Section 2 - Provision C.2 Reporting Municipal Operations Program Highlights and Evaluation Highlight/summarize activities for reporting year:

Summary: The primary C.2 provisions relevant to District operations are C.2.c, Bridge and Structure Maintenance and Graffiti Removal and C.2.f, Corporation Yard BMP Implementation.

PROGRAM EVALUATION The District owns and operates the storm water drainage systems at its facilities, which includes storm drains, catch basins, vegetated swales, open drainage ditches, utility trenches, and storm drain laterals. The District owns and maintains four corporation yards; one vehicle maintenance and parking facility (Corporation Yard) and three material storage facilities (Winfield Facilities, Brokaw Storage Yard, and Camden Storage Yard). Each District corporation yard has a site-specific Storm Water Pollution Prevention Plan (SWPPP).

Storm drains outside District facilities are owned and operated by the local (city or county) jurisdictions.

The District completed the following tasks: 1) Continued implementation of the storm drain inspection and cleaning program 2) Cleaned and reconstructed cinder block, screen, and gravel BMPs at the Corporation Yard and Winfield facilities in May of 2018.

HIGHLIGHTS AND ACCOMPLISHMENTS Pollution prevention and pollutant reduction has continued to be a focus of District staff discussions, including general good housekeeping practices, proper BMP inspection and implementation, and the need to document follow-up actions based on Storm Water Pollution Prevention Plan (SWPPP) inspections. Storm drain inspections and cleaning work orders continue to be distributed via the District’s Comcate Preventative Maintenance Program (field maintenance work-order software) for the corporation yards. Each month, facility maintenance staff inspects all storm drains at their facility and have them cleaned as needed. Inspections were completed for all District corporation yards, and BMPs were implemented according to site specific SWPPPs.

District staff attends the SCVURPPP Municipal Operations Ad Hoc group. Please refer to the C.2 Municipal Operations section of the Program’s FY 17-18 Annual Report for a description of program and regional activities.

Comments: District staff inspect corporation yards and facilities monthly or as needed to ensure compliance with the Storm Water Pollution Prevention Plans at the following facilities:

Corporation Yard – The District’s Corporation Yard is located on the District’s main campus and includes vehicle maintenance and parking areas, maintenance buildings, a fueling station, wash rack, motor pool parking areas, and heavy equipment parking. The fueling station consists of a concrete-paved fuel island, an overhead canopy, a berm, and a trench to contain minor spills. The wash rack has a concrete pad which drains to an underground sump and clarifier, and ultimately discharges into the sanitary sewer system. Storm drains from Corporation Yard facilities discharge directly to Guadalupe Creek (Outfall A), Guadalupe River (Outfall B), and Alamitos groundwater recharge pond. A culvert inlet protection device constructed of cinderblocks, filter fabric, and washed gravels is installed in the heavy equipment parking area at Outfall B.

Winfield Facilities – The District’s Winfield facility consists of supply warehouse buildings, a nursery plant storage area, outdoor general storage areas, sand/gravel storage areas, and parking areas. Storm drains from the Winfield facility discharge to Guadalupe River through the municipal storm drain system. Culvert inlet protection devices constructed of cinderblocks, filter fabric, and washed gravels are installed in all material storage areas. Storage piles are typically covered during the rainy season and when not in use.

Camden Yard – The District’s Camden Yard is used to store various stream maintenance related materials such as large tree trunks and large rocks. Camden Yard drains directly to Guadalupe Creek. A low berm was constructed along the perimeter of the material storage area to direct stormwater to straw wattles which are designed to settle and filter sediment before stormwater is discharged to the creek. Storage piles are typically covered during the rainy season and when not in use.

Brokaw Yard – The District’s Brokaw Yard is used to store large tree and rock material. The site is graded to allow stormwater runoff to drain into a large detention area in the middle of the site. The detention area is designed to detain runoff and settle sediment before discharging into Coyote Creek via a standing pipe and culvert. This is considered a permanent BMP.

Almaden Headquarters Campus and Laboratory – Though not a corporation yard the Almaden Campus utilizes vegetated swales for stormwater treatment and detention in it parking lot, and a vegetated garden for 50% of the drainage from the headquarters building. The District’s Laboratory uses a large sand filter stormwater treatment and detention basin all stormwater runoff of the laboratory building and parking area. These structures are inspected monthly and were installed prior to C.3 new construction deadlines.

The stormwater quality BMPs were visually inspected monthly or on an as-needed basis at Corporation Yard, Winfield Facilities, and Camden Yard. Due to the design of the Brokaw Yard facilities, regular inspections are not required.

C.3.j.i.(5)(d) ► Green Infrastructure Outreach On an annual basis, provide a summary of your agency’s outreach and education efforts pertaining to Green Infrastructure planning and implementation.

Summary: District stormwater staff have been working closely with the Water Supply Planning group. Stormwater capture projects have been included in the Water Supply Master Plan, such as centralized stormwater capture projects as well as programs to promote rain gardens, cisterns, and rain barrels. In addition, the District’s One Water Stakeholder group is also the Stormwater Resource Plan stakeholder group and has been updated on the planning process. Please refer to SCVURPPP FY 17-18 Annual Report for a summary of outreach efforts implemented by the Program.

C.3.j.ii.(2) ► Early Implementation of Green Infrastructure Projects

C.3.j.iii.(2) ► Participate in Processes to Promote Green Infrastructure

On an annual basis, report on the goals and outcomes during the reporting year of work undertaken to participate in processes to promote green infrastructure. Please refer to the Program’s FY 17-18 Annual Report for a summary of efforts conducted to help regional, State, and federal agencies plan, design and fund incorporation of green infrastructure measures into local infrastructure projects, including transportation projects. The Water District, in cooperation with the SCVURPPP Co-Permittees, applied for and received a $471,708 grant from the Storm Water Grant Program's Proposition 1 (Prop 1) Planning Grant administered by the State Water Resources Control Board. This grant is funding the development of a Storm Water Resource Plan (SWRP) for the Santa Clara Basin, which will support the development and implementation of Green Infrastructure Plans within the Basin. The project will also produce a list of prioritized projects eligible for future Prop 1 implementation grant funds expected to become available in 2019. The SWRP is important for identifying opportunities for communities and the District to utilize storm water and dry weather runoff and create benefits such as increased water supply, improved water quality, and flood attenuation.

