The 246th Meeting of the Eastern Regional Committee (ERC), National Council for Teacher Education

(NCTE) was convened on 23rd

– 24th November, 2017 at Conference Hall, ERC, NCTE, 15, Neelakantha Nagar,

Nayapalli, Bhubaneswar. The Chairperson, Members and Convener as listed below were present at the time of the

246th ERC Meeting.

At the outset, the Regional Director welcomed all the members of Committee and apprised them about

the provisions of the NCTE Act, Rules, Regulations and Guidelines issued from time to time. With the permission

of Chairperson, Shri Pradeep Kumar Yadav (Convener) presented the Agenda before the Committee for its due

consideration and appropriate decision.

The Proceedings of 244th

& 245th

meeting are hereby confirmed with the following amendment / review :-

(1) The decision in respect of Balurghat B.Ed. College, Plot No.-98, 276 & 517 (P), Vill.-Mongalpur, PO.-

Balurghat, Tehsil/Taluka-Mongalpur, Town/city-Balurghat, Dist.- Dakshin Dinajpur,West Bengal-

733101. (B.Ed.-Addl. Intake) (Private) (ERCAPP1390) in the 244th

meeting is as under:

“The institution was granted recognition for conducting B.Ed. course with 100 intake vide order dated 31.07.2006 from the academic session 2006-2007. Subsequently, permission order dated

08.10.2013 issued enhancing the intake from 100 to 200 from the academic session 2014-2015.

The ERC in its 242nd

meeting held on 15th

-16th July, 2017 considered the representation dated

23.05.2017 of the institution requesting for exclusion of land in plot No. 98 & 276 from the land schedule of Balurghat B.Ed. College and accordingly, letter dated 02.08.2017 was issued to the

institution seeking clarification regarding submission of Resolution of Managing Committee for exclusion of land and NOC from Govt. of West Bengal for removal of remaining unused land of the

leased land. In response, the institution vide its letter dated 24.07.2017 through e-mail submitted

some documents.

The Committee considered the reply and observed as under:

(i) Out of 9186.36 Sq. Mts. (2.27 Acre) land, the institution is required atleast 4500 Sq. Mts. land

demarcated for the teacher education programme and the rest area of land is to be free to use

as other educational purpose.

(ii) The institution is required to submit a photograph/videograph as a proof for demarcation of recognised teacher education institution.

In view of the above, the Committee decided as under: A letter be issued to the institution to submit its reply within 21 days”.

The above decision of ERC is rectified and may be read as under:

The institution submitted three plots of land i.e. 517(p) corresponding RS-67, 98 and 276 measuring

2.27 Acre, 2.39 Acre and 1.40 acre for conducting B.Ed., M.Ed. and D.El.Ed. programme. As per request of the institution on the basis of the resolution submitted by the Managing Committee and letter dated

19.07.2017 issued by the Office of the District Land and Land Reforms Officer & ADM, Dakshin Dinajpur,

Balurghat, Govt. of West Bengal and described as Plot No. 517(p) corresponding RS-67 measuring

2.27 acre is being earmarked for the aforesaid Teacher Education programmes and the other two plots 97

and 276 are being excluded and free from the land and building accommodated to run existing recognised

teacher training programmes by the institution. The management of the institution may use excluded two

plots of land according to their need.

In view of the above, the Committee decided as under:

A letter be issued to the institution accordingly.

(2) The decision in respect of Rajendra Academy for Teachers Education, Plot No.1952 & 1949, St.

No./Vill- Gopalpur, Tehsil/Taluka - Gopalpur, PO. - Bidhannagar, Town/City - Durgapur, Dist -

Bardhaman, West Bengal - 713212. (D.El.Ed.-Addl. Intake) (Private) (West Bengal Board of Primary

Education) (ERCAPP3045) in the 245th

meeting is as under:

“The institution was granted permission for conducting D.El.Ed. course with an additional intake 50

(existing 50 intake + additional 50 intake), thus making the total intake of 100 (one hundred fifty) vide Order dated 30.04.2017 from the academic session 2017-2018 as decided in 239

th ERC Meeting.

