DEFINITIONS

The terms given below denote the following:

FAW: Football Association of Wales Ltd

FIFA: Fédération Internationale de FootballAssociation.

UEFA: Union des Association Européennes de Football

Association: The FAW recognised by and a Member of FIFAand UEFA.

League: an organisation in membership of andsubordinate to the Association.

Area Association: an organisation in membership of andsubordinate to the Association.

Club: an organisation in membership of andsubordinate to the Association.

Officials: all board members, committee members,coaches, referees and attendants as well as otherpeople responsible for technical, medical andadministrative matters of the Association, AreaAssociations, Leagues, Clubs or theirSubordinates.

Player: a football player registered with the Association,an Area Association, Club or any other league orclub.

Annual General Meeting: the supreme body of the Association.

Council: the executive body of the Association.

Member: a Councillor, Area Association, League or Clubthat has been admitted into membership of theAssociation by the Council.

Subordinate: shall mean any director, member, representative,official, employee, referee or other playingofficial or player of a Member of the Associationtogether with every spectator and any personpurporting to be its supporter or followertogether also with all other organisations, clubs,bodies, entities or persons who are members of,or affiliated to, or over whom the Member of theAssociation exercises, or purports to exercisecontrol.

Association Football: the game controlled by FIFA and organised inaccordance with the Laws of the Game.

National Level: football played in leagues which are inmembership of and directly affiliated to theAssociation and which currently comprise TheFootball League of Wales; The Welsh FootballLeague; The Cymru Alliance League; The WelshAlliance League; The Mid Wales League andThe Welsh National League.

Recreational Level: football played in leagues which are not inmembership of and are not directly affiliated tothe Association.

IFAB: the International Football Association Board.

Juridical Body: the Associations Juridical Bodies comprise theDisciplinary, Appeal and IndependentArbitration Panels.

Ordinary Courts: state courts, which hear public and private legaldisputes.

Arbitration Tribunal: private court of justice acting instead of anOrdinary Court.

CAS (TAS): Court of Arbitration for Sport (Tribunal Arbitraldu Sport) in Lausanne (Switzerland).

COMPOSITION OF THE ASSOCIATION

1. The name of the Association is THE FOOTBALLASSOCIATION OF WALES LIMITED (“theAssociation”).

1.1 The Rules of this Association shall at all times beread and constructed in conjunction with theStatutes and Regulations of The FederationInternationale de Football Association (“the FIFARules”) and the Statutes and Regulations of theUnion des Associations Europeennes de Football(“the UEFA Rules”), in each case as published fromtime to time and in the case of conflict between theRules of this Association and the FIFA and UEFARules, the FIFA and UEFA Rules shall prevail, andin the case of conflict between the FIFA Rules andUEFA Rules, then the FIFA Rules shall prevail.

1.2 The objectives of the Association are:

a) to improve the game of football constantlyand promote, regulate and control itthroughout the territory of Wales in the lightof fair play and its unifying, educational,cultural and humanitarian values, particularlythrough youth and development programmes;

b) to organise and delegate competitions inAssociation Football in all its forms at alllevels, by defining precisely, as required, theareas of authority conceded to the variousArea Associations and Leagues of which it iscomposed;

c) to draw up regulations and provisions andensure their enforcement;

d) to protect the interests of its Members;

e) to respect and prevent any infringement ofthe statutes, regulations, directives anddecisions of FIFA, of UEFA and theAssociation as well as the Laws of the Gameand to ensure that these are also respected byits Members;

f) to prevent all methods or practices whichmight jeopardise the integrity of matches orcompetitions or give rise to abuse ofAssociation Football;

g) to control and supervise all friendly footballmatches of all forms played throughout theterritory of Wales;

h) to manage international sporting relationsconnected with Association Football in all itsforms

i) to host competitions at international andother levels.

1.3 a) The Association is neutral in matters ofpolitics and religion.

b) Discrimination of any kind against a country,private person or group of people on accountof ethnic origin, gender, language, religion,politics or any other reason is strictlyprohibited and punishable by suspension orexpulsion.

1.4 a) The Association shall promote friendlyrelations between its Members, clubs,Officials and Players and in society forhumanitarian objectives.

b) Every person and organisation involved inthe game of football is obliged to observe theRules, Regulations and the principles of fairplay as well as the principles of loyalty,integrity and sportsmanship.

c) The Association shall provide the necessaryinstitutional means to resolve any internaldispute that may arise between Members,Clubs, Officials and Players of theAssociation.

1.5 a) The status of Players and the provisions fortheir transfer shall be regulated by theCouncil of the Association in accordancewith the current FIFA Regulations for theStatus and Transfer of Players.

b) Players shall be registered in accordance withthe regulations of the Association.

1.6 The Association and each of its Members playAssociation Football in compliance with the Lawsof the Game issued by the IFAB. Only the IFABshall lay down and alter the Laws of the Game.

1.7 The Members and Officials of the Association mustobserve the Statutes, regulations, directives,decisions and the Code of Ethics of FIFA, of UEFAand of the Association in their activities.

1.8 The Members of the Association have the followingobligations

a) to comply fully with the Statutes,regulations, directives and decisions of FIFA,UEFA and the Association at all times and toensure that these are also respected by itsmembers;

b) to ensure the election of its decision-makingbodies;

c) to take part in competitions and other sportsactivities organised by the Association;

d) to pay their membership subscriptions;

e) to respect the Laws of the Game as laid downby the IFAB and to ensure that these are alsorespected by its Subordinates through astatutory provision;

f) to adopt a statutory clause specifying thatany dispute requiring resolution involvingitself or one of its members and relating tothe Rules, Regulations, directives anddecisions of the Association, AreaAssociation or League shall come solelyunder the jurisdiction of the appropriateJuridical Body of the Association

g) to communicate to the Association and itsmembers any amendment of its rules andregulations.

h) not to maintain any relations of a sportingnature with entities that are not recognised orwith Members that have been suspended orexpelled;

i) to observe the principles of loyalty, integrityand good sporting behaviour as an expressionof fair play through a statutory provision;

j) to administer a register of members whichshall regularly be updated;

k) to comply fully with all other duties arisingfrom the Statutes and other regulations ofFIFA, UEFA and the Association.

1.8.1 Violation of the above-mentioned obligations byany Member may lead to sanctions provided for inthese Rules.

1.9 Clubs, Leagues, Area Associations shall besubordinate to and recognised by the Association.These Rules define the scope of authority and therights and duties of the Members. Their rules andregulations must be approved by the Council of theAssociation.

1.9.1 The Members of the Association shall takeall decisions on any matters regarding theirmembership independently of any external body.This obligation applies regardless of their corporatestructure.

1.9.2 In any case, no natural or legal person (includingholding companies and subsidiaries) shall exercisecontrol over more than one Club or group wheneverthe integrity of any match or competition could bejeopardised.

2. The Members of the Association shall comprise thefollowing and the phrase “Member” shall be construedaccordingly :-

2.1 any club in Wales and in those English counties,any part of whose boundaries are contiguous withany part of the boundary of Wales, playing footballaccording to the Laws of the Association in thedivisions of the “Leagues” (as defined below) as theCouncil shall prescribe from time to time; any clubwhich has enjoyed fifteen (15) years continuousmembership of the Association whether or not stillplaying in the relevant divisions of a League andany other club permitted into membership of theAssociation at the absolute discretion of theCouncil (“the Qualifying Clubs”);

2.2 any regionally defined football associationresponsible for fostering and improving the game ofFootball, promoting and organising competitionsand matches and general management of Football,within its defined area under the authority of theAssociation, whose Headquarters are situate inWales, which currently comprise the Central WalesFootball Association; Gwent County FootballAssociation, North East Wales FootballAssociation; North Wales Coast FootballAssociation; South Wales Football Association andthe West Wales Football Association and any othersuch association permitted into membership of theAssociation at the absolute discretion of theCouncil (“the Area Associations”);

2.3 any organisation which arranges and runs aseasonal competition of a league or series ofleagues for clubs playing football according to theLaws of the Association which currently compriseThe Football League of Wales; The Welsh FootballLeague; The Cymru Alliance League; The WelshAlliance League; The Mid Wales League and TheWelsh National League and any other suchorganisation permitted into membership of theAssociation at the absolute discretion of theCouncil (“the Leagues”); and

2.4 each of the members of Council as defined in Rule4.

3. 3.1 The Officers of the Association shall be appointed

annually from and by the Council for a term of oneyear. They shall consist of a President, two Vice-Presidents (one to represent the North Wales Areaand one to represent the South Wales Area asrespectively defined in Rule 5), and an HonoraryTreasurer. No President shall service more thanthree terms in office, whether consecutively orotherwise. A person appointed to an Officer post bythe Council shall vacate his post as a Councillorelected or nominated by the Members and shall siton the Council as an Officer. Nominations for thepost of Officers must be made at the Councilmeeting, prior to the election, and the names ofthose nominated circulated to all Council members.Any such vacancy for the elected or nominated postshall be filled in accordance with Rule 9. Nothing inthis Rule shall affect the Life Vice Presidency orLife Membership of any person appointed as anOfficer.

3.2 The Officers, together with the Secretary of theAssociation, shall be, by virtue of their respectiveoffices, the legal owners of all cups, property andmonies as directed by the Council.

The Council

4. The Association shall be governed by a Council. TheCouncil shall consist of the Officers of the Council andnineteen Councillors as elected or nominated triennially(the next such date being 1998) together with such LifeVice-Presidents and Life Councillors as there maybefrom time to time. The said members of the Council arereferred to as “Councillors” in the Rules. The saidnineteen Councillors shall be elected or nominated asappropriate triennially as follows:-

4.1 six Councillors shall be, and shall be known as“South Wales Representatives” and shall benominated and elected by Qualifying Clubs in the“South Wales Area” as defined in Rule 5

4.2 six Councillors shall be, and shall be known as“North Wales Representatives” and shall benominated and elected by Qualifying Clubs in the“North Wales Area” as defined in Rule 5;

4.3 one Councillor shall be known as “The FootballLeague of Wales Representative” and shall benominated and elected by the Qualifying Clubs inThe Football League of Wales;

4.4 each of the six Area Associations (as set out in Rule2.2) shall nominate one Councillor;

4.5 the names of the persons nominated under Rules 4.4shall be submitted to the Secretary of theAssociation no later than 1st August.

5. Notwithstanding anything contained in these Rules, theCouncil, for the purpose of determining the constituencyfor the election of the six (6) South WalesRepresentatives and the six (6) North WalesRepresentatives and in so doing ensuring goodrepresentation of the whole of Wales shall be empoweredto divide the country into suitable areas and sub-areas andallocate such representation as far as possible suitablybetween the Qualifying Clubs (“the Areas”). Such Areasof the country are currently “the South Wales Area” and“the North Wales Area” with the North Wales Areacurrently divided further into the North East Wales, NorthWales Coast and Central Wales sub-Areas. QualifyingClubs in any particular Area or sub-Area shall only votefor those candidates nominated as Representatives fromthe particular Area or sub-Area concerned. The Councilshall have the power to prescribe the number of voteswhich each Qualifying Club must cast in any election.Failure to cast the said number of votes will render theQualifying Club’s ballot paper void. Voting papers forany particular Area or sub-Area will state clearly howmany votes must be cast by Qualifying Clubs, in theelection. Only those Qualifying Clubs which on the 1stof August preceding the occurrence of any election(whether triennial or for a vacancy), were eligible to voteat a Meeting, shall be entitled to nominate a candidate forelection and vote in that election.

6. Candidates for the post of the six North Wales and sixSouth Wales Representatives and the single FootballLeague of Wales Representative shall be chosen by aprocess of nomination and election as follows :-

6.1 candidates shall either be nominated by aQualifying Club (which in the case of the North andSouth Representatives shall mean a QualifyingClub from within the relevant Area and in the caseof the Football League of Wales Representativeshall mean a Qualifying Club in the FootballLeague of Wales) or shall be a retiring Councillorwho wishes to stand for re-election to the same postfrom which he is retiring. Candidates nominated bya Qualifying Club must express their willingness tostand in writing beforehand. The Qualifying Clubshall notify the Secretary of the Association of theirnomination on the official Form as prescribed bythe Secretary from time to time, sent out by theSecretary at least fourteen (14) days prior to the

fourteenth day of June. Such form shall be signedby the Recognised Signatories of the QualifyingClub (as defined in Rule 14.3) and returned to theSecretary on or before the first day of June in anyyear when the triennial elections are taking place.Any retiring Councillor seeking to be re-appointed,shall notify the Secretary on or before the first dayof June and his name shall be added to the list ofcandidates. No candidate shall be allowed towithdraw his name from the list within three (3)days after the closing date for the receipt ofnominations;

6.2 in the event that six (6) or less candidates arenominated for the North Wales posts they shall beautomatically elected to the Council without theneed for a vote amongst the relevant QualifyingClubs. If the number of candidates exceeds six (6),an election shall be held in accordance with Rules8.4 to 8.8 inclusive;

6.3 in the event that six (6) or less candidates arenominated for the South Wales posts they shall beautomatically elected to the Council without theneed for a vote amongst the relevant QualifyingClubs. If the number of candidates exceeds six (6),an election shall be held in accordance with Rules8.4 to 8.8 inclusive;

6.4 in the event that only one candidate is nominatedfor the Football League of Wales post that personshall be automatically elected to the Councilwithout a vote amongst the relevant QualifyingClubs. If the number of candidates exceeds one anelection shall be held in accordance with Rule 8.4 to8.8 inclusive;

6.5 in the event that less than six (6) candidates arenominated for the North Wales posts Council shallhave the power to, and shall, appoint the necessarynumber of person or persons to make the number ofNorth Wales Representatives up to six (6) and suchperson or persons so appointed shall be NorthWales Representatives as if elected to the post bythe relevant Qualifying Clubs;

6.6 in the event that less than six (6) candidates arenominated for the South Wales posts Council shallhave the power to, and shall, appoint the necessarynumber of person or persons to make the number ofSouth Wales Representatives up to six (6) and suchperson or persons so appointed shall be SouthWales Representatives as if elected to the post bythe relevant Qualifying Clubs;

6.7 in the event of no candidate being nominated for theFootball League of Wales post Council shall havethe power to, and shall, appoint a person as theFootball League of Wales Representative and suchperson so appointed shall be the Football League ofWales Representative as if elected to the post by therelevant Qualifying Clubs;

6.8 where there are more than six (6) candidatesnominated for the North Wales posts or more thansix (6) candidates nominated for the South Walesposts or more than one candidate nominated for theFootball League of Wales post, an election shall beheld in any such case amongst the relevantQualifying Clubs to choose the relevantRepresentatives;and

6.9 no Qualifying Club shall be allowed to nominatemore than one candidate for election to the Councilin any one election.

