Executive Summary Riverina Water County Council requires Pest Control services to ensure safe and healthy working environment for its employees and contractors for all of its buildings and facilities. In addition, Riverina Water requires pest management services as part of its water quality management systems to manage risks that may affect water quality.

The following Specification addresses Pest Control requirements for Riverina Water’s operation for a period of 5 years from 2018-2023.

1 Description of Riverina Water County Council’s Operations

1.1 Wagga Wagga City Water is sourced in Wagga Wagga from:

A) Murrumbidgee River intake at 91 Hammond Avenue

B) East Wagga Wagga borefield (Kooringal Road)

C) West Wagga Wagga borefield (McNickle Road to Moorong Street)

D) North Wagga Wagga borefield (East Street)

Raw water is treated at 4 principle water treatment plants located at the Hammond Avenue Waterworks and Aeration plants, and West & North Wagga Wagga treatment plants.

Pumping Stations at eight Wagga Wagga locations together with a network of rising mains transfer the water to eighteen reservoirs, on three different levels, to provide storage and pressure needed for the different elevations within Wagga Wagga as well as the surrounding area outside Wagga Wagga including Ladysmith, Brucedale and The Gap rural areas, and the township of Currawarna..

Reticulation water mains extend to cover the entire urban area providing water for industry, residential, commercial, recreation and emergency fire fighting needs.

1.2 Township & Rural Water from the Wagga Wagga sources, is also pumped into Willans Hill rural reservoir (to be relocated to Dunns Road in 2018/19) and gravitates down the southern trunk main that extends to Walla Walla. The southern trunk main supplies townships including San Isadore, Kapooka, Uranquinty, The Rock, Mangoplah, Yerong Creek, Henty, Morven, Pleasant Hills and Walla Walla. A supplementary bore supply and treatment plant north of Walla Walla is used in the summer months. Note: The township of Culcairn is supplied with water by Greater Hume Shire Council.

The western trunk main extends from Bulgary to Oaklands and is sourced water from Bulgary borefield 30 km west of Wagga Wagga. The western trunk main supplies townships including Lockhart, Boree Creek, Urana & Oaklands. The Western trunk main is also supplemented in the summer months by surface water from Colombo Creek to Urana Filtration Plant via a raw water pipeline.

There are a number of smaller independent water treatment plants and supply systems that serve various townships throughout Riverina Water’s area of supply. These include: Morundah, Walbundrie-Rand, Woomargama, Holbrook, Humula, Tarcutta, Oura and Collingullie. Note: Holbrook is supplied by Ralvona borefield and is operated independently to the southern trunk main.

Groundwater is sourced and chlorinated for other villages with systems operating at Collingullie, Oura, Woomargama, and Humula.

A small quantity of water is purchased from Goldenfields Water County Council, to supply customers near to their trunk main between Gumly Gumly and Junee.

2 Pest Control Services

2.1 Description of Contract This contract is for the provision of Pest Control Services comprising of 1) pest building inspections and 2) treatment of Council buildings and structures outlined in Section 8 for a period of 5 years from 2018 to 2023.

2.2 Treatment Details Each site is to be treated for termites and/or pests (i.e. spiders, cockroaches and rodents) at approximately 6 monthly intervals, including an annual building inspection for nominated sites outlined in this Specification.

Each Council building and structure listed in Section 8 is to be treated in accordance with the time frames stated.

2.3 Warranty Work Riverina Water County Council reserves the right to request the respraying of any or all Council buildings as a result of inadequate treatment and / or reinfestation during the warranty period.

A warranty service must be provided for:

six (6) month period for all internal treatment (at no cost to Council)

three to six months (3-6) month period for all external treatment (at no cost to Council) depending on weather conditions after treatment.

Any warranty work requested by Council in writing is to be investigated by the Contractor within seven (7) days of notification and if necessary, treated within fourteen (14) days of the Contractor’s inspection. The Contractor must submit a written report to Council within seven (7) days after treatment advising the results of the investigation and the treatment undertaken to remedy the complaint.

2.4 Applicant Suitability All applicants must hold a current licence as a Pest Control Operator in New South Wales.

2.5 Public Liability The contractor is to hold current Public Liability Insurance for twenty million dollars ($20,000,000.00) and produce sufficient documentation of the currency of this policy as part of the Tender submission – refer to Section 2.18 Insurances.

2.6 General Environmental Duty In accordance with the Environmental Protection Act 1994, the contractor has an obligation (“environmental duty”) to ensure that the operation of this contract and/or the business will not cause environmental nuisance or environmental harm.

2.7 Quoted Price Inclusion The price submitted on the attached Schedule A Forms is deemed to be inclusive of all the Contractor’s costs, including but not limited to labour, materials and travel expenses. The price submitted on the attached Schedule A Forms is for the per annum price for each treatment and is deemed to be inclusive of GST.

