When we inspected the property, the weather was cold, wet and heavily overcast.

The property was occupied, furnished and carpeted. We were let into the property by the owners’ mother and we could not ask pertinent questions relating to such matters as maintenance history of the services and availability of guarantees. The mains services were turned on.

About the inspection (continued)

We inspect the inside and outside of the main building and all permanent outbuildings, but we do not force or open up the fabric. We also inspect the parts of the electricity, gas/oil, water, heating and drainage services that can be seen, but we do not test them.

To help describe the condition of the home, we give condition ratings to the main parts (the ‘elements’) of the building, garage and some parts outside. Some elements can be made up of several different parts.

In the element boxes in parts E, F, G and H, we describe the part that has the worst condition rating first and then briefly outline the condition of the other parts. The condition ratings are described as follows.

Defects that are serious and/or need to be repaired, replaced or investigated urgently.

Defects that need repairing or replacing but are not considered to be either serious or urgent. The property must be maintained in the normal way.

No repair is currently needed. The property must be maintained in the normal way.

Not inspected (see ‘Important note’ below).

The report covers matters that, in the surveyor’s opinion, need to be dealt with or may affect the value of the property.

Important note: We carry out only a visual inspection. This means that we do not take up carpets, floor

coverings or floorboards, move furniture or remove the contents of cupboards. Also, we do not remove secured panels or undo electrical fittings.

We inspect roofs, chimneys and other surfaces on the outside of the building from ground level and, if necessary, from neighbouring public property and with the help of binoculars.

We inspect the roof structure from inside the roof space if there is access (although we do not move or lift insulation material, stored goods or other contents). We examine floor surfaces and under-floor spaces so far as there is safe access to these (although we do not move or lift furniture, floor coverings or other contents). We are not able to assess the condition of the inside of any chimney, boiler or other flues.

We note in our report if we are not able to check any parts of the property that the inspection would normally cover. If we are concerned about these parts, the report will tell you about any further investigations that are needed.

We do not report on the cost of any work to put right defects or make recommendations on how these repairs should be carried out. Some maintenance and repairs we suggest may be expensive.

Overall opinion and summary of the condition ratings

This section provides our overall opinion of the property, and summarises the condition ratings of the different elements of the property.

If an element is made up of a number of different parts (for example, a pitched roof to the main building and a flat roof to an extension), only the part in the worst condition is shown here.

To make sure you get a balanced impression of the property, we strongly recommend that you read all sections of the report, in particular the ‘What to do now’ section.

Our overall opinion of the property

The property is considered to be a reasonable purchase although there are a number of defects which require immediate attention and which will require some expenditure at the outset. We would not expect any particular difficulty on resale in normal market conditions, provided that the necessary works are carried out to a satisfactory standard. You should investigate the cost of these works prior to a commitment to purchase. Once known, you may wish to re-negotiate the purchase price to reflect them.

It is very important that you read this report as a whole. In the main body of the report, we will notify you of the actions that will be required prior to exchange of contracts. Where we have given elements a Condition Rating of 2 or 3, we particularly refer you to the section at the end of the report entitled ‘What to do now’. You must make sure that you have all of the repairs needed investigated by reputable contractors so that you are fully aware of their scope and financial implications before you purchase.

Local environment

According to the online Environment Agency web-site, the property is not in an area at risk from flooding by river or sea. The property is located in a former coal mining area. A copy of the coal mining report should be obtained to confirm the extent of any potential risk. Our report and valuation assume that the result of this mining report will be satisfactory. This survey does not cover potential issues arising from historic land uses or localised underground geological conditions.

Outside the property

Limitations to inspection

The external inspection of the building was limited to those parts that could be seen from ground level within the boundaries of the property and from accessible public areas only. As a result, where Condition Ratings have been provided these may be based on our limited inspection.

In accordance with the RICS instructions governing provision of the HomeBuyer service only a random sample of windows were opened. It is possible, therefore, that defects may exist with those windows not opened.

E1 Chimney stacks

The property has an external chimney breast but no chimney stack. The ventilating tile forming part of the ridge is no longer in use. The metal flue terminal would appear to be in serviceable condition but please refer to our comments in Section F5 in respect of the flues.