7. No two Councillors shall be directors or committeemembers or officers or in any other material wayassociated with the same Qualifying Club.

8. In the event of an election being held :-

8.1 voting papers containing the names of candidatesfor election to the Council as South WalesRepresentatives shall be sent by the Association toall Qualifying Clubs eligible to vote within theSouth Wales Area;

8.2 voting papers containing the names of candidatesfor election to the Council as North WalesRepresentatives shall be sent by the Association toall Qualifying Clubs eligible to vote within theNorth Wales Area;

8.3 voting papers containing the names of candidatesfor election to the Council as the Football League ofWales Representative shall be sent by theAssociation to all Qualifying Clubs in the FootballLeague of Wales;

8.4 all completed voting papers, relating to the electionof South Wales Representatives shall be dispatchedto the Association in special envelopes, whichenvelopes shall have been supplied by theAssociation and which shall be printed on their face“Ballot Paper South”. All completed voting papers,relating to the election of North WalesRepresentatives shall be dispatched to theAssociation in special envelopes, which envelopesshall have been supplied by the Association and

which shall have printed on their face, “BallotPaper North.” All completed voting papers relatingto the election of the Football League of WalesRepresentatives shall be dispatched to theAssociation in special envelopes which envelopesshall have been supplied by the Association andwhich shall have printed on their face, “BallotPaper Football League of Wales”. All such votingpapers, whether relating to the South Wales Area orNorth Wales Area or the Football League of Wales,must be dispatched to the Association by RegisteredPost or Recorded Delivery not later than the 25th ofJuly in the year of triennial elections. The date ofthe postmark shall determine the day of dispatch;

8.5 each special envelope, in which any completedvoting paper is dispatched to the Association, mustbe signed on behalf of the Qualifying Club by theRecognised Signatories (as defined in Rule 14.3) ofthat Qualifying Club and such signatures must besigned personally by the individuals;

8.6 voting papers shall be opened only in the presenceof an Officer of the Association;

8.7 in the event of a voting paper being declared void,the identity of the Qualifying Club concerned shallnot be disclosed;

8.8 the six candidates in the South Wales Areasreceiving the greatest number of votes shall bedeclared elected as South Wales Representatives.The six candidates in the North Wales Areasreceiving the greatest number of votes shall bedeclared elected as North Wales representatives.The candidate in the election for the League ofWales Representative receiving the greatest numberof votes shall be declared elected as the League ofWales Representative; and

8.9 the President of the Association, or in his absence,one of the Officers of the Association, shall be theReturning Officer for the purpose of supervising thecount of voting papers. The results of the election shallbe declared at a meeting which shall be open to theMembers. The Secretary of the Association shall notifyall Members of the result of the election in writing withinfourteen (14) days of the count.

9. Vacancies occurring on the Council shall be filled withinthree calendar months of such vacancy occurring. If thevacancy is in respect of a nominated Councillor from theArea Associations, the organisation which nominated that

person shall nominate a replacement and notify theAssociation in writing accordingly. If the vacancy is inrespect of an elected South Wales Representative orNorth Wales Representative or the Football League ofWales Representative, an election to fill such vacancyshall take place in the same manner as the triennialelections.

10. The Council shall have power at any time to appoint LifeVice-Presidents and Life Councillors. Councillorsentitled to be so appointed shall have served as Officersor Councillors (other than as an Officer) for not less thantwenty five years and twenty one years respectively. ACouncillor must also have been a previous President ofthe Association in order to be eligible to be appointed asa Life Vice-President. If an Officer of the Association isnot eligible to become a Life Vice-President at the end ofhis term of office he shall automatically become a LifeCouncillor.

11. Upon taking office the Councillor immediately assumesthe position of Shareholder and Director of The FootballAssociation of Wales Limited and shall remain so untilreplaced by election, appointment or nomination as thecase may be under these Rules.

12. A candidate for election to the Council shall not offer anybribe, or consideration, or pay fees, or offer any improperinducement of any kind whatsoever, to any QualifyingClub for the purpose of procuring the vote of the saidQualifying Club in the election of such candidate to theCouncil. No Area Association, nor any Qualifying Club,nor any League, nor any person whatsoever, shall offer,on behalf of any candidate or at all, any bribe, orconsideration, or pay fees, or offer any improperinducement of any kind whatsoever, to any QualifyingClub for the purpose of procuring the vote of any suchsaid Qualifying Club in the election of any such candidateto the Council. Any breach of this Rule shall ipso facto,be deemed serious misconduct. In addition to any otherpenalty, which the Council may deem fit to impose forany breach of this Rule, any breach whatsoever of thisRule shall, ipso facto, render null and void the election tothe Council of any candidates concerned or implicated byany such said breach, if such candidate shall have beenelected as a Councillor.

these Rules.

14. In addition to the May General Meeting the Secretary ofthe Association shall convene a Special General Meetingof the Members for the consideration of changes to theRules either :-

14.1 when ordered to do so by the Council; or

14.2 upon receipt of a requisition to convene such aMeeting signed by or on behalf of a quorum of atleast twenty five Members, such requisition to statethe wording of the proposed change or changes tothe Rules; and

14.3 such a requisition or any other documents requiredto be signed on behalf of any Qualifying Club, AreaAssociation or League under the terms of theseRules shall be properly signed when signed by thesecretary and three committee members of any suchbody (“the Recognised Signatories”); and

14.4 in these Rules unless expressly stated to thecontrary the word “Meeting” shall mean either theMay General Meeting or any Special GeneralMeeting as the context requires and the word“Meetings” shall mean both of the same.

15. 15.1 The wording of any change to the Rules, proposedby the Members for consideration at the MayGeneral Meeting, shall be notified to the Secretaryof the Association on or before the first day of Aprilin any year in the form of a written notificationsigned where appropriate by the RecognisedSignatories.

15.2 The Secretary of the Association shall notify allMembers and the Council of the date time and placeof all Meetings ten (10) clear days in advance, suchnotice to be in writing and to contain details of theproposed Rule changes to be discussed.

16. 16.1 All Members being a Qualifying Club, AreaAssociation or League shall be entitled to send onerepresentative to all Meetings. Such representativemust produce a written authority signed by theRecognised Signatories authorising him to be suchrepresentative at the Meeting. All Members beingmembers of Council shall be entitled to attendMeetings in person. No person shall represent morethan one body or person at a Meeting, except thatany person may in addition to acting in person or asthe representative of a Member body also act asproxy for another Member or Members.

16.2 All Members or their representatives shall beentitled to one vote at Meetings. A Rule shall be

changed if two thirds of those voting at the Meetingvote in favour of the proposed change.

16.3 Members shall be entitled to vote at Meetings byproxy. The Member shall complete the proxy formor as prescribed by the Secretary from time to time.The form of proxy shall be lodged with theSecretary a minimum of three (3) days prior to theMeeting.

16.4 The President of the Association if present, or ifabsent one of the Vice-Presidents shall preside asChairman at all May and Special General Meetingsunless there be no such Chairman present within 15minutes of the time appointed for the start of theMeeting in which case the Members present shallchoose any other Councillor to be Chairman.

17 Amendments to the Rules made at the May General Meetingshall come into force at the beginning of the following play-ing season. Amendments made at a Special General Meetingshall also come into force at the beginning of the followingplaying season, except that:-

17.1 where at any time the Council proposes an amend-ment, the Council shall have the right to designate thatthe amendment come into force at an earlier date asstipulated by the Council in the Notice of SpecialGeneral Meeting sent to Members proposing theamendment; or

17.2 where an amendment is not proposed by the Counciland the amendment is made after the May GeneralMeeting but before the commencement of the nextplaying season, the amendment shall not come intoforce until the beginning of the playing season afterthat unless deemed practicable to implement by theCouncil, in which case the amendment shall come intoforce at the beginning of the next playing season.

APPLICATION OF THE RULES AND THE POWERS

OF THE COUNCIL

18. 18.1 All Members of the Association, whetherQualifying Clubs, Leagues or Area Associationsshall draft their internal rules to be consistent withthe Rules of the Association. Where a conflictoccurs the Rules of the Association shall prevail.

18.2 Wherever required to do so by the Association allMembers shall exercise every power at theirdisposal to ensure that their internal rules and the

Rules of the Association, are fully complied with byevery officer, member, employee and associatedparty of the said Member.

18.3 Any changes to the rules of any Members of theAssociation shall be subject to the approval of theCouncil.

18.4 For the purposes of this Rule, every Member of theAssociation, and every representative, official,player or member thereof, is subject to and boundby all Rules, Bye-laws and Orders made by theAssociation.

18.5 In any case, where the wording of this Rule is inconflict with any wording in any other Rule,Regulation, Bye-law or Standing Order of thisAssociation, then the wording of this Rule shallprevail.

19. The Council is hereby empowered to make suchRegulations and Bye-Laws, which it deems necessary toprovide for matters arising from these Rules or toimplement these Rules. Any such Regulation or Bye-Law must not conflict with any Rule of the Association,and in the event of any conflict, such Regulation or Bye-Law concerned shall be of no effect to the extent, towhich it conflicts with any Rule of the Association. AllMembers of the Association and all other clubs shall bedeemed to have knowledge of and to be bound absolutelyby any such said Regulation or Bye-Law, if such saidRegulation or Bye-Law shall have been published in theMinutes of the relevant Council meeting. The productionof the Minutes of the appropriate Council meeting shallconstitute at all times absolute and indisputable proof ofthe validity of such said Regulation or Bye-Lawconcerned.

20. The Council is hereby authorised to make such Rules,Regulations, Bye-Laws and Orders as deemed necessarywith reference to and in connection with any competitionheld within the area of the Association’s jurisdiction andspecifically but without limitation the Council may makeany such rules or laws to regulate the actions of anyofficers or representatives involved in such competitions.

21. The Council shall have power to suspend the playing ofAssociation Football at all or any club or ground withinits jurisdiction at such times and for such duration as theCouncil shall see fit. Notwithstanding any provisioncontained in Rule 81, the Council shall have power toextend or diminish the period of the playing season in anyyear or at any time, when such a course shall seem to it tobe necessary or desirable. between Clubs, Players or Officials or between any or allof them shall only take effect subject to any decision ofthe Council, which may be made from time to time underthe provisions of this Rule.

22. The Council is hereby empowered to prohibit anyMember of the Association from playing any match ormatches with any league or leagues and any club or clubsnot belonging to some recognised Football Association, ifto the Council such prohibition seems necessary ordesirable.

DISCIPLINARY PROCEEDINGS, DISPUTES,

APPEALS AND INDEPENDENT ARBITRATION

PANEL STRUCTURE, COMPOSITION AND

JURISDICTION

23. The structure of the Association’s Panels for dealing withdisciplinary proceedings, disputes, appeals andindependent arbitration is as follows:-

23.1 the “Disciplinary Panel”

23.2 the “Appeals Panel”; and

23.3 an “Independent Arbitration Panel”.

24. For the purpose of Section E of the rules:-

24.1 The following expressions have the followingmeaning:-

24.1.1 “Disciplinary Offence” shall mean anybreach of a Rule or any subsistingRegulation, Bye-law or Order made underthe Rules;

24.1.2 “Rule” shall mean any subsisting rule ofthe Association from time to time; and

24.1.3 “Subordinate” shall mean any director,member, representative, official,employee, referee or other playing officialor player of a Member of the Associationtogether with every spectator and anyperson purporting to be its supporter orfollower together also with all otherorganisations, clubs, bodies, entities orpersons who are members of, or affiliatedto, or over whom the Member of theAssociation exercises, or purports toexercise control;

24.2 It shall be a breach of the Rules for any Member ofthe Association or any Subordinate to do or permitor assist in the doing or permitting of any of thefollowing:-

24.2.1 violate the laws of the Game or the Rulesor any subsisting Regulation, Bye-law orOrder made under the Rules or of FIFA orUEFA;

24.2.2 violate the rules or regulations of anyMember of the Association or anycompetition, sanctioned by a member ofthe Association or sanctioned by theCouncil;

24.2.3 play with or against any suspended club orappointed or allowed to remain in office adirector or official who has beensuspended;

24.2.4 bet in any betting activity (authorised andregistered Football Pools excepted) oraccepted any bets in any way related to anymatch;

24.2.5 offer or attempt to offer, either directly orindirectly, any consideration whatever to aMember of the Association, any other clubofficial, referee or any other footballingbody or individual with a view toinfluencing the result of any match, or toaccept any such consideration;

24.2.6 allow a director, official, referee, assistantreferee or player under suspension to act asa referee or to perform any duties from theexecution of which that person has beensuspended, or failed to take all reasonableprecautions to prevent such person fromentering the ground of any Qualifying Clubor any other club;

24.2.7 sell or offer for sale, either directly orindirectly, a ticket for any football match inexcess of the face value of the ticket;

24.2.8 play a match with or against a club whoseground has been closed by the Association(“the Offending Club”) on any groundwithin a radius of twelve (12) miles of theground closed unless such match is anaway fixture for the Offending Club and isplayed at the ground of the home teamwhich is within a radius of twelve (12)miles of the closed ground;

24.2.9 commit any act or make any statementeither verbally or in writing, or beresponsible for conduct, continuingmisconduct or any matter likely to bringthe game into disrepute;

24.2.10 any act or omission constituting a “DopingOffence” as defined in the Association’s Anti-Doping Regulations. For the purpose of thisRule 24.2.10 the words “Doping Offence”shall include any equivalent term or phraseused to define doping offences or dopingbreaches prescribed in any version of theAssociation’s Anti-Doping Regulationscurrent from time to time;

24.2.11 if more than two (2) members of a club arefound to have committed a Doping Offence(as defined in Rule 24.2.10 above) during an“Event Period” (as defined by theAssociation’s Anti-Doping Regulations), theclub shall be deemed to have committed aDisciplinary Offence;

24.2.12 receive a caution or conviction for any ofthe offences listed in Schedule 4 CriminalJustice and Court Services Act 2000, itsrevisions and amendments; or received anycaution or conviction for any offenceslisted in the Sexual Offences Act 2003, itsrevisions and amendments; or received anycaution or conviction for any of theoffences listed in Schedule 1 Children andYoung persons Act 1933, its revisions andamendments; or is identified as a personpresenting a risk or potential risk tochildren; or received any caution orconviction for any offences againstvulnerable adult; or breach or breaches ofthe FAW Welfare Policies and Procedures,or any Code of Conduct and Ethicsestablished under them, as prescribed bythe Association from time to time.;

24.2.13 fail to conduct themselves in an orderlyfashion or fail to refrain from violence,threatening, abusive, obscene orprovocative behaviour, conduct orlanguage whilst attending or taking part ina match in which it is involved, whether onits own ground or elsewhere;

24.2.14 encroach on the pitch area, save forauthorised persons or for reasons of crowdsafety;

24.2.15 throw missiles, bottles or other potentiallyharmful or dangerous objects at or on thepitch or at any other person on the pitch orelsewhere in the ground; or

24.2.16 fail to ensure that a private way is providedfor players and officials from the playingground to the dressing room whenever thisis practicable at every ground within thejurisdiction of that Member of theAssociation.

