Ivy Tech Community College of Indiana Ivy Tech Community College of Indiana (Ivy Tech) is the state's largest public postsecondary institution and the nation's largest singly accredited statewide community college system serving nearly 160,000 students annually with approximately 3,500 full-time staff and faculty.

Access to Public Records As a public institution in the in the State of Indiana, Ivy Tech Community College must comply with Access to Public Records laws. Information submitted in response to this RFP may be considered public record and subject to disclosure. Should a public records request be made regarding the information submitted in response to this RFP, Ivy Tech will analyze the request and respond according to the requirements of the law.

Proposal Submission This Request for Proposal (RFP) represents the requirements for an open and competitive process. Proposals submitted in response to this RFP are due no later than 3:00 pm Friday, May 8. Any proposals received after this date and time will not be considered. A legally authorized representative of the Respondent must sign the proposal. Unsigned proposals will not be considered.

Each Respondent must submit via Bonfire (Ivy Tech’s RFP online submission system) one PDF copy of the complete proposal AND must respond to all questionnaires required in the Bonfire Tool. Final submission is complete when all the required steps outlined in Bonfire have been completed. Don’t hesitate to contact Heather Vasquez to confirm the completeness of a final submission. RFP Opportunity Overview Ivy Tech Community College (ITCC) will be issuing reusable cloth masks to employees and students. ITCC wants to place an order for 125,000 reusable cloth masks with an option to buy an additional 25,000 reusable cloth masks. ITCC is seeking a single vendor to supply and distribute the reusable cloth masks. ITCC requires a minimum of 50,000 reusable cloth masks, to be delivered to all 18 of ITCC’s regional 18 campuses no later than June 5, 2020. The remaining 83,000 reusable cloth masks may be delivered at a later date, no later than August 1, 2020. See the campus distribution table to see how many reusable cloth masks are needed for each campus. Reusable Cloth Mask Required Specifications:

• Minimum Three-layer construction o Outer layer should be moister resistant/water repellent o Inner layer should be designed to wick moisture o Lining/middle layer should provide filtering benefit of exhaled air

• Home washable a minimum of 100 times • Tolerant of high temperature home washing • Designed to enclose the area around the nose and mouth, from the bridge of the nose to the chin

and extending onto the cheek beyond the corners of the mouth, so that no gaps occur when talking or moving

• Dark in color so as to not show stains or other discoloration easily • Preferred Color is Ivy Tech Green:

Preface your subject line with, Reusable Cloth Masks (RFP # SOFIN-20-002). Questions submitted after 3:00 pm Wednesday, May 6. will not be addressed. Responses to the questions will be available in the Bonfire system by 3:00 pm Thursday, May 7.

Except for cases authorized in writing by the designated employee, any communication by a Respondent with college staff other than the Proposal Contact, after this RFP is issued and through selection and notification of the contractor, may result in immediate rejection of that Respondent’s proposal.

If you are an incumbent vendor participating in this procurement, identify a separate point of contact for addressing ongoing service-related contact from the business development contact working on the proposal. While this procurement is underway, the point of contact for this business opportunity shall be separate from the team working on any current College projects or engagements.

Proposal Requirements To meet the College’s current and future needs, proposals submitted must demonstrate the organizational capacity to serve Ivy Tech’s business and service requirements. The Respondent must submit a complete proposal that describes how the organization would address Ivy Tech’s current needs; future state requirements; and respond to questions listed in the RFP and questionnaires.

In its proposal, each Respondent must describe its work plan for providing and distributing Reusable Cloth Masks. In its work plan, each Respondent must provide a detailed description of any and all deviations from the specifications included in the RFP. Proposals must detail the capacity and approach to provide the College with a seamless fulfillment of ITCC’s order of Reusable Cloth Masks.

Proposals must be uploaded to the Bonfire system. See Submission Instructions at the end of this document.

In addition to a written proposal, a complete RFP response will also require the Respondent to answer completely all the Bonfire questionnaires listed below. Each of these Proposal requirements must be completed and uploaded into the corresponding Bonfire questionnaire. Incomplete responses will not be evaluated for consideration. Primary Contact

Each Respondent must provide the name, address, telephone number, and e-mail address of the individual authorized to represent the Respondent from the time the Respondent’s proposal is delivered until the College and the Contractor have executed an Agreement. Signature Required An authorized representative of the firm must sign each Respondent’s proposal. Project Team Information

The proposal must include a list of the proposed project team members. The list shall include the title, role and responsibility for each team member. Provide biographical information for each team member, the role each individual will perform, and the individual’s qualifications for performing that role including any pertinent certifications obtained. For each individual, the respondent must include a list of projects for which the individual performed a similar role in providing goods or services within the last three years. Subcontractors

