INSURING AGREEMENT

We will provide the insurance described in this policyin return for the premium and compliance with allapplicable provisions of this policy.

The Declarations and Schedule Page show the policyperiod, coverages, limits of liability and premiums.This policy is not complete without the Declarationsand Schedule Pages.

PART I – DEFINITIONS

In this policy, "you" and "your" refer to the NamedInsured shown in the Declarations and the spouse, ifa resident of the resident premises. "We", "us" and"our" refer to the Company providing this insurance.In addition, certain words and phrases are defined asfollows:

1. Accident(s) means an unexpected or unintendedevent, which is specific as to place and timecausing Injury to your Pet.

2. Aggression means an abnormal hostile responseto an otherwise normal situation.

3. Allowable Charge(s) means the costs of theactual Treatment(s) provided by your VeterinaryProvider.

4. Alternative and Complementary Therapiesinclude acupuncture, chiropractic Treatment,laser treatment, hydrotherapy, andphysiotherapy performed by a Veterinarian or aveterinary staff member under direct supervisionof a Veterinarian.

5. Ambulance means a specialized land vehicleused for the sole purpose of transporting sick orinjured Pets.

6. Annual Maximum is the maximum amount wewill reimburse you per Pet in a period ofinsurance.

7. Bilateral Condition is a condition or disease thataffects both sides of the body.

8. Chronic Condition is a detectable condition that,once developed, is deemed incurable or likely tocontinue for the remainder of a Pet’s life.

9. Claim means your request for reimbursement ofan amount under the terms of your policy forTreatment by a Veterinary Provider of your Pet.

10. Clinical Signs means changes in a Pet’s normalhealthy state, bodily function or behaviorobserved by you, a Veterinarian, or other

observer.

11. Coverage is the insurance described in thispolicy.

12. Deductible is the annual amount you pay per Petfor Treatments covered by this policy before wewill begin to reimburse you.

13. Dental Illness is an Illness affecting the teethand/or gums including but not limited togingivitis, stomatitis, epulis, attrition, andgingival hyperplasia. This does not includeFORLs or Illnesses manifesting as oral diseasessuch as FELV gingivitis, feline bartonellainfection, or auto-immune (eosinophilic)stomatitis.

14. Dermatological Condition means an Illnessrelated to your Pet’s skin and is deemed toinclude ear infections and skin lumps from skinirritation or infection, such as interdigital cystsfrom pododermatitis, but not conjunctivitis orparasitic infestations.

15. Genetic Condition means an Illness whosepresence is determined by hereditary factors.

16. Illness means sickness, disease, or any changein a Pet’s normal, healthy state, which is notcaused by Injury to the Pet.

17. Injury means physical harm or damage to yourPet.

18. Medical Director means a Veterinarian who maybe assigned by us to monitor and review theappropriateness of the services provided to thePet, the reasonableness of the fees, and therelationship between conditions.

19. Medically Necessary means directly andmaterially related to a covered Illness or Injury,in our reasonable judgment.

20. Medication means any veterinary recommendeditems prescribed by your Veterinarian andapproved by the Food and Drug Administration(FDA) of the United States or accepted forinclusion in the Homeopathic Pharmacopoeia ofthe United States for veterinary use.FDA-approved or HomeopathicPharmacopoeia-included drugs available over thecounter must be dispensed directly by yourVeterinarian or compounded by a pharmacistunder the guidance of your Veterinarian.Medication includes medical supplies required toadminister those Medications.

21. Orthopedic Illness means an Illness affecting or

manifesting from the musculoskeletal system,which is made up of the body's bones (theskeleton), muscles, cartilage, tendons,ligaments, and joints, including intervertebralspaces and osteosarcoma.

22. Pet is a cat or dog named and described in theSchedule Page(s) and both owned by you andresiding with you.

23. Pet Original Start Date means the effective datewhen that Pet was first covered by a policyadministered by Embrace Pet Insurance AgencyLLC, unless otherwise stated on the SchedulePage.

24. Policy Original Start Date means the effectivedate when you were first continuously coveredby a policy administered by Embrace PetInsurance Agency, LLC unless otherwise statedon the Schedule Page.