24.3 every member of the Association will beresponsible for the actions of its Subordinates andthe Member of the Association will also be inbreach of any Rule or any subsisting Regulation,Bye-law or Order made under the Rules, if thatRule or any subsisting regulation, Bye-law or Orderis breached by a Subordinate.

25 Subject to Rule 26 the jurisdiction of the Panels is asfollows:-

25.1 the Disciplinary Panel will hear the followingmatters:-

25.1.1 any charge of an alleged DisciplinaryOffence brought by the Association againstany Member of the Association or anySubordinate. The Association and the saidMember of the Association or Subordinatewill be the relevant “Party” or “Parties” tothe proceedings for the purpose of SectionE of the Rules;

25.1.2 any appeal by a Subordinate or other thirdparty against a decision of a Member of theAssociation, where the said decision was adecision by the Member of the Associationin the first instance. The Member of theAssociation and the Subordinate or otherthird party will be the “Party” or “Parties”to the proceedings for the purpose ofSection E of the Rules;

25.1.3 any appeal by a Subordinate or other thirdparty against a decision of a Member of theAssociation, where the said decision was adecision by the Member of the Associationacting as an appellant body in hearing anappeal against a decision of a Subordinate.The Subordinates or other third party willbe the relevant “Party” or “Parties” to theproceedings for the purpose of Section E ofthe Rules;

25.1.4 any dispute or difference between two ormore Members of the Association (notbeing an appeal covered by Rule 25.1.2)which one or more of the said Membersrefers to the Association for resolution. Thesaid Members will be the relevant “Party”or “Parties” to the proceedings for thepurpose of Section E of the Rules.

25.1.5 any disputes or differences between aMember of the Association and anySubordinate or other third party (not beingcovered by Rules 25.1.2 or 25.1.3) whichone or more of the Member of theAssociation or the Subordinate or otherthird party refers to the Association forresolution. The Member of the Associationand the Subordinate or other third partywill be relevant “Party” or “Parties” to theproceedings for the purpose of Section E ofthe Rules.

25.2 The Appeals Panel will hear the following matters:-

25.2.1 an appeal by either of the relevant Partiesagainst a decision of the Disciplinary Panelmade under any part of Rule 25.1 exceptthat the Association will only have theright to appeal against the penalty orsanction imposed by the Disciplinary Panelunder Rule 25.1.1 and not against a findingof not guilty;

25.2.2 a first instance appeal by any Member ofthe Association or Subordinate or otherthird party against a decision of Counciland its Committees or Sub-committees(other than decisions of the DisciplinaryPanel) but only insofar as such decisionsinvolve the application of the Rules of theAssociation and any Regulations, Bye-lawor Order made under the Rules of theAssociation. Any decision of the Councilrelating to the financial, commercial orbusiness affairs of the Association shall beexcluded from the scope of appeals underthis Rule 25.2.2. The Council and theMember of the Association or Subordinateor other third party will be the “Party” or“Parties” to the proceedings for thepurpose of the Section E of the Rules; and

25.2.3 any matters referred to it by theAssociation under Rule 26 which would

otherwise have been heard by theDisciplinary Panel.

25.3 The Independent Arbitration Panel will hear thefollowing matters:-

25.3.1 an appeal by either of the relevant Partiesagainst a decision of the Appeals Panelmade under any part of Rule 25 except thatthe Association will only have the right toappeal against the penalty or sanctionimposed by the Appeals Panel under Rule25.2.1 and not against a finding of notguilty under Rule 25.2.1; and

25.3.2 any matter referred to it by the Associationunder Rule 26 which would otherwise havebeen heard by the Disciplinary Panel orAppeals Panel.

25.4 The proceedings of each Panel will be conducted ina private hearing of all the Parties unless there is anelection under the Rules by the Relevant Party orParties (as the case may be) waiving the right to aprivate hearing.

26. The Officers Committee may in absolute discretion electto:-

26.1 refer to the Appeals Panel or the IndependentArbitration Panel any matter which in the absenceof such an election would otherwise be under thejurisdiction of the Disciplinary Panel; or

26.2 refer to the Independent Arbitration Panel anymatter which in the absence of such an electionwould otherwise be under the jurisdiction of theAppeals Panel

AND the Association shall give notification of suchelection to the Parties and the matter shall proceedin accordance with the relevant provisions in theRules of the Association relating to the relevantPanel save that there shall be no increase in fees asa result of such referral.

27. The composition of the Panels will be as follows:-

27.1 The Disciplinary Panel – Only elected members ofthe Council will sit on the Disciplinary Panel. EachDisciplinary Panel will consist of three (3) electedmembers of Council, including one from a list offour(4) chairmen designate nominated by theCouncil from time to time. On a case by case basis,the Secretary General will appoint the DisciplinaryPanel chairman from the said list of chairmendesignate and the other two (2) members of theDisciplinary Panel;

27.2 The appeals Panel – Will consist of three (3)persons, two (2) of whom will drawn solely fromthe Officers of the Association, Life Vice Presidentsand Life Councillors and the third person will be anindependent chairman (not a Member of theAssociation) who will be a person of high standingand probity and with a sound knowledge of footballmatters. On a case by case basis, the SecretaryGeneral will select the independent chairman andthe two (2) other members of the Appeals Panel.

27.3 In any matter concerning a Disciplinary Offence oralleged Disciplinary Offence under Rules 24.2.10 or24.2.11, the appeal tribunal division of the NationalAnti-doping Panel will be the Independent ArbitrationPanel. In respect of any other Disciplinary Offence oralleged Disciplinary Offence under the Rules, on acase by case basis, the Secretary General will select anindependent sports arbitration service to act as theIndependent Arbitration Panel. In either case, thecomposition of the Independent Arbitration Panel willbe in accordance with that organisation’s rules orregulations and, for the avoidance of doubt, theIndependent Arbitration Panel may consist of only oneperson if such appointment is permitted by thatorganisation’s rules or regulations.

COMMENCEMENT OF PROCEEDINGS BEFORE A

PANEL – NOTICES, FEES AND PROCEDURE

28. The following will apply if a Party wishes to refer amatter to the Disciplinary Panel:-

28.1 where the Association brings a charge of an allegedDisciplinary Offence under Rule 25.1.1:-

28.1.1 the Association will give written notice tothe other Party of the charge, stipulatingthe nature of the alleged DisciplinaryOffence (“the Disciplinary Notice”);

28.1.2 the Party charged will have ten (10)calendar days after service of theDisciplinary Notice to reply stipulatingwhether (a) they admit or deny the chargeand (b) whether they wish to waive theirright to a private hearing before theDisciplinary Panel. If the charge is denied,the reply must state the grounds of denialand the Party charged will not be permittedto raise any other grounds of denialwithout the leave of the Chairman of theDisciplinary Panel;

28.1.3 if the Party charged fails to reply to theDisciplinary Notice within ten (10)calendar days, they will be deemed to havedenied the charge and to have waived theirright to a private hearing before theDisciplinary Panel. In such circumstancesthe Association will, without further noticeto the Party charged, convene aDisciplinary Panel who will consider thealleged disciplinary Offence in the absenceof the Party charged and the provisions ofRules 28.1.4 to 28.1.11 inclusive shall notapply.

28.1.4 if the Party charged has replied to theDisciplinary Notice and requested a privatehearing the Association will give the Partycharged no less than ten (10) calendar dayswritten notice of the date, time and place ofthe hearing and the provisions of Rules28.1.5 to 28.1.11 inclusive shall apply;

28.1.5 where the Party charged is an individualperson, they will be required to attend thehearing in person. Where the Party chargedis not an individual person, one or moreduly authorized senior representatives ofthe Party will attend the hearing, whetherdirectors, officers or otherwise;

28.1.6 the Association and the Party charged willdisclose to each other such documents asthey intend to produce in evidence at thehearing. Whenever reasonably possible,the parties will make such disclosures noless than forty-eight (48) hours prior to thehearing;

28.1.7 the Association and the Party charged willbe entitled to make opening and closingremarks at the hearing and to call areasonable number of witnesses who willbe expected to answer questions in cross-examination. Members of the DisciplinaryPanel will be entitled to ask questions ofany witness during the hearing. The Partycharged will not be obliged to giveevidence in person but the DisciplinaryPanel will be entitled to draw suchinference as may be reasonably appropriateif the Party charged declines to do so. TheChairman of the Disciplinary Panel willwarn the Party charged of this fact;

28.1.8 the Disciplinary Panel hearing will proceedin the absence of the Party charged, unlessthe Disciplinary Panel reasonablyconsiders that the Party charged has givenan acceptable reason for such non-attendance, in which case the hearing willbe adjourned;

28.1.9 the Disciplinary Panel will retire toconsider its findings in camera. A decisionmay be announced on the day or reservedto a later date in which case, the decisionwill be delivered in writing;

28.1.10 if the Disciplinary Panel finds the partycharged guilty of the Disciplinary Offenceat a Disciplinary Panel Hearing attendedby the party charged, no penalty orsanction will be imposed until:

28.1.10.1 the Disciplinary Panel has beeninformed by the Association of anyprevious Disciplinary Offencesrecorded against the guilty Party; and

28.1.10.2 the guilty Party has been given theopportunity to make representations inmitigation of the Disciplinary Offence;

28.1.11 the Association and the Party charged shallbe entitled to legal or other professionalrepresentation at the Disciplinary panelhearing;

28.1.12 where the Party charged has waived theright to a private hearing or is deemed tohave waived such right, or where the Partycharged does not attend the privatehearing, the Disciplinary Panel willconsider such information as it considersreasonably necessary to decide the matterincluding, without limitation, any writtenrepresentations made for or on behalf ofthe Party charged and representations(whether written or verbal) made for or onbehalf of the Association. The DisciplinaryPanel will be entitled to seek such furtherinformation or evidence as it deemsnecessary. If the Disciplinary Panel findsthe Party charged guilty of the DisciplinaryOffence, the Association will inform theDisciplinary Panel of any otherDisciplinary Offences recorded against theguilty party but the Disciplinary Panel willnot be obliged to invite the guilty Party to

make further representations in mitigationof the Disciplinary Offence beforeimposing a penalty or sanction;

28.1.13 whether or not the hearing takes place, theDisciplinary Panel will have absolutediscretion whether to make a cost order foror against the Party charged; and

28.1.14 whether or not a hearing takes place, theAssociation will send written confirmationof the Disciplinary Panel’s findings to theParty charged.

28.2 In the case of any other proceedings under thejurisdiction of the Disciplinary Panel pursuant toRule 25.1:-

28.2.1 the Party wishing to commence theproceedings will give written notice to theAssociation (marked for the attention ofthe Secretary General) and the other Partyor Parties stipulating the nature of thematter complained of and requesting thatsuch matter be referred to the DisciplinaryPanel (“the Disciplinary Request Notice”);

28.2.2 in an appeal under Rules 25.1.2 and 25.1.3against a decision of a Member of theAssociation, the Disciplinary PanelRequest Notice will be served on theAssociation not more than ten (10)calendar days after the earlier of (a) theMember of the Association announcing itsdecision at the time of its hearing (if any)or (b) receipt by the Party appealing ofwritten notification of the Member of theAssociation’s decision. Any DisciplinaryPanel Request Notice lodged after ten (10)calendar days will be rejected unless theParty lodging the same can demonstrate tothe reasonable satisfaction of theAssociation that it was not reasonablypracticable to lodge the Disciplinary PanelRequest Notice within the time limit;

28.2.3 the following appropriate “DisciplinaryPanel Fee” must accompany theDisciplinary Panel Request Notice:-

28.2.3.1 £355.00 if the Party lodging the Noticeis a Member of the Association playingin the FA Premiership or the FootballLeague or any Subordinate of suchMember of the Association; or

28.2.3.2 £262.00 if the Party lodging the Noticeis a Member of the Association playingin the League of Wales, FA Conference,Southern League or Northern League orany Subordinate of such Member of theAssociation; or

28.2.3.3 £183.00 if the Party lodging the Noticeis a Member of the Association which isan Area Association (as defined in Rule2.2) or League (as defined in Rule 2.3)or Qualifying Club (as defined in Rule2.1) playing in a League or anySubordinate of such Member of theAssociation; or

28.2.3.4 £100.00 in any other case.

