    Standard Terms and Conditions of SaleRM BILTRITE™ LLC sells products commercially for multiple applications determined by the Buyer or end-user. Determination of the suitability of the products for the uses and applications of Buyers and end-users shall be the sole responsibility of the Buyer or end-user. Consultation with qualified engineers and testing laboratories is recommended. RM BILTRITE™ LLC does not recommend any of its products for any particular use or application. The purchaser or end-user shall assume full responsibility for the adequacy and suitability for the intended use. Rubber products may fail as a result of temperature variances, excessive pressures, abrasion or damaging substances. The wear life of rubber products is limited by the circumstances and conditions of use. Buyer and end-users should regularly inspect the rubber to determine if it should be replaced for operational and safety requirements, to prevent injury of damage to persons and property.

    Payment Terms: Net 30 days from date of invoice on approved credit and accounts in current good standing. At our discretion, we may require full or partial payment in ad-vance if Buyer does not qualify for terms or continued terms. A charge of 1.5% per month (or at the highest rate permitted by law) shall be charged on overdue accounts. Credit balances will only be applied to future purchases.

    Transportation Policy: All shipments are made FOB Origin, Freight Collect or FOB Origin, Freight Prepaid & Add. Seller will determine the point of shipment, the method of transportation, and the routing of shipment. For Freight Prepaid & Add shipments, Seller reserves the right to determine the most economical shipping method on shipments, and all freight charges shall be added to Buyer invoice. Partial deliveries shall be accepted by the Buyer. Seller does not guarantee any delivery or completion date. Seller shall not be liable or responsible for any loss, damage, expense or charge of any kind, direct or indirect, suffered or incurred by Buyer as a result of such delay. All shipments shall be carefully inspected when received and any claims for freight damage should be noted on the Bill of Lading. Seller shall not be responsible for freight damage and/or concealed damage not reported to the carrier at time of delivery.

    Prices/Minimum Order: Minimum order is $500.00. All prices are subject to change without prior notice. All Buyer purchase orders shall be accepted by Seller at time of order. All price pages and catalog weights are approximate and actual shipping weights may vary from these listings. In case of dispute, actual shipping weight will apply. All orders accepted by the Seller are accepted on the understanding that Buyer, by placing the order, has agreed to these Standard Terms and Conditions of Sale, and are part of the Buyer’s order.

    Quantity Variance: Due to manufacturing variances, the quantity of goods delivered can be within 10% more or less, of the quantity specified and shall be charged at the unit price. Buyer agrees to accept quantity variances that may differ from the purchase order as described within.

    Cancellations: Requests for cancellation or modification for orders from warehouse stock must be submitted in writing and received by Seller at least 2 days prior to shipment. No cancellations or modifications are allowed on direct container shipments. Orders for merchandise produced and/or shipped specifically for a customer cannot be canceled once goods are produced.

    Returned Goods: No goods may be returned without Seller’s prior written authorization. Each request for exchange or return shall describe the condition of the goods, and the reasons for the requested return or exchange. Buyer shall request and receive a RMA (Return Merchandise Authorization) number from the Seller before returning any goods. Seller will not accept any returned good shipment without a RMA number attached to the shipment. For return of 1st class goods, Buyer shall pay return transportation costs and a restocking charge of 15%. All return requests shall apply only to warehouse stock products purchased within a six month period. No returns on goods that have been cut, treated, altered, processed, subject to abuse or misuse, or damaged after shipment by Seller. No returns on special orders, made-to-order goods, or custom-cut lengths.

    Warranties and Disclaimers: Goods furnished under this agreement shall conform to the description herein. All first quality goods are warranted to be free from defects in material and workmanship at the time of shipment. Seller shall convey good title to buyer. Seller further warrants that the goods sold hereunder do not infringe any valid US patent, and Seller does not warrant, however, that the use of the good or products made therefrom, either alone or in conjunction with other materials, will not infringe any valid US patent. THE WARRANTIES SET FORTH IN THIS PROVISION ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES EXPRESSED OR IMPLIED, INCLUDING WARRANTIES ARISING FROM COURSE FOR DEALING OR USAGE OF TRADE. SELLER MAKES NO WARRANTY, EXPRESSED OR IMPLIED, OF MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR PURPOSE. ALL PRODUCTS ARE SOLD AND WARRANTED ONLY PURSUANT TO OUR PUBLISHED TERMS AND CONDITIONS OF SALES. WE ARE NOT RESPONSIBLE FOR THE USER FOR ANY CONSEQUENTIAL, INCIDENTAL, OR SPECIAL DAMAGES RESULTING FROM PRODUCT USE OR PROCESSING. IN NO CIRCUMSTANC-ES WILL SELLER’S LIABILITY EXCEED THE PURCHASE PRICE OF THE GOODS.

