We have just completed two very successful and very informative City of Daphne candidate forums as I’m writing this article. Tuesday, August 9th, we hosted a forum for sixteen city council candidates. Wednesday, August 10th we hosted a forum for four mayoral candidates. We had 100% participation from all of the candidates. We had a great turnout of residents to hear what the candidates had to say with over eighty in attendance Tuesday night and over one hundred in attendance Wednesday night. The council candidates did a great job of making 5 minute presentations and then an informal and personal meet and greet. The mayoral candidates also did a great job of making opening statements, answering questions moderated by our board attorney, Patrick Collins, making closing statements, and also an informal meet and greet.
We sincerely appreciate the hard work, dedication, and vision that our current leaders have extended not only to Lake Forest, but to our beautiful City of Daphne, and the Eastern Shore. The city has expended significant resources in and around our neighborhood in recent history to improve road conditions, build sidewalks, build a new park, and
so on. While remaining financially responsible, they have made great strides at preserving and improving our quality of life. This board of directors has enjoyed a very positive and transparent relationship with all of our current leaders. Thank you just doesn’t say enough. We look forward to continuing this great relationship and collaborative effort with our newly elected leaders on August 23rd. I hope we all get to the polls and exercise our right to vote for the very people who will run our city for the next four years.
Lake Forest residents make up nearly half of the population of Daphne. We’re not just the largest subdivision in Daphne, nor Baldwin County, nor the State of Alabama. We’re the largest subdivision in the Southeast! Our properties take up a huge chunk of the I-10 and Hwy 98 corridor. Our Yacht Club sits on some of the flattest, most buildable parcels of land adjacent to Mobile Bay on the Eastern Shore. The potential
for our neighborhood is enormous and it is more than refreshing to have city leaders who appreciate the impact our neighborhood has on this city. As a resident of over thirty years, I can tell you that this has not always been the case.
Currently, we are in negotiations with the city to see if we can work out a lease, or better yet, a partnership at our boat launch. The city needs a viable boat launch. We need improvements to that property and boat channel that we won’t have the funds for many years to come. As your board of directors, we’re being diligent to ensure that the end result is a net positive for our residents as our private boat ramp will become public. Our city leaders are very responsible with our public grants and tax revenue to ensure that the end result is a net positive for the citizens of Daphne. I’m surely not bragging on myself, but I think we’ve got enough great minds involved to make this a mutually beneficial partnership for all of us. There is nothing set in stone yet, and it is very possible that this may never come to fruition.
I will take this opportunity however, to clear up some misinformation that is being propagated by the rumor mill with some cold hard facts. #1 Lake Forest is not even considering selling any property to the
City of Daphne. What is on the table is a lease, very similar to the lease of our land that made up our old Lake Nine golf course that is now Daphne Central Park. #2 The proposed area of the lease includes the boat ramp, the existing fuel dock, the wash down area in front of the ramp, the waterfront between the boat launch and A dock, and the contained area from our property line just North of the fuel tank to a currently ambiguous line from A dock to the road. This is just under one acre. It does not include the harbor shack, Yacht Club, A through D docks, our parking lot, or anything else. The city will have no part and no control of anything outside of the leased area. #3 We do not want to get rid of our fuel dispenser. We want to relocate it. The grant(s) that the city has at their disposal will not allow for a fuel tank or dispenser to be on the property. It is a deal breaker for the grant. Your board of directors and your city leaders understand and appreciate the significance of this water accessible fueling station. Our plan is to relocate the fuel tank to wherever will work best and move the dispenser to the end of A dock. #4 Dredging and channel marking are key to making this partnership attractive to Lake Forest. Not coincidentally, dredging and channel marking are key to making this a viable boat launch for the citizens of Daphne. Also not coincidentally, the cost of doing such is not in Lake Forest’s budget nor the City of Daphne’s. The money that will fund this will come from grants that the city will apply for. That feels
good to put in black and white. These are the facts, and by the powers that be, they are undisputed.
