2 CSR 90-10.011 Inspection Authority—Duties

PURPOSE: This rule sets out the authorityand duties of the inspection authority and hasbeen developed in the interest of safety to lifeand property. These rules do not apply topublic utilities regulated by the Missouri Pub-lic Service Commission.

(1) The director of agriculture is the officer incharge of the collection of meter inspectionfees, liquefied petroleum gas (LPG) meterinspection and safety in the storage, handling,transportation and use of liquefied petroleumgas in the Department of Agriculture referredto as the inspection authority.

(2) The inspection authority shall have dis-cretional authority to require annual pressuretesting of all LPG piping systems servingschools, churches, nursing homes, resorts,mobile home parks, public housing, hospi-tals, amusement parks, summer camps (BoyScout, Girl Scout, church, etc.) and otherpublic buildings and institutions. It shall bethe responsibility of the owner, administrator,superintendent, director or other responsibleperson directly associated with any of the pip-ing systems serving any of the listed publicbuildings, mobile home parks, summercamps (Boy Scout, Girl Scout, church, etc.),amusement parks and institutions to assumefull responsibility to secure the annual pres-sure test of the LPG system on or beforeSeptember 1 of each calendar year with theexception of summer camps and amusementparks which shall be completed on or beforeJune 1 of each calendar year. A copy of thetest report shall be submitted to the inspec-tion authority within five (5) days after com-pletion of the test. Failure to complete therequired annual pressure tests may be duecause to consider the LPG system unsafe forcontinued use and shall be reason to place thesystem out of service until the time a pressure

test is completed and the system found to befree of leaks and safe for continued opera-tion.

(3) The standards for storage and handling ofLPGs and the standards for the installation ofgas appliances and gas piping as published inthe National Fire Protection Association pub-lications, Numbers 54, 58, 59, 501A and501C will be adhered to by the inspectionauthority in the course of administering itsduties. These are adopted as rules in 2 CSR90-10.020, 2 CSR 90-10.040, 2 CSR 90-10.060 and 2 CSR 90-10.090.

(4) For the purpose of ascertaining whetherany container or system complies with allrules regulating the storage and handling ofLPGs and the installation of appliances andpiping—

(A) The inspection authority and/or theauthorized agents, deputies and inspectorsshall have free access, at reasonable timesand upon reasonable notice, to any premiseswhere a LPG container or system is offeredfor sale, stored, being repaired, installed orbeing used; and

(B) Owners, operators, drivers, custodiansand occupants of transport vehicles, duringreasonable hours and upon reasonable requestof the inspection authority, shall permitinspection of that vehicle.

(5) Any person, firm, corporation or othersmaking LPG installations or supplying fuelfor installations, upon reasonable request,shall furnish reasonable and pertinent infor-mation as may be considered necessary by theinspection authority to determine that there iscompliance with the rules.

(6) An exception to these regulations may beapproved by the inspection authority aftersufficient evidence is supplied showing thatthe exception will provide a level of safety atleast equivalent to that contemplated by theregulations.

(7) The provisions of these regulations shallnot be construed as prohibiting the continueduse of an installation which received the writ-ten approval of the inspection authority at thetime of installation or was in compliance withsafety standards and codes at the time ofinstallation, unless circumstances of a haz-ardous nature justify correction for the bene-fit of public safety.

(8) If the director of the Department of Agri-culture determines that any LPG containerconstitutes an immediate danger to the publicor property, s/he shall require the immediateremoval of liquid and vapor LPG from the

container by a registered LPG dealer or com-pany. If the director determines that any LPGappliance, equipment or system constitutes animmediate danger to the public and property,s/he shall require the immediate disconnec-tion by a registered LPG dealer or companyfrom the LPG container.

2 CSR 90-10.012 Registration—Training

PURPOSE: This rule sets forth registration,training and examination requirements forpersons applying for or holding registrationsto ensure the safety of life and property.

(1) As a prerequisite to registration in thisstate and receiving a numbered certificate ofregistration to engage in the business of sell-ing at retail liquefied petroleum gas (LPG),or in the business of handling or transportingLPG over the highways of this state, or in thebusiness of installing and servicing equip-ment and appliances for use with LPG in thisstate, application shall be made to the direc-tor of agriculture on forms prescribed for thispurpose with such reasonable information asshall be deemed necessary.

(2) All persons applying for registration toengage in the business of handling, storing ortransporting LPGs or in the business ofinstalling, repairing or servicing piping,equipment or appliances for use with LPGsshall be properly trained and experienced inthe work, familiar with all safety precautionsrequired and comply with all requirements ofChapter 323, RSMo and the rules pursuant toit.

(3) Every individual applying for registrationto engage in the business of handling, storingor transporting LPGs or in the business ofinstalling, repairing or servicing piping,equipment or appliances for use with LPGsmust score at least seventy-five percent(75%) on a written examination administeredby the Division of Weights and Measuresbefore approval of registration will be grant-ed.

(4) Every individual, except clerical person-nel and others not actually handling LPGs,within any business involved in handling,storing or transporting LPGs or involved inthe installation, repairing or servicing of pip-ing, equipment or appliances for use withLPGs must attend and complete a trainingprogram, including the passing of a writtenexamination, managers must attend every five(5) years and all other personnel every three(3) years, regarding the safe handling, storingand bulk delivery of LPGs and the safe instal-lation, repairing or servicing of piping,equipment and appliances for use with LPGs.These training programs must be approved bythe director. All training programs submittedto the director must contain information onapplicable statutes and regulations governingliquefied petroleum gases; must be resubmit-ted to the director for review and approval onan annual basis or at such time change hasbeen made; and any training program that,through audit, does not meet the approvedtraining program criteria, may be rejected foruse by the director.

(5) Residents of states other than Missouriwho desire to engage in or continue to dobusiness in this state shall submit an applica-tion for registration on forms furnished forthis purpose by the director of agriculture.Qualifications and approval for this registra-tion permit will be determined on the basisoutlined in Chapter 323, RSMo. The infor-mation submitted shall be related to therequirements of this state and any additionalprovisions required by the LPG inspectionauthority of their state residency in determin-ing eligibility for registration.

