Regular Meeting Board of Education 5:30 p.m. Call to Order The September 27 regular meeting was called to order by the president, Pam Costa. Roll Call Present: Pamela Costa, president Michael McKibbin, vice president Lucinda Luttgen, clerk Greg Paulo, member Saul Hernandez, member Recess: Closed Session The meeting was immediately recessed with the board convening in closed session to consider student expulsions in three cases (Education Code §48918[f]); and discussion with Negotiator Jim Shoemake, Assistant Superintendent of Schools and Labor Relations, regarding CSEA Chapter 127 General/Operations support, Chauffeurs/Teamsters Local No. 150 Transportation, Supervisors, SJTA, and SJPEC (Government Code §54957.6). Pledge of Allegiance At 6:30 p.m., four members of the Casa Roble Fundamental High School Air Force Jr. ROTC led the group in the Pledge of Allegiance. Minutes Approved It was moved by Dr. McKibbin, seconded by Ms. Luttgen, that the minutes of the September 13 regular meeting be approved. MOTION CARRIED UNANIMOUSLY [Costa, McKibbin, Luttgen, Paulo, Hernandez]. Recognition (E-1a) It was moved by Dr. McKibbin, seconded by Ms. Luttgen, to adopt Resolution No.A-357, proclaiming October 9-15 as the Week of the Administrator. MOTION CARRIED UNANIMOUSLY [Costa, McKibbin, Luttgen, Paulo, Hernandez]. Board/Staff Reports (E-2) Mr. Paulo reported he attended the Citizen’s Oversight Committee (COC) meeting on September 20 at Greer Elementary School. He stated that the committee was provided an overview of project JOE (Jump on Education) and given a site tour of project JOE classrooms and library. Mr. Paulo explained some of the challenges working with vendors in installing prefab classrooms. The facilities team of Mr. Camarda, Mr. Mitchell, Mr. Burke and Mr. Reid have come up with pre-manufactured classrooms that can be built quickly in a cost-effective way, called project JOE (Jump on Education). Project JOE was designed in collaboration with teaching staff, principals, administrators and M & O staff. Mr. Paulo stated these next-generation classrooms will greatly benefit students and teachers. Like all next-generation classrooms, Project JOE includes

flexible furniture, flat-screen television monitors and writing surfaces on multiple walls. Mr. Paulo commended the Facilities, Maintenance and Operations team for a fantastic job. Mr. Hernandez shared that he attended a Del Campo High School football game Friday night. Mr. Hernandez noted the game was KCRA’s game of the week and also was broadcasted on the radio. Mr. Hernandez stated that it was great to see the support of the students, band, and community attending this event. Dr. McKibbin reported on his school site visitations at Northridge K-6, Cottage K-5 and Charles Peck K-5 elementary schools and shared that he enjoyed meeting the new principals. Dr. McKibbin attended the Sacramento County Office of Education Teacher of the Year recognition. Dr. McKibbin noted San Juan Unified’s 2017 teachers of the year, Nichole Harshbarger and Bradley Ward, were among 16 teachers recently recognized at an awards program. Ms. Harshbarger, who teaches first grade at Kingswood K-8, was named one of Sacramento County’s Teachers of the Year. Dr. McKibbin attended the Back-to-School Business/Community Partners Breakfast on Wednesday, September 21 with Ms. Costa and Ms. Luttgen. Dr. McKibbin reported that he was invited to be the regional advisor to the California Association of Student Councils at the Sacramento County Office of Education, where student leadership of high schools from Northern California come together to learn management and leadership skills. Ms. Costa reported that Superintendent Kern had the opportunity to serve as a substitute teacher in Ms. Harshbarger’s first grade class so that she could be interviewed on TV. Ms. Costa reported that she, Ms. Luttgen, Dr. McKibbin, Mr. Kern and district staff celebrated Nichole Harshbarger and Bradley Ward at the Sacramento County 2017 Teacher of the Year recognition. Ms. Costa attended the fifth of sixth trainings for the System of Professional Growth (SPG), and will attend the sixth training in October. Ms. Costa thanked Cheryl Dultz, Shannan Brown and Rick Messer for setting up the training programs. Ms. Costa reported that she attended the LCAP Parent Advisory Committee (PAC) orientation on September 15, 2016 for potential new members interested in serving on the LCAP PAC. The committee will be considering doing the orientation in the spring in efforts to get more people involved. Ms. Costa reported that she attended the Back-to-School Business/Community Partners Breakfast on Wednesday, September 21. Ms. Costa commended Kate Hazarian for coordinating this event and she noted that Gabe Cooper spoke about the Unschool program. Ms. Costa shared that she attended site leadership training, and College Night at Rio Americano High School. Ms. Costa thanked Ann Del Core, Ann Marie and the Rio Americano parent community for organizing College Night which benefits all San Juan students. Ms. Costa attended the first SPAC meeting, and on Saturday, September 24, attended CSBA Region 6, representing San Juan Unified. Ms. Costa listened to an ACSA webinar on the new LCAP rubric and will also be attending a session on October 2. District High School Student Council (E-3) High School Student Council Representatives Claire Thomas and Kamryn Whitworth from Casa Roble Fundamental High School, and Mikaela Yuson and Rebeckah Muratore from Mira Loma High School, updated the board on the goals, activities, and achievements at their respective schools. Board-appointed/District Committees (E-4) Juan Yniguez, chair of the Facilities, Transportation and Finance Committee, reported on the meeting of September 9. Mr. Yniguez reported that Michael Alcalay is the new chair of the committee and Linda Martin is the assistant chair. They assume their new roles at the October meeting. The committee is requesting four items for board consideration: clarification of who may serve on district and board-appointed / approved committees; request a “cooling off” period or lapse of time, before a former employee may serve on a district or board-appointed committee; request the board direct staff to present a report on the investment and performance of Encina High School; and request an update on the investment in the System of Professional Growth. Amy Kassouni, chair of the LCAP Parent Advisory Committee, updated the board on the activities of the September 23 membership Ad Hoc committee. The committee met to review applications to fill vacant membership seats. Nineteen applicants were reviewed and eight applicants were recommended for membership. The committee was highly selective to assure regular attendance of members, to provide a quorum and the fulfillment of LCAP committee duties. There are a few seats left to be filled. The committee recommended the district advertise for membership to retain a broader pool of applicants to serve the needs of foster youth, English learner, low-income and homeless students within our district. The committee will recommend candidates to provide balanced advocacy, both geographically and demographically