2.8 Commencement of Treatment The Contractor must be able to perform the treatment of all buildings and structures in the following timeframes:

2.9 Payment Payment will be based on pro-rata of treated sites listed in Schedule A with respect to accepted quoted annual price, and will be paid upon submission of the following:

1. An invoice;

2. Completed service reports for each treated site after each treatment. Refer to Section 2.14- Submission of Building Inspection & Pest Control Reports

Riverina Water County Council reserves the right to withhold money from the Contractor’s invoiced amount equal to any outstanding penalties Council believes has occurred as defined in the penalty clause of this specification (Section 2.10 - Penalties), or if completed service report(s) of the treated sites have not been submitted.

Payments will be made within 14 days of receiving the above-mentioned documents.

2.10 Penalties The following penalty clauses will apply to this contract:

The Contractor is required to contact the following persons by phoning (during business hours) the appropriate numbers below to pre-arrange a time of treatment so not interfere with the day-to-day operations of any person working or living within that building - Refer to Appendix A for the descriptions of buildings and structures for each of the following areas:

2.12 Sufficiency of Quotation Submission The applicant shall be deemed to be satisfied before tendering as to the correctness and sufficiency of his quotation for the works which shall cover his obligations under his contract and all things necessary for the proper completion and maintenance of the works.

2.13 Chemicals The applicant shall indicate the chemicals to be used in protecting the properties from termites, spiders, wasps, ants, cockroaches, rabbits etc.

The applicant also shall provide Council with copies of SDS for each chemical used and the handling procedure for mixing and application including personal protection equipment used. The SDS’s are to be in accordance with Schedule 7of the NSW Work and Safety Regulation 2011.

2.14 Submission of Building Inspection & Pest Control Reports Upon completion of treatment for each site, the Contractor is to provide the following written reports:

1. Annual Building Pest Inspection Reports (if required);

2. Pest Control Visitation Report for each site indicating the following:

o Date & Time;

o Licensed Contractors name, signature and License Number;

o Site Name & Location Code;

o Type and quantities of baits deployed with identification of Batch Numbers or Serial Numbers;

o Indication or extent of how much bait has been consumed;

2.15 Plant and Equipment The Contractor will be responsible for providing his/her own vehicle, including all associated running costs, i.e.; fuel, oil, registration, wear and tear, etc.

2.16 Access to Properties

A restricted security key will be issued to the successful applicant to freely access all sites outlined in this Specification, except for the following premises that require:

1. Deactivation /reactivation of electronic security alarms:

Administration/Engineering Building, Wagga Wagga

Waterworks Treatment Plant, Wagga Wagga

Depot Building, Wagga Wagga

The Rock Depot, The Rock

Or

2. Fluoride Rooms - Restricted Areas (not to be treated unless in the presence of a person with Fluoride Certificate issued by the NSW Public Health Department). Fluoride batching plant rooms are located at:

Waterworks Treatment Plant, Wagga Wagga

West Wagga Aeration Plant, Wagga Wagga

North Wagga Aeration Plant, Wagga Wagga

Urana Water Treatment Plant, Urana

Bulgary Aeration Treatment Plant

Gardiner’s Crossing Treatment Plant, Culcairn

The above-mentioned properties require co-ordination with Council as outlined in Section 2.11 Communication with Council.

2.17 Work Health & Safety All site workers must produce the following cards/documents prior to commencement on site:-

• Current WHS General Induction for Construction Work in NSW – WHS Construction Induction Training Certificate (White Card) or an acceptable certificate issued from another Australian State

• Current Operator’s Permits/Licences

All moving plant must be operated in accordance with the “Code of Practice for Moving Plant on a Construction Site 2004” published by WorkCover. The owner of plant and equipment will induct (or arrange for the induction of) operators onto each piece of plant and equipment. Plant and equipment inductions will cover plant and equipment risk assessments. The Contractor is to provide Riverina Water with copies of Safe Work Method Statements associated with work being undertaken before commencing work.

Whenever, by any legislation, the Contractor’s site workers are required to be registered or licensed or to hold any permit or certificate or exemption certificate or other qualification, the Contractor shall at his expense ensure that the legislation is complied with and proof thereof produced prior to the commencement of work.

All Pesticides must be used in compliance with the NSW Code of Practice Safe Use of Pesticides including Herbicides in Non-Agricultural Workplaces 2006.

The Contractor shall comply with Council’s “Induction Handbook & Safety Regulations for Contractors 2017 (Version 3.15)” and shall provide, at the Contractors own cost, protective clothing and equipment as necessary to satisfy Council’s requirements for safety in the workplace.