Co-Permittees are providing a funding match of 47% through contributions to SCVURPPP for county-wide Green Infrastructure Plan development tasks that directly relate to development of the SWRP. The District will provide a funding match of 3% through funds expended on conducting the stakeholder participation process for the One Water Master Plan, and through in-kind services of its staff to prepare the grant application and perform project administration and management tasks. District staff are actively participating in the development of the SWRP, including as Technical Advisory Committee members and in the development of conceptual designs. District staff also attended the GSI funding workshop held by SCVURPPP on February 15, 2018.

Summary: Emergency Response Program The District addresses illicit connection/illegal dumping (IC/ID) incidents effectively through its hazardous materials “Emergency Response” (ER) Program. The District received and responded to a total of 111 emergency response reports throughout Santa Clara County during FY 17-18. This was 30 reports less than in FY 16-17. Of the 111 total incidents reported during the last fiscal year, 102 were within the jurisdiction of the San Francisco Bay Regional Water Quality Control Board (SFBRWQCB), 49 were actual or potential discharge events, and 75 required a field response by a team member or members for general investigation, source identification, multi-agency coordination, and clean up or evidence collection. The District is one of the few Santa Clara County Permittees that has 24-hour availability to conduct storm and stream water pollution investigations. District staff will, as needed, investigate, and collect evidence at a site that can later be transferred to the appropriate jurisdictional authority on the next business day. Jurisdictional authority could reside with a co-permittee, state, or federal agency. The District responded within target field response time 100% of the time for all incidents requiring urgent field response. Water Resource Protection Ordinance Code Enforcement Program To protect District owned public lands, the District regulates non-District use of the agency’s property through the Water Resources Protection Ordinance. The Water Resources Protection Manual, which includes measures to protect the riparian corridor, is utilized for case development. For FY 17-18, the Community Projects Review Unit’s Code Enforcement Program processed 186 cases. Of the 186 cases, encroachment violations accounted for 17% of the cases. Encroachments (unauthorized private use of District’s property) often occur on creekside or near-creekside lands and can have negative impacts on the stream environment due to increased erosion from irrigation and overland drainage, the potential for the introduction of pesticides into the creek, planting of non-native and invasive plant species in the riparian corridor, grading of creek banks, and dumping. The District has been protecting creekside public lands by remediating encroachments for over 40 years. Approximately 25% of the cases were for illegal dumping on District property, which is predominately creekside. Dumped items consisted of materials such as soil, yard clippings, and pet waste. Drainage issues included discharges to creeks from backyard pools. Water Waste Inspector Program In September 2014, the District initiated the Water Waste Inspector Program and created advertisements for how people can report water waste to the District. Water Waste reports are received from citizens through Access Valley Water, the Drought Hotline (408-630-2000), and via email through [email protected]. These reports are dispatched to one of three Water Waste Inspectors, who then visit the site and inspect for water waste, leaks, etc. The Water Waste Inspectors make direct contact with homeowners or business owners, leave educational materials if no one is there, or contact the appropriate retailer or municipality to address the issue. For FY 17-18, the District processed 493 reports on water waste. Of these, 226 reports were water leaks from broken plumbing and irrigation systems, and 267 were for other types of water waste, such as overspray onto pavement and watering during the wrong time of day. Excessive watering, overspray onto impervious surfaces, and leaking irrigations systems can all be mechanisms for the transport of urban pollutants such as oils, herbicides, pesticides, fertilizers, and lawn clippings to

creeks, which can ultimately lead to a significant degradation of stream water quality. One goal of the Water Waste Inspector Program is to address all water waste reports within 24 hours of receipt. In FY 17-18, all 493 water waste reports were responded to and resolved.

PROGRAM EVALUATION The ER Program is recognized as an effective and timely means of addressing acute contaminants that are illegally dumped or discharged to District waterways, reservoirs, lands, and facilities. The Emergency Response Program’s performance was evaluated within the context of the District’s Safe Clean Water and Natural Flood Protection Program.

Comments: The District addresses illicit connection/illegal dumping (IC/ID) incidents effectively through its hazardous materials “Emergency Response” (ER) Program. This aggressive 24-7 program responds reactively to IC/ID incidents by providing referral and inter-agency cooperation and/or conducting field investigation and clean-up activities as appropriate. The ER Program may be contacted via the Pollution Hotline (1-888-510-5151), which is advertised on the District’s internal and external websites, as well as in occasional fliers, countywide mailers, and various memos. The Hotline is also advertised on the Santa Clara Valley Urban Runoff Pollution Prevention Program’s website. Description: This year, the District had 20 violations reported during construction site inspections. This is down from 48 total violations for FY 16-17. Most of these violations concerned erosion control, sediment control, good site management and non-storm water management problems. District stream related projects are usually not in active construction during the winter months.

C.6.e.iii.(4) ►Evaluation of Inspection Program Effectiveness

Describe what appear to be your program’s strengths and weaknesses, and identify needed improvements, including education and outreach.

Description: A Senior Engineer, experienced and knowledgeable in storm water regulatory compliance, continued to work directly on the District’s construction related environmental compliance program beginning in April 2017. The Senior Engineer worked in an advisory capacity for the capital projects’ storm water design and construction personnel, conducted monthly site visits, and reviewed Monthly Environmental Compliance Inspection Reports to ensure regulatory compliance for most of the District’s capital projects. In FY 17-18, the Construction Services Unit updated the Monthly Environmental Compliance Inspection Report Form (FC1467) with versions dated 07-28-17 and 10-30-17 to include additional areas of monthly inspections, and to track any non-compliance with the SWPPP, BMP Action Plan, or the State Storm Water Construction General Permit. In FY 17-18, storm water inspections were performed by District’s Construction Inspectors on Capital projects on a systematic monthly basis on most construction projects in addition to regular SWPPP inspections conducted by the contractor’s inspectors. In FY17-18, the Construction Services Unit’s Senior Engineer conducted monthly site visits and inspections to ensure that the District’s Construction Management (CM) firms’ QSD/QSPs were completing Monthly Environmental Compliance Inspection Reports. These CM firms managed Permanente Creek McKelvey Park and Ranch San Antonio projects, the Lower Berryessa Creek Project, and the San Francisquito Creek Ecosystem Recreation Project. Number of violations and correction time have significantly improved from previous years; further adjustments are continually being made to the District’s construction related storm water compliance program to ensure problems are addressed in a timely manner. Construction related storm water compliance program’s significant accomplishments for 2017-18 include: (1) Continuation of Senior Engineer’s work directly on the District’s construction related environmental compliance program; (2) Updating the construction site inspection form with versions dated 07-28-17 and 10-30-17; (3) Senior Engineer’s involvement in an advisory capacity for the capital projects’ storm water design and construction personnel; (4) Senior Engineer’s continued monthly site visits, and review of Monthly Environmental Compliance Inspection Reports to ensure regulatory compliance;

