Preface
1. This document constitutes The All Saints Cathedral Nairobi Children & Teens Center
(CTC) for Proposals (RFP).
2. The RFP includes a Letter of Invitation, Instructions to Consultants, Terms of
Reference, and a Form of Contract. The Instruction to Consultants and the General
Conditions of Contract may not be modified under any circumstances. However, the
Data Sheet and the Special Conditions of Contract may be used to reflect country and
assignment conditions.

2. A Consortium led by an Architect will be selected using the Quality & Cost based selection
method, as per the procedures described in the RFP, in accordance with the policies of All Saints
Cathedral Nairobi.

demonstrate clearly your appreciation to our desire to develop CTC by suitable measure aids and
descriptions will also be expected to demonstrate clearly

Section 2. Instructions to Consultants
Definitions a) “Client” refers to the ‘All Saints Cathedral Nairobi’
b) “Consultant” means any entity or person that may provide or
provides the Services to the Client under the Contract.
c) “Contract” means the Contract signed by the Parties and all the
attached documents listed in its Clause 1, that is the General
Conditions (GC), the Special Conditions (SC), and the
Appendices.
d) “Data Sheet” means such part of the Instructions to Consultants
used to reflect specific country and assignment conditions.
e) “Day” means calendar day.
f) “Government” means the government of the Client’s country.
g) “Instructions to Consultants” (Section 2 of the RFP) means the
document which provides short listed Consultants with all
information needed to prepare their Proposals.
h) “LOI” (Section 1 of the RFP) means the Letter of Invitation
being sent by All Saints Cathedral Nairobi to the short listed
Consultants.
i) “Personnel” means professionals and support staff provided by
the Consultant or by any Sub-Consultant and assigned to
perform the Services or any part thereof; “Foreign Personnel”
means such professionals and support staff who at the time of
being so provided had their domicile outside the Government’s
country; “Local Personnel” means such professionals and
support staff who at the time of being so provided had their
domicile inside the Government’s country.
j) “Proposal” means the Technical Proposal and the Financial
Proposal.
k) “RFP” means the Request For Proposal to be prepared by the
Client for the selection of Consultants, based on the SRFP.
l) “SRFP” means the Standard Request for Proposals, which must
be used by the Client as a guide for the preparation of the RFP.
m) “Services” means the work to be performed by the Consultant
pursuant to the Contract.

n) “Sub-Consultant” means any person or entity with whom the
Consultant subcontracts any part of the Services.
o) “Terms of Reference” (TOR) means the document included in
the RFP as Section 5 which explains the objectives, scope of
work, activities, tasks to be performed, respective
responsibilities of the Client and the Consultant, and expected
results and deliverables of the assignment.
1. Introduction 1.1
1.2 The shortlisted Consultants are invited to submit a Technical
Proposal and a Financial Proposal, as specified in the Data
Sheet, for consulting services required for the assignment
named in the Data Sheet. The Proposal will be the basis for
contract negotiations and ultimately for a signed Contract with
the selected Consultants.
1.3 Consultants should familiarize themselves with local
conditions and take them into account in preparing their
Proposals. To obtain first-hand information on the assignment
and local conditions, Consultants are encouraged to arrange
with the client for a visit to the site of the project in adequate
time before submitting the proposal. See Data Sheet.
Fraud and
Corruption
1.7 The Client requires that all consultants adhere to the highest
ethical standards, both during the selection process and
throughout the execution of a contract. In pursuance of this
policy, Clients limited:
(a) defines, for the purpose of this paragraph, the terms set
forth below as follows:
(i) “corrupt practice” means the offering, giving,
receiving, or soliciting, directly or indirectly,
of anything of value to influence the action of
the Client or any of the clients officials in the
selection process or in contract execution;
(ii) “fraudulent practice” means a
misrepresentation or omission of facts in order
to influence a selection process or the
execution of a contract;
(iii) “collusive practices” means a scheme or
arrangement between two or more consultants
with or without the knowledge of the Client or
the client, designed to establish prices at