E2 Roof coverings

The main roof is pitched and covered with concrete tiles. The ridge tile pointing is falling out and needs to be renewed. The roof pitches are straight and have not been affected by structural movement. The roof coverings are in satisfactory condition. Normal maintenance will be required It was wet at the time of inspection and we found no evidence of rainwater penetration. Roofing underfelt can become brittle with age, particularly when exposed to sunlight, rainwater and wind action. Deterioration often occurs at the bottom of the roof and at the edges where the lining is more exposed. In this case, the felt behind the gutters is inaccessible and we cannot describe its condition.

The gable verge would appear to be set on cement based boards probably containing asbestos fibres. To the rear pitch, sections of boarding would appear to be loose and in danger of falling from the roof. We recommend that these boards are re-laid and the verge as a whole is repointed. This will require scaffolding and will be a costly exercise, possibly requiring the use of a specialist contractor trained to deal with materials containing asbestos. E3 Rainwater pipes and gutters

The property has plastic gutters and downpipes. These appear to be in generally serviceable condition with no evidence of significant defects. Normal ongoing maintenance will be required. The gutter joint above the front double window is out of line and will need to be re-fitted if it the joint opens and it starts to leak.

E4 Main walls

The property dates from around 1985. The construction of the walls is traditional

in cavity brickwork roughly 275 mm thick. Alterations to the door and window openings have been made since the property was built. There has been no material deterioration of the brickwork and pointing. At the top of the chimney breast, the bricks have started to weather and attention to pointing will be required in the near future. The structural condition of the walls appears to be generally satisfactory. We found no evidence of significant cracking, subsidence or structural movement. There are fine cracks in the main walls apparently caused by initial settlement. These are limited in extent and would not appear to have been caused by ground movement such as subsidence. We consider that they can be accepted as a characteristic of the property’s age, construction and location and that specialist further investigation is not required. There is no evidence to indicate that cavity wall insulation has been installed. Where walls are tile hung, it is not possible to comment specifically on the condition of the construction beneath. The tile hung areas are in generally good condition but there is one slipped tile which needs to be repaired. The flashings sealing the tiles to the windows are in serviceable condition. The property was built with a damp proof course which is still exposed in the outside walls at a satisfactory height above the finished ground level.

We found no evidence of significant rising dampness at the time of inspection. To the side of the property, there is no door on the cable box and the internal block wall is exposed to the elements. A new door or other form of weatherproof covering must be fitted immediately. To the rear of the house, a disused drain pipe hole needs to be bricked up.

E5 Windows

The property has UPVC framed double glazed windows. They are not original and are likely to be in the region of 10 years old. The frames are in generally satisfactory condition. The quality of double glazed window panes varies. Whilst none would appear to be defective at present, no assurance can be given over their long-term durability. The sealant to some of the windows has failed and should be renewed to prevent water penetration between the frames and the walls. There is one potential fire escape from the windows to the upper floor. We recommend that you check that your tenants are physically capable of getting out of this window. If not, at least one building regulations compliant fire escape window should be installed. Your legal adviser should confirm that a FENSA Certificate or suitable alternative is available otherwise the installation may not comply with the Building Regulations.

E6 Outside doors (including patio doors)

The property has a mixture of wood and UPVC framed double glazed doors. They are not original and are likely to be in the region of 10 years old or less in the case of the French door. There is no evidence of decay in the window frame attached to the front door and it does not need to be replaced on the grounds of condition alone. The doors are in generally satisfactory condition and are well sealed to the brickwork. The quality of double glazed window panes varies. Whilst none would appear to be defective at present, no assurance can be given over their long-term durability. Your legal adviser should confirm that a FENSA Certificate or suitable alternative is available otherwise the installation may not comply with the Building Regulations.

The door window is poorly painted. External redecoration is required immediately to protect the woodwork. Periodic redecoration will be required thereafter.

E7 Conservatory and porches

Not applicable.

E8 Other joinery and finishes

These comprise UPVC clad facia boards. These appear to be in generally satisfactory condition. Normal maintenance will be required. UPVC fascia’s are often fitted over wood or asbestos cement boarding. If this is the case in this instance, we cannot describe the construction or condition of the concealed fittings.

