sub,ject.

The gentleman from the 24th District asserts positivelythlat:

"No money had been paid for.services in con-nection with the Land Department but that Col.