Getting us back to Lake Forest’s budget, we’ve had money allocated for the landscaping at Montclair Pool since this Spring. We couldn’t start the landscape project once the pool was open for the Summer, but come October 1st, (or there about) after the pools are closed, we’ve got a contract and a contractor ready to go to get the erosion of this property at bay and put a new face on the property with new sod and flowerbeds. That’s a very underwhelming description of what HMR has designed, but come Thanksgiving we plan to have it wrapped up and you can come see our efforts in revitalizing our neighborhood. Just to give you an example of the speed bumps we run into on a daily basis, we had to hire a plumber to replace the sewer pipe from the bathhouse to the road that was crushed and clogged. Upon digging the ditch, he uncovered a septic tank that the bathhouse was plumbed to! We can only assume that it has been like that since the pool was constructed in the 70’s and none of us knew. Thanks to Art Anderson, Danny Lyndall and Daphne Utilities, for providing us, at no charge, a tap and sewer line for us to tie our sewer line into so we can pump and fill the septic tank.
We’re still hoping to be able to remodel the Ridgewood Pool next year. Originally we hoped to do it prior to the swim season, but time and money are getting close to the wire. Unlike Montclair and Swim
& Racquet, Ridgewood has a leak in the plumbing very possibly below the pool. We’ve contracted a company to find this leak so we can include this repair in the scope of work to remodel the pool and property. I drive past the Ridgewood Pool numerous times daily. I just can’t wait to see the chain length fence topped with barbed wire disappear!
The physical and mechanical failures of our old buildings never stop. While we’re in the middle of our bathroom remodel at the Yacht Club, one of our A/C units dies. We contract to get that replaced, and then discover some structural damaged under the floor of the hallway by the ladies room. It turns out that the shower in there, I’m assuming as old as the building, has been leaking into the floor for decades. You just can’t make this stuff up!
We’re trying diligently to bring all of our amenities up to a standard that we’ll all be proud of. We’re trying diligently to execute a long range plan to remodel and replace our aging properties. It’s going to take years to get there, but we’re moving in the right direction. I’m proud of this board of directors and I’m proud to be a part of this team who puts so much time and effort into bettering our community. Please come support us at your monthly meetings. We’d love your input. We look forward to seeing you at the 19th Hole at 7PM every third Thursday of the month. Even more important than that, it’s the time of year to celebrate the greatest sport on Earth. Happy football!

August was the summer month that didn’t know where to go. It was either really hot or really wet. We’re counting on September being a fantastic month. With the start of the “R” months look for food specials at the Yacht Club for everybody, golf specials and tennis leagues restart.
School restarted on August 22nd. Please watch for school kids going and coming from the bus stops.
On August 9th, Lake Forest opened the 19th Hole to the 16 City Council candidates to make their pitches to Lake Forest residents and the residents of Daphne. It was the largest single forum
for the candidates during this election cycle. Under the new districting alignments, four of the Council candidates’ districts impact Lake Forest, and of course, all seven set the course for Daphne. On August 10th, Lake Forest had presentations by the 4 mayoral candidates. They were allowed 5 minutes to speak and then answered questions submitted by citizens and monitored by Board President, Steve Sasser, and Board attorney, Patrick Collins. The venue was packed, with Channel 5 and Gulf Coast newspaper reporting. It
showed the leadership role that Lake Forest is taking and should be taking.
The pool season goes until September 30th. All members, in good standing, who have a pool access card from previous years, found those cards activated on May 1st. The pools are open 7 days a week from 8:00 am to 7:00pm. For those who don’t have a pool card please contact the office at 626-0788. The Swim and Racquet pool is also available for private parties. If you have any questions please don’t hesitate to call me. If there are ever any issues at a pool, please call the Pro Shop at 251-621-4728. They know how to contact the appropriate person. Remember to
put your cards away in a safe, memorable place. By doing so, owners that are here next year and in good standing, the cards will be reactivated.
The Yacht Club has many family oriented nights as well as a swing set play area for the kids. The BOGO burger night is huge and it’s a great deal and a great meal for Lake Forest members. Thursday night is family night, all you can eat buffet with salads, entrees and a dessert. Have fun.
You don’t have to be a golf member to play the golf course. Come out with family and friends and enjoy the best golf course in the area for a members only price. The course
is healthy and in great condition.
As a reminder, summer is a time when work is done on homes and the property. Please remember to check with the Lake Forest Architectural Committee before you do any work. We do allow members to walk on the golf course when the pin flags have been removed. If you see the flags in, do not go on the course, for your own safety. We have a lot of dogs around here. Please be considerate of your neighbors and clean up behind your pet; thank you. Lake Forest has a storage area for boats and trailers; remember unless they’re behind a permitted fence that they must be stored off property.

