Tour Itinerary and Highlights Day 1 Arrivals in Winnipeg Individual arrivals at Winnipeg James Armstrong Richardson International (YWG) Airport.

You will arrive in Winnipeg by your own arrangements and make your way to the Inn at the Forks Hotel, located in downtown Winnipeg.

This afternoon we will enjoy a guided tour of the brand new museum, Qaumajuq, home of the largest public collection of contemporary Inuit Art in the world. This first of its kind centre connects to the Winnipeg Art Gallery (WAG) and holds in trust close to 14,000 pieces of Inuit art, including carvings, drawing, prints, textiles, and new media. This is an engaging, accessible space to experience art in new ways, where artists and technology offer direct connections to the lands, peoples, and cultures of the north. The tour will be followed by our welcome dinner.

Day 2 Winnipeg to Churchill After an early morning breakfast we will transfer to the hangar for our flight from Winnipeg to Churchill.

Upon arrival, we will enjoy a Churchill and area tour visiting local and historical points of interest such as Cape Merry, Manitoba Conservation’s Polar Bear Holding Facility and the Inukshuk at town beach, weather permitting.

Following lunch at a local restaurant we will head over to the Itsanitaq Museum, home to a world class collection of ivory and soapstone sculptures which document daily life in the north and focuses mainly on Inuit art and culture. Curator Lorraine Brandson, a Churchill resident since 1973, has authored two books on Inuit and Dene culture as well as, “Churchill, Hudson Bay: A Guide to Natural and Cultural Heritage".

You will enjoy free time to explore the community of Churchill prior to dinner, or you can choose to add on a one hour helicopter excursion (weather permitting).

Our hotel in Churchill is the Tundra Inn.

After dinner together at a local restaurant you can peruse the local gift shops or tuck into a relaxing evening at the hotel. Each evening we will be on the lookout for the Aurora Borealis. Churchill is located under the aurora oval and as long as the skies are clear there is a good chance you could see the bright dancing lights. Our guide will watch for Aurora Borealis while we are there and will alert us to a good viewing point.

Day 3 Churchill After an early morning breakfast, we will depart for our first full day Tundra Buggy® adventure exploring the Churchill Wildlife Management Area (C.W.M.A.) in search of polar bears, arctic fox, ptarmigan and other sub arctic wildlife. A Polar Bears International representative will join guests on board for an in depth discussion on polar bears and their habitat.

Lunch will be onboard the Tundra Buggy®. We will return to Churchill and tuck into dinner at a local restaurant before enjoying a cultural presentation conducted by seasoned residents of Churchill.

Day 4 Churchill Following breakfast we will be transferred to the boreal forest to enjoy an exciting dog sled excursion and interpretive program hosted by a local resident and dog sledding expert. Meet the team of friendly dogs, hear stories and enjoy a mile long ride on a custom built sled through the northern boreal forest.

After lunch at a local restaurant we will step back in time at the Parks Canada Visitor Centre while viewing detailed wildlife dioramas and learning the remarkable history of the fur trade.

Following dinner at a local restaurant, we will enjoy a wine and cheese reception where a Polar Bears International representative will deliver a presentation on polar bears.

Day 5 Churchill After breakfast we will depart for our second and final full day Tundra Buggy® adventure.

Lunch will be onboard the Tundra Buggy®.

After a day of exploring the tundra, we will be transferred directly to the Churchill Airport for an evening flight

back to Winnipeg. A light meal will be served aloft.

Upon arrival in Winnipeg, we will check in for the night at the Lakeview Signature by Wyndham Hotel, near the Winnipeg International Airport.

Day 6 Departures from Winnipeg After breakfast, you will make your way to the Winnipeg International Airport for your individual departure.

Terms and Conditions Churchill and its Polar Bears

November 1 to 6, 2022These terms and conditions (“Terms and Conditions”) constitute a binding legal agreement (the “Agreement”) between the individual named on the ticket (“you”) and 750207 Ontario Inc., operating as Adventure Canada (Ontario registration numbers 04001400 and 50021860) (“Adventure Canada”). These terms and conditions apply to the Adventure Canada experience for which the registration agreement is being completed (the “tour”) and associated pre, mid and post tour enhancements.

If you have any questions or concerns, or if you require any clarification, you must raise them with the ROMTravel Coordinator and or Adventure Canada.

By purchasing this ticket and agreeing to these terms and conditions, you will waive certain legal rights, including the right to sue. You will also agree to assume liability for injury, property damage, illness and disease (including Covid 19). Pay specific attention to sections 12, 13, 14, 21 and 22, which contain important limitations on your cancellation rights and your rights to assert claims against Adventure Canada and others.