25. Preventative Care means any Treatment, serviceor procedure, including but not limited tophysical examinations, Medications, surgery,inoculations or laboratory procedures, for thepurpose of prevention of Injury or Illness or forthe promotion of general health, where therehas been no Injury or Illness.

26. Professional Services are diagnosing, treating,operating, or prescribing for any cat or dogIllness or Injury.

27. Pre-existing Condition(s) means:

a. A Chronic Condition observed by you oryour Veterinary Provider prior to the end ofthe Waiting Period for your Pet(s) and anyrelated conditions; or

b. An Illness or Injury that first occurred orshowed Clinical Signs prior to the end ofthe Waiting Period for your Pet and anyrelated conditions.

c. Undiagnosed conditions with the sameClinical Signs as those in a. or b. above arealso considered pre-existing.

28. Reimbursement Percentage is the amount of thecovered Allowable Charge for which you may bereimbursed.

29. Temporary Condition means an abnormalClinical Sign or diagnosis, which is likely toresolve. A Temporary Condition may become aChronic Condition.

30. Treatment means any examination,

consultation, hospitalization, anesthesia,surgery, X-rays, MRI or CT scans, Alternative orComplementary Therapies, laboratory tests,nursing or other care provided and administeredby a Veterinary Provider.

31. Undiagnosed means the underlying or causativecondition has not yet been identified.

32. Veterinarian means a currently licensed Doctorof Veterinary Medicine.

33. Veterinary Provider means a Veterinarian,veterinary technician or veterinary nursecurrently licensed in the state in whichTreatment is performed.

34. Waiting Period means the time period where thepolicy’s Coverage is restricted. For this policy,the time period is two (2) days for Injuries andfourteen (14) days for Illnesses, except forOrthopedic conditions for dogs where theWaiting Period is six (6) months.

The Waiting Period starts from the Pet OriginalStart Date. Conditions that occur during theWaiting Period will be excluded from yourpolicy’s Coverage as Pre-existing Conditions.The Waiting Period also applies again whenthere are Coverage increases but is waived forpolicy renewals and Optional Coveragerenewals.

PART II – CONDITIONS

1. Your Pet must have been examined by aVeterinarian in the twelve (12) months prior tothe Pet Original Start Date as shown on theSchedule Page(s) Or within 14 days after the PetOriginal Start Date. Failure to do so may resultin your policy being voided. If your policy isvoided, your premium will be refunded. NoCoverage is available until a qualifyingVeterinarian has examined your Pet, andPre-existing Conditions, if any, may bedetermined upon the date of the qualifyingVeterinarian's examination.

2. The examining Veterinarian for the purposes ofmedical information or for an Orthopedicexamination cannot be you or be related to you.

3. All Treatment must be performed by aVeterinary Provider that you may freely choose.

4. You must arrange for a Veterinarian to examineand treat your Pet as soon as possible after itshows Clinical Signs of Injury or Illness.

5. You are financially responsible to your

Veterinary Provider for payment of allTreatment.

6. Your Pet(s) must reside with you and be underyour regular care and supervision at the physicaladdress zip code listed on the Declaration Page.

7. By purchasing a policy you give us permission togather all medical history for your Pet(s) from allyour Veterinary Providers as we deemnecessary. The medical information mustcontain detailed Veterinarian examinationfindings and must be made available to us forreview to satisfy the examination requirement inPart II.1.

8. The standard Orthopedic condition WaitingPeriod for dogs is six (6) months from the PetOriginal Start Date shown on the Schedule Pagefor that dog.

You may apply to reduce the OrthopedicWaiting Period by having a Veterinarian perform,at your own expense, an Orthopedicexamination on your dog and submitting theresults to us for review.

The Orthopedic examination must occur on orafter the Pet Original Start Date for that dog andthe Veterinarian must complete, sign and datethe “Canine Orthopedic Examination Report”form based on that Orthopedic examination,which we shall supply upon request. Uponreview of the results of the Orthopedicexamination, we may reduce the OrthopedicWaiting Period for some or all Orthopedicconditions to two (2) days for Injuries orfourteen (14) days for Illnesses, or from theOrthopedic examination date, whichever is later.