Tom Nelson, chair of the Curriculum, Standards, Instructional, and Student Services Committee, reported on the committee meetings of September 7 and September 21. The committee received presentations on CAASPP and LCAP. The committee discussed future agenda items and recommended advising the board on listening circles, school site council and other public meetings. Closed Session: Expulsions (E-7) It was moved by Ms. Luttgen, seconded by Mr. Paulo, that the hearing panels’ recommendation be accepted as written, expelling a student in case no. S-126, and the stipulated agreement, expelling two students in case nos. S-125 and S-01. MOTION CARRIED UNANIMOUSLY [Costa, McKibbin, Luttgen, Paulo, Hernandez]. Visitor Comments (F) Joy Wake, Facilities, Transportation and Finance (FT & F) Committee member, spoke in opposition to an appointment of a committee member to the FT & F committee, citing conflict of interest. Juan Yniguez, Facilities, Transportation and Finance (FT & F) Committee member, spoke in opposition to the an appointment of a committee member to the FT & F committee based on procedural and ethical grounds. Mr. Yniguez requested the board rescind the appointment. Sarah Gibson, teacher/librarian at Mira Loma High School, spoke in support of Mira Loma High School signature project for a new science wing. Tom Nelson, Curriculum and Standards chairperson, spoke in opposition to the board policy defining a community member “as those who reside within the boundaries of the San Juan Unified School District.” Nancy Griffin, community member, spoke in opposition to the appointment of a committee member to the FT & F committee. Terri Cristy, community member, spoke in opposition to the board policy defining a community member “as those who reside within the boundaries of the San Juan Unified School District.” She requested the board amend the policy to include all parents and guardians of San Juan students to be eligible for appointment. Five high school students provided information regarding the North American All Youth Film & Education Day on Friday, October 7 at the Crest Theater. The students requested support for maximum attendance at this event. Amy Kassouni, LCAPPAC chairperson, requested the board modify the June 22 decision relating residency requirements and participation on dual appointed / approved committees. Ms. Kassouni requested committee members have the opportunity to complete their term. Consent Calendar Approved (G-1/G-9) It was moved by Dr. McKibbin, seconded by Ms. Luttgen, that the consent calendar, items G-1/G-9 be approved. MOTION CARRIED UNANIMOUSLY [Costa, McKibbin, Luttgen, Paulo, Hernandez]. Personnel (G-1) – appointments, leaves of absence, and separations – all approved as submitted. Purchasing Report (G-2) –change orders – approved as submitted. Business/Financial Report (G-3) – notice of completion, warrants and payroll, and budget revisions – approved as submitted. Gifts (G-4) Acceptance of gifts to Arcade Fundamental Middle School, Barrett Middle School, Ottomon Elementary School, San Juan High School, and Thomas Kelly Elementary School. Child Protective Service Contract for Independent Living Skills (ILP) (G-5) Approval of Cost Reimbursement Agreement 7205000-17-023 with Sacramento County, Department of Health and Human Services (DHHS), Child Protective Services.