artificial, noncompetitive levels;
(iv) “Coercive practices” means harming or
threatening to harm, directly or indirectly,
persons or their property to influence their
participation in a procurement process, or
affect the execution of a contract.
(b) will reject a proposal for award if it determines that the
Consultant recommended for award has, directly or
through an agent, engaged in corrupt, fraudulent,
collusive or coercive practices in competing for the
contract in question;
Proposal
Validity
1.8 The Data Sheet indicates how long Consultants’ Proposals
must remain valid after the submission date. During this
period, Consultants shall maintain the availability of
Professional staff nominated in the Proposal. The Client will
make their best effort to complete negotiations within this
period. Should the need arise, however, the Client may
request Consultants to extend the validity period of their
proposals. Consultants who agree to such extension shall
confirm that they maintain the availability of the Professional
staff nominated in the Proposal, or in their confirmation of
extension of validity of the Proposal, Consultants could
submit new staff in replacement, which would be considered
in the final evaluation for contract award. Consultants who do
not agree have the right to refuse to extend the validity of their
Proposals.
Eligibility of
Sub-Consultants
1.9 In case a short listed Consultant intends to associate with
Consultants who have not been short listed and/or individual
expert(s), such other Consultants and/or individual expert(s)
shall be subject to the eligibility criteria set forth in the
Guidelines.
2. Clarification
and
Amendment of
RFP Documents
2.1 Consultants may request a clarification of any of the RFP
documents up to the number of days indicated in the Data
Sheet before the proposal submission date. Any request for
clarification must be sent in writing, or by standard electronic
means to the Client’s address indicated in the Data Sheet. The
Client will respond in writing, or by standard electronic means
and will send written copies of the response (including an
explanation of the query but without identifying the source of
inquiry) to all Consultants. Should the Client deem it
necessary to amend the RFP as a result of a clarification, it
shall do so following the procedure under para. 2.2.

2.2 At any time before the submission of Proposals, the Client
may amend the RFP by issuing an addendum in writing or by
standard electronic means. The addendum shall be sent to all
Consultants and will be binding on them. Consultants shall
acknowledge receipt of all amendments. To give Consultants
reasonable time in which to take an amendment into account
in their Proposals the Client may, if the amendment is
substantial, extend the deadline for the submission of
Proposals.
3. Preparation of
Proposals
3.1 The Proposal (see para. 1.2), as well as all related
correspondence exchanged by the Consultants and the Client,
shall be written in the language (s) specified in the Data
Sheet.
3.2 In preparing their Proposal, Consultants are expected to
examine in detail the documents comprising the RFP.
Material deficiencies in providing the information requested
may result in rejection of a Proposal.
3.3 While preparing the Technical Proposal, Consultants must
give particular attention to the following:
Language (a) Documents to be issued by the Consultants as part of
this assignment must be in the language(s) specified in
the Reference Paragraph 3.1 of the Data Sheet.. It is
desirable that the firm’s Personnel have a working
knowledge of the Client’s national language.

Format and
Content
3.4 Depending on the nature of the assignment, Consultants are
required to submit a Technical Proposal (TP). The Technical
Proposal shall provide the information indicated in the
following paras from (i) to (vii) using the attached Standard
Forms (Section 3).
(i) A brief description of the Consultants’ organization
and an outline of recent experience of the
Consultants. For each assignment, the outline
should indicate the names of Sub-Consultants/
Professional staff who participated, duration of the
assignment, contract amount, and Consultant’s
involvement. Information should be provided only
for those assignments for which the Consultant was
legally contracted by the client as a corporation or as
one of the major firms within a joint venture.
Assignments completed by individual Professional
staff working privately or through other consulting
firms cannot be claimed as the experience of the

Consultant, or that of the Consultant’s associates,
but can be claimed by the Professional staff
themselves in their CVs. Consultants should be
prepared to substantiate the claimed experience if so
requested by the Client.
(ii) Comments and suggestions on the Terms of Reference
including workable suggestions that could improve the
quality/ effectiveness of the assignment; and on
requirements for counterpart staff and facilities
including: administrative support, office space, local
transportation, equipment, data, etc. to be provided by
the Client (Form TECH-3 of Section 3).
(iii) A description of the approach, methodology and work
plan for performing the assignment covering the
following subjects: technical approach and
methodology, work plan, and organization and staffing
schedule. Guidance on the content of this section of
the Technical Proposals is provided under Form
TECH-4 of Section 3. The work plan should be
consistent with the Work Schedule (Form TECH-8 of
Section 3) which will show in the form of a bar chart
the timing proposed for each activity.
(iv) The list of the proposed Professional staff team of
each firm in the consortium by area of expertise, the
position that would be assigned to each staff team
member, and their tasks (Form TECH-5 of Section 3).
(v) Estimates of the staff input needed to carry out the
assignment (Form TECH-7 of Section 3). The staff-
months input should be indicated separately for office
and field activities.
(vi) CVs of the Professional staff signed by the staff
themselves or by the authorized representative of the
Professional Staff (Form TECH-6 of Section 3).
3.5 The Technical Proposal shall not include any financial
information. A Technical Proposal containing financial
information may be declared non responsive.
Financial
Proposals
3.6 The Financial Proposal shall be prepared using the attached
Standard Forms (Section 4). It shall list all costs associated
with the assignment. If appropriate, these costs should be
broken down by activity. All activities and items described in
the Technical Proposal must be priced separately; activities