1. Parties to this Agreement

Adventure Canada offers a series of specialty tours. These tours are provided by independent operators (“Independent Operator”).

This Agreement is between you and any or all of the following:

i. Adventure Canada; ii. Frontiers North Inc.; iii. Royal Ontario Museum

(ROMTravel); iv. All Enhancement Providers; v. Operators of Group Flights; vi. Owners, officers, directors,

employees, agents, crew, pilots, subcontractors, affiliates, volunteers, successors and assigns of the entities identified in subsections (i), (ii), (iii) and (iv) of this section;

vii. Agents and suppliers of Adventure Canada.

The parties listed above (i. through vii.) shall collectively be referred to as the “Benefiting Party” or “Benefiting Parties”.

Certain Benefiting Parties may request that you complete a separate agreement with terms and conditions for them (“Other Terms and Conditions”). If so, the Other Terms and Conditions will supplement these Terms and Conditions. If there is a conflict, these Terms and Conditions will apply over the Other Terms and Conditions, except for any terms and conditions solely dealing with the relationship between the traveller and the Benefiting Party.

2. Tour Cost Per Person Double Occupancy $10,215

Single Supplement $1,300

All quoted costs are in Canadian Dollars.

Tour cost does not include flight costs to and from your home and Winnipeg, Manitoba. Adventure Canada cannot assist with booking flights. ROMTravel will provide recommended flight information to and from Toronto and Winnipeg, or suggested arrival and departure times for travellers flying a different routing.

Adventure Canada can assist with booking pre and post tour hotel rooms.

3. Optional Add Ons Gear Rentals (advance booking recommended):

Canada Goose parka, Canada Goose ski pants, and Baffin boots.

Approximately $98 per day for three piece rental.

One hour helicopter:

On Day 2 you can experience the majesty of Canada’s large ecosystem on an hour long helicopter tour over the desert like tundra and northern boreal forest. Fly over the Churchill Wildlife Management Area and Wapusk National Park in search of northern wildlife including polar bears, moose, ringed seals, caribou and arctic fox.

Approximately $672.

4. Tour Cost Includes Two nights shared accommodation in double occupancy room with private facilities in Winnipeg.

Three nights shared accommodation in double occupancy room with private facilities in Churchill.

Free WiFi access at included hotels.

Porterage of one standard sized suitcase per person at the hotels, excluding the morning of Day 2 when you must bring your suitcase from your room to the hotel lobby.

Regional flights from Winnipeg to Churchill, and Churchill to Winnipeg.

Transfers from Churchill Airport to hotel on Day 2, and from hotel to Churchill Airport on Day 5.

Meals: breakfast daily, 4 lunches and 4 dinners. All meals include tea, coffee, soft drink, juice, or milk.

Wine and cheese reception with Polar Bears International (includes 2 complimentary glasses of wine).

Welcome dinner (includes one alcoholic beverage per person).

Reusable water bottle provided.

Ground transport in private coach or Tundra Buggy® for transfers and excursions as per itinerary.

Two full day private Tundra Buggy® adventures.

All visits, entrance fees, speakers’ fees and events as per itinerary.

All taxes and tips for all goods and services, drivers, hotels, restaurants and guiding staff related to the basic tour.

Services of a ROMTravel Coordinator, English speaking local guides, and Adventure Canada.

5. Not Included Flight costs to and from your home and Winnipeg. Fuel surcharges. Airline baggage fees if any.

Video camera fees if any.

Airport and hotel transfers on Day 1 and Day 6 to and from Winnipeg International Airport.

Meals, snacks, beverages and other services unless specified.

Optional add ons.

Mandatory comprehensive travel insurance, including without limitation, medical, emergency evacuation, trip cancellation and interruption insurance.

Additional meals, accommodations or other expenses due to delays or itinerary changes.

Items of a personal nature such as laundry or phone calls for example.

Pre and post tour hotel accommodation.

Visa fees, if any.

Internet access outside the hotels.

6. Costs All costs quoted herein are based on rates, fees and taxes as of May, 2021. Costs are subject to change without notice. Should tour costs increase, Adventure Canada (as per Tico regulations) reserves the right to

increase the cost accordingly up to a maximum of 7%. Adventure Canada reserves the right to substitute itineraries, hotels or airlines due to conditions beyond their control. Any change to itinerary will not result in eligibility for a refund.

7. ROM Membership Requirement

Travellers must be members of the Royal Ontario Museum. For a full list of membership levels and benefits, visit the ROM website. Only one person per room must be a member.