28.2.4 any Disciplinary Panel Request Noticewhich is not accompanied by theappropriate Disciplinary Panel Fee will berejected by the Association and anyincorrect fee will be returned and, in thecase of an appeal under Rules 25.1.2 or25.1.3, time will continue to run for theservice of the Disciplinary Panel RequestNotice within the original ten (10) calendarday period stipulated in Rule 28.2.2;

28.2.5 the Association will have the right (but notthe obligation) to carry out an investigationbefore referring the matter to theDisciplinary Panel and the Association willbe entitled to reject the Disciplinary PanelRequest Notice if it reasonably considersthat the Disciplinary Panel Request Noticeis frivolous or vexatious;

28.2.6 subject to Rule 28.2.5, the Association willwithin twenty-eight (28) calendar days ofactual receipt of the Disciplinary PanelRequest Notice send a written notice to theparties confirming the date, time and placeof the Disciplinary Panel hearing . In thecase of an appeal under Rules 25.1.2 or25.1.3, the Disciplinary Panel proceedingswill be a re-hearing of the case and theDisciplinary Panel will decide the matteron the basis of the evidence produced tothem. At any time prior to the DisciplinaryPanel hearing any Party will have the rightto waive their right to a private hearing buta hearing will take place unless all Partiesagree in writing to waive their right to aprivate hearing;

28.2.7 where the Party involved is an individualperson, they will be required to attend ahearing in person. Where the Partyinvolved is not an individual person, one ormore duly authorised seniorrepresentatives of the Party will attend thehearing, whether directors, officers orotherwise;

28.2.8 the Parties involved will disclose to eachother and to the Association suchdocuments as they intend to produce inevidence at the hearing. Wheneverreasonably possible the Parties will makesuch disclosures no less than forty-eight(48) hours prior to the hearing;

28.2.9 the Parties will be entitled to make openingand closing remarks at the hearing and tocall a reasonable number of witnesses whowill be expected to answer questions incross examination. Members of theDisciplinary Panel will be entitled to askquestions of any witnesses during thehearing. No Party will be obliged to giveevidence in person but the DisciplinaryPanel will be entitled to draw suchinference as may be reasonably appropriateif the Party declines to do so. TheChairman of the Disciplinary Panel willwarn the Party concerned of this fact;

28.2.10 the Disciplinary Panel hearing will proceedin the absence of either Party, unless theDisciplinary Panel reasonably considersthat the absent Party has given anacceptable reason for such non-attendance,in which case the hearing will beadjourned;

28.2.11 the Disciplinary Panel will retire toconsider its findings in camera. A decisionmay be announced on the day or reservedto a later date in which case the decisionwill be delivered in writing;

28.2.12 the Parties will be entitled to legal or otherprofessional representation at theDisciplinary Panel hearing;

28.2.13 where the Parties to the appeal have allwaived their rights to a private hearing, theDisciplinary Panel will consider suchinformation as it considers reasonablynecessary to decide the matter including,

without limitation, any writtenrepresentations made for or on behalf ofthe Parties. The Disciplinary Panel will beentitled to seek such further information orevidence as it deems necessary;

28.2.14 whether or not a hearing takes place, theDisciplinary Panel will have absolutediscretion whether to make a cost order foror against a Party to the proceeding; and

28.2.15 whether or not a hearing takes place, theAssociation will send written confirmationof the Disciplinary Panel’s findings to theParties.

29. The following procedures will apply if a Party wishes torefer a matter to the Appeals Panel:-

29.1 Where a Party wishes to appeal pursuant to Rule 25.2.1 against a decision of the DisciplinaryPanel:-

29.1.1 the notice from the Party wishing to appeal(“the Disciplinary Appeal Notice”) must bein writing and served on the Associationnot more than ten (10) calendar days afterthe earlier of (a) the Disciplinary Panelannouncing its decision at the time of anyhearing or (b) receipt by the Partyappealing of written notification of theDisciplinary Panel’s decision. TheDisciplinary Appeal Notice will be markedfor the attention of the Secretary General,except where the Association is the Partyappealing, in which case the notice ofappeal will be deposited with theAssociation’s disciplinary department. TheDisciplinary Appeal Notice must state thegrounds of appeal and the Party appealingshall not be permitted to raise any othergrounds of appeal without the leave of theChairman of the Appeals Panel;

29.1.2 any Disciplinary Appeal Notice lodgedafter ten (10) calendar days will be rejectedunless the Party lodging the same candemonstrate to the reasonable satisfactionof the Association that it was notreasonably practicable to lodge theDisciplinary Appeal Notice within the timelimit;

29.1.3 where the Association is the Partyappealing, no appeal fee will be payable.Where any other Party is appealing, theappropriate “Appeals Panel Fee” must

accompany the Disciplinary AppealNotice. The Appeals Panel Fee will bedetermined by the same categorisation ofMembers of the Association and others asused for determining the DisciplinaryPanel Fee under Rule 28.2.3 but theAppeals Panel Fee will be two (2) timesthat of the Disciplinary Panel Fee;

29.1.4 any Disciplinary Appeal Notice which isnot accompanied by the appropriateAppeals Panel Fee will be rejected by theAssociation and any incorrect fee will bereturned and time will continue to run forthe service of the Disciplinary AppealNotice within the original ten (10) calendarday period stipulated in Rule 29.1.1;

29.1.5 the Association will within fourteen (14)calendar days of actual receipt of theDisciplinary Appeal Notice send a writtennotice to the Parties confirming the date,time and place of the Appeals Panelhearing. Subject to Rule 29.1.7, theAppeals Panel proceedings will be a re-hearing of the case and the Appeals Panelwill decide the matter on the basis of theevidence produced to them. At any timeprior to the Appeals Panel hearing anyParty will have the right to waive theirright to a private hearing but a hearing willtake place unless all Parties agree inwriting to waive their right to a privatehearing;

29.1.6 the Appeals Panel hearing will be a re-hearing of the case originally decided bythe Disciplinary Panel. The same rules ofattendance, disclosure of documents,presentation of evidence, conduct of theproceedings and rights of representationwhich applied in the original DisciplinaryPanel hearing will apply in the AppealPanel hearing;

29.1.7 where the appeal is by the Associationagainst the penalty or sanction imposed bythe Disciplinary Panel, the Appeals Panelhearing will confine itself to mattersrelevant to the appropriateness of the saidpenalty or sanction and not DisciplinaryPanel’s finding of guilt;

29.1.8 where the Parties to the appeal have allwaived their rights to a private hearing or

where a Party does not attend the privatehearing, the Appeals Panel will considersuch information as it considers reasonablynecessary to decide the matter including,without limitation, any writtenrepresentations made for or on behalf ofthe Parties. The Appeals Panel will beentitled to seek such further information orevidence as it deems necessary;

29.1.9 whether or not a hearing takes place, theappeals panel will have absolute discretionwhether to make a costs order for oragainst a Party to the proceedings; and

29.1.10 whether or not a hearing takes place, theAssociation will send written confirmationof the Appeals Panel’s findings to theParties.

29.2 Where a Party wishes to appeal pursuant to Rule25.2.2 against a decision of Council or itsCommittees or Sub-committees:-

29.2.1 the Party wishing to appeal will givewritten notice to the association (markedfor the attention of the Secretary General)stipulating the nature of the decisioncomplained of and requesting that suchmatter be referred to the Appeals Panel(“the Council Appeal Notice”). The Partyappealing must state the grounds of appealand the Party appealing shall not bepermitted to raise any other grounds ofappeal without the leave of the Chairmanof the Appeals Panel;

29.2.2 the Council Appeal Notice will be servedon the Association not more than twenty-eight (28) calendar days after thepublication of the minutes of the relevantmeeting of the Council or its Committeesor Sub-committees at which the decisioncomplained of was made. Any CouncilAppeal Notice lodged after twenty-eight(28) calendar days will be rejected unlessthe Party lodging the same can demonstrateto the reasonable satisfaction of theAssociation that it was not reasonablypracticable to lodge the Council AppealNotice within the time limit;

29.2.3 the appropriate “Appeals Panel Fee” mustaccompany the Council Appeal Notice.The Appeals Panel Fee will be determinedby the same categorisation of Members of

the Association and others as used fordetermining the Disciplinary Panel Feeunder Rule 28.2.3 but the Appeals PanelFee will be two (2) times that of theDisciplinary Panel fee;

29.2.4 any Council Appeal Notice which is notaccompanied by the appropriate AppealsPanel Fee will be rejected by theAssociation and any incorrect fee will bereturned and time will continue to run forthe service of the Council Appeal Noticewithin the original twenty-eight (28)calendar day period;

29.2.5 the Association will have the right (but notthe obligation) to carry out an investigationbefore referring the matter to the AppealsPanel and the Association will be entitledto reject the Council Appeal Notice if itreasonably considers that the CouncilAppeal Notice is frivolous or vexatious;

29.2.6 subject to Rule 29.2.5, the Association willwithin twenty-eight (28) calendar days ofactual receipt of the Council AppealsNotice send a written notice to theappealing Party and to the Chairman ofCouncil who will accept service on behalfof the Council confirming the date, timeand place of the Appeals Panel hearing butat any time prior to the Appeals Panelhearing any Party will have the right towaive their right to a private hearing but ahearing will take place unless all Partiesagree in writing to waive their rights to aprivate hearing;

29.2.7 the Appeals Panel hearing will involve afull consideration of all relevant matters.The rules of attendance, disclosure ofdocuments, presentation of evidence,conduct of proceedings and rights ofrepresentation which apply in proceedingsbefore the Disciplinary Panel shall apply tothe proceedings before the Appeals Panel;

29.2.8 where the Parties to the appeal have allwaived their rights to a private hearing orwhere a Party does not attend the hearing,the Appeals Panel will consider suchinformation as it considers reasonablynecessary to decide the matter including,without limitation, any writtenrepresentations made for or on behalf of

the Parties. The Appeals Panel will beentitled to seek such further information orevidence as it deems necessary;

29.2.9 whether or not a hearing takes place, theAppeals Panel will have absolutediscretion whether to make costs order foror against a party to the proceedings; and

29.2.10 whether or not a hearing takes place, theAssociation will send written confirmationof the Appeals Panel’s findings to theParties.

30. The following procedures will apply if a Partywishes to appeal to the Independent ArbitrationPanel against a decision of the Appeals Panel:-

30.1 the notice of appeal from the Party (“theArbitration Notice”) must be in writing andserved on the Association not more thanten (10) calendar days after the earlier of(a) the Appeals Panel announcing itsdecision at the time of any hearing or (b)receipt by the Party appealing of writtennotification of the Appeal Panel’s decision.The Arbitration Notice will be marked forthe attention of the Secretary General,except where the Association is the Partyappealing, in which case the arbitrationNotice will be deposited with theAssociation’s disciplinary department;

30.2 any Arbitration Notice lodged after ten(10) calendar days will be rejected unlessthe lodging Party the same can demonstrateto the reasonable satisfaction of theAssociation that it was not reasonablypracticable to lodge the Arbitration Noticewithin the time limit;

30.3 where the Association is the Partyappealing, no appeal fee will be payable.Where any other Party is appealing, theappropriate “Arbitration Fee” mustaccompany the Arbitration Notice. TheArbitration Fee will be determined by thesame categorisation of Members of theAssociation and others as used fordetermining the Disciplinary Panel Feeunder Rule 28.2.3 but the Arbitration Feewill be five (5) times that of theDisciplinary Panel Fee;

30.4 any Arbitration Notice which is notaccompanied by the appropriate

Arbitration fee will be rejected by theAssociation and any incorrect fee will bereturned and time will continue to run forthe service of the Arbitration Notice withinthe original ten (10) calendar day period;

30.5 the Association will within fourteen (14)calendar days of actual receipt of theArbitration Notice send a written notice tothe Parties (and where the Association is aParty, to the Chairman of Council who willaccept service on behalf of theAssociation) confirming the identity andcontact particulars of the independentsports arbitration service selected underRule 27.3 to act as the IndependentArbitration Panel to decide the matter;

30.6 the procedures to be followed by theIndependent Arbitration Panel will be inaccordance with the rules or regulations ofthe independent sports arbitration serviceselected under Rule 27.3 provided thatnothing in such rules or regulations willsupercede Rule 25.4 (right to a privatehearing) or Rule 35 (application of thelaws of England and Wales).

PENALTIES, SANCTIONS AND OTHER POWERS

31. Where:-

31.1 under Rule 25.1 the Disciplinary Panelfinds the Party charged guilty of aDisciplinary Offence, the DisciplinaryPanel will have the the power to order thefollowing penalties or sanctions against theParty charged (or two or moreconcurrently):-

31.1.1 suspension from, or any involvement in,Football or Football Management eitherpermanently or sine die or for a specificand stated period;

31.1.2 a fine;

31.1.3 a censure;

31.1.4 the closure of a football ground eitherpermanently or sine die or for a specificand stated period;

31.1.5 the offending Party, if a club, to forfeitpoints awarded in one or morecompetitions;

31.1.6 the offending Party, if a club, to be

disqualified from playing in one or morecompetitions;

31.1.7 such other penalty or sanction as theDisciplinary Panel shall reasonablydeem fit including, without limitation, awritten undertaking from the Partycharged as to their future conduct; or

31.1.8 the offending Party, if a club, to makesuch publication in its programme as theDisciplinary Panel may direct.

31.2 under Rules 25.1.2 or 25.1.3 theDisciplinary Panel hears an appeal againsta decision by a subordinate or other thirdparty against a decision of a Member of theAssociation, the Disciplinary Panel willhave the power to grant or deny the appeal(in whole or in part) and the power toincrease or decrease the penalty or sanction(if any) imposed by the Member of theAssociation or substitute such otherpenalty or sanction as the DisciplinaryPanel shall deem fit; and

31.3 in the case of any other proceedings underthe jurisdiction of the Disciplinary Panelpursuant to Rules 25.1.4 or 25.1.5, theDisciplinary Panel will have the power tomake such order or ruling as it deemsreasonable to resolve the dispute ordifference.