Summary: The District serves a community of nearly 1.9 million countywide and has excellent outreach programs to many sectors of the community. Key elements include: • A popular Water Resources Education Outreach Program • A Youth Commission • A growing Adopt-A-Creek Program • Creek cleanup events supporting citizen participation • Attendance at community events targeting the general public • A Grant Program that provides funding to several programs that include community engagement and public outreach components, such

as conducting trash cleanup events, implementing docent-led walks, and creating interpretive displays. • Flood Awareness Guide and Creekwise Mailer, which included stormwater pollution prevention messages

The District’s website continues to provide updates to the community, including storm water pollution prevention messages. Our on-line maintenance request form (Access Valley Water) empowers citizens to report dumping or waterway-related problems and allows them to send messages to the appropriate watershed staff. The site also includes a link to the SCVURPPP website, where other storm water pollution prevention program materials can be found. The District uses numerous methods to conduct outreach, including written brochures, radio, newspaper, social media (e.g., Facebook and Twitter), website, blogs, public transportation bus back ads, in-class presentations, library programs, educational tours, community events and workshops. Additionally, the District launched “Valley Water News,” an official online news web page created to increase community engagement and reach a larger number of people. The wide variety of outreach methods increases the probability that the messages are being received and understood. Combining all these different methods is very effective at meeting our public education goals. The variety of outreach methods also ensures that many segments of the Santa Clara Valley population are being reached, including residents, businesses, students, as well as people from other locations. The District evaluates the different outreach methods with the use of surveys, evaluation forms and verbal feedback and continuously seeks to improve messages and outreach methods. We work collaboratively with many other agencies and organizations such as SCVURPPP, BASMAA, and the Watershed Watch campaign to conduct outreach and will continue these partnerships in the future.

C.7.c. Stormwater Pollution Prevention Education No Change District outreach includes: 1) Access Valley Water (http://www.valleywater.org/avwapp/) is a way to send immediate requests, questions, complaints and compliments directly to the Santa Clara Valley Water District. Citizens can report water waste, trash or downed trees near a creek, graffiti, illegal dumping, or other problems near creeks, from a computer or from the Access Valley Water mobile app. Users can check on status and receive messages from the District as a request is processed. Issues reported to Access Valley Water that are found to be outside of District jurisdiction are forwarded to the appropriate government entity. Access Valley Water response time is typically five days or less.

2) The District Pollution Hotline (1-888-510-5151; www.valleywater.org/Services/PollutionHotline.aspx) receives and responds to emergency response reports throughout Santa Clara County. The District is one of the few Santa Clara County Permittees that has 24-hour availability to conduct storm water pollution investigations. The District staff will, as needed, investigate and collect evidence at a site that can later be transferred to the appropriate jurisdictional authority during the next regularly scheduled business hours. Jurisdictional authority could reside with a co-permittee, state or federal agency. Further information is provided in Section C.5 of this report.

C.7.d ►Public Outreach and Citizen Involvement Events SCVURPPP Program staff, the Watershed Watch consultant, and Co-permittees staffed 12 public outreach events in FY 17-18. Events were selected based upon target audience and attendance. Materials distributed at the events included the following: Less Toxic Pest Management fact sheets, “10 Most Wanted Backyard Bugs” brochure, “Draining Pools & Spas” brochure, “You are the Solution to Water Pollution” brochure, “Clean Cars & Clean Creeks” brochure, “Mercury in Fish” brochure, and giveaways (e.g. flyswatters, drawstring backpacks, and temporary tattoos). The flyswatters have the Watershed Watch website and hotline number and the words “The Original Earth-Friendly Pest Control” printed on them. The bean bag toss game for children was used at most of the events. Event staff distributed approximately 3,800 outreach materials and giveaways. In addition, the Program provided funding for the following citizen involvement events:

1) National River Cleanup Day – The Program supports the involvement of Santa Clara Valley residents by providing advertising support for the National River Clean-up Day.

2) Citizen involvement events at the Don Edwards San Francisco Bay Wildlife Refuge (Refuge) – A number of citizen involvement and stewardship programs are conducted as part of the Program funded Watershed Watchers Program at the Refuge. Participants usually work in the Refuge gardens planting native plants, pulling non-native plants, and mulching. More details are included in the Watershed Watchers Report in the Program Annual Report Appendix 7-3.