and items described in the Technical Proposal but not priced,
shall be assumed to be included in the prices of other
activities or items.
Taxes 3.7 The Financial Proposal should clearly identify as a separate
amount, the local taxes, duties, fees, levies and other charges
imposed under the law on the consultants. A PIN and VAT
registration Certificate must be attached.
4. Submission,
Receipt, and
Opening of
Proposals
4.1 The original proposal (Technical Proposal and Financial
Proposal; see para. 1.2) shall contain no interlineations or
overwriting, except as necessary to correct errors made by the
Consultants themselves. The person who signed the proposal
must initial such corrections.
4.2 The signed Technical and Financial Proposals shall be marked
“ORIGINAL”.
4.3 The Technical Proposal shall be marked “ORIGINAL” or
“COPY” as appropriate. The Technical Proposals shall be sent
to the addresses referred to in para. 4.5 and in the number of
copies indicated in the Data Sheet. All required copies of the
Technical Proposal are to be made from the original. If there
are discrepancies between the original and the copies of the
Technical Proposal, the original governs.
4.4 The original and all copies of the Technical Proposal shall be
placed in a sealed envelope clearly marked “TECHNICAL
PROPOSAL” Similarly, the original Financial Proposal shall be
placed in a sealed envelope clearly marked “FINANCIAL
PROPOSAL” followed by the name of the assignment, and with
a warning “DO NOT OPEN WITH THE TECHNICAL
PROPOSAL.” The envelopes containing the Technical and
Financial Proposals shall be placed into an outer envelope and
sealed. This outer envelope shall bear the submission address,
reference number and clearly marked The Client shall not be
responsible for misplacement, losing or premature opening if
the outer envelope is not sealed and/or marked as stipulated.
This circumstance may be case for Proposal rejection. If the
Financial Proposal is not submitted in a separate sealed
envelope duly marked as indicated above, this will constitute
grounds for declaring the Proposal non-responsive.
4.5 The Proposals must be sent to the address/addresses indicated
in the Data Sheet and received by the Client no later than the
time and the date indicated in the Data Sheet, or any extension
to this date in accordance with para. 2.2. Any proposal
received by the Client after the deadline for submission shall

be returned unopened.
4.6 The Client and the Client shall open the Technical Proposal
immediately after the deadline for their submission. The
envelopes with the Financial Proposal shall remain sealed and
securely stored.
5. Proposal
Evaluation
5.1 From the time the Proposals are opened to the time the
Contract is awarded, the Consultants should not contact the
Client or the Client on any matter related to its Technical and
Financial Proposal. Any effort by Consultants to influence the
Client or the Client in the examination, evaluation, ranking of
Proposals, and recommendation for award of Contract may
result in the rejection of the Consultants’ Proposal.
Evaluation of
Technical
Proposals
5.2 The evaluation committee shall evaluate the Technical
Proposals on the basis of their responsiveness to the Terms of
Reference, applying the evaluation criteria as specified in the
Data Sheet. Each responsive Proposal will be given a
technical score (St). A Proposal shall be rejected at this stage
if it does not respond to important aspects of the RFP, and
particularly the Terms of Reference or if it fails to achieve the
minimum technical score indicated in the Data Sheet.
Consortiums will also be expected to make powerpoint
presentations to the client on the date specified in the data
sheet. Technical scores will also be given for this
presentation.

Evaluation of
Financial
Proposals
5.3 In case of QCBS, the lowest evaluated Financial Proposal
(Fm) will be given the maximum financial score (Sf) of 100
points. The financial scores (Sf) of the other Financial
Proposals will be computed as indicated in the Data Sheet.
Proposals will be ranked according to their combined
technical (St) and financial (Sf) scores using the weights (T =
the weight given to the Technical Proposal; P = the weight
given to the Financial Proposal; T + P = 1) indicated in the
Data Sheet: S = St x T% + Sf x P%. The firm achieving the
highest combined technical and financial score will be invited
for negotiations.
5.4 In the case of Fixed-Budget Selection, the Client and Client
will select the firm that submitted the highest ranked
Technical Proposal within the budget. Proposals that exceed
the indicated budget will be rejected. In the case of the Least-
Cost Selection, the Client and Client will select the lowest
proposal among those that passed the minimum technical
score. In both cases the evaluated proposal price according to
para. 5.6 shall be considered, and the selected firm is invited
for negotiations.
6. Negotiations
6.1 The invited Consultant will, as a pre-requisite for attendance
at the negotiations, confirm availability of all Professional
staff. Failure in satisfying such requirements may result in the
Client and Client proceeding to negotiate with the next-ranked
Consultant. Representatives conducting negotiations on
behalf of the Consultant must have written authority to
negotiate and conclude a Contract.