32. Where the Appeals Panel hears an appeal against adecision of the Disciplinary Panel, the Appeals Panel willhave the power to order:-

32.1 where the Association has appealed againstthe penalty or sanction imposed by theDisciplinary Panel under Rule 31.1, toincrease or decrease the penalty or sanctionimposed by the Disciplinary Panel orsubstitute such other penalty or sanction aswas available to the original DisciplinaryPanel as the Appeals Panel shall deem fit;

32.2 where the Appeals Panel hears an appealby the Party charged with a DisciplinaryOffence against a finding by theDisciplinary Panel under Rule 25.1.1, theAppeals Panel shall have the power togrant or deny the appeal in whole or in partand the power to increase or decrease thepenalty or sanction imposed by theDisciplinary Panel or substitute such other

penalty or sanction as was available to theoriginal Disciplinary Panel as the AppealsPanel shall deem fit;

32.3 where the Appeals Panel hears an appealby a Party against a decision of theDisciplinary Panel under Rules 25.1.2,25.1.3, 25.1.4 or 25.1.5 the Appeals Panelshall have the power to grant or deny theappeal in whole or in part and where theParty appealing appeals against anypenalty or sanction imposed by theDisciplinary Panel, the Appeals Panel willhave the right to increase or decrease thepenalty or sanction imposed by theDisciplinary Panel or substitute such otherpenalty or sanction as the Appeals Panelshall deem fit;

32.4 where the Appeals Panel hears an appealunder Rule 25.2.2 by any member of theAssociation or subordinate or other thirdparty against a decision of Council and itsCommittees or Sub-committees (other thandecisions of the Disciplinary Panel), theAppeals Panel will only have the power toconfirm or disallow in its entirety the saiddecision of Council or its Committee orSub-committee.

33. The Independent Arbitration Panel will have the power togrant or deny any appeal made to it in whole or in part(except an appeal against a decision of the Appeals Panelmade under Rule 25.2.2 where the IndependentArbitration Panel will only have the power to confirm ordisallow in its entirety the decision of Council or itsCommittee or Sub-committee) and to impose suchpenalty or sanction or other order as the IndependentAppeals Panel deems reasonable and where the appeal isagainst a penalty or sanction imposed by the AppealsPanel, the Independent Arbitration Panel will have theright to increase or decrease the penalty or sanction as theIndependent Arbitration Panel shall deem fit.

34. If a Party is in default for twenty-one (21) days in failingto pay or carry out any penalty or sanction or other ordermade by the Disciplinary Panel, Appeals Panel orIndependent Arbitration Panel, the Party willautomatically be suspended from Football or FootballManagement until the penalty or sanction or other orderhas been paid or complied with in full and the Associationshall have the right to refer the non-compliance back tothe Panel which made the relevant decision and that

Panel shall have the power to impose further penalties orsanctions as a result of a non-compliance.

MISCELLANEOUS

35. The law governing any proceedings before theDisciplinary Panel, Appeals Panel, or IndependentArbitration Panel shall be the law of England and Wales.

36. The Rules of service set out in Rule 89 shall apply to allnotices and any other communications whatsoever sent inconnection with any proceedings of a Disciplinary Panel,Appeals Panel or Independent Arbitration Panel.

37. The Rules are sufficient to enable the Association,Members of the Association and Subordinates to resolveall Disciplinary Offences and disputes or differences. TheParties must exhaust all procedures and processes ofappeal in the Rules before taking legal proceedings andthen only as a last resort.

38. Notwithstanding any rule of any Member of theAssociation to the contrary, it shall be a condition of theAssociation sanctioning any competition organised by theMember of the Association or any Subordinate that anyappellant may lodge an appeal with the DisciplinaryPanel (under Rule 25.1.2) against any decision of theMember of the Association or a subordinate.

39. Any Decision of the Disciplinary Panel, Appeals Panel orIndependent Arbitration Panel shall be a decision of theAssociation and all Members of the Association willcomply with the same and will ensure that allSubordinates comply with the same.

CONTRACTS AND TRANSFERS

40. Any player not registered who appears for a club in anyofficial match shall be considered to have playedillegitimately. Without prejudice to any measure requiredto rectify the sporting consequences of such anappearance, sanctions may also be imposed on the playerand/or the club.

40.1 Subject to an authorised transfer no Player undercontract shall be allowed to play for more than oneclub in any one season, whether any such club is aQualifying Club or any other club within thejurisdiction of this Association or of any otherNational Association, unless special writtenpermission for the player so to do has been obtained

from the Council. Players under contract may betransferred from one club to another during theplaying season, subject to Rule 42.6. Any suchtransfer will be null and void unless made on a formas prescribed by the Secretary from time to time.All such said forms shall be supplied only by theSecretary of the Association and may not beobtained from another source. Any player thustransferred must be re-registered with thisAssociation by the club to which the said player istransferred.

40.2 If circumstances arise causing it to be urgent that aplayer shall be registered or transferred with theminimum amount of delay the registration form andthe transfer form (if any) must be forwarded toarrive 24 hours prior to the match (Sundayexcluded) by Special Delivery to the RegistrationsDepartment of this Association and a facsimiledispatched to the Registered office via (029) 20435876 at 11 & 12 Neptune Court, Vanguard Way,Cardiff. CF24 5PJ. If such registration form andtransfer form (if any) is found to be in order, suchform or forms shall be deemed to have beenreceived at the time of arrival of the facsimile.

40.3 A Player under contract may be registered for amaximum of three (3) clubs during the period from1st July to 30th June of the following year andduring such period the Player will only be eligibleto play for two (2) clubs. Any exemption is as perthe revised FIFA regulations on the Status andTransfer of Players (Article 5 Para. 3).

41. No Player under contract shall enter into any negotiationor engagement with any other club than the one withwhich he/she is registered for the time being, whethersuch other club be within the jurisdiction of thisAssociation or of another National Association, until suchtime as his/her existing engagement has terminated. Noplayer, whilst he/she is bound by any existingengagement, may be approached by another club, or byan official of another club, or by any person whatsoever,with a view to inducing such player to leave the club withwhich he is registered at the time in question, upon thetermination of his existing engagement, except ashereinafter provided for in Rule 45.

42. 42.1 All players under written contract approved by theCouncil shall be registered with the Association.Such registration in every case must be made on aform as prescribed by the Registrations Departmentfrom time to time. All such said forms shall besupplied only by the Registrations Department ofthe Association and must not be obtained from any

other source. Each such form, when once all theinformation required has been written thereon, mustbe signed by the player concerned and such saidsignature must be properly attested by one witness.Each such said form, after such signature andattestation aforesaid has been completed, must bereturned to the Registrations Department of thisAssociation to arrive within five days of such saidsignature and attestation and shall be accompaniedby a copy of the agreement entered into betweenclub and player. The minimum weekly payment toplayers under written contract shall be £15.00,either per match per week, over a period as definedin the player’s written contract. The minimumperiod of a Contract shall be between two (2)Registration Periods. The maximum duration of aContract shall be five (5) years; however playersunder the age of 18 years may not sign a contractfor a term longer than three (3) years.

42.2 The Registrations Department, on behalf of thisAssociation, may refuse to accept any registrationwhich does not comply with the rules of theFootball Association of Wales. Once the saidagreement is accepted it is binding on both parties.

42.3 No player shall be allowed to play until these ruleshave been complied with strictly and until theSecretary of any club concerned registering anyplayer concerned shall have received anacknowledgement in respect of that player on theofficial form from the Registrations Department ofthis Association. Such acknowledgement shall besent by the Registrations Department of thisAssociation within forty-eight hours (excludingSunday) of the receipt of the registration concernedin cases where there is no irregularity.

42.4 If, following written notification from the FootballAssociation of Wales to the relevant League Board,a club is determined to be in default of any paymentdue in accordance with a Player’s contract orpayment in consequence of termination of suchContract, the League Board may place an embargoon any registration by such Club until payment ismade.

42.5 A player registered under written contract with theFootball Association of Wales shall play for theclub by which the Player is registered unless, in thecase of benefit, testimonial and charity matches, thePlayer obtains special permission of the FootballAssociation of Wales, or has the written permissionof the Club, such permission to be copied to the

Football Association of Wales, to play up to twotrial matches with another Club, provided that suchmatches are not for the First Team of the club in aCompetition match and both are within a period ofone month from the date of such permission.Permission shall not be given twice in the sameSeason for such trials for the same player to thesame Club.

42.6 Registration periods will apply to all Playersholding a written contract with their club and whoparticipate in adult football. The periods forregistration and transfer of Contract Players will beas follows:-

42.6.1 Players registered with a club playing in aleague within Wales – 1st June until 31stAugust inclusive and 1st January until 31stJanuary inclusive; and

42.6.2 Players registered with a club playing inthe English pyramid system – as per therules and regulations applicable to theleague in which the club plays.

42.7 All payments made to Players must be made by theClub and fully recorded in the accounting recordsof the Club.

42.8 All salaried payments must be subject to PAYE andNational Insurance, and the appropriate recordsmaintained by the Club.

42.9 Any players paid expenses must be reimbursed viaan expense claim form. The Club must retain allexpense records in a format acceptable to the InlandRevenue.

43. Any agreement made between a club in membership withThe Football Association and a player will include anoption exercisable in writing by the club at least sixty(60) calendar days before the expiry of the currentcontract to renew the agreement for a further period (suchperiod to be for not longer than the original period) onterms and conditions not less favourable than those whichapplied during the original period. If the club shall haveexercised the option for such further period and it shallhave not less than sixty (60) calendar days prior to theexpiry of the current contract, by notice in writing to theplayer indicating that the club requires to offer a furtherre-engagement to the player after the further period, thefollowing practice shall prevail:-43.1 The notice given by the club to offer a further re-

engagement to the player shall specify the termsand conditions which the club is prepared to agreeand must be sent by Special Delivery to the player

and such notice shall also set out the following sub-paragraphs 43.2, 43.3 and 43.4 of this Rule. A copyof such notice must be forwarded at the same timeto the Registrations Department of this Association.

43.2 unless within 28 days of the service of the noticemaking such an offer the player notifies the club inwriting that he/she does not accept such terms andconditions, the agreement shall continue for thefurther period of re-engagement specified in theclub’s notice and on the terms and conditionstherein set out;

43.3 If within such period of 28 calendar days the playernotifies the club that the player does not accept suchterms and conditions and they are unable to agreealternative terms and conditions and sign anyagreement embodying the same within such periodof 28 calendar days or, alternatively agree withinthat period terms for the transfer of the player’sregistration, either party shall have the right to referthe matter to the relevant League Board for adecision, if either party is dissatisfied with suchdecision, there shall be a right of appeal to theRegistrations Department of the Association, butsuch appeal must be made within not more than 10calendar days of the receipt of the decision of therelevant League Board;

43.4 If a final decision has not been given in accordancewith the procedure set out in rule 43.3 by the datewhen the agreement with the player would haveexpired had the offer of re-engagement not beenmade, the employment of the player shall continueon the like terms and conditions as existedimmediately before that date until a final decisionhas been given.

43.5 Any communication given under these rules mustbe sent by Special Delivery.

43.6 Temporary transfers of a Contract player’sregistration shall be on the prescribed temporaryloan form and shall only be approved for a definedperiod and subject to the condition of suchtemporary transfer being known to the Player, andapproved by the Registrations Department of theAssociation, prior to registration with the respectiveLeague.

43.7 Temporary loan transfers shall be allowed to orfrom Clubs providing the rules and regulations ofthe respective Leagues allow.

43.8 A Club can have up to 4 players on loan during theSeason, but no more than 2 players at any one time.No more than 2 players may be from any one clubduring the Season.

43.9 The temporary transfer of players shall only beallowed during a registration period as set out in theFAW rule 42.6.

43.10The minimum period of a temporary transfer shallbe the time between two Registration Periods,subject to Rule 42.6.

43.11Temporary loan transfers which subsequentlybecome permanent transfers shall not count againsta Club’s quota of temporary loan transfers for thatSeason.

43.12The temporary loan transfer of a goalkeeper may besubject to a recall clause but this may only beimplemented in exceptional circumstances with theconsent of the respective League Board.

43.13The temporary loan of transfer of an outfield playermay be subject to a recall, but this may only beimplemented after twenty-eight (28) days from theoriginal date of the temporary loan transfer.

44. 44.1 Except by mutual consent a club or player shall notbe entitled to terminate the agreement betweenthem.

44.2 Application for cancellation of an agreement by theplayer must be made in accordance with the Rulesof the Football Association of Wales.

44.3 When an agreement has been cancelled by mutualconsent notice signed by the club and the playershall at once be sent to the RegistrationsDepartment of this Association who will cancel theregistration.

44.4 Upon cancellation, by mutual consent of bothPlayer and Club, of a Contract agreement, thePlayer will not be able to regain his Amateur statusand therefore register for a further Club until aperiod of 30 days has elapsed. The period shallstart as from the day the Player competed in his lastcompetitive match with the club with which he wasregistered as a Non-Amateur.

44.5 The agreement may provide that a player shall onlybe paid for each match in which the player actuallyplays or attends as a substitute, but should anyplayer not be selected by the club or play or attendas a substitute for a period of four (4) weeks, theplayer may apply to the club to cancel theagreement and registration, and if refused, theplayer shall be at liberty to apply to this Associationfor the cancellation of the agreement upon suchterms as may be deemed reasonable.

44.6 Where conditions, other than payment of wages for

playing football, form part of an agreement, thisAssociation in dealing with claims there under willrestrict its investigations and decision solely to thequestion of wages for playing as stipulated in theagreement.

