Notice is hereby given that on September 16, 2019 at 9:10 a.m., the Board ofEducation of Alton Community Unit School District No. 11, of Madison and
Jersey Counties, Illinois (hereinafter “District”) will sell by taking sealed bids,which shall be accepted until 9:00 a.m. on September 16, 2019, and which willbe opened at 9:10 a.m. on September 16, 2019, at 550 Landmarks Blvd., Ste
A, Alton, IL 62002, the following described property (“Property”):
Clara Barton Elementary SchoolAddress: 409 Main Street, Alton, IL
The Property is currently improved and vacant, and previously served as thesite of the former Clara Barton Elementary School for Alton School District.Legal description on District’s title to govern. Property to be sold in “AS IS /
WHERE IS” condition.
This public sale will be made on the following terms, to wit:
1. The Property is to be offered by the District for public sale in accordancewith Section 5-22 of the Illinois School Code, 105 ILCS 5/5-22, to the highestresponsible and qualified bidder tendering a sealed bid meeting or exceedingthe minimum bid price of Ten Thousand and No/100 Dollars ($10,000.00). All

reserves the right to reject (with or without cause) any or all bids withinseventy-two (72) hours after the sealed bid opening’s date and time, in whichevent the public sale by sealed bid shall be of no force or effect and in which

bidder’s name, address, phone number and email address, along with thenotation: “Sealed Bid for Clara Barton Elementary School.” All bids must be
submitted to 550 Landmarks Blvd. Ste. A, Alton, IL 62002 ATTN:SUPERINTENDENT.
3. All bids must be accompanied by a “Bid Deposit” via personal checkpayable to “Alton School District” in the amount equal to Five Percent (5.0%)of the bidder’s bid. The highest responsible and qualified bidder’s Bid Depositwill be cashed and retained by the District, and will be applied to the purchaseprice. The District will return all other Bid Deposit checks to the unsuccessful
bidders within forty-eight (48) hours.4. The Property shall be sold “as is-where is” by Quit Claim Deed, legal
description on District’s title to govern. Additionally, the District makes norepresentations or warranties with respect to the condition or use of saidProperty, or compliance with environmental laws and regulations. The
Purchaser shall be solely responsible for determining the applicability of anylaws, local ordinance, or other regulations which may impact the Property
and/or the Purchaser’s contemplated use thereof. The Property is being soldsubject to any and all rights of the public and any and all easements,

inspect the Property and records relating to its condition and title before thedate of bid submission; and (c) that it has availed itself, to its satisfaction, ofthe right to inspect the Property and records relating to its condition and title
prior to the date of bid submission; and (d) that it is satisfied with theProperty’s condition and title and that it is taking the Property in AS-IS /
WHERE-IS condition. Records relating to the Property’s condition and title,including any and all environmental contaminants known and/or believed to
have been located on the Property in the past or currently (if any), areavailable for inspection and/or coping by contacting the District’s
Superintendent and/or the Director of Financial Services during regularbusiness hours at the District’s administrative office at 618-474-2600.
5. The District will not be responsible for paying any real estate brokers’commission.
6. By submitting a sealed bid, a bidder accepts the terms of the sale ascontained herein and in the Board of Education’s Resolution dated August 20,
2019, incorporated herein by this reference as if set out in full, expresslyincluding the terms and provisions of this Notice and the Purchase and Sale
Agreement attached to said Resolution. Copies of said Resolution andPurchase and Sale Agreement are available by contacting the District’s
Superintendent and/or Director of Financial Services during regular businesshours at the District’s administrative office at 618-474-2600.
7. Upon presentation by the District, the highest responsible and qualifiedsealed bidder shall immediately execute the Purchase and Sale Agreement
with the District subject to the terms and conditions as set forth in the Board ofEducation’s Resolution dated August 20, 2019, and this Notice of Public Sale.In addition, the highest responsible and qualified sealed bidder shall tender an
additional Five Percent (5.0%) of the bidder’s bid (in type of payment andfunds acceptable to the District) to the District as Earnest Money to be
credited to the purchase price at closing in accordance with the Purchase andSales Agreement.
8. The closing date on any resulting sale shall be scheduled for October 31,2019, unless District and the successful bidder agree to alternate closingarrangements. If the successful bidder fails to pay the balance due uponclosing, the Bid Deposit and Earnest Money paid shall be forfeited and
retained by District as liquidated damages and District may resell the Property.Possession shall be delivered to Buyer at closing.
9. The District may request assurances and proof satisfactory to the District ofthe bidders’ ability to purchase the property. Failure of the bidder to produce
same, to District’s satisfaction as measured solely by District, will permitDistrict to terminate sale to said bidder.
10. The Property and available records regarding its title and condition will beavailable for inspection, upon District’s receipt of reasonable written request,prior to the sealed bid opening date. 8. The closing date on any resulting sale shall be scheduled for October 31,2019, unless District and the successful bidder agree to alternate closingarrangements. If the successful bidder fails to pay the balance due uponclosing, the Bid Deposit and Earnest Money paid shall be forfeited and
retained by District as liquidated damages and District may resell the Property.Possession shall be delivered to Buyer at closing.
9. The District may request assurances and proof satisfactory to the District ofthe bidders’ ability to purchase the property. Failure of the bidder to producesame, to District’s satisfaction as measured solely by District, will permit
District to terminate sale to said bidder.10.