(6) Registration shall be filed at the time of orbefore commencing operations by the classesdescribed in this section. The registrant shallnotify the inspection authority within ten (10)days after discontinuance of his/her individu-al operations, providing the name of his/hersuccessor organization, if any. The classesare—

(A) Class I—General LP gas operation.The storage, sale, transportation and distribu-tion of LP gas at retail-wholesale and theinstallation, service and repair of appliances,equipment and piping for use with LP gas.This does not include LP gas carburetion orliquid meter service or repair;

(B) Class II—Installer and service of lowpressure systems. The installation, serviceand repair of appliances, equipment and pip-ing for use with LP gas. This class applies toonly the low pressure portion of the LP gassystem downstream of the first stage regulatorand those systems addressed in NFPA 54;

(C) Class III—Installer and service of highpressure systems. The installation, serviceand repair of piping and equipment for usewith LP gas. This class applies to only thehigh pressure portion of the LP gas systemupstream of the first stage regulator and thosesystems addressed in NFPA 58;

(D) Class IV—Installer and service of highand low pressure. The installation, serviceand repair of appliances, equipment and pip-ing for use with LP gas, the installation of LPgas cylinders and tanks and the delivery ofLP gas cylinders. This class applies to bothhigh and low pressure portions of LP gas sys-tems as addressed in NFPA 54 and NFPA 58;

(E) Class V—LP Service station operator(metered sales). The retail operation of an LPgas service station consisting of LP gas stor-age containers, piping, pumps, and other per-tinent equipment utilized to fill portable LPgas containers by weight;

(F) Class VI—LP gas dispenser operator(non-metered sales). The retail operation ofan LP gas dispensing station consisting of anLP gas storage container(s), piping, pumpsand other pertinent equipment utilized to fillportable LP gas containers by weight;

(G) Class VII—Cylinder exchange dealer.The operation of an LP gas cylinder exchangebusiness whereby Department of Transporta-tion (DOT) cylinders are stored in a securedcage or area and exchanged with customers(full cylinder for empty cylinder). This doesnot include the filling of any cylinder or tankon premises;

(H) Class VIII—Cylinder sales and ser-vice. An operation or business engaged in thefilling, distribution and service of LP gascylinders;

(I) Class IX—Carburetion. An operationor business engaged in the installation andservices of LP gas carburetion systems;

(J) Class X—Liquid meter repair and ser-vice. The installation, repair and service ofLP gas meters utilized for liquid LP gasdeliveries, i.e., bobtail delivery truck meters;and

(K) Class XI—Transporters. An operationengaged in the business of transporting LPgas.

(7) Each registrant shall be issued a certifi-cate of registration which shall bear a perma-nent identifying number. This certificate shallbe displayed in a conspicuous location in theoffice at the address for which issuance wasmade.

(A) This same number shall be used as anidentifying number to be conspicuously dis-played on each and every motor vehicle usedby the registrant for the transportation of liq-uefied petroleum gas over the highways ofthis state.

(B) The number shall be preceded by theletters LPG MO.

(C) The letters and numbers shall be in acolor contrasting with the background color,at least two inches (2”) in height, paintedwith a minimum stroke width of one-fourthinch (1/4”).

(D) The letters and numbers shall be locat-ed in clear view on the rear of each truck andbulk tank or on each side of a truck notequipped with a tank body.

(E) Trucks and truck tanks shall be num-bered consecutively or by some other methodof identification which has been approved bythe inspection authority. This method of iden-tification shall be used and placed on the tankor truck following the identifying number.

(8) Each transporter making delivery to abulk plant or any similar type delivery ofLPG over the highways of this state, shallhave the LPG MO identifying number print-ed or written on each ticket delivered to eachconsignee in this state receiving a productwhich is transported by the registered trans-porter.

2 CSR 90-10.014 Storage

PURPOSE: This rule sets out minimum gen-eral standards for the storage of liquefiedpetroleum gas and promotes safety for lifeand property. These requirements do notapply to public utility facilities regulated bythe Missouri Public Service Commission.

PUBLISHER'S NOTE: The publication of thefull text of the material that the adoptingagency has incorporated by reference in thisrule would be unduly cumbersome or expen-sive. Therefore, the full text of that materialwill be made available to any interested per-son at both the Office of the Secretary of Stateand the office of the adopting agency, pur-suant to section 536.031.4, RSMo. Suchmaterial will be provided at the cost estab-lished by state law.

(1) All liquefied petroleum gas (LPG) storagecontainers or storage systems where one (1)tank is used having a water capacity of onehundred (100) gallons or more, or where two(2) or more tanks are used having a totalcombined capacity of more than one hundred(100) gallons, and all related equipmentlocated at or near containers which areinstalled on school grounds, public play-grounds, recreation park grounds or any oth-er playground areas where children in agegroups from preschool through grade twelve(12) have access shall be fenced with indus-trial type fence a minimum of six feet (6’)high as to prevent tampering with the gas sys-tem.

(2) Where LPG storage of five hundred (500)gallons or less is in use or where a hazardexists in connection with any size of under-ground storage system, reasonable protectivemethods, other than fencing, which aredeemed necessary may be required.

(3) Used containers for storage of LPG, oth-er than containers approved by the InterstateCommerce Commission (ICC) or the UnitedStates Department of Transportation and con-nected for use on a motor vehicle, shall notbe imported into Missouri, or installed orused if they are not in conformance with therequirements of these regulations and unlessthe inspection authority has been furnishedwith the information contained in the manu-facturer’s data report. Name plate data maybe accepted in lieu of a manufacturer’s datareport on tanks of two thousand (2000) gal-lons water capacity or less.

(4) A manufacturer’s data report shall be fur-nished to the inspection authority on all newLPG containers, other than containers

approved by the ICC or United States Depart-ment of Transportation, having a water capac-ity greater than one thousand (1000) gallons.

