    REGULATIONS RGLEMENTS

    Regulations 3. (1) Subject to subsection (2), the Gover-nor in Council may make regulations for carry-ing out and giving effect to the provisions ofthe Convention, and, without restricting thegenerality of the foregoing, may make regula-tions

    (a) for the detention and transportation ofcontainers that do not carry a valid Safety

    Approval Plate as required by the Conven-tion;

    (b) for the detention and transportation ofcontainers in respect of which there is signif-icant evidence that the condition of the con-tainer creates an obvious risk to safety;

    (d) describing the circumstances and themanner in which the Minister may dispose ofdetained containers that have not been repos-sessed by the person entitled thereto;

    (e) requiring that the Safety Approval Plateaffixed to any or all containers approved un-der the authority of the Government ofCanada be in both English and French; and

    (f) describing the circumstances in which theMinister must obtain the concurrence of an-other specified Minister in the choice of the

    person or persons to be authorized to conductan inquiry under subsection 13(1).

    Limitations (2) No regulation made under subsection (1)may

    (a)

    authorize any person to prevent the re-moval of the contents of a container; or

    (b) authorize the continued detention of acontainer after its contents have been re-moved, except where an inspector believeson reasonable grounds that there is about to

    be a contravention of a regulation respectingthe transportation of containers made under

    paragraph (1)(a) or (b).

    Inspectors 4. (1) The Minister may designate as an in-spector for the purposes of this Act and the reg-ulations any person who, in the Ministersopinion, is qualified to be so designated.

    (2) The Minister shall furnish every inspec-tor with a certificate of his designation as an in-spector setting out the provisions of this Act,the regulations, the Convention and Annexes Iand II to the Convention that the inspector isauthorized to enforce, and, on boarding any ve-

    hicle or entering any place described in subsec-tion 5(1), an inspector shall, if so required, pro-duce the certificate to the person in chargethereof.

    5. (1) In addition to any powers that he mayhave pursuant to the regulations, an inspectormay at any reasonable time

    (a) go on board any vehicle, including aship, train, truck or aircraft, or enter any

    place in which he believes on reasonablegrounds that

    (i)

    there is significant evidence that thecondition of a container creates an obviousrisk to safety, or

    (ii) a provision of this Act or the regula-tions has been contravened;

    (b) go on board any vehicle, including aship, train, truck or aircraft, or enter any

    place in which he believes on reasonablegrounds there is a container, for the purposeof verifying that the container carries a validSafety Approval Plate as required by theConvention; and

    (c) examine any record or document re-quired under the regulations to be kept, andmake copies thereof or extracts therefrom.

    False statements (2) No person shall knowingly make anyfalse or misleading statement, either orally or inwriting, to an inspector engaged in carrying outhis duties or functions under this Act or the reg-ulations.

    7. (1) Every person who contravenes a pro-vision of this Act or the regulations is guilty ofan offence and liable on summary conviction toa fine not exceeding five thousand dollars.

    8. (1) Subject to this section and sections 9to 12, the Governor in Council may by orderamend the schedule to reflect any amendmentto the Annexes to the Convention to which

    Canada has not objected as provided in theConvention.

    RECOGNIZING the need to maintain a high level of safety of hu-man life in the handling, stacking and transporting of containers,

    MINDFUL of the need to facilitate international container trans-port,

    RECOGNIZING, in this context, the advantages of formalizingcommon international safety requirements,

    CONSIDERING that this end may best be achieved by the conclu-sion of a Convention,

    HAVE DECIDED to formalize structural requirements to ensuresafety in the handling, stacking and transporting of containers in thecourse of normal operations, and to this end

    HAVE AGREED as follows:

    The Contracting Parties undertake to give effect to the provisionsof the present Convention and the Annexes hereto, which shall con-stitute an integral part of the present Convention.

    DEFINITIONS

    For the purpose of the present Convention, unless expressly pro-

    vided otherwise:1. Container means an article of transport equipment:

    (a) of a permanent character and accordingly strong enough to besuitable for repeated use;

    (b) specially designed to facilitate the transport of goods, by oneor more modes of transport, without intermediate reloading;

    (c) designed to be secured and/or readily handled, having cornerfittings for these purposes;

    (d) of a size such that the area enclosed by the four outer bottomcorners is either:

    (i) at least 14 sq.m. (150 sq.ft.) or

    (ii) at least 7 sq.m. (75 sq.ft.) if it is fitted with top corner fit-

    tings;the term container includes neither vehicles nor packaging; howev-er, containers when carried on chassis are included.