The Respondent is responsible for the performance of any obligations that may result from this response, and shall not be relieved by the non-performance of any subcontractor. If a Respondent intends to use another company or private individual as a subcontractor in providing the goods or services described in this RFP, the Respondent, in its proposal, must list each subcontractor, describe the

For each portion of the proposed products or services to be provided by a subcontractor, the technical proposal must include the identification of the functions to be provided by the subcontractor and the subcontractor’s related qualifications and experience. Either a copy of the executed subcontract or a letter of agreement over the official signature of the firms involved must accompany each proposal. The College reserves the right to approve or reject any proposed subcontractor or to reject any proposal based on the use of a proposed subcontractor. Vendor Expectations of Ivy Tech

The successful fulfillment of this order will require significant cooperation between the vendor and the College. Please describe in detail the expectations of the College to ensure a seamless fulfillment of this order proposed by the respondent. Proposed Schedule

Each Respondent must provide its proposed schedule for providing the goods or services described in this RFP. The proposed schedule must cover the time period from the date that the Agreement is signed until the date that the Contractor will complete its performance under the Agreement.

References and Related Experience

Each Respondent must provide a list of references consisting of at least three clients for whom the Respondent has provided products and/or services that are the same or similar to those products and/or services requested in this request including references for institutes of higher education. Information provided should include the name, address, and telephone number of the client facility and the name, title, and phone/fax numbers of a person who may be contacted for further information. Proposal Evaluation Criteria

The College will evaluate all proposals based on the following criteria. To ensure consideration for this Request for Proposal, your proposal should be complete and include all of the following criteria:

1) Overall proposal suitability: proposed solution(s) must meet the scope and needs included herein and be presented in a clear and organized manner

2) Organizational Experience: Respondents experience as it pertains to the scope of this project

3) Previous work: Respondents examples of their work as it pertains to the scope of this project as well as client testimonials and references

4) Value and cost: the cost of their solution(s) based on the work to be performed in accordance with the scope of this project

5) Technical expertise and plan: Technical solution, implementation and support plan in accordance with the scope of this project

A copy of the supplier diversity information form is available in the Bonfire tool entitled “Supplier Diversity Form.pdf.” The form must be signed even if it is not applicable to your company. MBE/ VBE/ WBE Participation Plan The MBE/VBE/WBE Participation Plan for products/services under this RFP must meet the following requirements:

1) Ivy Tech must be able to confirm certification of classification. 2) Each firm can serve as only one classification: MBE, VBE, or WBE. 3) Firm must provide goods or services specific to the contract. 4) Must serve a Commercially Useful Function (CUF). The firm must serve a value-added purpose on the

engagement as confirmed by Ivy Tech Community College. 5) Respondent shall not be required to utilize, or continue to utilize, any supplier, partner or joint venture

in the event such supplier, partner or joint venture is not adequately performing the services, or is no longer the low-cost bidder for their services.

Contractor’s Compensation

All proposals must include proposed costs to complete the tasks described in the project scope. Costs should be stated as one-time or non-recurring costs (NRC) or monthly recurring costs (MRC). All costs must be itemized to include an explanation of all fees and costs.

Respondents are encouraged to provide a cost narrative explaining pricing including any discounts. If the respondent must outsource or contract any work to meet the requirements contained herein, this must be clearly stated in the proposal. Additionally, all costs included in proposals must include any outsourced or contracted work and include a name and description of the organizations being contracted. Preliminary Information

Any information released either verbally or in writing prior to the issuance of this RFP is considered preliminary and is not binding upon the College in any manner. Submission Deadline-Withdraw, Rejection and Opening

Respondents may withdraw their proposals before the submission deadline. The College will reject any proposal received after the submission deadline. After the submission deadline, proposals will be opened and reviewed at the convenience of the College. There will be no public opening of the proposals. Irrevocability of Submitted Proposal

Each proposal constitutes an offer by the Respondent that remains open and irrevocable for 120 days. Proposal Costs

The College will not pay for any information requested under this RFP, nor is it liable for any costs incurred by the Respondent in responding to this RFP. If a Respondent is invited to come to the College to present its proposals, it will do so at its own expense.

Confidentiality of RFP Process

Each potential respondent is provided with the same information and is subject to the same requirements and deadline in order to provide the same opportunity to all. All who are involved, either directly or indirectly, must keep all aspects of the process and the proposals confidential. On the RFP due date, only the names of the Respondents will be available. Proposals are not available for review by anyone, other than the evaluation team, until after the award is made. Proposal Ownership

All proposals submitted become the property of the College; they will not be returned and are subject to the Indiana Access to Public Records Law (IC 5-14-3). The College reserves the right to use any concept presented in a proposal to obtain the most beneficial and effective path to achieving the College’s desired goals. The selection or rejection of a proposal does not affect the College’s rights under this section.