    Products Suitability and Length of Use: Buyer acknowledges the use of its own knowledge, expertise, skill, experience and judgment in the selection of products(s) and /or in the selection, provision, or designation of any specifications or set of specifications for a product(s) agreed upon by the Buyer and Seller. Buyer acknowledges that Seller shall not be liable for, and Buyer assumes all risk of, inaccurate or unsuitable specifications or information provided, selected or designed by the Buyer. RM BILTRITE™ LLC MAKES NO REPRESENTATIONS OR WARRANTIES WITH RESPECT TO THE SUITABILITY OF MATERIALS FOR A PARTICULAR PURPOSE. BUYERS AND USERS MUST DETERMINE THE SAFETY AND SUITABILITY OF RM BILTRITE™ LLC’S PRODUCTS FOR THEIR OWN PURPOSES, AND ASSUME ALL RISK, RESPONSIBILITY, AND LIABILITY FOR ALL INJURIES, LOSSES, OR DAMAGES ARISING FROM THE APPLICATION OF THE INFORMATION OR USE OF RM BILTRITE™ LLC’S PRODUCTS, WHETHER OR NOT CAUSED BY RM BILTRITE™ LLC’S NEGLIGENCE OR BASED ON STRICT PRODUCT LIABILITY.

    Physical Properties Grade 1: ASTM basic requirements for physical properties are based on values obtained from standard laboratory test specimens prepared and tested in accordance with the applicable ASTM test methods. Test results from specimens prepared from finished products may not duplicate values obtained from standard test specimens. Per ASTM D2000, Section 7.1, Buyer agrees that when standard test specimens are cut from finished parts in accordance with Practice D3183, a deviation of the up to 10% on tensile strength and elongation values is permissible.

    Claim Period and Remedies: Prompt written notice shall be given to Seller of any claim or failure of goods to conform to the warranties hereunder. Should any failure to conform to these warranties appear under normal and proper use within the period of six (6) months from the date of shipment to the Buyer, Seller shall correct such noncon-formity, at its option, by repair or replacement of the defective goods or by the refund of the purchase price thereof with due allowances made for the service rendered by the goods returned. In no circumstances shall Buyer commence any action under this Agreement later than one year after receipt of the goods. The remedies provided above are the Buyer’s sole remedies for any failure of Seller to comply with its obligations.

    Limitation of Liability: Seller shall not be liable to contract, in tort (including negligence) or otherwise for damage or loss other property, loss of profits or revenue, loss of use of property or equipment, claims of customers of the Buyer, or for any special, indirect , incidental, or consequential damages whatsoever. Under no circumstances shall Seller’s liability exceed the purchase price of the goods in respect of which damages are claimed.

    Attorney’s Fees and Venue: In any action to collect amounts due Seller, with respect to sales made to Buyer, arising out of or relating to this Agreement or any such sales, or in which a party seeks an interpretation of this Agreement or asserts it as a defense, the prevailing party shall be entitled to recover attorney’s fees in any amount determined by the Court to be reasonable, as well as such party’s costs of suit. All notices, requests, claims and other communication by Buyer with respect to this Agreement or sales hereunder shall be direct to Seller at its corporate offices located at 8525 Dunwoody Pl, Sandy Springs, GA 30350. Any action brought by Buyer against Seller must be brought in a State or Federal Court located in Fulton County, Georgia, and any action brought in any other locations shall, upon appropriate motion by Seller, be dismissed.

    Entire Agreement: This agreement constitutes the complete and final Agreement of sale and purchase of the products specified herein and supersedes all prior contracts and discussions. NO modification hereof shall be effected by the use of purchase order, acknowledgment, acceptance, or other forms that vary with or are additions to the terms and conditions contained herein. No modification shall be effected in any manner other than in writing and signed by seller.

    Governing Law: This contract shall be governed by and construed under the laws of the State of Georgia, USA.

    This resistance chart is based on a single polymer compound and is offered as a general guide, including the suitability of various elastomers for service in these chemicals and fluids. The ratings are mainly based on published literature of various polymer suppliers, rubber manufacturers, and in some cases, the opinion of experienced compounders. We recommend self-testing polymers as we cannot guarantee the accuracy of this chart nor assume responsibility for use thereof. Many factors must be considered in using a rubber part in service. The most important as we see them are:1) The temperature of service: Higher temperatures increase the affect of all chemicals on polymers. The increase varies with the polymer and the chemical. A compound quite suitable at room temperature might fail at elevated temperatures.2) Conditions of service: A compound that swells badly might still function as a static seal yet fail in any dynamic application.3) The grade of the polymer: Many types of polymers are available in different grades that vary greatly in chemical resistance.4) The compound itself: Compounds designed for their outstanding properties may be poorer in performance in a chemical than one designed especially for fluid resistance.5) The durometer: In general, the harder the compound the better the resistance.