    2. Corner fittings means an arrangement of apertures andfaces at the top and/or bottom of a container for the purposes of han-dling, stacking and/or securing.

    3. Administration means the Government of a ContractingParty under whose authority containers are approved.

    DFINITIONS

    4. Approved means approved by the Administration.

    5. Approval means the decision by an Administration that adesign type or a container is safe within the terms of the present Con-vention.

    6. International transport means transport between points ofdeparture and destination situated in the territory of two countries toat least one of which the present Convention applies. The presentConvention shall also apply when part of a transport operation be-tween two countries takes place in the territory of a country to whichthe present Convention applies.

    7. Cargo means any goods, wares, merchandise and articles ofevery kind whatsoever carried in the containers.

    8. New container means a container the construction of whichwas commenced on or after the date of entry into force of the presentConvention.

    9. Existing container means a container which is not a newcontainer.

    10. Owner means the owner as provided for under the nation-al law of the Contracting Party or the lessee or bailee, if an agreement

    between the parties provides for the exercise of the owners responsi-

    bility for maintenance and examination of the container by suchlessee or bailee.

    11. Type of container means the design type approved by theAdministration.

    12. Type-series container means any container manufacturedin accordance with the approved design type.

    13. Prototype means a container representative of those manu-factured or to be manufactured in a design type series.

    14. Maximum Operating Gross Weight or Rating or Rmeans the maximum allowable combined weight of the container andits cargo.

    15. Tare Weight means the weight of the empty container in-cluding permanently affixed ancillary equipment.

    16. Maximum Permissible Payload or P means the differ-ence between maximum operating gross weight or rating and tareweight.

    3. Le terme Administration dsigne le Gouvernement de laPartie Contractante sous lautorit de laquelle les conteneurs sontagrs.

    Par propritaire , on entend soit le propritaire au sens de lalgislation nationale de la Partie Contractante, soit le locataire bailou le dpositaire si les parties un contrat conviennent que le loca-taire bail ou le dpositaire assumera la responsabilit du propritaireen ce qui concerne lentretien et lexamen du conteneur conform-ment aux dispositions de la prsente Convention.

    11. Par type de conteneur , on entend le type de constructionagr par lAdministration.

    12. Par conteneur de la srie , on entend tout conteneurconstruit conformment au type de construction agr.

    13. Par prototype , on entend un conteneur reprsentatif desconteneurs qui ont t ou qui seront construits dans une mme srie.

    14. Lexpression masse brute maximale de service ou R dsigne la masse totale maximale admissible du conteneur et de sonchargement.

    15. Le terme tare dsigne la masse du conteneur vide, y com-pris les accessoires fixs demeure.

    16. Lexpression charge utile maximale admissible ou P reprsente la diffrence entre la masse brute maximale de service etla tare.

    ARTICLE III ARTICLE III

    APPLICATION

    1. The present Convention applies to new and existing containersused in international transport, excluding containers specially de-signed for air transport.

    2.

    Every new container shall be approved in accordance with theprovisions either for type-testing or for individual testing as con-tained in Annex I.

    3. Every existing container shall be approved in accordance withthe relevant provisions for approval of existing containers set out inAnnex I within 5 years from the date of entry into force of the presentConvention.

    ARTICLE IV ARTICLE IV

    TESTING, INSPECTION, APPROVALANDMAINTENANCE

    1. For the enforcement of the provisions in Annex I every Admin-istration shall establish an effective procedure for the testing, inspec-tion and approval of containers in accordance with the criteria estab-lished in the present Convention, provided however that anAdministration may entrust such testing, inspection and approval toorganizations duly authorized by it.

    2. An Administration which entrusts such testing, inspection andapproval to an organization shall inform the Secretary-General of theInter-Governmental Maritime Consultative Organization (hereinafterreferred to as the Organization) for communication to ContractingParties.

    3. Application for approval may be made to the Administration ofany Contracting Party.

    4. Every container shall be maintained in a safe condition in ac-cordance with the provisions of Annex I.

    5. If an approved container does not in fact comply with the re-quirements of Annexes I and II the Administration concerned shalltake such steps as it deems necessary to bring the container into com-

    pliance with such requirements or to withdraw the approval.