E9 Other

These comprise a metal and UPVC door canopy and a brick column between the pair of front doors. The canopy appears to be in generally satisfactory condition. Normal maintenance will be required. The brick column is not visibly tied in. It would appear to be secure but the vertical joint needs to be repointed.

Inside the property

Limitations to inspection

In the roof void, there is no secure flooring and our inspection was therefore made from above the loft hatch. The floors were concealed by furnishings and a variety of floor coverings and could not be inspected. The under-stair cupboard was full of personal belongings and could not be inspected. Where the walls were concealed by the fitted kitchen, they could not be inspected and tested for dampness. Where the walls were concealed by furnishings and radiators, they could not be inspected and tested for dampness. The bathroom fittings were visually inspected but were not tested. The kitchen units, sink and appliances were visually inspected but were not tested. The fireplace was visually inspected but was not tested. The flues were not inspected and were not tested. The condition of the flues and flue liners cannot be described.

F1 Roof structure

Access to the roof void is from the landing. The roof structure is constructed with pre-formed trussed rafters. The timbers are tightly jointed and there is no evidence of serious physical distress. One of the rafters to the front pitch has warped slightly. This would not appear to be serious and improved bracing should be sufficient to maintain structural integrity.

The trussed rafters are braced to a degree but this falls well short of current building standards. We recommend that you obtain an estimate from a roofing contractor to install additional bracing and strapping before you exchange contracts. The underfelt beneath the tiles is in generally good condition but there is one hole to the rear pitch which needs to be patched. There are no indications of rain penetration through the roof covering. The party wall is built up fully to the roof covering. There are no timber defects in the structural timbers we could examine at close quarters. The ceilings are insulated to an average depth of 50 mm or less. This provision falls well below current standards. We recommend that new insulation is installed to provide a level thickness of 200mm over the entire ceiling area taking care not to cover power cables and spotlights. The roof space is not visibly ventilated from the eaves but the open former ducted air heating flue is open and there is no evidence of condensation.

F2 Ceilings

The ceilings are made of plasterboard. They are in generally satisfactory condition although there are fine cracks which should be filled when you re-decorate. A textured finish has been applied, visible to all of the ceilings apart from the living room, kitchen and bathroom. In these rooms, it may also be present but concealed. It is now known that such finishes may contain low levels of asbestos. These appear to be in satisfactory condition at present and should present no health risk if undisturbed. However, they should not be cut or worked in any way and specialist advice must be sought if they are to be removed as this could be costly.

F3 Walls and partitions

The outside walls are wet plastered onto the external brick and blockwork. The inside walls are made of a mixture of lightweight timber and masonry. The walls are in generally satisfactory condition with no serious plaster defects or evidence of structural movement. A partition may have been removed from the kitchen. Based upon the layout of the first-floor floor joists, this is unlikely to have been a load-bearing structure.

We examined the main walls and partitions with a damp meter and found no evidence of dampness.

F4 Floors

The floors are made from a mixture of concrete and timber. The floors were concealed and they could not be inspected. Where the floors were concealed, they could not be inspected other than to identify the direction of the joists. Having regard to the age of the house, the concrete flooring is likely to contain an integral damp proof membrane. The ground floor is level and there has been no transfer of dampness from the ground into the partitions. Houses of this age were sometimes built with colliery shale as the fill material underneath concrete floors and underneath the oversite concrete in timber floors. Over the years, the shale can react with the chemicals in the concrete causing the concrete to heave, a process known as sulphate attack. The common symptoms of this defect are lifting of floor structures and lateral outward movement of brickwork below the damp proof course. These symptoms are not apparent in this case. If you would like to establish the level of sulphates in the concrete as a precautionary measure, tests are commercially available from analytical laboratories. Having regard to the property’s age, it would not be unusual for there to be plastic tiles containing asbestos fibres underneath the modern floor coverings. If so, provided they are in satisfactory condition, they do not pose a material health hazard. They should not however be cut or worked in any way without taking specialist advice from a suitable contractor. Further advice is available from the Health & Safety Executive - https://www.gov.uk/search?q=asbestos The timber floors were found to be in generally satisfactory condition with no evidence of significant deflection or distortion. The floorboards have been cut and lifted to facilitate modernisation of the heating system. In places, they creak when being walked upon.