Educator Effectiveness Funds for Visions in Education (G-6) Approval of the expenditure plan for the one-time Educator Effectiveness funds for Visions in Education.

Federal Surplus Property Program (G-7) Adoption of Resolution No. 2815 to participate in the Federal Surplus Property Program.

Disposal of Surplus Property (G-8) Approval to dispose of surplus property pursuant to Board Policy 3270 and Education Code §17545 & §17546. CEQA Notices of Exemption (G-9) Approval of CEQA Notice of Exemption for Camp Winthers. High School Credit Recovery Programs (I-1) Assistant Superintendent of Secondary Education Rick Messer, presented an update on the high school credit recovery programs. Mr. Messer explained that the programs’ purpose is to increase the graduation rate, maintain enrollment, offer differentiated opportunities, and move from credit recovery to intervention and prevention. Mr. Messer stated that beyond the traditional seat based high school summer school programs, the various blended learning opportunities have developed to support credit recovery across the district. Mr. Messer reviewed the major shifts in credit recovery. Mr. Messer stated that these programs are supporting students before and after school, during the school day, as well as during the summer. Ms. Luttgen commended staff for developing these programs. Ms. Luttgen would like to see the addition of “Successful Mastery” to slide #2 under Purpose, and maintain that as part of the district focus. Mr. Hernandez also commended the staff for responding to the board’s concerns and appreciates the use of the word “support.” Mr. Hernandez stated he saw how “support” helped students in the 7020 program at Del Campo resulting in large increases in academic improvement were seen with the extra support. Dr. McKibbin believes these programs have great potential not only for our district, but for other districts as well, in the data that will be collected and evaluating outcomes. Mr. Paulo also commended the staff for developing these intervention programs. Mr. Paulo asked if staff has given consideration to creating an intersession between semesters for students struggling in a class. Mr. Messer stated that it is a good idea, but this would have to be coordinated with the district calendar and discussed with SJTA. Ms. Costa echoed fellow board members’ comments and thanked Superintendent Kern for his leadership in developing these programs. Ms. Costa suggested considering having students who complete credit recovery and jump start students to participate in a listening circle to have them discuss the impact these programs have had academically for them. Mr. Kern stated that staff has discussed having students who have completed these programs present to the board at a future date. Ms. Luttgen stated that the Casa Roble Fundamental High School students mentioned they are working on an intervention period. Ms. Luttgen stated when that Casa Roble comes up with a solution to developing an intervention period, the board might be interested in hearing a report. Measure J, N, Deferred Maintenance and One-Time Funds Capital Improvement Projects (I-2) Senior Director of Facilities, Maintenance, and Transportation, Frank Camarda, presented a report on the 2016 Measure J, N, Deferred Maintenance and one-time funds Capital Improvement Projects. Mr. Camarda reported on the projects that are in various stages of progress and/or projects that were completed in the summer of 2016. Visitor comment:

Ken Firl – asked the board to consider using funds for an athletic field at Mira Loma High School. Notice of Public Hearing: Contract for LED Lighting – Phase III (I-3) Ms. Costa declared the Contract for LED Lighting – Phase III a public hearing and invited the public to speak. There being no comments or questions from the public, Ms. Costa declared the public hearing closed It was moved by Dr. McKibbin, seconded by Ms. Luttgen, to approve implementation of the proposed project as an “energy conservation facility” under Government Code section 4217.10 et. seq., adopt Resolution No. 2816, and adopt under Government Code section 4217.10 et. seq. Resolution No. 2817, awarding a contract for lighting energy conservation. MOTION CARRIED UNANIMOUSLY [Costa, McKibbin, Luttgen, Paulo, Hernandez]. Board Policy Review (I-4) Director of Admissions and Family Services, John Garrard, Ed.D., introduced the revisions to Board Policy 5116.1 Intradistrict Open Enrollment. Action was scheduled for October 11.