    3. La demande dagrment peut tre adresse lAdministrationde toute Partie Contractante.

    4. Tout conteneur doit tre maintenu dans un tat satisfaisant dupoint de vue de la scurit, conformment aux dispositions de lAn-nexe I.

    5. Si un conteneur agr ne rpond pas aux rgles des Annexes I etII, lAdministration intresse prendra les mesures quelle juge n-

    cessaires pour faire en sorte que le conteneur soit conforme auxditesrgles ou pour retirer lagrment.

    ARTICLE V ARTICLE V

    ACCEPTANCEOFAPPROVAL

    1. Approval under the authority of a Contracting Party, grantedunder the terms of the present Convention, shall be accepted by theother Contracting Parties for all purposes covered by the present Con-vention. It shall be regarded by the other Contracting Parties as hav-ing the same force as an approval issued by them.

    2. A Contracting Party shall not impose any other structural safetyrequirements or tests on containers covered by the present Conven-tion, provided however that nothing in the present Convention shall

    preclude the application of provisions of national regulations or legis-lation or of international agreements, prescribing additional structuralsafety requirements or tests for containers specially designed for thetransport of dangerous goods, or for those features unique to contain-ers carrying bulk liquids or for containers when carried by air. Theterm dangerous goods shall have that meaning assigned to it by in-ternational agreements.

    APPROBATIONDELAGRMENT

    1. Une Partie Contractante ne doit imposer aucune autre prescrip-tion ni aucun autre essai en matire de scurit de construction desconteneurs auxquels sapplique la prsente Convention; toutefois, au-cune disposition de la prsente Convention nexclut lapplication derglementations ou lois nationales ou daccords internationaux pres-crivant des rgles ou des essais supplmentaires en matire de scuri-t de construction des conteneurs spcialement conus pour le trans-

    port de marchandises dangereuses, ou en matire de scurit deconstruction des lments caractristiques de conteneurs transportantdes liquides en vrac, ou en matire de scurit de construction desconteneurs quand ils sont transports par air. Lexpression mar-chandises dangereuses aura le sens qui lui est donn par les accordsinternationaux.

    ARTICLE VI ARTICLE VI

    CONTROL

    1. Every container which has been approved under article III shall

    be subject to control in the territory of the Contracting Parties by offi-cers duly authorized by such Contracting Parties. This control shall

    be limited to verifying that the container carries a valid Safety Ap-proval Plate as required by the present Convention, unless there issignificant evidence for believing that the condition of the containeris such as to create an obvious risk to safety. In that case the officercarrying out the control shall only exercise it in so far as it may benecessary to ensure that the container is restored to a safe condition

    before it continues in service.

    CONTRLE

    2. Where the container appears to have become unsafe as a resultof a defect which may have existed when the container was approved,the Administration responsible for that approval shall be informed bythe Contracting Party which detected the defect.

    uary 1973 at the Office of the United Nations at Geneva and subse-quently from 1 February 1973 until 31 December 1973 inclusive atthe Headquarters of the Organization at London by all States Mem-

    bers of the United Nations or Members of any of the SpecializedAgencies or of the International Atomic Energy Agency or Parties tothe Statute of the International Court of Justice, and by any otherState invited by the General Assembly of the United Nations to be-come a Party to the present Convention.

    2. The present Convention is subject to ratification, acceptance orapproval by States which have signed it.

    3. The present Convention shall remain open for accession by anyState referred to in paragraph 1.

    4.

    Instruments of ratification, acceptance, approval or accessionshall be deposited with the Secretary-General of the Organization(hereinafter referred to as the Secretary-General).

    1. The present Convention shall enter into force twelve monthsfrom the date of the deposit of the tenth instrument of ratification, ac-ceptance, approval or accession.

    2. For each State ratifying, accepting, approving or acceding to thepresent Convention after the deposit of the tenth instrument of ratifi-cation, acceptance, approval or accession, the present Conventionshall enter into force twelve months after the date of the deposit by

    such State of its instrument of ratification, acceptance, approval oraccession.

    3. Any State which becomes a Party to the present Convention af-ter the entry into force of an amendment shall, failing an expressionof a different intention by that State,

    (a) be considered as a Party to the Convention as amended; and

    (b) be considered as a Party to the unamended Convention in rela-tion to any Party to the Convention not bound by the amendment.

    shall be communicated by the Secretary-General to all ContractingParties for their acceptance.