45. No club, or any official or member of any club, shallinduce or attempt to induce any player under contractwith another club to leave the said other club, for whichthe player is then registered, until the period of suchregistration has expired, unless the written sanction ofthat said other club, for which the player concerned isregistered at the time in question, is first obtained. TheAssociation is hereby empowered to deal with anyoffending club, or any offending official or member ofany club, for any breach of this Rule in such manner as tothe Association shall seem fit. If the player has notreceived notice exercising an option or offering a furtherre-engagement under Rule 43 by the time specified forsuch notice to be served, or within six months of therelevant expiration date, the player shall be free to makesuch enquiries or approaches as the player thinks fit tosecure employment when the said agreement or renewalthereof expires. (As per Article 18 para. 3 of the currentFIFA Regulations on the Status and Transfer of Players).

46. 46.1 Any club shall, in the case of misconduct by aplayer, or breach of the training or disciplinary rulesor orders of the club, have the right to suspend suchplayer for period not exceeding fourteen (14) daysor impose a fine not exceeding two (2) weekswages, any such penalty must commence five (5)days following written notification to the player.The club must notify the Association of suchsuspension or fine within two (2) days. The playermay dispute any penalty, by forwarding an appealto this Association within three (3) days (excludingSunday) against such action by the club. Uponlodging an appeal, in accordance with Section E ofthese Rules, the player must pay the appropriate feeas per FAW Rule 28.2.3.

46.2 Each breach must be addressed individually inwriting to the player stating the nature of thebreach, the rule or order that has been breached, thepenalty to be imposed and the player’s full right ofappeal.

46.3 The notice of an alleged breach by the player mustbe sent to the player by Special Delivery, a copy ofthe notice to be forwarded at the same time to theRegistrations Department of the Association

46.4 The suspension or fine shall not operate as a

termination or cancellation of the agreementbetween the club and player.

46.5 A player under suspension may be re-signed by theclub or any option by the club may be exercisedsubject to the terms of the player’s suspension.

47. A player shall not enter into a contract with any club untilthe player reaches his/her sixteenth (16th) birthday and isno longer in compulsory education. If a player aged undereighteen (18) years wishes to confirm a contract with aclub, the agreement must be witnessed and countersignedby a parent or recognised guardian.

48. Subject to these Rules, any Qualifying Club or any otherclub in membership of or affiliated to an Area Associationmay negotiate whatever financial arrangements with itsplayers as may be mutually acceptable. (Refer to Rule42.1 for minimum payment).

49. Where an agreement between a club under thejurisdiction of the Association and a player provides forthe club terminating an agreement by notice to the playerthe following practice shall prevail:-

49.1 A player shall have the right to appeal to therelevant League and a further right of appeal to theAssociation;

49.2 A club on giving notice to a player to terminate theplayer’s agreement must state in the notice thename and address of the Secretary of the League towhich the player may appeal, and must also, at thesame time, give notice to the league of which theclub is a member, both notices to be forwarded bySpecial Delivery;

49.3 A copy of the notice sent to the player must, at thesame time, be forwarded to the RegistrationsDepartment of this Association, the copy of thenotice to be forwarded by Special Delivery;

49.4 The player shall have the right of appeal to theLeague, but such appeal must be made within ten(10) calendar days of the receipt of the notice fromthe club;

49.5 the notice terminating the agreement must informthe player the reasons or grounds for such notice;

49.6 The appeal shall be heard by the relevant League nolater than twenty-eight (28) calendar days followingreceipt of the appeal notice from the player;

49.7 If either party is dissatisfied with the appealdecision of the relevant League, there shall be a

right of further appeal to the Association but suchfurther appeal must be made within ten (10)calendar days of the receipt of the decision of therelevant League,

49.8 The League shall report to the RegistrationsDepartment of the Association when the matter isfinally determined, and the agreement andregistration shall be cancelled by the RegistrationsDepartment of the Association where necessary.

50. Agreements between clubs and players shall contain aclause, showing the provision made for dealing withdisputes about termination of agreements under Rule 49and for the cancelling of the agreement and registrationby the Association.

51 51.1. In the case of a male Player reaching the age ofsixteen (16) and in the case of a female Player onreaching the age of sixteen (16), and in either casebefore the Player reaches the age of nineteen (19), aPlayer not holding a written contract with a clubshall be permitted to play in both youth and adultfootball. The said Player must be registered witheach club, if he/she plays youth and adult footballfor different clubs. If the said Player plays youthfootball for a club playing in a league at NationalLevel he/she shall only be allowed to play adultfootball for another club if that other club playsonly in a league or leagues at Recreational Level.For the avoidance of doubt, this right shall onlyapply for the remainder of the playing season inwhich the said Player reaches his/her nineteenth(19) birthday.

51.2 A player who does not hold a written contract withhis club shall not be approached, except during theperiod of ‘Close Season’ by any club or personattempting to induce such player to play for anotherclub or clubs without at least seven (7) days’ noticein writing to the Secretary of the club for which thePlayer was last known to have played and thenegotiations with the player must cease at theexpiration of fourteen (14) days from the day ofsuch notice being given. The notice must beforwarded by recorded delivery, registered post or awritten acknowledgement otherwise obtained. Asecond notice shall not be given by the same club inrespect of the same Player during the same footballseason

51.3 Registration periods will apply to all Players notholding a written contract with their club and whoparticipate in adult football. The periods forregistration and transfer of Players will be asfollows:-

51.3.1 Players registered with a club playing in theWelsh Premier league – 1st June until 31stAugust inclusive and 1st January until 31stJanuary inclusive;

51.3.2 Players registered with a club playing in aleague below the Welsh Premier League –1st June until the last Thursday in Marchinclusive; and

51.3.3 Players registered with a club playing in theEnglish pyramid system – as per the rulesand regulations applicable to the league inwhich the club plays.

51.4.1 Whether registered for a club which playsin a league at National Level or whichplays in a league at Recreational Level, aPlayer not holding a written contract withtheir club may only be registered for oneclub at a time PROVIDED THAT this shallnot prevent:-

51.4.1.1 a youth Player being registered withseparate clubs to play both youth andadult football in the circumstancespermitted in Rule 51.1.1; or

51.4.1.2 a Player also being registered withanother club which is not a memberand which only ever playsAssociation Football on a Sunday.

51.4.2 Whether registered for a club which is amember of a league playing at NationalLevel or a league playing at RecreationalLevel a Player may be registered for amaximum of three (3) clubs during theperiod from 1st July to 30th June of thefollowing year and during such period thePlayer will only be eligible to play for two(2) clubs PROVIDED THAT if a Playerregisters for a second club pursuant to theexemptions permitted in Rules 51.4.1.1 or51.4.1.2 in either case such secondregistration shall not count towards thetotal of three (3) registered clubs andplaying for such second club shall notcount towards the total of playing for two(2) clubs.

51.5 When a Player is already registered with a club butwithout a written contract, the following procedureshall apply:-

51.5.1 formal notice of approach by the club mustbe given to the club to which the Player isalready registered;

51.5.2 the approaching club or person shall notgive notice of intention to approach morethan one (1) Player of a club at the sametime and shall not give notice of intentionto approach another Player of the sameclub within twenty-one (21) days of a priornotice;

51.5.3 the seven (7) days formal notice ofapproach must expire within a recognisedRegistration Period of the club providingthe notice of approach.

51.6 Any dispute as to whether a consent has beenunreasonably withheld under Rule 51.5 may bereferred to this Association or the Area Associationas the case may be. In addition to any other penaltyimposed under Rule 31 for a breach of this Rule, theregistration of the Player shall be cancelled andhe/she shall not be eligible to play for the offendingclub except with the permission of the Associationor the Area Association as the case may be.

51.7 A league playing at Recreational Level shall beentitled (but not obliged) to adopt the followingRule into its own rule book in order to regulate firstteam Players playing in the reserve team of thesame club:-

“Where (i) a club which plays in a leagueat National Level and also has a reserveteam playing in a league at RecreationalLevel and (ii) the club’s first team (whichplays in a league at National Level) doesnot have a playing fixture on a given day,then on that given day no more than three(3) Players from the club’s first team(which played in the club’s last fixture in aleague at National Level) shall be allowedto play in the reserve team fixture playedon that given day.”

The above sanctioned Rule shall be the only Rulepermitted by the Association to appear in the rulesof any organisation under the jurisdiction of theAssociation (whether as a Member or Subordinate)in respect of the regulation of first team Playersplaying in the reserve team of the same club.

51.8 No Player having taken part in matches for a clubshall be allowed to participate in a football matchfor another club without first satisfying the officialsof his/her existing club and intended club that

he/she has discharged his/her reasonable financialand other liability to the club or clubs for whichhe/she is, or was, a playing member. It is theresponsibility of the existing club to maintainrecords, mutually confirmed by club and Player,outlining any such liabilities.

51.9 A male Player aged under-16 and below and afemale Player aged under-16 and below mayregister for one club only and with effect from 1stJanuary in each season may only transfer with theapproval of his/her Area Association and inaccordance with the criteria as currently determinedby Council.

51.10 If a player wishes to change his/her status fromAmateur to Non-Amateur with his/her current clubi.e. register under written contract, then both FAWRules 42.1 and (unless it is the Player’s firstcontract of that current season) 42.6 will apply.

52 Girls football shall be arranged within the following agebands:-

52.1 There shall be no age grouping Rule for organised team football for players who are of the educationalages of academic years one (1), two (2), three (3), four (4) and five (5) (using current government classifications). For the purpose of this Rule, each academic year has a cycle from 1st September to 31st August and a child enters academic year one(1)in the year of the cycle which they reach their fifth (5th) birthday.

52.2 For girls who are of age in academic year six (6) (being the final year of Primary or Junior School) and girls in Secondary Schools (academic year seven (7) and above), the following rules on age groupings for organised team football and level of competition shall apply and nothing in this Rule shall prevent matches between players who are all of the same academic year:-

52.2.1 Academic year six (6) and seven (7) and referred to as Under 12.

52.2.2 Academic year eight (8) and nine (9) and referred to as Under 14.

52.2.3 Academic year ten (10) and eleven (11) and referred to as Under 16.

53. 53.1 No player who is under the age of eighteen yearsand who remains on the roll of a recognised schoolshall enter into a contract of employment with aclub within the jurisdiction of the Association buthe may be registered as an Associated Schoolboy(see Rule 54.5).

53.2 No player who is under the age of seventeen yearsshall enter into a contract of employment with aclub within the jurisdiction of the Association,except as a Trainee.

53.3 Players of sixteen or seventeen years of age who arenot receiving full-time education in accordancewith the provisions of the Education Acts may beregistered as a Trainee with the Association and theLeagues. The period of registration shall be twofull years for sixteen-years old school leavers andtwelve months for seventeen-year old schoolleavers. Players who sign for a club after leavingschool and taking up employment elsewhere shallbe registered for the balance of two years. Aregistration will be made on the form as prescribedby the Secretary from time to time.

53.4 On or after his seventeenth birthday a player maysign as a contract player subject to the Rules andRegulations of the League of which the club is amember, and to the Rules of the Association withreference to contract players, or remain as a Traineeuntil his eighteenth birthday.

53.5 If a player wishes to become a contract player, theclub for which he was registered as a Trainee shallbe entitled to his registration as a contract player. Ifthe club does not wish to register the player he shallbe free to register for any other club.

53.6 Each form, after completion of all particulars,including dates and signature, must be signed by theplayer, attested by his parent or guardian, andreturned to the Secretary of the Association withinfive days of such signature, accompanied by a copyof the agreement entered into by the club and theplayer and also a copy of his certificate of birth.

53.7 A Trainee does not become a member of a club noris he allowed to play until the club registering himshall have received acknowledgement of theregistration from the Association.

53.8 The names of such players shall be published andno club nor any person shall attempt to induce sucha player to leave the club for which he is registered.

to his club for the cancellation of his registrationduring his Traineeship. In such circumstances hemay not subsequently sign a contract to play foranother club until after a lapse of two years exceptwith the consent of the club for which he wasregistered as a Trainee.

53.10At the request of the player or his parent, the clubshall allow the player to continue his furthereducation or take up suitable vocational training.

53.11If a club fails to fulfil this or any other obligation inaccordance with the terms of its agreement, theplayer shall be entitled to apply to his club for thecancellation of his registration and in the event ofthe cancellation being effected, he may then sign asa trainee for another club. A player shall have theright of appeal to the Management Committee ofthe league of which the club is in membership if hisapplication be unreasonably withheld. If eitherparty is dissatisfied with a decision there shall be afurther right of appeal to the Association. A clubshall not have registered with the Association morethan fifteen Trainees at any one time.

54 54.1.1 Players of school age not registered inthe Programme for Excellence whilst aboy remains on the roll of a recognisedschool, priority must at all times begiven to school or school organisations’activities, in accordance with therecommendation of the MemorandumSchoolboys and School games publishedby the Association from time to time.

54.1.2 A junior player under the age of 16 yearsshall only play for a club located withina regional boundary defined by the AreaAssociation within which the juniorplayer resides. Any exemption is to beconsidered and granted by the AreaAssociation concerned and whose rulesshall include details of their regionalboundaries.

54.2 All clubs and leagues, excluding those that playtheir matches on Sundays, shall include in theirrules a rule which outlines the need to clear theavailability of a pupil with the Head Teacher.

54.3 Competitions for young players who are undereleven (11) years of age and more than six (6) yearsof age on 1st September in any playing season shallbe sanctioned by this Association or the Area

Associations, subject to the written consent of theplayers’ parents and to the competition being playedunder the rules of small-sided Football. Such gamesmay be played with mixed teams of boys and girlsand shall be played as friendly games only.

54.4 There shall be no age grouping Rule for organisedteam football for players who are of an age to attendInfant, Junior or Primary School, which (usingcurrent government classification) means childrenin academic years one (1), two (2), three (3), four(4), five (5) and six (6). Provided that no suchplayer shall play organised team football involvingplayers who are of an age to attend SecondarySchool, which means children in academic yearsseven (7) or above. For the purpose of this Rule54.4 (and Rule 54.5) each academic year has a cyclefrom 1st September to 31st August and a childenters academic year one (1) in the year of the cyclein which they reach their fifth (5th) birthday.