negotiations
6.2 Negotiations will include a discussion of the Technical
Proposal, the proposed technical approach and methodology,
work plan, and organization and staffing, and any suggestions
made by the Consultant to improve the Terms of Reference.
The Client and the Consultants will finalize the Terms of
Reference, staffing schedule, work schedule, logistics, and
reporting. These documents will then be incorporated in the
Contract as “Description of Services”. Special attention will
be paid to clearly defining the inputs and facilities required
from the Client to ensure satisfactory implementation of the
assignment. The Client shall prepare minutes of negotiations
which will be signed by the Client, Client and the Consultant.
Financial
negotiations
6.3 The financial negotiations will include a clarification (if any)
of the firm’s tax liability in the Client’s country, and the
manner in which it will be reflected in the Contract; and will
reflect the agreed technical modifications in the cost of the

services.
Availability of
Professional
staff/experts
6.4 Having selected the Consultant on the basis of, among other
things, an evaluation of proposed Professional staff, the Client
expects to negotiate a Contract on the basis of the Professional
staff named in the Proposal. Before contract negotiations, the
Client will require assurances that the Professional staff will
be actually available. The Client will not consider
substitutions during contract negotiations unless both parties
agree that undue delay in the selection process makes such
substitution unavoidable or for reasons such as death or
medical incapacity. If this is not the case and if it is
established that Professional staff were offered in the proposal
without confirming their availability, the Consultant may be
disqualified. Any proposed substitute shall have equivalent or
better qualifications and experience than the original
candidate and be submitted by the Consultant within the
period of time specified in the letter of invitation to negotiate.
Conclusion of
the negotiations
6.5 Negotiations will conclude with a review of the draft
Contract. To complete negotiations the Client and the
Consultant will initial the agreed Contract. If negotiations fail,
the Client will invite the Consultant whose Proposal received
the second highest score to negotiate a Contract.
7. Award of
Contract
7.1 After completing negotiations the Client shall award the
Contract to the selected Consultant and promptly notify all
Consultants who have submitted proposals. After Contract
signature, the Client shall return the unopened Financial
Proposals to the unsuccessful Consultants.

8. Confidentiality 8.1 Information relating to evaluation of Proposals and
recommendations concerning awards shall not be disclosed to
the Consultants who submitted the Proposals or to other
persons not officially concerned with the process, until award
of Contract. The undue use by any Consultant of confidential
information related to the process may result in the rejection
of its Proposal and may result in the blacklisting of the
consultant by the Client for any future tenders.

that shall govern the contractual relations between the Client and the
winning Consultant. The Consultant shall not sign versions of the Contract
in different languages in addition to the language used in his proposal.

5.3
The formula for determining the financial scores is the following:

F the price of the proposal under consideration.
The weights given to the Technical and Financial Proposals are:

FORM TECH-4 DESCRIPTION OF APPROACH, METHODOLOGY AND WORK
PLAN FOR PERFORMING THE ASSIGNMENT
[Technical approach, methodology and work plan are key components of the Technical
Proposal. You are suggested to present your Technical Proposal (inclusive of charts and
diagrams) divided into the following three chapters:
a) Technical Approach and Methodology,
b) Work Plan, and
c) Organization and Staffing,
a) Technical Approach and Methodology. In this chapter you should explain your
understanding of the objectives of the assignment, approach to the services, methodology for
carrying out the activities and obtaining the expected output, and the degree of detail of such
output. You should highlight the problems being addressed and their importance, and explain
the technical approach you would adopt to address them. You should also explain the
methodologies you propose to adopt and highlight the compatibility of those methodologies
with the proposed approach.
b) Work Plan. In this chapter you should propose the main activities of the assignment,
their content and duration, phasing and interrelations, milestones (including interim

be consistent with the technical approach and methodology, showing understanding of the

ARCHITECT
Stage 1- APPRAISAL AND DEFINITION OF THE PROJECT (INCEPTION).
Receive, appraise and report on the client’s requirements with particular regard to site
information, planning and statutory requirements.
Advice the client on the need for the appointment of consultants and procedures meet
his requirements including methods of contracting and on any supplementary service
(clause 6) which may be required.
Confirm in writing the client’s instructions to proceed.
Stage 2- DESIGN CONCEPT (OUTLINE PROPOSALS).
Advised by any consultants appointed, prepare an Outline proposal showing space
provisions, planning relationships, standards of material intended to be used and
standards and suitability of services, insufficient detail to enable the design be
approved by the client.
Advise the client on the feasibility of the project as designed, the estimated cost,
budget, time schedule and statutory requirements and on supplementary services.
Confirm in writing the client’s instructions to proceed.
Stage 3- DESIGN DEVELOPMENT AND APPROVALS (SCHEME DESIGN)
Incorporate any changes on the design by the client
After approval of the design, develop is sufficiently to coordinate the work and
services of consultants and specialists who have been appointed.
Discuss the design with the statutory authorities concerned, and submit for their
approval.

