Z-R-98-03 RESOLUTION APPROVING ZONING PETITION DOA97-12(A) CLASS B CONDITIONAL USE PETITION OF PBC AIRPORTS BY ROBERT BENTZ, AGENT (PBIA GOLF COURSE) WHEREAS, the Palm Beach County Zoning Commission, pursuant to Article 5 (Development Review Procedures) of the Palm Beach County Unified Land Development Code (Ordinance 92-20) is authdrized and empowered to consider, approve, approve with conditions or deny Class B Conditional Uses; and WHEREAS, the notice and hearing requirements, as provided for in Article 5 of the Palm Beach County Unified Land Development Code, have been satisfied; and WHEREAS, Zoning Petition DOA97-12(A) was presented to the Zoning Commission at a public hearing conducted on July 2, 1998; and WHEREAS, the Zoning Commission considered the evidence and testimony presented by the petitioner and other interested partie’s, and the recommendations of the various county review agencies; and WHEREAS, this approval is subject to Article 5, section 5.8 (Compliance with Time Limitations), of the Palm Beach County Unified Land Development Code and other provisions requiring that development commence in a timely manner; and WHEREAS, the Zoning Commission made the following findings of fact: 1. 2. 3. 4. 5. 6. 7. RESOLUTION APPROVING ZONING PETITION DOA97-12(A)CLASS B CONDITIONAL USEPETITION OF PBC AIRPORTSBY ROBERT BENTZ, AGENT

WHEREAS, the Palm Beach County Zoning Commission, pursuant to Article 5(Development Review Procedures) of the Palm Beach County Unified Land DevelopmentCode (Ordinance 92-20) is authdrized and empowered to consider, approve, approve withconditions or deny Class B Conditional Uses; and

WHEREAS, the notice and hearing requirements, as provided for in Article 5 of thePalm Beach County Unified Land Development Code, have been satisfied; and

WHEREAS, Zoning Petition DOA97-12(A) was presented to the Zoning Commissionat a public hearing conducted on July 2, 1998; and

WHEREAS, the Zoning Commission considered the evidence and testimonypresented by the petitioner and other interested partie’s, and the recommendations of thevarious county review agencies; and

WHEREAS, this approval is subject to Article 5, section 5.8 (Compliance with TimeLimitations), of the Palm Beach County Unified Land Development Code and otherprovisions requiring that development commence in a timely manner; and

9. This Class B Conditional Use, with conditions as adopted, minimizesenvironmental impacts, including but not limited to water, air, stormwatermanagement, wildlife, vegetation, wetlands and the natural functioning of theenvironment.

10. This Class B Conditional Use, with conditions as adopted, will result inlogical, timely and orderly development patterns.

11. This Class B Conditional Use, with conditions as adopted, is consistent withapplicable neighborhood plans.

WHEREAS, Article 5 of the Palm Beach County Unified Land Development Coderequires that the action of the Zoning Commission be adopted by resolution.

NOW, THEREFORE, BE IT RESOLVED BY THE ZONING COMMISSION OF PALMBEACH COUNTY, FLORIDA, that Zoning Petition DOA97-12(A), the petition of PBCAirports, by Robert Bentz, agent, for a Development Order Amendment (DOA) to addaccess point (service drive); relocation of building square footage; modify condition 0.2(landscaping) and delete E.4.b of (service drive) of Zoning Resolution ZR-97-01 in thePublic Ownership (PO) Zoning District, on a parcel of land legally described in EXHIBITA, attached hereto and made a part hereof, and generally located as shown on a vicinitysketch as indicated in EXHIBIT B, attached hereto and made a part hereof, was approvedon July 2, 1998, subject to the conditions of approval described in EXHIBIT C, attachedhereto and made a part hereof.

Commissioner Kaplan moved for the approval of the Resolution.

B. All required median landscaping, including an irrigation systemif required shall be installed at the property owners expense. Alllandscape material shall also be the perpetual maintenanceobligation of the petitioner and its successors, heirs orassignees or duly established Property Owner’s Associationand/or Homeowners’s Association. Perpetual maintenanceincludes, but is not limited to, pruning, fertilizing, irrigation, andalternate watering of Xeriscape material during periods ofdrought in order to maintain healthy plant material. Themaintenance responsibility of any existing trees within themedian shall also become the responsibility of this propertyowner. G. PROTECTION OF RESIDENTIAL AREAS