54.5 For children who are of an age to attend SecondarySchool (academic year seven (7) and above), thefollowing Rules on age groupings for organisedteam football shall apply and nothing in this Ruleshall prevent matches between players who are allof the same academic year:-

(A) Academic years seven (7) and eight (8)

(B) Academic years eight (8) and nine (9)

(C) Academic years nine (9) and ten (10)

(D) Academic years ten (10) and eleven (11)

(E) Academic years eleven (11) and twelve (12)

(F) Academic years twelve (12) and thirteen (13)

54.6 Players who reach the age of nine (9) years duringthe academic year and who are in full timeeducation may register with a recognised andlicensed Centre of Excellence through theprocedures established by the Association and setout in the Regulations current at the time. Thefollowing shall apply :-

54.6.1 it shall be a breach of the Rule for a Centrewithout a valid licence to coach and trainplayers of school age who are in full-timeeducation, and registered through theregistration scheme or for a licensedCentre of Excellence to play against anyCentre which is not licensed apart from aschool. The licensing authority for Centresof Excellence shall compriserepresentatives as determined by the

Association and which shall lay downregulations and guidelines by which theProgramme for Excellence shall be run;and

54.6.2 it shall be deemed to be misconduct for anyclub or club official to induce any player ofschool age registered with a separate clubor Centre of Excellence to leave school forthe purpose of signing a contract ofemployment.

54.7 An official involved with the organisation andoperation of junior players must hold the FootballAssociation of Wales’ Junior Leader AwardCertificate.

54.8 All books of the Association containing a recordeither of the registration or transfer, or of bothregistration and transfer, of players shall be open toinspection by the duly authorised representative ofany club within the jurisdiction of the Associationon payment of appropriate fee.

LEAGUES AND COMPETITIONS

55. 55.1 All leagues and competitions must be sanctioned bythe Council. No league or competition will besanctioned by the Council, unless each team takingpart in such league or competition fields a sideconsisting of eleven players, from which numberthere shall be no deviation, unless it be occasionedthrough injury or some such other and proper causeduring the course of any game in such league orcompetition.

55.2 Application for sanction of a league, charitycompetition or benefit competition or of any othercompetition coming within the direct jurisdiction ofthe Association, shall be made, and thereafterrenewed annually, in writing to the Secretary of theAssociation on or before the twentieth day of Julyimmediately preceding the playing season, duringwhich playing season the league or competition isintended to be played. Such application must bemade in every case on a form as prescribed by theSecretary from time to time. All such said formsshall be supplied only by the Secretary of theAssociation and may not be obtained from anyother source. Every such application must beaccompanied by two written copies of the rules ofthe league, or competition concerned. Every suchapplication must also be accompanied by a writtenlist of the names of all the clubs, which haveconsented and approved to join and take part in theleague or competition (as the case may be). such leagues and competitions shall observe theRules, Regulations, Bye-Laws and Orders of thisAssociation. All matches shall be played inaccordance with the laws of the game as settled byFIFA and UEFA.

56. Notwithstanding anything contained in Rule 55 or in anyother Rule, the Council may give permission for Six-a-Side and Five-a-Side competitions to be played, providedthat:-

56.1 the competition has been sanctioned by theAssociation or the Area Association concerned inaccordance with the requirements of Rule 55. Clubsseeking affiliation to an Area Association in orderto participate in a small side competition must becharged an affiliation fee;

56.2 in the case of single matches, charity competitions,and one-day competitions, eg. garden fetes, workssports days, they must be sanctioned by theAssociation or the affiliated Area Associationconcerned in accordance with the requirements ofRule 55, insofar as they are applicable. Thesanctioning of such a match or competition in thiscase shall automatically accord to the club and/orcompetition the status of affiliated players for theclub for which they play in the match orcompetition;

56.3 the rules governing the eligibility and conduct ofthe players shall be under the control of theManagement Committee of the sanctionedcompetition subject always to the over-ridingauthority of the Association or the affiliated AreaAssociation concerned and shall insofar as ispracticable be in conformity with the Rules andRegulations of the Association. In the case ofindividual matches the eligibility and conduct of theplayers shall be the responsibility of the sanctioningbody;

56.4 the playing of matches arranged by privateindividuals for speculative purposes shall not bepermitted;

56.5 for small side games played for charitableobjectives a statement of accounts of the event shallbe supplied to the sanctioning body concernedwithin twenty-one days (21). Where two AreaAssociations cover the same area, permission mustbe obtained from the appropriate parentAssociation. There shall be no close season forsmall side games. The laws applicable to theplaying of small side games shall be as set by theAssociation from time to time.

57. 57.1 No Area Association, nor League, nor QualifyingClub or other club under the jurisdiction of theAssociation, nor player, nor referee or Member ofthis Association or any other body or individual inany way within the jurisdiction of this Association,shall play in or take part in any league, tournament,charity competition or benefit competition or anyother competition within the boundaries of Walesunless such competition has been sanctioned by theCouncil.

57.2 No Area Association, nor League, nor QualifyingClub or other club under the jurisdiction of theAssociation, nor player, nor referee or Member ofthis Association or any other body or individual inany way within the jurisdiction of this Association,shall play, or take part in any league, tournament,charity competition or benefit competition or anyother competition outside the boundaries of Walesunless the said applicant shall have first obtainedthe sanction of this Association to participate in thesame. Such application for sanction shall be made,and renewed annually, in writing to the Secretary ofthis Association on or before the twentieth day ofJuly immediately preceding the playing season inwhich the said applicant wishes to participate in thesaid league or tournament or competition. Suchapplication must be made in every case on a formprescribed by the Secretary from time to time.

57.3 In all leagues or competitions recognised orsanctioned by this Association, the Council shallhave the right, as a condition of such recognition, orsanction, to co-opt one Member of the Council onto the Management Committee of such league orcompetition.

58. 58.1 Any cup competition or league of whatever kindwithin the jurisdiction of this Association shall onlybe played within an area approved and sanctionedby this Association, or by an Area Association.

58.2 Clubs, which enter for any or all of the cupcompetitions, must play off their ties in any roundconcerned in any such competition concerned on orbefore the Conference Date fixed by thisAssociation in respect of such round. Clubs maymake arrangements mutually to play off their ties inany such round concerned prior to the ConferenceDate fixed by this Association for that round. Anyclub, which, in breach of the provisions of thisRule, fails to play off its tie in any such roundconcerned on or before the Conference Date fixedin respect of that round, ipso facto shall be struck

out of the competition concerned. All ConferenceDates in any years concerned shall be notified inwriting by this Association to all Area Associationsand to all competitions concerned and to all clubsconcerned well in advance of the playing season inquestion.

59. Any club which is within the jurisdiction of theAssociation and which has received sanction from thisAssociation to become a member of and to compete inLeague Football or other competitions outside thejurisdiction of the Association, shall be deemed to haveagreed to accept and carry out in full its obligations tothose Welsh Football competitions, of which it may beexpected reasonably to become a member and in which itmay be expected reasonably to take part as defined byCouncil where each individual club is concerned. Thismeans that, at all times, a club shall field its strongestpossible team thus making every effort to stimulateinterest and bring credit to any Welsh Footballcompetition in which it competes. In the event of anyclub or other Football body complaining of hardship or ofany other unreasonable conditions, which are alleged tobe imposed by or to be the result of the operation of theprovisions of this Rule, such aggrieved club or otherFootball body (as the case may be) shall lay a complaintin writing and in proper form before the Council and theCouncil shall inquire into and investigate fully suchcomplaint. After such inquiry and investigation, theCouncil shall determine whether the complaint be well-founded or not. Such determination shall be conclusiveand binding on the parties concerned to whom it will becommunicated in writing by the Association.

60. 60.1 A competition may be used for trade or advertisingpurposes and the name of the donor of a cup ortrophy or any other person may form part of the titleof a Competition only with the prior consent of theAssociation.

60.2 Restricted advertising will be permitted on theshirts, shorts and stockings worn by player subjectto the written approval of the Association. Thedepth of the lettering in connection with suchadvertising shall not exceed 4 inches. A small motifof the manufacturer of the clothing may be worn,subject to the written approval of the Association.The emblem of the club, association or otherfootball body may, of course, be worn on the shirt.

61. No competition, which has been in existence during theplaying season proper, shall be allowed extended timeoutside the playing season proper, notwithstanding thatthe competition may be one for charitable purposes. Theonly matches allowed to be played after the end of theplaying season proper must be specially sanctioned

games arranged between two distinct clubs, or leagues, orArea Associations or between any two of them. The fullgate money received at any such match will be paid infull without any deductions whatsoever to a registeredCharity. Provided that charges actually paid forentertainment tax, advertising or Police services at anysuch match may be deducted from the gate moneyreceived at any such match.

62. Notwithstanding anything contained in these Rules, semifinal or final matches of Competitions of the Associationor of Area Associations, or of County Cup competitions,may be played not later than Saturday or Sundayfollowing the end of the season in any year as determinedby Council.

63. Any party in breach of any of the provisions of any Ruleor Rules in this section shall be liable to suspension or tosuch other penalties as the Council shall deem fit.

PRACTICE MATCHES

64. Practice Matches between teams of the same club, orbetween teams from different clubs may be played withthe consent of the appropriate Area Association duringthe 28 days immediately preceding the start of the playingseason. The net receipts must be distributed before the15th September in each season concerned as follows :-

64.1 not less than 25% to the Area Association to whichthe club or clubs are affiliated and the balance shallbe used or distributed in any such manner as theclub or clubs shall decide. When English andWelsh clubs play each other in public practicematches as provided for in this Rule, the 25% of thegate receipts referred to shall be equally divided,121⁄2% being given to the English County FootballAssociation concerned and the other 121⁄2% to therelevant Area Association;

64.2 the net receipts of each match shall be calculated bydeducting from each match receipts the essentialground and travelling expenses concerned with thematch which shall not in any case exceed 20% ofthe gross receipts. A return of the monies received,the expenses, and sums paid together with thenecessary receipts must be sent to the AreaAssociation or Associations from whom consent toplay the matches was obtained, and each such AreaAssociation shall by the 30th September make acomplete return to the Association of the matchesplayed and the monies distributed. Matchesbetween teams of different clubs must be advertisedas public practice matches and must be open to the

public on payment. Players who have not beenengaged for the following season, may play in suchpractice matches;

64.3 consent as referred to in the preceding paragraph isnot necessary in the case of private practicematches between teams of the same club at whichthe public is not admitted and where no charge ismade for or in lieu of admission either directly orindirectly; and

64.4 any club or player, who is in breach of this Rule inany way whatsoever, shall be liable to any suchsuspension or other penalty or both as to theCouncil may seem fit.

ARMED FORCES

65. Members of the Royal Navy or of the Army, or of theRoyal Air Force, or of any of the Auxiliary Forces, mayplay in matches or competitions in the close season,whilst such members are in Barracks or in Camp. Playersregistered by this Association or by an Area Associationmay take part in such matches or competitions aforesaid,provided that all such matches or competitions aforesaidshall be strictly confined to the units concerned andprovided also that no gate money is taken at any suchmatch or competition aforesaid.

66. A player, whilst serving in any branch of Her Majesty’sRegular Forces may not hold a contract of employmentwith any club under the jurisdiction of this Association.

67. Neither a club nor any person shall attempt to induce anyplayer of a club of any branch of Her Majesty’s RegularForces to play for another club during the current seasonwithout at least fourteen days notice - in the case of theArmy to the Secretary of the Army Football Association;in the case of the Royal Navy direct to the HonorarySecretary of the Royal Navy Football Association; in thecase of the Royal Air Force to its Commanding Officer.The notice must be forwarded by registered post, or awritten acknowledgement otherwise obtained. The rankof service player must be stated in league or otherregistration forms and service players are required tonotify civilian clubs of their Ranks.

68. 68.1 The Council shall compile and keep a list ofreferees for use of its Members and all other bodieswithin its jurisdiction. The Secretary of each Area

Association shall send in writing on or before thefirst day of October in each year to the Secretary ofthe Association, a list of all referees affiliated to theArea Association concerned together with theiraddresses, and telephone numbers. Such list shallshow each referee’s classification as at thecommencement of the current playing season.

68.2 Any decision by the referee in charge of any matchon questions of fact connected with the game shallbe final and conclusive. On any question ofinterpretation of the Rules or Laws of the Game, anappeal will lie from the decision of the refereeconcerned to the Council, provided that thereferee’s decision has been acted upon on the field,whether a protest against such decision was made ornot. If any referee is appointed for any match byany Area Association or by any competitionsanctioned by this Association, he shall inform suchappointing Association or competition (as the casemay be) in writing within three days of receipt byhim of the notice of appointment concernedwhether he accepts or declines the appointment.Any referee failing to accept or decline anappointment by an Area Association or by acompetition sanctioned by this Association inaccordance with the provisions of this Rule shall beliable to a fine of £53 for each such offence. Anyreferee who cancels any engagement to referee amatch, in order that he may officiate in some othermatch, shall be dealt with by the Council and shallbe deemed by the Council to be in breach ofcontract.

68.3 If any referee fails to report any instance ofmisconduct, which comes under his notice, and if itis proved to the satisfaction of the Council that suchinstance of misconduct was of a nature that requiredinvestigation, he shall either be suspended or dealtwith in such other manner as to the Council shallseem fit.

68.4 No referee may take any part in the management ofany league or other competition of whatever kind, ifhe officiates as a referee within the jurisdiction ofsuch league or competition concerned.

68.5 “The promotion and demotion of referees andassistant referees to and from the Directly AffiliatedLeagues together with the nomination of refereesand assistant referees to the annual FIFAInternational Referee and FIFA InternationalAssistant Referee lists shall be at the sole discretionof Council.”

69. The Membership subscription shall be :-

69.2 three hundred and fifty five pounds sterling perannum plus Value Added Tax for each AreaAssociation; and

69.3 three hundred and fifty five pounds sterling perannum plus Value Added Tax for each DirectlyAffiliated League.