8. Deposits and Final Payment

An initial deposit of $2,000.00 per person is required at the time of booking. The balance of payment of $8,215.00 per person, and if applicable, single supplement of $1,300.00, are due on July 4, 2022, 120 days prior to departure. All payments are non refundable.

All late payments are subject to a penalty of 1.5% interest per month, or 18% per annum. Adventure Canada reserves the right to cancel your booking if it is not paid by the balance due date or the departure date or deny participation due to any unpaid balances, without a refund to you.

9. Reservations As the number of travellers is limited, reservations should be made as soon as possible. In the event of over subscription, a waiting list will be maintained.

Each traveller is required to complete ROMTravel’s application form and

Frontier North Adventures’ Waiver form prior to the processing of the initial non refundable deposit. If travelling with children, a Parental Release must be signed for each child.

10. Age Limitations Adventure Canada offers family friendly tours. Travellers under the age of 18 must have Adventure Canada’s “Agreement for Accompanying a Minor Guest” completed at the time of booking if travelling without their legal guardian. Travellers 16 and under must be accompanied by and share accommodation with a travel companion over the age of 18. No babysitting or childcare services are provided.

11. Special Accommodations, Physical Limitations or Disabilities

Adventure Canada is committed to extending a high level of customer service to all travellers, including persons with disabilities. We are committed to meeting the needs of persons with disabilities in a timely manner, and will do so by preventing and removing barriers to accessibility wherever possible.

Adventure Canada tours can take place far away from hospitals and other institutional medical care and are therefore intended for persons in good health. Travellers who need assistance, special facilities or treatment, or need to bring medical equipment must disclose this at the

time of booking, or when it occurs, if later.

The Benefitting Parties reserve the right to refuse or revoke participation to anyone who, in its sole judgment, is unfit to participate in the tour or who endangers their safety or the safety of others, including by failing to follow health and safety protocols.

12. Cancellations by the Traveller

All cancellations must be made in writing to Adventure Canada. All payments are non refundable. No refunds will be given for payments made or unused services.

13. Cancellation of Pre and Post Tour Hotels

Hotels offered through Adventure Canada are a third party service and require full payment at the time of booking. If cancelled more than 120 days before the departure date, $50 per hotel room will be non refundable. At the time of final payment, the hotels will be non refundable.

Refunds will only be processed in the manner in which the original payment was made.

Refunds made by credit card will be subject to an additional 2% handling fee.

14. Cancellations by ROMTravel and Adventure Canada

ROMTravel and Adventure Canada may cancel the tour due to insufficient numbers of travellers or for any other reason in their sole

discretion. In the event of a cancellation, refunds will be issued.

Adventure Canada will not be held responsible for, and no refunds will be given for, delays or cancellation of all or part of a tour due to causes or circumstances beyond Adventure Canada’s or the Independent Operator’s responsibility or control, including but not limited to acts of God; act of any governmental or ruling authority; weather emergencies; breakdown; failure of equipment; epidemic, including any and all governmental orders, and government mandated closures, restrictions or cancellations imposed as a result of disease or pandemic; collision; stranding; fire; faults or errors in management of vehicles; seizure of any vehicles under legal process; any abrupt or unexpected increase in the cost of fuel or shortage of fuel; war; hostilities; riots; strikes or labor stoppages; terrorism; civil disturbance; quarantine, or any other cause or circumstance beyond Adventure Canada’s or the Independent Operator’s responsibility or control (a “Force Majeure Event”). A Force Majeure Event also includes (a) the occurrence of any pandemic, epidemic or prevalent disease or illness with an actual or probable threat to human life as may be designated or determined by any local, city, county or state governmental entities, as applicable, or the federal government of Canada or the United States, the World Health Organization, The Public Health Agency of Canada or the U.S. Centers for Disease Control; including,

without limitation, atypical pneumonia, Severe Acute Respiratory Syndrome (Sars), or avian influenza, or (b) adherence to any travel restriction, warning or advisory issued in relation thereto by any local, city, county or state governmental entities, as applicable, or the federal government of the United States, the World Health Organization or the U.S. Centers for Disease Control, or (c) any quarantine or similar measure taken in relation thereto by any governmental agency or authority to prevent the spread of any communicable disease, or (d) any unavailability of any resources, information or services resulting from any of the foregoing including, without limitation, the unavailability of resources, information or services due to any governmental shutdowns or the unavailability or resources, information or services due to a shutdown, quarantine or similar measure of any third party service provider whose service or information is relied upon by Adventure Canada or the Independent Operator to fulfill Adventure Canada’s obligations under this Agreement.