(5) Containers of any size shall not be usedfor storage other than manufacturer’s designand specifications; i.e., railcars, convertedrailcars, bulk delivery truck tanks both trans-port and bobtail cannot be utilized for fixedstorage.

(6) All LPG storage containers, includingportable or semi-portable with attached sup-ports or foundations to be used for temporaryor permanent installations, shall be mountedon solid concrete piers or foundations with amaximum height of the outside bottom of thecontainer shell no more than five feet (5')from the ground.

(7) All skid-mounted LPG storage tanks to beused for temporary or permanent installationshall be mounted on solid concrete footingswith the outside bottom of the container notmore than three feet (3') from the ground.

(8) All skid-mounted LPG storage containersystems of four thousand (4000)-galloncapacity (single or multiple containers) shallcomply with the National Fire ProtectionAssociation Manual Number 58, 1995 Edi-tion, Section 3-2.8.10.

(9) All LPG bulk storage containers, exceptthose covered in section (1) of this rule, oftwo thousand (2000) gallons or more capaci-ty shall have its pumps, piping, vaporizers,hoses, bulkheads and related equipment pro-tected from tampering by a metal industrial-type fence at least six feet (6') tall. All loca-tions with one hundred (100) square feet orless fenced area shall have at least one (1)lockable access gate. All locations with morethan one hundred (100) square feet fencedshall have at least two (2) lockable accessgates.

(10) All aboveground LPG storage containersshall be kept properly painted with a lightreflective paint such as white or aluminum.

(11) All aboveground LPG storage contain-ers, except domestic installations of two thou-sand (2000) gallons capacity or less, shall bemarked with warning signs placed in a con-spicuous location on both sides and both endsof the container incorporating the followingor equivalent wording: FLAMMABLE—PROPANE: NO SMOKING OR OPENFLAMES. All wording shall be in block-style letters with a minimum height of twoinches (2") and a minimum width of one-

fourth inch (1/4") on a contrasting back-ground.

(12) Each LPG storage plant or system of twothousand (2000) gallons or more shall have asign displayed in a conspicuous location stat-ing the name, address and telephone numberof the nearest representative, agent or ownerof the system.

(13) After the effective date of this rule,where possible, all LPG bulk storage con-tainers shall be installed parallel to surround-ing buildings.

(14) Any LPG storage container and its relat-ed piping and equipment which may beexposed to vehicle damage shall be protectedby guard rails or guard posts. All guard railsor guard posts shall be constructed of heavygauge metal of sufficient strength to absorbvehicle impact without damage to the con-tainer or its related equipment.

(15) Any LPG storage container, includingany container used for motor fuel, which hasbeen damaged in any manner shall berepaired according to the requirements of thecode it was manufactured under and shall behydrostatically tested prior to placing in ser-vice.

(16) Repair of any LPG container shell,excluding valves, fittings, regulators andattachments, shall be in conformance with thecode under which the container was manu-factured and all repairs shall be performedonly by a person certified under the code bywhich the container was manufactured.

(17) A copy of all container data informationand repairs to the container shall be submit-ted to the inspection authority for review pri-or to installation of the container.

(18) LP gas storage containers supplyingmobile home parks, schools, hospitals, com-mercial-industrial facilities, domestic sys-tems, other public or institutional facilitiesshall not be utilized as a bulk storage plant forloading LP gas into any fuel delivery vesselor vehicle.

2 CSR 90-10.015 Container, System orEquipment Violations

PURPOSE: This rule sets out the procedureto govern the inspection authority’s actions ineliminating hazardous conditions which couldresult in serious property damage and loss oflife.

(1) Any container, system or equipment thathas been determined through inspection bythe inspection authority to violate these regu-lations so as to constitute a substantial hazardor violation which makes the container, sys-tem or equipment unsafe for continued oper-ation shall be so identified by the inspectionauthority through a notice or tag affixed tothe container. The container, system or equip-ment upon which the tag has been affixedshall not be used, nor shall liquefiedpetroleum gas be placed in the container, sys-tem or equipment.

(2) Any container, system or equipment thathas been determined through inspection bythe inspection authority to violate these rulesand regulations but does not constitute animmediate hazard to life or property shallonly be tagged if the defect or the violation isnot corrected within five (5) days after writ-ten notification setting forth the violation ordefect has been personally served upon ordirected through the United States mail, cer-tified mail, postage prepaid, returned receiptrequested, to the owner, operator or supplierof the container, system or equipment. In theevent the owner or supplier is not identifiedon the container, system or equipment, noticeto the occupant of the premises where thecontainer, system or equipment is locatedshall be deemed sufficient.

(3) The tag or notice attached to the contain-er, system or equipment, shall be the proper-ty of Missouri and only shall be removed bythe inspection authority upon notificationand/or request by the owner, or supplier, orhis/her agent when defect or violation hasbeen corrected. The tag is to be removedpromptly after receiving notice of correctionand reinspection.

(4) Any underground container or system thatis being maintained in violation of these rulesso as to constitute a substantial hazard to pub-lic safety may be required to be removed forinspection by the inspection authority uponreasonable demand and notice.

2 CSR 90-10.016 Meters for Measure-ment—Specifications and Proving

PURPOSE: This rule sets out minimum gen-eral standards governing the design of metersused for measuring liquefied petroleum gas.

PUBLISHER'S NOTE: The publication of thefull text of the material that the adoptingagency has incorporated by reference in thisrule would be unduly cumbersome or expen-sive. Therefore, the full text of that materialwill be made available to any interested per-son at both the Office of the Secretary of Stateand the office of the adopting agency, pur-suant to section 536.031.4, RSMo. Suchmaterial will be provided at the cost estab-lished by state law.

(1) All liquid meters used in the sale of liq-uefied petroleum gas (LPG) shall beequipped with an effective vapor eliminator.