Stage 4- DETAILED TECHNICAL DOCUMENTATION (DETAILED DESIGN)

otherwise agreed herein, where meetings exceed four hours a month, the excess ranks

Stage 5- PRODUCTION DRAWINGS.
Prepare working drawings, specifications and other technical documents necessary
for the execution of the project and preparation of Bills of Quantities.
Stage 6- CONTRACT ADMINISTRATION.
Assist the Client in calling for tenders and / or negotiate the building contract we
required.
Assist the Client in advising the client regarding the reward of the building contract
and the completion of contract documents.
Confirm in writing the client’s instructions to proceed.
Inspect the works. By means of site meetings and visits to ensure that the works are
completed in accordance with the specifications and drawings and to advise the
Client immediately of any non conformity to them. Inspecting the works will vary
according to the nature and stage of the construction and the architect should clarify
for the client the attention to be provided pursuant thereto, such to be stated in the
schedule hereto.
On completion of the project, provide the client with as-built drawings.
QUANTITY SURVEYOR The services to be provided by the Quantity Surveyor in the contract include, but are not limited to:
Preparation of an approximate estimate based on the outline design from the architect.
Advise on possible design economies and on financial implications of different finishes.
Provide cost advice as necessary for preparation of the final design.
Advise on form of contract.
Prepare bills of quantities.
Price the bills of quantities.
Prepare tender documents.
Obtain, check and report on tender.
Advise on contract.
Draw up contract documents.
Make periodic visits to site to survey work in progress, take particulars and prepare
valuation for interim payments to the contractor.
Advise on financial implications of proposed variations.
Prepare monthly financial appraisals to show financial status of the project so that the
client is aware of the anticipated final account.
Advise on contract problems if any.
Examine, evaluate and report on contractors claims if any.

Complete the measurement and pricing of the final account and agree the same with the
contractor.
Prepare valuation for final certificate.
Advise on any outstanding disputes with the contractor.
MECHANICAL & ELECTRICAL ENGINEER
The services to be provided by the Consulting Engineer at this stage shall comprise all or any
of the following as may be necessary in the particular case:-
a) Investigating data and information relating to the project and relevant to the works
which are reasonably accessible to the consulting Engineer, and considering any
reports relating to them works which have either been prepared by the Consulting
Engineer or else prepared by others and made available to the Consulting Engineer by
the client.
b) Advising the client on the need for arrangements to be made, in accordance with
clause 2, for the carrying out of special surveys, special investigations or model tests,
and advising the client of the results of any such surveys, investigations or tests
carried out.
c) Consulting any local or other or other authorities on matters of principal in
connection with the design of the works.
d) Consulting the architect or any other professional adviser appointed by the client in
connection to the project.
e) Providing sufficient Preliminary information and approximate estimates (based on
unit volume, unit surface area or similar bases of estimation) regarding the works to
enable the client or the architect to prepare architectural sketch plans and budget
estimates for the project.
Design Stage II
The services to be provided by the Consulting Engineer at this stage shall comprise all or any
of the following as may be necessary in the particular case:-
a) Preparing designs, tender drawings and specifications for the works in such detail
may be necessary to enable competitive tenders for the execution of the works to be
obtained.
b) Providing outline information as to plant rooms, chimneys, air conditioning and
ventilation ducts, main service ducts and other similar elements incorporated in the
building structure, and providing information as to the approximate weights of items
pf heavy plant and equipment which are incorporated in the works.
c) Advising on conditions of contract relevant to the works and forms of tender and
invitations to tender as they relate to the works.
d) Advising the client as to the suitability for carrying out the works of persons and
firms tendering, and further as to the relative merits of tenders, prices and estimates
received for carrying the works.

As soon as the Consulting Engineer shall have submitted advice to the client upon tenders,
his services at this stage shall be complete.
Installation Stage.
The Consulting Engineer shall not accept any tender in respect of the works unless the client
gives him the instructions in writing to do so, and any acceptance so made by the Consulting
Engineer on the instructions of the client shall be on behalf of the client. The services to be
provided by the Consulting Engineer at this stage shall include all or any of the following as
may be necessary in the particular case:-
a) Advising on the preparation of formal contract documents relating to accepted
tenders for carrying out the works or any part thereof.
b) Providing the contractor with such further information as is necessary in the opinion
of the consulting Engineer, to enable the installation drawings to be prepared.
c) Examining the contractor’s proposals.
d) Making such visits to site as the Consulting Engineer shall consider necessary to
satisfy himself as to the performance of any site staff appointed pursuant to and to
satisfy himself that the works are executed generally according to his designs and
specifications and otherwise in accordance with good engineering practice.
e) Giving all necessary instructions to the contractor provided that the consulting
Engineer shall not without the prior approval of the client give any instructions
which are in his opinion likely substantially to increase the cost of the works unless
it is not in the circumstances practicable for the Consulting Engineer to obtain such
prior approval.
f) Advising the client or the architect as to the need to vary any part of the project for a
reason or reasons relating to the works.
g) Approving the contractor’s commissioning procedures and performance tests, and
inspecting the works on completion.
h) Advising on interim valuations, issuing certificates for payment to the contractor
where appropriate and advising on settlement of the contractor’s final accounts.
i) Performing any services which the Consulting Engineer may be required to carry out
under any document which he has prepared relating to the works. The Consulting
Engineer may decline to perform any services specified in a contract the terms of
which have not initially been expressly approved by him in writing.
j) Delivering to the client on the completion of the works of copies of record drawings,
the contractor’s operating instructions, and, where appropriate, certificates of work
tests.
k) Assisting in settling any dispute difference which may arise between the client and
the contractor, provided that this service shall not extend to advising the client
following the taking of any step in or towards any arbitration or litigation in
connection with the works.
General
Without prejudice to the proceeding provisions of this clause, the Consulting Engineer shall
from time to time as may be necessary advise the client as to the need for the client to be
provided with additional services in accordance with clause 2.