Sufficiency of Textbooks and Instructional Materials (I-5) Ms. Costa declared the sufficiency of textbooks and instructional materials topic a public hearing and invited the public to speak. There being no comments or questions from the public, Ms. Costa declared the public hearing closed. It was moved by Ms. Luttgen, seconded by Mr. Hernandez, to adopt Resolution No. 2814, stating that each pupil in each school in the district has sufficient textbooks and instructional materials in each subject that are consistent with the content and cycles of the curriculum framework adopted by the state board. MOTION CARRIED UNANIMOUSLY [Costa, McKibbin, Luttgen, Paulo, Hernandez]. Variable Term Waiver (I-6) It was moved by Mr. Hernandez, seconded by Mr. Paulo, to approve submission of a Variable Term Waiver to the California Commission on Teacher Credentialing, effective September 12, 2016 through June 8, 2017 for Mr. Ali Alazawi, to provide English Language Development services. MOTION CARRIED UNANIMOUSLY [Costa, McKibbin, Luttgen, Paulo, Hernandez]. DISTINGUISHING CHARACTERISTICS: The District Community Engagement Specialist works under general direction and spends a major portion of time developing community partnerships at a district-wide, school wide or program level. The Family and Community Engagement Specialist works under general supervision and spends a major portion of time planning and implementing multiple volunteer or partnership programs for a designated school, region or program. will organize, implement and support family and community engagement projects and activities consistent with the District’s Strategic Plan. Board Policy Intradistrict Open Enrollment BP 5116.1 Students The Ggoverning Bboard desires to provide enrollment options that meet the diverse needs and interests of district students. The Ssuperintendent or designee shall establish procedures for the selection and transfer of students among district schools in accordance with law, Bboard policy, and administrative regulation. (cf. 5117 - Interdistrict Attendance)

The parents/guardians of any student who resides within district boundaries may apply to enroll their child in any district school, regardless of the location of residence within the Ddistrict. (Education Code section 35160.5) (cf. 5111.1 - District Residency)

The Bboard shall annually review this policy. (Education Code sections 351605, 48980) Enrollment Priorities Priority for attendance outside a student's attendance area shall be given as follows: 1. If a district school receiving Title I funds is identified for program improvement, corrective action, or restructuring, all students enrolled in that school shall be provided an option to transfer to another district school. (20 USC 6316) (cf. 6171 - Title I Programs)

12. If, while on school grounds, a student becomes the victim of a violent criminal offense, he/she shall be provided an option to transfer to another district school. (20 USC 7912) 23. If a student attends a school designated by the California Department of Education as "persistently dangerous," he/she shall be provided an option to transfer to another district school or charter school. (20 USC 7912; 5 CCR 11992) 34. The Ssuperintendent or designee may approve a student's transfer to a district school that is at capacity and otherwise closed to transfers upon finding that special circumstances exist that might be harmful or dangerous to the student in the current attendance area, including, but not limited to, threats of bodily harm or threats to the emotional stability of the student.

To grant priority under these special circumstances, the Ssuperintendent or designee must have received either: (Education Code section 35160.5) a. A written statement from a representative of an appropriate state or local agency, such as a law enforcement official, social worker, or a properly licensed or registered professional, such as a psychiatrist, psychologist, or marriage and family therapist b. A court order, including a temporary restraining order and injunction. 45. Priority may be given to siblings of students already in attendance in that school. 56. Priority may be given to any student whose parent/guardian is assigned to that school as his/her primary place of employment. No student who currently resides in the attendance area of a school shall be displaced by students transferring from outside the attendance area. (Education Code section 35160.5) For all other applications for enrollment from outside a school's attendance area, the Ssuperintendent or designee shall use a random, unbiased selection process to determine who shall be admitted whenever the school receives admission requests that are in excess of the school's capacity. A school's capacity shall be calculated in a nonarbitrary manner using student enrollment and available space. (Education Code section 35160.5) Enrollment decisions shall not be based on a student's academic or athletic performance, except that existing entrance criteria for specialized schools or programs may be used provided that the criteria are uniformly applied to all applicants. Academic performance may be used to determine eligibility for, or placement in, programs for gifted and talented students. (Education Code section 35160.5) (cf. 6172 - Gifted and Talented Student Program)

Students who qualify to transfer under the Open Enrollment Act ("Romero Bill") will be processed pursuant to Education Code sections 48350-48361. No student currently residing within a school's attendance area shall be displaced by another student transferring from outside the attendance area. Transportation Except as required by 20 USC 6316 for transfers out of Title I program improvement schools, the Ddistrict shall not be obligated to provide transportation for students who attend school outside their attendance area. (cf. 3540 - Transportation)