(2) Each vehicle tank used in the retail sale ofLPG shall be equipped with a meter for mea-surement of LPG in terms of gallons andshall not be equipped with a bypass aroundthe meter. A vapor equalization line is not abypass and is not prohibited by this provision.

(3) LPG sold or delivered to a retail customerby liquid measure shall be corrected for tem-perature to sixty degrees Fahrenheit (60°F)with an automatic correction device or thequantity delivered shall be corrected for tem-perature of sixty degrees Fahrenheit (60°F)in accordance with the Volume CorrectionFactor Table, nationally accepted as accuratewithin fair tolerances.

(4) When the delivery is made through ameter automatically corrected for tempera-ture, the retail sales ticket shall show themetered adjusted gallons delivered.

(5) When the delivery is made through ameter not corrected automatically, the retailsales ticket shall show the metered gallonsdelivered, the temperature at the time ofdelivery and the corrected gallonage.

(6) A person, firm or corporation owning orhaving in its possession an LPG measuringdevice which is installed for use to measureliquid gallons to a retail customer in this stateshall permit the device to be tested after rea-sonable request is made by the inspectionauthority and give full assistance and cooper-ation during the testing procedure. Ticketsand other records of deliveries shall be made

available upon request to determine that prop-er compliance and procedure is in effect formaking deliveries to retail customers.

(7) When liquid meters are determined to beaccurate within the tolerance limits in thecurrent edition of the National Institute ofStandards and Technology Handbook 44, theinspection authority, immediately upon com-pletion of the test, shall seal the meter in amanner so as to prevent tampering whichwould affect the accuracy of measurement.No person shall remove, break or tamperwith the meter seal without the written con-sent of the inspection authority. Theserequirements shall not preclude the necessityto make needed repairs to the metering deviceor to transfer to another tank. If it is neces-sary to break or remove the seal to accom-plish repairs or transfer, written notice shallbe given to the inspection authority withinforty-eight (48) hours from the date therepairs or transfer is made.

(8) When a liquid meter is found to be inac-curate beyond the tolerance allowed in thecurrent edition of the National Institute ofStandards and Technology Handbook 44,after a test is made, it shall be conspicuouslymarked INACCURATE by the inspectionauthority and shall not be used for measuringliquid gallons to retail customers until it hasbeen corrected within tolerance limits.

(9) Any registrant delivering a lesser amountof LPG to a retail customer than is invoicedto the customer, if it is proven at a hearingconducted for this purpose that the shortageof delivery and overbilling of the amountdelivered was made with intent to defraud,shall be subject to having his/her registrationpermit suspended.

(1) All liquefied petroleum gas (LPG) gassupply and fuel burning equipment shall meetthe requirements as contained in 2 CSR 90-10.020(2) and 2 CSR 90-10.040(2) and sec-tions (2)–(38).

(2) Mobile units for human habitation andcontaining or utilizing equipment for LPGuse or equipment readily convertible to LPGuse shall not be used in this state or connect-ed for use to any liquefied petroleum gas sup-ply system or LPG container which containsLPG fuel unless that equipment and the gassupply system is installed, inspected or testedby a registrant or a person in the hire of a reg-istrant, in compliance with National Fire Pro-tection Association (NFPA) Standard Num-bers 501A, 54 and 58 and Chapter 323,RSMo and all corresponding rules. This ruledoes not apply to recreational-type vehiclestraveling the public roadways in the state andconnected to LPG containers constructedunder Interstate Commerce Commissionspecifications or United States Department ofTransportation regulations as a supply forfuel serving the burning, heating or illumi-nating equipment in or on the occupied spaceof the vehicle.

(3) It shall be the duty of the manufacturer ofthe new mobile unit or authorized agentsmaking the installation of the gas equipmentto comply with the standards in effect at thetime of manufacture.

(4) The inspection authority shall require cer-tification from the manufacturer or autho-rized agents that each mobile unit containingthe LPG equipment or equipment readilyconvertible to LPG use is, at the time of man-ufacture, in compliance with these standards.A copy of this certification shall be furnishedwith each manufactured mobile unit and bemade available to the owner, the connectinggas supplier and the inspection authority.

(5) Any section of a movable or portabledwelling or portion designed for human occu-pancy, with or without a permanent founda-tion containing all or part of a system for usewith LPG or readily convertible to LPG,

shall provide a level of safety at least equal tothat provided by nationally recognized stan-dards of safety.

(A) If any section has parts concealed insuch a manner that inspection is impracticalafter fabrication, the manufacturer shall cer-tify to the inspection authority that the part orsection does comply with nationally recog-nized standards of safety.

(B) When deemed necessary and a writtenrequest is made by the inspection authority,the manufacturer shall submit detailed plansof the prefabricated part or section for eachmodel or series of the prefabricated part orsection.

(C) Failure to comply with these require-ments shall be just causes for tagging the sys-tem to prohibit its use with LPG in Missouri.

(6) It shall be a violation for any person,firm, corporation or association to install,modify or alter, the burning, heating or illu-minating equipment for using LPG in or onany new or used mobile unit, prefabricatedunit, movable or portable dwelling designedfor human occupancy, with or without a per-manent foundation, containing all or part ofan installation or system for use with LPG orreadily convertible to LPG in a manner thatthe installation of equipment, piping or vent-ing would not be in compliance with applica-ble nationally recognized standards of safety,including NFPA Standards Numbers 54 and58 and referenced codes contained. Thesestandards are adopted as rules at 2 CSR 90-10.020 and 2 CSR 90-10.040.

(A) No such installation, modification oralteration shall be made in a manner not inconformity with the manufacturer’s equip-ment listing with a nationally recognized test-ing agency or without the written approval ofthe inspection authority.

(B) The inspection authority shall requiresatisfactory evidence or proof to substantiateclaims regarding the safety of any alternativeto nationally recognized standards.

(7) Only a holder of a registration permitissued by the inspection authority or a personin his/her employ shall connect any LPG con-tainer to the fuel system in or on a new orused mobile home or a prefabricated unit ora movable or portable dwelling designed forhuman occupancy.