The Benefiting Parties shall have no liability to you in the event of a Force Majeure Event, except that, if there is a Force Majeure Event that results in the cancellation of your booking prior to its commencement, The Benefiting Parties will provide a refund. Other than as expressly set out in this paragraph, the Benefiting Parties will have no liability to you if there is a Force Majeure Event. For greater certainty, under no circumstances will

the Benefiting Parties be responsible for additional expenses or arrangements incurred by you, including accommodation, transportation, travel visas and or vaccinations.

15. Documents For non Canadian residents, a passport valid for six months after the return date is required. For Canadian residents, a valid passport, driver’s licence or other comparable government issued identification is required. It is the individual traveller’s responsibility to ensure proper visas, affidavits, Covid 19 test results, proof of vaccination and or any other documents that may be required to enter and or to not have to quarantine at the destination or upon returning to your home. Neither Adventure Canada nor ROMTravel is responsible for missing or incorrect travel documents. Note that public health entry and quarantine requirements for any country may change with little notice. Entry to another country may be refused even if the required information and travel documents are complete.

16. ROMTravel values your Privacy

ROMTravel will publish your contact information in the tour handbook unless you advise not to do so. It is for the sole use of tour travellers and ROMTravel. Adventure Canada will only disclose personal data for the purposes of executing a safe tour.

17. Use of Data Adventure Canada collects personal information from travellers via a

secure online account. Online accounts are established by booking a reservation. Travellers on a given reservation travelling as a part of a family or group will have access to each others' personal information, including health information. Travellers must advise Adventure Canada at the time of booking if they do not consent to their personal information being accessible to other travellers on the same booking reservation.

18. Special Equipment Adventure Canada does not permit travellers’ use of drones or other unmanned vehicles. No exceptions will be made.

19. Insurance Comprehensive travel insurance is mandatory for this tour. Adventure Canada can facilitate the purchase of travel insurance through Manulife Financial. It is recommended to obtain travel insurance at the time of booking for maximum coverage. Insurance may be purchased up to the time the initial deposit is processed, or at a later time, but, if purchased later, would be subject to any changes to the premiums and or to the traveller's health or other circumstances at the time of purchase.

Travellers may provide their own travel insurance or purchase travel insurance through another provider, but proof of insurance will be required at the time of final payment.

A ROMTravel waiver of insurance will be required if the participant does

not purchase insurance through Adventure Canada.

All losses suffered or additional costs incurred associated with failure to have sufficient insurance, including coverage related to Covid 19 or any other transmissible diseases, are the sole responsibility of the traveller. It is the responsibility of the traveller to secure adequate insurance coverage for the level of protection they desire. The Benefiting Parties will not be held responsible for missed connections, incorrect check in times, improper documentation and or lost, stolen or damaged luggage.

20. Royal Ontario Museum Responsibility

Neither the Royal Ontario Museum nor the Department of Museum Volunteers of the Royal Ontario Museum, or any member thereof, assumes any responsibility for the financing, arranging or the conducting of the tour, nor shall be liable for damages or loss to person or property that might occur in connection with this tour however arising, whether by negligence or otherwise, and whether or not a member of the Royal Ontario Museum staff or the Department of Museum Volunteers accompanies the tour. The applicant by applying to join the tour hereby agrees to this limitation of liability on the part of the Royal Ontario Museum, the Department of Museum Volunteers or any member thereof.

21. Changes, Interruptions, Delays, Baggage and Security

Itinerary Itineraries are intended as examples only. All prices, inclusions and dates may change due to circumstances beyond our control including but not limited to weather, wildlife habits, contract service providers, and or logistical decisions of the tour leader and or operations manager. Travellers must be prepared to be flexible as schedules may vary depending on conditions. Weather and wildlife are unpredictable; northern lights and or wildlife sightings are not guaranteed.

Delays or Interruptions to the Tour Due to a Force Majeure Event If the tour is interrupted, the itinerary changed, or if the transportation is unduly delayed or prevented from proceeding in the ordinary course by any Force Majeure Event as defined above, the Benefiting Parties shall have the right, in their sole discretion, to terminate the tour. If that occurs, the tour shall be considered to have been fully performed as if the tour were completed and the Benefiting Parties’ responsibility shall cease without any liability on the part of the Benefiting Parties or any of them to refund any part of the fare or liability for any other costs or expenses.

Delay by Traveller Travellers arriving for the commencement of the tour are responsible for their timely arrival, regardless of any change to the

departure date or time, or to the itinerary.