Our review of the Canine OrthopedicExamination Report only addresses the length ofthe Orthopedic Waiting Period. A comprehensivereview of your dog’s medical information todetermine Pre-Existing Conditions is notperformed as part of this review and must berequested separately. Regardless of when themedical history is reviewed, any condition notedin the medical history prior to the end of theOrthopedic Waiting Period is a Pre-ExistingCondition even if the condition is not noted onthe Canine Orthopedic Examination Report form.

PART III – COVERAGE

IF SHOWN IN THE SCHEDULE PAGE(S), THEFOLLOWING COVERAGES APPLY SEPARATELY TOEACH PET.

1. Coverage

We will reimburse you for Allowable Charges inexcess of the Deductible amount, subject toReimbursement Percentage amounts, forTreatment(s) performed for conditions thatstarted after the Waiting Period and during thepolicy period, which result from:

a. Accidents, including but not limited to anautomobile Accident, ingestion of a foreignbody, poisoning, animal bites, gastrictorsion, and cruciate ligament rupture, aswell as Accidents resulting in dentaltrauma, burns, and fractures; (if shown asapplicable on the Schedule Page(s)).Orthopedic Accidents are subject to theOrthopedic Waiting Period;

b. Illnesses, including but not limited toGenetic Conditions, cancer, and ChronicConditions (if shown as applicable on theSchedule Page(s)); or

c. Accidental Orthopedic or dental fracturesthat occur or first show signs after the endof the Accident Waiting Period.

d. We will reimburse you for the costs ofMedications your Veterinarian prescribes aspart of your Pet's Accident or IllnessTreatment that started after the WaitingPeriod and during the policy period.

e. We will reimburse you for Pet Ambulancetransport costs in the case of a medicalemergency, by our best estimation.

f. We will reimburse you for eligibleVeterinary Treatment expenses caused byDental Illness in excess of the Deductibleamount, subject to Co-Paymentrequirements and a $1,000 AnnualMaximum sub-limit, for all Treatment(s)except dental prophylaxis, for conditionsthat started after the Waiting Period andduring the policy period.

g. We will reimburse you for the cost ofTreatment your Pet receives in the currentperiod of insurance for an Illness or Injurythat first showed Clinical Signs after theend of the Waiting Period.

Coverage is up to the Annual Maximum asshown on the Schedule Page(s), subject tothe Deductible and ReimbursementPercentage requirements.

We will reimburse you for Medically NecessaryTreatment, including tax, for:

a. Physical examination;

b. Surgery;

c. X-rays, ultrasounds, and other diagnostictests;

d. Professional Services rendered by yourVeterinary Provider;

e. Medical supplies required to performcovered procedures performed in theVeterinarian’s office and other medicalsupplies, where deemed MedicallyNecessary by the Veterinarian, such as anElizabethan collar;

f. Laboratory tests required by yourVeterinary Provider;

g. Hospitalization required in order for yourVeterinary Provider to deliver ProfessionalServices to your Pet and post procedurein-hospital care as is medically standard byour best estimation;

h. Medication that is prescribed by aVeterinary Provider.

i. Endodontic Treatment for dental Injuries,such as root canals and crowns, wheredeemed Medically Necessary;

j. Euthanasia where necessary for humanereasons;

k. Medical waste disposal.

l. Alternative and Complementary Therapiesrelated to a covered surgical procedure orIllness performed within a twelve (12)week period from the start of Treatment.

3. Deductible and Reimbursement Percentage

Your Deductible is an annual amount. We willapply the Deductible to your Allowable Chargesand then apply your Reimbursement Percentageto the remainder to determine your Claimreimbursement.

PART IV – EXCLUSIONS

Please read the following exclusions carefully. If anexclusion applies, we will not provide Coverageunder this policy and you will not be reimbursed forany cost of Treatment you have paid for. We do not

cover:

1. Pre-existing Conditions;

In addition, the following Illness or Injury shallbe considered Pre-existing Conditions:

a. If your Pet has had Clinical Signs, prior tobeing insured, of a Bilateral Condition onone side of the body, she/he runs a higherrisk of the same condition on the other sideof the body and future occurrences of thesame condition will not be covered. Forexample, but not limited to, if a dog hasbeen diagnosed with a cruciate tear in hisleft leg before the end of the WaitingPeriod, a subsequent cruciate tear in hisright leg shall be considered Pre-existing;

b. Any Pet diagnosed, treated or showingClinical Signs of intervertebral disk disease(IVDD) prior to the end of the WaitingPeriod runs a higher risk of further episodesof IVDD and will not be covered for anyfuture incidences of this condition.