(8) Each LPG installation shall be tested forleaks to determine that all parts of the instal-lation are in a safe operating condition beforeplacing the unit in service as it is initiallyconnected for the first time and, also as it isconnected for use after having been moved

from one (1) location to another, regardlessof the distance.

(A) It is the responsibility of the owner tosecure this inspection and test.

(B) These restrictions on container systemsshall not apply to the routine exchange ofcylinders.

(C) The registered installer and owner ofthe unit tested shall maintain a record indi-cating the date and results of the pressuretest.

(D) These restrictions on connection ofcontainers or testing shall not apply to recre-ational type vehicles except where there isevidence that these requirements are neces-sary for the benefit of public safety.

(9) For the purpose of this rule, when theterm equipment is used it shall be construedas including all burning, heating and illumi-nating appliances and their appurtenances.

(10) All LPG systems installed in or onmobile homes shall be of the vapor with-drawal type with a normal operating pressureof eleven inches (11") of water column (wc),unless otherwise specified by the appliancemanufacturer.

(11) Flexible appliance connectors shall belisted and approved for LPG use.

(12) Quick-disconnect connectors shall not beused in LPG systems.

(13) LPG containers shall not be installed orstored inside any mobile home, except forlisted, completely self-contained hand torch-es, lanterns or similar equipment with thecontainers having a maximum water capacityof not more than two and one-half pounds (21/2 lbs.) (approximately one pound (1 lb.)LPG capacity).

(14) LPG piping systems shall comply withthe NFPA Manual Number 54, 1996 editionand NFPA Manual Number 58, 1995 edition.

(15) LPG storage containers shall complywith the 1989 edition of NFPA Manual Num-ber 58.

(16) LPG storage containers and piping sys-tems shall be sized to insure adequate capac-ity for all appliances at maximum demand.

(17) Piping, tubing or pipe or tubing jointsshall not be installed within any wall, ceilingor floor space of the mobile home.

(18) Each mobile home shall have its gas sup-ply connection identified by a permanently

affixed label or tag at or near the gas supplyconnection.

(19) A shut-off valve shall be installed in thefuel piping at each appliance inside themobile home upstream of the union or con-nector in addition to any valve on the appli-ance and so arranged to be accessible for ser-vicing of the appliance and removal of itscomponents. The shut-off valve shall belocated within six feet (6') of a cooking appli-ance and within three feet (3') of any otherappliance. A shut-off valve may serve morethan one (1) appliance if located as requiredby this rule. Shut-off valves used in connec-tion with gas piping shall be of a typedesigned and listed for use with LPG.

(20) All openings in the LPG piping systemnot connected to appliances shall be closed,gas tight, with threaded pipe plugs or pipecaps.

(21) Gas piping shall not be used for an elec-trical ground.

(22) Pipe couplings and unions shall be usedto join sections of threaded piping. Right andleft nipples or couplings shall not be used.

(23) All gas piping under mobile homes shallbe adequately supported by galvanized orequivalently protected metal straps or hangersat intervals of not more than four feet (4').Gas supply connections shall be rigidlyanchored to a structural member within sixinches (6") of the supply connection.

(24) Before appliances are connected, pipingsystems shall stand a pressure of at least sixinches (6") mercury or three (3) pounds persquare inch gauge (psig) or at the pressurerecommended by the appliance manufacturerfor a period of not less than ten (10) minuteswithout showing a drop in pressure.

(25) After appliances are connected, the pip-ing system shall be pressurized to not lessthan ten inches (10") nor more than fourteeninches (14") water column and the applianceconnections tested for leakage.

(26) Defective heat exchangers on appliancesshall be replaced. Repair of any applianceheat exchanger is strictly prohibited.

(27) Heat-producing appliances and vents,roof jacks and chimneys necessary for theirinstallation in mobile homes shall be listed orcertified by a nationally recognized agencyfor use in mobile homes.

(28) Fuel-burning appliances shall not beconverted from one (1) fuel to another fuelunless converted in accordance with theterms of their listing and the appliance man-ufacturer instructions.

(29) Each heating appliance shall be providedwith a readily adjustable automatic controlfor regulation of living space temperature.

(30) All gas clothes dryers shall be exhaustedto the outside of the mobile home by a mois-ture-lint exhaust duct and termination fittingand the stubbed-in gas supply line shall beprovided with a shut-off valve, the outlet ofwhich shall be closed with a threaded cap orplug when not connected to a gas dryer.

(31) Each LPG heat-producing applianceshall be listed and installed in conformancewith its listing and manufacturer’s instruc-tions.

(32) Heat-producing appliances shall belocated so that no doors, drapes or othermaterial can be placed or swing closer to thefront of the appliance than the clearancesspecified by the manufacturer. Clearancessurrounding heat-producing appliances shallnot be less than specified by the appliancemanufacturer and the appliance listing.

(33) The area surrounding heat-producingappliances installed in areas with interior orexterior access shall be framed in or guardedwith noncombustible material so that the dis-tance from the appliance to the framing mate-rial is not greater than three inches (3").When clearance required by the listing isgreater than three inches (3"), the guard orframe shall not be closer to the appliancethan the distance provided in the listing.

(34) All fuel-burning appliances exceptranges, ovens, illuminating appliances,clothes dryers, solid fuel burning fireplacesand solid fuel burning fireplace stoves shallbe installed to provide for the complete sepa-ration of the combustion system from theinterior atmosphere of the mobile home. Anexception to this requirements may beallowed by the inspection authority if theheating appliance was manufactured formobile home use, is not utilized for or replac-ing the primary heat source and is equippedwith an oxygen depletion safety device whichwill prevent the oxygen level from droppingto a hazardous level. Combustion air inletsand flue gas outlets shall be listed or certifiedas components of the appliance. The requiredseparation may be obtained by—

(A) The installation of a direct vent system(sealed combustion system) appliances; or

(B) The installation of appliances withinenclosures so as to separate the appliancecombustion system and venting system fromthe interior atmosphere of the mobile home.There shall not be any door, removable accesspanel or other opening into the enclosurefrom the inside of the mobile home. Anyopening for ducts, piping, wiring, etc. shallbe sealed.