In any application, the customer should evaluate the performance requirements and conditions that will affect the working life of the thermoplastic product. Where appropriate, field tests may need to be performed before the type of thermoplastic is selected. If the customers’ quality assurance includes the testing of thermoplastic materials, the test criteria should specify the physical property of the ASTM specification that is most critical to its application. Polymer type alone may not be adequate for the selection of the thermoplastic that is best suited for a specific application.     TUFF TRAC® COMMERCIAL KITCHEN FLOORING

    RM Biltrite™ Flexgard® & Rubbermax™ Neoprene Rubber is an excellent general purpose polymer for most uses and applications. It has moderate resistance to oil, gasoline, sunlight, ozone, and oxidizing material. Its temperature range and physical toughness makes it an excellent choice for cold temperature flexibility, abrasion resistance, and repeated flexing applications.

    Applications: Electrical insulation, wear-resistant pads, vibration pads, isolation mounts, buffers, diaphragms, industrial matting, water retaining structures, and industrial applications such as gaskets, hoses, and corrosion-resistant coatings.

    RM Biltrite™ Tuff Trac® Acoustical Barrier Mass Loaded Vinyl (MLV) is a high density PVC product engineered to block sound wave transmission and reduce noise. MLV barrier is highly flexible and well-suited for a variety of automotive, industrial, and building applications. All MLV barrier products are manufactured to meet Federal Motor Vehicle Safety Standard No. 302 (FMVSS 302) specifications for fire safety, and are available in a variety of reinforced and non-reinforced materials.

    RM Biltrite™ also provides a specialized E84 Class-A MLV barrier in white or black. Excellent for use in high temperature areas where superior flame & smoke resistance is necessary.

    RM Biltrite™ Tuff Trac® Commercial Kitchen Flooring provides safety in commercial kitchens and other work environments where floor protection, slip resistance, and easy cleaning are essential. The PVC material does not absorb water and is resistant to many chemicals found in industrial areas. PVC is also resistant to bacteria and mold, and is flame and smoke retardant.

It has generally strong resistance to oil, fuel, petroleum based hydraulic fluids, aliphatic hydrocarbons, and hydrocarbon solvents, as well as alkalis, acids, and other chemicals. Like natural rubber, nitrile can be damaged by ozone, ketones, esters and aldehydes. It is more resistant than natural rubber to oils and acids, and has superior strength, but inferior flexibility. Nitrile rubber is less likely to cause an allergic reaction than natural rubber.

    RUBBERMAX™ CSM (HYPALON®)

    RM Biltrite™ Flexgard® SBR Rubber is a copolymer of styrene and butadiene and has properties similar to natural rubber. Compared to natural rubber, SBR has superior processability, heat aging, and abrasion resistance but inferior elongation, hot tear strength, resilience and tensile strength. SBR has excellent mechanical properties, low compression set, and high resilience. It also has excellent dynamic and rebound properties and exhibits good resistance to acids, brake fluids, moisture, alkalis and salts. SBR may be substituted for natural rubber in certain applications, offering significant cost savings. Not recommended for use in proximity to oils and hydrocarbons. An economical red or black sheet can be used in low pressure applications with no oil resistance requirements.

    Applications: HVAC and construction industry, hydraulic brake system seals and diaphragms, mechanical rubber parts, panel grommets and body pads.

    RM Biltrite™ Rubbermax™ Hypalon® Rubber, also known as CSM, is a premium grade synthetic rubber. It is flame resistant and offers strong resistance to most chemicals, alkalis, acids, oils, and heat. CSM rubber also display good electrical properties and color stability, along with good weather and abrasion resistance.

    Applications: Waterproofing, acid and alkaline proofing, hoses, cable sheathing, inflatables, roofing.

    RM Biltrite™ Tuff Trac® ESD Matting provides crucial safety in environments where people or products are at risk of harm from static charge.

    Tuff Trac® ESD Single Layer is made with a proprietary blend of polymers and migratory anti-static components. The anti-static components are homogeneously dispersed and continually migrate to the surface. This specialized blend has high hydrophilic properties, ensuring a micro-thin layer of water on the surface to assist the flow of static charge. The blend also contains polymers which actively control dissipation by slowing its speed. Tuff Trac® ESD Single Layer delivers a resistance of 108-109.