That the institution filed W.P. (C) No 8885 of 2017 in the Hon’ble High Court of Delhi at New Delhi.

The Hon’ble High Court disposed of the matter on 10.10.2017 with a direction inter alia:

“Learned Counsel for the petitioner points out that in similar matters directions have been given to

respondent to consider the application of the petitioner qua the second unit independently and the present petition has been directed to be treated as representation. Noting the aforenoted orders

passed by the Co-ordinate Benches of this court (reference has been made to the order dated

30.05.2016 in W.P. (C) No. 5017/2016; (Sant Tapasvi Narayan Das Foundation And Anr vs. National Council for Teacher Education and Anr.) where a similar order was passed; this court is

of the view that the present writ petition be directed to be treated as representation by respondent

No. 2 and be decided by way of a reasoned order within two months in accordance with law.”

The Committee considered the order dated 10.10.2017 of the Hon’ble High Court of Delhi and observed as under:

(i) The institution submitted list of 16 faculties and on scrutiny it was found that 8 faculties were appointed during 2010 to 2015 who were appointed faculities for the existing D.El.Ed.

programme and another eight faculties whose appointment was made in 2017 in different dates. It appears that the institution appointed only 8 teachers for the additional intake in

D.El.Ed. and which serves only 50 (one unit) additional intake not for 100 intake. Hence, the

decision of ERC taken in 239th

meeting granting permission for 50 additional intake in D.El.Ed. programme remain unchanged.

In view of the above, the Committee decided as under: A reasoned order be issued to the institution stating the above position”.

The above decision of ERC is rectified and may be read as under:

“The institution was granted permission for conducting D.El.Ed. course with an additional intake 50

(existing 50 intake + additional 50 intake), thus making the total intake of 100 (one hundred fifty) vide

Order dated 30.04.2017 from the academic session 2017-2018 as decided in 239th ERC Meeting.

That the institution filed W.P. (C) No. 8885 of 2017 in the Hon’ble High Court of Delhi at New Delhi.

The Hon’ble High Court disposed of the matter on 10.10.2017 with a direction inter alia:

“Learned Counsel for the petitioner points out that in similar facts, this Court has been passing orders wherein after the petitioner had been granted recognition for one unit, qua the second unit

this petition be treated as representation by respondent No. 2. This Court notes the earlier orders

passed by this Court. Accordingly, this writ petition be treated as a representation and the application of the petitioner qua the second unit be considered independently. The same shall be

disposed of by respondent No.2 within a period of two months in accordance with law.”


Letter of Intent u/c 7(13) of NCTE Regulation 2014 be issued to the institution for second unit in

addition to existing 100 intake previously granted for D.El.Ed. course.

ATTENTION!

1. The Committee unanimously decided that the institution may reply in response

to the decision of the Committee uploaded on the ERC website without waiting

for formal letters from the office of ERC. The replies so received will also be

considered by the committee.

2. The Endowment Fund / Reserve Fund (5 Lakhs + 7 Lakhs) is 12 Lakhs per

programme. (See ERC website: www.ercncte.org for detail).

3. The institution needs to submit list of 10 schools for internship and school based

activities duly approved by District Education Officer.

4. Institutions must give the affidavit for consent / willingness for number of units

either one or two if it was not submitted earlier.

5. As per provisions u/s 17(4) of the NCTE Act, 1993, if an institution offers any

course or training in Teacher Education without obtaining recognition or permission

under this Act, the qualification in teacher education obtained pursuant to such

course or training or after undertaking a course or training in such institution, shall

not be treated as a valid qualification for purposes of employment under the Central

Government, any State Government or University, or in any school, college or other

educational body aided by the Central Government or any State Government.

6. The Committee suggested to prepare Data Bank for the teachers.

7. The institution needs to install Fire Safety equipment and submit

the Fire Safety Certificate if not submitted earlier.