(35) A forced-air LPG appliance and itsreturn air system shall be designed andinstalled so that negative pressure created bythe air circulating fan cannot affect its oranother appliance’s combustion air supply oract to mix products of combustion with cir-culating air.

(36) Information on clearances, input rating,lighting and shutdown shall be attached to theappliances with the same permanence as thenameplate and located so that it is easilyreadable when the appliance is properlyinstalled or shut down for transporting of themobile home.

(37) Each fuel-burning appliance in eachmobile home shall bear a permanent markingdesignating the type(s) of fuel for which it islisted.

(38) Every appliance shall be accessible forinspection, service, repair and replacementwithout removing permanent construction.Sufficient room shall be available to enablethe operator to observe the burner, controland ignition means while starting the appli-ance.

(5) All appliances, except bunsen burners,ranges or cooktops, installed in public build-ings, such as schools, nursing homes or hos-pitals, shall be equipped with one hundredpercent (100%) shut-off safety valves.

(6) All science or laboratory rooms usingLPG shall have an accessible and markedmaster shut-off valve located within the sci-ence or laboratory room.

(7) All home economic, science, kitchen orlaboratory rooms shall have an accessible,properly charged fire extinguisher with aminimum rating of twenty (20) ABC (A

class-combustible materials, B class-flammable liquids, C class-live electricalequipment) located in an accessible locationwithin the room.

(2) All equipment shall be installed and main-tained in compliance with the safety stan-dards and in conformity with the rules.

(3) It shall be unlawful for any person or cor-poration to put into operation in this state anymotor vehicle using liquefied petroleum gas(LPG) as a fuel unless the fuel containers andsupporting equipment of the vehicle havebeen placed in service by an installer certifiedand registered by the LPG Inspection Author-ity, state of Missouri.

(4) All this installed equipment shall be iden-tified by a state decal issued by the Divisionof Weights and Measures, Department ofAgriculture and applied by the registeredinstaller. Upon transfer of equipment fromone (1) vehicle to another vehicle, the instal-lation shall be reinspected and a new decalapplied to the container and proper formsfiled with the Division of Weights and Mea-sures.

(5) Registered applicants for retail sales ofLPG shall not fill LPG storage containersinstalled on any vehicle where containersbeing used as a source for carburetion fuel,unless the container has displayed the officialstate decal installed per section (4). This shallnot apply to transient vehicles.

(6) At all LPG dispensers, it shall be the dis-penser owner’s responsibility to train specif-ic persons on the operation of the dispenser.It shall be illegal for any person other thanthe trained person to operate the dispensingdevice.

(7) No person shall transport in a passengertype vehicle, or sell for transportation, LPGin containers of forty-five pounds (45 lbs.)capacity or over unless the container is con-nected for direct use in the passenger vehicle.

This material may be found at theOffice of the Secretary of State or at the head-quarters of the agency and is available to anyinterested person at a cost established bystate law.

(1) A school bus equipped with liquefiedpropane (LP) gas carburetion shall beinspected annually during the months of Julyor August by a person who is an officialinstaller, registered with the Division ofWeights and Measures, Department of Agri-culture.

(2) The inspection must be performed follow-ing the detailed procedure for school busesset forth.

(A) Containers.1. American Society of Mechanical

Engineers’ (ASME) containers shall be con-structed for at least a two hundred fifty (250)pounds per square inch gauge (psig) designpressure and installed in accordance withparagraph (2)(A)4.

2. Installations made after February 11,1983 shall include an automatic eighty per-cent (80%) stop fill device.

3. All container valves and fittings mustbe protected by means of a heavy gauge, met-al guard, (minimum seven (7) gauge), as sup-plied by the tank manufacturer. This guardmust be securely attached to the tank with aminimum of two (2) bolted connections,using three-eighths inch (3/8") grade five (5)bolts (or the guard may be welded directly tothe tank at the tank manufacturer’s option).These valves, fittings and gauges must also beprotected from road debris by using mudflaps or metal shields installed in front of thecontainer. A mud flap or metal shield shall be

installed to the rear of fuel container if con-tainer is three feet (3') or less from rearwheels of bus.

4. LP-gas fuel containers used on pas-senger-carrying vehicles shall not exceed twohundred (200) gallons aggregate water capac-ity. (No single tank to exceed one hundred(100) gallon water capacity.) The tank(s)shall be mounted on either side of the bus,each on the outside frame rail and betweenthe axles.

5. If the fuel container must be installedtwelve inches (12") or closer to the engine orexhaust system, it shall be entirely shieldedagainst the source of direct heat by means ofa metal shield. (The main frame rail shall beconsidered to be a partial heat shield.)

6. After the effective date of this rule allLP gas tanks being installed or reinstalled onschool buses shall incorporate strap-typebrackets at the frame rail with no bolts pass-ing through the frame rail. Brackets mayeither encircle the tank and frame rail orencircle only the frame rail and attach to themanufacturer’s tank brackets when the tank isso equipped. If the brackets encircle the tankthey must be steel bands of not less thanthree-eighths inch (3/8") thickness and notless than two inches (2") in width. No lessthan two (2) brackets should be used on tanksup to thirty-six inches (36") in length. Notless than three (3) brackets should be used ontanks longer than thirty-six inches (36").

7. The clamps that encircle the framerail shall consist of straight bolts and backupplates (no U-bolts to be used). The backupplates used must be steel and have a mini-mum thickness of three-eighths inch (3/8")and a minimum width of two inches (2").

8. A minimum of two (2) bolts perbracket using five-eighths inch (5/8") gradeeight (8) bolts must be used to attach thebracket to the main frame. A minimum one-half inch (1/2") grade five (5) bolt must beused to secure the strap to the tank.