F5 Fireplaces, chimney breasts and flues

The property was built with an external chimney breast containing two flues, one for the fireplace in the living room and one redundant. Without testing the appliance, we cannot confirm whether the living room fire is vented through the Powerflue in the chimney breast or the roof terminal connected to a metal tubular flue in the wall and roof void. This must be established before the property is let.

Because the owner was not present, we cannot advise you whether it has been serviced within the last 12 months, nor whether it is properly fitted and ventilated. We recommend that it is checked by a qualified contractor prior to exchange of contracts. A landlord gas certificate will be required before the property is let and we advise that one is commissioned before you exchange contracts.

F6 Built-in fittings (e.g. built-in kitchen and other fittings, not including appliances)

The kitchen units appear to be adequately presented and generally satisfactory, subject to normal wear and tear. No doubt you have already assessed the adequacy of these, and other built-in fitments, for your own purposes. Some of the doors need to be re-hung, there are no tiles to protect the walls and the appliances are heavily soiled.

F7 Woodwork (e.g. staircase and joinery)

The internal doors, frames, skirting boards, stairs etc are adequately presented, subject to some general wear and tear. The staircase construction is largely concealed but the treads seem reasonably firm and in the absence of any obvious significant movement, no serious defects are suspected.

There are no visible British Standard marks on the internal door windows or the fan lights above the doors. This suggests that it is not safety glass and does not meet current safety standards. The glass should be checked and replaced if necessary.

The gaps between the landing stair rails are 180mm wide. This is a hazard, especially to small children. New rails should be fitted to reduce the clearance to no more than 100 mm.

The internal decorations are generally satisfactory, although you should allow for some marking to be revealed when the present owners remove their fixtures and fittings, and that some localised redecoration will be required. We expect that you have assessed the adequacy of decorations for your own purposes.

Given the age of the property some paint may contain lead. Removal of lead based paint can pose a health risk unless correct procedures are followed. Urgent action is not required, but before paint is removed advice should be obtained from the Health and Safety Executive - https://www.gov.uk/search?q=lead+paint.

F8 Bathroom and kitchen fittings

The sanitary fittings appear in generally reasonable and serviceable condition. No doubt you have already assessed their adequacy for your own purposes.

Condensation Condensation is frequently a lifestyle issue and care should be taken to avoid activities that can contribute to the problem such as drying clothes indoors. The control of condensation can be difficult and requires maintaining a careful balance between heating, insulation and ventilation. Alarms We recommend that mains powered smoke and heat alarms, and carbon monoxide detectors are fitted, as there are none currently installed. Asbestos In a property of this age asbestos based components are likely to have been used in many areas, some of which are hidden within the structure. This should be borne in mind when undertaking any works to the property. Should asbestos based materials be found then they may need to be dealt with by specialist contractors and this could prove expensive. Services

Services are generally hidden within the construction of the property. This means that we can only inspect the visible parts of the available services, and we do not carry out specialist tests. The visual inspection cannot assess the services to make sure they work efficiently and safely, or meet modern standards.

Limitations to inspection

The services were not tested and our comments are based on a visual inspection of the exposed elements. Where cables, pipes and internal components are concealed, no comment on their condition can be made.

We could not lift all of the drainage inspection covers because the rear garden cover is brick filled and too heavy to lift.

G1 Electricity Safety warning: The Electrical Safety Council recommends that you

should get a registered electrician to check the property and its electrical fittings and that a periodic inspection and testing is carried out at the following times: for tenanted properties every 5 years or at each change of occupancy, whichever is sooner; at least every 10 years for an owner-occupied home. All electrical installation work undertaken after 1 January 2005 should have appropriate certification. For more advice contact the Electrical Safety Council.

Mains electricity is connected with the meter located in the external cupboard and the fuse box in the internal living room cupboard. There is no test certificate on the fuse box and so far, as we could establish, the installation has not been tested in recent years. Deficiencies within the electrical installation were noted during our inspection and the installation is unlikely to comply with modern regulations. As examples of this the fuse box is original with no modern safety devices, there are loose sockets and there is limited earth bonding . We recommend that the installation is checked by an appropriately qualified specialist contractor, registered with either NICEIC or similar approved body, to carry out a full investigation of the system prior to exchange of contracts to establish the full extent of the upgrading or replacement required.