The District’s Water Resources Education Outreach Program (WREOP) staffed 19 public and 36 student outreach events in FY17-18. The District hosted 14 tours at the Alamitos Recharge Ponds, 6 tours at Edith Morley Outdoor Classroom, 1 tour at Alviso Outdoor Classroom and 2 tours at Coyote Valley Open Space. Additionally, one public event (Asian Community Tour Day) and 5 tours were given at the Santa Clara Valley Advanced Water Purification Center, as well as 1 open house and tour at the Rinconada Water Treatment Plant. We distributed “You are the Solution to Water Pollution” brochures to every classroom as well as provided them at every tour and outreach opportunity. The WREOP also facilitated 3 educator workshops, training teachers, and environmental educators, exponentially increasing the number of students exposed to water education. The District’s Water Supply Planning and Conservation Unit staffed 17 outreach events, presented at an additional 28 events, and conducted 11 Graywater Workshops to the community. Events included various venues throughout the county, including at libraries, churches, businesses, nurseries, festivals, and District events. The District’s Office of Government Relations staffed an additional 13 events. The District provided significant support for the following citizen involvement events: National River Cleanup Day and Coastal Cleanup Day – the District chairs Creek Connections Action Group, providing meeting support and supplies, coordinating the site coordinator training and supply pickup meetings, staffing the phones on the day of the events and reporting results to the California Coastal Commission on Coastal Cleanup Day. The District also provides pickup and disposal of the collected trash from approximately half the sites of both events. A new user-friendly online virtual map with cleanup site information was successfully launched in FY 2016-17 for the annual event and it helped improve volunteer recruitment. It allowed volunteers to easily access and view cleanup site locations from a computer or a mobile device. The District administers the Adopt-A-Creek Program, providing cleanup supplies, assigning adoption areas, and pickup of collected trash. Program staff, the Watershed Watch consultant, and Co-permittees staffed 8 public outreach events in FY 16-17. Events were selected based upon target audience and attendance. Summary: During FY 17-18, the Program actively supported the Santa Clara Basin Watershed Initiative, including the Land Use Subgroup, and the Santa Clara Valley Zero Litter Initiative. Information on these efforts is included within the C.7 Public Information and Outreach section of the Program’s FY 17-18 Annual Report. District staff chairs the Zero Litter Initiative (ZLI) Steering Committee, which continues to meet monthly. This fiscal year the Zero Litter Initiative continued to focus on two main efforts: 1. Continued coordination with Caltrans: ZLI participants in collaboration with the Santa Clara Valley Transportation Authority (VTA) continued coordination meetings with Caltrans on trash issues, including adopt-a-highway and on/off ramps encampments, and the possibility of using highway message boards for anti-litter messages. Caltrans used the “Don’t Trash California” message on message boards statewide on April 22, 2018 (Earth Day). 2. Trash Info Sharing Webinars: ZLI hosted the second in a series of webinars on stormwater trash management in January 2018 on the impacts of discarded cigarette butts on stormwater quality. ZLI has developed a third webinar on straws, which is scheduled for July 31, 2018.

C.7.f. ► School Age Children Outreach Outreach to school-age children is implemented through ZunZun assemblies at local elementary schools and the “Watershed Watchers” program at the Environmental Education Center at the Don Edwards San Francisco Bay Wildlife Refuge (Refuge) in Alviso. The Program sponsors up to 50 ZunZun assemblies at elementary schools in Santa Clara Valley and funds an Interpretive Specialist position at the Refuge for conducting activities and programs about watershed and urban runoff pollution prevention. The Fourth Quarter “Watershed Watchers” Report including the End-of-Year summary is included in the Program Annual Report Appendix 7-3. The Final ZunZun Report and Teacher Evaluation Report are included in the Program Annual Report Appendix 7-5. In addition, to SCVURPPP’s program, the District has a very active Water Resources Education Outreach Program (WREOP) that reached a total of 17,834 participants in FY 17-18. This is broken down below in further detail: • 3771 people through public events • 13,413 total students reached from pre-school to college through; o 423 direct in-classroom programs during 94 visits to 67 different Santa Clara County schools o 29 total tours provided. 22 at our outdoor classroom facilities: Alamitos Recharge Ponds, Edith Morley Park and Coyote Valley, plus 1 tour at Rinconada Water Treatment and 6 tours at the Silicon Valley Advanced Water Purification Center. o 39 student outreach events at Science, Technology, Engineering, Art & Math (STEAM) events, school science nights, water festivals and FIRST Lego League presentations. o 9 Summer, Winter or Spring Break camps o 1 presentations to Santa Clara County Boys and Girls Clubs • 650 teachers reached through WREOP programs and 3 educator training workshops (note: details included in C7.d section) • Ongoing public library programs (note: details included in section C.7.d) The WREOP serves a diverse population and responds to the needs of schools and groups throughout the County. Programming is consistent with State Standards and regularly integrates messages and priorities of other District units and programs. • District water distribution and water quality During school tours at the District’s outdoor classrooms, the WREOP highlights the importance of pollution prevention through Enviroscape demonstrations and activities that focus on the importance of wetland habitats and the impacts of pollution on salmonid species. During tours, WREOP also emphasizes creek clean-up opportunities by promoting the Adopt-A-Creek program, Coastal Cleanup Day and National River Cleanup Day events and emphasizes the importance of waste-reduction. During Classroom visits, the Water Resources Education Outreach Program team always addresses the importance of protecting our waterways and reducing pollution and presents hands-on lessons that have a specific focus on pollution-prevention; a Sesame Street-themed conservation puppet show for pre-school and kindergarten, Creek Story, Who Dirtied The Bay, and Salmon Survival activities for 2nd-5th grades, Sum Of Its Parts, Plastic Voyages, Hidden Water and Dilemma Derby for 6th – 8th grade students, and Plastic Voyages, Hidden Water and “Parts Per Billion” for high school students. Regarding the Youth Stewardship Commission, at the end of 2017 the District formally established the Santa Clara Valley District Water Commission, a 21-member-body with three members representing each of the District’s seven districts. The goal of the commission is to assist the district board of directors with “public policy, education, outreach, and all matters impacting the Santa Clara County youth and the water district” and “to foster greater involvement of youth in local government to inspire and develop future public policy leaders and professionals with an awareness of issues and activities relating to water supply, conservation flood protection and stream stewardship. Youth commissioners have been asked to help publicize as well as participate in such cleanup efforts as the May 19 National River Cleanup. Interactive, musical school assemblies educating K-6 children about watersheds and pollution prevention.

12,751 students ZunZun assemblies were evaluated using postage-paid evaluation cards that were distributed to all teachers present at the performances. The Program received 86 completed evaluation cards from teachers. Teachers were also given the option to complete the survey online. A total of 17 teachers submitted the online survey. A few highlights of the evaluations are: • After the performance, 33 teachers reported that 100%

of their students knew what a watershed was; 31 teachers indicated that 75% of their students knew what a watershed was; 13 teachers indicated that 50% of their students knew what a watershed was; and 21 teachers indicated that 25% of their students knew what a watershed was.