    Tuff Trac® ESD Dual Layer is made with the same proprietary blend of polymers and migratory anti-static components as ESD Single Layer and is permanently bonded to a 5mm conductive polymer layer on the backside for additional performance. The conductive polymer bonding produces an electrical rating of 106-108, making the Dual Layer's surface less hydrophilic and less dependent on room humidity.

Our conductive matting is manufactured from PVC engineered vinyl and consists of a highly conductive cap film bonded to a non-conductive base. It has a homogeneous distribution of carbon black and proprietary polymers to provide a continuous and permanent path-to-ground.

    Along with electrical floor protection, conductive matting also provides anti-fatigue comfort for employees. All conductive matting is fabricated to ANSI/ESD S7. 1-2005 standards and tests in the optimal electrical rating range of 104-106.     RM Biltrite™ Flexgard® Cloth-Inserted (CI) Rubber is reinforced with one or more plies of Nylon 6 fabric. Nylon 6 fabric insertion increases stability during applications using mechanical fastening, and reduces creep during high compression load handling. Cloth-Inserted rubber is available with either SBR or neoprene rubber, with both regular ply (one ply of fabric for each 1/16” thickness) and reduced ply (one ply of fabric for each 1/8” thickness) options.

    RM Biltrite™ Rubbermax™ Diaphragm Rubber is manufactured with a high quality nitrile rubber compound designed for prolonged wear and use. The rubber is then inserted with a Nylon 6 cloth for maximum strength and durability. Cloth insertion can be provided with either 1 or 2 ply reinforcement.

    RM Biltrite™ Tuff Trac® ASTM Vinyl Switchboard Matting insulates employees from electrical shock by interrupting the electrical path-to-ground. Perfect for use in high voltage areas and around high voltage equipment.

    RM Biltrite™ Flexgard® Fluoroelastomer Rubber, also known as FKM or Viton®, is a high-performance elastomer valued for its excellent heat stability and strong resistance to aggressive fuels and chemicals. FKM performs a broad range of resistances when exposed to oils, fuels, lubricants, and most mineral acids. It also has good resistance to many aliphatic hydrocarbon fluids used as solvents in other rubbers. FKM exhibits exceptionally good compression set characteristics at high temperatures and good resistance to atmospheric oxidation, sun and weather exposure, fungus and mold.

    Applications: Automotive, fluid power, appliance and chemical industries, fuel system seals, expansion joints and gaskets.

    FLEXGARD® DURA-TRANZ®

    RM Biltrite™ Flexgard® Dura-Tranz® Rubber Transit Flooring enhances the look of any vehicle while providing better walking comfort, slip resistance, anti-fatigue, anti-bacteria, noise reduction, and fire safety than other hard surface floorings.

    Dura-Tranz® is scratch resistant, has high dimensional stability, and cleans easily with regularly available floor cleaning solutions. It is very low maintenance flooring option in comparison to wood and carpet. Dura-Tranz® does not require any waxing, polishing, scrubbing, sanding, or refinishing. Product can be laid loosely on top of previous flooring or bonded directly to the floor itself.

    RM Biltrite™ supplies Dura-Tranz® in rolls with a smooth or ribbed finish and smooth, sandpaper, or fabric backing. Dura-tranz® is available in solid and marble patterns and comes in a wide range of colors for easy, customizable design creation. Custom colors can be provided upon request.     Dura-Tranz® Fire Guard is developed for military applications where fire safety standards are absolutely critical, such as battleships and submarines. Its quality and functionality make it an excellent floor covering option for interior use in passenger liners, ferries, cruise ships, tankers, container ships and marine ships. Duro-Tranz® Fire Guard flooring can also be used in underground metro rail cars where fire safety is a top priority. It is fire rated class 0 by Warrington Fire Labs U.K. Available with fabric finish.

    FIRE SAFE

    Dura-Tranz® Fire Safe is a custom made range of synthetic rubber floor coverings it is designed to meet requirement of tunnel (both single and multi track) railway system to BS 6853:1999 CAT 1A and 1B. Dura-Tranz® Fire Safe flooring is recommended for high traffic areas where higher safety standards are required. It is flame resistant and comes with a M1 (Class 1) classification tested at Warrington Fire UK. Available in plain, speckle or marble Finishes.

    RM Biltrite™ Flexgard® Butyl Rubber is a copolymer of isobutylene and isoprene. It has outstanding resistance to gases, vapors, heat aging, oxygen, ozone, sunlight, tearing, alkalis, and acids. Butyl has good flex and low resilience properties, making it ideal for vibration damping, insulation, and shock absorption. It also offers moderate resistance to abrasion and compression set. Butyl rubber is resistant to most inorganic products and is highly resistant to mineral acids, alkaline and aqueous acids.