G2 Gas/oil Safety warning: All gas and oil appliances and equipment should regularly be inspected, tested, maintained and

serviced by an appropriately qualified Gas Safe Engineer or Registered Heating Engineer and in line with the manufacturer’s instructions. For tenanted properties by law a 12 monthly gas safety check must be carried out on every gas appliance/flue. A gas safety check will make sure gas fittings and appliances are safe to use. This is important to make sure that the equipment is working correctly, to limit the risk of fire and carbon monoxide poisoning and to prevent carbon dioxide and other greenhouse gases from leaking into the air. For more advice contact the Gas Safe Register for gas installations, and OFTEC for oil installations.

Mains gas supply is connected, with a meter located in the external cupboard. Domestic gas installations should be checked annually. We were accompanied by the owner’s mother who knew nothing about service history and we cannot advise you whether the installation has been checked within the last twelve months. On this basis, We cannot confirm that it is safe and compliant with current regulations and we recommend that the installation is checked by an appropriate specialist registered with Gas Safe prior to exchange. We will revise our rating to one upon production of a valid test certificate.

G3 Water

Mains water is supplied. The external stop valve could not be located and you

should make enquiries of the local water ascertain its location.

We were unable to locate an internal stop valve and further enquiries of the

seller are recommended. If one does not exist, you should arrange for one to

be fitted. It is not in the sink cupboard where we would normally expect to find

it.

The supply pipes, where visible, are in generally satisfactory condition and no

leaks or other serious defects were noted. However, much of the pipework is

concealed and it is therefore possible that defects could exist in unseen areas.

G4 Heating

The property has a conventional gas fired central heating system with a boiler which feeds a series of radiators in the various rooms. Please refer to our comments in Section G2 in respect of service history and testing. We will change our condition rating to one upon production of a valid test certificate. Whilst apparently serviceable, you should now arrange for a Gas Safe engineer to check and test the system prior to exchange of contracts as a matter of safety. Some of the heating pipes would appear to be bedded in the concrete floors. Unprotected pipes can be attacked by corrosive chemicals in the concrete causing the pipes to leak. We could not check the pipes and advise as a precautionary measure that they are exposed and checked by a plumber or you budget to have the pipes re-plumbed above floor level.

Hot water is provided by the main combination boiler. See our comments in Section G4 above.

G6 Drainage

The waste pipes are enclosed within the building structure and are not visible. Within the house, we identified no dampness and have no reason to suspect that they are not watertight. The drain pipes are made of clay. We could examine the inspection chamber to the front of the house and found the drain to be clean and apparently in serviceable condition. We could not inspect the rear garden chamber because the cover contains brick paviours and is too heavy to lift. We advise that you check it before you exchange contracts.

The drainage installation is likely to be used in common with other houses in the estate prior to entering the public sewer.

Limitations to inspection

We were unable to inspect the inside of the garage, the back wall of the garage and the garden retaining wall concealed by the garage.

Due to the time of year, invasive plants such as Japanese Knotweed may be present but not visible.

The property has a single detached garage constructed in brick under a flat, felt covered roof. The garage is generally in serviceable condition although normal maintenance will be required. The roofing felt is fairly modern but the roof ponds rainwater close to the door and this could lead to early failure. You should ensure that your electrician checks the garage wiring as part of the overall system inspection. Flat roofs are known to have a limited life span. You should anticipate on-going repair and periodic renewal. You should check and upgrade the supporting structure at this time. We recommend that you check the inside of the garage before you exchange contracts.

The boundary walls need to be overhauled. There are weathered and missing bricks which need to be repaired. The side boundary fence in the rear garden is slightly loose and in need of attention. The missing handrail dividing the common steps to the front door should be reinstated. The cement benching around the front drainage inspection chamber needs to be made good. It is a trip hazard. The block paving has settled unevenly, especially around the rear inspection chamber. It should be re-laid where uneven. It is a trip hazard. We saw no sign of invasive species such as Japanese Knotweed in the garden. This survey does not extend to adjoining land and we cannot therefore confirm whether invasive plants such as Japanese Knotweed are present beyond the property. At this time of year invasive weeds such as Japanese Knotweed die back and are very difficult to identify. We cannot therefore confirm that the garden is free from invasive species of this type.