    (c) Such amendment shall come into force twelve months after thedate on which it is accepted by two-thirds of the Contracting Par-ties. The amendment shall come into force with respect to all Con-tracting Parties except those which, before it comes into force,make a declaration that they do not accept the amendment.

    3. Amendment by a Conference:

    Upon the request of a Contracting Party, concurred in by at leastone-third of the Contracting Parties, a Conference to which the Statesreferred to in article VII shall be invited will be convened by the Sec-retary-General.

    4. On entry into force any amendment shall, for all ContractingParties which have not objected to the amendment, replace and super-sede any previous provision to which the amendment refers; an ob-

    jection made by a Contracting Party shall not be binding on other

    Contracting Parties as to acceptance of containers to which thepresent Convention applies.

    5. The Secretary-General shall inform all Contracting Parties andMembers of the Organization of any request and communication un-der this article and the date on which any amendment enters intoforce.

    6. Where a proposed amendment to the Annexes has been consid-ered but not adopted by the Maritime Safety Committee, any Con-tracting Party may request the convening of a Conference to which

    2. A Contracting Party which has communicated an objection toan amendment to the Annexes may denounce the present Conventionand such denunciation shall take effect on the date of entry into forceof such an amendment.

    TERMINATION

    The present Convention shall cease to be in force if the number of

    Contracting Parties is less than five for any period of twelve consecu-tive months.

    ARTICLE XIII ARTICLE XIII

    SETTLEMENTOFDISPUTES

    1. Any dispute between two or more Contracting Parties concern-ing the interpretation or application of the present Convention whichcannot be settled by negotiation or other means of settlement shall, atthe request of one of them, be referred to an arbitration tribunal com-

    posed as follows: each party to the dispute shall appoint an arbitratorand these two arbitrators shall appoint a third arbitrator, who shall bethe Chairman. If, three months after receipt of a request, one of the

    parties has failed to appoint an arbitrator or if the arbitrators havefailed to elect the Chairman, any of the parties may request the Secre-tary-General to appoint an arbitrator or the Chairman of the arbitra-tion tribunal.

    2. The decision of the arbitration tribunal established under theprovisions of paragraph 1 shall be binding on the parties to the dis-pute.

    3. The arbitration tribunal shall determine its own rules of proce-dure.

    4. Decisions of the arbitration tribunal, both as to its procedureand its place of meeting and as to any controversy laid before it, shall

    be taken by majority vote.

    5. Any controversy which may arise between the parties to the dis-pute as regards the interpretation and execution of the award may besubmitted by any of the parties for judgment to the arbitration tri-

    bunal which made the award.

    3. Any Contracting Party which has formulated a reservation un-der paragraph 1 may withdraw it at any time by notification to theSecretary-General.

    under article VII;(b) the dates of entry into force of the present Convention in ac-cordance with article VIII;

    (c) the date of entry into force of amendments to the present Con-vention in accordance with articles IX and X;

    (d) denunciations under article XI;

    (e) the termination of the present Convention under article XII.

    (b) On each container for which the construction is commenced onor after January 1, 1984 all maximum gross weight markings onthe container shall be consistent with the maximum gross weightinformation on the Safety Approval Plate.

    (c) On each container for which the construction was commencedbefore January 1, 1984 all maximum gross weight markings on thecontainer shall be made consistent with the maximum gross weight

    information on the Safety Approval Plate not later than January 1,1989.

    2. (a) The Plate shall contain the following information in at leastthe English or French language:

    CSC SAFETY APPROVAL

    Country of approval and approval reference

    Date (month and year) of manufacture

    Manufacturers identification number of the container or, in thecase of existing containers for which that number is unknown,the number allotted by the Administration

    Maximum operating gross weight (kilogrammes and lbs.)

    Allowable stacking weight for 1.8 g (kilogrammes and lbs.)

    Transverse racking test load value (kilogrammes and lbs.).

    (b) A blank space should be reserved on the Plate for insertion ofend-wall and/or side-wall strength values (factors) in accordancewith paragraph 3 of this Regulation and Annex II, tests 6 and 7. A

    blank space should also be reserved on the Plate for the first andsubsequent maintenance examination dates (month and year) whenused.

    3. Where the Administration considers that a new container satis-fies the requirements of the present Convention in respect of safetyand if, for such container, the end-wall and/or side-wall strength val-ues (factor) are designed to be greater or less than those stipulated inAnnex II, such values shall be indicated on the Safety ApprovalPlate.