c. If a Pet has had Undiagnosed masses priorto the end of the Waiting Period, any mass,or condition where a mass is a ClinicalSign, is not covered, including those causedby cancer. If the cause of the mass thatoccurred prior to the end of the WaitingPeriod can be diagnostically narrowed downvia cytology, un-related conditions may becovered.

d. Orthopedic Accidents and Illnessesoccurring or showing Clinical Signs duringthe Orthopedic Waiting Period, even if theAccident Waiting Period is complete.

e. If a Pet has been diagnosed, treated, orwas showing Clinical Signs of renal diseaseprior to the end of the Waiting Period, anyrenal Treatments and Medications are notcovered, as well as any related conditionsthat may develop. This includes but is notlimited to: vomiting, diarrhea, dehydration,constipation, blood pressure or pH issues,and cardiac complications.

f. Osteosarcoma diagnosed or showingClinical Signs within the Orthopedic WaitingPeriod.

For the purposes of these exclusions,Temporary Conditions that started prior to theend of the Waiting Period that have not shownany Clinical Signs for a period of twelve (12)consecutive months shall not be considered

Pre-existing Conditions.

Specific situations include but are not limited to:

i. If your Pet showed Clinical Signs ofany Dermatological Condition prior tothe end of the Waiting Period, your Petmust be free of any DermatologicalConditions for twelve (12) consecutivemonths before any DermatologicalConditions may be covered again.

ii. If your Pet has been treated forUndiagnosed vomiting and/or diarrheaprior to the end of your Pet’s WaitingPeriod, your Pet must be free ofconditions with the same Clinical Signsfor twelve (12) consecutive monthsbefore any conditions with the sameClinical Signs may be covered again.

2. Preventative Care including, but not limited to,wellness exams or tests; preventativeTreatment, tests or diagnostic procedures;vaccinations; flea and other parasite prevention;spaying or castration (including preventativesterilization surgery, such as for Treatment forcryptorchidism, chimerism, or chromasonalabnormalities); grooming and de-matting;

3. Treatments for Accidents or Illnesses arisingfrom any Pre-existing behavioral problems. Forexample, a dog that has persistently eaten rocksor foreign objects prior to the Pet Original StartDate shall not be covered for Treatment duringthe policy period for similar episodes. A dogwho has shown any signs of Aggression prior tothe Pet Original Start Date shall not be coveredfor Treatment for Aggression or dog fights;

4. Alternative Treatment: Including but not limitedto: Reiki, Magnet therapy, Prolotherapy, Ozone,Hyberbaric Oxygen, electroacupuncture,Veterinary Orthopedic manipulation, Massage,Bicom, TENS and nutritional counseling.

5. More than the first submitted anestheticremoval of an ingested foreign body in one (1)period of insurance;

6. Any Illness as a result of a covered Accidentthat is not part of the initial course of Treatmentfor that Injury. For example, future Treatment(s)for liver damage from an accidental poisoningincident. This exclusion does not apply topolicies with Illness Coverage;

7. The cost of boarding your Pet including medicalboarding;

8. Costs of Treatments, including medicalboarding, arising from your decision to pursue acourse of Treatment other than that which wasrecommended to you by your Veterinarian,unless specifically authorized by us prior toTreatment. Examples include:

a. Cost of Treatments continued after aVeterinarian has recommended a Pet beeuthanized for humane reasons;

b. Ignoring a Veterinarian’s recommendationto amputate a leg, resulting in extra costsassociated with Treatment of gangrene;

c. Ignoring a Veterinarian’s recommendationto remove an eye, resulting in extra costsassociated with chronic eye issues;

9. Treatment for any Injury or Illness deliberatelycaused by you, your family members, anyoneliving with you, or any other persons who havecare, custody, or control of your Pet;