• there is no contamination in or from the ground, and the ground has not been used as landfill

• the property is connected to, and has the right to use, the mains services mentioned in the report; and

With regard to legal matters I have assumed that:

• the property is sold with ‘vacant possession’ (your legal advisers can give you more information on this term)

• the condition of the property, or the purpose the property is or will be used for, does not break any laws

• no particularly troublesome or unusual restrictions apply to the property, that the property is not affected by problems which would be revealed by the usual legal inquiries and that all necessary planning permissions and Building Regulations consents (including consents for alterations) have been obtained and complied with; and

• the property has the right to use the mains services on normal terms, and that the sewers, mains services and roads giving access to the property have been ‘adopted’ (that is, they are under local-authority, not private, control).

Any additional assumptions relating to the valuation

We have arrived at our opinion of value using the comparative method.

We have considered sales evidence relating to property of a generally similar nature sold in the current market conditions and adjusted to reflect such matters as detachment, size, condition and location etc.

The evidence supports a valuation range from £115,000 to £120,000.

The agreed purchase price is just below this range and supported by the evidence.

What to do now Getting quotations

The cost of repairs may influence the amount you are prepared to pay for the property. Before you make a legal commitment to buy the property, you should get reports and quotations for all the repairs and further investigations the surveyor may have identified.

You should get at least two quotations from experienced contractors who are properly insured. You should also:

• ask them for references from people they have worked for;

• describe in writing exactly what you will want them to do; and

• get the contractors to put the quotations in writing.

Some repairs will need contractors with specialist skills and who are members of regulated organisations (for example, electricians, gas engineers, plumbers and so on). Some work may also need you to get Building Regulations permission or planning permission from your local authority.

Further investigations

If the surveyor is concerned about the condition of a hidden part of the building, could only see part of a defect or does not have the specialist knowledge to assess part of the property fully, the surveyor may have recommended that further investigations should be carried out to discover the true extent of the problem.

Who you should use for these further investigations

You should ask an appropriately qualified person, though it is not possible to tell you which one. Specialists belonging to different types of organisations will be able to do this. For example, qualified electricians can belong to five different government-approved schemes. If you want further advice, please contact the surveyor.

What the further investigations will involve

This will depend on the type of problem, but to do this properly, parts of the home may have to be disturbed and so you should discuss this matter with the current owner. In some cases, the cost of investigation may be high.

When to do the work

The condition ratings help describe the urgency of the repair and replacement work. The following summary may help you decide when to do the work.

• Condition rating 2 – repairs should be done soon. Exactly when will depend on the type of problem, but it usually does not

have to be done right away. Many repairs could wait weeks or months, giving you time to organise suitable reports and quotations.

• Condition rating 3 – repairs should be done as soon as possible. The speed of your response will depend on the nature of the

problem. For example, repairs to a badly leaking roof or a dangerous gas boiler need to be carried out within a matter of hours, while other less important critical repairs could wait for a few days.

Warning

Although repairs of elements with a condition rating 2 are not considered urgent, if they are not addressed they may develop into defects needing more serious repairs. Flat roofs and gutters are typical examples. These can quickly get worse without warning and result in serious leaks.

As a result, you should regularly check elements with a condition rating 2 to make sure they are not getting worse.

Description of the RICS HomeBuyer (Survey & Valuation) Service The service

The RICS HomeBuyer (Survey & Valuation) Service includes:

• an inspection of the property (see ‘The inspection’)

• a report based on the inspection (see ‘The report’); and

• a valuation, which is part of the report (see ‘The Valuation’)

The surveyor who provides the RICS HomeBuyer (Survey & Valuation) Service aims to give you professional advice to help you to:

• make an informed decision on whether to go ahead with buying the property

• make an informed decision on what is a reasonable price to pay for the property

• take account of any repairs or replacements the property needs; and

• consider what further advice you should take before committing to purchase the property.

The inspection

The surveyor inspects the inside and outside of the main building and all permanent outbuildings, but does not force or open up the fabric. This means that the surveyor does not take up carpets, floor coverings or floorboards, move furniture, remove the contents of cupboards, roof spaces, etc., remove secured panels and/or hatches or undo electrical fittings.