2.0 ADDITIONAL SERVICES NOT INCLUDED IN NORMAL SERVICES.
As services additional to those specified in clause 1.0, the consulting Engineer shall, if so
requested by the client, provide any of the services specified in clause 2.1 below and provide
or take all reasonable steps to arrange for the provision by others of any of the services
specified in clause 2 .2
2.1
a) Preparing any report or additional contract documents required for consideration of
proposals for the carrying out of alternative works.
b) Carrying out works in connection with any application already made by the client any
order, sanction, license, permit or other consent, approval or authorization necessary
to enable the works to proceed.
c) Carrying out work arising from the failure of the client to award a contract in due
time.
d) Preparing preliminary estimates.
e) Preparing details for shop fabrication of ductwork, metal or plastic frameworks.
f) Checking and advising upon any part of the project not designed by the consulting
engineer.
g) Carrying out work consequent upon any assignment of a contract by the contractor or
upon the failure of the contractor properly to perform any contract or upon delay by
the client in fulfilling his obligations or in taking any other step necessary for the due
performance of the works.
h) Advising the client upon and carrying out work following the taking of any step or
towards any litigation or arbitration relating to the works.
i) Carrying out special cost investigations or detailed valuations, including estimates or
cost analysis based on measurement or forming an element of a cost planning service.
j) Negotiating and arranging for the provision or diversion of utility services.
k) Negotiating any contract or sub-contract with a contractor selected otherwise than by
competitive tendering, including checking and agreeing quantities and net costs of
materials added percentages to cover overheads and profit.
l) Preparing detail drawings, coordination drawings, builder’s work drawings, record
drawings or any detailed schedules.
2.2
a) Specialist technical advice on any abnormal aspects of the works. The services
provided by the Consulting Engineer under clause 1.1 will include the provision of all
expert technical advice and skills which are normally required for the class of work
for which the Consulting Engineer’s services are engaged.
b) Legal, financial and other professional services.
c) Services in connection with the valuation, purchase, sale or leasing of lands and
obtaining of way leaves.
d) Investigation of the nature and strength of existing works and the making of model
tests or special investigations.

2.3
The consulting Engineer shall obtain the prior agreement of the client to the arrangements
which he proposes to make on the client’s behalf for the provision of any of the services
specified in clause 2.2 .The client shall be responsible to any persons providing such services
for the cost thereof.
CIVIL & STRUCTURAL ENGINEER
The services to be performed by the consultant have been classified to suit the various types
of work. The details are as follows:-
Class I works.
Civil engineering and structural engineering services including geotechnical investigations
but excluding class 2 works.
Class II Works.
(Structural work in reinforced concrete, prestressed concrete steel and other metals).
Structural engineering services on projects where architect has been appointed by the client.
6.1 Class I Works.
6.1.1 Design Stage I
The services to be provided by the consulting engineer at this stage shall comprise all or any
of the following as may be necessary in the particular case:
a) Investigating data and information relevant to the works which are reasonably
accessible to the consulting Engineer, and considering any reports relating to the
works which have been previously prepared by the Consulting Engineer or else
prepared by others and made available to the consulting engineer by the client.
b) Making any normal topographical survey of the proposed site of the works
which may be necessary to supplement the topographical information already
available to the Consulting Engineer
c) Advising the client on the need to carry out any geotechnical investigations
which may be necessary to supplement the geotechnical information already
available to the Consulting Engineer, arranging for such investigations when
authorized by the client, certifying the amount of any payment to be made by
the client to the persons or firms carrying out such investigations under the
consulting Engineer’s direction, and advising the client on the results of such
investigations.
d) Advising the client on the need for arrangements to be made, in accordance with
clause 7, for the carrying out of special surveys, special investigations or model

