NEW ZONING ORDINANCE -- BOARD OF ZONING APPEALS

The League of Women Vot'ers o.f C~llier County presented acomprehensive statement during the proceedings of the Board ofCounty Commissioners t December 22, 198~, 'public hearing concerning:the proposect new Zoning Ordinance.. This statement, in part, was·supportive toward the establishment of a separate Board of ZoningAppeals and included the following facts and suggestions:

1. That The Laegue of Women Voters of the state of F'loridaestablished in 1975 the following position: "We supportprovision for an appeals board to arbitrate conflictsbetween governrnenta1 bodies and between citizens andgovernmental bodies.:.• It

That a~though there are no provisions within the FloridaStatutes., per se·, for the establishment oX a Board. 0'£Zoning Appeals, there are provisions within Section 28-13of the CO'llier County Code of Law and Ordinances for theestablishment of such a body. These include compositionand numJ)ers of Board members:" terms of office., vacanciesand quorum requirements.

3. That this quasi-judicial body conduct its business throughthe procedure oX sworn testimony, and that all Board. membersbe without conflicts' of interest as a position (1975) ofthe National L.eague of Women Voters states: -- that "indecisions about land use ••• the federa:L government shouldexert~eadership to. minimize conflict of interest on thepart of those who make dec::isions about land resources;"

At ii:s final hearing on J-anu'ary---'S-, 1.981, the B-oar-d-of---Geanty--­Commissioners -~ after some confusion during. the proceedings re .motions, et aI, to this subject -- eventually decided to continuethe status quo· and not to .establish a separate B.oard of Zoning Appeals.This means that the Commissioners will continue to hear all cases,which concern a Board of Zoning Appeals, during its regular sessions.

During the December 22, ~981, hearing, Mr. Pickworth expressed'his concern as to whether a separate Board of Zoning Appeals couldhear petitions for provisional uses.. S.ubsequently he found that it.cou1d and prepared a memorandum to this point -- to the Board ofCounty Commissioners -- just prior to the fina~ hearing of January5, 1982. He suggested that section ll.le of the proposed Zoning'Ordinance draft be changed to include five paragraphs at Ue" underProvisional Uses.. The last of these five re.ads as fo~l.ows:·:

"The Planning Commission shall hear all requests forprovisional. uses prior to hearing by the Board of ZoningAppeals. The. report and recommendations' of the PlanninqCommission shall be advisory only to the Board of ZoningAppeals."

His memorandum addressed itsel£ further to suggestions thatthe Board of County Commissioners be the final authority on thematter of provisianal uses, following hearinqs of the PlanninaCommission and the Board of Zoning Appeals. Under this.arrang~~ent,

The fourth annual Salute to Womenwill be Saturday, January 23rd atCoastland Center.. Our CollierCounty League is sponsoring thisevent for the third time, andthis year with the new cORceptwhich will honor current day'Women Achievers'. Nominationsfrom participating organizationswill be made in five categories:Government; Business; Arts; Volun­teer and Professional. Winners ofthe Achiever Award in each cate­gory will be honored at a 2:00. pmceremony on the central stage onthe 23td. Ribbon and monetaryawards to the organizations withthe best booth displays (based onhow creatively and artisticallythey tell the story of their or­ganization's activities) will also·be made at the ceremony. A paradeof organization leaders about themall will start at 1:30 and cul­minate at the stage area.

League's public relations chairman,Helen Franke, is overall chairfuanof this year's Salute to Women,with Virgie Grant, our foundingPresident and former Salute Chair.,taking charge of the entertainmentarrangements, display judging anddisplay workshop. Outstandingente~tainment Virgie h&s procurredconsists of: The Liberty Bells'from First Presbyterian Church ofNaples with piano soloist FrancesMcLaren directing the group. AnitaBoqvist, a local singer and voiceteacher will be the soloist.withthis group performing at 12 noon.

'At 1:00 p.m. the Gulf Coast Gym­.nastics Academy will perform rou­tines featuring the 'Tumble Bun-

nies' and the 'Hot Shots'; followingthe ~wards four women will perfor~

simultaneously on two pianos ledby Thelma Goldsword, former musicprofessor at Baldwin-Wallace Collegenear Cleveland. The other talentedpianists include Josephine Conover,Ellen Strader and Roxie Kerr; at4:00 p.m. the Naples Dance Academywill present ballet and jazz numbersunder director Cheryl Scull. Theballet numbers will be 'Creation of-erie ~·.Earth' .·and 'Sleeping Beauty' .Following the jazz dance, threeclasses of 5 to 6 year aIds, 7to 12 and over 12's will performas the finale to the Salute Enter­tainment program.

Marilyn Contrada and Gail Boormanhave teamed up to decorate and re­cruit members to assist in the Leaguedisplay booth. Members will be askedto help demonstrate. the voting ma-'chine to Coastland shoppers, pass outCitizens Guide to Voting (and otherLeague literature), assist in gettingcitizens to participate in an opinionpollan local problems, solicit newmemberships and tell the story of'what the League is and does in thiscounty, state and the nation.