Baggage Baggage is solely your risk and expense, and may be subject to sanitation measures. Baggage volume and weight may be limited. Any excess baggage charges for commercial flights are your responsibility. The maximum weight limit may be subject to change.

Security You agree that the Benefiting Parties shall be entitled to inspect your person or luggage for security purposes, and you hereby acknowledge that this may involve a physical search of your person and or your property.

22. Limitation of Liability, Your Responsibilities, Release and Assumption of Risk, Waiver of Claims, and Maximum Compensation

Responsibility and Participation You hereby certify that you do not have a mental, physical, medical or other condition or disability that would create a hazard for you, other travellers, crew, employees, or representatives of any of the Benefiting Parties that you have not disclosed to ROMTravel and Adventure Canada. You agree to honestly complete the personal information and health history request from ROMTravel and Adventure Canada via its website or by requesting paper copies, prior to departure. Adventure Canada

reserves the right to request further information from your physician or other treatment provider at your expense, to which you hereby provide your consent.

Due to regional and international obligations, the Benefiting Parties may be required to request additional information or medical documentation from you, perform daily health checks on you, keep a personal medical log, and distribute your personal data to a variety of third parties, to which you hereby consent.

You understand and agree that you will not be permitted to participate in the tour if at the commencement of the tour if you feel ill or exhibit any symptoms of communicable diseases, including symptoms of Covid 19, which include, but are not limited to, fever, cough, sore throat and shortness of breath. In addition, you may be screened for possible exposure to Covid 19 prior to joining and may be refused participation in the sole discretion of the Benefiting Parties. The Benefiting Parties have the right in their sole discretion to remove you from the tour or any part of it if you fail to adhere to health and safety standards and protocols in place to prevent the spread of disease or for any other safety reason. Refunds will not be available if this occurs.

Your inability to take part in the tour due to possible symptoms of or exposure to illness or disease will be your sole responsibility. Refunds will not be available. You must arrange

your own insurance to cover this eventuality.

Express Assumption of Risk and Release You acknowledge that there are risks, dangers, and hazards associated with the tour, and that the risks may be the result of the negligence of the Benefiting Parties or any of them, or the conduct of other travellers. You acknowledge that the risks, dangers, and hazards may also arise from foreseeable and unforeseeable causes, including weather, other acts of nature and diseases or pandemics such as Covid 19. You understand that Covid 19 and other communicable diseases are a significant health risk and carry a high risk of transmission through physical or shared contact. You acknowledge that the aforementioned risks, dangers and hazards may arise in connection with the tour, any enhancements, optional add ons, or any recreational activities which may take place during the tour.

In consideration of the benefits to be derived from the tour, you voluntarily accept all risk of personal injury or death and property damage or other loss arising from your participation. You also hereby agree that you and your dependents, heirs, executors, administrators, legal personal representatives, successors and assigns, release and hold harmless the Benefiting Parties from any and all claims, including claims of negligence, illness, personal injury, death or property damage or loss, however caused, arising from or related to the tour.

Waiver of Claims Unless otherwise provided for in these Terms and Conditions, you hereby waive any claim you may have against the Benefiting Parties for any damage, loss or injury, no matter how it is caused. You specifically agree to waive any claims or actions that you may have presently or in the future for the negligent acts or conduct of the Benefiting Parties or any of them. Regardless of the situation or circumstances giving rise to a claim, you waive any right to seek indirect, special, consequential, punitive or exemplary damages against the Benefiting Parties or any of them.

Maximum Compensation Compensation for personal injury is limited by these Terms and Conditions and in accordance with the provisions of any applicable International Conventions.

Notwithstanding the foregoing, should for any reason the Benefiting Parties or any of them, be found liable for any matter, their maximum liability, for any reason whatsoever, howsoever caused, will be limited to the amount paid by you to Adventure Canada for the tour.

Exclusive Governing Law and Jurisdiction These Terms and Conditions and any actions and proceedings related to them in any way shall be governed by the laws of the Province of Ontario and the laws of Canada applicable therein without regard to conflict of laws principles. Any action or legal proceeding based on any right arising out of these terms and conditions shall be commenced in

the courts of the City of Toronto, in the Province of Ontario, and you hereby consent to the exclusive jurisdiction of those courts. You also waive any objection to venue or jurisdiction you may have, notwithstanding any delays in the Ontario court system caused by the Covid 19 pandemic or for any other reason.

Independent Legal Advice You acknowledge that you have had the opportunity to seek independent legal advice prior to agreeing to these Terms and Conditions. By executing this Agreement, you confirm that you have received any legal advice you have deemed necessary before doing so.