ACTION REQUESTED: The superintendent is recommending that the board approve members to the Local Control Accountability Plan Parent Advisory Committee (LCAP PAC). RATIONALE/BACKGROUND: The Local Control Accountability Plan (LCAP) approved by the Board of Education on June 24, 2014 includes a provision for a parent advisory committee to be formed for the purpose of advising the board on matters connected with the plan. This committee, which is required by Education Code section 52063 (a)(1) and (a)(2), must include parents or legal guardians of students in the three targeted populations for which funding is received (low income, foster youth, and English language learners). The guidelines for the LCAP PAC are intended to increase the input of parents and students, particularly of the targeted groups. This work is necessary as we move to close achievement gaps across our system. This Parent Advisory Committee will work collaboratively with staff, employee groups and at-large stakeholders to provide input and feedback on the actions and services provided for in the LCAP and their effectiveness in meeting the state priorities and overall goals. ACTION REQUESTED: The superintendent is recommending the board adopt Resolution No. 2818, declaring the intent to convey a permanent utility easement at Mesa Verde High School to the Citrus Height Water District (CHWD) and to call a public hearing to be held on October 25, 2016 in order to solicit public comment. Action anticipated: 10/11/16 and 10/25/16 RATIONALE/BACKGROUND: In order to complete the abandonment of 1,510 linear feet of aging 8” water line along the west portion of the MVHS property, the CHWD is proposing to install 250 linear feet of new 14” water line along the north side of the MVHS property. The proposed new line will connect to the existing main at the northwest property corner, running westerly adjacent to the north property line and connect to a newly replaced distribution main on Poplar Avenue. The CHWD is requesting a dedicated utility easement for the location of the proposed new line. Attachment 4 identifies the location of the proposed easement. Education Code section 17556, et seq. authorizes the San Juan Unified School District to dedicate or convey an easement/real property to municipal corporations for public streets or highways and to a public corporation, to lay, construct, reconstruct, maintain and operate water, sewer, gas, or storm drain facilities or ditches, electric or telephone lines, and access roads used in connection therewith, either with or without consideration and without a vote of the electors of the district being taken. The conveyance of a utility easement as authorized by Education Code section 17556, et seq. is not subject to surplus property proceedings. The process of conveying property for purposes of a utility easement consists of (1) adopting a resolution of intent to convey the property; (2) posting a public notice of the intent to convey property; (3) holding a public hearing to accept public comment on the proposed conveyance, anticipated on October 25, 2016; and (4) adopting a resolution conveying the property, also anticipated on October 25, 2016, and (5) recording the easement. Government Code section 17557 requires the ordering of the intent to convey a dedicated utility easement be passed by the board by a two-thirds vote. The proposed easements total approximately 8,829 square feet in area (see Exhibit B). RESOLUTION NO. 2818

RESOLUTION BEFORE THE SAN JUAN UNIFIED SCHOOL DISTRICT BOARD OF EDUCATION ON MESA VERDE HIGH SCHOOL

(Intent To Convey an Easement for Public Utilities)

WHEREAS, section 17556, et seq. of the Education Code authorizes the San Juan Unified School District (“District”) to dedicate or convey an easement/real property to municipal corporations for public streets or highways and to a public corporation, to lay, construct, reconstruct, maintain and operate water, sewer, gas, or storm drain facilities or ditches, electric or telephone lines, and access roads used in connection therewith, either with or without consideration and without a vote of the electors of the District being taken; WHEREAS, the District desires to dedicate a permanent easement for utility access and maintenance to the Citrus Heights Water District (CHWD) for the purpose of maintaining water lines at Mesa Verde High School, located at 7501 Carriage Drive, Citrus Heights, CA 95621. The proposed easement is specifically described in Exhibit “A” attached hereto and incorporated herein by the reference (hereinafter referred to as the “Easement”); and WHEREAS, the District desires to give notice of its intent to dedicate to the CHWD the Easement described above and to call a public hearing in connection therewith. NOW, THEREFORE, the Board of Education of San Juan Unified School District does hereby resolve as follows:

Section 1. The foregoing recitals are hereby adopted as true and correct. Section 2. The District declares its intent to dedicate and convey the Easement to the CHWD, as described and depicted in Exhibit “A” for the purposes set forth in the Grant of Easement Document attached hereforth. Section 3. The Superintendent or a designee thereof is hereby directed to give notice that on October 25, 2016 at 6:30 p.m. or as soon thereafter as practicable, at the District Board Room, located at 3738 Walnut Avenue, Carmichael, CA, the board will hold a public hearing on the question of making the conveyance of the Easement to the CHWD. The public hearing shall be held during a regularly scheduled public meeting of the board. Notice of the public hearing shall be given by posting copies of this resolution, signed by the majority of the board, in three public places within the District at least ten (10) days prior to the hearing, and by publishing the notice once in a newspaper of general circulation in the District, at least five (5) days prior to the hearing. At the time and place of the hearing, if no legal protest is entered, the board may adopt a resolution by a two-thirds vote of all its members authorizing and directing the conveyance of the Easement to the CHWD. The foregoing resolution was adopted by the Governing Board of the San Juan Unified School District at a meeting of the board on October 11, 2016, by the following vote:

RATIONALE/BACKGROUND: In response to concerns about the difficulty employers are having in hiring teachers, specifically substitute teachers, during the current teacher shortage, the existing law provides for an exemption to the separation-from-service requirement imposed immediately after retirement if the retired CalSTRS Defined Benefit Program member or Cash Balance Benefit Program participant receiving an annuity is hired in a critically needed position and meets other eligibility criteria. To meet one of the requirements of the exemption qualification, the governing board of the employee must approve the retired CalSTRS member or participant appointment by adopting a resolution in a public meeting. Thus, by adopting the resolution, the governing board will be providing retired certificated employees the ability to work as a substitute teacher without waiting the required 180 calendar days. RESOLUTION FOR EXEMPTION TO THE SEPARATION-FROM-SERVICE REQUIREMENT PURSUANT TO SECTION 24214.5 OR 26812 OF

THE EDUCATION CODE Resolution No. 2819

  

WHEREAS, pursuant to Education Code section 24214.5 and 26812, there is a 180 calendar day separation-from-service requirement for all retired CalSTRS members and participants; and,

 WHEREAS, all retired CalSTRS members and participants are subject to a restriction if they

perform retired member activities as defined by section 22164.5 of the Education Code or retired participant activities as defined by section 26135.7 of the Education Code, during the first 180 calendar days after their most recent retirement; and,

 WHEREAS, if the retired CalSTRS member or participant performed retired member or

participant activities during this period, CalSTRS will reduce his or her retirement benefit or annuity one dollar for each dollar earned for performing retired member or participant activities during the 180-day period; and,

 WHEREAS, there is an exemption from the 180 calendar day separation-from-service

requirement for a member o r participant who retires for service and is at or above normal retirement age; and,

 WHEREAS, in order to qualify for this narrow exemption, the employer must appoint the retired

member or participant to a critically needed position that has been approved by the governing body of the employer in a public meeting as reflected in a resolution; and,

 WHEREAS, this approval by the governing body of the employer in a public meeting as

reflected in a resolution must be finalized and communicated to CalSTRS before the member or participant commences to perform retired member or participant activities; and,

 WHEREAS, the superintendent must complete the Request for Separation-from-Service

Requirement Exemption form, which must be submitted to CalSTRS and received by CalSTRS before the member or participant commences to perform retired member or participant activities,

 NOW, THEREFORE, BE IT RESOLVED that this board does provide public notice that the

district is in critical need of substitute teachers to teach because there is a lack of qualified substitute teachers;

 AND BE IT FURTHER RESOLVED that the board wishes to meet this critical need by hiring

Cheryl Bremson, Karen Murphy, Mary Samelson and Cheryl Carden, members or participants who retired for service less than 180 days ago or who will retire;

 AND BE IT FURTHER RESOLVED that this appointment is needed to fill this critical need

before the 180 calendar day separation-from-service requirement is fulfilled;

AND BE IT FURTHER RESOLVED that this member or participant did not receive a retirement incentive or any financial inducement to retire from any public employer;

 AND BE IT FURTHER RESOLVED that the retired member’s or participant’s termination of

employment is not the basis for the need to acquire his or her services;  

AND BE IT FURTHER RESOLVED that the earnings for retired member activities during the 180 calendar days will still be subject to the annual postretirement earnings limit for the Defined Benefit Program;

 AND BE IT FURTHER RESOLVED that this member or participant will not commence to perform

retired member or participant activities before this approval is authorized by the governing body of the employer in a public meeting as reflected in a resolution and received by CalSTRS;

 AND BE IT FURTHER RESOLVED that this member or participant will not commence to

perform retired member or participant activities before the superintendent completes the Request for Separation-from-Service Requirement Exemption form and this is transmitted to and received by CalSTRS.