• After the performance, 55 teachers indicated that 100% of their students could name a way to prevent pollution in the watershed; 30 teachers indicated that 75% of their students could name a way to prevent pollution in the watershed; 8 teachers indicated that 50% of their students could name a way to prevent pollution in the watershed; and 5 teachers indicated that 25% of their students could name a way to prevent pollution in the watershed.

In addition, 20 classrooms completed the “I Pledge to Keep My School Clean” activity. The pledge requires students to dispose of trash or recyclables properly or pick up litter for a week. Students sign the pledge each day to indicate completion. Teachers are asked to fax or email the completed pledge form to Program staff to be entered into a monthly drawing. Watershed Watch sports backpacks were distributed to students in 10 classrooms. In addition, a certificate of appreciation and Watershed Watch tattoos were sent to each classroom that submitted pledges.

IPM Tactics and Strategies Used: The District uses pesticides as one of the tools for pest management on its properties and facilities. The primary category of pesticides used is herbicides. Specific strategies that were used include:

• Insecticides are used after other methods, such as prevention or natural nontoxic control methods, have been shown to be ineffective in similar situations. Where use is needed, the product with the lowest toxicity is used in accordance with the manufacturer’s label.

• Herbicides are used only when alternatives use such as mowing, hand removal, disking, or grazing, has been shown to be ineffective or inefficient to meet the needs and requirements of this program.

• For invasive species control, a combination of mechanical removal and if needed follow up herbicide treatment is typically used. • Facilities staff avoid use of pesticides by changing the conditions, cleaning the area and removing the attractant, using traps and baits or detractions before

considering use of pesticides if needed.

Only employees authorized and trained to apply pesticides can use them at work. No over-the-counter pesticides are allowed in or around the workplace. This is consistent with the District’s IPM Policy (see Appendix). Additionally, continuing education (CE) is required for employees to maintain certification for pesticide application.

• For Executive Officer approval, any refinements, if necessary, to the measurement and estimation methodologies to assess mercury load reductions in the subsequent permit.

Summary:

The District owns and operates three reservoirs (Almaden, Calero, and Guadalupe reservoirs) and one lake (Lake Almaden) within the Guadalupe River Watershed that were included in the Clean Water Act (CWA) Section 303 (d) list as impaired due to mercury in 1999. A Basin Plan amendment, adopted in 2008 by the SFBRWQCB, established new water quality objectives and Total Maximum Daily Loads (TMDLs) for mercury in the Guadalupe River Watershed. In the Guadalupe River Watershed Mercury TMDL (Guadalupe TMDL), it is recognized that the District initiated voluntary applied studies in these water bodies prior to its adoption, and that the continuation of these studies is one means of compliance with regulatory enforceable portions of the Guadalupe TMDL applicable to the District. The District’s mercury reduction activities are implemented under its Impaired Water Bodies Improvement Program, a component of Safe, Clean Water (Priority B1).

Inorganic mercury enters the reservoirs from the lands draining historic mercury mines in the upper Guadalupe River Watershed, as well as from atmospheric deposition and imported water deliveries into Calero Reservoir. Methylmercury (the bio-available form of mercury) is produced in the reservoirs and in Lake Almaden during the warm summer months through processes related to the seasonal depletion of bottom oxygen.

The Guadalupe TMDL establishes a schedule for implementation of treatment controls for the reservoirs, and includes new water quality objectives for mercury in fish tissue and surface water that are to be achieved by meeting target reductions of seasonal maximum methylmercury concentrations in Almaden, Calero and Guadalupe reservoirs and Lake Almaden. The District has implemented treatment controls on schedule in all the above-mentioned water bodies.

The District operates oxygenation systems at Calero Reservoir, Stevens Creek Reservoir, Guadalupe Reservoir, and Almaden Reservoir to suppress hypolimnetic methylmercury production. Oxygenation systems were installed in Calero and Stevens Creek reservoirs during calendar year 2012. Equipment for oxygen-injection into the hypolimnion of Guadalupe Reservoir was installed in March 2013, and an oxygen-injection system at

Almaden Reservoir was installed in June 2015. Oxygenation systems have been operated nearly continuously in 2017 throughout periods of summer stratification, with brief shutdowns due to mechanical failure or damage to oxygenation lines.

Mercury concentrations in fish tissue in the Guadalupe Watershed have been found to exceed the U.S. Environmental Protection Agency’s mercury criterion for the safe consumption of fish by humans. The Guadalupe TMDL defines a maximum limit for fish tissue mercury concentrations within the watershed. Fish sampling and laboratory analyses for mercury were conducted in August/September of 2017 and March/April of 2018 at Almaden, Calero, Guadalupe, and Stevens Creek reservoirs. The District is required to provide periodic progress reports regarding its studies of methylmercury production and controls, and progress towards reducing the bioavailability of mercury in the watershed. As part of its Stream Maintenance Program (SMP), the District conducts sediment removal activities in channels and creeks to reduce the potential for local flooding and to meet the requirements of the Federal Emergency Management Agency for flood protection. The District follows a sediment characterization plan to determine chemical and physical properties of the sediments, including for total mercury, to effectively plan for disposal or beneficial reuse of the sediments and assist with determining the best management practices to implement in order to avoid and minimize impacts to water quality and aquatic life during sediment removal and disposal. Sediment removal from channels and creeks, as well as groundwater percolation ponds, allows for the opportunistic removal of mercury-laden sediments from the watershed (Figure 3).

During FY 17-18 the District removed 512 kg of total mercury from the Guadalupe Watershed, 5,313 kg from the Coyote Creek Watershed, 58 kg from the Uvas/Llagas Watershed, and 1,079 kg from the West Valley/Lower Peninsula Watershed (Figure1, Figure 2: in log scale to show detail of low level removals). Concentration of mercury in sediment removed from each watershed is shown in Figure 3.