    4.

    The presence of the Safety Approval Plate does not remove thenecessity of displaying such labels or other information as may be re-quired by other regulations which may be in force.

    1. The owner of the container shall be responsible for maintainingit in safe condition.

    2. (a) The owner of an approved container shall examine the con-tainer or have it examined in accordance with the procedure either

    prescribed or approved by the Contracting Party concerned, at in-tervals appropriate to operating conditions.

    (b) The date (month and year) before which a new container shallundergo its first examination shall be marked on the Safety Ap-

    proval Plate.

    (c) The date (month and year) before which the container shall bere-examined shall be clearly marked on the container on or as closeas practicable to the Safety Approval Plate and in a manner accept-

    (d) The interval from the date of manufacture to the date of thefirst examination shall not exceed five years. Subsequent examina-tion of new containers and re-examination of existing containersshall be at intervals of not more than 30 months. All examinationsshall determine whether the container has any defects which could

    place any person in danger. As a transitional provision, any re-quirements for marking on containers the date of the first examina-tion of new containers or the re-examination of new containerscovered in Regulation 10 and of existing containers shall bewaived until January 1, 1987. However, an Administration maymake more stringent requirements for the containers of its own(national) owners.

    3. (a) As an alternative to paragraph 2, the Contracting Party con-cerned may approve a continuous examination programme if satis-fied, on evidence submitted by the owner, that such a programme

    provides a standard of safety not inferior to the one set out in para-graph 2 above.

    (b) To indicate that the container is operated under an approvedcontinuous examination programme, a mark showing the letters

    ACEP and the identification of the Contracting Party which hasgranted approval of the programme shall be displayed on the con-tainer on or as close as practicable to the Safety Approval Plate.

    (c) All examinations performed under such a programme shall de-termine whether a container has any defects which could place any

    person in danger. They shall be performed in connection with amajor repair, refurbishment, or on-hire/off-hire interchange and inno case less than once every 30 months.

    (d) As a transitional provision any requirements for a mark to indi-cate that the container is operated under an approved continuousexamination programme shall be waived until January 1, 1987.However, an Administration may make more stringent require-ments for the containers of its own (national) owners.

    4. For the purpose of this Regulation the Contracting Party con-

    cerned is the Contracting Party of the territory in which the owner isdomiciled or has his head office. However, in the event that the own-er is domiciled or has head office in a country the government ofwhich has not yet made arrangements for prescribing or approving anexamination scheme and until such time as the arrangements have

    been made, the owner may use the procedure prescribed or approvedby the Administration of a Contracting Party which is prepared to actas the Contracting Party concerned. The owner shall comply withthe conditions for the use of such procedures set by the Administra-tion in question.

    3. a) titre de variante des dispositions du paragraphe 2, la PartieContractante intresse peut agrer un programme dexamenscontinus si elle a acquis la conviction, sur la base des preuves pr-sentes par le propritaire, quun tel programme permettra dassu-rer un niveau de scurit qui ne soit pas infrieur celui vis au

    paragraphe 2 ci-dessus.

    b)

    Afin dindiquer que le conteneur est exploit dans le cadre dunprogramme agr dexamens continus, une marque comportant lesigle ACEP et le nom de la Partie Contractante ayant agr le

    programme doit tre appose sur le conteneur soit sur la plaquedagrment aux fins de la scurit soit le plus prs possible de cette

    plaque.

    c) Tous les examens effectus dans le cadre dun tel programmedoivent dterminer si le conteneur a des dfauts pouvant prsenterun danger pour quiconque. Ces examens doivent tre effectuschaque fois que le conteneur fait lobjet de rparations importantesou dune remise neuf et au dbut ou la fin des priodes de loca-tion; ils doivent en tout tat de cause, tre effectus au moins tousles 30 mois.

    d) titre transitoire, il est sursis jusquau 1erjanvier 1987 lap-plication de toutes dispositions en vertu desquelles on doit apposerune marque indiquant que le conteneur est exploit dans le cadredun programme agr dexamens continus. Toutefois, une Admi-nistration peut imposer des dispositions plus rigoureuses auxconteneurs appartenant des propritaires qui relvent de la juri-diction du pays.