9. After the February 11, 1983 all LPgas tanks being installed or reinstalled may beon the left or right side of the vehicle. How-ever, if it is mounted on the right side, thecontainer vessel shall not be less than threefeet (3’) from the passenger entrance door.

10. Containers shall be installed with asmuch road clearance as practicable but notless than seven inches (7") on vehicles havinga wheelbase of one hundred twenty-seveninches (127") or less nor less than nine inch-es (9") on vehicles having a wheelbase ofmore than one hundred twenty-seven inches(127"). This clearance shall be measuredwhen the vehicle is under full rated load andis standing on a flat surface. It shall be mea-sured to the bottom of the container or to the

lowest fitting, support or attachment on thecontainer or container housing, whichever islower under full rated load of the bus. But inno case, shall the bottom of the tank be low-er than the lowest point of the vehicle.

11. Where remote-fill connections areused, double back pressure check valves shallbe installed both at the tank and at theremote-fill location, and a shutoff valve orfitting with a number fifty-four (#54) drillsize hole shall be installed in the eighty per-cent (80%) tank outage connection, in addi-tion to the (fixed liquid level) gauge at theremote location.

(B) Container Safety Relief Valve Pipe-away. After the effective date of this rule, therelief valve discharge shall be to a flush-mounted (recessed) fitting mounted in theskirt of the bus below the rub rail. Prior tothe effective date of this rule flush-mounted(recessed) is considered to be not protrudingpast the rub rail. After the effective date ofthis rule flush-mounted (recessed) is consid-ered to be not protruding past the bus body.This recessed fitting shall provide that thedischarge of the relief valve be directed to notmore than forty-five degrees (45 ) of vertical.A means shall be provided (such as a loosefitting cap) to minimize the possibility of theentrance of water or dirt into the pipe. Theprotecting means shall remain in place exceptwhen the relief valve operates and bedesigned to close automatically. In this event,it shall permit the relief valve to operate atsufficient capacity. This fitting shall also beconstructed so as to prevent tampering andentrance of road debris by use of wire mesh.Safety relief valve discharge lines shall bemetallic and have a melting point over onethousand five hundred degrees Fahrenheit(1500°F) (eight hundred sixteen degrees Cel-sius (816°C)). Relief valve adaptors installeddirectly in the relief valve to deflect the flowupward shall be metallic and have a meltingpoint over seven hundred degrees Fahrenheit(700°F). Discharge lines and adaptors are notto be reduced in size from the inside diame-ter of the relief valve and are not to be lessthan one inch (1") inside diameter. Pipingfrom the relief valve to the outside of the busshall not be more than forty-eight inches(48") in length. The relief valve dischargeline shall be able to withstand the pressurefrom the relief valve discharge and remainvapor tight when the relief valve is in fullopen position.

(C) Piping, Hose and Fittings.1. Pipe shall be wrought iron or steel

(black or galvanized), brass or copper andshall comply with the following:

A. Wrought iron pipe; ANSI B36.10-1979 Welded and Seamless Wrought SteelPipe;

B. Steel pipe; ASTM A53-81a Weld-ed and Seamless Steel Pipe;

C. Steel pipe; ASTM A106-80 Seam-less Carbon Steel Pipe for High TemperatureService;

D. Steel pipe; ASTM A120-81 Blackand Hot Dipped Zinc-Coated (Galvanized)Welded and Seamless Steel Pipe for OrdinaryUses;

E. Brass pipe; ASTM B43-80 Seam-less Red Brass Pipe; and

F. Copper pipe; ASTM B42-82 Seam-less Copper Pipe.

2. For LP gas vapor in excess of onehundred twenty-five (125) psig or for LP gasliquid, the pipe shall be Schedule 80 or heav-ier. For LP gas vapor at pressures of one hun-dred twenty-five (125) psig or less, the pipeshall be Schedule 40 or heavier.

3. Tubing shall be steel, brass or copperand shall comply with the following:

A. Steel tubing; ASTM A539-79Electric-Resistance Welded Coiled Steel Tub-ing for Gas and Oil Lines with a minimumwall thickness of 0.049 inches;

B. Copper tubing; Type K or L,ASTM B88-81 Seamless Copper Water Tube;

C. Copper tubing; ASTM B280-80Seamless Copper Tube for Air Conditioningand Refrigeration Field Service; and

D. Brass tubing; ASTM B135-82Seamless Brass Tube.

4. Cast iron pipe fittings, such as ells,tees, crosses, couplings, unions, flanges orplugs, shall not be used. Fittings shall besteel, brass, copper, malleable iron or ductileiron and shall comply with the following:

A. Pipe joints in wrought iron, steel,brass or copper pipe may be screwed, weldedor brazed. Tubing joints in steel, brass orcopper tubing may be flared or brazed. Fit-tings may be flared, soldered or brazed.

(I) Fittings used with liquid LP gasor with vapor LP-gas at operating pressuresover one hundred twenty-five (125) psig shallbe suitable for a working pressure of two hun-dred fifty (250) psig.

(II) Fittings for use with vapor LPgas at pressures in excess of five (5) psig andnot exceeding one hundred twenty-five (125)psig shall be suitable for a working pressureof one hundred twenty-five (125) psig; and

B. Brazing and soldering filler materialshall have a melting point exceeding onethousand degrees Fahrenheit (1000°F).

5. Hose, hose connections and flexibleconnectors used for conveying LP-gas liquidor vapor at pressures in excess of five (5) psigshall be fabricated of materials resistant to the

action of LP-gas both as liquid and vapor andbe of wire braid reinforced construction. Thewire braid shall be of stainless steel. Thehose shall comply with the following:

A. Hose shall be designed for a min-imum bursting pressure of one thousand sev-en hundred fifty (1750) psig (three hundredfifty (350) psig working pressure) and shallbe marked with “LP-gas” or “LPG” andwith the working pressure in psig at notgreater than ten foot (10') intervals; and

B. Hose assemblies after the applica-tion of connections, shall have a design capa-bility of withstanding a pressure of not lessthan seven hundred (700) psig. If a test ismade, the assemblies shall not be leak testedat pressures higher than the work pressure(three hundred fifty (350) psig minimum) ofthe hose.