10. Treatment for Injury or Illness caused bydeliberate endangerment of your Pet, such asorganized fighting;

11. Treatment for Injury or Illness caused bypersistent neglect of your Pet;

12. Cost for Treatment of Injury or Illness that ariseout of racing, commercial guarding, Organizedfighting or any other occupational, professionalor business use of your Pet unless specificallyauthorized by us prior to the Pet Original StartDate as shown on the Schedule Page;

13. Cosmetic, aesthetic, or elective surgeryincluding tail docking, ear cropping, de-clawingor any other surgical procedure not related toInjury or Illness;

14. Natural supplements, vitamins, and all foods,whether prescribed or not, including but notlimited to Denamarin, glucosamine, probiotics,shampoo, conditioner, or ear cleaner. Thisexclusion does not apply to Hill's y/d diet (or asimilar preparation by another manufacturer)used in Treatment for feline hyperthyrodism;

15. Treatments for any Illness for which a vaccine isavailable for your Pet to prevent such Illness andfor which vaccination is both recommended byyour Veterinary Provider and rejected by you.For the purposes of this exclusion, such Illnessshall include but not be limited to “corevaccinations” as stated by the American AnimalHospital Association Canine Vaccine Guidelinesfor your dog or “highly recommended

vaccinations” as stated by the AmericanAssociation of Feline Practitioners;

16. Any administration fees charged by a VeterinaryProvider or others, including chart set-up fee orfor providing information which may be requiredby us;

17. Professional fees and services performed byVeterinary Provider for his/her own cat or dog;

18. Costs for any Treatment for:

a. Organ transplants;

b. Genetic/chromosome testing not used fordiagnosis;

c. Procedures to determine the suitability orcategorization of your Pet for breeding orgenealogical purposes, including PennHIPand OFA evaluations, not used fordiagnosis; or

d. Costs resulting from breeding, pregnancy,whelping or queening.

19. Costs for any Treatment arising from:

a. Avian, swine, or any other type of influenzaor any mutant variation;

b. Intentional slaughter by, or under, the orderof any government or public or localauthority;

c. Epidemics or pandemics as declared by theU.S. Department of Agriculture;

20. Costs for any Treatment arising from a nuclearreaction, radiation, radioactive contamination orthe discharge of a nuclear device, whethercontrolled or uncontrolled, accidentally orotherwise;

21. Costs for any Treatment arising from achemical, biological, bio-chemical orelectromagnetic weapon, device, agent ormaterial whether controlled or uncontrolled,accidentally or otherwise;

22. Costs for any Treatment arising from war,invasion, acts of foreign enemies, hostilities(whether war be declared or not), civil war,rebellion, revolution, insurrection, military orusurped, strikes, riots, or civil commotion.

PART V - LIMITS OF INSURANCE

Regardless of the number of Claims made or

covered Injuries or Illnesses that occur duringthe period of insurance, our total liability foreach period of insurance for all covered benefitsshall not exceed the amounts shown on theSchedule Page(s) under Annual Maximum.

PART VI - OTHER TERMS AND CONDITIONS

1. Paying Your Premiums

Your policy does not become legally bindinguntil you have paid your premium. The premiumis payable when you take out a new policy andwhen you renew an existing policy. Your policyis an annual contract of insurance with theoption to pay annually or monthly.

Premiums may increase at renewal for AnnualMaximum increase, age, veterinary costinflation, and other actuarial changes. Premiumsmay also change during the policy term forchanges in your address, your Pet’s details, orother policy parameters.

You must pay your premiums in full and on timeto remain covered. Your policy willautomatically renew at the end of your policyterm unless you tell us otherwise or wenon-renew under rare circumstances.

Upon payment of a Claim under this policy, anypremium that is due and unpaid may bededucted from the Claim.

2. Cancellation

You may cancel this policy at any time bycalling, emailing or writing to us and stating thefuture date that you wish the cancellation to beeffective.

We will not back date a cancellation for a periodgreater than sixty (60) days in the absence ofproof that your Pet has died or is no longer inyour possession.

We may cancel this policy at any time withinthe first sixty (60) days of the policy period.To cancel this policy, we will mail you a noticeof cancellation to the named insured shown onthe Declaration at the last known addressshown in our records. If we cancel this policywithin the first sixty (60) days after theeffective date, notice of cancellation will bemailed at least thirty (30) days before theeffective date of the cancellation.