Summary: Promote Conservation Programs, and Drought Tolerant and Native Vegetation The District has a number of water conservation programs, including residential and commercial conservation programs specifically aimed at reducing runoff and excess irrigation. The Landscape Rebate Program provides rebates for changing out high-water using landscapes to low water using plants and permeable hardscapes and for upgrading to efficient irrigation equipment. 914 rebates ($921 K) were issued through this program in FY17-18. Other programs that work toward this goal include the Water Wise Survey Program, which provides free home water audits (an indoor Do-It-Yourself Kit and an outdoor irrigation audit with a trained specialist) for residents in Santa Clara County, and a Landscape Water Use Evaluation Program, which evaluates site water use and provides monthly usage reports. The District also provides free hose nozzles and soil moisture meters. Promote Outreach Messages to Encourage Appropriate Watering/Irrigation Practices The District periodically updates its outreach messages that encourage appropriate watering and irrigation practices. The District’s current campaign is “VOW: Value Our Water” to encourage an approach to water conservation as a California way of life. The District also conducts messaging to dial back irrigation during fall and winter months. The District has developed several literature pieces that specifically educate people on irrigation best management practices. This literature is given away at outreach events and by request through the mail to residents. Also, the District’s Nursery Outreach Program provides water-wise gardening literature to nurseries in the county. The District is also one of the partners for the South Bay Green Gardens website, which promotes sustainable landscaping. Promote Outreach for Less Toxic Pest Control and Landscape Management For outreach for less toxic pest control and appropriate irrigation practices, refer to the Watershed Watch Campaign in the C.7. Implement Illicit Discharge Enforcement Response Plan for Ongoing, Large Volume Landscape Irrigation Runoff In September 2014, the District initiated the Water Waste Inspector Program, and created advertisements for how people can report water waste to the District. Water waste reports are received from citizens through Access Valley Water, the Drought Hotline (408-630-2000), and via email through [email protected]. These reports are dispatched to Water Waste Inspectors, who then visit the site and inspect for water waste, leaks, etc. The Water Waste Inspectors make direct contact with homeowners or business owners, leave educational materials if no one is there, or contact the appropriate retailer or municipality to address the issue. For FY 17-18, the District processed 493 reports on water waste. Of these, 226 reports were water leaks from broken plumbing and irrigation systems, and 267 were for other types of water waste, such as overspray onto pavement and watering during the wrong time of day. All 493 reports were responded to and resolved. The District’s goal is to address all water waste reports within 24 hours of receiving the report.

Project will install a series of berms and contour plantings to slow and treat surface runoff as it approaches the creek, and densely plant low-lying areas to further slow and sink runoff. Volunteers will help create berms using nuisance vegetation removed from the project site and install strategically placed native plants along the contour and in topographic low areas. The project will help to address remnant pollutants following the removal of the paddock. Additionally, because of its location in the catchment area below Westwind Barn, it will safeguard Moody Creek from polluted runoff in the event of severe weather overwhelming the existing stormwater system.

The Little Blue Hen is a conservation story where the hen teaches us to conserve water every day. The Three Little Pigs and the Big Bad Weather Wolf is our fl ood season story where students learn how and where to build homes to make them fl ood-safe.

Puppet ShowsOur conservation-themed puppet show features Elmo and Grover in the park where they learn about the importance of picking up litter, recycling, planting trees, and saving water. During fl ood season Hoots McDrip joins his friends Elmo and Grover and helps to teach them about fl ood safety.

Sink or FloatThis fun activity introduces early scientifi c principles as children experiment with objects to discover whether they sink or fl oat when placed in water.

Fin RummyStudents learn about the salmon lifecycle and the many different types of habitats they live in. This presentation informs students about the importance of keeping our water ways clean, as well as conserving water to help protect all forms of life.

Drops on a PennyThis is a fun and interactive activity that incorporates water science to challenge student minds in the fi eld of water. By dropping water on a penny students will experience phenomena of cohesion in a fun fi lled manner.

Incredible JourneyWater on the go! The Incredible Journey activity is an exciting game that illustrates

the different ways water moves throughout our environment. Students role-play being drops of water as they journey through the water cycle and record their journey to discuss at the end of the activity.

Water CrossingIn this design challenge, students engineer a miniature raft that will carry “cargo” across a “river” as both native people and early settlers had to do. The goal of this activity is for small groups of students (using only sticks, string and scissors) to carry their cargo for at least 3 seconds. This activity aims to explain the team work and thought processes that go into designing a water supply system.

Dilemma DerbyFruit or candy? The Dilemma Derby presentation is a fun interactive game that aims to show students how the choices they make every day can affect the world around them. Giving students scenario cards, they will be able to analyze situations and make the right choices. Concluding the activity we will discuss some of the situations students were in and the choices they made showing them the benefi ts and consequences of their choices.

Seeing WatershedsStudents learn about the importance of environmental stewardship as they explore a map of their local watershed and understand how humans can positively and negatively impact the health of our water supply. Through this mapping activity they gain an understanding of watershed boundaries, tributaries and how water travels through our environment.

We were involved in 29 tours at our outdoor classrooms and the Silicon Valley Advanced Water Purification Center (SVAWPC). The program hosted 3 Teacher Trainings. The Education Outreach program reached many new audiences through community engagement: • Presented 34 programs in libraries throughout the county. • Engaged with over 120 FIRST Lego League robotics teams and supported their research into hydrodynamics, the delivery

of water. • Presented to high school educators who were participating in a district high school teacher externship program. • Promoted flood awareness and safety through a Flood Awareness Coloring Contest that involved students from schools

throughout Santa Clara County. • Increased the use of outdoor classrooms by reaching new audiences and involving more students in hands-on

environmental learning.

This defines District policies and procedures for pesticide approval, purchasing, acquisition, handling, use, storage, transportation, disposal, and reporting in a manner consistent with all Districts’ permits, the California Environmental Quality Act (CEQA), and the California Department of Pesticide Regulation. These policies and procedures do not replace the need for regulatory permits and only apply to District work activities once these permits are in place. These policies and procedures apply to all District-owned or operated facilities and staff, contractors, permittees, and suppliers. The District goal is to minimize the environmental risk and exposure resulting from its pesticide use by employing Best Management Practices (BMPs) and alternatives to their use to the maximum extent practicable and to facilitate the safe use of pesticide by qualified staff and contractors.

2. POLICY

1. Only pesticides included on W751D01 Pesticides Products Approved for District Use (Product List) are allowed to be used, in the appropriate categories for product application on District facilities. 1.1. District staff is prohibited from purchasing over the counter pesticides 1.2. The product lists will be updated, as needed, by the Pesticide Review Team to ensure

compliance with these practices. 1.3. All pesticide products not on the approved list that are desired to be used on District facilities

(by employees, contractors, or permittees) will need first to be reviewed and approved by the Pesticide Review Team (PRT) prior to their use in accordance with Section 8 of this document and be verified as being in accordance with any relevant regulatory agency review.