If necessary, the surveyor carries out parts of the inspection when standing at ground level from public property next door where accessible.

The surveyor may use equipment such as a damp-meter, binoculars and torch, and may use a ladder for flat roofs and for hatches no more than 3 metres above level ground (outside) or floor surfaces (inside) if it is safe to do so.

Services to the property

Services are generally hidden within the construction of the property. This means that only the visible parts of the available services can be inspected, and the surveyor does not carry out specialist tests. The visual inspection cannot assess the efficiency or safety of electrical, gas or other energy sources; plumbing, heating or drainage installations (or whether they meet current regulations); or the inside condition of any chimney, boiler or other flue.

Outside the property

The surveyor inspects the condition of boundary walls, fences, permanent outbuildings and areas in common (shared) use. To inspect these areas, the surveyor walks around the grounds and any neighbouring public property where access can be obtained.

Buildings with swimming pools and sports facilities are also treated as permanent outbuildings, but the surveyor does not report on the leisure facilities, such as the pool itself and its equipment, landscaping and other facilities (for example, tennis courts and temporary outbuildings).

Flats

When inspecting flats, the surveyor assesses the general condition of outside surfaces of the building, as well as its access areas (for example, shared hallways and staircases). The surveyor inspects roof spaces only if they are accessible from within the property. The surveyor does not inspect drains, lifts, fire alarms and security systems.

Dangerous materials, contamination and environmental issues

The surveyor does not make any enquiries about contamination or other environmental dangers. However, if the surveyor suspects a problem, he or she should recommend a further investigation.

The surveyor may assume that no harmful or dangerous materials have been used in the construction, and does not have a duty to justify making this assumption. However, if the inspection shows that these materials have been used, the surveyor must report this and ask for further instructions.

The surveyor does not carry out an asbestos inspection and does not act as an asbestos inspector when inspecting properties that may fall within the Control of Asbestos Regulations 2012. With flats, the surveyor assumes that there is a ‘dutyholder’ (as defined in the regulations), and that in place are an asbestos register and an effective management plan which does not present a significant risk to health or need any immediate payment. The surveyor does not consult the dutyholder.

The report

The surveyor produces a report of the inspection for you to use, but cannot accept any liability if it is used by anyone else. If you decide not to act on the advice in the report, you do this at your own risk. The report focuses on matters that, in the surveyor’s opinion, may affect the value of the property if they are not addressed.

Condition ratings

The surveyor gives condition ratings to the main parts (the ‘elements’) of the main building, garage and some outside elements. The condition ratings are described as follows.

Condition rating 3 – defects that are serious and/or need to be repaired, replaced or investigated urgently.

Condition rating 2 – defects that need repairing or replacing but are not considered to be either serious or urgent. The property must be maintained in the normal way.

Condition rating 1 – no repair is currently needed. The property must be maintained in the normal way.

NI – not inspected.

The surveyor notes in the report if it was not possible to check any parts of the property that the inspection would normally cover. If the surveyor is concerned about these parts, the report tells you about any further investigations that are needed.

The surveyor does not report on the cost of any work to put right defects or make recommendations on how these repairs should be carried out. However, there is general advice in the ‘What to do now’ section at the end of the report.

Energy

The surveyor has not prepared the Energy Performance Certificate (EPC) as part of the RICS HomeBuyer Service for the property. If the surveyor has seen the current EPC, he or she will present the energy-efficiency and environmental impact ratings in this report. The surveyor does not check the ratings and cannot comment on their accuracy.

Issues for legal advisers

The surveyor does not act as ‘the legal adviser’ and does not comment on any legal documents. If, during the inspection, the surveyor identifies issues that your legal advisers may need to investigate further, the surveyor may refer to these in the report (for example, check whether there is a warranty covering replacement windows).

This report has been prepared by a surveyor (‘the Individual Surveyor’) merely in his or her capacity as an employee or agent of a firm or company or other business entity (‘the Company’). The report is the product of the Company, not of the Individual Surveyor. All of the statements and opinions contained in this report are expressed entirely on behalf of the Company, which accepts sole responsibility for these. For his or her part, the Individual Surveyor assumes no personal financial responsibility or liability in respect of the report and no reliance or inference to the contrary should be drawn.