ER-246.2 Court Case

1. 246.2.1 Jharkhand Teachers Training College, Plot no - 3515, Street No - Ne 6 Old 1, Vill -

Telaiya Basti, PO - Jhumri Telaiya, Tehsil/Taluka - Koderma, Town/City - Koderma, Dist

- Koderma, Jharkhand - 825409 (D.El.Ed.-Addl.Course) (Jharkhand Academic Council)

(ERCAPP3602)

The recognition to D.El.Ed. course was refused vide ERC order No. 45532 dated 14.04.2016 on the ground that

NOC issued from affiliating/examining body not submitted. The institution preferred an appeal to the NCTE

HQs. against the refusal order of ERC and the Appellate Authority vide Order No. 89-335/2016 Appeal/11th

Meeting-2016 dated 02.09.2016 rejected the appeal and confirmed the order of ERC.

That the institution preferred W.P.(C) No. 11917 of 2016 in the Hon’ble High Court of Delhi. The Hon’ble High

Court disposed of the matter on 16.08.2017 with a direction inter alia:

“Learned Counsel for respondent has instructions to state that appeal filed against the aforenoted judgment

of Rambha College (Supra) has been dismissed by the Division Bench on 09.08.2017. She submits that the case of the petitioner shall be examined in accordance with rules of respondent nos.1 and 2 for the next

academic year i.e. 2018-2019 within an outer limit of four weeks and the same shall be conveyed to him.

This satisfies the case of the petitioner”.

On the basis of direction of Hon’ble Court, the Committee observed as under:

(i) The institution is required to submit fresh No Objection Certificate (NOC) issued from the concerned

affiliating body.

In view the above, the Committee decided as under: Show Cause Notice be issued to the institution as to why the application applied for recognition be not refused

on the above points. The Committee therefore, provides last opportunity under section 15(3)(b) of the NCTE Act

1993 to the institution to submit its reply within 21 days from the issue of this letter before the Committee takes

final decision.

ER-246.5 VTR U/S 14/15

2. 246.5.1 Chandrakanta Hazarika College, Milan Nagar, ‘I’ Lane, PO.- C.R. Building, Dist-

Dibrugarh, Assam-786003 (B.Ed.) (Private) (Dibrugarh University)(APE00388)

The institution was granted recognition to B.Ed. course vide order dated 13.03.2001 with an intake of 60 from

the academic session 2001-2002 by ERC, NCTE. Recognition to B.Ed. course was withdrawn under section

17(1) from the academic session 2011-2012 vide order dated 18.11.2010 and the appeal preferred by the

institution against the withdrawal order was confirmed by the Appeallate Authority vide order dt. 26.04.2011.

The ERC in its 242nd

meeting considered the Order dated 02.06.2017 in W.P.(C) No. 2698 of 2011 filed by the

institution in the Hon’ble Gauhati High Court and decided that re-inspection be conducted on payment of

Rs. 1,50,000/- by the institution. On payment of requisite fee, inspection of the institution has been conducted

u/s 14 on 4th -5

th September, 2017 and the VT report considered by ERC.


Letter of Intent under clause 7(13) of NCTE Regulation 2014 be issued to the institution.

The institution be asked to submit the FDRs of Rs.5.00 and Rs. 7.00 lakh towards endowment fund and reserve

fund in the joint name of RD, ERC, NCTE and institution with the reply of letter of intent.

3. 246.5.2 Rambha College of Education, Plot No - 464, 466, 467, 468, 526, 554, etc., Street No -

SH-6, Vill/PO - Gitilata, Tehsil/Taluka -Dhalbhumgarh, Town/City - Jamshedpur, Dist-

Purba Singhbhum, Jharkhand - 832107 (B.Ed.) (Private) (Kolhan University)

(ERCAPP3085)

After considering and examining the application along with the documents submitted by the institution, the

agenda note, the NCTE Act., the NCTE Regulations 2014 including Norms and Standards, guidelines received

from the NCTE Hqrs. from time to time and VTR, the Committee discussed the matter in detail and decided as

under:

(i) As the show cause notice has been decided for D.El.Ed. application (ERCAPP3090) of the said

institution, hence the application for B.Ed. course be kept in abeyance .