tests, and advising the client of the results of any such surveys, investigations or
tests carried out.
e) Consulting any architect appointed by the client in connection with the
architectural treatment of the works.
f) Preparing such documents as are reasonably necessary to enable the client to
consider the Consulting Engineer’s general proposals for the construction of the
works in the light of the investigations carried out by him at this stage, and to
enable the client to apply for approval in principal of the execution of the works
in accordance with such proposals.
6.1.2 Design Stage II
The services to be provided by the Consulting Engineer at this stage shall comprise all or
any of the following as may be necessary in the particular case:-
a) Preparing designs and tender drawings in connection with the works.
b) Advising as to the appropriate conditions of contract to be incorporated in any
contract to be made between the client and the contractor. Preparation of tender
documents.
c) Preparing such specifications, schedules and bills of quantities as may be necessary to
enable the client to obtain tenders or otherwise award a contract for carrying out the
works.
d) Advising the client as to the suitability for carrying out the works of persons and
firms tendering and further as to the relative merits of tenders, prices and estimates
received for carrying out the works.
As soon as the Consulting Engineer shall have submitted advice to the client upon tenders,
his services at this stage shall be complete.
6.1.3 Construction Stage.
The Consulting Engineer shall not accept any tender in respect of the works unless the client
gives him instructions in writing to do so, and any acceptance so made by the Consulting
Engineer on the instructions of the client shall be on behalf of the client. The services to be
provided by the consulting Engineer at this stage shall include all or any of the following as
may be necessary in the particular case:-
a) Advising on the preparation of formal contract documents relating to accepted tenders
for carrying out the works or any thereof.
b) Inspecting and testing during manufacture and installation such electrical and
mechanical materials, machinery and plant supplied for incorporation in the works as
are usually inspected and tested by Consulting Engineers, arranging and witnessing
acceptance tests.
c) Advising the client on the need for special inspection or testing other than that
referred to in sub-clause (b).
d) Advising the client on the appointment of site staff in accordance with clause 10.

e) Preparing bar bending schedules and any further designs and drawings which may be
necessary.
f) Examining the contractor’s proposals.
g) Making such visits to site as the Consulting Engineer shall consider necessary to
satisfy himself as to the performance of any site staff appointed pursuant to clause 10
and to satisfy himself that the works are executed generally according to the contract
and otherwise in accordance with good engineering practice.
h) Giving all necessary instructions to the contractor, provided that the Consulting
Engineer shall not without the prior approval of the client give any instructions which
in the opinion of the consulting Engineer are likely substantially to increase the cost
of the works unless it is not in the circumstances practicable for the consulting
Engineer to obtain such prior approval.
i) Issuing certificates for payment to the contractor.
j) Performing any services which the Consulting Engineer may be required to carry out
under the any contract for the execution of the works, including where appropriate the
supervision of any specified tests and of the commissioning of the works, provided
the Consulting Engineer may decline to perform any services specified in a contract
the terms of which have not initially been approved by the Consulting Engineer.
k) Delivering to the client on the completion of the works such records and
manufacturer’s manuals as are reasonably necessary to enable the client to operate
and maintain the works.
l) Deciding any dispute or difference arising between the client and the contractor and
submitted to the Consulting Engineer for his decision, provided that this service shall
not extend to advising the client following the taking of any step in or towards any
arbitration or litigation in connection with the works.
6.1.4 General.
Without prejudice to the preceding provisions of this clause, the Consulting Engineer shall
from time to time as may be necessary advice the client as to the need for the client to be
provided with additional services in accordance with clause 7.
6.2 Class II Works.
6.2.1 Preliminary or Sketch Plan Stage.
The services to be provided by the Consulting Engineer at this stage shall comprise all or any
of the following as may be necessary in the particular case:
a) Investigating data and information relating to the project and relevant to the works
which are reasonably accessible to the Consulting Engineer, and considering any
reports relating to the works which have either been prepared by the Consulting
Engineer by the client.
b) Advising the client on the need to carry out any geotechnical investigations which
may be necessary to supplement the geotechnical information already available to the
consulting Engineer, arranging for such investigations when authorized by the client,

certifying the amount of any payments to be made by the client to the persons or
firms carrying out such investigations under the consulting Engineer’s directions, and
advising the client of the results of such investigations.
c) Advising the client on the need for arrangements to be made, in accordance with

d) Consulting any local or other authorities on matters of principle in connection with
the structural design of the works.
e) Providing sufficient structural information to enable the Architect to produce his
sketch plans.
6.2.2 Tender Stage.
The services to be provided by the consulting Engineer at this stage shall include all or any of
the following as may be necessary in the particular case, for the purpose of enabling tenders
to be obtained:-
a) Developing the design of the works in collaboration with the architect and preparing
calculations, drawings and specifications of the works to enable a bill of quantities to
be prepared.
b) Advising on conditions of contract relevant to the works and forms of tender and
invitations to tender as they relate to the works.
c) Consulting any local or other authorities in connection with the structural design of
the works, and preparing typical details and typical calculations.
d) Advising the client as to the suitability for carrying out the works of persons and
firms tendering.
6.2.3 Working Drawing Stage.
The services to be provided by the Consulting Engineer at this stage shall include all or any
of the following as may be necessary in the particular case:-
a) Advising the client as to the relative merits of tenders, prices and estimates received
for carrying out the works.
b) Preparing such calculations and details relating to the works as may be required for
submission to any appropriate authority.
c) Preparing any further designs, specifications and drawings, including bar bending
schedules, necessary for the information of the contractor to enable him to carry out
the works, but expecting the preparation of any shop details relating to the works or
any part thereof.
d) Checking shop details for accuracy, general dimensions and adequacy of members
and connections.
6.2.4 Construction Stage.
The Consulting Engineer shall not accept any tender in respect of the works unless the client
gives him instructions in writing to do so, and any acceptance so made by the Consulting