2.17.1 Successful Applicant Inductions Requirements (Compulsory)

A formal contractor and safety inductions are required before commencement of work, including familiarisation with Council’s “Induction Handbook & Safety Regulations for Contractors 2017 (Version 3.15)” and familiarisation of Council’s ‘Statement of Business Ethics’ (Policy Number 1.4).

The successful applicant (and their staff) is/are to be inducted to each site listed in Section 8.2 prior to commencement of the Contract. This will be arranged over three days by Riverina Water County Council at mutually agreeable times together with provision of transport (if required).

The successful applicant is to provide safe working method statements to undertake work outlined in this Specification to the satisfaction of Council in order to demonstrate compliance with WHS Act and Regulations

2.18 Insurances & Licences The Contractor shall take out the following Insurance Policy/Policies as necessary:-

A Pest Management Technician Licence endorsed by WorkCover New South Wales or NSW EPA

A Motor Vehicle Policy for mechanically propelled plant and trailers to be used for the purpose of carrying out the contract.

A Public Liability Policy insuring against accidental death or bodily injury to any person or damage to property arising out of and caused by the negligence of the insured or by any persons for whose negligence the insured are or could become legally liable in the course of the provision of the Trade Service with a limit of indemnity of not less than $20,000,000.

A Workers Compensation Policy pursuant to the Workers Compensation Act 1987, updated 2003 and any act amending that Act.

Applicants should refer to Section 127 of the Industrial Relations Act 1996:B127 Liability of principal contractor for remuneration payable to employees of subcontractor

(1) Application (This section applies where)

(a) a person (the principal contractor) has entered into a contract for the carrying out of work by another person (the subcontractor), and

(b) employees of that subcontractor are engaged in carrying out the work (the relevant employees), and (c) the work is carried out in connection with a business undertaking of the principal contractor.

(2) Liability of principal contractor

The principal contractor is liable for the payment of any remuneration of the relevant employees that has not been paid for work done in connection with the contract during any period of the contract unless the principal contractor has a written statement given by the subcontractor under this section for that period of the contract.

Plant items under a policy of insurance pursuant to the Motor Accidents Act 1988, updated 2002 (Compulsory Third Party Insurance) whether the item is registered or not.

Where any insurance policy bears any reference to an excess, such excess shall be borne solely by the Contractor.

If successful, the applicant will provide reasonable evidence of all insurance policies referred to in this clause prior to commencing work with Riverina Water County Council

Unregistered plant will not be accepted unless being operated exclusively within private property and prior approval from Riverina Water County has been obtained.

2.19 Annual Cost Variances during Contract Period The Contractor may elect to revise annual quotations to cater for increases in Consumer Price Index (CPI).

Note: Proposed increases greater than the CPI must be justified and supported by evidence such as invoices from suppliers showing increased cost of chemicals, fuel, labour etc.

2.20 Additional Unspecified work Additional pest control work may be incorporated into the Schedule A based on mutual agreement and demonstrating:

best economic value for Council;

maintaining public and employee safety interests;

maintaining water supply services, including water quality.

Please note that additional purchases and services by Council are to be in accordance to Council’s “Procurement and Disposal Policy” (Policy Number 1.19).

2.21 Early Termination of Agreement Either party may elect to terminate this agreement based on convenience subject to:

Riverina Water must give the Contractor at least 12 months’ notice in writing

The Contactor must give Riverina Water at least 3 months’ notice in writing

In addition, early termination of this agreement may also arise based on:

Either party not fulfilling obligations and requirements within this Agreement, including work non-conformances and agreed performance standards

Unlawful acts and omissions

Breach Council’s ‘Statement of Business Ethics’

Inappropriate/unauthorised use of Council’s physical assets and information outside the scope of this Agreement

Failure to notify either party of significant changes to their organisation that may affect the performance and operation of work

3 Quotation Submission Process 1. Quotations shall be submitted using the attached formal quotation documents outlined in

Section 0 (Electronic copies are available upon request).

2. Options for submission of quotations:

a) Quotations may be placed in a sealed envelope clearly labelled “Quote – Pest Control Services Contract W127” and personally delivered into the Tender Box at Riverina Water, 91 Hammond Ave, Wagga Wagga

b) Quotations may be posted to:-

Tender Box Riverina Water County Council P.O. Box 456 WAGGA WAGGA NSW 2650

c) Emailed Quotations may be accepted subject to:-

a. Emailed copy sent to: [email protected] with the subject title “Quote – Pest Control Services Contract W127”;

b. Submitted to Riverina Water before the closing date.

3. Applicants shall submit all other requisite information outlined in Section 0 as part of their quotations.

4. Quotation submissions close at 12pm, Tuesday 12 June, 2018. No quotations will be accepted after this time.

5. Advice of the successful quotation will be provided after the Council meeting on 27th June 2018.
