Modernization E-MAIL dated 4-28-11 discussed early forming of initial Modernization Employee Workgroups.
In May, the specific members of the Right of Way
Workgroup were designated. A kick-off meeting was held on June 3rd.
First actual working meeting on June 17th

Early startup of the Right of Way Modernization Work Group pre-dated the establishment of Kaeppel’s formal training.
Team Leads meet with Scott Kaeppel on July 7th 12th and 18th for direct initial training overview of process, Charter discussion and coaches orientation.
Entire team training conducted by Scott Kaeppel August 2nd and 3rd (pilot of future training for all Modernization Teams).
Working sessions started again in August, with meetings held August 9, 10, 23, 30, September 7, 19, 20, 21 and October 4th.
The team is following the structured process provided by Kaeppel and refined the Right of Way Team’s Charter & Goals.
Charter Information
Concept Definition: Expand streamlined right of way acquisition and utility accommodation process to reduce project delivery cycle time in support of TxDOT staff and property interest owners.
Project Problem & Goal ► Problem:
Right of Way Acquisition and Utility Accommodation are not completed prior to construction letting dates.
► Goal: 100% of the ROW process and Utility Accommodation completed that materially affect construction of the project prior to letting date ** (Constructive Possession)

Measures of Success
1. 100% of the ROW process and utility accommodation completed that materially affect construction of the project prior to letting date. ** (Constructive Possession).
2. Reduce cycle time by 25% for ROW and Utility process.
3. 90% of the ROW and Utility submissions are approved on the 1st submission Key Customers

► Acquisition of real property for public transportation
purposes is governed by both State and Federal laws
and regulations.
► May limit ability to reduce or shorten the time for some
acquisition steps.
► SB 18 (Eminent Domain Bill) adds significant days to
acquisition process.