2. State-certified Qualified Applicator (see definition in Section 4) with the appropriate current

certification categories must be onsite for entire application of all pesticides. 3. Products listed on the State Department of Pesticide Regulation (DPR) “A” list of known

groundwater contaminants will not be used. Detailed information on DPR regulations can be found on their web site at http://www.cdpr.ca.gov/docs/legbills/calcode/040101.htm#a6800

4. Category I and II pesticides will not be used for routine projects without prior review and approval by the Pesticide Review Team and per regulatory authorizations.

5. To minimize the use of pesticides in the work place, pesticides derived from non-toxic natural ingredients should be used as repellants when appropriate.

6. Insecticides are used after other methods, such as prevention or natural nontoxic control methods, have been shown to be ineffective in similar situations. Where use is needed, the product with the lowest toxicity is used in accordance with the manufacturer’s label.

7. Herbicides are used only when alternatives use such as mowing, hand removal, disking, or grazing, has been shown to be ineffective or inefficient to meet the needs and requirements of this program. 7.1. No herbicide shall be used by District staff without a written recommendation from a Pest

Control Advisor in accordance with State Department of Pesticide Regulation (DPR) www.cdpr.ca.gov

8. Rodenticides are used only after trapping to control burrowing rodents has been shown to be ineffective in similar situations or deemed impractical, unless regulatory permits are required.

4. DEFINITIONS

Integrated Pest Management – Integrated pest management (IPM), is a process that is used at the Santa Clara Valley Water District (District) to solve pest problems through a combination of techniques such as biological control, cultural controls, mechanical and physical controls, and chemical control while minimizing risks to people and the environment. IPM is practiced at the District to manage a variety of pests such as algae, weeds, and squirrels.

Permitting – The process to acquire regulatory permits from state and federal agencies that have legal jurisdiction with the application of pesticides. Permitting and receiving permits allows the District to legally apply pesticides per the directives in the permits. An environmental planner needs to be engaged to discuss the potential permitting issues. Pest Control Advisor (PCA) – As defined by the State of California, the Pest Control Advisor is an individual who meets the minimum educational requirements to qualify for examination and who passes the State examination in the categories relative to the area of pesticide work for which they will be making written recommendations for pesticide use. Categories relative to this policy include: Insects, Mites and Other Invertebrates, Vertebrate Pests, and Weeds. The licensed Pest Control Advisor is the authority making written recommendations for pesticide use. Pest Control Operator (PCO) – The Pest Control Operator possesses a valid Qualified Applicator License from the State of California, supervises the pesticide application (restricted use and/or general use) made by a licensed pest control business, and is responsible for the safe and legal operation of that business relative to pesticide use. Pesticide – A product formulated specifically for the purpose of controlling pests. The generic term “pesticide” refers to a broad spectrum of products, including herbicides, insecticides, algaecide, rodenticides, etc. The following pesticides are used by the District:

• Algaecide – Algae control in percolation ponds.

• Fungicides – Chemical that controls fungi. The District does not use fungicides

• Herbicides – Control of weeds and undesirable vegetation to minimize fire hazards, control invasive species, maintains flood conveyance of waterways, and complies with State and Federal requirements.

• Insecticides – Control of insects in and around District buildings or worksites, or in the case of a serious pest outbreak,

• Rodenticides – Control of rodents on flood control levees, dams, and other facilities.

Pesticide Review Team (PRT) –is a five member committee consisting of the following functional roles: District PCA, Health and Safety Program Administrator, Watershed Biologist, Water Utility Support Program Administrator, and Facilities Maintenance Administrator.

Qualified Applicator – As defined by the State of California is an individual who has passed the State examination for application of various pesticide products and is certified to do so. A Qualified Applicator must be certified in the appropriate certification categories to perform the pesticide application. Categories relative to this policy include: Landscape Maintenance, Right of Way, Aquatic, and Residential, Industrial and Institutional.

Toxicity – The Environmental Protection Agency and the State Department of Pesticide Regulation define pesticides in the following categories:

• Category I – highest pesticide toxicity, or poses specific health hazards such as a severe eye hazard.

o Signal Word(s) - Danger/Poison; Skull & Crossbones

• Category II – Moderate toxicity pesticides 1-10 times less toxic than Category I. o Signal word - Warning

• Categories III and IV – least toxic, 1-10 times less toxic than Category II, and Category IV is

considered practically non-toxic. o Signal word – Caution

5. ROLES AND RESPONSIBILITIES

District’s Pest Control Adviser (PCA): Is responsible for coordinating, reviewing, tracking, documenting and reporting pest control practices at the District. Additionally, the PCA provides updates on policy changes and modifications to all District staff. The PCA works with the Watersheds Environmental Health and Safety Program Administrator on the aspects of employee training. This role is filled by the Vegetation Program Senior Field Operations Administrators and the Vegetation Program Specialist II’s in the Vegetation Management Unit. Pesticide Policy Process Owner: Is responsible for resolving any issues with related pesticide use that could not be resolved by working with the PRT and Management. This role is filled by the Vegetation Unit Manager. Pesticide Review Team (PRT): The purpose of this operational team is to oversee compliance to the pesticide program. The team will also be responsible for meeting on an as needed basis to determine the following:Meeting annually and as-needed which will be decided by the Team

• Evaluating the District’s pesticide use • Revision, as needed, of the Pesticides Products Approved for District Use list.