After this policy has been in effect for morethan sixty (60) days, notice of cancellation dueto any reason other than nonpayment of

premium will be mailed at least sixty (60) daysbefore the effective date of cancellation.

If we cancel this policy at any time due tononpayment of premium, notice of cancellationwill be mailed at least thirty (30) days beforethe effective date of the cancellation.

After this policy is in effect for more than sixty(60) days, or if this is a renewal or continuationpolicy, we may only cancel for one or more ofthe following reasons:

a. You fail to pay your premium by the duedate in accordance with the policy terms.

b. The policy was obtained through fraud,misrepresentation or concealment in yourapplication, the content of which isspecifically incorporated into and as amaterial term of this policy.

c. We have agreed to issue a new policy withthe same or an affiliated company.

d. The Department of Insurance of the stategoverning the policy determines that acontinuation of the policy could place us inviolation of that state' s insurance laws.

e. You fail to comply with the policy termsand conditions in a manner that prejudicesor negatively impacts our ability to properlyassess or evaluate the Claim or othermaterial rights we have under the policy.

f. Failure to provide us with information wehave requested that is directly relevant tothe Coverage provided under this policy orany Claim.

g. The use or threat of violence or aggressivebehavior against our staff, contractors orproperty.

h. The use of foul or abusive language.With respect to cancellation, this policy isneither severable nor divisible. Any cancellationwill be effective for all Coverage for all personsand all Pets. If this policy is canceled, Coveragewill not be provided as of the effective date ofthe cancellation shown on the notice ofcancellation.

3. Cancellation Refund

Upon cancellation, you may be entitled to apremium refund. If you provide us notice ofcancellation within thirty (30) days of the PolicyOriginal Start Date and you have made no

Claim, we will refund the premium you paid usand the policy will be canceled.

If you have made a Claim within thirty (30) daysof the effective date, the premiums paid for orallocable to the first month of Coverage becomefully earned upon the submittal of the Claim,and you will only receive a refund for anypremiums paid for periods beyond the firstmonth.

After the first thirty (30) days of the policyperiod, we will compute any refund due on adaily pro-rata basis based on the terminationdate of the policy.

4. Nonrenewal

If we decide not to renew or continue thispolicy, we will mail notice of non-renewal to thenamed insured shown on the Declaration at thelast known address appearing in our records.Notice, including the reason for non-renewal,will be mailed at least sixty (60) days before theend of the policy period.

5. Misrepresentation, Concealment, or Fraud

This policy is void in any case of fraud,intentional concealment or misrepresentation ofa material fact, by you or any other insured, atany time, concerning:

a. This policy

b. Your Pet;

c. Your interest in your Pet; or

d. A Claim under this policy.

6. Rights

In the event we reimburse a Claim contrary tothe policy terms and conditions, this paymentwill not constitute a waiver of our rights toapply the terms and conditions retrospectivelyas they stand to any paid Claims or to anyfuture Claims for that or any related condition.We reserve our right to recover from you anyClaim reimbursement paid in error.

7. Splitting of Charges

In the event an Allowable Charge is for bothcovered and non-covered conditions, theAllowable Charge may be split into a coveredand a non-covered Allowable Charge tocalculate your Claim reimbursement.

8. Increasing Coverage

In the event you choose to increase your Pet’sCoverage after the Original Pet Start Date,including lowering your Deductible, the WaitingPeriod and the determination of Pre-ExistingConditions reset as of the date of the Coveragechange. There is no reset for a decrease inCoverage.

We will automatically renew your policy atexpiration unless you are otherwise notified ofnonrenewal. We may change the premium,Reimbursement Percentage amounts,Deductible, policy terms and conditions atrenewal. You will be notified of changes inwriting.

9. Allowable Charges Disputes

In the event that your Veterinary Providercharges an amount for Treatments in excess ofthose typically charged in your geographic areafor identical Treatments or Professional Servicesor Treatments that are not Medically Necessary,we reserve the right to dispute the amount ofthe Allowable Charges to be reimbursed. Shouldwe fail to resolve such disputes to yoursatisfaction, such disputes shall be resolved bymeans of the procedures listed in Part VIII:Appeals and Complaints of the policy.