69.4 Certain clubs and leagues not coming under thejurisdiction of an Area Football Association shall beeligible for election as Associate Members of theAssociation subject to the approval of the Council,and on payment of the appropriate fee which shallbe half that for a club or league identified in 69.1 or69.3 above. Associate Members shall not be entitledor permitted to attend or vote at General Meetingsnor take part in Elections.

69.5 Such fee shall be paid on or before the first day ofAugust in each year; failure to do so will result inthe automatic suspension of all Membership rights.Resumption of rights shall be at the Council’sdiscretion following payment.

70. 70.1 Each Qualifying Club shall forward by 1st Augustin each year to the Secretary of the Association ona form to be supplied by the said Secretary thefollowing information :-

70.1.1 the name and address of the Secretary ofthe Qualifying Club concerned; No personcan be Secretary of two or more clubs atthe same time.

70.1.2 a full and accurate description of theClub’s distinguishing colours or costume;

70.1.3 the situation and address of the Club’sground;

70.1.4 whether the said ground is public orprivate; and

70.1.5 such further or other information as theCouncil at any time may require.

70.2 The Secretary of each Qualifying Club shall alsoinform the Secretary of the Association in writing,whenever any change in any of the matters set outin Rule 70.1 occurs.

70.3 The Secretary of each Area Association shall sendin writing on or before the first day of October ineach year to the Secretary of The Association, a listof all clubs affiliated to the said Area Associationconcerned together with the names and addresses ofthe Secretaries of the aforesaid clubs. All clubsaffiliated to an Area Association may take part incompetitions sanctioned by the Association.

71. Each Qualifying Club, shall be required to send annuallyto this Association a Balance Sheet showing the workingof the season immediately past. Such Balance Sheet shallbe sent to this Association not later than the first day ofAugust in any year concerned. Such Balance Sheet mustbe signed by the Chairman and by the Honorary Treasureror Treasurer and by the Secretary of, and on behalf of,each such Club concerned. Each Club in default of anyprovision of this Rule in any way whatsoever shall beliable to a penalty of the sum on a scale as per Rule 28.2.3in respect of each such default.

72 The Secretary of every league, charity competition orbenefit competition or of any other competition comingwithin the direct jurisdiction of the Association shall sendto the Secretary of the Association at the close of suchleague or competition concerned a Balance Sheet whichshall have been duly audited, and a list of all the clubswhich have competed in the said league or competition.Each league or competition in default of any provision ofthis Rule in any way whatsoever shall be liable to apenalty on a scale as per Rule 28.2.3 in respect of eachsuch default.

MISCELLANEOUS

73. 73.1 At any meeting held by the Council or any sub-committee of the Council to discuss issues relatingto any Club, League or Area Association,Councillors having an interest in such Club, Leagueor Area Association shall not:-

73.1.1 vote at said meeting;

73.1.2 in any way influence any decision of theCouncil or sub-committee other thaninsofar as such influence is permitted byRule 73.1.3 below; and

73.1.3 act in any such matter or contribute to suchdiscussion without the prior consent of theChairman, which consent the Chairmanmay in his absolute discretion withdraw ifhe feels that a Councillor has breachedparts 73.1.1 and 73.1.2 of this Rule.

provisions of this Rule, shall forfeit immediatelyhis seat on the Council.

74. 74.1 In all matches in which the Association isrepresented, the players representing theAssociation shall be selected by the appropriateteam manager at that time appointed.

74.2 No Councillor being a director or official of anyparticular club may attempt to influence theselection of a player to play in any International orRepresentative Match.

75. Any player selected to attend any International or othermatch arranged by this Association, who refuses tocomply with the arrangements of the Council for theplaying of such said match or who fails to attend suchsaid match without good and sufficient cause, shall beguilty of misconduct. What shall or shall not constitute“good and sufficient cause” in any particular case shall bedetermined by the Council in its absolute discretion. Anyclub or official, who shall be deemed to have encouragedor instigated or induced or connived at any breach by anyplayer of any of the provisions of this or any Rule or ofany other order of the Association, shall be guilty ofmisconduct.

76. 76.1 No Councillor, Area Association, League,Qualifying Club, any other club, any body, or anyperson whatsoever, shall be allowed to take playerson tour to England, Northern Ireland, Scotland, orto any foreign country under a designation, orpurported or colourable designation, that suchplayers are connected with the Association in anyway.

76.2 All intended tours outside Wales must first receivethe written permission of the Council.

76.3 If the Council give permission for a tour under Rule77.2, it will be an implied term of such permissionthat it is only given subject to the promoters of anysuch tour rendering to the Council a full, accurateand complete statement of all accounts of allmoneys received and disbursed in connection withsuch said tour, such said statement of accounts to bedelivered to the Council within twenty-one days ofcompletion of the tour. In default of rendering suchaccount or accounts in accordance with theconditions required by this Rule, the Council shallimpose upon any parties in default a fine as per thescale set out in Rule 28.2.3. The Council is herebyempowered to exact any additional penalty uponany parties in default under this Rule as to theCouncil shall seem just.

77 Each Councillor shall, ex officio, be furnished with aspecial ticket, which shall not be transferable. All clubsshall admit the holder of such special ticket to theirgrounds and stands upon production by the holder of suchspecial ticket without requiring any other or furtherauthority, except on any other specified occasions, whichshall be determined by the Council if such course shallseem expedient to the Council.

78 From each International Match staged in Wales, the clubon whose ground the match is played shall pay to theAssociation the gross receipts. No deduction from thegross receipts shall be allowed, other than permittedground expenses. A detailed statement of accounts of thegross receipts and any deductions shall be supplied to theAssociation. This statement and payment must be sentwithin 21 days of the match. If this instruction is notobserved, the Association shall have the power to imposea fine for each week or part of a week that the statementand/or payment is late. The above regulations do notapply in respect of any match played at the NationalStadium or venue not coming under the control of theAssociation where such matter will be determined byagreement.

79. Any Qualifying Club, or any other club which isadjudged by the Council to have taken the place of and tohave succeeded a Qualifying Club or any other club,whether by change of name, purchase or takeover, shalltake over without delay all the liabilities whatsoever ofthe replaced club, all of which liabilities the replacingclub shall discharge fully and within a reasonable time.

80. The Association shall be entitled to publish in the publicpress or in any other manner, which to it shall seem fit thereports of its proceedings, act or resolutions or any partthereof, without having any regard as to whether suchpublication shall or shall not reflect upon the character orconduct of any Member or any other party involved at thetime in question within the jurisdiction of theAssociation. Every such party shall be deemed hereby tohave assented to any such said publication.

81. 81.1 A playing season commences in the month ofAugust in one year (or as Council decides) and endson a date to be determined by the Council. Nomatches are permitted to be played during theremainder of the year, which period shall be knownas the close season.

81.2 Six-a-side and Five-a-side competitions asspecified in Rule No.56 shall be exempt from theprovisions of this Rule.

81.3 Notwithstanding anything contained in this Rule,matches may be played for charity or some other

object approved by the Association not later thanthe Saturday or Sunday following the end of theseason in any year. Application for permission toplay any such said match must be in writing andmust be forwarded to reach the Secretary of theAssociation not later than the first day of April inthe year concerned.

82. Any Qualifying Club or any club within the jurisdictionof the Association which wilfully breaks any fixture withanother club belonging to any Area Association, shall befined by the Council or the appropriate Area Associationto which the club is affiliated or dealt with by such a bodyin any other manner which that body shall deem fit. Suchdecision by a body other than the Association shall besubject to Rule 25.1 “Appeals”. Until such offendingclub has complied with any order, which the Council maysee fit to make in the circumstances, that club’srepresentative shall be disbarred from voting at anyGeneral Meeting held under the Rules of this Association.Any club lodging any complaint about broken fixturesshall deposit with the Association the sum on a scale asper Rule 28.2.3 in respect of each complaint. If it isfound on inquiry that a complaint is frivolous the clublaying the complaint shall forfeit the complaint fee and inaddition to any other penalty may be condemned in thecosts of or incidental to the Commission or Inquiry whichmay be held, if such course seems fit to the Council orany Commission or Inquiry appointed by the Council allof which shall have an absolute discretion in the matter.

83. 83.1 Except in small sided matches involving playersunder the age of twelve years, no football match inwhich player of the opposite sex are involved shallbe permitted to be played on any football groundwithin the jurisdiction of the Association, exceptthat in those Area Associations, where there is nojunior league available for girls, (the area referredto is identified as the geographical area of the localboys’ League or Area Association Girls’ League asappropriate) the age limit will increase to UnderSixteen. Clubs, officials, players and referees arenot permitted to associate themselves in any waywhatsoever with mixed football matches that falloutside the aforementioned criteria.

83.2 Activities carried out at a recognised CoachingCentre, or Centre of Excellence, shall not bedeemed to be matches for the purpose of Rule 84.

84. No Club, player, official, referee or assistant referee shallbe compelled to participate in football on Sundays, GoodFriday or Christmas Day.

85. The Association shall have first claim to the use of allfootball grounds, offices and facilities of clubs within thejurisdiction of the Association. On such occasions, theCouncil shall retain the sole rights in respect of televisionand broadcasting, ground advertising and programmesales. The Council alone shall determine whether anypayment shall be made for the use of such grounds by theAssociation and the amount of any payment in anyparticular instance.

86. 86.1 No player nor registered referee nor any paidofficial of any Area Association, League orQualifying Club shall be allowed to serve on theCouncil of this Association.

86.2 No player, or paid official of an Association,Leagueor Club within the jurisdiction of the Associationshall be allowed to serve on the Committee of anysuch association or league. No registered refereeshall be allowed to serve on the Committee of anyassociation or league within whose area he is soregistered.

87. What constitutes a paid official of an association, leagueor club within the meaning of Rule 87 shall be decided bythe Council in its absolute discretion.

88. Throughout these Rules the amounts payable as entrancefees and subscriptions or as otherwise required by Lawshall be the amounts stated plus the appropriate amountrequired in respect of Value Added Tax as determined atthat time.

89. 89.1 Any notice or other communication given underthese Rules shall be in writing and signed by or onbehalf of the party giving it and shall be served bydelivering it personally or sending it by pre-paidfirst class post or facsimile transmission to theaddress and for the attention of the relevant partyset out in Rule 89.2 and such notice orcommunication shall be deemed to have beenreceived:-

89.1.1 is delivered personally, at the time ofdelivery;

89.1.2 in the case of pre-paid first class posttwenty-four (24) hours from the date ofposting; and

89.1.3 in the case of facsimile transmission; atthe time of transmission PROVIDEDTHAT if deemed receipt occurs before9.00am on a Business Day the notice or

communication shall be deemed to havebeen received at 9.00am on that day andif deemed receipt occurs after 4.30pmon a Business Day, or on a day which isnot a Business Day, the notice shall bedeemed to have been received at 9.00amon the next Business Day. For thepurpose of this Rule, “Business Day”means any day which is not a Saturday,Sunday or a public holiday.

89.2 Any notice or other communication to be served onthe Association shall be addressed to theAssociation at 11/12 Neptune Court, Vanguard Way,Cardiff CF24 5PJ or by facsimile on 029 20496953. In either case, the notice or communicationshall be marked for the attention of the SecretaryGeneral. Any notice or other communication servedby the Association on a Member or other party shallbe served on the address or facsimile number of thatMember or other party last known to theAssociation. The Association shall notify Membersin writing from time to time of any change to itsaddress or facsimile number and each Member shallnotify the Association in writing of any change inthe Member’s address or facsimile number.

89.3 In proving such service it shall be sufficient toprove that the envelope containing such notice orother communication was addressed to the addressof the relevant party set out or referred to in Rule89.2 and delivered either to that address or into thecustody of the postal authorities as a pre-paid firstclass letter or that the notice or othercommunication was transmitted by facsimile to thefacsimile number of the relevant party set out orreferred to in Rule 89.2.

89.4 For the avoidance of doubt, any notice or othercommunication given under these Rules shall not bevalidly served if sent by e-mail.

90. The practice of kicking-off matches by persons other thanthe players competing in the match is prohibited except incharity matches.

91 The Association shall create an Arbitration Panel, whichshall deal with all internal national disputes between theAssociation, its Members, Players, Officials and matchand players’ agents that do not fall under the jurisdictionof its Judicial Bodies. The Council shall draw up specialregulation regarding the composition, jurisdiction andprocedural rules of this Arbitration Panel.

92 92.1 The Association, its Members, Players, Officialsand match and player agents will not take anydispute to Ordinary Courts unless specificallyprovided for in these Rules and Regulations andFIFA Statutes. Any disagreement shall be submittedto the jurisdiction of FIFA, UEFA or theAssociation.

92.2 The Association shall have jurisdiction on internalnational disputes. i.e. disputes between partiesbelonging to the Association. FIFA shall havejurisdiction on international disputes, i.e. disputesbetween parties belonging to different Associationsand/or Confederations.

93 93.1 The Association, its Members, Players, Officialsand match and player agent’s members willrecognise the jurisdiction of the Court ofArbitration for Sport (CAS) in Lausanne(Switzerland), as specified in the relevantprovisions of the FIFA and UEFA Statutes.

93.2 The Association shall ensure its full compliance andthat of its Members, Players, Officials and matchand players’ agents with any final decision passedby a FIFA body or CAS.

94 The Council of the Association will set up regulationsregarding a club licensing system governing theparticipation of Clubs in competitions of FIFA, UEFAand the Association

95 95.1 The authority for organising international matchesand competitions between Association teams andbetween Leagues and/or Club teams lies solely withFIFA. No match or competition shall take placewithout the prior permission of the FIFA ExecutiveCommittee. In addition, permission from therelevant Confederation may be required inaccordance with the FIFA regulations.

95.2 The Association is bound to comply with theinternational match calendar compiled by FIFA.

96 The Association shall not play matches or make sportingcontacts with Associations that are not members of FIFAor with provisional members a Confederation without theapproval of FIFA.

97 Clubs, Leagues or any other group of Clubs that areaffiliated to the Association cannot belong to anotherAssociation or participate in competitions on the territoryof another Association without the authorisation of theAssociation and the other Association and of FIFA,except in exceptional circumstances.