• Responding to issues relative to the use of pesticides • Recommending changes to the pesticide program including training and procedures • Reviewing, evaluating, and approving the use of new products including those to be used by

contractors and permittees. These approvals do not override the legal requirements for CEQA compliance

• Researching alternatives to pesticides using staff and consultant services Unit Manager of Units with Oversight of the Use of Pesticides - these units include, but are not limited to: Vegetation Management Unit, Facilities, Watershed Field Operations Units, Water Utility Raw Water Field Operations and Pipeline Maintenance Unit, and Watershed Stream Stewardship

• Provide training on pesticide use, MSDS labeling, and BMPs relating to pesticide use • Maintaining original training records in accordance with District Record Retention Policy • Sending copies of training records to the Training Unit

Unit Manager with Oversight of Pesticide Contractors – these units include: Vegetation Management Unit, Facilities, and Watershed Stream Stewardship are responsible for

• Ensuring that any contracts involving pesticides comply with this document and contain all project specific requests, restrictions, and BMPs for limitation on pesticide use prior to signing contract

• Ensuring that any contractors using pesticides have immediate oversight by a State-Certified Qualified Applicator

• Oversight of the pesticide contractor from the time the contract is in effect to the end of the contract service

• Training contractors on District BMPs, District Environmental Management System including Policy and aspects, Pesticide Policies (this document), and W751D01 Pesticide Products Approved for District Use

• Acquiring the appropriate approvals, permits, any environmental reviews, biological surveys, and clearances before beginning work

• Providing a report after the use of pesticides back to the Vegetation Management Unit Manager with the exact names of pesticides applied and the amounts used

Qualified Applicator* – Is responsible for:

• Being certified by the State of California with the appropriate certification categories (see definition, section 4)

• Annual training of District BMPs, Pesticide Policies (this document), and W751D01 Pesticide Products Approved for District Use.

• Must be onsite for entire application “immediate oversight” of all pesticide use. • Responsible for the storage, handling, transportation, labeling, disposal, and clean up of spills

according to State Department of Pesticide Regulation, District standards, and Hazardous Materials regulations.

(5) Training Requirements for Using Pesticides (Unit Managers of units who use or oversee the use of Pesticides)

• All Unit Managers of units who use or oversee the use of pesticides will provide trainings on pesticide, MSDS labeling, and BMPs for any staff that use or oversee the use of pesticide in the course of their duties. o Optionally, Unit Managers can contract Process

(7) Processing Pesticide Use Recommendations for Internal Use (Pest Control Adviser (PCA))

• Staff pesticide requests are initiated, entered, and tracked in Maximo in accordance with WQ75101 Field Operations Work Order Process

• The request will be evaluated for:

o Any questions or issues will be resolved by the Pesticide Review Team

o Environmental clearances and permits must be obtained, as required

o Biological Survey and clearance must be obtained before proceeding with application of pesticides, when required by permit or regulation

o BMPs must be followed

• A proposed use is evaluated based on: o Regulatory restrictions including CEQA and BMPs o Anticipated effectiveness of the proposed methods o Public health aspects o Long and short term environmental impacts o Financial cost o Consistency with other District’s policies

• All herbicide use by District staff require a written

recommendation from the PCA in accordance with State Department of Pesticide Regulation (DPR) www.cdpr.ca.gov

• PCA develops a written Pest Control Recommendation

(8) Use of Aerosols for

Yellow Jackets and Spiders

(Staff)

• District Staff is prohibited from purchasing pesticides over the counter as these are designated for home use only

• Aerosols for yellow jackets and spiders can be obtained from PCA o Contact PCA via email and specify whether the use

will be outdoors or indoors, date planned, and if training is needed.

o Only employees that have been trained on the MSDS

and label are allowed to use the aerosols for yellow jackets and spiders. Contact PCA for more details

o Proper PPE (eye goggles and gloves) is required

when handling these pesticides.

o Aerosol cans will be individually issued. New cans can be issued only after empty cans are returned.

• Reporting on the usage of the use of these pesticides:

o Will be done after each can is emptied and returned to the PCA

o Report will be submitted to the Agricultural Commissioner. See step 11 of this section.

(9) Handling, Labeling, Storage, Disposal, Transportation, and Spills of Pesticides (Qualified Applicator)

• Handling. Mixing and loading should never be done without a full understanding of the pesticide label and with the use of all recommended personal protective equipment (PPEs-See W640D23 Personal Protective Equipment) The label will identify the dangers involved and the precautions to follow, may indicate the signs and symptoms of poisoning and recommend first aid practices, should one be exposed to the product. o Pesticide handling includes the following activities:

• Mixing, loading transferring, applying or assisting with an application of pesticides,

• Servicing, repairing or handling contaminated equipment,

• Incorporating pesticides into soil or entering treated area during an application

• Labeling. Containers containing pesticides will be

labeled according to State Department of Pesticide Regulation (DPR) - Keeping Pesticides Out Of Floodwaters – Container Labeling http://www.cdpr.ca.gov/docs/pressrls/archive/1998/980213.htm o Each pesticide service container must be labeled with

(10) Posting, Notification, and Application of Pesticides (Qualified Applicator)

• Posting of areas where pesticides are used shall be performed in compliance with this policy as follows: • Posting shall be performed in compliance with the

label requirements of the product being applied. • In addition, the District shall provide posting for any

products applied in areas used by the public for recreational purposes, or those areas readily accessible to the public, regardless of whether the label requires such notification. In doing this, the District ensures that exposure risk is minimized by adopting practices that go beyond the product label requirements.

• Sign postings shall include the date and time of application, the product’s active ingredients, common name, and the time of allowable re-entry into the treated area. A District staff contact phone number shall be posted on the sign.

• Signs shall not be removed until after the end of the specified re-entry interval.

• Right-to-know literature on the product shall be made available upon request to anyone in the area of the application.

• The District maintains records of neighbors with specific needs relative to notification prior to treatment of an adjacent area to ensure such needs are accommodated. These records are maintained in Maximo with the pest control recommendation.

• A Spray Operators Report (F751D01) shall be completed for each pesticide application performed by District staff. This report shall be submitted with each daily work order in accordance with WQ75101 Field Operations Work Order Process and include:

• Pesticide common name and active ingredient • Method of application • Dilution rate, if applicable • Total amount of product applied, plus the total

amount of diluted material • For outdoor applications, weather conditions,

including temperature and wind speed • Specific pests controlled with each application

• Unit Managers overseeing pesticide contractors must

supply a monthly use report with the exact pesticides used and amounts (Spray Operators Report) to the Vegetation Management Unit Manager by the 5th day of the following month. This is necessary for tracking all pesticide use on District facilities. The contractor’s use report is an internal document only and will not be submitted to the Agricultural Commissioner.