The College’s Office of Information Technology will utilize the standard Services Contract for this contractor engagement. Some of the terms and conditions may be negotiated, however most of the provisions are fixed for all College contracts. A sample of this contract can be found in the system entitled “Ivy Tech BASE Contract_v5.pdf.” Data Sharing Agreement

If any exchange or hosting of College data is anticipated with this engagement, a Data Sharing Agreement must be included at Contract execution. The data sharing agreement may be found in the Bonfire system entitled “Ivy Tech Data Sharing Agreement_v5.pdf.” Confidential Information

Contractor acknowledges that in the course of providing goods or services it may have access to personal and confidential information, including but not limited to names, addresses, social security numbers, personal data, and financial information. Contractor shall implement appropriate measures, including the establishment and maintenance of policies, procedures, and technical, physical, and administrative safeguards, that are designed to ensure the security and confidentiality of personal and confidential information, protect against reasonably foreseeable threats to the security and integrity of that information, and protect against unauthorized disclosure of, access to or use of that information. Contractor shall promptly notify College upon discovery of any possible loss, unauthorized disclosure, or unauthorized use of any personal or confidential information. With respect to its duties under this section, Contractor shall comply with all relevant laws and regulations, including but not limited to the Gramm-Leach-Bliley Act, the Family Educational Rights and Privacy Act, IC 4-1-10, IC 4-1-11, and the regulations promulgated under those federal and state statutes and indemnify the College for its costs incurred as a result of any unauthorized disclosure of, access to or use of personal or confidential information. Unacceptable Contract Terms

The College will not enter into any Agreement or execute any contract or affix its signature to any document from a Respondent whose terms require the College to waive all conditions or requirements provided for in this RFP, the College's purchase order, or any other Agreement negotiated by the College and the Contractor. The College may reject any proposal or other document that contains a clause or clauses that serve to supersede all other documents related to the goods or services to be provided by the Contractor under the Agreement. Non-Collusive Certificate

Each Respondent must include a completed non-collusion certificate with its proposal. A copy of the non-collusion certificate can be found in the Bonfire tool entitled “NonCollusiveCertificateForm.pdf.”

Non-Disclosure of Proprietary or Trade Secret Information

Respondents are prohibited from including proprietary or trade secret information in their proposal or any documentation provided to the College in response to this RFP. Information submitted in response to this RFP may be considered public record and subject to disclosure. Per Ind. Code 5-14-3-1: Any person may inspect and copy the public records of any public agency, except as provided in section 4 of the Access to Public Records Act (“APRA”). Ind. Code 5-14-3-3(a). Since it is the public policy of the APRA that it is to be construed liberally in favor of disclosure, exceptions to that general rule of disclosure are to be narrowly construed. IC 5-14-3-1. See Robinson v. Indiana University, 659 N.E.2d 153, 156 (Ind. Ct. App. 1995). Among the types of records that may not be disclosed by a public agency unless access to the records is specifically required by a state or federal statute or is ordered by a court under the rules of discovery, are records containing trade secrets. IC 5-14-3-4(a)(4). “Trade secret” for purposes of the APRA has the meaning set forth in Indiana Code 24-2-3-2, the Indiana Uniform Trade Secrets Act (“IUTSA”). IC 5-14-32(o). "Trade secret" means information, including a formula, pattern, compilation, program, device, method, technique, or process, that:

(1) derives independent economic value, actual or potential, from not being generally known to, and not being readily ascertainable by proper means by, other persons who can obtain economic value from its disclosure or use; and (2) is the subject of efforts that are reasonable under the circumstances to maintain its secrecy.

The College reserves the right to: 1) Reject any or all proposals and, in particular, any proposals not containing complete data requested in this RFP; 2) Waive any irregularity in any proposal received; 3) Accept the proposal that appears to be in the best interests of the College and negotiate a contract with that Respondent using the proposal submitted as part of the basis for the contract; 4) Conduct discussions with any or all Respondents for the purpose of clarification of proposals; 5) Waive, or decline to waive, any insignificant defect in any proposal or proposal procedure; 6) Accept, reject, or negotiate the terms of any proposal, or any part of a proposal, for the purpose of obtaining the best and final offer from a Respondent; 7) Reissue the RFP; 8) Select the finalist or finalists based on the College's analysis and evaluation of proposals submitted; and 9) Request proposal presentations if the College determines further information would benefit the decision-making process.