Description (continued) In the case of sole practitioners, the surveyor may sign the report in his or her own name unless the surveyor operates as a sole trader limited liability company.

Nothing in this report excludes or limits liability for death or personal injury (including disease and impairment of mental condition) resulting from negligence.

Risks

This section summarises defects and issues that present a risk to the building or grounds, or a safety risk to people. These may have been reported and condition rated against more than one part of the property or may be of a more general nature, having existed for some time and which cannot reasonably be changed.

If the property is leasehold, the surveyor gives you general advice and details of questions you should ask your legal advisers.

The valuation

The surveyor gives an opinion on both the market value of the property and the reinstatement cost at the time of the inspection (see the ‘Reinstatement cost’ section).

Market value

‘Market value’ is the estimated amount for which an asset or liability should exchange on the valuation date between a willing buyer and a willing seller in an arm’s length transaction, after proper marketing wherein the parties had each acted knowledgeably, prudently and without compulsion’

When deciding on the Market Value, the surveyor also makes the following

assumptions.

The materials, construction, services, fixtures and fittings, and so on

The surveyor assumes that:

• an inspection of those parts that have not yet been inspected would not • identify significant defects • no dangerous or damaging materials or building techniques have been used in

the property • there is no contamination in or from the ground, and the ground has not been

used as landfill • the property is connected to, and has the right to use, the mains services

mentioned in the report and • the valuation does not take account of any furnishings, removable fittings and

sales incentives of any description.

Legal matters

The surveyor assumes that:

• the property is sold with ‘vacant possession’ (your legal advisers can give you more information on this term)

• the condition of the property, or the purpose that the property is or will be used for, does not break any laws

• no particularly troublesome or unusual restrictions apply to the property, that the property is not affected by problems which would be revealed by the usual legal enquiries and that all necessary planning and Building Regulations permissions (including permission to make alterations) have been obtained and any works undertaken comply with such permissions; and

• the property has the right to use the mains services on normal terms, and that the sewers, mains services and roads giving access to the property have been ‘adopted’ (that is, they are under local-authority, not private, control).

Standard terms of engagement

1 The service – the surveyor provides the standard RICS HomeBuyer (Survey & Valuation) Service (‘the service’) described in the ‘Description of the RICS HomeBuyer (Survey & Valuation) Service’, unless you and the surveyor agree in writing before the inspection that the surveyor will provide extra services. Any extra service will require separate terms of engagement to be entered into with the surveyor. Examples of extra services include:

• costing of repairs; • schedules of works; • supervision of works; • re-inspection; • detailed specific issue reports; and • market valuation (after repairs).

2 The surveyor – the service is to be provided by an AssocRICS, MRICS or FRICS member of the Royal Institution of Chartered Surveyors, who has the skills, knowledge and experience to survey, value and report on the property and is a member of the RICS Valuer Registration Scheme.

3 Before the inspection – you tell the surveyor if there is already an agreed or proposed price for the property, and if you have any particular concerns (such as plans for extension) about the property.

4 Terms of payment – you agree to pay the surveyor’s fees and any other charges agreed in writing.

5 Before the inspection – nothing in this clause 5 shall operate to exclude, limit or otherwise affect your rights to cancel under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 or the Consumer Rights Act 2015, or under any such other legislation as may from time to time be applicable. Entirely without prejudice to any other rights that you may have under any applicable legislation, you are entitled to cancel this contract in writing by giving notice to the surveyor’s office at any time before the day of the inspection, and in any event within fourteen days of entering into this contract. Please note that where you have specifically requested that the surveyor provides services to you within fourteen days of entering into the contract, you will be responsible for fees and charges incurred by the surveyor up until the date of cancellation.

6 Liability – the report is provided for your use, and the surveyor cannot accept responsibility if it is used, or relied upon, by anyone else.

Complaints handling procedure

The surveyor will have a complaints handling procedure and will give you a copy if you ask. The surveyor is required to provide you with contact details, in writing, for their complaints department or the person responsible for dealing with client complaints. Where the surveyor is party to a redress scheme, those details should also be provided. If any of this information is not provided, please notify the surveyor and ask that it be supplied.

Note: These terms form part of the contract between you and the surveyor.