10. Promotional Offers Insurance

Each named insured may occasionally receivepromotional offers, which include but are notlimited to gift cards, coupons, gift certificates,and items of merchandise. The maximum valueof any promotional item will not exceed $25.00.

11. Other Insurance

a. If your Pet is covered by more than onepolicy issued by us, we will not pay morethan the highest amount payable under anyone policy.

b. This insurance is excess over any otherinsurance covering your Pet that is providedby a policy issued by any other insurancecompany, whether collectable or not.

It is your responsibility to notify us in the eventthat other insurance is in force. Failure to do somay be considered concealment and may renderCoverage provided under this policy null andvoid and all outstanding Claims shall be forfeitedand not paid.

12. Transfer of Rights of Recovery Against Others

to Us

If the insured has rights to recover all or part ofany payment we have made under this policy,those rights are transferred to us. The insuredmust do nothing after loss to impair them. Atour request, the insured will bring "suit" ortransfer those rights to us and help us enforcethem.

13. Joint and Individual Interests

If there is more than one Named Insured on thispolicy, any Named Insured may cancel orchange this policy. The action of one NamedInsured shall be binding on all persons affordedCoverage under this policy.

14. Transfer

This policy may not be transferred to anotherperson without our written consent.This coverage is not transferable to other Pets.

15. Period of Insurance and Territory

This policy applies only to Injuries and/orIllnesses occurring during the policy periodshown on the Declaration and which occuranywhere in the world.

16. Electronic Delivery

By accepting the terms of this insurance asevidenced by the payment of premiums, it isagreed that, unless otherwise notified by you,all documents, notices and communicationsregarding this policy, other than documentrequired to be delivered by another method, maybe delivered to you by electronic mail using theemail associated with your account. It is yourresponsibility to keep your contact detailsincluding email current and correct.

17. Conformity to State Statutes

When this policy’s provisions are in conflict withthe statutes of the state in which this policy isissued, the terms and conditions are amendedto conform to such statutes.

1. Claim Procedure

Any Claim you make will be assessed fairly,reasonably and promptly against the informationyou provide and the terms of the policy.

a. All Claims must be submitted and receivedby us within sixty (60) calendar days afterthe next policy renewal date after the dateof the Claim's veterinary AllowableCharges. You must send us a Claim formthat has been properly completed. We willthen write to you with our decision.

b. We will not guarantee on the phone if wecover a Claim.

c. All Claims must be submitted on the Claimsform that we email you with your policydocuments.

d. You may also download the Claims formfrom our web site or print it at yourVeterinary Provider’s office. You may alsoask us to mail you a Claims form.

e. You must provide all itemized invoices fromyour Veterinary Provider along with yourcompleted Claim form before we willreimburse you. Save the originals in casewe require them from you.

f. You must cooperate with us in theinvestigation or settlement of the Claim.

We will send you an Explanation of Benefitsform that shows how we determined theamount to reimburse you for your Claim. If youdisagree with the outcome of your Claim, youmay dispute it as described in the followingpages.

The following describes the appeal process in theevent you are not satisfied with the way we havehandled your Claim or you are not happy with yourpolicy. All requests for an appeal must be submittedto us within ninety (90) days you were notified yourClaim was not covered or as soon as reasonablypracticable on other actions giving rise to yourcomplaint. You may contact us using the informationabove.

Procedure

1. First Appeal

Once we receive your formal appeal orcomplaint, we will contact you within five (5)working days to tell you what we are doingabout it. We will answer you within two (2)weeks. If it takes us longer than two (2) weeksto complete our review, we will tell you whenyou can expect an answer.

2. Second Appeal

If you disagree with our decision in the firstappeal, you may request further appeal via anexternal review. A request for a Second Appealmust be made within thirty (30) days of thedate of issuance of our First Appeal decision toyou. An impartial Veterinarian selected byEmbrace, who is independent of Embrace andthe Insured, who is not controlled by us, andwho has not been a part of your Pet’s veterinaryteam previously, will conduct an externalreview. Embrace will provide the decision to theInsured within three (3) working days ofreceiving the independent Veterinarian’s report.

3. Complaints

If you disagree with the decision made at anytime during the appeal process, you have theright to file a complaint with your StateDepartment of Insurance. Please refer to yourindividual state’s department for details andapplicable rules and laws.