Engineer on the instructions of the client shall be on behalf of the client. The services to be
provided by the Consulting Engineer at this stage shall include all or any of the following as
may be necessary in the particular case:-
a) Advising on the preparation of formal contract documents relating to accepted tenders
for carrying out the works or any part thereof.
b) Advising the client on the need for special inspections or tests.
c) Advising the client and the architect on the appointment of site staff in accordance
with clause 10.
d) Examining the contractor’s proposals.
e) Making such visits to the site as the Consulting Engineer shall consider necessary to
satisfy himself as to the performance of any site staff appointed pursuant to clause 10
and to satisfy himself that the works are executed generally according to contract and
otherwise in accordance with good engineering practice.
f) Giving all necessary instructions to the contractor, provided that the Consulting
Engineer shall not without the prior approval of the client give any instructions
which in the opinion of the Consulting Engineer are likely substantially to increase
the cost of the works unless it is not in the circumstances practicable for the
Consulting Engineer to obtain such prior approval.
g) Advising on certificates for payment to the contractor.
h) Performing any services which the Consulting Engineer may be required to carry out
under any contract for the execution of the works, including where appropriate the
supervision of any specified tests, provided that the Consulting Engineer may decline
to perform any services specified in a contract the terms of which have not initially
been approved by the Consulting Engineer.
i) Delivering to the client on the completion of the works such records as are reasonably
necessary to enable the client to operate and maintain the works.
j) Assisting in settling any dispute or difference which may arise between the client and
the contractor, provided that this shall not extend to advising the client following the
taking of any step in or towards any arbitration or litigation in connection with the
works.
6.2.5 General.
Without prejudice to preceding provisions of this clause, the Consulting Engineer shall from
time to time as may be necessary advice the client as to the need for the client to be provided
with the additional services in accordance with clause 7.
7. ADDITIONAL SERVICES NOT INCLUDED IN NORMAL SERVICES.
7.1
As services additional to those specified in clause 6, the consulting Engineer shall, if so
requested by the client, provide any of the services specified in clause 7.2 and provide or take
all reasonable steps to arrange for the provision by others of any of the services specified in
clause 7.3

7.2
a) Preparing any report or additional contract documents required for consideration of
proposals for the carrying out of alternative works.
m) Carrying out work consequent upon a decision by the client to seek parliamentary
powers.
n) Carrying out works in connection with any application already made by the client any
order, sanction, license, permit or other consent, approval or authorization necessary
to enable the works to proceed.
o) Carrying out work arising from the failure of the client to award a contract in due
time.
p) Preparing preliminary estimates.
q) Preparing details for shop fabrication of ductwork, metal or plastic frameworks.
r) Checking and advising upon any part of the project not designed by the consulting
engineer.
s) Carrying out work consequent upon any assignment of a contract by the contractor or
upon the failure of the contractor properly to perform any contract or upon delay by
the client in fulfilling his obligations under clause 11 or in taking any other step
necessary for the due performance of the works.
t) Advising the client upon and carrying out work following the taking of any step or
towards any litigation or arbitration relating to the works.
u) Carrying out work in conjunction with the others employed to provide any of the
services specified in clause 7.3
v) Carrying out such other additional services, if any, as are specified in clause 7 of the
memorandum of agreement.
w) Carrying out special cost investigations or detailed valuations, including estimates or
cost analysis based on measurement or forming an element of a cost planning service.
x) Negotiating and arranging for the provision or diversion of utility services.
y) Negotiating any contract or sub-contract with a contractor selected otherwise than by
competitive tendering, including checking and agreeing quantities and net costs of
materials added percentages to cover overheads and profit.
z) Preparing detail drawings, coordination drawings, builder’s work drawings, record
drawings or any detailed schedules.
7.3
e) Specialist technical advice on any abnormal aspects of the works. The services
provided by the Consulting Engineer under clause 6 will include the provision of all
expert technical advice and skills which are normally required for the class of work
for which the Consulting Engineer’s services are engaged.
f) Legal, financial and other professional services.
g) Services in connection with the valuation, purchase, sale or leasing of lands and
obtaining of way leaves.
h) The surveying of sites or existing works in connection with class II works.

i) Investigation of the nature and strength of existing works and the making of model
tests or special investigations.
j) The carrying out of special inspections or tests advised by the Consulting Engineer
under clause 6.1.3(c) and 6.2.4 (b).
7.4
The consulting Engineer shall obtain the prior agreement of the client to the arrangements
which he proposes to make on the client’s behalf for the provision of any of the services
specified in clause 7.3 .The client shall be responsible to any persons providing such services
for the cost thereof.

a) The technical proposal shall carry 70 marks while the financial proposal shall carry 30 marks