ER-246.4 Appeal Case

4. 246.4.1 Rambha College of Education, Plot No - 464,466,467,468, etc., Street No - SH-6,

Vill/PO - Gitilata, Tehsil/Taluka-Dhalbhumgarh, Town/City - Near Jamshedpur, Dist-

Purba Singhbhum,Jharkhand - 832107(D.El.Ed.)(Private)(Jharkhand Academic Council)

(ERCAPP3090)

As per decision of 197th ERC Meeting, recognition to D.El.Ed. Course was summarily rejected vide ERC order

dated 16.11.2015. The institution preferred an appeal against the rejected order of ERC and the Appellate

Authority vide Order No. 89-234/2015 Appeal/14th Meeting-2017 dated 15.09.2017 remanded back the case to

ERC with a direction to consider the NOC dt. 08.01.2016 and take further action as per the NCTE Regulations,

2014. The appellant is directed to submit the original NOC issued by the Directorate of Primary Education,

Govt. of Jharkhand to the ERC within 15 days of issue of the orders on the appeal.

The ERC re-viewed the matter in accordance with the appeal order as well as letter dated 20.09.2017

from the institution with NOC from Directorate of Primary Education, Govt. of Jharkhand and observed

as under:-

(i) The institution is required to submit the original NOC dated 08.01.2016 issued by the Directorate of

Primary Education, Govt. of Jharkhand, instead it has submitted the NOC vide letter No. 17/A-2-

39/2015/34 dated 08.01.2015 issued by Directorate of Primary Education, Deptt. of School Education &

Literacy, Govt. of Jharkhand which is contradictory.

In view the above, the committee decided as under:

Show Cause Notice be issued to the institution as to why the application applied for recognition be not refused

As per decision of 236th ERC Meeting, permission to B.Ed.(Addl. Intake) Course was refused vide ERC order

dated 12.04.2017. The institution preferred an appeal against the refusal order of ERC and the Appellate

Authority vide Order No. 89-398/E-4812/2017 Appeal/15th

Meeting-2017 dated 16.10.2017 remanded back the

case to ERC with a direction to consider the documents related to the construction of building to be submitted by

the appellant to them and take further action after conducting re-inspection of the institution on payment of the

prescribed fee by the appellant, as per the NCTE Regulations, 2014. The appellant is directed to forward to the

ERC, the documents submitted in appeal, within 15 days of receipt of the orders on the appeal.

The ERC re-viewed the matter in accordance with the appeal order and decided as under:-

Re-inspection of the institution be conducted on payment of fee of Rs. 1,50,000/-.

11. 246.4.3

Gayatri Devi Institute of Education, Plot No. - 427, Vill - Radhanagar, P/o - Gopinagar,

Tehsil/Taluka - Dhaniakhali, Town/City - Dhaniakhali, Dist - Hooghly, West Bengal -

712402 (D.El.Ed.) (Private)(West Bengal Board of Primary Education) (ERCAPP2946)

As per decision of 220th ERC Meeting, recognition to D.El.Ed. Course was refused vide ERC order dated

26.08.2016. The institution preferred an appeal against the refusal order of ERC and the Appellate Authority

vide Order No. 89-158/2017 Appeal/9th Meeting-2017 dated 21.06.2017 remanded back the case to ERC with a

direction to conduct another inspection of the institution on payment of inspection fee by the appellant so as to

obtain a correct picture of the building of appellant institutions as well as the building of Beta College of

Education which is anticipated to located in near vicinity as architect and manson of the building are stated to be

same ERC should provide to the inspection team the correct and complete address of Beta College of Education

also and VT should be instructed to compare at least the elevation of both the building if these are found to be

separate.



Further, as directed by the Appeal Committee, constituted VT members be instructed to obtain a correct picture

of the building of appellant institutions as well as the building of Beta College of Education which is anticipated

to located in near vicinity as architect and manson of the building are stated to be same. The correct and

complete address of another institution viz. Beta College of Education be provided to the inspection team with

instruction to compare atleast the elevation of both the building if these are found to be separate.