    4. Aux fins de la prsente rgle, la Partie Contractante intres-se sentend de la Partie Contractante sur le territoire de laquelle le

    propritaire a son domicile ou son sige principal. Toutefois, si lepropritaire a son domicile ou son sige principal dans un pays dontle gouvernement na pas encore pris de dispositions en vue de pres-crire ou dapprouver un systme dexamen, il peut, jusqu ce que detelles dispositions aient t prises, utiliser la procdure prescrite ouapprouve par lAdministration dune Partie Contractante qui est dis-

    pose assumer le rle de la Partie Contractante intresse. Le pro-

    pritaire doit satisfaire aux conditions rgissant lutilisation des pro-cdures de cette nature, qui ont t fixes par lAdministration enquestion.

    To qualify for approval for safety purposes under the present Con-vention all new containers shall comply with the requirements set outin Annex II.

    DESIGNTYPEAPPROVAL

    In the case of containers for which an application for approval hasbeen submitted, the Administration will examine designs and witnesstesting of a prototype container to ensure that the containers will con-form to the requirements set out in Annex II. When satisfied, the Ad-ministration shall notify the applicant in writing that the containermeets the requirements of the present Convention and this notifica-tion shall entitle the manufacturer to affix the Safety Approval Plateto every container of the design type series.

    PROVISIONSFORAPPROVALBYDESIGNTYPE

    1. Where the containers are to be manufactured by design type se-ries, application made to an Administration for approval by designtype shall be accompanied by drawings, a design specification of thetype of container to be approved and such other data as may be re-quired by the Administration.

    2. The applicant shall state the identification symbols which willbe assigned by the manufacturer to the type of container to which theapplication for approval relates.

    3. The application shall also be accompanied by an assurance fromthe manufacturer that he will:

    (a) produce to the Administration such containers of the designtype concerned as the Administration may wish to examine;

    (b) advise the Administration of any change in the design or speci-fication and await its approval before affixing the Safety ApprovalPlate to the container;

    (c) affix the Safety Approval Plate to each container in the designtype series and to no others;

    (d) keep a record of containers manufactured to the approved de-sign type.

    This record shall at least contain the manufacturers identificationnumbers, dates of delivery and names and addresses of customers towhom the containers are delivered.

    4. Approval may be granted by the Administration to containersmanufactured as modifications of an approved design type if the Ad-

    ministration is satisfied that the modifications do not affect the validi-ty of tests conducted in the course of design type approval.

    5. The Administration shall not confer on a manufacturer authorityto affix Safety Approval Plates on the basis of design type approvalunless satisfied that the manufacturer has instituted internal produc-tion-control features to ensure that the containers produced will con-form to the approved prototype.

    DISPOSITIONSRELATIVESLAGRMENTPARTYPEDECONSTRUCTION

    1. Lorsque les conteneurs doivent tre construits en srie, la de-mande dagrment par type de construction doit tre adresse lAd-ministration, accompagne de plans ainsi que des spcifications dutype de conteneur qui doit faire lobjet de lagrment et de toutesautres informations que pourrait demander lAdministration.

    2. Le demandeur doit indiquer les marques didentification qui se-ront assignes par le constructeur au type de conteneur qui fait lobjetde la demande.

    3. La demande doit aussi tre accompagne dune dclaration duconstructeur par laquelle il sengage:

    a) mettre la disposition de lAdministration tout conteneur dutype de construction en question quelle peut vouloir examiner;

    b) informer lAdministration de toute modification concernant laconception ou les spcifications du conteneur, et napposer la

    plaque dagrment aux fins de la scurit quaprs avoir reu sonaccord;

    c) apposer la plaque dagrment aux fins de la scurit sur cha-cun des conteneurs des sries agres et sur aucun autre;

    d) conserver la liste des conteneurs construits conformment autype de construction agr.

    Sur cette liste seront indiqus au moins les numros didentificationattribus par le constructeur aux conteneurs, les dates de livraison desconteneurs et les noms et adresses des personnes auxquelles lesconteneurs sont livrs.

    4.

    Lagrment peut tre accord par lAdministration aux conte-neurs qui constituent une version modifie dun type de constructionagr, si elle juge que les modifications apportes nont pas deffetsur la validit des essais effectus en vue de lagrment par type deconstruction.

    5. LAdministration ne donnera au constructeur lautorisationdapposer la plaque dagrment aux fins de la scurit en se fondantsur lagrment par type de construction que lorsquelle se sera assu-re que le constructeur a instaur un systme de contrle de la pro-