Daphne Art Center ClassesThe Daphne Art Center is a Non-profit organization dedicated to helping the community to advance in the arts through weekly art classes for adults and children. They are located at 1704 6th street in Daphne, which is right behind City hall. They can be reached at 251-586-8096. They are a small organization which allows participants to learn how to paint and draw, in all mediums. Every summer they hold summer art classes for children. The kids who attend love coming to paint. This also gives Mom an hour or two to get other things accomplished. Perhaps you’ve never painted, or as they say, drawn a straight line, this could be the place for you to learn a new talent. If you have EVER thought to your self, "Oh, I wish I could do that," then you are a prime candidate for the Art Center. GO and visit; you'll be welcome. They have fall classes starting up this week. The “Fall Months” are finally here! Kids are back in school and long awaited football is finally here. This is a great time of year to be outside, especially after the extreme heat of the summer months. From now through December, historically are great temperature months for our part of the country. It’s also a great time for golf!
Here are a few events that are coming soon. Monday, August 5th is our Annual Labor Day Scramble which is
open to all. Saturday and Sunday, August 17th and 18th, is our Annual Men’s Club Championship. This event we crown our Men’s Club Champion and Senior Club Champion. Sunday, August 25th is the fall tournament for our Senior Couples League. This is always a fun event and it’s highlighted with dinner at the Yacht Club after play.

September is finally here and the water has cleared up after a huge influx of rain and fresh water in August. The water temps are in the upper 80’s and lower 90’s and finally beginning to show reasonable amounts of salinity in the upper bay and Delta. Strong southern winds have pushed the cloudy water north and brought in some salt in the upper delta along the Appalachee River and Tensaw River to the Raft River. Specks are scattered out from Point Clear to Daphne past the Causeway and all along the ship channel into the Mobile River. Fish the bottom on all the reefs in the bay where the water is cooler. Slip corks, rigged Carolina style with a live shrimp, is
the best way to fish after the sun gets up. So, try and find some clear water and work the docks and fishing reefs along the bay. Speckled trout and reds will be looking for a quick meal and the best thing for them is a live shrimp under a slip cork or a popping cork. If you can’t find shrimp, artificial baits such as a soft plastic on a jig head, or a top water plug such as a Mirrorlure Top Dog or She Dog will work just as well.
The Flounder and Redfish have started showing up in good numbers along the eastern end of the causeway and upper bay, so look around sandy points that face into the current. Another good place will be around pilings of the docks and boat houses along the bay. Fishing with bull minnows on a Carolina rig is the best bet but a soft plastic on a jig head works great also.
Now is the time to get out and catch fish while there is plenty of bait and the water temperatures are in the 80 degree range. Good luck this month and remember to stay hydrated, use plenty of sunscreen and stay safe.

Contesting a Last Will and TestamentBy: Drew Wenzel, Caldwell Wenzel & Asthana, PC
A person who creates a Last Will and Testament is oft en re-ferred to as a Testator, if male, or a Testatrix, if female. A Testator’s Last Will and Testament may be challenged when someone claims that the Will is invalid. Usually, the challenger is an individual who is an heir and/or a distributee of the estate of deceased Tes-tator. A Will may be found to be invalid on many grounds, some of which include that the Will of the Testator was not duly execut-
ed or that at the time of execution of said Will, the deceased had an unsound mind, or the deceased was acting under undue infl uence of another. Generally, due execution of a will pertains to the age of the Testator, and includes requirements that the will be in writing, signed by the Testator, in the presence of two witnesses, signed by such witnesses, and in the presence of and signed by a notary public. Soundness of mind also known as testamentary capacity relates to whether the Testator understood what a Will does, knew what property he or she owned and was aware of whom such property was to be distributed to. Other common objections to due execution and soundness of mind include accusations that the creation and execution of will was procured by fraud or undue infl uence. Undue infl uence most certainly complicates the understanding of whether a Testator had the requisite capacity when he signed his Last Will and Testament. Undue infl uence addresses the dynamic between the Testator and another person. It outlines the intentional use of infl uence, authority, deception, and manipulation to gain control of the decision making of the Testator. In doing so, such individuals were able to unduly infl uence the Testator’s decision making for their fi nancial benefi t and to the detriment of the natural heirs of the Testator.