6. Hose used for vapor service at five(5) psig or less shall be constructed of mate-rials resistant to the action of LP gas.

7. Hose in excess of five (5) psig servicepressure and quick connectors shall beapproved.

(D) Pipe and Hose Installation.1. The piping system shall be designed,

installed, supported and secured in a manneras to minimize the possibility of damage dueto expansion, contraction, vibration, strainsor wear and to preclude any working loosewhile in transit. Supports should be installedas necessary to insure that segments of liquidhose do not extend without support beyondtwenty-four inches (24").

2. Piping shall be installed in a protect-ed location, under the vehicle and below anyinsulation or false bottom, fastenings andprotection shall be so as to prevent abrasionor damage due to vibration. At points wherepiping passes through structural members, arubber grommet or bulkhead shall beinstalled to prevent chafing.

3. Exposed parts of the piping systemshall either be of corrosion-resistant materialor adequately protected against exterior cor-rosion.

4. Piping systems, including hose, shallbe tested and proven free of leaks at not lessthan normal operating pressure.

5. After the effective date of this rule,all hydrostatic relief valves being installed orreinstalled shall be installed in each section ofpiping (including hose) in which liquid LPgas can be isolated between shutoff valves soas to relieve to a safe atmosphere the pressurewhich could develop from the trapped liquid.This hydrostatic relief valve shall have a pres-sure setting not less than four hundred (400)psig or more than five hundred (500) psig.

(E) Equipment Installation.

1. Installation shall be made in accor-dance with the manufacturer’s recommenda-tions and, in the case of listed or approvedequipment, it shall be installed in accordancewith the listing or approval.

2. Equipment installed on a vehicle aspart of the LP gas system shall be considereda part of the vehicle and shall be installed soas not to interfere with, nor be damaged bythe movement of other mechanical parts inthe normal operation of the vehicle.

3. The gas regulator and the carburetorshall be installed as follows:

A. Approved automatic pressurereducing equipment, properly secured, shallbe installed between the fuel supply contain-er and the carburetor to regulate the pressureof the fuel delivered to the carburetor; and

B. An approved automatic shutoffvalve shall be provided in the fuel system incompliance with paragraph (2)(E)8.

4. Vaporizers shall be securely fastenedin position.

(F) Carburetion Equipment.1. Carburetion equipment shall comply

with this subsection or shall be designed, fab-ricated, tested and marked using criteriawhich incorporate and investigation to deter-mine that they are safe and suitable for theproposed service, are recommended for thatservice by the manufacturer and are accept-able to the authority having jurisdiction.

2. Carburetion systems must remainintact as a total unit unless a component isremoved for repair or replacement. If use ofcarburetion system is discontinued, systemmust be removed in total with no LP gasequipment remaining on vehicle. If a compo-nent is removed from the system for repair orreplacement, gas supply shall be blocked offat the fuel container supply valve with anapproved threaded cap or plug.

3. Vaporizers shall be fabricated ofmaterials suitable for LP gas service andresistant to the action of LP gas under serviceconditions. These vaporizers shall bedesigned and approved for engine fuel serviceand shall comply with the following: Thevaporizer proper, any part of it or any devicesused with it which may be subjected to con-tainer pressure, shall have a design pressureof at least two hundred fifty (250) psig andshall be plainly and permanently marked at areadily visible point with a design pressure ofthe fuel containing portion in psig.

4. The vaporizer shall not be equippedwith a fusible plug.

5. Each vaporizer shall have a valve, orsuitable plug located at or near the lowestportion of the section occupied by the wateror other heating liquid to permit substantiallycomplete drainage. The engine cooling sys-

tem drain or water hoses may serve this pur-pose, if effective.

6. Engine exhaust gases may be used asa direct source of heat to vaporize the fuel ifthe materials of construction of those parts ofthe vaporizer in contact with the exhaust gas-es are resistant to corrosion from these gasesand if the vaporizer system is designed to pre-vent pressure in excess of two hundred (200)psig.

7. Devices which supply heat directly tothe fuel container shall be equipped with anautomatic device to cut off the supply of heatbefore the pressure in the container reachestwo hundred (200) psig.

8. The regulator shall be approved andcan either be part of the vaporizer unit or aseparate unit.

9. An approved automatic shutoff valveshall be provided in the fuel system at somepoint ahead of the inlet of the gas regulator.The valve shall prevent flow of fuel to thecarburetor when the engine is not runningeven if the ignition switch is in the “on” posi-tion. Atmospheric type regulators (zero gov-ernors) shall not be considered as automaticshutoff valves for this purpose.

10. Fuel filters, if used, shall beapproved and can be either a separate unit orpart of a combination unit.

11. Dual fuel systems (gasoline/propane) shall use approved gasoline lockoffvalves. Each valve shall be installed withsteel line from carburetor to a point belowintake manifold and away from exhaust man-ifold. Electric fuel pumps are not consideredan approved gasoline lockoff valve.

(3) It shall be the responsibility of the schoolto properly train all persons operating the LPgas dispenser.

(4) The registered installer making theinspection shall be required to complete theschool bus inspection report in triplicate. One(1) copy is to be filed with the school district,one (1) is to be sent to the Division ofWeights and Measures, P.O. Box 630, Jeffer-son City, MO 65102, and one (1) copy toremain with the installer for his/her files. Theschool bus inspection report will be furnishedby the Division of Weights and Measuresupon written request.

(5) A registered installer completing therequired annual inspection or making theoriginal installation of liquefied propane gascarburetion on a school bus must be in com-pliance with 2 CSR 90-10.040 and this rule.

(6) The Division of Weights and Measures,Department of Agriculture will forwardmonthly during July, August and September,

a report to the Department of Elementary andSecondary Education detailing conditionsexisting on inspected buses and recommenda-tions made to the school district or bus own-er for corrections if required.
